Regulations on quality inspection for technical safety and environmental protection of imported motorcycles and engines used for manufacturing and assembling motorcycles
Circular No. 44/2012/TT-BGTVT dated October 23, 2013, issued by the Minister of Transport, stipulates regulations on quality inspection for technical safety and environmental protection of imported motorcycles and engines used for manufacturing and assembling motorcycles, which took effect from January 1, 2013, and has been amended and supplemented by:
1. Circular No. 49/2023/TT-BGTVT dated December 31, 2023, issued by the Minister of Transport, amending and supplementing certain articles of Circulars in the field of quality inspection for technical safety and environmental protection of motor vehicles, specialized motor vehicles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines, and electric bicycles produced, assembled, and imported, which took effect from February 15, 2024.
On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;
Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;
Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;
Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
At the proposal of the Director of the Science and Technology Department and the Director of the Vietnam Vehicle Inspection Agency,
The Minister of Transport issues this Circular to stipulate regulations on quality inspection for technical safety and environmental protection of imported motorcycles and engines used for manufacturing and assembling motorcycles.[1]
Chapter I. GENERAL PROVISIONS
Article 1. Scope of Regulation
1. This Circular stipulates the inspection of the quality for technical safety and environmental protection of imported complete motorcycles (hereinafter referred to as "vehicles") and imported complete engines (hereinafter referred to as "engines") used for manufacturing and assembling motorcycles.
2. This Circular does not apply to:
a) Vehicles and engines imported for national defense and security purposes of the Ministry of National Defense and the Ministry of Public Security;
b) Vehicles imported for other purposes not intended for road traffic.
Article 2. Applicability
This Circular applies to organizations and individuals importing vehicles and engines, and relevant agencies and organizations involved in managing, inspecting, and testing vehicles and engines.
Article 3. Explanation of Terms
In this Circular, the following terms shall be understood as follows:
1.[2] Motorcycles are types of motorized vehicles operating on roads as defined in National Technical Regulation QCVN 14:2015/BGTVT - National Technical Regulation on Quality for Technical Safety and Environmental Protection for Motorcycles.
2. Same type vehicles and engines are vehicles and engines of the same industrial owner, same brand, design, and technical specifications, manufactured on the same production line.
3. Quality Inspection Authority The Vietnam Vehicle Registration Agency under the Ministry of Transport is the State Quality Inspection Authority responsible for organizing management, inspection of quality for technical safety and environmental protection for vehicles and engines within the scope regulated by this Circular (hereinafter referred to as the Quality Inspection Authority).
4. testing facility is an organization that meets the conditions and is designated to conduct vehicle and vehicle component testing according to corresponding national technical standards and related regulatory documents.
Chapter II. PROCEDURE AND CONTENT OF TECHNICAL QUALITY SAFETY AND ENVIRONMENTAL PROTECTION INSPECTION
Article 4. Registration dossier for inspection
1. The registration dossier for vehicle inspection includes:
a) The vehicle quality inspection registration form (hereinafter referred to as the Inspection Registration Form) according to the model attached to this Circular; Appendix I accompanying this Circular;
b)[3] (Repealed)
c) Technical specification documentation provided by the manufacturer for the imported vehicle type, including key parameters such as dimensions, weight, number of passengers allowed, maximum speed, drive type, clutch type, transmission type, tire markings, and basic engine technical specifications: maximum power at engine speed, engine displacement, fuel type;
d) A certified copy by the importing organization or individual of one of the following documents related to emissions (if available):
- Emission testing report issued by foreign competent authorities for the vehicle type, which includes the results of tests prescribed in current national technical standards;
- Certificate from foreign competent authorities confirming that the vehicle type meets emission regulations equivalent to or stricter than current national technical standards;
Requirements for emission-related documentation do not apply to the subjects specified in Clause 5, Article 5 of this Circular. Clause 5 of Article 5 of this Circular.
d) Vehicle technical specification declaration form (only applicable if the technical specification documentation does not contain all the information required under point c of this clause) according to the model attached to this Circular. 2. The registration dossier for engine inspection includes:
a) The engine quality inspection registration form (hereinafter referred to as the Inspection Registration Form) according to the model attached to this Circular; Appendix I accompanying this Circular;
b) Certified copies of import documents by the importing organization or individual including: Import Declaration, commercial invoice, or other documents related to the value of goods;
c) Technical specification documentation provided by the manufacturer for the imported engine, including key parameters such as maximum torque, maximum power at engine speed, cylinder diameter, piston stroke, engine displacement, fuel type, clutch type, transmission ratio;
d) Engine technical specification declaration form (only applicable if the technical specification documentation does not contain all the information required under point c of this clause) according to the model attached to this Circular. ANNEX III Enterprises importing tobacco raw materials and cigarette paper for producing tobacco products for export or processing tobacco products for export shall submit registration applications according to Form
3. Cases exempted from or reduced in the registration dossier for inspection:
a) Vehicle types or engines already inspected and certified by the Quality Control Agency are exempted from the items specified in points c, d, đ of Clause 1 and points c, d of Clause 2 of this Article.
b) Documents such as: Import Declaration; Technical Specification Declaration; Emission-related documentation can be submitted by the importing organization or individual before the inspection process begins.
Article 5. Method and Content of Inspection
1. Inspection method: Inspection is carried out through sampling inspection and testing for each batch of imported vehicles of the same type (hereinafter referred to as the batch). The sample is selected randomly by the Quality Control Agency from within a batch. The number of samples depends on the quantity of goods in a batch and is defined as follows:

2.[4] Inspection and Testing Content:
a) Vehicle inspection and testing content is conducted in accordance with the provisions of National Technical Regulation QCVN 14:2015/BGTVT.
Where:
Exemption from separate testing of parts as stipulated in sections: 2.4.1; 2.4.2; 2.6.1; 2.6.2; 2.11.2; 2.15.3; 2.16.3; 2.18.1.5; 2.18.2.1; 2.18.2.4.
Emission testing of vehicles as stipulated in section 2.19.1 is conducted when: The vehicle lacks emission-related documentation as specified in Point d, Clause 1, Article 4 of this Circular; The vehicle has emission-related documentation but it does not fully reflect the applicable tests for that vehicle type as prescribed in National Technical Regulation QCVN 04:2009/BGTVT "National Technical Regulation on Emissions for New Motorcycles and Motorized Vehicles" for motorcycles and motorized vehicles (excluding two-wheeled motorcycles) or National Technical Regulation QCVN 77:2014/BGTVT "National Technical Regulation on Emissions Level 3 for New Two-Wheeled Motorcycles"; The vehicle structure does not match the emission-related documentation. Exemption from vapor test as stipulated in QCVN 04:2009/BGTVT or QCVN 77:2014/BGTVT for motorcycles and motorized vehicles.b) Engine inspection and testing content is conducted in accordance with the provisions of National Technical Regulation QCVN 37:2010/BGTVT - National Technical Regulation on Motorcycle and Motorized Vehicle Engines or QCVN 90:2019/BGTVT - National Technical Regulation on Electric Motorcycle and Motorized Vehicle Engines.
3. Sample testing is conducted at testing facilities. After completion of testing, the test report is transferred to the Quality Control Agency, and the tested sample will be returned to the importing organization or individual.
4. Exemption from sample testing in the following cases:
a) Vehicle types that have been inspected under agreements or mutual recognition arrangements on standards and conformity that Vietnam has signed;
b) For vehicle types and engines imported by the same organization or individual, which have already been tested and certified.
In cases where batches belonging to the subjects mentioned in points a and b of this clause show signs of non-compliance with quality requirements, the Quality Control Agency shall conduct sample testing, inspection, and certification as stipulated in Clauses 1, 2, and 3 of this Article.
5. Inspection of imported vehicles and temporarily imported vehicles not for commercial purposes
a) Applies to the following cases:
- Imported vehicles under asset transfer regulations;
- Imported vehicles as non-repayable aid or gifts to organizations, institutions, or individuals;
- Imported vehicles as per special regulations of the Prime Minister.
- Imported vehicles are aid or non-repayable gifts for agencies, organizations, or individuals;
- Imported vehicles in accordance with special regulations of the Prime Minister.
b) Content to be inspected: confirmation of general parameters of the vehicle: type of equipment, condition of the equipment, brand, model number, country of production, year of production, chassis number, engine number, overall dimensions, wheelbase, engine type, engine displacement and maximum power, clutch type, transmission, drive system, fuel type, gross weight, total weight, number of passengers allowed, tire marking, brake type.
Article 6. Procedures and formalities for issuing the Certificate of Import Quality and Recall[5]
1.[6] The importer shall prepare one set of registration documents for inspection in accordance with the provisions at Article 4 of this Circular and submit them to the Inspection Authority either directly, through postal services, or via the National Single Window Portal.
2.[7] Upon receipt of the registration documents for inspection, the Inspection Authority will accept and review the contents of the documents and notify the importer of the results within one working day from the date of receipt. If the registration documents for inspection are complete according to the regulations, the Inspection Authority will confirm on the Registration Form. In case the registration documents for inspection are incomplete according to the regulations, the Inspection Authority will return the documents upon notification to the importer and provide guidance for supplementation and completion.
Within three working days from the date of receiving the inspection request, the Inspection Authority will agree with the importer on the time and location of the inspection.
3. The Inspection Authority conducts inspections of imported vehicles and engines at the agreed location with the importer. Within four working days from the end of the inspection and upon submission of complete documents as required, the Inspection Authority issues the Certificate of Import Quality or Notification of Non-Conformity as follows:
a)[8] For vehicles and engines that meet quality standards and have complete documents as required, the Inspection Authority will issue the Certificate of Import Quality according to the corresponding form at Appendix IVa and IVb Enterprises importing tobacco raw materials and cigarette paper for producing tobacco products for export or processing tobacco products for export shall submit registration applications according to Form
During the inspection process, if the Inspection Authority receives official information from the vehicle manufacturer or foreign vehicle management authority regarding recall (repair and rectify defects) of vehicles, the Inspection Authority will only issue the Certificate of Import Quality after the importer provides a commitment letter accompanied by a confirmation document from the manufacturer or authorized repair facility stating that the imported vehicle has completed the necessary repairs and meets safety requirements.
b)[9] For vehicles and engines that do not comply with the provisions of this Circular, the Inspection Authority will issue the Notification of Non-Conformity according to the corresponding form at the following Appendix Va and Vb Enterprises importing tobacco raw materials and cigarette paper for producing tobacco products for export or processing tobacco products for export shall submit registration applications according to Form
c)[10] For used vehicles (except those temporarily imported for non-commercial purposes as stipulated in Clause 5 of Article 5 of this Circular) or vehicles with chassis numbers or engine numbers that have been erased, altered, or tampered with, the Inspection Authority will handle as follows: Suspend all inspection and certification procedures for technical safety and environmental protection of imported vehicles, and record the violation in a report according to the model prescribed in Appendix VI promulgated together with this Circular.
Within no more than three (3) working days from the date of recording the violation, the Inspection Authority will notify the importer and the Customs Authority (where import procedures were handled) in writing to resolve the matter according to the regulations.
d)[11] In cases where imported vehicles suffer damage during transportation from abroad to Vietnam, the importer may be permitted to repair the following items: superficial scratches or localized oxidation on the paint layer without rot or holes; cracked or broken rearview mirrors; damaged headlight and signal systems; missing relays; non-functioning batteries.
4.[12] For imported vehicles or engines subject to recall as specified in Clause 1, Article 8 of Circular No. 03/2018/TT-BGTVT dated January 10, 2018, issued by the Minister of Transport on technical safety and environmental protection inspection for imported automobiles under Decree No. 116/2017/NĐ-CP (Circular No. 03/2018/TT-BGTVT), the recall procedure shall be carried out in accordance with Clause 2, Article 8 of Circular No. 03/2018/TT-BGTVT.”
Chapter III. IMPLEMENTING PROVISIONS
Article 7. Responsibilities of organizations and individuals importing
1. Bear responsibility for the accuracy and honesty of the submitted documents.
2. Present the vehicle and engine in their original condition for the Inspection Agency to conduct inspection and testing at the agreed location between the Inspection Agency and the importing organization or individual.
3. Pay all fees and charges for inspection, testing, and issuance of quality certificates in accordance with current regulations.
Article 8. Responsibilities of the Vietnam Motor Vehicle Registration Agency
1. Guide organizations and individuals importing vehicles and engines on ensuring technical safety and environmental protection requirements.
2. Uniformly issue and manage quality certificates.
3. Organize inspections and tests of vehicles and engines according to current national technical standards.
4. Guide the procedures for inspecting technical safety and environmental protection quality in accordance with this Circular.
5. Collect revenues related to inspection and issuance of quality certificates in accordance with current regulations.
6. Retain import vehicle and engine inspection files for three years from the date of issuing the quality certificate.
7. Regularly compile results of imported vehicle and engine quality inspections and report to the Ministry of Transport.
Article 9. Effective Date[13]
1. This Circular takes effect from January 1, 2013.
2. The following consolidated documents are abolished:
a) Decision No. 57/2007/QĐ-BGTVT dated November 21, 2007, issued by the Minister of Transport, providing regulations on the inspection of technical safety and environmental protection quality for imported motorcycles and engines used for motorcycle production and assembly.
b) Clause 1 of Circular No. 29/2011/TT-BGTVT dated April 15, 2011, issued by the Minister of Transport, amending and supplementing certain provisions of the regulations on the inspection of technical safety and environmental protection quality for imported motorcycles and engines used for motorcycle production and assembly, as stipulated in Decision No. 57/2007/QĐ-BGTVT dated November 21, 2007, and the regulations on the inspection of technical safety and environmental protection quality during motorcycle production and assembly, as stipulated in Decision No. 58/2007/QĐ-BGTVT dated November 21, 2007, both issued by the Minister of Transport.
3. Quality certificates issued before the effective date of this Circular remain valid.
4. In cases where referenced documents in this Circular are amended or supplemented, the new versions shall be applied.
Article 10. Implementation Organization[14]
The Director of the Ministry's Office, the Inspector General, Heads of Departments, the Director of the Vietnam Motor Vehicle Registration Agency, and Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.

Pursuant to the Road Traffic Law dated November 13, 2008;

||| The Minister of Transport and the Minister of Finance jointly issue this Circular guiding the valuation methods and price management of public goods and services in the field of inland waterway management and maintenance carried out under the government procurement method using central budget funds.
AT THE SUGGESTION OF the Director of the Science and Technology Department and the Director of the Vietnam Vehicle Inspection Agency, the Minister of Transport issues this Circular to amend and supplement certain Articles of Circular No. 23/2009/TT-BGTVT dated October 15, 2009 of the Minister of Transport on technical quality and environmental safety inspection for specialized motor vehicles (hereinafter referred to as Circular No. 23/2009/TT-BGTVT), Circular No. 44/2012/TT-BGTVT dated October 23, 2012 of the Minister of Transport on technical quality and environmental safety inspection for imported motorcycles and engines used for motorcycle production and assembly (hereinafter referred to as Circular No. 44/2012/TT-BGTVT), and Circular No. 41/2013/TT-BGTVT dated November 5, 2013 of the Minister of Transport on technical quality and environmental safety inspection for electric bicycles (hereinafter referred to as Circular No. 41/2013/TT-BGTVT).
Circular No. 42/2018/TT-BGTVT amending and supplementing certain Articles of Circulars in the field of vehicle inspection is based on the following grounds:
“On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;
Pursuant to the Law on Inland Waterway Traffic dated June 15, 2004;
Pursuant to the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Traffic dated June 17, 2014;
BASED ON The Maritime Code dated November 25, 2015;
Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;
Pursuant to the Environmental Protection Law on June 23, 2014;
BASED ON Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Product Quality Law and Decree No. 74/2018/NĐ-CP dated May 15, 2018 amending and supplementing certain provisions of Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Product Quality Law;
Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Considering the proposal of the Director of the Science and Technology Department and the Director of the Vietnam Vehicle Inspection Agency;
THE MINISTER OF TRANSPORT issues this Circular to amend and supplement certain Articles of Circulars in the field of vehicle inspection.
Circular No. 49/2023/TT-BGTVT dated December 31, 2023 of the Minister of Transport amending and supplementing certain Articles of Circulars in the field of technical quality and environmental safety inspection for motor vehicles, specialized motor vehicles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines, and electric bicycles produced, assembled, and imported is based on the following grounds:
Pursuant to the Road Traffic Law dated November 13, 2008;
Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;
Pursuant to the Environmental Protection Law dated November 17, 2020;
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;
BASED ON Decree No. 74/2018/NĐ-CP dated May 15, 2018 amending and supplementing certain provisions of Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Product Quality Law;
BASED ON Decree No. 13/2022/NĐ-CP dated January 21, 2022 of the Government amending and supplementing certain provisions of Decree No. 132/2008/NĐ-CP dated December 31, 2008, Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government detailing the implementation of certain provisions of the Product Quality Law, and Decree No. 86/2012/NĐ-CP dated October 19, 2012 of the Government detailing and guiding the implementation of certain provisions of the Metrology Law;
BASED ON Decree No. 69/2018/NĐ-CP dated May 15, 2018 of the Government promulgating the Decree detailing certain provisions of the Foreign Trade Management Law;
BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;
At the proposal of the Director of the Science, Technology, and Environment Department and the Director of the Vietnam Registration Agency;
THE MINISTER OF TRANSPORT issues this Circular to amend and supplement certain Articles of Circulars in the field of technical quality and environmental safety inspection for motor vehicles, specialized motor vehicles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines, and electric bicycles produced, assembled, and imported.
[2] This Clause is amended and supplemented according to the provisions of Clause 1, Article 9 of Circular No. 49/2023/TT-BGTVT dated December 31, 2023 of the Minister of Transport amending and supplementing certain Articles of Circulars in the field of technical quality and environmental safety inspection for motor vehicles, specialized motor vehicles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines, and electric bicycles produced, assembled, and imported, which shall take effect from February 15, 2024.
[3] This Point is abolished according to the provisions of Clause 1, Article 6 of Circular No. 42/2018/TT-BGTVT amending and supplementing certain Articles of Circulars in the field of vehicle inspection, which shall take effect from October 15, 2018.
[4] This Clause is amended and supplemented according to the provisions of Clause 2, Article 9 of Circular No. 49/2023/TT-BGTVT dated December 31, 2023 of the Minister of Transport amending and supplementing certain Articles of Circulars in the field of technical quality and environmental safety inspection for motor vehicles, specialized motor vehicles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines, and electric bicycles produced, assembled, and imported, which shall take effect from February 15, 2024.
[5] The name of this Article is amended according to the provisions of Point a, Clause 3, Article 9 of Circular No. 49/2023/TT-BGTVT dated December 31, 2023 of the Minister of Transport amending and supplementing certain Articles of Circulars in the field of technical quality and environmental safety inspection for motor vehicles, specialized motor vehicles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines, and electric bicycles produced, assembled, and imported, which shall take effect from February 15, 2024.
[6] This Clause is amended according to the provisions of Clause 2, Article 6 of Circular No. 42/2018/TT-BGTVT amending and supplementing certain Articles of Circulars in the field of vehicle inspection, which shall take effect from October 15, 2018.
[7] This Clause is amended and supplemented according to the provisions of Point b, Clause 3, Article 9 of Circular No. 49/2023/TT-BGTVT dated December 31, 2023 of the Minister of Transport amending and supplementing certain Articles of Circulars in the field of technical quality and environmental safety inspection for motor vehicles, specialized motor vehicles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines, and electric bicycles produced, assembled, and imported, which shall take effect from February 15, 2024.
[8] This Point is amended according to the provisions of Clause 3, Article 6 of Circular No. 42/2018/TT-BGTVT amending and supplementing certain Articles of Circulars in the field of vehicle inspection, which shall take effect from October 15, 2018.
[9] This point has been amended and supplemented pursuant to Point c, Clause 3, Article 9 of Circular No. 49/2023/TT-BGTVT dated December 31, 2023, issued by the Minister of Transport to amend and supplement certain articles of several Circulars in the field of quality and technical safety inspection and environmental protection for motor vehicles, specialized motorcycles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines, and electric bicycles produced, assembled, and imported, which shall take effect from February 15, 2024.
[10] This point has been supplemented pursuant to Clause 1, Article 2 of Circular No. 19/2014/TT-BGTVT amending and supplementing certain articles of Circular No. 23/2009/TT-BGTVT dated October 15, 2009, issued by the Minister of Transport on the quality and technical safety inspection and environmental protection for specialized motorcycles, Circular No. 44/2012/TT-BGTVT dated October 23, 2012, issued by the Minister of Transport on the quality and technical safety inspection and environmental protection for imported motorcycles and motorbikes and imported engines used for producing and assembling motorcycles and motorbikes, and Circular No. 41/2013/TT-BGTVT dated November 5, 2013, issued by the Minister of Transport on the quality and technical safety inspection for electric bicycles, which shall take effect from July 15, 2014.
[11] This point has been supplemented pursuant to Point d, Clause 3, Article 9 of Circular No. 49/2023/TT-BGTVT dated December 31, 2023, issued by the Minister of Transport to amend and supplement certain articles of several Circulars in the field of quality and technical safety inspection and environmental protection for motor vehicles, specialized motorcycles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines, and electric bicycles produced, assembled, and imported, which shall take effect from February 15, 2024.
[12] This clause has been supplemented pursuant to Point e, Clause 3, Article 9 of Circular No. 49/2023/TT-BGTVT dated December 31, 2023, issued by the Minister of Transport to amend and supplement certain articles of several Circulars in the field of quality and technical safety inspection and environmental protection for motor vehicles, specialized motorcycles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines, and electric bicycles produced, assembled, and imported, which shall take effect from February 15, 2024.
[13] Article 4 of Circular No. 19/2014/TT-BGTVT amending and supplementing certain articles of Circular No. 23/2009/TT-BGTVT dated October 15, 2009, issued by the Minister of Transport on the quality and technical safety inspection and environmental protection for specialized motorcycles, Circular No. 44/2012/TT-BGTVT dated October 23, 2012, issued by the Minister of Transport on the quality and technical safety inspection and environmental protection for imported motorcycles and motorbikes and imported engines used for producing and assembling motorcycles and motorbikes, and Circular No. 41/2013/TT-BGTVT dated November 5, 2013, issued by the Minister of Transport on the quality and technical safety inspection for electric bicycles, which shall take effect from July 15, 2014, provides as follows:
“Article 4. Effective date
This Circular shall take effect from July 15, 2014.”
Article 10 of Circular No. 42/2018/TT-BGTVT amending and supplementing certain articles of several Circulars in the field of vehicle inspection, which shall take effect from October 15, 2018, provides as follows:
“Article 10. Effective Date
1. This Circular shall take effect from October 15, 2018.
2. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Vehicle Inspection Bureau, the Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular./.”
g) Specialized motorcycles produced and assembled shall comply with the provisions of Circular No. 89/2015/TT-BGTVT, Circular No. 42/2018/TT-BGTVT, and Circular No. 23/2020/TT-BGTVT.”
Article 10 and Article 11 of Circular No. 49/2023/TT-BGTVT dated December 31, 2023, issued by the Minister of Transport to amend and supplement certain provisions of circulars in the field of quality and technical safety inspection and environmental protection for motor vehicles, special-purpose motorcycles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines, and electric bicycles produced, assembled, and imported shall take effect from February 15, 2024, and are stipulated as follows:
"Article 10. Effective Date
1. This Circular takes effect from February 15, 2024.
2. For imported electric bicycles; imported motorcycles, imported motor vehicle engines, and imported motorcycle engines that arrive at Vietnamese ports or border gates before this Circular takes effect, the following shall apply:
a) Imported electric bicycles shall be implemented according to the provisions of Circular No. 41/2013/TT-BGTVT, Circular No. 19/2014/TT-BGTVT, Circular No. 42/2018/TT-BGTVT, and Circular No. 16/2022/TT-BGTVT;
b) Imported motorcycles and imported motor vehicle engines shall be implemented according to the provisions of Circular No. 44/2012/TT-BGTVT, Circular No. 19/2014/TT-BGTVT, and Circular No. 42/2018/TT-BGTVT.
3. Design approval files, product registration files, or certification registration files of types of motor vehicles, electric bicycles produced and assembled, and parts used for motor vehicles submitted before this Circular takes effect shall be implemented as follows:
a) Domestic production and assembly of passenger cars within the scope of Decree No. 116/2017/ND-CP dated October 17, 2017, of the Government on conditions for production, assembly, importation, and warranty and maintenance services for passenger cars (hereinafter referred to as Decree No. 116/2017/ND-CP), and parts used for passenger cars shall be implemented according to the provisions of Circular No. 25/2019/TT-BGTVT;
b) Domestic production and assembly of passenger cars not within the scope of Decree No. 116/2017/ND-CP, semi-trailers, and trailer trucks, and parts used for passenger cars shall be implemented according to the provisions of Circular No. 30/2011/TT-BGTVT, Circular No. 54/2014/TT-BGTVT, and Circular No. 16/2022/TT-BGTVT;
c) Domestic production and assembly of motorcycles and parts used for motorcycles shall be implemented according to the provisions of Circular No. 45/2012/TT-BGTVT, Circular No. 42/2018/TT-BGTVT, and Circular No. 16/2022/TT-BGTVT;
d) Domestic production and assembly of four-wheeled cargo vehicles with engines and parts used for four-wheeled cargo vehicles with engines shall be implemented according to the provisions of Circular No. 16/2014/TT-BGTVT, Circular No. 42/2018/TT-BGTVT, and Circular No. 16/2022/TT-BGTVT;
đ) Domestic production and assembly of electric bicycles shall be implemented according to the provisions of Circular No. 41/2013/TT-BGTVT, Circular No. 19/2014/TT-BGTVT, Circular No. 42/2018/TT-BGTVT, and Circular No. 16/2022/TT-BGTVT;
e) Domestic production and assembly of four-wheeled passenger vehicles with engines shall be implemented according to the provisions of Circular No. 86/2014/TT-BGTVT, Circular No. 42/2018/TT-BGTVT, and Circular No. 16/2022/TT-BGTVT;
g) Domestic production and assembly of special-purpose motorcycles shall be implemented according to the provisions of Circular No. 89/2015/TT-BGTVT, Circular No. 42/2018/TT-BGTVT, and Circular No. 23/2020/TT-BGTVT.
Article 11. Implementation Organization
The Director of the Office of the Ministry, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Motor Vehicle Inspection Agency, the Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular./.
[14] Article 5 of Circular No. 19/2014/TT-BGTVT amending and supplementing certain provisions of Circular No. 23/2009/TT-BGTVT dated October 15, 2009 issued by the Minister of Transport on the inspection of technical safety quality and environmental protection for specialized motor vehicles, Circular No. 44/2012/TT-BGTVT dated October 23, 2012 issued by the Minister of Transport on the inspection of technical safety quality and environmental protection for imported motorcycles and engines used to produce and assemble motorcycles, and Circular No. 41/2013/TT-BGTVT dated November 5, 2013 issued by the Minister of Transport on the inspection of technical safety quality for electric bicycles, shall take effect from July 15, 2014, and is hereby prescribed as follows:
“State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments under the Ministry, the Director of the Vietnam Motor Vehicle Inspection Agency, Heads of relevant agencies, organizations, and individuals shall be responsible for implementing this Circular.
2. During the implementation process, if there are any difficulties, relevant organizations and individuals shall promptly reflect them to the Ministry of Transport for consideration and resolution./”
[8] This Appendix is replaced according to Clause 4, Article 4 of Circular No. 16/2022/TT-BGTVT amending and supplementing certain provisions of Circulars in the field of vehicle inspection, which takes effect from August 15, 2022.
