CIRCULAR

REGULATING THE DETERMINATION OF EQUIVALENT TEACHING RANKS

BASED ON THE EDUCATOR LAW NO. 73/2025/QH15;

BASED ON DECREE NO. 93/2026/NĐ-CP dated March 31, 2026 OF THE GOVERNMENT REGULATING AND GUIDING THE IMPLEMENTATION OF SOME ARTICLES OF THE EDUCATOR LAW;

BASED ON DECREE NO. 37/2025/NĐ-CP dated February 26, 2025 OF THE GOVERNMENT REGULATING THE FUNCTION, MISSION, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF EDUCATION AND TRAINING;

IN ACCORDANCE WITH THE RECOMMENDATION OF THE DIRECTOR OF THE OFFICE OF EDUCATOR AND MANAGEMENT OF EDUCATION STAFF;

THE MINISTER OF EDUCATION AND TRAINING ISSUES THIS CIRCULAR REGULATING THE DETERMINATION OF EQUIVALENT TEACHING RANKS.

ARTICLE 1. SCOPE OF APPLICATION AND APPLICABLE SUBJECTS

1. SCOPE OF APPLICATION

This Circular regulates the determination of equivalent teaching ranks, including: purpose, principles, and determination of equivalent teaching ranks.

2. APPLICABLE SUBJECTS

a) This Circular applies to educators in public educational institutions under the national education system and relevant organizations and individuals;

b) This Circular does not apply to educators in educational institutions under the jurisdiction of the Ministry of National Defense or the Ministry of Public Security.

ARTICLE 2. PURPOSE AND PRINCIPLES OF DETERMINING EQUIVALENT TEACHING RANKS

1. PURPOSE

The determination of equivalent teaching ranks serves as a basis for appointing corresponding teaching ranks after the implementation of position changes in accordance with legal provisions.

2. PRINCIPLES OF DETERMINING EQUIVALENT TEACHING RANKS

a) Determination of equivalent teaching ranks is carried out based on rank and grade of the rank (hereinafter referred to collectively as rank);

b) The determination of equivalent teaching ranks must ensure equivalence in terms of educational qualifications or at the same level of complexity of work according to the requirements of the position and be consistent with the salary scale issued along with Decree No. 204/2004/NĐ-CP on remuneration for civil servants, public officials, staff members, and military personnel;

c) Ensuring transparency, objectivity, fairness, equality, and compliance with legal provisions.

ARTICLE 3. DETERMINATION OF EQUIVALENT TEACHING RANKS

Teaching ranks are determined as equivalent in accordance with the annex attached to this Circular. Among them, teaching ranks within the same group are considered equivalent.

ARTICLE 4. APPLICABLE PROVISIONS

1. In cases where positions other than those of educators are changed to educator positions in accordance with legal provisions, the provisions of this Circular and relevant legal provisions shall be used as a basis for determining equivalence and appointing corresponding teaching ranks.

2. Private educational institutions under the national education system may apply the provisions of this Circular in their management and development of the faculty.

ARTICLE 5. ENFORCEMENT

1. This Circular takes effect from April 15, 2026. 2. The Deputy Director General, Director of the Office of Educator and Management of Education Staff, Heads of Relevant Units under the Ministry of Education and Training, Chairmen of People's Committees of Provinces and Municipalities Directly Under Central Government, Directors of Departments of Education and Training, Heads of Educational Institutions, and relevant organizations and individuals are responsible for enforcing this Circular.

3. In case any referenced documents in this Circular are amended, supplemented, or replaced, the provisions of the new documents shall be applied.

Should any difficulties arise during implementation, please report to the Ministry of Education and Training for guidance or consideration and resolution./.
