RESOLUTION
Ninth Session, Fifteenth National Assembly
OF THE NATIONAL ASSEMBLY
Pursuant to the Constitution of the Socialist Republic of Vietnam amended and supplemented by Resolution No. 203/2025/QH15;
Pursuant to the Law on Organization of the National Assembly No. 57/2014/QH13 amended and supplemented by Law No. 65/2020/QH14 and Law No. 62/2025/QH15;
Based on the results of the Ninth Session of the Fifteenth National Assembly from May 5, 2025 to May 29, 2025 and from June 11, 2025 to June 27, 2025;
At the proposal of the Standing Committee of the National Assembly and the opinions of the National Assembly deputies,
RESOLUTION:
1. The National Assembly has adopted the Resolution amending and supplementing certain articles of the Constitution of the Socialist Republic of Vietnam, amending the Law on the Organization of Local Administration, creating a full legal basis for the implementation of the policy of streamlining the organizational structure of the political system, building a two-level local government model that is streamlined, reducing intermediate levels, enhancing the effectiveness and efficiency of national and local governance, restructuring the entire spatial development of the country comprehensively. Simultaneously, the National Assembly and the Standing Committee of the National Assembly have issued according to their authority resolutions on the reorganization of provincial administrative units and commune-level administrative units to officially implement the two-level local government model from July 1, 2025.
These are major decisions with profound historical significance, directly affecting the entire political system, every citizen, and the whole society, especially the 696 district-level administrative units and provincial and commune-level administrative units across the country that will cease operations from July 1, 2025. This decision has received widespread support from the masses of people, National Assembly deputies, party committees at all levels, governments, civil servants, public officials, workers in the political system in the reorganized administrative units.
The National Assembly and voters nationwide recognize and highly appreciate the historical role and contributions of the party committees and governments of district-level administrative units throughout the country who have faithfully and persistently shouldered heavy responsibilities, excellently and completely fulfilled their glorious historical mission over the past 80 years, laying a solid foundation for the country to enter a new phase of development, transitioning to a two-level local government organization model. The National Assembly recognizes and commends the sense of responsibility of cadres, Party members, civil servants, public officials, and workers in the political system at district-level administrative units and provincial and commune-level administrative units, ministries, and agencies implementing the reorganization, who have united in supporting the major policy of the Party and State regarding the reorganization and streamlining of the organizational structure of the political system; respecting the sacrifices and contributions of collectives and individuals for the common goal and the common interests of the nation. It requests the Government, local governments at all levels, relevant agencies, and organizations to focus on reorganizing and stabilizing the organizational structure so that the two-level local government operates smoothly, effectively, and efficiently; having mechanisms and policies to care for, support, and motivate those affected by the reorganization and streamlining of the organizational structure.
2. The National Assembly has adopted 34 laws and 34 resolutions; given initial comments on six draft laws (attached list), including the decision to adjust the time for submitting the Draft Law Amending and Supplementing Certain Provisions of the Law on Planning to the Tenth Session of the Fifteenth National Assembly for continued review and comprehensive revision.
The Standing Committee of the National Assembly, the Government, the Supreme People's Court, the Supreme People's Procuracy, and related agencies are instructed to promptly implement the laws and resolutions adopted at the Ninth Session, ensuring close integration between lawmaking and law enforcement, timely, strict, consistent, effective, and efficient; studying, explaining, and incorporating the opinions of National Assembly deputies to perfect the draft laws that were commented on at the Ninth Session; promptly preparing the contents to be submitted to the National Assembly at the Tenth Session of the Fifteenth National Assembly to ensure quality and progress.
It requests the Government to strictly direct relevant ministries and sectors to build, issue, or submit to competent authorities for issuance detailed regulations and guidance on the implementation of laws and resolutions, ensuring that laws and resolutions are implemented immediately upon taking effect; continue to vigorously decentralize and delegate powers in administrative procedures; closely control the establishment of administrative procedures in legal normative documents. At the same time, prioritize the construction and improvement of institutional frameworks for national development in the new era, focusing on building and improving legal systems and mechanisms to effectively implement the four key resolutions of the Politburo: Resolution No. 57-NQ/TW dated December 22, 2024 on breakthroughs in national science and technology development, innovation, and digital transformation; Resolution No. 59-NQ/TW dated January 24, 2025 on international integration in the new situation; Resolution No. 66-NQ/TW dated April 30, 2025 on reforming legislative work and law enforcement to meet the requirements of national development in the new era; Resolution No. 68-NQ/TW dated May 4, 2025 on developing the private economy. Innovate thinking and direction in legislative work; make institutions and laws competitive advantages. Focus on building laws on science and technology, innovation, and digital transformation, providing legal frameworks for new issues, forming new growth drivers; quickly resolve bottlenecks caused by legal provisions to meet the requirements of rapid and sustainable national development in the new era. Enhance the effectiveness and breakthroughs in law enforcement work, ensuring that laws are implemented fairly, strictly, consistently, promptly, effectively, and efficiently.
3. Based on the Party's policy and practical requirements, the National Assembly has considered and decided to shorten the term of the Fifteenth National Assembly and the People's Councils at all levels for the 2021-2026 term. It proposes that the President, the Standing Committee of the National Assembly, the Government, the Supreme People's Court, the Supreme People's Procuracy, the State Audit Office, the National Ethnic Council, and the Committees of the National Assembly develop Work Reports for the term according to Plan No. 1255/KH-UBTVQH15 dated April 17, 2025 of the Standing Committee of the National Assembly, ensuring quality and progress to be submitted to the National Assembly for consideration at the final session of the Fifteenth National Assembly term.
At the same time, the National Assembly decided that the election day for the sixteenth session of the National Assembly deputies and the deputies of all levels of People's Councils for the term 2026-2031 would be on Sunday, March 15, 2026; established the National Election Council to implement the preparatory work for the election of the sixteenth session of the National Assembly deputies and the deputies of all levels of People's Councils for the term 2026-2031.
4. The National Assembly acknowledges and highly appreciates the guidance, management, and the vigorous implementation of tasks and solutions by the Government, the Prime Minister, Ministries, sectors, localities, business communities, and various social strata, which have basically completed the tasks of economic and social development and state budget for the year 2024 and the early months of 2025.
The National Assembly requests the Government to direct and coordinate with relevant agencies to continue closely monitoring developments, forecasting domestic and international situations, implementing synchronously, promptly, and comprehensively the goals, tasks, and solutions already proposed to address existing issues and strive to achieve the highest possible targets set out in the Plan for Economic and Social Development in 2025; focusing on effectively implementing the following tasks and solutions:
a) Accelerate digital transformation and complete the construction of the National Land Database connected to the National Data Center and related databases by the end of 2025; facilitate businesses' access to land; control fluctuations in land prices, particularly agricultural and non-agricultural production and business land prices; promote electronic transactions, transparency of information, and simplification and reduction of administrative procedures related to land;
b) Vigorously develop the domestic market, stimulate consumption, diversify distribution channels, strongly develop digital platforms and e-commerce; implement in substance and effectively the Campaign "Vietnamese Preferentially Use Vietnamese Goods"; upgrade and innovate the national trade promotion program; support enterprises in building and promoting their brands;
c) Resolve decisively long-standing projects causing waste of resources and hindering the development of businesses, clarify the responsibilities of relevant agencies; stop the delay in payment of contracts signed by state agencies and state-owned enterprises with private enterprises. Focus on resolving difficulties and obstacles in procedures, settling disputes, accelerating project progress, and utilizing effectively idle land resources;
d) Review and improve credit policies, including preferential commercial credit sources for businesses, especially small and medium-sized enterprises, supporting industries, innovative startups, to invest in new machinery, equipment, technology, green transition, digital transformation, and export credit, supply chain finance. Encourage lending based on data, cash flow, and value chains. Strengthen inspection, supervision, and strict control over internal lending activities;
đ) Urgently restructure the securities market, develop the insurance market; perfect regulations on corporate bonds to deepen the corporate bond market, attract medium- and long-term capital for economic development;
e) Continue to promote and enhance the effectiveness of signing and implementing international treaties and agreements, allocate corresponding resources to contribute to effectively implementing Resolution No. 59-NQ/TW dated January 24, 2025 of the Politburo;
g) Review the objectives and indicators of the National Strategy on Gender Equality for the period 2021-2030 to adjust them appropriately for the period 2026-2030; organize mid-term reviews to be completed in 2025; at the same time, study and soon submit to the National Assembly for amending the Law on Gender Equality;
5. Regarding thrift and anti-waste efforts,the National Assembly requires the Government to focus on institutionalizing the Party's policy on thrift and anti-waste, particularly Directive No. 27-CT/TW dated December 25, 2023 of the Politburo on strengthening the Party's leadership over thrift and anti-waste efforts; review and amend standards and norms as the basis for thrift and anti-waste in specialized laws, ensuring consistency within the legal system. At the same time, conduct a comprehensive assessment of the current status of public assets of agencies and organizations subject to administrative restructuring and streamlined organizational structures. Develop an overall and synchronized plan for managing, using, and transferring office premises after organizational restructuring; prioritize converting surplus premises into public welfare facilities, hospitals, schools; study and establish mechanisms for leasing, transferring assets, premises, land... to ensure that all surplus assets are used efficiently, avoiding wasteful abandonment or improper use;
6. The National Assembly agrees with the main contents in the Report on the Summary of Citizens' Opinions and Suggestions submitted to the Ninth Session of the Fifteenth National Assembly by the Central Committee of the Vietnam Fatherland Front. Requests the Government, the Prime Minister, the Supreme People's Court, the Supreme People's Procuracy, Ministries, sectors, central agencies, and local authorities at all levels to study, adopt, resolve, and respond to the proposals and suggestions of the Chairman's Board of the Central Committee of the Vietnam Fatherland Front according to their assigned functions and tasks.
After discussing in the plenary session on the results of supervising the handling of citizens' suggestions sent to the Eighth Session of the Fifteenth National Assembly, the National Assembly highly commends the efforts of the Government, the Prime Minister, Ministries, sectors, and central agencies in addressing and responding to citizens' suggestions. Many suggestions related to the rights of citizens have been seriously adopted, considered, and promptly resolved by competent authorities. Requests the Government, the Prime Minister, Ministries, sectors, and central agencies to continue to pay attention to addressing citizens' suggestions and the opinions and suggestions of National Assembly deputies regarding the resolution of citizens' suggestions. Assigns the Standing Committee of the National Assembly to direct, urge, and supervise the handling and response to citizens' suggestions and National Assembly deputies; overcome the shortcomings and limitations mentioned in the supervision report.
7. The Supreme People's Court shall continue to study and propose to the National Assembly and the Standing Committee of the National Assembly to issue regulations on the model, organization, and operation of specialized courts to resolve disputes arising at international financial centers in Vietnam. The Supreme People's Court and the Supreme People's Procuracy shall direct the synchronous and timely implementation of new laws, resolutions, and ordinances adopted by the National Assembly and the Standing Committee of the National Assembly to ensure smooth and effective operations of the three-level People's Courts and People's Procuracies; increase investment in human resources, material infrastructure, modern equipment, and digital transformation to ensure that local People's Courts and Procuracies can effectively perform their newly assigned functions and tasks.
8.Regarding the transition of application of certain special mechanisms and policies already permitted by the National Assembly for implementation in some localities following the reorganization of administrative machinery and expansion of territorial boundaries according to the guidelines of the Party and State.
a) Permitting localities (including cities such as Da Nang, Khanh Hoa, Ho Chi Minh City, and Can Tho) after the merger of administrative units to continue implementing special mechanisms and policies under Resolutions No. 136/2024/QH15 dated June 26, 2024, No. 55/2022/QH15 dated June 16, 2022, No. 98/2023/QH15 dated June 24, 2023, and No. 45/2022/QH15 dated January 11, 2022 of the National Assembly, except for those provisions and clauses that have been abolished according to the Law on Organization of Local Administration No. 72/2025/QH15, corresponding to the localities (including cities such as Da Nang, Khanh Hoa, Ho Chi Minh City, and Can Tho) before the merger of provincial administrative units.
b) Permitting new communes and wards corresponding to the territory of Buon Ma Thuot city in Dak Lak province after the reorganization of administrative units to continue applying special mechanisms and policies under Resolution No. 72/2022/QH15 dated November 15, 2022 of the National Assembly, which were applied to Buon Ma Thuot city before the implementation of the two-tier local government model.
c) Entrusting the Government to direct the assessment of policy impacts to ensure the principle of balanced revenue and expenditure in accordance with the State Budget Law; summarizing and evaluating special mechanisms and policies for localities (after completing mergers and consolidations) to adjust and supplement them appropriately to suit the new situation or submit to the National Assembly for legislative codification issues that are clear and have been tested through practical implementation to be applied nationwide.
9. Exempting visa requirements for a limited period for foreigners who belong to special categories requiring preferential treatment to serve economic and social development based on ensuring national defense, security, and public order and safety. Entrusting the Government to specify details and direct research to submit to the National Assembly for amendments and supplements to relevant laws to meet practical needs.
10.Regarding the overall plan to resolve the issue of the Vietnam Shipbuilding Industry Corporation (SBIC) conclusively.
Agreeing with the Government's proposal to transfer all remaining debt payment obligations of the Government at the Vietnam Shipbuilding Industry Corporation into budgetary expenditures to resolve the corporation's debt issue conclusively as stated in the Government's Report No. 22/TTr-CP dated June 24, 2025, ensuring it does not affect the country's reputation. The Government shall be responsible for the accuracy of the figures regarding the remaining debts owed by the Government at the Vietnam Shipbuilding Industry Corporation, preventing the emergence of additional debts that the Government must pay on behalf of the corporation.
11.Regarding the handling of recovered funds from credit programs funded by the state budget that have expired at the Social Policy Bank.
Permitting the Social Policy Bank to continue using the entire amount of VND 6,068,961 billion from the state budget allocated for credit programs (of which VND 3,144,499 billion has been recovered by April 30, 2025, and VND 2,924,462 billion is expected to be recovered) to provide loans for credit programs at the Social Policy Bank as stated in the Government's Report No. 511/TTr-CP dated June 12, 2025, prioritizing the allocation of funds for the loan program to develop socio-economic activities in ethnic minority regions.
Entrusting the Government to be responsible for the accuracy of the figures and to direct related agencies and units to continue fully recovering outstanding loans in accordance with the law to implement credit programs.
12.Regarding the adjustment of the central budget allocation for ministries and central agencies, targeted supplementary funding from the central budget for local budgets in 2025, and determining the local budget revenue and expenditure forecast for 2025 after the reorganization of provincial administrative units as stated in the Government's Reports No. 504/TTr-CP dated June 11, 2025, and No. 509/TTr-CP dated June 12, 2025.
The Government shall implement the adjustment of the central budget allocation for ministries and central agencies, targeted supplementary funding from the central budget for local budgets in 2025, and determine the local budget revenue and expenditure forecast for 2025 after the reorganization of provincial administrative units in accordance with Clause 1, Article 13 of Resolution No. 190/2025/QH15 dated February 19, 2025, of the National Assembly on handling certain issues related to the reorganization of state administrative machinery, and report to the Standing Committee of the National Assembly and the National Assembly at the nearest session.
13.Regarding funding for drug rehabilitation facilities and support policies for staff working in drug rehabilitation as stated in the Government's Report No. 492/TTr-CP dated June 10, 2025.
Entrusting the Government to decide and organize the implementation of adjustments to the state budget estimates and final accounts for 2025 between the Ministry of Public Security and localities as stated in the Government's Report No. 492/TTr-CP dated June 10, 2025, in accordance with Clause 1, Article 13 of Resolution No. 190/2025/QH15 dated February 19, 2025, of the National Assembly.
Starting from the 2026 fiscal year, the Ministry of Public Security shall be responsible for preparing the annual state budget estimates, managing, using, and settling accounts for state budget funds to ensure the operation of drug rehabilitation facilities within the annual state budget estimates of the Ministry of Public Security in accordance with the State Budget Law and related guiding documents.
BASED ON THE LOCAL BUDGET BALANCE CAPACITY, THE LOCALITY CONTINUES TO SUPPORT FUNDS FOR DRUG REHABILITATION FACILITIES AND CENTERS AND THE SUPPORT POLICIES FOR OFFICERS, SOLDIERS, CIVIL SERVANTS, STAFF, WORKERS, AND STUDENTS PARTICIPATING IN DRUG REHABILITATION WORK AT SUCH FACILITIES AND CENTERS AS CURRENTLY APPLIED. AMONG WHICH, HO CHI MINH CITY AND CAN THO CITY ARE PERMITTED TO SUPPORT DRUG REHABILITATION FACILITIES AND OFFICERS, SOLDIERS, CIVIL SERVANTS, STAFF, WORKERS, AND STUDENTS AT SUCH FACILITIES LOCATED IN OTHER LOCALITIES ACCORDING TO THE PETITION NUMBER 492/TTr-CP OF JUNE 10, 2025 FROM THE GOVERNMENT.
14.REGARDING THE ADDITION OF INVESTMENT FORMS FOR THE HIGH-SPEED RAILWAY PROJECT ALONG THE NORTH-SOUTH AXIS
AGREE WITH THE GOVERNMENT'S PROPOSAL IN PETITION NUMBER 573/TTr-CP OF JUNE 23, 2025. APPROVE THE ADDITION OF INVESTMENT FORMS UNDER THE INVESTMENT LAW THROUGH PUBLIC-PRIVATE PARTNERSHIP AND BUSINESS INVESTMENT METHODS ALONGSIDE THE PUBLIC INVESTMENT FORM FOR THE HIGH-SPEED RAILWAY PROJECT ALONG THE NORTH-SOUTH AXIS. ASSIGN THE GOVERNMENT TO ORGANIZE THE SELECTION OF INVESTMENT FORMS AND INVESTORS IN ACCORDANCE WITH THE REGULATIONS. IN CASE THERE ARE MECHANISMS OR POLICIES THAT EXCEED THE GOVERNMENT'S AUTHORITY, REPORT TO THE NATIONAL ASSEMBLY FOR CONSIDERATION AND DECISION.
15.REGARDING SOLUTIONS TO CONTINUE IMPLEMENTING PLANNING WORK IN CONNECTION WITH ADMINISTRATIVE UNIT REORGANIZATION DURING THE PERIOD BEFORE THE ADOPTION OF THE REVISED PLANNING LAW
a) FOR NATIONAL LEVEL PLANNING, REGIONAL PLANNING, AND PROVINCE PLANNING FOR THE 2021-2030 PERIOD THAT HAVE BEEN DECIDED OR APPROVED PRIOR TO JULY 1, 2025, THEY SHALL BE CONTINUED TO BE IMPLEMENTED UNTIL REPLACED OR ADJUSTED IN ACCORDANCE WITH THE PLANNING LAW TO ENSURE THAT THEY DO NOT IMPACT THE IMPLEMENTATION SCHEDULE OF PROJECTS, PROGRAMS, AND TASKS THAT HAVE BEEN DECIDED OR APPROVED.
b) FOR TECHNICAL AND SPECIALIZED PLANNING, THE ESTABLISHMENT, REVIEW, APPROVAL, AND ADJUSTMENT OF PLANNING SHALL CONTINUE TO BE IMPLEMENTED IN ACCORDANCE WITH THE SPECIALIZED LAWS UNTIL NEW REGULATIONS ARE ISSUED.
c) ASSIGN THE GOVERNMENT TO SUMMARIZE AND EVALUATE ALL CONTENT RELATED TO PLANNING IN LEGAL DOCUMENTS TO AMEND AND SUPPLEMENT AND ISSUE THEM IN ACCORDANCE WITH THEIR AUTHORITY OR SUBMIT THEM TO THE COMPETENT AUTHORITIES FOR ISSUANCE TO MEET THE REQUIREMENTS OF STATE MANAGEMENT OF PLANNING WORK AND ENSURE THE CONSISTENCY AND UNIFORMITY OF THE LEGAL SYSTEM. DURING THE PERIOD WHEN THE COMPETENT AUTHORITIES HAVE NOT YET ISSUED LEGAL DOCUMENTS RELATED TO PLANNING, THE PROVISIONS OF RESOLUTION NUMBER 206/2025/QH15 OF JUNE 24, 2025 OF THE NATIONAL ASSEMBLY ON SPECIAL MECHANISMS TO HANDLE DIFFICULTIES AND OBSTACLES CAUSED BY LEGAL PROVISIONS MAY BE APPLIED UNTIL NEW LEGAL PROVISIONS ON PLANNING ARE ISSUED.
16. REGARDING THE SUPPORT POLICY FOR LUNCH FOR PRIMARY AND LOWER SECONDARY SCHOOL STUDENTS IN BORDER COMMUNITIES
UNIFY THE PROPOSAL TO ASSIGN THE GOVERNMENT TO PROMPTLY IMPLEMENT THE SUPPORT FOR LUNCH FOR PRIMARY AND LOWER SECONDARY SCHOOL STUDENTS IN BORDER COMMUNITIES FROM THE 2025-2026 SCHOOL YEAR. IN CASE THIS EXCEEDS THE GOVERNMENT'S AUTHORITY, REPORT TO THE NATIONAL ASSEMBLY'S STANDING COMMITTEE AND THE NATIONAL ASSEMBLY FOR CONSIDERATION AND DECISION.
17. THE NATIONAL ASSEMBLY'S STANDING COMMITTEE, THE GOVERNMENT, THE PRIME MINISTER, THE VIETNAMESE FATHERLAND FRONT'S CENTRAL COMMITTEE, THE SUPREME PEOPLE'S COURT, THE SUPREME PROSECUTOR'S OFFICE, THE NATIONAL MAJORITY COUNCIL, THE NATIONAL ASSEMBLY'S COMMITTEES, THE STATE AUDITOR, THE MINISTRIES, SECTORS, CENTRAL ORGANIZATIONS, AND LOCAL AUTHORITIES AT ALL LEVELS SHALL ORGANIZE THE EFFECTIVE IMPLEMENTATION OF THIS RESOLUTION IN ACCORDANCE WITH THEIR FUNCTIONS AND TASKS; INCREASE PUBLICITY, DISSEMINATION, AND LEGAL EDUCATION TO SOON IMPLEMENT THE LAWS AND RESOLUTIONS PASSED BY THE NATIONAL ASSEMBLY.
THE NATIONAL ASSEMBLY'S STANDING COMMITTEE, THE NATIONAL MAJORITY COUNCIL, THE NATIONAL ASSEMBLY'S COMMITTEES, THE DELEGATIONS OF THE NATIONAL ASSEMBLY, AND NATIONAL ASSEMBLY MEMBERS SHALL MONITOR THE IMPLEMENTATION OF THIS RESOLUTION.
THE VIETNAMESE FATHERLAND FRONT'S CENTRAL COMMITTEE AND ITS MEMBER ORGANIZATIONS SHALL MONITOR AND ENCOURAGE CITIZENS TO IMPLEMENT THIS RESOLUTION.
