Regulations on Additional Teaching and Learning
Pursuant to the Education Law dated June 14, 2019;
Pursuant to Decree No. 86/2022/NĐ-CP dated October 24, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 127/2018/NĐ-CP dated September 21, 2018 of the Government stipulating the responsibilities for state management in education;
Pursuant to Decree No. 24/2021/NĐ-CP dated March 23, 2021 of the Government stipulating management within public preschool educational institutions and public general educational institutions;
Pursuant to Decree No. 125/2024/NĐ-CP dated October 5, 2024 of the Government stipulating conditions for investment and operation in the field of education;

The Minister of Education and Training issues this Circular on Additional Teaching and Learning.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Circular regulates additional teaching and learning in general education and continuing education, including: principles of additional teaching and learning; cases where additional teaching and learning are not allowed; organization of additional teaching and learning; responsibility for managing additional teaching and learning activities.
Article 2. This Circular applies to persons providing additional teaching and learning; organizations and individuals organizing additional teaching and learning, and related organizations and individuals.
In this Circular, the following terms are understood as follows:
1. Additional Teaching and Learning means teaching and learning activities outside the prescribed time in the education plan for subjects and educational activities (hereinafter referred to as subjects) in the General Education Program, the Continuing Education Program for lower secondary level, and the Continuing Education Program for upper secondary level issued by the Minister of Education and Training.
2. Additional Teaching and Learning within Schools means teaching and learning activities organized by general education schools, continuing education schools, and other educational institutions implementing the General Education Program, the Continuing Education Program for lower secondary level, and the Continuing Education Program for upper secondary level (hereinafter referred to as schools).
3. Additional Teaching and Learning Outside Schools means teaching and learning activities not organized by schools as stipulated in Clause 2 of this Article.
Article 3. Principles of Additional Teaching and Learning
1. Additional teaching and learning may only be organized when students have a need for additional learning, voluntarily participate in additional learning, and obtain the consent of their parents or guardians (hereinafter referred to as parents). Schools, organizations, and individuals organizing additional teaching and learning shall not use any form to compel students to participate in additional learning.
2. The content of additional teaching and learning must not contravene Vietnamese laws, shall not carry racial, religious, occupational, gender, or social status biases. The curriculum content of the school shall not be reduced to include additional teaching.
3. Additional teaching and learning must contribute to the development of students' qualities and capabilities; it shall not affect the implementation of the school's education program and teachers' subject programs.
4. The duration, timing, location, and format of organizing additional teaching and learning must be appropriate to the age characteristics and ensure the health of students; comply with legal provisions on working hours, overtime, and legal provisions on security, public order, environmental hygiene, and fire prevention in areas where additional teaching and learning classes are held.
Article 4. Cases where additional teaching shall not be organized
1. Additional teaching shall not be organized for elementary school students, except in the following cases: artistic enhancement, physical education and sports, life skill training.
2. Teachers currently teaching at schools shall not provide additional teaching outside the school premises for students whom they are assigned to teach according to the school's educational plan, and charge fees from such students.
3. Teachers at public schools shall not participate in managing or directing additional teaching outside the school premises but may participate in providing additional teaching outside the school premises.
Chapter II
ORGANIZING ADDITIONAL TEACHING AND LEARNING
1. Additional teaching and learning within schools shall not charge fees from students and shall only be provided for students who have registered for additional learning on a subject-by-subject basis as follows:
a) Students whose academic performance in a subject at the end of the previous semester was below standard;
b) Students selected by the school for outstanding student enhancement;
c) Students in the final grade level voluntarily registering for review classes for entrance exams or graduation exams according to the school's educational plan.
2. The school shall organize for students falling under the provisions of Clause 1 of this Article to submit registration forms for additional learning on a subject-by-subject basis for each grade level (according to Form No. 01 attached to this Circular).
3. Based on the number of students who have registered, the school shall develop a plan to organize additional teaching for each subject for each grade level.
4. The class arrangement, timetable scheduling, and organization of additional teaching and learning must meet the following requirements:
a) Additional teaching classes shall be arranged by subject for each grade level; each class shall not exceed 45 (forty-five) students;
b) Additional teaching hours shall not be interspersed with regular class schedules and shall not cover topics ahead of the curriculum distribution plan for each subject in the school's educational plan;
c) Each subject's additional teaching shall not exceed 02 (two) periods per week.
5. The plan for organizing additional teaching and learning shall be publicly disclosed on the school's website or posted at the school.
1. Organizations or individuals organizing activities of additional teaching and learning outside schools that charge fees from students (hereinafter referred to as additional teaching facilities) must comply with the following requirements:
a) Registering business operations in accordance with the law;
b) Publicly disclosing on their online portal or posting at their facility's location information about the subjects offered for additional teaching; the duration of additional teaching for each subject by grade level; the location, form, time of organizing additional teaching and learning; the list of additional teachers and the fee for additional learning before recruiting students for additional teaching and learning classes (according to Form No. 02 attached to this Circular).
2. Individuals providing additional teaching outside schools must ensure good moral character and possess professional competence appropriate to the subject they are participating in teaching.
3. Teachers currently teaching at schools who participate in additional teaching outside schools must report to the Principal or Director or head of the school (hereinafter collectively referred to as the Principal) regarding the subject taught, location, form, and time of participation in additional teaching (according to Form No. 03 attached to this Circular).
Article 7. Collection and Management of Additional Learning Fees
1. The funds for organizing additional teaching and learning within schools shall be sourced from the state budget and other lawful financial resources as prescribed by law.
2. The amount of fees for additional learning outside schools shall be agreed upon between parents/guardians of students and the students themselves with the educational institution providing additional teaching.
3. The collection, management, and utilization of additional learning fees shall be carried out in accordance with the provisions of laws on finance, budget, property, accounting, taxation, and other relevant regulations.
Chapter III
RESPONSIBILITIES FOR MANAGING ADDITIONAL TEACHING AND LEARNING ACTIVITIES
Article 8. Responsibilities of the Provincial People's Committee
1. Shall be responsible for managing additional teaching and learning activities in the locality.
a) The responsibilities of people's committees at all levels, educational management agencies, and related agencies in implementing the regulations on additional teaching and learning;
b) The management and use of funds for organizing additional teaching and learning;
c) Inspection, supervision, and handling of violations.
3. Directing the inspection and supervision of additional teaching and learning activities within the managed area; handling violations according to the provisions of the law.
1. Taking the lead and coordinating with related agencies to advise the provincial people's committee on issuing local regulations on additional teaching and learning.
2. Guiding and organizing the implementation of regulations on additional teaching and learning for schools, organizations, and individuals under their jurisdiction within the managed area.
1. Shall be responsible for managing additional teaching and learning activities within the district.
2. Guiding and supervising the implementation of regulations on additional teaching and learning within the district; handling violations or recommending competent authorities to handle violations.
3. Directing the People's Committee of communes to supervise and inspect compliance with legal provisions on working hours, overtime, and legal provisions on security, public order, safety, environmental hygiene, and fire prevention of organizations and individuals providing additional teaching and learning outside schools within the district.
1. Taking the lead and coordinating with related agencies to implement the management of additional teaching and learning within the area.
2. Guiding and organizing the implementation of regulations on additional teaching and learning for schools, organizations, and individuals under their jurisdiction within the managed area.
3. Organizing or coordinating with related agencies to conduct inspections of additional teaching and learning activities within the managed area; handling violations within their authority or recommending competent authorities to handle violations.
1. Coordinating with the Educational and Training Office and related agencies to manage the implementation of regulations on additional teaching and learning within the area.
2. Implementing directives of the District People's Committee as stipulated in Clause 3, Article 10 of this Circular.
1. Organizing additional teaching and learning activities within the school in accordance with this Circular and other relevant legal provisions.
3. Shall be accountable to the direct management agency regarding the quality of additional teaching and learning within the school; the management and utilization of funds for organizing additional teaching and learning within the school as prescribed.
5. Receiving and processing opinions, suggestions, and wishes of students and their parents regarding additional teaching and learning before and during the implementation process.
1. Implement the regulations on supplementary teaching and learning set forth in this Circular and other relevant laws.
2. Manage and ensure the quality of supplementary teaching and learning and the rights of students participating in supplementary learning and teachers providing supplementary teaching; manage and use supplementary learning fees in accordance with the regulations.
3. Manage and retain records of supplementary teaching and learning organizations in accordance with the regulations.
4. Report and explain the implementation of the regulations stipulated in this Circular and other relevant laws to competent authorities when requested.
5. Receiving and processing opinions, suggestions, and wishes of students and their parents regarding additional teaching and learning before and during the implementation process.
1. Supplementary teaching and learning activities are subject to inspection by state inspection agencies in accordance with the provisions of the law.
2. Supplementary teaching and learning activities are subject to supervision by educational management agencies and state management agencies at all levels according to their respective jurisdictions.
Article 16. Handling Violations
1. Schools, supplementary education institutions, organizations, and individuals violating the regulations on supplementary teaching and learning shall be handled according to the law depending on the nature and severity of the violation.
2. The heads of agencies, organizations, and units where civil servants and public officials violate the regulations on supplementary teaching and learning shall be handled according to the law depending on the nature and severity of the violation.
Chapter IV
IMPLEMENTING PROVISIONS
Article 17. Effective Date
This Circular takes effect from February 14, 2025.
This Circular replaces Circular No. 17/2012/TT-BGDĐT dated May 16, 2012, issued by the Minister of Education and Training on supplementary teaching and learning regulations.
Article 18. Responsibility for Implementation
The Director of the Office, the Heads of the Secondary Education Department, the Primary Education Department, the Continuous Education Department, the Heads of related units under the Ministry of Education and Training, the Chairpersons of Provincial People's Committees, the Directors of Departments of Education and Training, and related organizations and individuals are responsible for implementing this Circular./.
