CIRCULAR
Detailed provisions on certain articles of Government Decree No. 117/2015/NĐ-CP dated November 12, 2015, regarding construction, management, and utilization of information systems on housing and real estate markets.

Pursuant to the Law on Statistics dated November 23, 2015;
On the basis of Government Decree No. 117/2015/NĐ-CP dated November 12, 2015, concerning construction, management, and utilization of information systems on housing and real estate markets;
Pursuant to Decree No. 62/2013/NĐ-CP dated June 25, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;
PURSUANT TO THE PROPOSAL OF THE INSTITUTE OF CONSTRUCTION ECONOMICS DIRECTOR;
The Minister of Construction issues this Circular to provide detailed provisions on certain articles of Government Decree No. 117/2015/NĐ-CP dated November 12, 2015, concerning construction, management, and utilization of information systems on housing and real estate markets.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates certain contents related to determining statistical indicators, provision, collection, processing, updating, storage, preservation, security, publication, exploitation, and utilization of information and data in the database on housing and real estate markets as prescribed in Government Decree No. 117/2015/NĐ-CP dated November 12, 2015, concerning construction, management, and utilization of information systems on housing and real estate markets (hereinafter referred to as Decree No. 117/2015/NĐ-CP).
Article 2. Applicability
This Circular applies to agencies, organizations, and individuals involved in the construction, management, exploitation, and utilization of information systems on housing and real estate markets.
Article 3. Legal validity of the database on housing and real estate markets
1. Information and data that have been checked, processed, and updated according to regulations in the database on housing and real estate markets shall have legal validity equivalent to paper files and documents.
2. In cases where information and data in the database on housing and real estate markets are inconsistent with paper files, they shall be determined based on paper documents having sufficient legal validity.
Chapter II
STATISTICAL INDICATORS IN THE FIELD OF HOUSING AND REAL ESTATE MARKETS
Article 4. List of statistical indicators in the database on housing and real estate markets
1. National statistical indicators in the field of housing and real estate markets:
a) Floor area of completed housing;
b) Number of houses, total current housing area;
c) Average housing area per person;
d) Real estate price index;
2. Industry-specific statistical indicators in the field of housing and real estate markets:
a) Total number of houses started under projects, compiled as follows:
- By type of house: apartment, individual house;
- By region: urban, rural;
- By locality: province, centrally-administered city.
b) Total number of houses completed in the year, compiled as follows:
- By type of house: apartment, individual house;
- By region: urban, rural;
- By locality: province, centrally-administered city.
c) Total housing area completed under projects in the year, compiled as follows:
- By type of house: apartment, individual house;
- By region: urban, rural;
- By locality: province, centrally-administered city.
d) Total number of social housing units and total social housing area completed in the year, compiled as follows:
- By type of house: apartment, individual house;
- By transaction form: sale, lease-purchase, lease;
- By region: urban, rural;
- By locality: province, centrally-administered city.
đ) Number of real estate transactions through trading floors, compiled as follows:
- By type of real estate: apartment, individual house, land plot, office, commercial service premises;
- By transaction form: purchase-sale, lease;
- By locality: province, centrally-administered city.
e) Transaction price index for some types of real estate, compiled as follows:
- By type of real estate including: apartment for sale, individual house for sale, land plot transfer, office for rent;
- By locality: province, centrally-administered city.
g) Quantity of real estate transactions, compiled as follows:
- By type of real estate including: apartment for sale, individual house for sale, land plot transfer, office for rent;
- By locality: province, centrally-administered city.
Article 5. Collection, compilation, updating of statistical indicators in the housing and real estate market sector
1. National statistical indicators in the housing and real estate market sector as stipulated in Clause 1, Article 4 of this Circular shall be collected and compiled by the General Statistics Office in accordance with the laws on statistics. After these indicators are published by the central statistical agency, the Ministry of Construction updates them into the database on housing and the real estate market.
2. Industry statistical indicators in the housing and real estate market sector as prescribed in Clause 2, Article 4 of this Circular (excluding transaction price indices for certain types of real estate) shall be periodically compiled nationwide and updated into the database on housing and the real estate market by the Ministry of Construction from the indicators collected, compiled, and calculated by the Construction Departments as the leading agencies responsible for such tasks in accordance with Appendix I of this Circular.
3. The Construction Department shall take the lead and coordinate with the statistical agencies and other relevant agencies and organizations at the local level to implement the collection, compilation, and calculation of the indicators prescribed in Clause 2, Article 4 of this Circular to update them into the local database on housing and the real estate market. If necessary, research institutions, training centers, professional associations, and enterprises operating in the construction and real estate sectors may be hired to perform these tasks. The organizations hired must bear responsibility for the accuracy and objectivity of the data they provide.
The Construction Department shall be responsible for reviewing and evaluating the appropriateness of the indicators implemented by the hired organizations and individuals with the actual situation at the local level.
4. Implementation timeline for industry statistical indicators in the housing and real estate market sector is as follows:
a) For the statistical indicators prescribed in points a, b, c, d, đ of Clause 2, Article 4: all provinces and centrally-administered cities shall commence data collection and compilation starting from 2017;
b) For the statistical indicators prescribed in points e and g of Clause 2, Article 4:
- Provinces and centrally-administered cities listed in Appendix II of this Circular shall organize data collection and establish original quantity, price, and weight data in 2017;
- Centrally-administered cities listed in Group 1 of Appendix II of this Circular shall start collecting, compiling, and calculating the indicators from January 1, 2018;
- Provinces listed in Group 2 of Appendix II of this Circular shall start collecting, compiling, and calculating the indicators from January 1, 2019.
It is encouraged that the remaining provinces implement the compilation and calculation of the indicators for publication and updating into the local database on housing and the real estate market.
5. The financial resources for collecting, compiling, and calculating the statistical indicators at the local level shall be balanced from the annual local budget. The Construction Department shall prepare plans and budgets for this work, submit them to the provincial People's Committee for approval, and organize their implementation.
Chapter III
PROVISION, COLLECTION, UPDATE, PROCESSING, STORAGE, PRESERVATION, AND SECURING OF INFORMATION AND DATA ON HOUSING AND THE REAL ESTATE MARKET
Article 6. Provision of information and data on housing and real estate market by agencies and organizations
The provision of information and data by agencies and organizations as stipulated in Clause 10, Article 13 of Decree No. 117/2015/NĐ-CP shall be carried out as follows:
1. Information and data provided through electronic information networks must be sent from an electronic account issued by the agency managing the database.
2. Information and data provided in writing must be confirmed by an authorized person of the unit (with red seal or using digital signature) accompanied by a data file (file). For information provided according to prescribed forms, the data file should be in Excel format or Open Document Format ".ods".
Article 7. Detailed guidance on certain contents in the information provision form
1. The classification of office rental grades A, B, C shall refer to the criteria set forth in Appendix VI of this Circular. The Department of Construction at local level may adjust and supplement the criteria specified in the Appendix based on actual conditions to suit the characteristics of the local real estate market as a basis for compiling and collecting data as prescribed in Form No. 2 of the Appendix attached to Decree No. 117/2015/NĐ-CP.
2. The area of apartment units as prescribed in the Forms of the Appendix attached to Decree No. 117/2015/NĐ-CP is the usable area of the apartment unit, determined in accordance with Clause 2, Article 101 of the Housing Law dated November 25, 2014; the area of individual houses is determined based on the floor area.
3. Commercial and service floors are the floor areas of buildings used for business purposes or services.
4. The volume of real estate transactions as prescribed in Form No. 1 of the Appendix attached to Decree No. 117/2015/NĐ-CP is compiled from successful transactions (excluding initial transactions of newly formed or created real estate in projects).
5. Characteristics of real estate as prescribed in Form No. 3 of the Appendix attached to Decree No. 117/2015/NĐ-CP include certain information depending on the type of real estate as follows:
a) For apartment units: the floor level of the apartment, number of bedrooms;
b) For individual houses: land area, construction area, number of floors, number of bedrooms;
c) For offices: number of floors of the building, floor level of the office, office grade;
d) For commercial and service floors: number of floors of the building, floor level, purpose of use;
đ) For land plots: plot area, plot dimensions, number and width of adjacent roads.
7. The address of real estate as prescribed in Form No. 3 of the Appendix attached to Decree No. 117/2015/NĐ-CP is the actual registered address. In cases where there is no registered address, it shall be recorded according to the address in the certificate of ownership of real estate or land use rights.
8. The classification of housing by degree of durability as prescribed in Form No. 15 of the Appendix attached to Decree No. 117/2015/NĐ-CP shall be implemented in accordance with the guidelines set forth in Appendix VII of this Circular.
9. The determination of housing demand as prescribed in point b, Clause 2, Article 8 of Decree No. 117/2015/NĐ-CP shall be based on survey and assessment data on the number of households and individuals requiring housing and the socio-economic characteristics of the locality. Data can be compiled based on the annual and five-year development plans for housing organized and approved by the People's Committee of the province.
Article 8. Collection of Additional Information and Data on Housing and Real Estate Market
1. Objectives, Principles:
a) The collection of additional information and data on housing and the real estate market at the local level shall be carried out for information and data that are not currently available or have not been reported but are necessary to ensure timely service for state management work and to meet economic and social development requirements;
b) The collected information and data must be accurate, complete, and systematic;
c) The collection of additional information and data must ensure no duplication or overlap of tasks among relevant organizations and units; there must be close cooperation in collecting information and data; and maximum utilization of existing sources of information and data should be made.
2. Basis for Implementation:
a) The content of the database on housing and the real estate market is stipulated in Articles 7 and 8 of Decree No. 117/2015/NĐ-CP;
b) The current status of the database on housing and the real estate market;
c) Requirements of state management work and economic and social development needs;
d) Tasks assigned to competent state agencies.
3. Annually, the Department of Construction proposes and reports to the People's Committee of the province on the collection of additional information and data on housing and the real estate market of the locality according to the following contents:
a) Purpose and requirements for collecting data on housing and the real estate market;
b) Types of information and data on housing and the real estate market that need to be collected and supplemented in the database on housing and the real estate market;
c) Tasks for collecting additional information and data on housing and the real estate market;
d) Agencies and units responsible for and cooperating in implementing the tasks;
đ) Implementation plan (including: budget, time frame, human resources, implementation procedures).
4. The People's Committee of the province bases on the actual conditions of the locality to approve the tasks and budget for collecting additional information and data on housing and the real estate market.
Article 9. Updating Information and Data of the Database Management Agency
1. The updating of information and data shall be carried out in the following steps:
a) Receiving information and data that have been checked and processed in accordance with regulations;
b) Classifying information and data according to the content of the database prescribed in Articles 7 and 8 of Decree No. 117/2015/NĐ-CP;
c) Determining the position for updating information and data within the database system;
d) Implementing the updating of information and data using software prescribed by the Ministry of Construction;
đ) Checking the results of the update on the database system.
2. The database management agency has the responsibility to process and update information and data provided by agencies, organizations, and individuals into the housing and real estate market database system within the latest seven working days after receiving suitable and reliable information and data.
3. For information and data prescribed in Article 8 of Decree No. 117/2015/NĐ-CP that are already available, the Department of Construction must complete the update within six months upon notification from the Ministry of Construction regarding the readiness of the housing and real estate market information system to operate.
4. The frequency and deadlines for updating certain information and data under the management functions of the Department of Construction in the housing and real estate market database are specified as follows:
a) For information and data on individual real estate brokers, the Department of Construction updates the information and data immediately during the process of handling administrative procedures for issuing professional certificates;
b) For information and data on real estate trading floors, the Department of Construction updates the information and data within five working days from the date of receiving the notification filing for operation or dissolution of the real estate trading floor;
c) For information and data on the number and area of housing owned by the state, collective bodies, individuals, and foreign organizations and individuals, the Department of Construction collaborates with local statistical agencies to update the database according to the survey and publication periods of the statistical agencies;
d) For information and data on demand for each type of residential real estate product compiled based on the annual and five-year housing development plans, the Department of Construction updates this information and data into the housing and real estate market database no later than twenty days from when the housing development plan is approved by the competent authority;
đ) For information and data on completed housing construction projects, the Department of Construction develops a plan and completes the update within six months upon notification from the Ministry of Construction regarding the readiness of the housing and real estate market information system to operate;
e) For statistical indicators specified in the attached forms of Appendix I of this Circular, the Department of Construction updates these into the database according to the deadlines for publishing the statistical indicators stipulated in Clause 3 of Article 17 of this Circular.
5. In cases where the infrastructure of the housing and real estate market information system does not meet the requirements for updating information, the database management agency is responsible for receiving, processing, and systematically storing information and data provided by agencies, organizations, and individuals in the unit's server and organizing the update of this information and data when the system is ready to operate.
Article 10. Processing of Information and Data
1. The content of processing information and data shall be carried out in accordance with Clause 1 of Article 11 of Decree No. 117/2015/NĐ-CP.
2. Requirements for information and data to be included in the database on housing and real estate market are as follows:
a) For survey and statistical programs on housing and real estate market, they must be statistical figures, results, reports submitted and stored in accordance with regulations.
b) For data from regular and ad hoc reports of agencies, organizations, and individuals, there must be confirmation from the competent authority issuing them.
c) For data obtained from surveys and investigations, it must be approved by the competent authority.
3. For information and data donated by organizations and individuals, if necessary, the head of the agency or unit receiving and processing such information and data shall establish an Advisory Board consisting of experts and experienced managers to review and evaluate such information and data.
4. During the processing of information, if any errors or inconsistencies in the provided information and data are discovered, the entity responsible for providing such information and data shall clarify, explain, and correct them, and provide them to the agency or unit responsible for processing such information and data.
Article 11. Storage and Preservation of Information and Data
1. The management agency of the database on housing and real estate market must implement measures in terms of management, business operations, and technology for the information system to protect and restore the system, services, and data content; ensure security for the application system and databases including database security level, system level, and application level, physical level.
2. The management agency of the database on housing and real estate market has the responsibility to apply information technology to ensure safe data storage in the database in aspects:
a) Physical storage: ensuring that storage devices such as computer hard drives, magnetic disks, or other long-term data backup systems are not damaged.
b) Logical organization: data must be secured according to the principles and formats of database systems, avoiding intentional damage to the logical organization of the data.
c) Ensuring network information security, preventing information leakage from the database system.
d) Digital data stored on servers must be protected against unauthorized access through advanced security systems and techniques.
3. The management agency of the database on housing and real estate market must take measures to ensure the integrity of information and data, regularly inspect and ensure the safety of the electronic information system.
4. Backup of housing and real estate market data:
a) Data stored in the housing and real estate market database must be copied to information storage devices periodically and stored according to technical procedures, security, and safety regulations currently in force.
b) Housing and real estate market data must be regularly copied and stored at least once every seven days.
Article 12. Security Regime for Information and Data on Housing and Real Estate Market
1. Printing, copying, photographing, transferring, storing, preserving, and providing information and data must comply with regulations on information and data security.
2. The management agency of the database on housing and real estate market shall establish specific regulations on access rights and updating of information and data.
3. Individuals who update and exploit the database on housing and real estate market shall be granted certain access and updating rights within each data component, ensuring strict control over information access rights in housing and real estate market databases.
Chapter IV
EXPLOITATION, USE AND DISCLOSURE OF INFORMATION ON HOUSING
AND REAL ESTATE MARKET
Article 13. Agencies Providing Information and Data in the Database on Housing and Real Estate Market
1. The Ministry of Construction provides information and data in the housing and real estate market database system.
2. Provincial Construction Departments provide information and data in the national housing and real estate market database and the local housing and real estate market database under their management.
Article 14. Exploitation and use of information and data on housing and the real estate market through the Internet and websites
1. Organizations and individuals exploiting and using information and data on housing and the real estate market through the Internet and websites shall not be required to pay exploitation and usage fees for the following cases:
a) Exploiting and using the list of information and data on housing and the real estate market;
b) Exploiting and using information and data on housing and the real estate market as prescribed by law that are publicly disclosed and widely disseminated.
2. For information and data outside the provisions of Clause 1 of this Article, organizations and individuals must register for access rights to exploit and use through the Internet and websites. The management agency of the database on housing and the real estate market shall grant access rights to registered organizations and individuals in accordance with the objects and purposes of use as prescribed.
The procedures for registering and granting exploitation and usage rights for information and data on housing and the real estate market through the Internet and websites shall be carried out as follows:
a) Organizations and individuals who wish to register for exploitation and usage rights for information and data on housing and the real estate market (referred to as the Requesting Party) shall submit a request form to the agency or unit entrusted with managing and providing information and data on housing and the real estate market (referred to as the Providing Party) in the following forms:
- Submitting directly in writing to the Providing Party;
- Sending via official correspondence, fax, or postal service;
- Registering online on the electronic information page of the Providing Party.
The request form and request letter shall follow the model specified in Appendix III of this Circular;
b) Within three working days from the date of receipt of a valid registration request for exploitation and usage rights for information and data on housing and the real estate market, the Providing Party shall notify the service usage fee (if applicable); in case of refusal to provide access rights, the Providing Party must respond clearly stating the reasons;
c) The Providing Party shall send the Requesting Party the account for accessing and searching information and data within seven working days from the date of receipt of the request or the time when the Requesting Party pays the service usage fee (if applicable);
3. Organizations and individuals granted access rights shall be responsible for:
a) Accessing the correct address and password; they shall not disclose the address and password provided;
b) Exploiting and using information and data only within the scope granted, without unauthorized intrusion into the database on housing and the real estate market; using information and data for the intended purpose;
c) Managing the content of the exploited information and data, not providing it to other organizations or individuals except where permitted by the management agency of the database on housing and the real estate market;
d) Not altering, deleting, canceling, copying, disclosing, displaying, or moving part or all of the data illegally; not creating or disseminating software programs that affect or distort the database on housing and the real estate market; promptly reporting to the data management agency any errors in the provided information and data;
đ) Paying the service usage fee for providing information and data on housing and the real estate market as prescribed (if applicable);
e) Adhering to laws on state secrets protection; being responsible for any violations in exploiting and using information and data.
4. In the event of temporarily suspending the provision of information, data, and related services on the network, the Providing Party shall be responsible for:
a) Except in cases of force majeure, public notice must be given at least seven working days before the Providing Party voluntarily suspends the provision of information, data, and related services on the network for repairs, rectification of incidents, or upgrading and expanding the information infrastructure; the notice content must specify the expected recovery period for the activities of providing information, data, and related services on the network;
b) Taking immediate measures to rectify incidents after their information system malfunctions during operation, affecting or causing the suspension of the provision of information, data, and related services on the network.
5. The provision, exploitation, and use of information and data on housing and the real estate market through the Internet and websites must comply strictly with the provisions of the Law on Electronic Transactions, the Law on Information Technology, and guiding documents.
Article 15. Exploitation and use of information and data on housing and real estate market through request forms or request documents
1. Procedure for providing information and data on housing and real estate market through request forms or request documents:
a) The requesting party sends the request form or request document to provide data to the supplying party in the following ways:
- Submitting directly at the supplying party;
- Sending via official correspondence, fax, or postal service;
- Sending directly via electronic information network.
The request form and request letter shall follow the model specified in Appendix III of this Circular;
b) The supplying party receives and processes the request form or request document.
In case the requesting party does not comply with the provisions set out in Clause 2 of this Article, the supplying party has the right to refuse to provide information and data and must clearly state the reasons within the latest three working days from the date of receipt of the request;
In case the request form or request document complies with regulations and the requested information and data are valid, the requesting party shall pay the service fee for providing information and data on housing and real estate market according to the regulations to the supplying party (if applicable);
c) The supplying party prepares information and data on housing and real estate market for delivery to the requesting party within a period not exceeding seven working days from the date of receipt of the request or from the time the requesting party pays the service fee (if applicable);
d) During the exploitation and use of information and data on housing and real estate market, it is not allowed to copy or transfer them to third parties except in cases where there is an agreement with the data supplier.
2. The supplying party may refuse to provide information and data in the following cases where the requesting party does not comply with the regulations:
a) Request forms or request documents for information and data with unclear contents; the requested information and data fall within the scope affecting national security, business secrets of enterprises, are not available in the current database, and personal information except in cases serving investigative activities, verification and handling of violations of laws and serving administrative management work of competent authorities;
b) Request documents without the signature of authorized persons and stamped confirmation for organizations; request forms without signatures, names, contact information for individuals requesting information and data;
c) Failure to pay the service fee for providing information and data on housing and real estate market when payment is required according to regulations.
Article 16. Exploitation and use of information and data on housing and real estate market under contract form
1. For cases requiring the aggregation and processing of information and data before providing to organizations and individuals, such actions shall be carried out under contract form.
2. The signing of contracts between agencies and units entrusted with managing and providing information and data on housing and real estate market and organizations and individuals requiring exploitation and use of such information and data shall be conducted in accordance with the Civil Code and other relevant laws.
Article 17. Disclosure of Information and Statistical Indicators in the Field of Housing and Real Estate Market 1. The system for disclosing information and statistical indicators in the local housing and real estate market database is implemented by the Department of Construction:
a) Information updated and disclosed regularly on the Department of Construction's electronic portal includes:
- Legal documents related to housing and real estate market issued by the locality within its authority;
- Information on housing development programs and plans of the locality;
- Information on housing projects currently being invested and constructed in the locality;
- Information on real estate trading floors in the locality;
b) Information and statistical indicators disclosed periodically every quarter include:
- Information on the number of houses meeting transaction conditions but not yet traded in projects by region;
- Transaction price index for certain types of real estate and transaction volume index for real estate in the locality as stipulated in Point e and Point g, Clause 2, Article 4 of this Circular;
c) Statistical indicators disclosed periodically every six months include: the number of real estate transactions through trading floors in the locality as stipulated in Point d, Clause 2, Article 4 of this Circular;
d) Information and statistical indicators disclosed periodically annually include:
- Information and statistical indicators as stipulated in Points b and c above;
- Total number of houses started construction according to projects, total number of houses completed in the year, total area of houses according to projects completed in the year, and total number of social housing and total area of social housing completed in the year in the locality as stipulated in Points a, b, c, and d, Clause 2, Article 4 of this Circular;
Forms for disclosing information and statistical indicators in the local housing and real estate market database are guided in Appendix IV of this Circular.
2. The system for disclosing information and statistical indicators in the national housing and real estate market database:
a) Information disclosed regularly on the Ministry of Construction's electronic portal includes:
- Legal documents related to housing and real estate market issued by the National Assembly, Government, Ministries, and sectors within their authority;
- Information on individual real estate brokers reported by localities;
b) Statistical indicators disclosed periodically every quarter include: transaction volume index for real estate as stipulated in Point g, Clause 2, Article 4 of this Circular;
c) Statistical indicators disclosed periodically every six months include: the number of real estate transactions through trading floors as stipulated in Point d, Clause 2, Article 4 of this Circular;
d) Statistical indicators disclosed periodically annually include:
- Statistical indicators as stipulated in Points b and c above;
- Total number of houses started construction according to projects, total number of houses completed in the year, total area of houses according to projects completed in the year, and total number of social housing and total area of social housing completed in the year as stipulated in Points a, b, c, and d, Clause 2, Article 4 of this Circular.
3. Time limit for disclosing information and statistical indicators
3. Period for disclosing information, statistical indicators
a) For information and statistical indicators in the local housing and real estate market database: publish before the 20th day of the first month of the period following the publication period;
b) For information and statistical indicators in the national housing and real estate market database: publish before the 25th day of the first month of the period following the publication period.
4. Time to commence information and statistical indicator publication
a) The time to commence information publication is from July 1, 2017;
b) For statistical indicators specified in Clause 2, Article 4 of this Circular collected, compiled, and calculated by the Construction Departments:
- Statistical indicators specified in Points a, b, c, d, đ of Clause 2, Article 4 shall be published from January 1, 2018;
- Statistical indicators specified in Point e, Point g of Clause 2, Article 4: central cities specified in Group 1 of Appendix II of this Circular shall be published from 2018; provinces specified in Group 2 of Appendix II of this Circular shall be published from 2019.
Chapter V
IMPLEMENTATION
Article 18. Responsibilities of units under the Ministry of Construction
1. The Housing Management and Real Estate Market Administration shall be responsible to the Minister for implementing inspection, urging, and guiding ministries, sectors, and localities nationwide on the construction, management, exploitation, use, and updating of the housing and real estate market database; serving as the point of contact for receiving, compiling information about housing and the real estate market reported and provided by ministries, sectors, and localities, and transferring it to the Institute of Construction Economics for processing, calculation, and data updating; providing access and supplying information about housing and the real estate market for the Ministry of Construction's publication purposes; coordinating with the Construction Information Center to establish regulations on managing and using the housing and real estate market information system.
2. The Information Center shall be responsible for leading and coordinating with the Housing Management and Real Estate Market Administration and the Institute of Construction Economics to organize the development of a unified software system to operate and exploit the housing and real estate market information system; building and managing the technical infrastructure for information technology related to housing and the real estate market connected to local Construction Departments; organizing training and enhancing skills in using software; ensuring the security, safety, and confidentiality of databases; organizing the establishment of regulations on managing and using the housing and real estate market information system.
3. The Institute of Construction Economics shall be responsible for receiving information and data provided by the Housing Management and Real Estate Market Administration and other agencies, organizations, and individuals; processing, updating, and providing information and data about housing and the real estate market; jointly calculating and compiling statistical indicators and basic information about housing and the real estate market for the Ministry of Construction's publication purposes with the Housing Management and Real Estate Market Administration; guiding the construction, management, exploitation, use, and updating of housing and real estate market databases at local levels; coordinating with the Housing Management and Real Estate Market Administration and the Information Center in implementing the contents stipulated in Clauses 1 and 2 of this Article.
Article 19. Responsibilities of the People's Committee of the Province
1. Popularize and direct the implementation of this Circular at the local level.
2. Direct the Department of Construction to:
a) Establish regulations on management, exploitation, use, and updating of housing and real estate market databases at the local level; regulations on ensuring security and confidentiality of information;
b) Inspect and supervise the implementation of construction management, exploitation, use, and updating of housing and real estate market databases at the local level;
c) Guide and urge relevant units, agencies, and organizations at the local level to implement reporting contents as prescribed; widely announce the email address on the electronic information website for organizations and individuals to submit reports and data;
d) Grant access rights to related organizations and individuals as prescribed;
đ) Organize the collection of information, consolidation, and calculation of statistical indicators in the field of housing and the real estate market;
e) When the technical infrastructure of the housing and real estate market information system does not meet the requirements for accessing and updating information, the Department of Construction shall send the information and statistical indicators specified in Appendix IV of this Circular to the Ministry of Construction for monitoring and consolidation; periodically report to the Ministry of Construction the contents of information according to the forms prescribed in Appendix V of this Circular.
3. Direct the General Statistics Office to cooperate with the Department of Construction in providing information and data in the field of housing and the real estate market.
4. Allocate regular funds for the construction, management, and operation of the housing and real estate market database; collect, update, and supplement information and data; calculate and publish statistical indicators in the field of housing and the real estate market at the local level.
Article 20. Provisions 1. This Circular takes effect from February 15, 2026; Circular No. 24/2013/TT-BKHCN dated September 30, 2013 of the Minister of Science and Technology on activities related to calibration, verification, testing of measuring instruments, and measurement standards shall cease to be effective from the date this Circular takes effect.

2. Contents regarding the reporting system for basic information of real estate projects, reports on the implementation of investment construction activities stipulated in points a and b, Clause 2, Article 4, and the reporting content on the situation of selling houses, renting houses, transferring land use rights, and renting land stipulated in point c, Clause 2, Article 4 of Circular No. 11/2013/TT-BXD dated July 31, 2013 issued by the Minister of Construction on the reporting system for the implementation of investment construction and business activities of real estate projects; statistical indicators on housing and real estate stipulated in Circular No. 05/2012/TT-BXD dated October 10, 2012 issued by the Minister of Construction promulgating the system of statistical indicators for the Construction Industry (codes 0301÷0308); the comprehensive industry statistics reporting system for statistical indicators on housing and real estate according to Forms: 12/BCĐP, 13a/BCĐP, 13b/BCĐP, 14/BCĐP, 15/BCĐP, 16/BCĐP stipulated in Circular No. 06/2012/TT-BXD dated October 10, 2012 issued by the Minister of Construction on the comprehensive industry statistics reporting system cease to be effective upon the entry into force of this Circular.
