N |||Article 2. Procedures for transferring levels and corresponding coefficients for beneficiaries as stipulated in Article 40 of Decree No. 136/2013/NĐ-CP
Article 1. Scope of Application
1. Procedures for transferring monthly social assistance levels and coefficients are as follows:
a) A civil servant at the commune level responsible for labor, invalids, and social affairs compiles a list of beneficiaries currently receiving monthly social assistance within their jurisdiction and guides those beneficiaries subject to adjustment of monthly social assistance levels and coefficients according to the provisions of Decree No. 136/2013/NĐ-CP, supplementing the Application for Social Assistance as prescribed in Clause 1, Article 5 of this Joint Circular; b) The Social Assistance Review Board reviews, examines, and concludes with a list of beneficiaries eligible for adjustment of levels and coefficients according to the provisions of Decree No. 136/2013/NĐ-CP;
Article 1. Scope of Regulation and Applicability
c) Based on the minutes of the Social Assistance Review Board's conclusions, the Chairman of the People's Committee at the commune level issues a letter of request along with the list and the Application for Social Assistance of the beneficiary to the Department of Labor - Invalids and Social Affairs;
d) The Department of Labor - Invalids and Social Affairs reviews and submits to the Chairman of the People's Committee at the district level for decision.
2. The head of social welfare institutions and social houses reviews beneficiaries currently receiving care and nurturing from state budget sources and reports to the competent authority for decision on the level of care and nurturing allowances within social welfare institutions and social houses according to the delegated management hierarchy.
1. Procedures for adjusting the monthly social assistance level and coefficient are as follows:
a) The civil servant at the commune level responsible for labor, war invalids, and social affairs compiles a list of individuals currently receiving monthly social assistance within their jurisdiction and guides these individuals to fill out the Application Form for Social Assistance according to the provisions of Decree No. 136/2013/NĐ-CP, using the form prescribed in Clause 1, Article 5 of this Joint Circular;
b) The Social Assistance Review Board reviews, examines, and concludes with a list of individuals whose monthly social assistance level and coefficient are adjusted according to the provisions of Decree No. 136/2013/NĐ-CP;
c) Based on the minutes of the Social Assistance Review Board, the Chairman of the Commune People's Committee issues a request letter accompanied by a list and the Application Form for Social Assistance of the individual to be sent to the Department of Labor, War Invalids, and Social Affairs;
d) The Department of Labor, War Invalids, and Social Affairs verifies and submits to the Chairman of the District People's Committee for decision.
2. The head of social welfare institutions and social houses reviews individuals currently receiving care and maintenance from the state budget and presents them to the competent authority for determination of the maintenance allowance level within social welfare institutions and social houses according to the分级任务不符合要求
Article 3. The support regime for urgent protection subjects who receive temporary care and maintenance at household families as prescribed in Clause 2, Article 18 of Decree No. 136/2013/NĐ-CP.
1. Food allowance: VND 40,000 per person per day.
2. Medical treatment costs in cases where medical treatment is required at healthcare facilities without health insurance cards shall be handled as follows:
a) Children under six years old; persons from poor households, near-poor households; ethnic minority people living in areas with difficult socio-economic conditions, particularly difficult conditions; persons enjoying preferential policies according to laws on preferential treatment for those contributing to the revolution shall be supported with medical examination and treatment costs at the level of the health insurance fund's payment for corresponding subjects.
b) For subjects not falling within the scope prescribed in Point a of this Clause but have no relatives to support medical examination and treatment costs at the level of the health insurance fund's payment for subjects from poor households.
3. Costs for transporting subjects back to their place of residence or to social welfare institutions, community houses: The cost is based on the price of public transportation commonly applied in the locality. In cases where vehicles of agencies or units are used, the cost is calculated based on actual kilometers traveled and fuel consumption; in cases where vehicles are rented from outside, the rental fee is based on the contract, actual receipts, invoices, and consistent with prices in the same area at the same time.
Article 4. Guidance and training on receiving care and nurturing of social assistance beneficiaries in the community
1. Households and individuals receiving care and nurturing of social assistance beneficiaries shall be guided and trained in the following aspects of care and nurturing:
a) Suitable dietary regimen;
b) Arrangement of accommodation and assistance with personal activities;
c) Counseling and evaluation of mental and physical conditions;
d) Relevant policies and laws;
đ) Other related business matters.
2. The Department of Labor, Invalids, and Social Affairs is responsible for organizing the implementation of the provisions stipulated in Clause 1 of this Article.
Article 5. Model social assistance policy implementation files
Attached herewith are the model social assistance policy implementation files as follows:
1. Application form for social assistance according to forms No. 1a, 1b, 1c, 1d, and 1e;
2. Care and maintenance application form according to Form No. 2;
3. Household form with disabled members according to Form No. 3;
4. Care and maintenance recipient's application form according to Form No. 4;
5. List of households and number of people in households facing food shortages according to Forms No. 5a and 5b;
6. Application form for funeral expense support according to Form No. 6;

Article 6. Regular social assistance policy implementation funds
1. Funds for monthly social allowance payments to social welfare recipients entitled to monthly allowances, and support for households and individuals caring for and maintaining subjects in the community are allocated in the local budget's social security expenditure plan according to the budgetary division.
2. Funds for caring for and maintaining subjects at social welfare institutions, community houses:
a) For public social welfare institutions, community houses at which level, the budget at that level ensures funding in the social security expenditure plan;
b) For non-public social welfare institutions, community houses, funding is allocated in the social security expenditure plan of the provincial budget.
3. Funds for propaganda, dissemination of policies, review of subjects, application of information technology, management of subjects, training, and capacity enhancement of cadres, family and individual training for caring for and maintaining social welfare recipients in the community, and supervision by agencies at which level are ensured in the social security expenditure plan according to the State Budget Law and guiding documents thereof.
4. Regular social assistance policy implementation funds are established, allocated, utilized, managed, and settled according to the State Budget Law, Accounting Law, guiding documents of these laws, and specific regulations in this Joint Circular. Specifically, in 2015, the central budget will provide additional funding to local budgets as follows:
- 100% for localities that cannot yet achieve budget self-balancing and the province of Quảng Ngãi.
- 50% for localities with a distribution ratio of revenue transfers to the central budget below 50%.
- For localities using local budgets to implement part or all of the policy, if there is a revenue shortfall due to objective reasons or low revenue growth: after using 50% of the increased local budget revenue (if any) and 50% of the local budget reserve according to the plan approved by the Prime Minister, if there is still a shortage, the central budget will cover the difference.
- For other localities, the local budget will ensure funding itself.
The Department of Labor, Invalids, and Social Affairs prepares the additional 2015 budget estimate due to the adjustment of the social allowance standard according to Decree No. 136/2013/NĐ-CP for subjects specified in Clause 1 and Clause 3 of Article 11 of this Joint Circular, sends it to the Department of Finance for consideration and consolidation, and submits it to the Chairman of the Provincial People's Committee for approval, then sends it to the Ministry of Labor, Invalids, and Social Affairs, the Ministry of Finance for consolidation and submission to the competent authority for decision to supplement the budget according to the law on the state budget.
Article 7. Content and expenditure levels for management work
1. People's Committee at commune level
a) Expenditure on office supplies; printing forms; purchasing books, materials serving management work. The payment level is based on actual expenses within the approved budget estimate by the competent authority;
b) Expenditure for meetings of the Social Assistance Review Council:
- Chairperson: VND 70,000/person/session;
- Participants: VND 50,000/person/session;
- Expenditure for drinking water for participants. The expenditure level is as prescribed in Circular No. 97/2010/TT-BTC dated July 6, 2010, issued by the Ministry of Finance, regarding travel expenses and expenditure for organizing conferences for state agencies and public service units (hereinafter referred to as Circular No. 97/2010/TT-BTC);
c) Payment for individuals directly responsible for disbursing social assistance benefits to beneficiaries (in cases where the competent authority has assigned a budget for monthly social benefit payments in the community budget) shall be implemented according to the provisions of Point c, Clause 2 of this Article;
d) Expenditure for propaganda and dissemination of social assistance policies to the public. Content and expenditure levels are as prescribed in Joint Circular No. 14/2014/TTLT-BTC-BTP dated January 27, 2014, issued by the Ministry of Finance and the Ministry of Justice, regarding the preparation, management, use, and settlement of state budget funds to ensure the work of legal education and popularization of laws and access to justice for the people at the grassroots level;
2. Department of Labor, Invalids, and Social Affairs
a) Expenditure on office supplies; printing forms, cash receipt vouchers, lists of beneficiaries; purchasing books, materials serving management work; printing or purchasing sample files for beneficiaries. The payment level is based on actual expenses within the approved budget estimate by the competent authority;
b) Expenditure for reviewing and verifying applications for social allowances and assistance; recommending acceptance into social welfare facilities under district management. The expenditure level is VND 20,000/file;
c) Payment for individuals directly responsible for disbursing social assistance benefits. The payment level is VND 500,000/person/month, with a maximum of two persons/community. The Chairman of the People's Committee at the district level shall determine the number of personnel based on the number of beneficiaries and the geographical conditions of each community;
d) Service fees for disbursement through service organizations for localities implementing disbursements through such organizations. The disbursement fee level is determined by the Chairman of the Provincial People's Committee;
đ) Expenditure for training families and individuals caring for and supporting beneficiaries of social assistance in the community. Content and expenditure levels are as prescribed in Circular No. 97/2010/TT-BTC;
e) Expenditure for surveys, reviews, and statistics of beneficiary data as prescribed by the competent authority in Clauses 2, 3, and 4 of Article 10 of Decree No. 40/2004/NĐ-CP dated February 13, 2004, issued by the Government, detailing and guiding the implementation of certain provisions of the Law on Statistics. Content and expenditure levels are as prescribed in Circular No. 58/2011/TT-BTC dated May 11, 2011, issued by the Ministry of Finance, regarding the management, use, and settlement of funds for statistical surveys;
g) Expenditure for procurement, repair, and maintenance of assets, equipment, and means of transportation serving disbursement and management work. The expenditure level is based on needs and the approved budget estimate by the competent authority and in accordance with legal provisions on bidding;
h) Expenditure for supporting the application of information technology to manage files, beneficiaries, and social allowance disbursements. Content and expenditure levels are as prescribed in Joint Circular No. 19/2012/TTLT-BTC-BKH&ĐT-BTTTT dated February 15, 2012, issued by the Ministry of Finance, the Ministry of Planning and Investment, and the Ministry of Information and Communications, guiding the management and use of funds for the National Program on the Application of Information Technology in State Agency Activities, and Circular No. 194/2012/TT-BTC dated November 15, 2012, issued by the Ministry of Finance, regarding the level of expenditure for creating electronic information to maintain the regular operation of state budget-funded agencies and units;
i) Expenditure for fuel and communication. The expenditure level is based on valid invoices and receipts;
k) Other rental expenditures serving disbursement and management work. The expenditure level is as stipulated in contracts, receipts, or invoices (in cases of service rentals);
l) Expenditure for monitoring and supervising the implementation of policies. Content and expenditure levels are as prescribed in Circular No. 97/2010/TT-BTC;
m) Expenditure for disseminating social assistance policies to cadres implementing social assistance policies for beneficiaries as prescribed in Point d, Clause 1 of this Article.
3. Provincial Department of Labor, Invalids, and Social Affairs
a) Expenditure on office supplies; printing forms, reports, training materials, related legal documents. The payment level is based on actual expenses within the approved budget estimate by the competent authority;
b) Expenditure for reviewing and verifying applications for acceptance into social welfare facilities under provincial management. The expenditure level is VND 20,000/file;
c) Expenditure for the contents prescribed in Points e, g, h, i, l, and m of Clause 2 of this Article;
d) Expenditure for propaganda on mass media as approved by the competent authority. The expenditure level is as stipulated in the contract between the propaganda agency and the mass media agency and in accordance with legal provisions on bidding;
đ) Expenditure for training, professional development, mid-term reviews, and final summaries. Content and expenditure levels are as prescribed in Circular No. 97/2010/TT-BTC and Circular No. 139/2010/TT-BTC dated September 21, 2010, issued by the Ministry of Finance, regarding the preparation, management, and use of state budget funds for training and professional development of civil servants;
4. Ministry of Labor, Invalids, and Social Affairs
a) Expenditure on office supplies; printing reports, training materials, propaganda, and dissemination of policies, related legal documents. The payment level is based on actual expenses within the approved budget estimate by the competent authority;
b) Expenditure for the contents prescribed in Points e, h, and l of Clause 2, and Points d and đ of Clause 3 of this Article.
Article 8. Implementation of social assistance policy payments
1. The social assistance policy regime shall be directly paid monthly to beneficiaries through one of the following agencies or organizations:
a) Department of Labor, Invalids and Social Affairs or People's Committee at commune level;
b) Payment service organization.
2. The Chairman of the Provincial People's Committee decides on the payment method suitable for the actual situation of the locality towards transitioning social assistance policy payments from state agencies to payment service organizations.
3. The Department of Labor, Invalids and Social Affairs takes the lead and coordinates with the Department of Finance based on the actual conditions in the locality; selects payment service organizations with transaction points in communes, wards, towns that can undertake home payments for certain special groups; submits to the Chairman of the Provincial People's Committee for decision on implementing social assistance policy payments through local payment service organizations, implementation timeline, areas, payment fees, and responsibilities of relevant agencies.
Article 9. Process for Implementing Payments Through Payment Service Organizations
1. Based on the Decision of the Chairman of the Provincial People's Committee, the Department of Labor, Invalids and Social Affairs authorized by the competent authority signs a Contract regarding the payment of social assistance policy benefits with the payment service organization at district level. The Contract clearly states the responsibilities and rights of each party; the process of transferring money and settlement; the process, location, time of payment, and payment fee. The signing, implementation of the contract, and handling of disputes related to the payment of social assistance policy benefits are carried out according to the provisions of the Civil Code and guiding documents.
2. Transfer of funds for payment implementation
a) The procedure for transferring funds to the payment service organization according to the signed Contract under Clause 1 of this Article shall be completed before the 25th of each month;
b) The Department of Labor, Invalids and Social Affairs bases on the list of beneficiaries (including those increased or decreased compared to the previous month); the amount of funds allocated for social assistance policy payments in the month (including back payments and funeral expenses of beneficiaries); withdraws the budget at the State Treasury, issues a mandate to transfer funds to the payment service organization, and transfers the payment list to the payment service organization.
3. Location and Time of Payment
a) The centralized payment location for social assistance policy benefits is at the transaction point in the commune, ward, town or at the residence of severely disabled persons, very disabled persons, or elderly people without a proxy to receive assistance;
b) The payment period is from the 5th to the 15th of each month.
4. Implementation of Payments
a) Based on the monthly payment list provided by the Department of Labor, Invalids and Social Affairs, the payment service organization prepares the payment list for households at the nearest transaction point to the beneficiary's place of residence (convenient for the beneficiary to collect money) and transfers the beneficiary list to the transaction points assigned to make payments in the commune, ward, town;
b) Transaction points implement payments and require beneficiaries or authorized representatives to sign and write their full name on the payment list; simultaneously, payment staff sign to confirm in the record book tracking the collection of assistance payments. In cases where the beneficiary cannot sign, fingerprints are used instead. If a household does not come to collect the assistance payment or if the payment staff makes home visits but there is no one to receive the payment, the payment staff returns the unspent funds to the payment service organization for transfer in the following month;
c) If a beneficiary does not collect money for two consecutive months, the payment staff has the responsibility to cooperate with the Commune People's Committee to investigate the cause. If it is due to the death, disappearance, or relocation of the beneficiary, the payment service organization has the responsibility to notify the Commune People's Committee and the Department of Labor, Invalids and Social Affairs to handle the procedures for discontinuing assistance payments or temporarily suspending assistance payments according to regulations.
5. Reporting and Settlement
a) The payment service organization compiles the list of beneficiaries who have received money, the amount of money paid, and the list of beneficiaries who have not collected money to transfer for payment in the following month to the Department of Labor, Invalids and Social Affairs and the Commune People's Committee before the 20th of each month;
b) Quarterly, the payment service organization transfers settlement vouchers (signed lists) for the funds paid to beneficiaries and returns any unspent funds (for the fourth quarter) to the Department of Labor, Invalids and Social Affairs as the basis for government budget settlement.
Article 10. Responsibilities of agencies
1. Commune People's Committee
a) Establishes a Social Assistance Review Board;
b) Manages social welfare beneficiaries in the locality;
c) Updates the monthly list of beneficiaries (if there are changes, new additions, or reductions due to death or no longer meeting eligibility criteria) and sends it to the Department of Labor, Invalids and Social Affairs for submission to the Chairman of the District People's Committee for decision;
d) Summarizes and reports periodically on the implementation results of social assistance policies in the locality and submits along with a summary table of data according to Models 11a, 11b, 11c, and 11d issued together with this Circular to the Department of Labor, Invalids and Social Affairs and the District People's Committee before June 15 and December 15 each year;
đ) Manage activities of social welfare facilities, social houses, and coordinate activities with social welfare facilities and social houses in the locality;
e) For emergency assistance policies: Prepare lists and organize timely relief for the correct recipients and support affected individuals to quickly overcome disaster consequences, stabilize production, and daily life.
2. Department of Labor, Invalids, and Social Affairs
a) Manage social welfare beneficiaries in the locality through files, registers, or computer software;
b) Guide, organize implementation, inspect, and supervise communes in identifying and managing beneficiaries; organize implementation of social assistance policies within the jurisdiction;
c) Annually, prepare a budget for monthly assistance payments; emergency assistance; and management costs, submit to the Department of Finance for consolidation and report to the Chairman of the District People's Committee for regular and emergency assistance budget settlement according to current regulations;
d) For localities implementing social assistance policies through payment service organizations, send the payment list monthly to the payment service organization; guide, inspect, and supervise the payment service organization in the implementation of payment work for beneficiaries.
đ) Summarize and report periodically on the results of implementing social assistance policies in the locality and attach the summary table of data according to templates 11a, 11b, 11c, and 11d issued together with this Joint Circular to the Department of Labor, Invalids and Social Affairs and the People's Committee of the district before June 30 and December 31 each year.
e) Manage social welfare facilities and social houses established by the district.
3. Provincial Department of Labor, Invalids, and Social Affairs
a) Take the lead, coordinate with the Department of Finance, based on specific conditions of the locality regarding social assistance policy beneficiaries and the budget balancing capacity of the local budget, establish social allowance levels, maintenance allowance levels, care and maintenance funding support levels, and other higher social assistance levels than those prescribed in Decree No. 136/2013/ND-CP, and submit them to the Provincial People's Committee for promulgation.
b) Guide, organize the implementation, and inspect and supervise the implementation of social assistance policies in the locality.
c) Annually, at the time of preparing the budget estimate, compile the number of regular social assistance policy beneficiaries from the districts, emergency assistance funds, and anticipated needs for implementation funds, along with the regular expenditure budget estimate, and submit them to the Department of Finance for consideration and consolidation into the local budget estimate, and submit to the competent authority for decision in accordance with the State Budget Law and guiding documents.
d) In cases of widespread natural disasters or fires causing significant damage and where the funds specified in Clause 1, Article 35 of Decree No. 136/2013/ND-CP are insufficient for emergency assistance, the Department of Labor, Invalids and Social Affairs shall take the lead, coordinate with the Department of Finance and the Department of Agriculture and Rural Development to compile and submit to the Chairman of the Provincial People's Committee for reporting to the Ministry of Labor, Invalids and Social Affairs and the Ministry of Finance for consolidation and submission.
đ) Summarize and report periodically on the results of implementing policies in the locality and attach the summary table of data according to templates 11a, 11b, 11c, and 11d issued together with this Joint Circular to the Ministry of Labor, Invalids and Social Affairs and the Provincial People's Committee before January 15 and July 15 each year.
e) Manage social welfare facilities and social houses established by the province.
g) Implement the application of information technology in managing social welfare beneficiaries at the provincial and district levels; build databases, compile, and send information of beneficiaries formatted according to the XML standard to the Ministry of Labor, Invalids and Social Affairs (the Ministry's electronic portal) regularly and urgently as prescribed.
4. Provincial Finance Departments
a) Coordinate with the Department of Labor, Invalids and Social Affairs, based on specific conditions of the locality regarding social assistance policy beneficiaries and the budget balancing capacity of the local budget, establish social allowance levels, maintenance allowance levels, care and maintenance funding support levels, and other higher social assistance levels than those prescribed in Decree No. 136/2013/ND-CP, and submit them to the Provincial People's Committee for promulgation.
b) Compile the budget estimate for implementing social assistance policies for social welfare beneficiaries in the province into the local budget estimate, and submit to the competent authority for decision in accordance with the State Budget Law and guiding documents.
5. Payment service organizations are responsible for implementing as prescribed in Article 9 of this Joint Circular. In case of loss of money during the implementation of payments or incorrect payments, the payment service organization is responsible for recovering and compensating the beneficiary or the agency that signed the contract, and must bear legal responsibility.
Article 11. Transitional Provisions
1. The subjects entitled to monthly social allowance levels and coefficients as prescribed in Decree No. 136/2013/ND-CP from January 1, 2015 include:
a) Subjects prescribed in Clauses 1, 2, 3, and 4 of Article 5 of Decree No. 136/2013/ND-CP;
b) Subjects prescribed in Point a and Point c of Clause 5 of Article 5 of Decree No. 136/2013/ND-CP;
c) Subjects prescribed in Point b of Clause 5 and subjects prescribed in Clause 6 of Article 5 of Decree No. 136/2013/ND-CP who belong to poor households.
3. Subjects living in social welfare facilities and social houses prescribed in Article 25 of Decree No. 136/2013/ND-CP shall enjoy benefits and policies as prescribed in Decree No. 136/2013/ND-CP from January 1, 2015.
5. From January 1, 2015, procedures and documents for implementing regular, emergency, and other social assistance benefits and policies shall be carried out according to Decree No. 136/2013/ND-CP and this Joint Circular. Subjects who have submitted applications before January 1, 2015 but have not yet received decisions on benefits and policies do not need to resubmit applications (except in cases where subjects must supplement documents as prescribed).
Article 12. Effective Date
1. This Joint Circular takes effect from January 1, 2015.

3. In case the referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the newly issued documents.
4. During the implementation process, if there are any difficulties, it is requested that ministries, sectors, and localities promptly reflect them to the Ministry of Labor, Invalids and Social Affairs and the Ministry of Finance for research and resolution./.
