Regulations on fishing vessel inspectors; recognition of fishing vessel inspection facilities; ensuring technical safety of fishing vessels and fisheries service vessels[1]; registration of fishing vessels and fisheries service vessels; cancellation of fishing vessel registration and marking of fishing vessels
Circular No. 23/2018/TT-BNNPTNT dated November 15, 2018 of the Minister of Agriculture and Rural Development stipulates regulations on fishing vessel inspectors; recognition of fishing vessel inspection facilities; ensuring technical safety of fishing vessels and fisheries service vessels; registration of fishing vessels and fisheries service vessels; cancellation of fishing vessel registration and marking of fishing vessels, which took effect from January 1, 2019, has been amended and supplemented by:
1. Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022 of the Minister of Agriculture and Rural Development amending and supplementing some Circulars in the field of fisheries, which took effect from March 4, 2022;
2. Circular No. 06/2024/TT-BNNPTNT dated May 6, 2024 of the Minister of Agriculture and Rural Development regarding amendments and supplements to certain provisions of Circular No. 23/2018/TT-BNNPTNT dated November 15, 2018 of the Minister of Agriculture and Rural Development stipulating regulations on fishing vessel inspectors; recognition of fishing vessel inspection facilities; ensuring technical safety of fishing vessels and fisheries patrol vessels; registration of fishing vessels and fisheries service vessels[2]; cancellation of fishing vessel registration and marking of fishing vessels, which took effect from May 6, 2024.
Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Fisheries Law 2017;
Animal Feed - Maximum Allowable Levels of Safety Indicators in Animal Feed and Raw Materials for Aquafeed Production.
The Minister of Agriculture and Rural Development issues this Circular stipulating regulations on fishing vessel inspectors; recognition of fishing vessel inspection facilities; ensuring technical safety of fishing vessels and fisheries patrol vessels; registration of fishing vessels and fisheries service vessels; cancellation of fishing vessel registration and marking of fishing vessels[3]
Chapter I. GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates standards, tasks, vocational training, procedures, and formalities for issuing and revoking inspection cards and technical seals for fishing vessel inspectors; recognition of facilities meeting the conditions for inspecting fishing vessels; ensuring technical safety of fishing vessels and fisheries service vessels[4]; registration of fishing vessels and fisheries service vessels; cancellation of fishing vessel registration and marking of fishing vessels.
Article 2. Applicability
This Circular applies to organizations and individuals related to management, design, construction, modification, repair, and ensuring technical safety of fishing vessels and fisheries service vessels[5]; registration of fishing vessels and fisheries service vessels[6].
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. Fishing vessel inspector is a person with expertise and vocational skills meeting the standards and being issued an inspection card and technical seal for fishing vessel inspectors to carry out fishing vessel inspections in accordance with the law.
2. Fishing vessel inspection, fisheries service vessel inspection[7] is the technical management of fishing vessels and fisheries service vessels[8], reviewing design documents and conducting technical safety supervision during new construction, modification, annual, dockside, periodic, and unscheduled repairs and restoration of fishing vessels and fisheries service vessels[9], aiming to ensure technical safety for vessels operating under certain conditions.
3. Technical safety supervision of fishing vessels and fisheries service vessels[10] is the inspection and evaluation of the compliance of hulls, engines, propulsion systems, safety equipment, exploitation equipment, processing, classification, and preservation equipment installed on fishing vessels and fisheries service vessels[11] with current technical regulations and national standards.
4. New construction of fishing vessels and fisheries service vessels[12] is the process of shipbuilding from laying the keel or equivalent construction stage to delivery for operation.
5. Modification of fishing vessels and fisheries service vessels[13] involves repairs that affect the technical performance of the vessel (changes in basic dimensions, main engine, function, operational area of the vessel).
6. Repair and restoration of fishing vessels and fisheries service vessels[14] involves repairs and replacements aimed at returning the vessel to its original technical condition without affecting the vessel's technical performance.
7. Traditional fishing vessel model (folk model) is a fishing vessel model used for a long time in local areas, developed into a technical design file and announced by the provincial People's Committee.
8. Registration of fishing vessels and fisheries service vessels[15] is the implementation of state management over fishing vessels and fisheries service vessels[16] to establish ownership rights and obligations of the vessel owner.
Chapter II. REGULATIONS ON FISHING VESSEL INSPECTORS
Article 4. Categories of Fishing Vessel Surveyors
Fishing vessel surveyors are divided into three categories as follows:
1. Category III fishing vessel surveyor.
2. Category II fishing vessel surveyor.
3. Category I fishing vessel surveyor.
Article 5. Category III Fishing Vessel Surveyor
1. Criteria for Category III fishing vessel surveyor:
a) Graduated from a college or higher in one of the relevant technical majors related to fishing vessels, marine vessels, electricity, refrigeration, machinery manufacturing, or equipment installation on vessels;
b)[17] (abolished).
c)[18] (abolished).
d) Hold a certificate of vocational training for Category III fishing vessel surveyor;
đ)[19] (abolished).
2.[20] Duties of Category III fishing vessel surveyor:
a) Inspect and evaluate the annual technical condition of various fishing vessels and fisheries service vessels;
b) Inspect and evaluate the technical condition of various fishing vessels and fisheries service vessels on the slipway at regular intervals[21] according to the specialized training received.
Article 6. Category II Fishing Vessel Surveyor
1. Criteria for Category II fishing vessel surveyor:
a) Graduated from a college or higher in one of the relevant technical majors related to fishing vessels, marine vessels, electricity, refrigeration, machinery manufacturing, or equipment installation on vessels;
b)[22] (abolished).
c)[23] (abolished).
d)[24] Already been issued with a card and seal of Category III fishing vessel surveyor and have continuously held the category for a minimum of 36 months from the date of issuance of the Category III fishing vessel surveyor card;
d) Hold a certificate of vocational training for Category II fishing vessel surveyor.
2.[25] Duties of Category II fishing vessel surveyor:
a) Review technical designs for new construction, modification, restoration, construction drawings, completion drawings of fishing vessels and fisheries service vessels,[26]machinery, and equipment installed on fishing vessels and fisheries service vessels according to specialized training received;
b) Inspect and evaluate the technical condition of newly constructed, initial, slipway, regular, modified, and abnormal fishing vessels and fisheries service vessels;
c) Supervise the manufacture of materials, machinery, and equipment installed on fishing vessels and fisheries service vessels.
Article 7. Category I Fishing Vessel Surveyor
1. Criteria for Category I fishing vessel surveyor:
a) Graduated from a university or higher in one of the relevant technical majors related to fishing vessels, marine vessels, electricity, refrigeration, machinery manufacturing, or equipment installation on vessels;
b)[27] (abolished).
c)[28] (abolished).
d)[29] Already been issued with a card and seal of Category II fishing vessel surveyor and have continuously held the category for a minimum of 36 months from the date of issuance of the Category II fishing vessel surveyor card;
d) Hold a certificate of vocational training for Category I fishing vessel surveyor.
2.[30] Duties of Category I fishing vessel surveyor:
Participate in technical appraisals and determine the cause of accidents involving fishing vessels and fisheries service vessels[31] and other duties specified in Clause 2 of Article 6 of this Circular.
Article 8. Vocational Training for Fishing Vessel Surveyors
1. The Fisheries Department[32] is the unit organizing vocational training and issuing certificates of vocational training for fishing vessel surveyors.
2. The program for vocational training for fishing vessel surveyors and the standards for instructors in vocational training for fishing vessel surveyors as prescribed in Appendix I attached to this Circular.
3. Individuals applying for vocational training for fishing vessel surveyors must submit the following documents:
a) Application form for participation in vocational training for fishing vessel surveyors according to Form No. 01.DKV in Appendix II attached to this Circular;
b) A copy of the diploma and professional certificate and present the original for verification if submitting directly or a certified copy if sending through postal services or online (if applicable);
c) Two color photographs (3 x 4 cm).
4.[33] Individuals will be issued a Certificate of Vocational Training for Fishing Vessel Surveyors according to Form No. 02.DKV in Appendix II attached to this Circular upon completion of the vocational training course and meeting the final examination requirements. The Certificate of Vocational Training for Fishing Vessel Surveyors will be reissued in case it is lost or damaged; individuals requiring reissuance must submit an application according to Form No. 05.DKV in Appendix II attached to this Circular to the Fisheries Department[34].
Within five working days from the date of receipt of the application for reissuance of the Certificate of Vocational Training for Fishing Vessel Surveyors, the Fisheries Department[35] will reissue the Certificate of Vocational Training for Fishing Vessel Surveyors according to Form No. 02.DKV in Appendix II attached to this Circular; in cases where the Certificate of Vocational Training for Fishing Vessel Surveyors is not reissued, the Fisheries Department[36] will respond in writing and specify the reasons.
Article 9.[37] Issuance and Reissuance of Cards and Seals for Fishing Vessel Surveyors
1. Authority responsible for issuing and reissuing cards and seals for fishing vessel surveyors: The Fisheries Department[38].
2. Documents required for issuing and reissuing cards and seals for fishing vessel surveyors include:
a) Application form for issuance/reissuance of cards and seals for fishing vessel surveyors according to Form No. 03.DKV in Appendix II attached to this Circular;
b) A copy of the Certificate of Vocational Training for Category I, II, or III fishing vessel surveyors (for first-time issuance);
c) Two color photographs (3 x 4 cm).
3. Procedures for implementation:
a) Individuals submit one set of documents directly to the Fisheries Department[39] or send via postal services or online (National Single Window Portal, online public services, electronic software, email, fax) if available;
b) In cases of direct submission: The Fisheries Department[40] checks the completeness of the documents and responds immediately when the individual submits the documents;
c) In cases of submission via postal services or online: Within two working days, the Fisheries Department[41] reviews the completeness of the documents; if the documents are incomplete, the Fisheries Department[42] will notify the individual in writing to provide additional information;
d) Within twelve working days from the date of receiving complete documents, the Fisheries Department[43] will review and decide on the issuance of cards and seals for fishing vessel surveyors according to Form No. 04.DKV in Appendix II attached to this Circular; in cases where issuance is denied, the Fisheries Department[44] will respond in writing and specify the reasons;
d) The Fisheries Department[45] will deliver the results directly at the place of document submission or send via postal services.
4. The fishing vessel surveyor card has a validity period of thirty-six months from the date of issuance. The card will be reissued in cases of expiration, loss, or damage. If the fishing vessel surveyor card has expired for twenty-four months or more, the surveyor must participate in the vocational training program for fishing vessel surveyors and obtain a Certificate of Vocational Training for Fishing Vessel Surveyors to be eligible for reissuance.
Article 10. Revocation of Inspection Officer's Card and Technical Seal for Fishing Vessels
1. The fishing vessel inspection officer shall have their card and technical seal revoked when they fall under any of the following circumstances:
a) Fabricating documents to obtain the card and technical seal of a fishing vessel inspection officer; b) Creating false inspection records, intentionally distorting inspection results; c) Failing to comply with inspection procedures or technical regulations on fishing vessels, national standards, and related regulations.
2. The Director of the Fisheries Department[46] shall be responsible for revoking the card and technical seal of a fishing vessel inspection officer in cases stipulated in Clause 1 of this Article.
3. A fishing vessel inspection officer who violates the provisions set out in Point c Clause 1 of this Article may only be considered for reissuance of the card and technical seal after a period of 12 months from the date of the revocation decision.
Chapter III. RECOGNITION OF QUALIFIED INSPECTION FACILITIES FOR FISHING VESSELS
Article 11. Issuance of Certificate of Qualified Inspection Facilities for Fishing Vessels
1. Competent authority for issuance is the Fisheries Department[47].
2.[48] In cases of refusal, the State Bank will issue a document refusing approval to use foreign currency within the territory and clearly state the reasons.
a) Application for issuance of the Certificate of Qualified Inspection Facilities for Fishing Vessels according to Form No. 01.CN Appendix III issued together with this Circular;
b) Quality management system documentation in accordance with ISO 9001 or equivalent standard.
3. Procedures for implementation:
a) Organizations or individuals submit one set of application documents directly to the Fisheries Department[49] or send them through postal services or via online environment (national single window portal, online public service, electronic software, email, fax) if available;
b) In cases of direct submission: The Fisheries Department[50] check the contents of the application documents and respond immediately upon receipt of the application documents;
c) In cases of submission via postal services or online: Within two working days, the Fisheries Department[51] reviews the completeness of the documents; if the documents are incomplete, the Fisheries Department[52] issue a written notice requesting additional information;
d) Within twenty days from the date of receiving complete application documents as prescribed, the Fisheries Department[53] completes on-site inspection at the facility, inspection content, and inspection record according to Form No. 02.CN Appendix III issued together with this Circular;
đ) Within ten working days from the end of the inspection, if the inspection results meet the requirements, the Fisheries Department[54] issues the Certificate of Qualified Inspection Facilities for Fishing Vessels according to Form No. 03.CN Appendix III issued together with this Circular and issues the technical seal and professional stamp for fishing vessel inspection. The technical seal and professional stamp for fishing vessel inspection, along with usage principles, are according to Form No. 04.CN Appendix III issued together with this Circular. In case the Certificate of Qualified Inspection Facilities for Fishing Vessels is not issued, the Fisheries Department[55] will respond in writing and specify the reasons;
e) The Fisheries Department[56] will deliver the results directly at the place of document submission or send via postal services.
4. Maintenance inspection of qualified inspection facilities for fishing vessels:
a) The Fisheries Department[57] conducts maintenance inspections of recognized qualified inspection facilities for fishing vessels every 24 months;
b) The content of the maintenance inspection of qualified inspection facilities for fishing vessels is carried out according to Form No. 02.CN Appendix III issued together with this Circular;
c) The inspection results are notified to the qualified inspection facility for fishing vessels within ten working days from the end of the inspection. If the qualified inspection facility for fishing vessels does not meet the conditions, the Fisheries Department[58] decides to revoke the certificate of qualified inspection facilities for fishing vessels.
5.[59] In cases where due to natural disasters or epidemics it is impossible to conduct on-site inspections as stipulated in Point d Clause 3 and Clause 4 of this Article, online inspection methods shall be applied; or the maintenance inspection activities of qualified inspection facilities for fishing vessels may be temporarily suspended for a maximum of six months.
The Fisheries Department[60] provides technical and professional guidance for online evaluation to issue certificates of qualified inspection facilities for fishing vessels.
Article 12. Reissuing the Certificate of Eligibility for Fishing Vessel Inspection
1. Competent authority for issuance is the Fisheries Department[61].
2. The documents include:
a) A request form for reissuing the Certificate of Eligibility for Fishing Vessel Inspection according to Form No. 05.CN - Appendix III issued together with this Circular;
b) The original Certificate of Eligibility for Fishing Vessel Inspection in case it is damaged or information has been changed.
3. Procedures for implementation:
a) Organizations or individuals submit one set of application documents directly to the Fisheries Department[62] or send them through postal services or via online environment (national single window portal, online public service, electronic software, email, fax) if available;
b) In cases of direct submission: The Fisheries Department[63] check the contents of the application documents and respond immediately upon receipt of the application documents;
c) In cases of submission via postal services or online: Within two working days, the Fisheries Department[64] reviews the completeness of the documents; if the documents are incomplete, the Fisheries Department[65] issue a written notice requesting additional information;
d) Within five working days from the date of receiving a complete application file in accordance with the regulations, the Director of the Fisheries Inspectorate[66] shall reissue the Certificate of Eligibility for Fishing Vessel Inspection according to Form No. 03.CN - Appendix III issued together with this Circular; in cases where the Certificate of Eligibility for Fishing Vessel Inspection cannot be reissued, the Fisheries Inspectorate[67] will respond in writing and specify the reasons;
d) The Fisheries Department[68] will deliver the results directly at the place of document submission or send via postal services.
Chapter IV. ENSURING TECHNICAL SAFETY OF FISHING VESSELS AND FISHERIES SERVICE VESSELS[69]
Article 13. Inspection of Fishing Vessels and Fisheries Service Vessels[70]
1. Fishing vessels as specified in Clause 1, Article 67 of the Fisheries Law, fisheries service vessels[71] must undergo inspection.
2. Fishing vessels with maximum length under twelve meters must be equipped with safety equipment when operating according to Appendix IV issued together with this Circular.
Article 14. Contents of Fishing Vessel Inspection
1. Review design documentation for new construction, alteration, repair and restoration of fishing vessels.
2. Supervise technical safety of fishing vessels during new construction, alteration, annually, on slipways, periodically, abnormally, and during repair and restoration of fishing vessels.
3. Inspect machinery and equipment required to be inspected installed on fishing vessels.
4. Participate in technical appraisal and determination of causes of accidents and incidents related to the technical condition of fishing vessels upon request.
5. Fishing vessel inspections shall be carried out in accordance with technical standards for fishing vessels and related technical standards according to Appendix V issued together with this Circular.
Article 15. Forms of Technical Safety Inspection of Fishing Vessels
1. Initial inspection for the following types of vessels:
a) Newly constructed fishing vessels;
b) Fishing vessels that have not been issued a Technical Safety Certificate.
2. Abnormal inspection for fishing vessels involved in accidents, repaired after accidents; at the request of the vessel owner or competent authority.
3. Periodic inspection:
a) Periodic inspection rounds include: Annual inspection; inspection on slipways; regular inspection;
b) The period for periodic inspection shall be carried out in accordance with the relevant technical standards applicable to fishing vessels.
Article 16. Review of Design Documentation for Fishing Vessels
1. Fishing vessels with a maximum length of twelve meters or more must have technical design documentation reviewed before new construction or alteration; in the case of newly constructed wooden fishing vessels based on traditional models, design documentation for such models must be reviewed by the fishing vessel inspection facility.
2. Authority to review design documentation for fishing vessels:
a) Type I fishing vessel inspection facilities shall review design documentation for new construction, alteration, completion, repair and restoration of all types of fishing vessels;
b) Type II fishing vessel inspection facilities shall review design documentation for new construction, alteration, completion, repair and restoration of fishing vessels with a maximum length under twenty-four meters;
c) Type III fishing vessel inspection facilities shall review design documentation for new construction, alteration, completion, repair and restoration of fishing vessels with a maximum length under fifteen meters.
3. Documents include:
a) Request form for reviewing design documentation for fishing vessels according to Form No. 01.BĐ - Appendix VI issued together with this Circular;
b) Design documentation for fishing vessels (three sets).
4. Procedure for implementation:
a) Organizations and individuals submit one set of documentation directly to the fishing vessel inspection facility as stipulated in Clause 2 of this Article or send through postal services;
b) In cases of direct submission: The fishing vessel inspection facility checks the completeness of the documentation and responds immediately when organizations and individuals submit the documentation;
c) In cases of submission through postal services: Within two working days, the fishing vessel inspection facility examines the completeness of the documentation; if the documentation is incomplete, the fishing vessel inspection facility will notify organizations and individuals to supplement the missing parts;
d) Within twenty days (for new construction design documentation) or ten working days (for alteration and repair design documentation), from the date of receiving complete documentation in accordance with the regulations, the fishing vessel inspection facility conducts a design review; if the requirements are not met, the organization or individual will be notified; if the requirements are met, a Certificate of Design Review for Fishing Vessels according to Form No. 02.BĐ - Appendix VI issued together with this Circular will be issued and stamped with the review seal;
đ) The fishing vessel inspection facility delivers the results either directly at the place of submission or sends them through postal services.
Article 17.[72] Issuing the Certificate of Technical Safety for Fishing Vessels
1. The authority to issue the Certificate of Technical Safety for Fishing Vessels is the fishing vessel inspection facility.
2. The documents include:
a) Request form for issuing the Certificate of Technical Safety for Fishing Vessels according to Form No. 03.BĐ - Appendix VI issued together with this Circular;
b) Photocopies of reviewed design documentation (for new construction and alteration of fishing vessels).
3. Procedures for implementation:
a) Organizations and individuals submit one set of documentation directly to the fishing vessel inspection facility or send through postal services or via electronic means (email, fax) if available;
b) In cases of direct submission: The fishing vessel inspection facility checks the completeness of the documentation and responds immediately when organizations and individuals submit the documentation;
c) In cases of submission through postal services or via electronic means: Within two working days, the fishing vessel inspection facility examines the completeness of the documentation; if the documentation is incomplete, the fishing vessel inspection facility will notify organizations and individuals to supplement the missing parts;
d) Within one working day from the date of receiving complete documentation in accordance with the regulations, the fishing vessel inspection facility agrees on the time and location for inspection with the requesting organization or individual;
đ) The fishing vessel inspection facility supervises the technical safety of fishing vessels in accordance with technical standards for fishing vessels and related technical standards. For materials, machinery, and equipment listed in Appendix XI issued together with this Circular, before installation on fishing vessels, organizations and individuals requesting the issuance of the Certificate of Technical Safety for Fishing Vessels must submit (copies and present originals or certified copies for verification) Certificates of Conformity and Compliance (for domestically produced materials, machinery, and equipment) or Certificates of Origin and Quality (for imported materials, machinery, and equipment) or conformity assessment certificates as prescribed by law;
e) In cases where the main engine is a second-hand marine engine that does not meet the requirements stipulated in point đ of this clause, it must be inspected and evaluated by the fishing vessel inspection facility according to Form No. 07.BĐ - Appendix VI issued together with this Circular;
g) In case the results do not meet the requirements, within two working days from the date of completing technical supervision, the fishing vessel registration facility shall notify in writing the organization or individual with detailed reasons; in case the results meet the requirements, within three working days from the completion of inspection, the fishing vessel registration facility shall issue to the shipowner the following documents:
Inspection report of fishing vessels according to Model No. 04a.BĐ to Model No. 04n.BĐ in Appendix VI issued together with this Circular;
Certificate of technical safety for fishing vessels according to Model No. 05.BĐ in Appendix VI issued together with this Circular;
Logbook of fishing vessel registration for new construction inspections or first-time inspections according to Model No. 06.BĐ in Appendix VI issued together with this Circular;
h) The fishing vessel registration facility shall deliver the results directly at the place where the file was received or send them through postal service.
Article 18. Fishing Vessel Registration[73]
1. Content and form of technical safety inspection, design documentation review, and issuance of technical safety certificates for fisheries service vessels[74] shall be carried out at fishing vessel registration facilities in accordance with Articles 14, 15, 16, and 17 of this Circular.
2. In cases where the fisheries service vessel management organization[75] selects a registration facility that is not a fishing vessel registration facility to register fisheries service vessels, [76]it shall comply with the regulations of the selected registration facility.
Chapter V. REGISTRATION OF FISHING VESSELS AND FISHERIES SERVICE VESSELS[77]; DELETION OF FISHING VESSEL REGISTRATION AND MARKING OF FISHING VESSELS
Article 19. Registration of Fishing Vessels and Fisheries Service Vessels[78]
1. Fishing vessels with a maximum length of six meters or more and fisheries service vessels[79] must be registered in accordance with this Circular before being put into operation.
2. At the same time, each fishing vessel or fisheries service vessel[80] may only be registered at one registration authority and may only be issued one registration certificate.
3. The registration authority for fishing vessels and fisheries service vessels[81] shall be responsible for recording in the National Register of Fishing Vessels according to Model No. 01.ĐKT in Appendix VII issued together with this Circular before issuing the Certificate of Registration for fishing vessels and fisheries service vessels.[82].
Article 20. Regulations on Registration Numbers and Names of Fishing Vessels and Fisheries Service Vessels[83]
1. The registration number shall be written on both sides of the hull near the bow of the vessel; in cases where small vessels cannot write the registration number on the sides near the bow, a signboard shall be affixed to the outside of the cabin wall or sleeping quarters wall, if there is no cabin or sleeping quarters, then it shall be written or affixed to any part of the hull that is easily visible.
2. Letters and numbers shall be neatly and clearly written in uniform Latin script, contrasting colors with the background to ensure visibility.
3. The size of letters and numbers must be proportional to the size of the vessel, with the thickness of letters and numbers not less than 30 mm, and the height of letters and numbers not less than 200 mm. For very small vessels, the size of letters and numbers must be clear and easily visible.
4. The registration number of fishing vessels consists of three groups of characters (from left to right), separated by a hyphen “-” as follows:
a) The first group: Abbreviations of the names of provinces and centrally-administered cities according to Appendix VIII issued together with this Circular;
b) The second group: Consists of five digits in sequence from 00001 to 99999.
c) The third group: Consists of two letters: “TS” (Fisheries).
5. The registration number of fisheries service vessels[84] consists of three groups of characters (from left to right), separated by a hyphen “-” as follows:
a) The first group consists of two letters “KN” for fisheries service vessels
, inspection, patrol, inspection, control, and monitoring of fisheries activities, and “NC” for research and assessment vessels;[85]b) The second group consists of three digits according to Appendix IX issued together with this Circular;
c) The third group consists of two letters “VN” for centrally-managed vessels or abbreviations of the names of provinces and centrally-administered cities according to Appendix VIII issued together with this Circular for locally-managed vessels.
6. The name of the fishing vessel is set by the shipowner and marked above the cabin wall.
6. The name of the fishing vessel is self-designated by the owner and painted on the upper part of the cabin wall.
Article 21. Registration of fishing vessels and fisheries service vessels[86]
1. Competent authority for registering fishing vessels and fisheries service vessels[87]:
a) The provincial state management agency on fisheries shall issue registration certificates for fishing vessels within its jurisdiction;
b) The Fisheries Department[88] shall issue registration certificates for fisheries service vessels[89].
2. Documents required for newly built vessels include:
a) Application form for registration of fishing vessels and fisheries service vessels[90] according to Model No. 02.ĐKT Appendix VII issued together with this Circular;
b) Original Certificate of Factory Completion issued by the shipbuilding facility owner according to Model No. 03.ĐKT Appendix VII issued together with this Circular;
c) Original approval document for new construction of fishing vessels or an approval document from the competent authority for fisheries service vessels;
d) Original receipt for payment of initial registration tax of the vessel or original Application Form for Initial Registration Fee of the vessel confirmed by the tax authority;
đ) Color photograph (9 x 12 cm, showing the entire vessel from both sides);
e)[91] Copy of the Safety Technical Certificate of fishing vessels with a maximum length of 12 meters or more.
3. Documents required for modified vessels include:
a) Documents as stipulated at points a, d, đ, e of Clause 2 of this Article;
b) Original Certificate of Modification and Repair of Vessels according to Model No. 04.ĐKT Appendix VII issued together with this Circular;
c) Original previous registration certificate;
d) Approval document for modification of fishing vessels or an approval document from the competent authority for fisheries service vessels[92].
4. Documents required for purchased or gifted vessels include:
a) Documents as stipulated at points a, d, đ, e of Clause 2 of this Article;
b) Original ownership transfer document as prescribed;
c) Approval document for purchase of fishing vessels, except in cases where fishing vessels are sold within the province or centrally governed city;
d) Original previous registration certificate of fishing vessels attached to the original registration documents of the vessel;
đ) Original cancellation registration certificate.
5. Documents required for imported vessels include:
a) Documents as stipulated at points a, d, đ, e of Clause 2 of this Article;
b) Certified copy of the import permit document for fishing vessels issued by the competent authority;
c) Original cancellation registration certificate attached with certified copy of the Vietnamese translation for used fishing vessels and fisheries service vessels;[93] d) Certified copy of the customs declaration confirmed as completed customs procedures;
đ) Certified copy of the receipt for payment of taxes as prescribed by Vietnamese law.
6. Documents required for bareboat chartered vessels include:
a) Documents as stipulated at points a, đ, e of Clause 2 and points c, d, đ of Clause 5 of this Article;
b) Original approval document for bareboat charter issued by the competent Vietnamese authority;
c) Original bareboat charter contract.

6a[94]. Documents required for fishing vessels as specified in Clause 4, Article 27 of this Circular include:
a) Application form for registration of fishing vessels with confirmation by the People's Committee of the commune where the vessel owner has permanent residence according to Appendix XII issued together with this Circular;
b) Copy of the Safety Technical Certificate of fishing vessels with a maximum length of 12 meters or more;
c) Original notification of payment of initial registration fee of the vessel;
d) Color photograph (9cm x 12cm showing the entire vessel from both sides).
7. Implementation procedure:
a) Organizations and individuals submit one set of documents directly to the competent authority as stipulated in Clause 1 of this Article or send through postal services or via electronic environment (national single window portal, online public services, electronic software, email, fax) if available;
b) In case of direct submission: The competent authority as stipulated in Clause 1 of this Article will check the documents and respond immediately when organizations and individuals submit the documents;
c) In case of submission through postal services or via electronic environment: Within two working days, the competent authority as stipulated in Clause 1 of this Article will review completeness, and if the documents are incomplete, the competent authority will notify organizations and individuals to supplement;
d) Within three working days from the date of receiving complete documents as prescribed, the competent authority as stipulated in Clause 1 of this Article is responsible for processing the registration, entering into the Fishing Vessel Register and Fisheries Service Vessel Register[95] and issuing the Fishing Vessel Registration Certificate and Fisheries Service Vessel Registration Certificate according to Model No. 05.ĐKT Appendix VII issued together with this Circular and issuing the Fishing Vessel Crew Logbook according to Model No. 06.ĐKT Appendix VII issued together with this Circular; in case of non-issuance of the Fishing Vessel Registration Certificate and Fisheries Service Vessel Registration Certificate, the competent authority will reply in writing and specify the reasons;
đ) The competent authority as stipulated in Clause 1 of this Article will deliver the results directly at the place of document submission or send through postal services.
Article 22. Re-registration of fishing vessels and fisheries service vessels[96]
1. Certificate of registration for fishing vessels and fisheries service vessels[97] shall be reissued in the following cases:
a) Lost, torn, or damaged;
b)[98] Changing the name of the vessel, call sign (if any), or technical parameters of the vessel without affecting the technical performance of the fishing vessel;
c) Changing information about the owner in the Certificate of registration for fishing vessels;
d) Fishing vessels have exceeded the lease period for foreign organizations or individuals;
đ)[99] The vessel has been issued a Confirmation of Registration.
2. The documents include:
a) Application form for reissuing the Certificate of registration for fishing vessels and fisheries service vessels [100]according to Form No. 07.DKT Appendix VII promulgated together with this Circular;
b)[101] Original Certificate of registration for fishing vessels or Confirmation of Registration, old Certificate of registration for fisheries service vessels; in case the Certificate of registration for fishing vessels is lost, the shipowner must declare and specify the reason;
c)[102] A copy of the Technical Safety Certificate of fishing vessels with a maximum length of 12 meters or more;
d) Color photograph (9 x 12 cm, showing the entire vessel from both sides);
3. Procedures for implementation:
a) Organizations or individuals submit one set of application documents directly at the competent authority specified in Clause 1, Article 21 or send through postal services or via electronic environment (national single window portal, online public services, electronic software, email, fax) if available;
b) In case of direct submission: The competent authority specified in Clause 1, Article 21 will check the completeness of the documents and respond immediately when the organization or individual submits the application;
c) In case of submission through postal services or via electronic environment: Within no more than two working days, the competent authority specified in Clause 1, Article 21 will review the completeness of the documents; if the documents are incomplete, the competent authority will issue a written notice to the organization or individual to supplement the missing information;
d) Within three working days from the date of receiving complete documents as prescribed, the competent authority specified in Clause 1, Article 21 will reissue the Certificate of registration for fishing vessels and fisheries service vessels. If the Certificate of registration for fishing vessels and fisheries service vessels is not reissued, the competent authority will provide a written response and specify the reasons;
đ) The competent authority specified in Clause 1, Article 21 will deliver the results directly at the place where the application was submitted or send it through postal services;
4. The Certificate of registration for fishing vessels and fisheries service vessels[103] reissued must retain the original registration number and clearly indicate the issuance time;
Article 23. Temporary registration of fishing vessels and fisheries service vessels[104]
1. Fishing vessels and fisheries service vessels[105] shall be issued a temporary Certificate of registration in the following cases:
a) Vessels without a receipt for preliminary property tax payment;
b) Newly built vessels being moved to their official registration location;
c) Imported vessels or bareboat chartered vessels from abroad arriving at the first Vietnamese port.
2. The documents include:
a) Application form for issuing a temporary Certificate of registration for fishing vessels and fisheries service vessels according to Form No. 08.DKT Appendix VII promulgated together with this Circular;
b) Certified copy or certified copy and presentation of the original Technical Safety Certificate of fishing vessels, shipbuilding contract, and delivery acceptance report;
c)[106] Certified copy of relevant documents for imported vessels or bareboat chartered vessels from abroad arriving at the first Vietnamese port, including: Import permit or bareboat charter permit, shipbuilding contract and settlement contract for newly built vessels, valid Technical Safety Certificate or classification certificate for at least six months issued by the classification organization of the country where the vessel is registered;
d) Color photograph (9 x 12 cm, showing the entire vessel from both sides);
3. Procedures for implementation:
a) Organizations or individuals submit one set of application documents directly at the competent authority specified in Clause 1, Article 21 or send through postal services or via electronic environment (national single window portal, online public services, electronic software, email, fax) if available;
b) In case of direct submission: The competent authority specified in Clause 1, Article 21 will check the completeness of the documents and respond immediately when the organization or individual submits the application;
c) In case of submission through postal services or via electronic environment: Within no more than two working days, the competent authority specified in Clause 1, Article 21 will review the completeness of the documents; if the documents are incomplete, the competent authority will issue a written notice to the organization or individual to supplement the missing information;
d) Within three working days from the date of receiving complete documents as prescribed, the competent authority specified in Clause 1, Article 21 will issue a temporary Certificate of registration for fishing vessels and fisheries service vessels[107] according to Form No. 09.DKT Appendix VII promulgated together with this Circular; if the temporary Certificate of registration for fishing vessels and fisheries service vessels is not issued, the competent authority will provide a written response and specify the reasons;
đ) The competent authority specified in Clause 1, Article 21 will deliver the results directly at the place where the application was submitted or send it through postal services;
4. The temporary Certificate of registration for fishing vessels and fisheries service vessels is valid for a maximum of ninety days from the date of issuance.
Article 24. Deletion of Fishing Vessel Registration
1. The dossier shall include:
a) Form No. 10.DKT attached as Appendix VII to this Circular for the deletion of fishing vessel registration;
b) Original Certificate of Fishing Vessel Registration; in case the Certificate of Fishing Vessel Registration is lost, the vessel owner must report and specify the reason.
"2. Implementation procedures:"
a) Organizations and individuals submit one set of documents directly at the competent authority specified in Clause 1, Article 21 of this Circular, or send them through postal services or via online environment (national single window portal, online public service, electronic software, email, fax) if available;
b) In case of direct submission: The competent authority specified in Clause 1, Article 21 will check the completeness of the documents and respond immediately when the organization or individual submits the application;
c) In case of submission through postal services or via electronic environment: Within no more than two working days, the competent authority specified in Clause 1, Article 21 will review the completeness of the documents; if the documents are incomplete, the competent authority will issue a written notice to the organization or individual to supplement the missing information;
d)[108] Within three working days from the date of receipt of complete documents as prescribed, the competent authority specified in Clause 1, Article 21 of this Circular shall issue the Certificate of Deletion of Fishing Vessel Registration according to Form No. 11.DKT attached as Appendix VII to this Circular; hand over the original Certificate of Fishing Vessel Registration with the upper right corner cut off and the original registration file of the vessel to the vessel owner. In case the Certificate of Deletion of Fishing Vessel Registration is not issued, the fisheries service vessel[109] the competent authority shall respond in writing and specify the reason;
đ) The competent authority specified in Clause 1, Article 21 will deliver the results directly at the place where the application was submitted or send it through postal services;
3. The Certificate of Deletion of Fishing Vessel Registration shall be issued one original copy to the vessel owner.
4. For fishing vessels that are destroyed, dismantled, or sunk and cannot be salvaged as stipulated in Point a, Clause 1, Article 72 of the Fisheries Law, within thirty days from the date of destruction, dismantling, or sinking of the fishing vessel, the vessel owner must return the original Certificate of Fishing Vessel Registration to the registration authority where the fishing vessel is registered (except in cases where the Certificate of Fishing Vessel Registration is lost); the fishing vessel registration authority shall delete the name of the fishing vessel in the National Register of Fishing Vessels.
5. For fishing vessels missing as stipulated in Point b, Clause 1, Article 72 of the Fisheries Law, the registration authority of missing fishing vessels must announce on mass media. Within thirty days after the expiration of one year from the date of announcement, the vessel owner of the missing fishing vessel must return the original Certificate of Fishing Vessel Registration to the registration authority where the fishing vessel is registered (except in cases where the Certificate of Fishing Vessel Registration is lost); the fishing vessel registration authority shall delete the name of the fishing vessel in the National Register of Fishing Vessels.
Article 25. Marking of Fishing Vessels
1. For fishing vessels engaged in fishing with a maximum length from six meters to less than twelve meters, the entire cabin must be painted blue; in case the vessel does not have a cabin, the entire dry side of the vessel must be painted blue.
2. For fishing vessels engaged in fishing with a maximum length from twelve meters to less than fifteen meters, the entire cabin must be painted yellow; in case the vessel does not have a cabin, the entire dry side of the vessel must be painted yellow.
3. For fishing vessels engaged in fishing with a maximum length of fifteen meters or more, the entire cabin must be painted light gray; in case the vessel does not have a cabin, the entire dry side of the vessel must be painted light gray.
Chapter VI. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS
Article 26. Directorate of Fisheries[110]
1. Organize, direct uniformly, guide, and inspect activities related to fishing vessel inspection, registration, and fisheries service vessel registration[111] throughout the country.
2.[112] Annually build plans, organize training for fishing vessel inspectors' professional skills, and announce on the Directorate of Fisheries' website[113]; Organize training sessions, update legal regulations, relevant provisions, standards, and technical specifications.
3. Uniformly manage technical seals and professional stamps in fishing vessel inspection work; issue and revoke technical seals and professional stamps in fishing vessel inspection work for inspection facilities and fishing vessel inspectors nationwide; guide their use and inspect management and use of technical seals and professional stamps used in fishing vessel inspection work.
4. Propose to build new or supplement and amend technical standards and specifications for fishing vessels to be promulgated by competent state agencies and applied nationwide.
Article 27. Departments of Agriculture and Rural Development of provinces and centrally governed cities
1. Organize the implementation of regulations on inspection, registration of fishing vessels, and registration of crew members at the local level.
2. Regularly report to the Fisheries General Department monthly, quarterly, annually, or urgently[114] on the situation of fishing vessel registration according to Form No. 01.BC Appendix X issued together with this Circular.
3. Direct the Fisheries Sub-Department or Port Management Organization to confirm changes in crew members or persons working on fishing vessels in the Fishing Vessel Crew Register.
4.[115] Review, compile, and submit to the provincial People's Committee for publication the list of fishing vessels that have been newly built, modified, bought, or given as gifts before the effective date of this Circular but are currently operating without complete documentation to be registered as required under Clause 2, Clause 3, Clause 4, and Clause 6 of Article 21 and widely announce such information through local mass media.
Article 28. Inspection bases for fishing vessels
1.[116] Enter into the Fishing Vessel Technical Management Logbook, according to Form No. 02.BC Appendix X issued together with this Circular, before issuing the Certificate of Safety Technical Inspection for Fishing Vessels and Fisheries Service Vessels; input data on inspected fishing vessels and fisheries service vessels into the national fishery database "VNFISHBASE" as prescribed.[117] 2. Regularly report monthly, quarterly, annually, or urgently to the Department of Agriculture and Rural Development at the local level and the Fisheries General Department
on the results of reviewing design documents for fishing vessels and fisheries service vessels[118] according to Form No. 03.BC Appendix X issued together with this Circular and the situation of inspection of fishing vessels and fisheries service vessels[119] according to Form No. 04.BC Appendix X issued together with this Circular.[120] 3. Manage and use seals and technical stamps issued according to regulations; supervise the use of technical seals by inspectors under their management. In case the inspection base for fishing vessels is dissolved or transferred to other tasks, the inspection base for fishing vessels shall be responsible for recovering issued seals and technical stamps and returning them to the Fisheries General Department.
4. In case seals become worn out or damaged, the inspection base for fishing vessels must return old seals to the Fisheries General Department[121].
and submit a written request to engrave new seals.[122] Article 29. Bases for building new, modifying fishing vessels
1. Before construction of new, modified, or repaired fishing vessels, they must present the construction technology process to the inspection base for fishing vessels (the place requesting safety technical inspection); comply with inspection and supervision steps as notified by the inspection base for fishing vessels.
2. Regularly or urgently report to the Department of Agriculture and Rural Development at the local level and the Fisheries General Department
on the situation of building new, modifying fishing vessels according to Form No. 05.BC Appendix X issued together with this Circular.[123] Article 30. Inspectors of fishing vessels
1. Manage and use the inspector's card and technical seal for fishing vessel inspection in accordance with the intended purpose and legal regulations.
2. Perform the task of inspecting the safety technical condition of fishing vessels according to their professional technical expertise and in accordance with assigned tasks.
3. Use the technical seal for fishing vessel inspection within the validity period indicated on the inspector's card; if the inspector's card expires, the inspector may only continue using the seal after obtaining a renewed card according to regulations.
Article 31. Owners of fishing vessels and fisheries service vessels
1. Carry the original or certified copy of the Registration Certificate for Fishing Vessels and Fisheries Service Vessels[124]
; the original Safety Technical Inspection Certificate for Fishing Vessels and related documents concerning fishery activities.[125]2. Only operate fishing vessels after receiving the Safety Technical Inspection Certificate and only operate within permitted sea areas.
3. Regularly check the technical condition of the vessel before setting sail for operations.
4. Maintain the technical condition between two inspections and inform the inspector about any damages or incidents discovered, as well as repair measures taken since the last inspection.
5. Mark fishing vessels and paint the vessel number according to regulations and repaint when the number becomes unclear.
5. Marking of fishing vessels shall be carried out in accordance with regulations, including painting the registration number on the vessel and repainting it when the number becomes unclear.
Chapter VII. IMPLEMENTATION PROVISIONS[126]
Article 32. Transitional Provisions
1. Fishery vessel inspectors who were appointed before this Circular takes effect shall continue to maintain their inspector ranks until the expiration date of their inspection certificates.
2. All fishery service vessels[127] must re-register in accordance with the provisions of this Circular before January 1, 2020.
3. Fishing vessels that were in operation before this Circular takes effect must comply with the marking requirements set forth in this Circular before January 1, 2020.
4.[128] In cases where the main engine is a used marine engine installed on fishing vessels prior to the effective date of this Circular, it must be inspected and evaluated according to point e, Clause 3, Article 17 of this Circular; for materials, machinery, and equipment specified in Appendix XI attached to this Circular which do not have a certificate of origin, quality certificate, or conformity certificate, the owner of the fishing vessel must conduct an inspection in accordance with the law before installation on the vessel. The inspection of materials, machinery, and equipment before use and installation shall be carried out from April 1, 2023.
5.[129] The deadline for accepting applications for fishing vessels as stipulated in Clause 6a, Article 21 is December 31, 2024.
Article 33. Effective Date
1. This Circular shall take effect from January 1, 2019.
2. This Circular replaces:
a) Decision No. 96/2007/QD-BNN dated November 28, 2007 of the Ministry of Agriculture and Rural Development promulgating the regulations on fishery vessel inspections;
b) Decision No. 10/2006/QD-BTS dated July 3, 2006 of the Ministry of Fisheries regulating the registration of fishing vessels and crew members;
c) Circular No. 13/2013/TT-BNNPTNT dated February 6, 2013 of the Ministry of Agriculture and Rural Development detailing the regulations on fishery vessel inspectors;
d) Circular No. 02/2007/TT-BTS dated July 13, 2007 of the Ministry of Fisheries guiding the implementation of Decree No. 66/2005/NĐ-CP dated May 19, 2005 of the Government on ensuring safety for people and fishing vessels engaged in fisheries activities;
đ) Decision No. 122/2008/QĐ-BNN dated December 18, 2008 of the Ministry of Agriculture and Rural Development promulgating regulations on sample stamps and technical and operational seal usage procedures in fishery vessel inspection work;
e) Circular No. 25/2013/TT-BNNPTNT dated May 10, 2013 of the Ministry of Agriculture and Rural Development detailing the implementation of certain provisions of Decree No. 33/2010/NĐ-CP dated March 31, 2010 of the Government on managing fishing activities of organizations and individuals in Vietnam's maritime zones and detailing the implementation of Article 3 of Decree No. 53/2012/NĐ-CP dated June 20, 2012 of the Government amending and supplementing certain provisions of decrees in the fisheries sector;
g) Directive No. 54/2008/CT-BNN dated April 21, 2008 of the Ministry of Agriculture and Rural Development on strengthening management of fishing vessels and addressing the issue of unregistered fishing vessels operating in various water areas;
3. This Circular abolishes:
a) Articles 5 and 6 of Circular No. 24/2011/TT-BNNPTNT dated April 6, 2011 of the Ministry of Agriculture and Rural Development amending, supplementing, and abolishing certain administrative procedures in the fisheries sector pursuant to Resolution No. 57/NQ-CP dated December 15, 2010 of the Government;
b) Clause 5, Article 14 and point đ, Clause 2, Article 15 of Circular No. 12/2014/TT-BNNPTNT dated April 8, 2014 of the Ministry of Agriculture and Rural Development detailing the insignia, flags, traditional flags, uniforms, model inspection cards, and paint colors for fishery service vessels;[130].
4. During the implementation process, if any issues arise or difficulties occur, organizations and individuals shall promptly report them to the Fisheries Department[131] for consolidation and reporting to the Minister of Agriculture and Rural Development for consideration and decision.

The Minister of Agriculture and Rural Development issued the Circular amending and supplementing certain circulars in the fisheries sector.
2. Circular No. 06/2024/TT-BNNPTNT dated May 6, 2024 of the Minister of Agriculture and Rural Development amending and supplementing certain articles of Circular No. 23/2018/TT-BNNPTNT dated November 15, 2018 of the Minister of Agriculture and Rural Development regarding fishery vessel inspectors; recognizing inspection facilities; ensuring technical safety of fishing vessels and fishery inspection vessels; registering fishing vessels and fishery service vessels; deregistering fishing vessels and marking fishing vessels, which took effect from May 6, 2024, was issued based on the following grounds:
Pursuant to Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

At the proposal of the Director of the Fisheries Department;
The Minister of Agriculture and Rural Development issued the Circular amending and supplementing certain articles of Circular No. 23/2018/TT-BNNPTNT dated November 15, 2018 of the Minister of Agriculture and Rural Development regarding fishery vessel inspectors; recognizing inspection facilities; ensuring technical safety of fishing vessels and fishery inspection vessels; registering fishing vessels and fishery service vessels; deregistering fishing vessels and marking fishing vessels.
[4] The term "fishery inspection vessel" is replaced by the term "fishery service vessel" in accordance with Clause 17, Article 5 of Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022 of the Minister of Agriculture and Rural Development amending and supplementing certain circulars in the fisheries sector, which took effect from March 4, 2022.
[5] The term "fishery inspection vessel" is replaced by the term "fishery service vessel" in accordance with Clause 17, Article 5 of Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022 of the Minister of Agriculture and Rural Development amending and supplementing certain circulars in the fisheries sector, which took effect from March 4, 2022.
[6] The term "fishery inspection vessel" is replaced by the term "fishery service vessel" in accordance with Clause 17, Article 5 of Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022 of the Minister of Agriculture and Rural Development amending and supplementing certain circulars in the fisheries sector, which took effect from March 4, 2022.

[114] The phrase "Fisheries General Administration" is replaced by the phrase "Fisheries Bureau" pursuant to Clause 2, Article 2 of Circular No. 06/2024/TT-BNNPTNT dated May 6, 2024, issued by the Minister of Agriculture and Rural Development regarding amendments and supplements to some provisions of Circular No. 23/2018/TT-BNNPTNT dated November 15, 2018, issued by the Minister of Agriculture and Rural Development concerning fishery vessel inspectors; recognition of fishery vessel inspection facilities; ensuring technical safety of fishery vessels and fishery surveillance vessels; registration of fishery vessels and fishery service vessels; cancellation of fishery vessel registration and marking of fishery vessels, which took effect on May 6, 2024.
[115] This Clause is supplemented pursuant to Clause 2, Article 1 of Circular No. 06/2024/TT-BNNPTNT dated May 6, 2024, issued by the Minister of Agriculture and Rural Development amending and supplementing some Articles of Circular No. 23/2018/TT-BNNPTNT dated November 15, 2018, issued by the Minister of Agriculture and Rural Development regarding fishery vessel inspectors; recognition of fishery vessel inspection facilities; ensuring technical safety of fishery vessels and fishery surveillance vessels; registration of fishery vessels and fishery service vessels; cancellation of fishery vessel registration and marking of fishery vessels, which took effect from May 6, 2024.
[116] This Clause is amended and supplemented pursuant to Clause 14, Article 5 of Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022, issued by the Minister of Agriculture and Rural Development amending and supplementing some Circulars in the field of fisheries, which took effect from March 4, 2022.
[117] The term "fishery inspection vessel" is replaced by the term "fishery service vessel" in accordance with Clause 17, Article 5 of Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022 of the Minister of Agriculture and Rural Development amending and supplementing certain circulars in the fisheries sector, which took effect from March 4, 2022.

[126] Article 10 of Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022, issued by the Minister of Agriculture and Rural Development to amend and supplement some Circulars in the field of fisheries, which took effect from March 4, 2022, provides as follows:
"Article 10. Effective Date
1. This Circular takes effect from March 4, 2022.
2. Circular No. 13/2020/TT-BNNPTNT dated November 9, 2020, issued by the Minister of Agriculture and Rural Development on amending and supplementing certain provisions of Circular No. 21/2018/TT-BNNPTNT dated November 15, 2018, regarding recording, submitting reports, and logbooks of fishing activities; announcing designated fish ports for confirming the origin of fishery products from fishing; lists of illegal fishing vessels; confirming raw materials and certifying the origin of fishery products from fishing shall cease to be effective from the date this Circular takes effect.
3. During the implementation process, if any issues arise or difficulties occur, organizations and individuals are required to promptly report them to the Fisheries General Department for consolidation and reporting to the Minister of Agriculture and Rural Development for consideration and decision.
Article 3 of Circular No. 06/2024/TT-BNNPTNT dated May 6, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement certain provisions of Circular No. 23/2018/TT-BNNPTNT dated November 15, 2018, issued by the Minister of Agriculture and Rural Development, concerning ship surveyors for fishing vessels; recognizing ship surveying facilities for fishing vessels; ensuring technical safety of fishing vessels and patrol vessels; registering fishing vessels and marine service vessels; deregistering fishing vessels and marking fishing vessels, which will take effect from May 6, 2024, provides as follows:
"Article 3. Implementation Provisions
1. This Circular takes effect from May 6, 2024.
2. During the implementation of this Circular, if there are any difficulties, it is requested that they be reported promptly to the Ministry of Agriculture and Rural Development for guidance, research, and appropriate amendments and supplements.
[127] The term "fishery inspection vessel" is replaced by the term "fishery service vessel" in accordance with Clause 17, Article 5 of Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022 of the Minister of Agriculture and Rural Development amending and supplementing certain circulars in the fisheries sector, which took effect from March 4, 2022.
[128] This Clause was added pursuant to Clause 15, Article 5 of Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022, issued by the Minister of Agriculture and Rural Development to amend and supplement some Circulars in the field of fisheries, which took effect from March 4, 2022.
[129] This Clause was added pursuant to Clause 3, Article 1 of Circular No. 06/2024/TT-BNNPTNT dated May 6, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement certain provisions of Circular No. 23/2018/TT-BNNPTNT dated November 15, 2018, issued by the Minister of Agriculture and Rural Development, concerning ship surveyors for fishing vessels; recognizing ship surveying facilities for fishing vessels; ensuring technical safety of fishing vessels and patrol vessels; registering fishing vessels and marine service vessels; deregistering fishing vessels and marking fishing vessels, which will take effect from May 6, 2024.
