Pursuant to Decree No. 70/2007/NĐ-CP dated April 20, 2007, of the Government on registration of nationality and rights over civil aircraft;
Pursuant to Decree No. 75/2007/NĐ-CP dated May 9, 2007, of the Government on investigation of incidents and accidents involving civil aircraft,
The Minister of Transport hereby issues the Civil Aviation Safety Regulations in the Aircraft and Aircraft Operations Sector as follows relating to aircraft and aircraft operation in the civil aviation sector as follows[1]:
Article 1. The Civil Aviation Safety Regulations in the Aircraft and Aircraft Operation Sector are issued together with this Circular[2].
Article 2. This Circular takes effect twelve months after its date of issuance and revokes[3]:
1. Decision No. 10/2008/QĐ-BGTVT dated June 13, 2008, issued by the Minister of Transport to issue the Civil Aviation Safety Regulations;
2. Decision No. 2727/1998/QĐ-CHK dated October 10, 1998, issued by the Director of the Civil Aviation Administration of Vietnam to issue the Commercial Aircraft Operation Regulations - QCHK-KT1;
3. Decision No. 20/2000/QĐ-CHK dated August 1, 2000, issued by the Director of the Civil Aviation Administration of Vietnam regarding the Airworthiness Regulations - Issue 1 - QCHK-CB1;
4. Decision No. 06/2000/QĐ-CHK dated February 3, 2000, issued by the Director of the Civil Aviation Administration of Vietnam on the Regulation on personnel confirming completion of maintenance - QCHK-66;
Decision No. 10/2001/QĐ-CHK dated July 9, 2001, issued by the Director of the Civil Aviation Administration of Vietnam on the Regulation on the process of issuing certificates for aircraft and products and equipment of aircraft - QCHK-21;
6. Decision No. 16/2006/QĐ-BGTVT dated March 31, 2006, issued by the Minister of Transport to issue National Standard 22TCN 337-06 on Aircraft Maintenance Organization Approval;
7. Decision No. 45/2006/QĐ-BGTVT dated December 19, 2006, issued by the Minister of Transport to issue the Commercial Helicopter Operation Regulations.
Article 3. Head of the Ministry's Office, Head of the Ministry's Inspectorate, Heads of Departments, Director of the Civil Aviation Authority of Vietnam, Heads of agencies, organizations, and individuals related thereto are responsible for implementing this Circular[4]./.

CIVIL AVIATION SAFETY REGULATIONS IN THE AIRCRAFT AND AIRCRAFT OPERATIONS SECTOR
(Issued together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport)
Article 1. Scope of application
1. The Civil Aviation Safety Regulations in the Aircraft and Aircraft Operations Sector stipulate the criteria for aircraft operation qualifications, aircraft operation standards, professional standards of aviation personnel in the field of aircraft operation, maintenance, repair, and health examination facilities for aviation personnel. The Civil Aviation Safety Regulations in the Aircraft and Aircraft Operations Sector consist of the following 22 Parts.
2. In cases where international treaties to which the Socialist Republic of Vietnam is a member have provisions different from those of this Circular, the provisions of such international treaties shall be applied.
Article 2. Applicability
The Civil Aviation Safety Regulations in the Aircraft and Aircraft Operations Sector apply to organizations and individuals participating in activities related to design, production, testing of aircraft, installation equipment on aircraft, equipment and materials serving aircraft repair and maintenance, aircraft operation, training, education, and health examination for aviation personnel.

Article 1 of Circular No. 11/2022/TT-BGTVT amending and supplementing certain provisions of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, effective from June 29, 2022, is stipulated as follows:
“Article 1. Amending and supplementing certain provisions of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation (hereinafter referred to as the "Civil Aviation Safety Regulations") as follows:
1. Amend and supplement certain provisions of Part 5 of the Civil Aviation Safety Regulations in Appendix I attached hereto.
2. Amend and supplement certain provisions of Part 7 of the Civil Aviation Safety Regulations in Appendix II attached hereto.
3. Amend and supplement certain provisions of Part 10 of the Civil Aviation Safety Regulations in Appendix III attached hereto.”
[3] Article 2 of Circular No. 03/2016/TT-BGTVT amending and supplementing certain provisions of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, effective from May 15, 2016, is stipulated as follows:
“Article 2. Effective Date
1. This Circular shall take effect from May 15, 2016.
2. This Circular abolishes Circular No. 14/2014/TT-BGTVT dated May 12, 2014, issued by the Minister of Transport amending and supplementing Clause 14.010 Chapter B Part 14 of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation promulgated together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport.”
Article 2 of Circular No. 21/2017/TT-BGTVT amending and supplementing certain provisions of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation and Circular No. 03/2016/TT-BGTVT dated March 31, 2016, issued by the Minister of Transport amending and supplementing certain provisions of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, effective from September 1, 2017, is stipulated as follows:
“Article 2. Effective Date
1. This Circular shall take effect from September 1, 2017.
2. The application of the provisions set forth in Appendix XI of this Circular shall be implemented from July 1, 2018.
3. This Circular abolishes:
a) Circular No. 41/2015/TT-BGTVT dated August 12, 2015, issued by the Minister of Transport amending and supplementing certain provisions in Part 12 and Part 14 of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation promulgated together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport.
b) Decision No. 471/QĐ-BGTVT dated February 22, 2017, regarding the correction of Circular No. 03/2016/TT-BGTVT dated March 31, 2016, issued by the Minister of Transport amending and supplementing certain provisions of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation.”
Article 2 of Circular No. 56/2018/TT-BGTVT dated December 11, 2018, issued by the Minister of Transport promulgating the Circular amending and supplementing certain provisions of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, effective from January 30, 2019, is stipulated as follows:
“Article 2. Effective Date
1. This Circular shall take effect from January 30, 2019.
2. This Circular replaces Circular No. 14/2018/TT-BGTVT dated April 3, 2018, amending and supplementing certain provisions of Circular No. 03/2016/TT-BGTVT dated March 31, 2016, issued by the Minister of Transport amending and supplementing certain provisions of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation.”
Article 2 of Circular No. 42/2020/TT-BGTVT dated December 31, 2020, issued by the Minister of Transport to amend and supplement certain articles of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, which takes effect from March 15, 2021, is stipulated as follows:
“Article 2. Effective Date
This Circular takes effect from March 15, 2021.”
Article 2 of Circular No. 11/2022/TT-BGTVT amending and supplementing certain articles of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, which takes effect from June 29, 2022, is stipulated as follows:
“Article 2. Effective Date
1. This Circular shall take effect from June 29, 2022.
2. Administrative procedures submitted to the Vietnam Civil Aviation Authority before this Circular takes effect shall be implemented according to the provisions of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation (amended and supplemented by Circular No. 03/2016/TT-BGTVT dated March 31, 2016; Circular No. 21/2017/TT-BGTVT dated June 30, 2017; Circular No.
56/2018/TT-BGTVT dated December 11, 2018; Circular No. 42/2020/TT-BGTVT dated December 31, 2020).”
[4] Article 3 of Circular No. 03/2016/TT-BGTVT amending and supplementing certain articles of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, which takes effect from May 15, 2016, is stipulated as follows:
“Article 3. Implementation Organization
The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, the Heads of agencies, units, and individuals concerned shall be responsible for implementing this Circular./.
Article 3 of Circular No. 21/2017/TT-BGTVT amending and supplementing certain articles of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation and Circular No. 03/2016/TT-BGTVT dated March 31, 2016, issued by the Minister of Transport amending and supplementing certain articles of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, which takes effect from September 1, 2017, is stipulated as follows:

Article 3 of Circular No. 42/2020/TT-BGTVT dated December 31, 2020, issued by the Minister of Transport on the Circular amending and supplementing certain articles of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, which takes effect from March 15, 2021, is stipulated as follows:
“Article 3. Implementation Organization
The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, the Heads of agencies, units, and individuals concerned shall be responsible for implementing this Circular./.
