Decree No. 36/2011/NĐ-CP Amending the Decree No. 107/2004/NĐ-CP on the number of Vice Chairpersons and the structure of members of People's Committees at all levels

DECREE

Amending and supplementing certain articles of Decree No. 107/2004/NĐ-CP dated April 1, 2004 of the Government on the number of Vice Chairpersons and the structure of members of People's Committees at all levels 规定副省长和各级人民政府组成人员的数量和结构

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Organization of People's Councils and People's Committees dated November 26, 2003;

Pursuant to Resolution No. 15/2008/QH12 dated May 29, 2008 of the National Assembly on adjusting administrative boundaries of Hanoi City and some related provinces;

Considering the proposal of the Minister of Home Affairs,

DECREE

Article 1. Amending and supplementing certain articles of Decree No. 107/2004/NĐ-CP dated April 1, 2004 of the Government on the number of Vice Chairpersons and the structure of members of People's Committees at all levels (hereinafter referred to as Decree No. 107/2004/NĐ-CP), which has been amended and supplemented by Decree No. 82/2008/NĐ-CP dated July 30, 2008 and Decree No. 27/2009/NĐ-CP dated March 19, 2009, as follows:

1. Amend Article 5 as follows: Delete the phrase "Hanoi City and" in paragraph 1.

2. Supplement Article 5a after Article 5 as follows:

"Article 5a.1. During the term of operation of People's Councils at all levels from 2011 to 2016, the People's Committee of Hanoi City shall have 13 members, including 01 Chairman, not more than 06 Vice Chairmen, and other members.2. The current number of Vice Chairmen of the People's Committee of Hanoi City shall be maintained; in case of vacancy due to transfer, rotation, retirement, or other reasons, it shall be implemented according to the provisions of Clause 1 of this Article.3. Based on local conditions and the capabilities of cadres, the Chairman of the People's Committee of Hanoi City shall assign tasks to each Vice Chairman and member of the People's Committee."

3. Supplement Article 10a after Article 10 as follows:

"Article 10a.1. During the term of operation of People's Councils at all levels from 2011 to 2016, the People's Committee of districts, towns under Hanoi City shall have 09 members, including 01 Chairman, 03 Vice Chairmen, and 05 members.2. The current number of Vice Chairmen of the People's Committee of districts, towns under Hanoi City shall be maintained; in case of vacancy due to transfer, rotation, retirement, or other reasons, it shall be implemented according to the provisions of Clause 1 of this Article.3. Based on local conditions and the capabilities of cadres, the Chairman of the People's Committee of districts, towns under Hanoi City shall assign tasks to each Vice Chairman and member of the People's Committee."

Article 2. Effectiveness

1. This Decree takes effect from the date of issuance.

2. Repeal Decree No. 82/2008/NĐ-CP dated July 30, 2008 of the Government amending and supplementing certain articles of Decree No. 107/2004/NĐ-CP.

3. The Chairman of the People's Committee of Hanoi City, Ministers, Heads of ministerial-level agencies, and Heads of agencies under the Government are responsible for implementing this Decree.
