On the basis of Decree No. 3/2013/NĐ-CP dated February 23, 2013 of the Government amending and supplementing certain provisions of Decree No. 61/2006/NĐ-CP dated June 20, 2006 of the Government on policies for teachers and education managers working at specialized schools and in areas with particularly difficult socio-economic conditions
Pursuant to DecreeNo. 61/201(hereinafter referred to as Decree No. 19/2013/NĐ-CP);1The Ministers of the Ministry of Education and Training, the Ministry of Home Affairs, and the Minister of Finance issue this Joint Circular stipulating to implement Clause 1 and Clause 2 Article 1 of Decree No. 19/2013/NĐ-CP as follows:
Decree No. 1Article 1. Guidelines on areas with particularly difficult socio-economic conditions as provided in Clause 1 Article 1 of Decree No. 19/2013/NĐ-CP"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."Government stipulating ||| functions, tasks, powers and organizational structure of the Ministry of Science and Technology; structure organizations under the Ministry Finance;
Pursuant to DecreeNo. 19/2011. The island districts: Truong Sa, Hoang Sa.12. Particularly difficult communes in ethnic minority and mountainous regions, particularly difficult communes in coastal lowlands and islands according to the Decision of the Prime Minister. Specifically:ua) Decision No. 164/2006/QĐ-TTg dated July 11, 2006 of the Prime Minister approving the list of particularly difficult communes, border communes, and safe area communes included in the investment program for the development of socio-economic programs in particularly difficult communes in ethnic minority and mountainous regions for the period 2006-2010 (Program 135 Phase II);"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."Article 2. Level of Support for b) Decision No. 69/2008/QĐ-TTg dated May 28, 2008 of the Prime Minister approving the supplementary list of particularly difficult communes, border communes, and safe area communes included in Program 135 Phase II and the list of communes removed from the investment scope of Program 135 Phase II;intention c) Decision No. 1105/QĐ-TTg dated July 28, 2009 of the Prime Minister approving the supplementary list of particularly difficult communes, border communes, and safe area communes included in Program 135 Phase II and the list of communes that have completed their objectives and been removed from the investment scope of Program 135 Phase II;shall d) Decision No. 539/QĐ-TTg dated April 1, 2013 of the Prime Minister approving the list of particularly difficult communes in coastal lowlands and islands for the period 2013-2015.policies 3. Particularly difficult hamlets (generally referred to as hamlet) according to the decisions of the Minister, Chairman of the National Ethnic Minorities Committee. Specifically: lThe Minister of Finance promulgates the Circular stipulating on the National Price Database. 1a) Decision No. 01/2008/QĐ-UBDT dated January 11, 2008 of the Minister, Chairman of the National Ethnic Minorities Committee approving the list of particularly difficult hamlets in Zone II included in the investment scope of Program 135 Phase II;
b) Decision No. 325/QĐ-UBDT dated October 19, 2009 of the Minister, Chairman of the National Ethnic Minorities Committee approving the supplementary list of particularly difficult hamlets in Zone II included in the investment scope of Program 135 Phase II.ưở4. When the Prime Minister, the Minister, Chairman of the National Ethnic Minorities Committee, or the competent authority (collectively referred to as the competent authority) issues decisions to amend, supplement, or replace the decisions stipulated in this Article, they shall be implemented according to those decisions; when the communes or hamlets listed in these decisions are approved by the competent authority as having completed their program objectives, individuals within the scope of those communes or hamlets will not be entitled to the benefits stipulated in this Joint Circular from the month immediately following the month in which the decision becomes effective. guiding to implement Clause 1 and Clause 2 Article 1 Decree No. 19/2013/ND-CP as follows:
Article 1. Guidance on areas with special difficulties in economic and social conditions as stipulated in Clause 1 Article 1 of Decree No. 19/2013/ND-CP
1. The island districts: Truong Sa, Hoang Sa.
2. Particularly difficult communes in ethnic minority and mountainous regions, particularly difficult communes in coastal lowlands and islands according to the Decision of the Prime Minister. Specifically:
a) Decision No. 164/2006/QD-TTg dated July 11, 2006 of the Prime Minister approving the list of particularly difficult communes, border communes, and safe area communes for investment under the Socio-Economic Development Program for Particularly Difficult Communes in Ethnic Minority and Mountainous Areas for the period 2006-2010 (Program 135 Phase II);
b) Decision No. 69/2008/QD-TTg dated May 28, 2008 of the Prime Minister approving the supplementary list of particularly difficult communes, border communes, and safe area communes for investment under Program 135 Phase II and the list of communes exiting the investment scope of Program 135 Phase II;
c) Decision No. 1105/QD-TTg dated July 28, 2009 of the Prime Minister approving the supplementary list of particularly difficult communes, border communes, and safe area communes for investment under Program 135 Phase II and the list of communes completing the program objectives and exiting the investment scope of Program 135 Phase II;
d) Decision No. 539/QD-TTg dated April 1, 2013 of the Prime Minister approving the list of particularly difficult communes in coastal lowlands and islands for the period 2013-2015.
3. Particularly difficult hamlets, villages, neighborhoods, settlements, phums, socs, aps (collectively referred to as hamlets) according to the decisions of the Minister, Chairman of the National Ethnic Minorities Committee. Specifically:
a) Decision No. 01/2008/QD-UBDT dated January 11, 2008 of the Minister, Chairman of the National Ethnic Minorities Committee approving the list of particularly difficult hamlets in commune areas II for investment under Program 135 Phase II;
b) Decision No. 325/QD-UBDT dated October 19, 2009 of the Minister, Chairman of the National Ethnic Minorities Committee approving the supplementary list of particularly difficult hamlets in commune areas II for investment under Program 135 Phase II.
4. When the Prime Minister, Minister, Chairman of the National Ethnic Minorities Committee, or competent authority (collectively referred to as the competent authority) issues decisions amending, supplementing, or replacing the decisions provided for in this Article, they shall be implemented according to those decisions; when communes and hamlets listed in the decisions provided for in this Article are approved by the competent authority as having completed their program objectives, individuals within the scope of those communes and hamlets shall not enjoy the benefits prescribed in this Circular from the month immediately following the month in which the decision takes effect.
Article 2. Guidance on implementing Clause 2, Article 1 of Decree No. 19/2013/NĐ-CP
1. As of April 15, 2013 (the date Decree No. 19/2013/NĐ-CP takes effect), teachers and educational management officials who have completed three years for women and five years for men working in areas with special economic and social difficulties but whose competent educational management authorities have not yet arranged to return to their last place of residence or work before being transferred to work in such areas shall continue to receive an attraction allowance equal to 70% of the salary coefficient corresponding to their current job title and leadership position allowance, and seniority allowance exceeding the standard (if applicable), and cease to receive the long-term service allowance in areas with special economic and social difficulties as stipulated in Article 5 of Decree No. 116/2010/NĐ-CP dated December 24, 2010 of the Government regarding policies for cadres, civil servants, public employees, and personnel receiving salaries in the armed forces working in areas with special economic and social difficulties (hereinafter referred to as Decree No. 116/2010/NĐ-CP).
The determination of individuals eligible for limited-term transfers to areas with special economic and social difficulties to receive allowances as prescribed in Decree No. 19/2013/NĐ-CP is based on the transfer period specified in the decision of the competent authority.
Example: Mr. Nguyen Van A, a teacher, was decided by the competent authority to be transferred from an educational institution not located in an area with special economic and social difficulties to an educational institution in an area with special economic and social difficulties for a term of five years starting from September 1, 2007 (the transfer period is clearly stated in the decision of the competent authority). By September 1, 2012, although Mr. Nguyen Van A had completed five years of work in an area with special economic and social difficulties, the competent authority had not yet arranged for him to return to his last place of residence or work before the transfer. Therefore, Mr. Nguyen Van A continues to work in an area with special economic and social difficulties until now. If Mr. Nguyen Van A has already received the attraction allowance for five years as stipulated in Article 8 of Decree No. 61/2006/NĐ-CP and is currently receiving the long-term service allowance in areas with special economic and social difficulties as stipulated in Article 5 of Decree No. 116/2010/NĐ-CP, then from April 15, 2013 (the date Decree No. 19/2013/NĐ-CP takes effect) until he is transferred back to his last place of residence or work before the transfer, Mr. Nguyen Van A will again receive the attraction allowance equal to 70% of the salary coefficient corresponding to his current job title and leadership position allowance, and seniority allowance exceeding the standard (if applicable) as prescribed in Decree No. 19/2013/NĐ-CP, and cease to receive the long-term service allowance according to the provisions of Decree No. 116/2010/NĐ-CP.
2. In cases where teachers and educational management officials have been decided by the competent educational management authority to be transferred back to their last place of residence or work before being transferred to work in areas with special economic and social difficulties, they shall cease to receive the attraction allowance prescribed in Clause 1 of this Article from the month immediately following the month in which the transfer decision is made.
Article 3. Guidelines on the compilation of financial needs

2. In cases where the State adjusts the base salary level, provincial People's Committees (hereinafter collectively referred to as provincial People's Committees) shall be responsible for organizing, guiding, reviewing, and compiling the budget requirements for implementing the allowance system as guided in this Circular into the actual salary reform requirements and submitting them to the Ministry of Finance for examination and approval in accordance with regulations.
3. For provinces and centrally-administered cities
a) Direct management agencies paying salaries to teachers and educational administrators shall be responsible for reviewing and preparing the budget for beneficiaries according to Table 1 issued together with this Circular and submitting it to the higher-level management agency according to the current budget hierarchy;
b) The higher-level management agency shall review and compile the additional budget requirements of subordinate agencies and units according to Table 2 issued together with this Circular and submit it to the Department of Finance;
c) The Department of Finance shall be responsible for reviewing and compiling the additional budget requirements according to Table 2 and reporting to the provincial People's Committee for decision;
d) The provincial People's Committee shall compile and report according to Table 2 to the Ministry of Finance for consideration and resolution in accordance with regulations.
4. For the year 2013 and 2014, the Department of Finance shall be responsible for reviewing the additional budget requirements according to Table 3 and compiling the budget requirements for implementing the allowance system according to Table 4 issued together with this Circular, reporting to the provincial People's Committee for submission to the Ministry of Finance for review and presentation to the competent authority for supplementation.
5. The preparation, allocation, management, and settlement of the budget for implementation shall be carried out in accordance with the current provisions of the State Budget Law.
Article 4. Effectiveness and Implementation Provisions
1. This Circular shall take effect from November 3, 2013.
2. The policies prescribed in this Circular shall be enjoyed from April 15, 2013.
3. The areas with special difficulties in economic and social conditions as stipulated in Article 1 of this Circular replace the provisions at Point b Clause 2 Section I of Joint Circular No. 06/2007/TTLT-BGDĐT-BNV-BTC dated March 27, 2007 guiding the implementation of Decree No. 61/2006/ND-CP dated June 20, 2006 of the Government on policies for teachers and educational administrators working in specialized schools and in areas with special difficulties in economic and social conditions, and shall be used to apply the policies and regulations stipulated in Decree No. 61/2006/ND-CP and Decree No. 19/2013/ND-CP.
4. The head of the educational institution shall be responsible for examining, reviewing the files, and compiling the list of teachers eligible to receive the attraction allowance as guided in this Circular.
During the implementation process, if there are difficulties or obstacles, relevant ministries, sectors, and localities should report to the Ministry of Education and Training for coordination with the Ministry of Home Affairs and the Ministry of Finance to study and resolve them./.
