CIRCULAR

REGULATIONS ON THE DESIGNATION, RANK CODES AND QUALIFICATION STANDARDS FOR RANKS OF SPECIALIZED CIVIL SERVANTS IN CIVIL ENFORCEMENT

Circular No. 03/2017/TT-BTP dated April 5, 2017 of the Minister of Justice on the designation, rank codes and qualification standards for ranks of specialized civil servants in civil enforcement, which took effect from May 22, 2017, has been amended and supplemented by:

Circular No. 08/2020/TT-BTP dated December 28, 2020 of the Minister of Justice amending and supplementing certain articles of Circular No. 03/2017/TT-BTP dated April 5, 2017, which took effect from March 1, 2021.

Pursuant to the Law on Public Officials and Civil Servants dated November 13, 2008;

Pursuant to the Civil Enforcement Law 2008; the Law Amending and Supplementing Certain Articles of the Civil Enforcement Law 2014;

Pursuant to Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 22/2013/NĐ-CP dated March 13, 2013, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Pursuant to Decree No. 24/2010/NĐ-CP dated March 15, 2010 of the Government stipulating recruitment, utilization and management of civil servants;

Pursuant to Decree No. 62/2015/NĐ-CP dated July 18, 2015 of the Government detailing and guiding the implementation of certain articles of the Civil Enforcement Law;

On the basis of reaching consensus with the Ministry of Home Affairs regarding the authority to issue and the content of this Circular on the designation, rank codes and qualification standards for ranks of specialized civil servants in civil enforcement at Official Document No. 5463/BNV-CCVC dated November 21, 2016 of the Ministry of Home AffairsThe Minister of Justice issues this Circular on the designation, rank codes;

At the proposal of the Director of the Civil Enforcement General Department;

and qualification standards for ranks of specialized civil servants in civil enforcement as follows: and qualification standards for ranks of specialized civil servants in civil enforcement 1. This Circular stipulates the designation, rank codes and qualification standards for ranks of specialized civil servants in civil enforcement, including Enforcement Officers, Reviewers, and Court Secretaries.[1]

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

2. This Circular applies to persons engaged in civil enforcement work under the General Department of Civil Enforcement, Civil Enforcement Departments of provinces and centrally-administered cities, and Civil Enforcement Sub-departments of districts, towns, urban districts, and sub-cities of provinces and centrally-administered cities.

The time spent working in legal affairs within the civil enforcement agency system includes:

Article 2.

1. Total time worked in the following ranks: Court Secretary, Judicial Reviewer, Judge; Prosecutor, Assistant Prosecutor; Investigator in the Investigation Agency of Public Security Organs, People's Armed Forces, Supreme People's Procuracy; Intermediate-level Detective, Intermediate-level Police Officer of the Public Security Force, Intermediate-level Detective of the Security Force; Officer Investigator, Security Guard in the People's Armed Forces; Enforcement Officer, Civil Enforcement Reviewer, Civil Enforcement Secretary, Intermediate-level Civil Enforcement Secretary; Inspector;

2.[2] Time held in the position of Specialist or equivalent and above in positions requiring a bachelor's degree in law or higher for civil servants and officials working at the Ministry of Justice, Departments of Justice, Justice Offices; the civil enforcement system; judicial, prosecution, inspection, audit, internal affairs, internal security organs or in positions directly implementing legal drafting and implementation work in political organs;

3.[3] Time holding a bachelor's degree in law or higher and leadership positions in Party Committees, People's Councils, People's Committees (at district level or higher);

4. Time obtaining a practice certificate for lawyers and appointment to the title of Notary Public for Notaries.

4. The time for issuing a professional practice certificate for lawyers and appointing the title of judicial scrivener for judicial scriveners.

Article 4. General Standards

1. Possess firm political resolve, steadfast in Marxism-Leninism, Ho Chi Minh Thought, grasp the Party's policies and guidelines; loyal to the State and the Constitution of the Socialist Republic of Vietnam; protect the interests of the country and the people.

2. Fully fulfill the duties of a civil servant as prescribed by law; strictly comply with the assignment of tasks by superiors; adhere to the law, maintain discipline and administrative order; set an example in following internal regulations and rules of the agency.

3. Devoted, responsible, honest, impartial, fair, and exemplary in performing public duties; courteous, cultured, and appropriate in communication and service to the people.

5. Continuously have a sense of learning and training to improve moral qualities, competence, and capabilities.

[4] Civil servants registering to take the examination or being considered for promotion must meet the standards and conditions stipulated in Articles 30 and 31 of Decree No. 138/2020/NĐ-CP dated November 27, 2020 of the Government on recruitment, utilization, and management of civil servants, and other relevant laws.

Chapter II

DUTIES, TASKS AND PROFESSIONAL STANDARDS OF ENFORCEMENT OFFICER RANKS

Article 5. Senior Enforcement Officer Rank

1. Responsibilities

The Senior Enforcement Officer is the highest-ranking civil servant specialized in civil enforcement and administrative enforcement, directly organizing and supervising the execution of particularly complex civil and administrative enforcement cases involving various sectors, levels, localities, or foreign elements within the jurisdiction of the Civil Enforcement Bureau. a) Implement the duties and powers specified in Article 20 of the Civil Enforcement Law;

2. Tasks

b) Organize and direct the implementation of administrative enforcement work according to the law;

c) Lead research, propose programs of work, organizational and operational issues related to civil enforcement and administrative enforcement, measures for guidance and organization of enforcement work;

d) Guide, urge, or assist the head of the civil enforcement agency to guide and urge subordinate civil enforcement agencies under their jurisdiction to implement civil enforcement and laws on civil enforcement and administrative enforcement; receive citizens as prescribed;

e) Develop plans for civil enforcement and organize the implementation of decisions made by the head of the agency regarding civil enforcement; f) Guide the enforcement business for Intermediate Enforcement Officers and Junior Enforcement Officers;

g) Assist the head of the civil enforcement agency in grasping the situation of enforcement work and compliance with laws in enforcement work within their jurisdiction; organize summaries of practical enforcement work and propose solutions to enhance the effectiveness of civil enforcement and administrative enforcement;

h) Study and recommend amendments and supplements to enforcement-related documents, propose improvements to the legal system on civil enforcement and administrative enforcement;

i) Perform other tasks prescribed by law or assigned by the head of the civil enforcement agency.

a) Profoundly understand the Party's policies and state laws, directives, and resolutions of superiors to apply them to civil enforcement and administrative enforcement work; strategic goals for economic, cultural, and social development;

b) Profoundly understand administrative management knowledge and civil enforcement and administrative enforcement laws; skillfully apply principles, systems, and procedures related to civil enforcement business;

3. Professional Qualification Standards

c) Understand the current situation and trends in domestic and international civil enforcement; organize research to manage and process management information;

Have the ability to propose and advise on policy formulation, lead the drafting of legislative projects, ordinances, proposals, and programs related to civil enforcement to submit for review and decision by competent authorities;

Have the ability to coordinate well with relevant agencies in organizing enforcement;

d) d) Have the ability to educate and persuade parties to enforce court judgments and decisions; e) Be proficient in drafting, presenting, defending, and organizing the implementation of projects, proposals, programs, work plans, and teaching materials related to civil enforcement and administrative enforcement work;

g) Have the ability to conduct scientific research, summarize broad topics within the assigned field, propose strategic issues about civil enforcement work and administrative enforcement work; have the ability to analyze, generalize, and synthesize across multiple fields related to enforcement work;

h) For civil servants taking the examination for promotion to Senior Enforcement Officer, they must have led or participated in drafting at least two normative legal documents approved by competent authorities, or have led or participated in researching and drafting at least two scientific research projects at the ministry, sector, or local level that have been accepted and met requirements, or have led or participated in drafting and implementing at least two specialized projects or initiatives effectively within the Civil Enforcement General Department or the civil enforcement organizational system;

i) Civil servants taking the examination for promotion to Senior Enforcement Officer must have held the Intermediate Enforcement Officer rank for five years (60 months) or more.

a) Hold a bachelor's degree in law or higher; b)[5] Hold a certificate in advanced civil enforcement business and state administration knowledge training according to the content and program of the Ministry of Justice. at least two (2) topics, projects, specialized programs or having led and implemented at least two (2) topics, projects, initiatives effectively within the scope of the General Department of Civil Execution or the civil execution organization system;

i) A civil servant applying to upgrade to the Senior Enforcement Officer rank must have held the Intermediate Enforcement Officer rank for at least five (5) years (sixty months);

4. Educational and Training Standards

a) Hold a bachelor's degree in law or higher;

b)[5] Have a certificate in advanced state administration management and civil execution business knowledge according to the content and program of the Ministry of Justice;

c)[6] Hold a degree in Advanced Political Theory or Advanced Administrative Political Theory or a Bachelor's Degree in Politics, or have a certificate confirming equivalent advanced political theory level issued by the competent authority;

d) Possess a foreign language certificate at a level equivalent to Level 4 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam;

đ)[7] Possess a computer skills certificate meeting the basic standard of information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Minister of Information and Communications on Information Technology Skill Standards, or an equivalent applied computer skills certificate;

Article 6. Intermediate Enforcement Officer Rank

1. Responsibilities

The intermediate enforcement officer is a specialized civil servant responsible for enforcing civil and administrative judgments, directly organizing and supervising the enforcement of complex civil and administrative judgment cases involving large amounts of money or assets; enforcement actions related to multiple localities under the jurisdiction of the Civil Enforcement Agency or District Civil Enforcement Agency;

2. Tasks

b) Organize and direct the implementation of administrative enforcement work according to the law;

b) Implement administrative judgment enforcement work in accordance with the law;

c) Develop plans and organize the implementation of civil judgment decisions; propose measures and direct the enforcement of civil judgment decisions within their jurisdiction; perform citizen reception tasks as prescribed;

d) Report on the results of civil and administrative judgment enforcement work; make recommendations and propose measures for organizing civil and administrative judgment enforcement within the assigned functions and tasks;

đ) Provide guidance on business practices for初级级执行员、书记员和中级书记员;

e) Draft guiding documents for enforcement work, compile materials and provide guidance on civil and administrative enforcement business practices;

g) Assist the head of the civil enforcement agency in understanding the situation of enforcement work and the compliance with laws in enforcement work within their jurisdiction according to their assigned duties;

h) Participate in researching and summarizing experiences and practical enforcement situations;

i) Study, recommend amendments and supplements to enforcement-related documents, and propose opinions on improving the enforcement legal system;

k) Perform other tasks as prescribed by law or assigned by the head of the civil enforcement agency;

3. Professional Qualification Standards

a) Be thoroughly familiar with the Party's policies and State laws, directives, and resolutions from superiors to apply them to civil and administrative enforcement work;

b) Have a deep understanding of the content of civil and administrative enforcement laws; skillfully apply principles, systems, and procedures related to civil enforcement business practices;

c) Understand the current situation and trends in domestic and international civil enforcement work; organize research to serve management and information processing;

d) Have the ability to coordinate well with relevant agencies in enforcement work;

g) Have the ability to conduct scientific research, summarize broad topics within the assigned field, propose strategic issues about civil enforcement work and administrative enforcement work; have the ability to analyze, generalize, and synthesize across multiple fields related to enforcement work; decisions of the Competition Dispute Resolution Council and arbitral awards, decisions of commercial arbitration;

e) Have the ability to analyze and synthesize, be proficient in document drafting skills related to assigned responsibilities and tasks, and present on assigned issues;

g) For civil servants applying for promotion to the rank of intermediate enforcement officer, they must be individuals whohave led or participated in drafting at least one legislative document or led, researched, and drafted or participated in researching and drafting at least one research topic, project, program at the ministerial or provincial level that has been issued or accepted and evaluated as meeting requirements by the competent authority, or have successfully led and implemented at least one research topic, project, or initiative within the Civil Enforcement Bureau or District Civil Enforcement Bureau;

h) Civil servants applying for promotion to the rank of intermediate enforcement officer must have held the rank of primary enforcement officer for five years (60 months) or more;

4. Educational and Training Standards

a) Hold a bachelor's degree in law or higher;

b)[8] Hold a certificate in state administration knowledge and civil enforcement business training according to the content and program of the Ministry of Justice;

c) Possess a foreign language certificate at a level equivalent to Level 3 of the Vietnamese foreign language proficiency framework as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam;

d)[9] Possess a computer skills certificate meeting the basic standard of information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Minister of Information and Communications on Information Technology Skill Standards, or an equivalent applied computer skills certificate.

Article 7. Junior Enforcement Officer Rank

1. Responsibilities

A junior enforcement officer is a specialized civil servant responsible for organizing the execution of civil judgments and administrative decisions, directly handling simple cases where the value of money or property to be executed does not exceed the jurisdiction of the Civil Enforcement Agency and its branches.

2. Tasks

b) Organize and direct the implementation of administrative enforcement work according to the law;

b) Implement administrative judgment enforcement work in accordance with the law;

c) Develop plans and implement civil judgment enforcement decisions; perform citizen reception tasks as prescribed;

d) Report on the results of civil judgment and administrative decision enforcement; propose measures to resolve issues;

đ) Provide guidance on enforcement procedures to Secretaries and Intermediate-level Secretaries;

e) Study and propose amendments to enforcement-related documents; contribute suggestions for improving the enforcement legal system;

g) Participate in drafting documents related to civil enforcement work within their assigned field; propose organizational issues concerning civil and administrative enforcement within their authority;

h) Perform other tasks assigned by the head of the enforcement agency;

3. Professional Qualification Standards

a) Be thoroughly familiar with the Party's policies and State laws, directives, and resolutions from superiors to apply them to civil and administrative enforcement work;

b) Master the content of laws on civil enforcement and administrative enforcement, and skillfully apply principles, systems, and procedures in enforcement operations;

c) Understand the economic and social conditions in the locality; be familiar with the area under their responsibility;

d) Possess the ability to coordinate with relevant agencies, units, and individuals in performing assigned tasks;

đ) Possess the ability to educate and persuade parties to comply with court judgments and decisions; decisions of the Competition Dispute Resolution Council and arbitral awards, decisions of commercial arbitration;

e) Possess the ability to draft documents related to their responsibilities and tasks;

g) Candidates for the junior enforcement officer rank must currently hold the Specialist rank or equivalent, with at least three years (36 months) of legal work experience; Cpplying for the junior enforcement officer rank must currently hold the Specialist rank or equivalent, with at least three years (36 months) of legal work experience;

4. Educational and Training Standards

a) Hold a bachelor's degree in law or higher;

b)[10] Hold a certificate in state management knowledge and civil enforcement procedures according to the content and program of the Ministry of Justice;

c) Hold a foreign language certificate at level 2 equivalent to the Vietnamese Foreign Language Proficiency Framework as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 issued by the Ministry of Education and Training;

d)[11] Hold a computer skills certificate meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 issued by the Minister of Information and Communications regarding the Standard for Information Technology Usage or an equivalent application computer skills certificate.

Chapter III

DUTIES, TASKS AND PROFESSIONAL STANDARDS OF THE APPEALS OFFICER RANKS

Article 8. Senior Appeals Officer Rank

1.[12] Responsibilities

A senior appeals officer is the highest-ranking civil servant in the field of appeals in civil enforcement, assisting the head of the civil enforcement management agency in conducting reviews and inspections of significant and complex civil enforcement cases involving multiple levels, sectors, fields, and regions; reviewing, inspecting, and verifying cases involving complaints and reports about civil enforcement and performing other tasks as assigned by the head of the civil enforcement management agency;.

2. Tasks

a) Implement the duties and powers specified in Article 67 of Decree No. 62/2015/NĐ-CP dated July 18, 2015 of the Government detailing and guiding the implementation of certain provisions of the Civil Enforcement Law (hereinafter referred to as Decree No. 62/2015/NĐ-CP);

b)[13] Conduct reviews and inspections of civil enforcement cases that have been and are being executed; develop inspection plans, proactively carry out or cooperate with relevant agencies and units to verify and inspect civil enforcement work according to plans approved by the head of the civil enforcement management agency; During the inspection process, if errors are discovered, they must advise the competent authority to temporarily suspend the execution of erroneous decisions to correct them and bear responsibility for their recommendations; c)[14]

Draft plans for approval by the head of the civil enforcement management agency, organize their implementation or cooperate with relevant agencies and units to review, inspect, verify, and propose solutions for cases involving complaints and reports about civil enforcement and administrative enforcement management according to the directives of the head of the civil enforcement management agency; ) Draft plans, organize implementation, review, verify, compile statistics, report data on civil enforcement and administrative enforcement, and other files and documents related to civil enforcement work of provinces and centrally-administered cities; counties, districts, towns, and cities under provincial and centrally-administered city jurisdictions;

e)[16] Advise the head of the civil enforcement management agency to respond to objections and proposals from the People's Procuratorate within their authority;

g) Review, inspect, and advise on resolving complex complaints and reports related to personnel organization work in the civil enforcement system;

h) Review, inspect, and compile reports related to civil enforcement work; report on business accounting in the civil enforcement system within the entire system;

i) Participate in drafting laws, ordinances, and other regulatory documents related to the functions and tasks of the civil enforcement system;

k)[17] Assist the head of the civil enforcement management agency in directing and guiding the review and inspection of civil enforcement procedures nationwide and proposing measures to ensure the proper and effective organization of civil enforcement in accordance with the law;

l) Participate in researching scientific topics on enforcement work;

m) Participate in developing goals, contents, programs, and training materials for appeals officers in civil enforcement;

m) Participate in developing objectives, contents, programs, textbooks for training and enhancing business skills for the ranks of Civil Execution Review Officers;

n)[18] Perform other tasks as prescribed by law or assigned by the head of the civil enforcement agency.

3. Professional Qualification Standards

a) Be well-versed in the Party's guidelines and policies, state laws, directives, and resolutions from superiors to apply them in civil enforcement work, administrative enforcement work; strategic goals for economic, cultural, and social development;

b) Master and have a deep understanding of administrative management knowledge, have a thorough understanding of the contents of civil enforcement and administrative enforcement laws, laws on handling complaints and denunciations; skillfully apply principles, systems, examination and inspection procedures, complaint and denunciation resolution procedures in civil enforcement work, administrative enforcement work; have a thorough understanding of the contents of civil enforcement and administrative enforcement laws; skillfully apply principles, systems, and procedures related to civil enforcement business operations;

Have the ability to coordinate well with relevant agencies in organizing enforcement;

d) Have the ability to propose and advise on policy formulation, lead in drafting laws, ordinances, projects, programs related to their professional expertise in the field of civil enforcement to submit to competent authorities for consideration and decision;

đ) Be proficient and in control of skills in drafting, presenting, defending, and organizing implementation to build and implement projects, proposals, programs, work plans, teaching materials related to enforcement work in civil enforcement, administrative enforcement, examination and inspection business operations, complaint and denunciation resolution in civil enforcement;

e) Have the ability to conduct scientific research, summarize broad topics within the assigned field, propose strategic issues regarding civil enforcement work, administrative enforcement work; have the ability to analyze, generalize, and synthesize across multiple fields related to enforcement work;

g) For civil servants applying for promotion to Senior Examiner, they must be individuals whohave led in drafting or participated in drafting documents submitted to competent authorities for issuance of at least two (2) legal normative documents or have led in researching, drafting or participating in researching, drafting at least two (2) research topics, projects, programs at the ministry or sector level, local level accepted with satisfactory results or have led b)[5] Hold a certificate in advanced civil enforcement business and state administration knowledge training according to the content and program of the Ministry of Justice. at least two (2) specialized research topics, projects, programs or have led in drafting and implementing achieving effectiveness at least two research topics, projects, innovations within the Civil Enforcement General Bureau or the civil enforcement organizational system;

h)[19] Civil servants applying for promotion to Senior Examiner must have held the position of Chief Examiner or equivalent for at least six years (72 months), including at least one year (12 months) as Chief Examiner up to the deadline for submitting registration forms for the promotion examination.

4. Educational and Training Standards

a) Hold a bachelor's degree in law or higher;

b)[20] Hold a certificate of advanced training in state administration management and civil enforcement business operations according to the content and program of the Ministry of Justice;

c)[21] Hold a degree in Advanced Political Theory or Advanced Political Theory and Administration or a Bachelor's Degree in Political Science or a certificate confirming equivalent advanced political theory qualifications issued by an authorized authority;

d) Hold a foreign language certificate at a level equivalent to Level 4 of the Vietnamese Foreign Language Competency Framework as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the Vietnamese Foreign Language Competency Framework of Six Levels;

đ)[22] Hold an information technology certificate meeting the basic standard for information technology usage skills as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Minister of Information and Communications on Information Technology Usage Standards or an equivalent application information technology certificate.

Article 9. Senior Inspector Rank

1. Responsibilities

A Senior Inspector is a civil servant with specialized expertise in civil enforcement inspection, assisting the head of the agency directly or participating in the inspection of cases that have been and are being enforced, inspecting and checking, verifying complaints and reports regarding civil enforcement matters, and performing other tasks assigned by the head of the civil enforcement management agency or the civil enforcement agency.

2. Tasks

a) Performing duties and exercising powers as prescribed in Article 67 of Decree No. 62/2015/NĐ-CP;

b) Inspecting case files of cases that have been and are being enforced according to approved plans or assignments from the head of the civil enforcement management agency or the civil enforcement agency, proposing solutions and bearing responsibility for their recommendations. During the verification process, if errors are discovered, they must advise the competent authority to temporarily suspend the implementation of erroneous decisions to rectify them and bear responsibility for their suggestions;

c) Developing plans, organizing implementation, or coordinating with related agencies and units to verify, check, and propose measures to resolve assigned tasks;

d) Inspecting and checking statistical reports and data on civil enforcement from mid-level enforcement officers, junior-level enforcement officers, and subordinate civil enforcement agencies;

đ) Advising the head of the civil enforcement management agency or the civil enforcement agency: Responding to protests and suggestions from the People's Public Prosecutor within their jurisdiction; advising on resolving complaints and reports within the jurisdiction of the head of the civil enforcement management agency or the civil enforcement agency;

e) Inspecting, checking, and advising on resolving complaints and reports related to personnel work in the civil enforcement system;

g) Inspecting, checking, compiling reports related to civil enforcement work, and accounting reports on civil enforcement business of subordinate units;

h) Participating in drafting laws, ordinances, and other regulatory documents related to the functions and responsibilities of the civil enforcement organization system;

i) Preparing materials, participating in training for junior-level enforcement officers, inspector ranks, and enforcement clerk ranks;

k) Performing other tasks as prescribed by law or assigned by the head of the agency.

3. Professional Qualification Standards

a) Be thoroughly familiar with the Party's policies and State laws, directives, and resolutions from superiors to apply them to civil and administrative enforcement work;

b) Understanding legal provisions on civil enforcement, administrative enforcement, and laws on handling complaints and reports; skillfully applying principles, systems, procedures for inspection, checking, and resolving complaints and reports in civil enforcement and administrative enforcement work;

c) Understand the current situation and trends in domestic and international civil enforcement work; organize research to serve management and information processing;

d) Possessing analytical and synthesis skills, proficient in document preparation, and presenting issues related to assigned responsibilities;

đ) For civil servants applying for promotion to the Senior Inspector rank must be a person whohave led or participated in drafting at least one legislative document or led, researched, and drafted or participated in researching and drafting at least one research topic, project, program at the ministerial or provincial level that has been issued or accepted and evaluated as meeting requirements by the competent authority, or have successfully led and implemented at least one research topic, project, or initiative within the Civil Enforcement Bureau or District Civil Enforcement Bureau;

h)[23] Civil servants applying for promotion to the Senior Inspector rank must have held the Inspector rank or equivalent for at least nine years (excluding probationary and trial periods), including at least one year (twelve months) as an Inspector, calculated up to the deadline for submitting registration forms for the promotion examination.

4. Educational and Training Standards

a) Hold a bachelor's degree in law or higher;

b)[24] Hold a certificate of training in state administration knowledge and civil enforcement business according to the content and program of the Ministry of Justice;;

c) Possess a foreign language certificate at a level equivalent to Level 3 of the Vietnamese foreign language proficiency framework as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam;

d)[25] Hold a computer proficiency certificate meeting the basic information technology usage standards as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Minister of Information and Communications, or an equivalent application computer certificate.

Article 10. Auditor Rank

1. Responsibilities

An auditor is a civil servant with specialized expertise in the field of auditing the enforcement of civil judgments and administrative judgments, assisting the head of the agency in directly conducting audits on cases that have been and are being enforced, verifying complaints and reports according to the assignment of the head of the agency managing the enforcement of civil judgments and the civil judgment enforcement agency.

2. Tasks

a) Performing duties and exercising powers as prescribed in Article 67 of Decree No. 62/2015/NĐ-CP;

b)[26] Conducting audits on case files that have been and are being enforced by Enforcement Officers according to approved plans or assignments from the head of the agency managing the enforcement of civil judgments and the civil judgment enforcement agency, proposing solutions and being responsible for their own recommendations.;

c)[27] Auditing statistics, reports, and data on the enforcement of civil judgments by Enforcement Officers and subordinate civil judgment enforcement agencies.;

d) Advising the head of the agency managing the enforcement of civil judgments and the civil judgment enforcement agency: Responding to objections and suggestions from the People's Public Prosecutor within their authority regarding simple cases; advising on resolving complaints and reports within the authority of the head of the agency managing the enforcement of civil judgments and the civil judgment enforcement agency.

đ) Auditing, inspecting, and advising on resolving complaints and reports related to organizational and personnel work within the civil judgment enforcement system.

e)[28] Auditing, inspecting, and compiling reports related to the enforcement of civil judgments and administrative judgments.;

g) Advising on drafting laws, ordinances, and other regulatory legal documents related to the functions and tasks of the civil judgment enforcement organization system.

h) Drafting and organizing the implementation of audit work according to the assignment of the head of the agency.

i) Coordinating with relevant agencies and units to carry out audit work on assigned cases in accordance with the law.

k) Performing other tasks assigned by the head of the agency.

3. Professional Qualification Standards

a) Mastering the Party's guidelines and state policies, directives, and resolutions of superiors to apply them to civil judgment enforcement and administrative judgment enforcement work.

b) Mastering legal provisions on civil judgment enforcement, administrative judgment enforcement, laws on handling complaints and reports, and auditing and inspection skills in civil judgment enforcement, as well as complaint and report resolution skills.

c) Understanding the economic and social situation in the locality related to civil judgment enforcement work.

d) Having the ability to coordinate with units and individuals during the performance of tasks.

đ) Mastering the procedures for handling tasks, having writing skills for documents and presenting issues assigned for research and advice.

A civil servant proposed for appointment to the Auditor rank must currently hold the Specialist rank or equivalent and have at least three years (36 months) of experience in legal work.

4. Educational and Training Standards

a) Hold a bachelor's degree in law or higher;

b)[29] Holding a certificate of training in state administration management knowledge and civil judgment enforcement business according to the content and program of the Ministry of Justice.

c) Holding a certificate For power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract.of foreign language proficiency at level 2 equivalent to the Vietnamese Foreign Language Competency Framework as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 issued by the Ministry of Education and Training on the six-level Vietnamese Foreign Language Competency Framework.;

d)[30] Hold a computer proficiency certificate meeting the basic information technology usage standards as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Minister of Information and Communications, or an equivalent application computer certificate.

Chapter IV

DUTIES, TASKS AND SPECIALIZATION STANDARDS OF THE SECRETARY RANK IN CIVIL JUDGMENT ENFORCEMENT

Article 11. Clerk of Enforcement

1.[31] Responsibilities

The Clerk of Enforcement is a specialized civil servant in civil enforcement, responsible for assisting the Enforcement Officer in implementing procedures and formalities in civil enforcement work, administrative enforcement, or assisting the Reviewer in performing tasks to review cases that have been and are being enforced, reviewing and verifying cases with complaints and denunciations regarding civil enforcement as prescribed by law.

2. Tasks

a) Advise and assist the Enforcement Officer in preparing files, formalities, organizing enforcement within the enforcement authority of the provincial or district civil enforcement agency; assist the Enforcement Officer in performing tasks related to administrative enforcement work as prescribed by law, or assist the Reviewer in performing tasks to review cases that have been and are being enforced, and cases with complaints and denunciations regarding civil enforcement as prescribed by law;

b) Record minutes of verification of enforcement; minutes of enforcement resolution; minutes of service; minutes of handling evidence, seized and temporarily detained assets; minutes of asset seizure; minutes of meetings; minutes of asset valuation; minutes of asset status inspection; minutes of destruction of evidence; minutes of forced execution; minutes of property transfer; minutes of returning assets, and other procedural minutes;

c) Assist the Enforcement Officer and the Reviewer in serving enforcement documents;

d) Implement certain verification contents and build civil enforcement files according to the assignment of the Enforcement Officer and the Reviewer;

đ) Coordinate with relevant agencies and units to assist the Enforcement Officer in organizing enforcement work; assist the Reviewer in reviewing civil enforcement cases as assigned by law;

e) Perform other tasks assigned by the head of the enforcement agency.

3. Professional Qualification Standards

a) Master the viewpoints, policies, and guidelines of the Party and the state's policies and laws related to civil enforcement work;

b) Master basic knowledge about legal principles and civil enforcement procedures;

c) Possess the ability to synthesize and propose measures to resolve issues related to the duties of the Clerk of Enforcement;

d) Have skills in drafting documents related to assigned responsibilities and tasks;

đ) Civil servants applying for promotion to the position of Clerk of Enforcement must have held the position of Intermediate Clerk of Enforcement for at least three years (36 months);

4. Educational and Training Standards

a) Hold a bachelor's degree in law or higher;;

b) Hold a certificate of training in state management knowledge and civil enforcement procedures according to the content and program of the Ministry of Justice;

The Intermediate Clerk of Enforcement is a specialized civil servant in civil enforcement, responsible for assisting the Enforcement Officer in implementing procedures and formalities in civil enforcement work, administrative enforcement, or assisting the Reviewer in performing tasks to review cases that have been and are being enforced, reviewing and verifying cases with complaints and denunciations regarding civil enforcement as prescribed by law.

2. Tasks

a) Advise and assist the Enforcement Officer in preparing files, formalities, organizing enforcement within the enforcement authority of the provincial or district civil enforcement agency; assist the Enforcement Officer in performing tasks related to administrative enforcement work as prescribed by law, or assist the Reviewer in performing tasks to review cases that have been and are being enforced, and cases with complaints and denunciations regarding civil enforcement as prescribed by law;

3. Professional Qualification Standards

a) Understand the viewpoints, policies, and guidelines of the Party and the state's policies and laws related to civil enforcement work;

b) Master basic knowledge about legal principles and civil enforcement procedures;

c) Possess the ability to synthesize and propose measures to resolve issues related to the duties of the Intermediate Clerk of Enforcement;

d) Possess the ability to draft documents related to assigned responsibilities and tasks.

4. Educational and Training Standards

a) Hold a high school diploma in law or higher;

b) Hold a certificate of training in state management knowledge and civil enforcement procedures according to the content and program of the Ministry of Justice;

c) Holding a certificate For power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract.foreign language proficiency equivalent to level 1 of the Vietnamese Foreign Language Competency Framework as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 issued by the Ministry of Education and Training on the Vietnamese Foreign Language Competency Framework of six levels;;

d) Hold a computer skills certificate meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 issued by the Minister of Information and Communications on the Standard for Information Technology Usage Skills or an equivalent application computer skills certificate.

Article 12a. Classification of salaries for civil enforcement officers

Civil enforcement officers specified in Circular No. 03/2017/TT-BTP shall apply the Table of Salaries for Professional and Vocational Staff in State Agencies (Table 2) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for cadres, civil servants, public officials, and armed forces (amended and supplemented by Decree No. 17/2013/NĐ-CP dated February 19, 2013 of the Government) as follows:

a) The Senior Enforcement Officer and Senior Review Officer ranks shall apply the salary coefficient for Class A3, Group A3.1 civil servants.

b) The Intermediate Enforcement Officer and Chief Review Officer ranks shall apply the salary coefficient for Class A2, Group A2.1 civil servants.

c) The Junior Enforcement Officer, Review Officer, and Enforcement Clerk ranks shall apply the salary coefficient for Class A1 civil servants.

d) The Intermediate Enforcement Clerk rank shall apply the salary coefficient for Class B civil servants.

Chapter V

IMPLEMENTING PROVISIONS

Article 13. Implementation Organization

1. The professional standards of the ranks of specialized civil servants within the civil enforcement system serve as the basis for recruitment, utilization, appointment, and management of civil servants engaged in civil enforcement work.

2. The training and development standards for Enforcement Officers and Review Officers under the Ministry of National Defense shall be implemented according to the regulations of the Minister of National Defense, ensuring that they are not lower than the standards set for corresponding civil servant ranks stipulated in this Circular.

Article 14. Transitional provisions and implementation clauses

1. The current rank codes of civil enforcement officers holding the Senior Review Officer (code 03.232) and Review Officer (code 03.230) ranks previously shall be transferred to new rank codes as follows:

a) The Senior Review Officer rank (code 03.232) shall be transferred to the Senior Review Officer rank (code 03.230);

b) The Review Officer rank (code 03.230) shall be transferred to the Review Officer rank (code 03.232).

2. From the date this Circular takes effect, appointments to the ranks of specialized civil servants in civil enforcement must comply with the standards set out in this Circular, except for the standards stipulated in point b, Clause 4, Article 8, point b, Clause 4, Article 9, point b, Clause 4, Article 10 which continue to be applied according to the provisions at point c, Clause 4, Sections I, II, III of Decision No. 01/2007/QĐ-BNV dated January 17, 2007 of the Minister of Home Affairs on the issuance of standards for the Review Officer, Senior Review Officer, and Senior Review Officer ranks in civil enforcement until December 31, 2017.

3. Abolish Circular No. 10/2010/TT-BNV dated October 28, 2010 of the Ministry of Home Affairs on the rank codes and professional standards for Enforcement Officers and Enforcement Clerks and Decision No. 01/2007/QĐ-BNV dated January 17, 2007 of the Minister of Home Affairs on the issuance of standards for the Review Officer, Senior Review Officer, and Senior Review Officer ranks in civil enforcement.

4. From the date this Circular takes effect, certificates of vocational training for ranks already issued according to point b, Clause 4, Article 5, point b, Clause 4, Article 6, point b, Clause 4, Article 7, point b, Clause 4, Article 8, point b, Clause 4, Article 9, point b, Clause 4, Article 10, point b, Clause 4, Article 11 of Circular No. 03/2017/TT-BTP dated April 5, 2017 of the Minister of Justice on the titles, rank codes, and professional standards for the ranks of specialized civil servants in civil enforcement shall continue to be valid for promotion to corresponding ranks.

Certificates of training in state administration knowledge and civil enforcement vocational skills at the advanced level may be used for examination and promotion to the Senior Specialist, Senior Enforcement Officer, and Senior Review Officer ranks; certificates of training in state administration knowledge and civil enforcement vocational skills at the chief level may be used for examination and promotion to the Chief Specialist, Intermediate Enforcement Officer, and Chief Review Officer ranks; certificates of training in state administration knowledge and civil enforcement vocational skills may be used for examination and promotion to the Specialist, Junior Enforcement Officer, Review Officer, Enforcement Clerk, and Intermediate Enforcement Clerk ranks.

5. Time spent obtaining a bachelor's degree in law, performing tasks related to civil enforcement accounting, and holding an accounting officer rank or higher for civil servants in the civil enforcement system before the Circular No. 78/2020/TT-BTC dated August 14, 2020 of the Minister of Finance guiding civil enforcement accounting becomes effective shall be counted as time spent in legal work.

6. For promotion plans approved before the date this Circular takes effect, they shall continue to be implemented according to the approved plans within six months from the date this Circular takes effect. After this period, if the promotion has not been organized, it shall be carried out according to this Circular.

7. Entrust the Academy of Judicial Science to take the lead and coordinate with the Civil Enforcement General Department to develop training and development programs as prescribed in this Circular; conversion programs for those who have obtained vocational training certificates in civil enforcement prior to the effectiveness of this Circular, certificates of administrative or other specialized civil servant training to obtain certificates according to this Circular.

Article 15. Effective Date

1. This Circular takes effect from May 22, 2017.

2. Heads of units under the Ministry of Justice, heads of local civil enforcement agencies, and Directors of the Civil Enforcement Department of the Ministry of National Defense within their assigned duties and powers are responsible for organizing and implementing the provisions of this Circular.

[13] This Point has been amended and supplemented pursuant to Clause 7, Article 1 of Circular No. 08/2020/TT-BTP amending and supplementing certain articles of Circular No. 03/2017/TT-BTP dated April 5, 2017 of the Minister of Justice stipulating job titles, grade codes, and professional standards for grades of specialized civil servants in civil enforcement, which shall take effect from March 1, 2021.

[38] This point has been amended and supplemented pursuant to Clause 19, Article 1 of Circular No. 08/2020/TT-BTP amending and supplementing certain provisions of Circular No. 03/2017/TT-BTP dated April 5, 2017 issued by the Minister of Justice on job titles, grade codes, and professional standards for civil enforcement grades, which shall take effect from March 1, 2021.

[39] This article has been added pursuant to Clause 20, Article 1 of Circular No. 08/2020/TT-BTP amending and supplementing certain provisions of Circular No. 03/2017/TT-BTP dated April 5, 2017 issued by the Minister of Justice on job titles, grade codes, and professional standards for civil enforcement grades, which shall take effect from March 1, 2021.

[40] This clause has been added pursuant to Clause 21, Article 1 of Circular No. 08/2020/TT-BTP amending and supplementing certain provisions of Circular No. 03/2017/TT-BTP dated April 5, 2017 issued by the Minister of Justice on job titles, grade codes, and professional standards for civil enforcement grades, which shall take effect from March 1, 2021.

[41] This clause has been added pursuant to Clause 21, Article 1 of Circular No. 08/2020/TT-BTP amending and supplementing certain provisions of Circular No. 03/2017/TT-BTP dated April 5, 2017 issued by the Minister of Justice on job titles, grade codes, and professional standards for civil enforcement grades, which shall take effect from March 1, 2021.

[42] This clause has been added pursuant to Clause 21, Article 1 of Circular No. 08/2020/TT-BTP amending and supplementing certain provisions of Circular No. 03/2017/TT-BTP dated April 5, 2017 issued by the Minister of Justice on job titles, grade codes, and professional standards for civil enforcement grades, which shall take effect from March 1, 2021.

[43] This clause has been added pursuant to Clause 21, Article 1 of Circular No. 08/2020/TT-BTP amending and supplementing certain provisions of Circular No. 03/2017/TT-BTP dated April 5, 2017 issued by the Minister of Justice on job titles, grade codes, and professional standards for civil enforcement grades, which shall take effect from March 1, 2021.

[44] Article 2 of Circular No. 08/2020/TT-BTP amending and supplementing certain provisions of Circular No. 03/2017/TT-BTP dated April 5, 2017 issued by the Minister of Justice on job titles, grade codes, and professional standards for civil enforcement grades, which shall take effect from March 1, 2021, provides as follows:

Article 2. Implementation clause

1. This Circular takes effect from March 1, 2021.

2. The heads of units under the Ministry of Justice, the heads of local civil enforcement agencies, and the Director of the Civil Enforcement Department of the Ministry of National Defense shall be responsible for implementing this Circular within their respective duties and authorities.
