Amending and supplementing some articles of Decision No. 39/2021/QĐ-TTg dated December 30, 2021 of the Prime Minister stipulating principles, criteria, and allocation quotas for central state budget capital and the matching ratio of local state budgets to implement the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030, Phase I: from 2021 to 2025, which has been amended, supplemented, and some articles abolished by Decision No. 18/2023/QĐ-TTg dated July 1, 2023 of the Prime Minister
Pursuant to the Law on Government Organization No. 63/2025/QH15;
Pursuant to the Investment Law No. 58/2024/QH15, which has been amended and supplemented with some articles according to Law No. 90/2025/QH15;
Pursuant to the State Budget Law No. 83/2015/QH13, which has been amended and supplemented with some articles according to Law No. 56/2024/QH15;
Pursuant to Resolution No. 120/2020/QH14 of the National Assembly approving the investment policy for the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030;
Pursuant to Resolution No. 973/2020/UBTVQH14 of the Standing Committee of the National Assembly stipulating principles, criteria, and allocation quotas for public investment capital from the state budget for the period 2021-2025;
Based on the proposal of the Minister of Ethnic Minorities and Religion;
The Prime Minister issues this Decision amending and supplementing some articles of Decision No. 39/2021/QĐ-TTg dated December 30, 2021 of the Prime Minister stipulating principles, criteria, and allocation quotas for central state budget capital and the matching ratio of local state budgets to implement the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030, Phase I: from 2021 to 2025, which has been amended, supplemented, and some articles abolished by Decision No. 18/2023/QĐ-TTg dated July 1, 2023 of the Prime Minister.
Article 1. Amending and supplementing some articles of Decision No. 39/2021/QĐ-TTg dated December 30, 2021 of the Prime Minister as follows:
1. Abolishing the phrase "district level" in Clause 1, Article 2.
2. Replacing the phrase "poor districts" with the phrase "locality"; replacing the phrase "for district" with the phrase "locality" in Clause 4, Article 3.
3. Abolishing Clause 6, Article 3 of Decision No. 39/2021/QĐ-TTg: "The central state budget allocates annual plans for localities implementing the Program based on the disbursement results of the previous year; prioritizing allocations for localities, projects, sub-projects, and contents of the Program to ensure disbursement progress."
4. Adding the word "city" after the phrase "provinces"; replacing the phrase "Quang Nam" with the phrase "Da Nang" in Clause 7, Article 3 and Point b, Clause 2, Article 6.
5. Abolishing the phrase "poor district"; replacing the phrase "Quang Nam" with the phrase "Da Nang" in Point a, Clause 2, Article 6.
6. Replacing the phrase "Committee for Ethnic Minorities" with the phrase "Ministry of Ethnic Minorities and Religion" in Clause 2, Article 4; Clause 1, Article 7; Point a, Clause 4, Article 7.
7. Abolishing the phrase "Ministry of Planning and Investment" in Clause 2, Article 4; Point a, Clause 1, Article 7; Point a, Clause 4, Article 7.
8. Amending Clauses 2 and 3, Article 7 as follows:
"2. Responsibilities of the Ministry of Finance
a) Taking the lead and coordinating with the Ministry of Ethnic Minorities and Religion to propose a plan for balancing and submitting it to the competent authority for approval of development investment capital from the central state budget annually for the Program.
b) Summarizing the plan for allocating development investment capital from the central state budget over the medium term and annually during the period 2021-2025 for central agencies and localities implementing the Program based on the proposals of the Ministry of Ethnic Minorities and Religion, ensuring compliance with the principles, criteria, and allocation quotas prescribed in this Decision.
c) Summarizing the plan for allocating recurrent expenditure capital from the central state budget annually for central agencies and localities implementing the Program to submit to the competent authority for consideration and decision;"
Article 2. Abolishing the content "University preparatory training, allocated to the Committee for Ethnic Minorities not exceeding 20% of the capital content 2 of the sub-project" stipulated in Item b, Point 2.2, Clause 2, Appendix V (which has been amended and supplemented according to Clause 4, Article 1 of Decision No. 18/2023/QĐ-TTg).

Article 4. This Decision shall take effect from September 25, 2025.
Article 5. The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, relevant central agencies, Chairpersons of provincial People's Committees under the Central Government, Heads of agencies and units using state budget funds to implement the Program for the period 2021-2025 are responsible for enforcing this Decision.
