Guidelines for certain provisions of Decree No. 101/2017/ND-CP dated September 1, 2017 of the Government on training and capacity building for cadres, civil servants, and public officials, and Decree No. 89/2021/ND-CP dated October 18, 2021 of the Government amending and supplementing certain articles of Decree No. 101/2017/ND-CP of the Government on training and capacity building for cadres, civil servants, and public officials.
Pursuant to Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

The Minister of Home Affairs issues this Circular guiding certain provisions of Decree No. 101/2017/ND-CP dated September 1, 2017 of the Government on training and capacity building for cadres, civil servants, and public officials, and Decree No. 89/2021/ND-CP dated October 18, 2021 of the Government amending and supplementing certain articles of Decree No. 101/2017/ND-CP of the Government on training and capacity building for cadres, civil servants, and public officials.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
1. This Circular guides the management and model of certificates for training programs; organizing overseas capacity building for cadres, civil servants, and public officials using state budget funds; standards for lecturers at training and capacity-building institutions for cadres, civil servants, and public officials; and evaluating the quality of capacity building for cadres, civil servants, and public officials.
2. The contents guiding management, certificate models, and evaluation of the quality of capacity building for cadres, civil servants, and public officials set forth in this Circular apply to the following courses (including direct classroom teaching or distance learning):
a) Courses on administrative management knowledge and skills according to the cadre rank standards.
b) Courses according to the occupational title standards for specialized public officials.
c) Courses according to job position requirements for leadership and management positions.
d) Courses according to job position requirements for professional and technical positions.
e) Courses according to the standards for positions and titles of cadres and civil servants at the commune level.
Article 2. Applicability
1. The following agencies and organizations:
a) Agencies and units managing and utilizing cadres, civil servants, and public officials.
b) National Academy of Public Administration.
c) Political Theory Schools of provinces and centrally governed cities, and training and capacity-building institutions for cadres and civil servants under ministries, ministerial-level agencies, government agencies, the Vietnam Fatherland Front, and central-level political-social organizations (hereinafter referred to as training and capacity-building institutions).
d) Academies, research institutes, universities, colleges, and secondary vocational schools (hereinafter referred to as training and research institutions).
2. The following individuals:
a) Cadres in state agencies.
b) Civil servants in Party of Vietnam Communist Party, State, Vietnam Fatherland Front, central-level, provincial-level, district-level, and commune-level organizations (hereinafter referred to as commune-level).
c) Public officials in public service units.
Article 3. Explanation of Terms
In this Circular, the following terms shall be understood as follows:
1. Quality of capacity building: Satisfaction of relevant parties and achievement of capacity-building objectives for cadres, civil servants, and public officials.
2. Criteria: A component forming part of the assessment content, specifically detailing the assessment content.
3. Index: Quantitative figures used to measure criteria.
4. Former trainees: Trainees who have completed a course and returned to work at their agency or unit.
5. Independent assessment agency: An organization that has been granted a license to operate according to the law for educational quality assurance or vocational education quality assurance.
Article 4. Purpose and Content of Quality Training Evaluation for Civil Servants and Public Officials
1. Provide the Ministry of Home Affairs; agencies and units managing and using civil servants and public officials; National Academy of Public Administration; training and development institutions; educational and research institutions with objective information on the quality of training for civil servants and public officials.
2. Based on the results of the quality evaluation, the Ministry of Home Affairs; agencies and units managing and using civil servants and public officials; National Academy of Public Administration; training and development institutions; educational and research institutions propose and implement solutions to innovate and improve the quality of training for civil servants and public officials.
3. Content of Evaluation:
a) Programs and materials.
b) Students.
c) Lecturers.
d) Infrastructure and supporting activities.
đ) Training courses.
e) Post-training effectiveness.
Chapter II
CERTIFICATE OF TRAINING PROGRAM
FOR CIVIL SERVANTS AND PUBLIC OFFICIALS
Article 5. Printing, Issuing, Reissuing and Managing Certificates and Certificates of Completion
1. The National Academy of Public Administration; training and development institutions; educational and research institutions have the right to print and issue certificates for training programs assigned by authorized bodies. The certificate format is specified in Appendix I attached hereto.
2. The certificate of completion for a training program is issued once to students who complete the course on the final day of the course.
3. The National Academy of Public Administration, training and development institutions, educational and research institutions shall be responsible for:
a) Issuing a certificate of course completion for cases where the certificate is lost or damaged. The certificate of course completion has the same validity as the certificate of completion for a training program. The format of the certificate of course completion is specified in Appendix II attached hereto.
b) Reissuing the certificate of completion for a training program in cases where there are errors in the previously issued certificate due to the fault of the National Academy of Public Administration, training and development institutions, educational and research institutions.
c) Reissuing the certificate of course completion in cases where the certificate of course completion is lost or damaged.
4. Within the shortest period of five working days from the date of receiving the student's application (accompanied by the erroneous or damaged certificate), the National Academy of Public Administration, training and development institutions, educational and research institutions shall be responsible for reviewing and deciding to issue or reissue the certificate of course completion or the certificate of completion for a training program to the student.
5. The National Academy of Public Administration, training and development institutions, educational and research institutions shall establish a record of management for issuing certificates of completion for training programs and certificates of course completion in accordance with the law. Ensure transparency and openness.
Article 6. Conditions for Issuing a Certificate of Completion for a Training Program
A certificate of completion for a training program shall be issued to students meeting the following conditions:
1. Participating fully in training in accordance with the training program regulations.
2. Completing all required tests, write-ups, essays, and projects as stipulated in the training program; each test, write-up, essay, and project must achieve at least 50% of the points according to the grading scale specified in the program.
3. Adhering strictly to all laws and regulations regarding the training of civil servants and public officials; rules and internal regulations of the National Academy of Public Administration; training and development institutions; educational and research institutions.
Article 7. Language on certificates and certification papers
The language on certificates and certification papers shall be Vietnamese. For certificates and certification papers that also include foreign languages, such foreign languages must be accurately recorded and consistent with the content in Vietnamese; the size of the foreign language font shall not exceed the size of the Vietnamese font.
Article 8. Revocation and cancellation of training program certificates and course completion certification papers
1. Training program certificates and course completion certification papers shall be revoked in the following cases:
a) There is fraud in recruitment or study for the certificate holder.
b) Issued to individuals who do not meet the requirements; issued beyond authority.
c) The certificate has been erased or altered.
d) Allowed others to use it.
đ) Due to errors of the National Academy of Public Administration, training institutions, or research institutions.
2. The National Academy of Public Administration, training institutions, research institutions have the authority to revoke and cancel certificates and certification papers issued by their units. In cases where these institutions have merged, split, separated, or dissolved, the competent authority directly above these units shall have the authority to revoke and cancel certificates and certification papers.
3. The head of the agency mentioned in Clause 2 of this Article shall issue a decision to revoke and cancel certificates and certification papers. The content of the decision shall clearly state the reasons for revocation and cancellation. The decision shall be published on the official website of the authority responsible for revoking and cancelling certificates and certification papers; sent to the individual whose certificate or certification paper is being revoked, the inspection agency that discovered the violation (if any), the agency where the individual is currently employed (if any), and relevant agencies and organizations.
Chapter III
TRAINING ABROAD
AT THE EXPENSE OF THE STATE BUDGET
Article 9. Tasks of agencies and units assigned to organize overseas training programs for cadres, civil servants, and public officials
1. Develop and approve plans for overseas training of cadres, civil servants, and public officials.
2. Develop detailed content and programs for the training courses after the plan has been approved.
3. Sign contracts with foreign organizations with training and development functions. The contract must clearly specify the commitments of both parties regarding the form, duration, content, program, funding, living and learning conditions, and other related matters.
4. Issue a decision to establish an outbound training delegation, appointing one member as the team leader and another as the secretary. The authority to dispatch cadres, civil servants, and public officials for overseas training shall be carried out according to regulations on exit and entry for Vietnamese citizens.
5. Inform each member of the delegation before departure:
a) Regulations on managing the delegation and cadres, civil servants, and public officials studying and researching abroad; an overview of the laws, culture, and religion of the host country.
b) Content, duration, program of the training course, and related benefits.
Article 10. Responsibilities and tasks of the team leader and cadres, civil servants, and public officials dispatched for overseas training
1. Responsibilities and tasks of the team leader:
a) Responsible for all activities of the delegation during the period of study abroad.
b) Represent the delegation in transactions with foreign training and development institutions and Vietnamese diplomatic missions abroad (if necessary).
c) Monitor and ensure that the study and research program of the delegation is implemented in accordance with the signed contract.
d) Manage members of the delegation.
đ) Sign and send reports on the implementation of the plan and the results of the study to the competent authority after the training course ends.
2. Responsibilities and tasks of cadres, civil servants, and public officials dispatched for overseas training:
a) Strictly comply with regulations on managing the delegation and cadres, civil servants, and public officials studying and researching abroad; follow the instructions of the team leader.
b) Comply with the law, respect local customs, traditions, and cultural norms of the host country, and abide by the rules of the training institution and accommodation facilities.
c) Report on the results of studies as stipulated in Articles 11 and 12 of this Circular.
Article 11. Report on Learning Outcomes
1. The report on learning outcomes of the delegation includes the following main contents:
a) Composition of the delegation.
b) Overview of the situation in the country where they study.
c) Content, duration, and program of the training course.
d) Organization work of the training course and compliance with regulations by trainees and the delegation.
đ) Implementation results and comments and evaluations on the content, program, methods, and duration of the training course.
e) Contents absorbed and experiences drawn from the training course.
g) Proposals for recommendations and solutions to improve the quality of overseas training courses.
2. The report on learning outcomes of the trainee includes the following main contents:
a) Name, year of birth.
b) Position, rank, working agency/unit, contact phone number; email address.
c) Implementation results and comments and evaluations on the content, program, methods, duration, and organization work of the training course.
d) Knowledge and experiences absorbed and proposals for application in professional work and management of the current working agency/unit.
đ) Opinions on cadre training work abroad.
Article 12. Reporting System
1. Within the latest 15 days from the date the delegation returns to the country, the delegation's report must be sent to the following agencies:
a) Ministry of Home Affairs (if the delegation participates in annual overseas training plans for cadres, civil servants, and public officials organized by the Ministry of Home Affairs).
b) Agency that decided to establish the delegation.
2. Within the latest 15 days from the date the delegation returns to the country, the trainee's report must be sent to the following agencies:
a) Agency that decided to establish the delegation.
b) Agency or unit employing the cadre, civil servant, or public official.
3. Within the latest 30 days from the date the delegation returns to the country, the delegation's report must be publicly posted on the electronic information portal of the agencies as stipulated in Clause 2 of this Article (excluding state secrets according to regulations).
4. Annually, ministries, ministerial-level agencies, government agencies, provincial/municipal people's committees under the central government, and central-level political-social organizations have the responsibility to send reports on cadre, civil servant, and public official training abroad (if applicable) to the Ministry of Home Affairs.
Chapter IV
STANDARDS, TASKS, WORKING REGIME, AND POLICIES FOR TEACHERS IN TRAINING AND REHABILITATION INSTITUTIONS FOR CADRES, CIVIL SERVANTS, AND PUBLIC OFFICIALS
Article 13. Standards
1. Senior Teacher:
a) Hold a doctoral degree appropriate to the job position, major, and teaching specialty.
b) Have theoretical political level as prescribed.
c) Possess a certificate for teacher vocational standard training.
d) Be able to use information technology and foreign languages as required by the job position.
2. Principal Teacher:
a) Hold a master's degree or higher appropriate to the job position, major, and teaching specialty.
b) Have theoretical political level as prescribed.
c) Possess a certificate for teacher vocational standard training.
d) Be able to use information technology and foreign languages as required by the job position.
3. Teacher:
a) Hold a bachelor's degree or higher appropriate to the job position, major, and teaching specialty.
b) Have theoretical political level as prescribed.
c) Possess a certificate for teacher vocational standard training.
d) Be able to use information technology and foreign languages as required by the job position.
Article 14. Working Time, Standard Teaching Hours, and Standard Teaching Hour Quotas
1. Teachers' working time follows a 40-hour workweek system.
2. Total working time of teachers in a year to fulfill teaching, scientific research, study, training, and other tasks is 1,760 hours after deducting the number of days off as prescribed.
3. Standard teaching hour is a unit of time converted from the necessary labor hours to complete a certain workload within the teaching tasks of teachers equivalent to one theoretical or practical class session (or remote teaching), including necessary labor hours before, during, and after the class session.
4. Teaching time in the training and rehabilitation plan is calculated in standard teaching hours, wherein one session (45 minutes) of direct classroom teaching or discussion (or remote teaching) is counted as one standard teaching hour and is specifically defined in Article 19 of this Circular.
5. Framework of standard teaching hour quotas in a year:
a) Probationary Teacher: Maximum 90 standard hours.
b) Teacher: 270 standard hours.
c) Principal Teacher: 290 standard hours.
d) Senior Teacher: 310 standard hours.
đ) Direct classroom teaching hours of the positions specified in points b, c, and d of this clause account for at least 50% of the corresponding quota.
6. Heads of training and rehabilitation institutions specify specific standard teaching hour quotas for each teacher, consistent with the actual situation of the unit but not exceeding or falling below 15% compared to the standard teaching hour quotas prescribed in Clause 5 of this Article.
Article 15. Teaching Duties
1. Teaching Preparation:
a) Master the objectives, content, curriculum, teaching methods, position, requirements of the subject, of the assigned topics, examination regulations, assessment criteria for student learning outcomes.
b) Develop a teaching plan, course outline, lecture materials, and design data to support teaching activities.
2. Delivering lectures, guiding students in self-study skills, discussion, problem-solving, scientific research, participation in practical activities, writing graduation theses (if applicable), term papers, projects.
3. Understanding the level, knowledge, and aspirations of students; regularly updating information to supplement, improve, and innovate teaching content, methods, and data supporting teaching.
4. Implementing the process of evaluating student learning outcomes and guiding students to evaluate teaching activities.
5. Observing classes, conducting demonstration lessons, and participating in the evaluation of other lecturers' teaching activities according to the training institution's regulations.
Article 16. Scientific Research Duties
1. Leading or participating in implementing scientific research programs, projects, and topics assigned; results must be evaluated by the Science Council as meeting or exceeding requirements.
2. Leading or participating in developing training programs, reference materials; innovative teaching methods and assessment for courses and topics within the assigned training curriculum.
3. Writing articles published in scientific journals; special topics, reports, presentations at conferences and seminars assigned to attend.
4. Implementing the process of evaluating scientific research outcomes of students; participating in assessing and certifying the quality of training and development.
5. Participating in international cooperation activities in science when assigned.
6. Assigning scientific research tasks to lecturers must align with the training institution's conditions, scientific potential, development strategy, and the lecturer's professional capacity.
7. Each year, lecturers must complete assigned scientific research tasks corresponding to their rank or job position. Lecturer's research outcomes are assessed through scientific and technological products, research activities, and technology transfer.
8. The head of the training institution assigns scientific research tasks to lecturers and specifies the number of hours of scientific research converted from various types of scientific and technological products, research activities, and technology transfer.
Article 17. Duties in Participating in Training Management, Development, Scientific Research, Party Work, Mass Organizations, and Other Activities
1. Participating in building, implementing, and monitoring the execution of teaching and learning plans of the training institution.
2. Participating in enrollment, admission, class management, internship supervision, laboratory management (if applicable); departmental management, scientific management, party work, mass organizations, social activities at the training institution, and other tasks assigned by authorized bodies.
Article 18. Training and Development Tasks
1. Continuously provide training and development to enhance political, professional, state management, foreign language, information technology, and teaching method skills to meet the requirements of educational reform and improve the quality of training and developing cadres, civil servants, and public officials.
2. Annually participate in practical research, supplementing practical knowledge into lectures and improving skills to handle work situations.
Article 19. Conversion to Standard Teaching Hours
1. Teaching:
a) One class session of lecturing and discussion is counted as 1 standard hour.
b) One class session of guiding problem-solving exercises is counted from 2 to 2.5 standard hours.
c) One class session of guiding practical exercises is counted from 1.5 to 2 standard hours.
d) One class session of delivering a specialized report lecture is counted from 1.5 to 2 standard hours.
2. Guidance:
a) Guiding one student to write a graduation thesis (if applicable) is counted from 8 to 10 standard hours.
b) Guiding one student to write a summary, essay, or project is counted from 3 to 5 standard hours.
c) Guiding and taking students to conduct practical research for one working day is counted from 3 to 4 standard hours.
3. Preparing and Reviewing Examination Questions:
a) Preparing one written examination question and answer is counted from 2 to 2.5 standard hours. Reviewing one written examination question and answer is counted as 0.5 standard hour.
b) Preparing five oral examination questions and answers is counted from 1.5 to 2 standard hours. Reviewing five oral examination questions and answers is counted as 0.5 standard hour.
c) Preparing one multiple-choice examination question and answer is counted from 2 to 2.5 standard hours. Reviewing one multiple-choice examination question and answer is counted as 0.5 standard hour.
4. Supervising Examinations:
Each examination session is counted as 0.5 standard hour per lecturer.
5. Grading Examination Papers, Summaries, Essays, and Projects (grading two rounds, each round by one lecturer):
a) Each round grading four to six written examination papers is counted as 1 standard hour.
b) Each round grading one oral examination paper is counted as 0.5 standard hour.
c) Each round grading eight to ten multiple-choice examination papers is counted as 1 standard hour.
d) Each round grading one graduation thesis (if applicable) is counted as 2 standard hours.
đ) Each round grading four summaries or essays is counted as 1 standard hour.
e) Each round grading one project is counted as 2 standard hours.
6. Admissions Board or Graduation Recognition Board (if applicable): The Chairperson is counted as 2 standard hours per session; the Vice-Chairperson and Secretary are counted as 1.5 standard hours per session; Members are counted as 1 standard hour per session.
7. Graduation Examination Board or Thesis Grading Board (if applicable): The Chairperson is counted as 3 standard hours per session; the Vice-Chairperson is counted as 2 standard hours per session; the Head of the Examination Grading Committee, Examination Supervisor is counted from 1.5 to 2 standard hours per session; the Deputy Head of the Examination Grading Committee, Examination Supervisor is counted from 1 to 1.5 standard hours per session.
8. Monitoring Graduation Examinations is counted from 1.5 to 2 standard hours per session per person.
9. Grading Excellent Lecturer Examinations at the School Level is counted from 3 to 4 standard hours per session per person.
10. For tasks that have been supported with remuneration from other sources, time conversion to standard teaching hours will not be implemented. However, these tasks are included in the total standard teaching hours quota for evaluating and ranking lecturers who do not meet the labor quota.
11 ||| Based on the above provisions, the head of the training and development institution shall specifically convert the time spent on activities under Clause 1, Clause 2, Clause 3, Clause 5, Clause 6, Clause 7, Clause 8, and Clause 9 of this Article into standard teaching hours, ensuring compliance with the requirements of each training and development program and actual conditions.
Article 20. Management and Utilization of Time for Fulfilling Tasks and Other Activities of Lecturers
1. The head of training and upgrading institutions shall assign teaching, scientific research, study, upgrading tasks, and other tasks suitable to the lecturer's capacity and occupational title, depending on the institution's capabilities, conditions, and development orientation, considering this as one of the bases for annually evaluating and classifying lecturers' quality.
2. Each lecturer must complete assigned teaching, scientific research, study, upgrading tasks, and other tasks corresponding to their occupational title or current position in each year.
Article 21. Application of Standard Hour Quotas
1. Lecturers who exceed standard hour quotas in teaching, scientific research, and other professional activities shall be entitled to overtime work benefits according to the law. The annual overtime working hours of lecturers shall not exceed the time stipulated by labor laws.
2. Female lecturers with children under 36 months old shall have their standard hour quotas reduced by 10%. Non-residential studying lecturers shall have their standard hour quotas reduced by the proportion corresponding to their lecturer rank or concurrently held lecturer positions, respectively. If lecturers simultaneously meet these cases, they shall accumulate the quota reduction ratio.
3. Lecturers during periods of receiving social insurance benefits or taking leave according to current Labor Code regulations shall be exempted from or have their teaching standard hour quotas reduced in proportion to the duration of their leave.
Article 22. Standard Teaching Hour Quotas for Lecturers Holding Leadership and Management Positions or Concurrently Engaged in Party and Mass Organization Work
1. Lecturers appointed to leadership and management positions or concurrently engaged in party and mass organization work shall implement teaching within the following standard hour quota framework:

2. Individuals appointed to leadership and management positions without holding any lecturer occupational titles shall not apply the standard hour quotas prescribed in Clause 1 of this Article.
3. If lecturers hold multiple leadership and management positions or concurrently engage in multiple tasks, they shall only apply the lowest standard teaching hour quota corresponding to their positions.
4. Lecturers working in functional departments of educational institutions without holding leadership and management positions or concurrently engaging in other tasks shall have a teaching quota of 40% of the standard hour quota of their current lecturer rank.
Article 23. Policies for Lecturers
1. Lecturers at training and upgrading institutions shall enjoy salary systems, preferential occupation allowances, seniority allowances, teaching allowances, extra-hour teaching pay, and other lecturer policies and systems as stipulated by law; they shall also benefit from political, professional, and vocational upgrading programs.
2. Lecturers at training and upgrading institutions may be appointed as associate professors or professors and may be awarded titles such as Excellent Teacher and National Teacher according to legal provisions.
Chapter V
QUALITY UPGRADING ASSESSMENT
FOR CIVIL SERVANTS AND PUBLIC OFFICIALS
Section 1
CRITERIA, TOOLS, FEEDBACK COLLECTION,
IMPLEMENTATION OF QUALITY UPGRADING ASSESSMENT
FOR CIVIL SERVANTS AND PUBLIC OFFICIALS
Article 24. Evaluation Criteria
1. Programs and materials:
a) The objectives of the program are clearly defined.
b) The program's output standards are clearly defined and meet the requirements that students need to achieve upon completion of the program.

d) The content of the materials ensures a combination of theory and practice.
đ) The compilation of materials ensures a balance between theory, discussion questions, practical exercises, and real-life scenario assignments.
e) The materials have a logical structure and sequence; language, spelling, and format comply with regulations.
g) The contribution of each section and topic in the materials towards achieving the output standards is clear.
h) The materials are designed and compiled based on the program's output standards.
2. Students:
a) Actively exchange and discuss the content of each topic in the training course.
b) Actively share practical experience and real-life situations during the study period.
c) Properly implement the instructors' learning guidelines.
d) Fully comply with the regulations of the training course, National Academy of Public Administration, training and development institutions, and research institutions.
3. Teacher:
a) The knowledge, skills, and experience of the instructors are appropriate for the teaching content.
b) Instructors guide, encourage, and promote students' practical experience during the learning process.
c) Instructors strictly adhere to the program and material regulations regarding theoretical lectures, discussions, practical sessions, and guidance on solving real-life scenario assignments.
d) Instructors demonstrate good political ideology.
đ) Instructors treat students politely and civilly in communication.
e) Instructors use suitable teaching methods to achieve the program's output standards.
4. Physical facilities and supporting activities:
a) Classrooms and equipment meet teaching and learning requirements.
b) Teaching and learning materials and tools meet the course requirements.

Article 25. Collection of Evaluation Opinions
1. Collect evaluation opinions of trainees and lecturers of the training course on the contents stipulated in Clause 1, Clause 2, Clause 3, and Clause 5 of Article 24 of this Circular.
2. Collect evaluation opinions of trainees, lecturers, Director of the National Academy of Public Administration, and heads of training and development institutions, training institutions, and research institutions on the content stipulated in Clause 4 of Article 24 of this Circular.
3. Collect evaluation opinions of former trainees and heads of agencies and units employing civil servants and public officials on the contents stipulated in Clause 6 of Article 24 of this Circular. The collection of opinions shall be conducted at least six months and up to twelve months from the end of the training course.
4. The collection of evaluation opinions as prescribed in Clause 1 and Clause 2 of this Article shall be carried out on the day following the closing ceremony of the training course.
Article 26. Evaluation Tools, Degree, and Results
1. Use the quality evaluation software for cadre, civil servant, and public official training (hereinafter referred to as the software) to evaluate the contents stipulated in Article 24 of this Circular.
2. Degree of evaluation: From 1 to 5.
3. The results of evaluating the quality of each content shall be implemented according to the guidelines set forth in Appendix IX issued together with this Circular.
4. Depending on the degree achieved by the general evaluation index for each content, the evaluation results will be classified into corresponding levels as follows:

Article 27. Implementation of Evaluation
1. The National Academy of Public Administration, training and development institutions, training institutions, and research institutions shall access, log in, and enter the following information into the software immediately after the trainee completes the enrollment procedures.
a) Training Course: Name of the training course and topics of the training course; opening and closing dates.
b) Lecturer: Full name of the lecturer teaching each topic of the training course, phone number and email address; working unit, rank of public official, civil service grade, leadership position (current or retired).
c) Trainee: Full name, phone number and email address; working unit, rank of public official, civil service grade, position, leadership title.
2. The Ministry of Home Affairs sends login information to trainees, lecturers, Director of the National Academy of Public Administration, and heads of training and development institutions, training institutions, and research institutions through the software.
3. On the day following the closing ceremony of the training course, trainees, lecturers, Director of the National Academy of Public Administration, and heads of training and development institutions, training institutions, and research institutions shall access and conduct evaluations according to the instructions on the software.
4. Six months or more, but not exceeding twelve months from the end of the training course, the Ministry of Home Affairs sends information requesting to evaluate the quality of cadre, civil servant, and public official training to former trainees and heads of agencies and units employing civil servants and public officials through the software.
Section 2
IMPLEMENTATION OF QUALITY EVALUATION
FOR CADRE, CIVIL SERVANT, AND PUBLIC OFFICIAL TRAINING
Article 28. Ministry of Home Affairs
1. Organize the evaluation of the quality of cadre, civil servant, and public official training for the courses stipulated in Clause 2 of Article 1 of this Circular by the following methods:
a) Direct evaluation.
b) Assign tasks or commission independent evaluation agencies to carry out the evaluation.
2. Monitor and urge the National Academy of Public Administration and research institutions to organize the implementation of regulations on the quality evaluation of cadre, civil servant, and public official training.
3. Guide and inspect the quality evaluation activities of cadre, civil servant, and public official training of ministries, ministerial-level agencies, government agencies, central-level political and social organizations, and provincial and municipal people's committees.
4. Develop, manage, transfer, and guide the use of the quality evaluation software for cadre, civil servant, and public official training.
5. Send the results of the quality evaluation of cadre, civil servant, and public official training to Personnel Departments of ministries, ministerial-level agencies, government agencies, central-level political and social organizations; Provincial Departments of Home Affairs and relevant agencies and units.
6. Study and implement solutions to improve the quality of cadre, civil servant, and public official training within its authority.
Article 29. Ministries, ministerial-level agencies, government-affiliated agencies, central-level political-social organizations; People's Committees of provinces and centrally governed cities
1. On the basis of the guidelines for assessing the quality of cadre, civil servant, and public official training stipulated in this Circular, select and adjust to suit actual conditions to assess the quality of cadre, civil servant, and public official training courses within their jurisdiction through various methods:
a) Direct evaluation.
b) Assign tasks or commission independent evaluation agencies to carry out the evaluation.
2. Coordinate with the Ministry of Home Affairs to implement the assessment of the quality of cadre, civil servant, and public official training within their jurisdiction.
3. Supervise and urge training and retraining institutions; training and research institutions to implement regulations on assessing the quality of cadre, civil servant, and public official training.
4. Based on the assessment results report, propose and implement measures to improve the quality of cadre, civil servant, and public official training within their scope of responsibility.
5. Have the responsibility to submit reports on the assessment results of cadre, civil servant, and public official training, implemented measures, and the implementation status and results of these measures to the Ministry of Home Affairs as prescribed in Clause 1, Article 44 of Decree No. 101/2017/NĐ-CP.
6. The Cadre and Civil Service Departments of ministries, ministerial-level agencies, government-affiliated agencies, central-level political-social organizations; Provincial Departments of Home Affairs of provinces and centrally governed cities are the lead units assisting the Minister, head of a ministerial-level agency, head of a government-affiliated agency, head of a central-level political-social organization, and the Chairman of the provincial People's Committee in implementing the guidelines on assessing the quality of cadre, civil servant, and public official training as stipulated in this Circular.
Article 30. National Academy of Public Administration, training and retraining institutions of ministries, ministerial-level agencies, government-affiliated agencies, central-level political-social organizations; Provincial Political Schools of provinces and centrally governed cities; training and research institutions
1. On the basis of the guidelines for assessing the quality of cadre, civil servant, and public official training stipulated in this Circular, select and adjust to suit actual conditions to assess the quality of cadre, civil servant, and public official training courses directly organized through various methods:
a) Direct evaluation.
b) Assign tasks or commission independent evaluation agencies to carry out the evaluation.
2. Implement regulations on assessing the quality of cadre, civil servant, and public official training.
3. Based on the assessment results report, propose and implement measures to improve the quality of cadre, civil servant, and public official training within their scope of responsibility.
4. Have the responsibility to submit reports on training and retraining results; assessment results of cadre, civil servant, and public official training quality, implemented measures, and the implementation status and results of these measures to ministries, ministerial-level agencies, government-affiliated agencies, central-level political-social organizations; People's Committees of provinces and centrally governed cities before January 15 of the following year or as required by the competent authority.
Article 31. Independent Evaluation Agency
1. Conduct evaluations of the contents as required by the agency assigning tasks or placing orders, ensuring compliance with regulations, objectivity, and accuracy.
2. Report the assessment results of cadre, civil servant, and public official training quality as required by the agency assigning tasks or placing orders.
Article 32. Regarding subjects whose opinions are collected for evaluation
1. Subjects whose opinions are collected for evaluation shall be responsible for participating in the quality assessment of cadre, civil servant, and public official training, ensuring compliance with procedures, completeness, objectivity, and honesty.
2. Subjects whose opinions are collected for evaluation who fail to fulfill their responsibilities in implementing the regulations on quality assessment shall be evaluated as not meeting the criteria for organizational discipline as prescribed by law.
Chapter VI
IMPLEMENTING PROVISIONS
Article 33. Transitional Provisions
1. The Ministry of Home Affairs shall use Appendices III, IV, V, VI, VII, VIII, IX, X issued together with this Circular to assess the quality of training until the assessment software is put into use.
2. Agencies and organizations specified in Articles 29 and 30 of this Circular shall refer to and use the Appendices mentioned in Clause 1 of this Article to assess the quality of training for cadres, civil servants, and public officials within their jurisdiction.
3. In cases where lecturers at training institutions have obtained one of the Level I, Level II, or Level III instructor training certificates as prescribed by law before June 30, 2022, they shall be deemed to meet the requirements for the certificate of the training program according to the occupational title standards for lecturers corresponding to each level, which can be used when participating in examinations or considering promotion to higher occupational titles without having to undergo the training program for university lecturers as prescribed in this Circular.
Article 34. Effective Date
1. This Circular takes effect from June 15, 2023.
2. Abolish all the following normative legal documents:
a) Circular No. 01/2018/TT-BNV dated January 8, 2018, of the Minister of Home Affairs guiding certain provisions of Decree No. 101/2017/NĐ-CP dated September 1, 2017, of the Government on training and development of cadres, civil servants, and public officials.
b) Circular No. 10/2017/TT-BNV dated December 29, 2017, of the Minister of Home Affairs stipulating the quality assessment of cadre, civil servant, and public official training.
Article 35. Responsibility for Implementation
1. The Minister, Heads of ministries equivalent to ministries, agencies under the Government, Chairpersons of People's Councils of provinces and centrally governed cities, and relevant agencies, organizations, and individuals shall be responsible for implementing the provisions of this Circular.
2. Any difficulties encountered during implementation should be reported to the Ministry of Home Affairs for guidance or consideration and resolution.
