CIRCULAR

Guidelines for comprehensive inspection of schools and other educational institutions and inspection of teaching activities of teachers

and inspection of pedagogical activities of teachers

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 85/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 166/2004/NĐ-CP dated September 16, 2004 of the Government stipulating responsibilities for state management of education;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

Pursuant to Decree No. 85/2006/NĐ-CP dated August 18, 2006 of the Government on the organization and operation of Educational Inspectors;

GENERAL GUIDELINES

This Circular applies to units under the Ministry of Education and Training; departments of education and training, education and training divisions; preschool education institutions, general education institutions, regular education institutions, teacher training colleges, college of education, universities, universities, academies, other educational institutions, and related organizations and individuals (hereinafter referred to collectively as agencies and units).

This Circular guides comprehensive inspection of schools, other educational institutions, and pedagogical activities of teachers;

This Circular applies to all schools and other educational institutions within the national education system (hereinafter referred to collectively as educational institutions) and teachers.

2. Comprehensive Inspection of Educational Institutions

Comprehensive inspection of educational institutions involves reviewing and evaluating the performance of duties and powers of educational institutions as prescribed by the Education Law, School Regulations; Organizational and operational regulations of other educational institutions issued by the Minister of Education and Training, and other relevant provisions.

3. Inspection of Pedagogical Activities of Teachers

Inspection of pedagogical activities of teachers involves reviewing and evaluating the performance of teaching, educational duties, and other tasks of teachers as prescribed by the Education Law, School Regulations; Organizational and operational regulations of other educational institutions issued by the Minister of Education and Training, and other relevant provisions.

4. Responsibilities for Comprehensive Inspection of Educational Institutions and Inspection of Pedagogical Activities of Teachers

a) State administrative bodies authorized to establish or permit establishment, suspend operations, merge, divide, split, or dissolve schools pursuant to Article 51 of the Education Law; state administrative bodies responsible for state management of education as stipulated in Decree No. 166/2004/NĐ-CP dated September 16, 2004 of the Government stipulating responsibilities for state management of education; organizations of Educational Inspectors as stipulated in Decree No. 85/2006/NĐ-CP dated August 18, 2006 of the Government on the organization and operation of Educational Inspectors shall be responsible for comprehensive inspection of educational institutions and inspection of pedagogical activities of teachers.

b) Based on the annual inspection plan approved by the competent authority, the head of the inspection agency, the head of the district, county, town, city under province education and training department issues decisions to inspect and form inspection teams for comprehensive inspection of educational institutions and inspection of pedagogical activities of teachers.

When necessary, the head of the state administrative body may issue a decision to inspect and form an inspection team to conduct inspections.

II. COMPREHENSIVE INSPECTION OF EDUCATIONAL INSTITUTIONS

1. Objectives and Requirements

a) Review and evaluate the performance of duties and powers of educational institutions based on checking and comparing with the provisions of legal documents regarding objectives, plans, programs, contents, methods of education, professional regulations, examination and graduation regulations, issuance of certificates and diplomas, teacher evaluation and classification regulations, and provisions concerning conditions ensuring quality of education and training;

b) Accurately assess the current situation of educational institutions in relation to the overall context and compare with the regional and provincial standards and national standard school criteria as stipulated by the Ministry of Education and Training. Affirm achievements, promote strengths, advise measures to overcome weaknesses, and simultaneously recommend adjustments and supplements to policies and regulations in accordance with reality.

c) Competent authorities shall develop comprehensive inspection plans for subordinate educational institutions suitable to specific circumstances of each locality and unit over a five-year period, with at least one comprehensive inspection for each educational institution. The Ministry of Education and Training's Inspectorate shall organize comprehensive inspections of directly subordinate higher education institutions according to the plan.

2. Content of Inspection

a) Organization of Educational Institutions

Quantity and quality of managerial staff, teachers, and employees compared to staffing norms; number and ratio of staff, teachers not meeting, meeting, and exceeding standards;

b) Physical and technical infrastructure:

- Area of campus, landscape, educational environment; number of classrooms, offices, laboratories, specialized rooms, libraries, multi-purpose rooms, health rooms, collective dining halls, dormitory areas, parking areas, sanitation facilities, playgrounds, sports fields, multi-functional buildings;

- Teaching equipment, library books;

- Preservation and utilization of physical and technical infrastructure.

c) Implementation of Educational Plans:

- Enrollment: implementation of quotas, number of students, trainees in each grade (course), class;

- Organization of teaching and learning, implementation of curricula, contents, teaching plans;

- Implementation of professional regulations on examinations, evaluations, and classifications;

- Graduation results, student excellence competition results (if applicable) for three consecutive years prior to the inspection;

- Confirmation or issuance of certificates and diplomas by the educational institution;

- Pedagogical activities of teachers are specified in Section III of this Circular on inspection of pedagogical activities of teachers;

- Implementation of moral, aesthetic, physical education, national defense, vocational guidance, vocational training, care, and nurturing activities as prescribed, including planned classroom activities, extracurricular activities, social activities; classification results and educational activities for three consecutive years;

- Implementation of universal education tasks assigned.

d) Management Work of the Head of the Educational Institution:

- Development of educational plans; scientific research and service plans;

- Management of staff, teachers, employees, and students: recruitment; management of teacher, staff, employee, and student records; allocation and utilization; plans for teacher development.

- Implementing democratic regulations, handling complaints and reports within educational institutions;

- Inspection work of the head of the educational institution as prescribed;

- Organizing for teachers, staff, and students to participate in social activities; implementing policies and benefits for teachers and students;

- Administrative, financial, and asset management: files, books; income and expenditure of financial resources; investment in construction, use of technical facilities, and preservation of public assets;

- Advisory work with higher-level management agencies, local authorities, and socialization of education;

- Coordinating work between educational institutions and mass organizations, Parent-Teacher Associations;

d) Other tasks assigned;

e) Results of educational quality assessment and educational accreditation (if applicable);

3. Inspection Activities

a) The inspection team consists of a Team Leader and from 5 to 20 members;

b) Time limit for inspections

- An inspection conducted by the Ministry's Inspectorate shall not exceed 10 days; an inspection conducted by the Inspectorate of the Department or District Education and Training Office shall not exceed 5 days;

- The duration of a comprehensive inspection is calculated from the date of announcing the inspection decision until the end of the inspection at the inspected location;

c) Procedure and process of inspection

- Preparation work:

+ Collecting information about the inspected unit and gathering relevant legal documents;

+ Drafting the inspection plan: determining objectives, requirements, contents, methods of conducting the inspection, anticipating the composition of the team and the time of the inspection; budgeting expenses and equipment;

+ Submitting the draft inspection decision to the competent authority for approval, no later than 15 days from the date of issuing the inspection decision, the Team Leader is responsible for announcing the inspection decision to the inspected entity;

+ Holding a meeting of the team to announce the inspection decision, disseminate the inspection plan, assign tasks to each member, prepare sample minutes and other necessary matters;

- Conducting the inspection:

+ Organizing the announcement of the inspection decision and the inspection plan to the leadership of the inspected unit;

+ Listening to the report of the unit's leadership on the situation and results of the implementation of the academic year's tasks; questioning and exchanging views between the team and the unit's leadership;

+ Checking administrative files of the educational institution, specialized and functional departments; organizing mass organizations and functional departments;

+ Inspecting teaching activities of teachers: professional files, classroom observations;

+ Discussing among the team to summarize the inspection results of each department; preparing the content for meetings with the unit and related agencies;

+ Announcing the draft report on the inspection results;

- Concluding the inspection:

+ Collecting and archiving all inspection files according to regulations;

+ No later than 15 days from the end of the inspection, the Team Leader must submit a report on the inspection results to the person who issued the inspection decision;

+ No later than 15 days from receiving the report on the inspection results, the person who issued the inspection decision must issue a conclusion on the inspection;

- After the inspection:

+ Notifying the inspection conclusion to the inspected entity, the managing agency, and related units;

+ Within 15 days from the date of the inspection conclusion, the head of the state management agency at the same level is responsible for reviewing and handling the inspection conclusions;

+ The person who issued the inspection decision has a plan to monitor the implementation of the inspection team's recommendations;

4. Reporting Inspection Results and Inspection Conclusions

a) Report on Inspection Results

- Content of the report on inspection results:

+ Based on the educational goals, programs, and plans of the educational institution; School Regulations, organizational and operational regulations of other educational institutions; results of the implementation of the institution's duties and powers; results of educational quality assessments to draw specific conclusions on each content inspected as stipulated in Clause 2, Section II of this Circular;

+ Clearly identifying strengths, weaknesses, causes, and responsibilities of related agencies, organizations, and individuals;

+ Recommendations to the inspected entity and related agencies;

- The report on inspection results is submitted to the person who issued the inspection decision. In cases where the person who issued the inspection decision is the head of the state management agency, the report on inspection results is also sent to the head of the inspection agency at the same level;

b) Inspection Conclusion

After receiving the report on inspection results, the person who issued the inspection decision is responsible for reviewing the report content and signing the inspection conclusion document. The inspection conclusion document must include the following contents:

- Evaluation of the implementation of policies, laws, and tasks of the inspected entity within the scope of the inspection;

- Conclusion on the inspected content;

- Clearly identifying strengths, weaknesses, causes, and responsibilities of related agencies, organizations, and individuals;

- Recommendations to the inspected entity, related agencies, and higher-level management agencies;

The inspection conclusion is sent to the head of the state management agency at the same level and the inspected entity. In cases where the person who issued the inspection decision is the head of the state management agency, the inspection conclusion is also sent to the head of the inspection agency at the same level;

III. INSPECTION OF TEACHING ACTIVITIES OF TEACHERS

1. Forms of Inspection of Teaching Activities of Teachers

a) For teachers:

- Inspection of teachers' teaching activities is carried out during a comprehensive inspection of the educational institution;

- Inspection of teachers' teaching activities can be conducted independently according to the inspection plan of the educational institution's management agency;

b) For lecturers at higher education institutions, the head of the higher education institution specifies the form and content, and the method of conducting inspections;

2. Content of Inspection

a) Political qualities, ethics, lifestyle:

- Understanding political ideology; compliance with state policies and laws; adherence to industry regulations, institutional rules, ensuring quantity and quality of working hours;

- Ethics, personality, lifestyle, awareness of fighting negative phenomena; trust among colleagues, students, and the people; spirit of unity; honesty in work; relationships with colleagues; attitude towards serving the people and students.

b) Results of assigned work

- Fulfilling teaching duties of teachers:

+ Implementing professional regulations: reviewing the teacher's file and other related files;

+ Observing classes: attending a maximum of three periods, if two periods attended are not of the same type, then attend the third period; analyzing and evaluating the class;

+ Teaching results: examination scores or subject evaluation results of students from the beginning of the year to the time of inspection; survey checks by inspection officers; comparing the results of classes taught by the teacher with other classes within the educational institution at the time of inspection (taking into account the characteristics of the teaching subjects).

- Fulfilling other assigned tasks: performing head-of-class duties, other兼任的职务任务。

3. Inspection Activities

a) Inspection plan

Based on the specific situation of the locality and unit, establish an inspection plan for teachers' pedagogical activities, ensuring that each teacher is inspected at least once every five years. In cases of necessity, authorized persons may decide to conduct surprise inspections.

b) Time limit for inspections

The duration of the teacher's pedagogical activity inspection shall not exceed three days, calculated from the date of announcing the inspection decision to the completion of the inspection.

c) Inspection procedure:

- Preparation work

+ Collecting information about the inspection object including: level of education, spirit and attitude in fulfilling tasks, reputation among colleagues;

+ Studying the content assigned for teaching by the teacher.

- Conducting the inspection:

+ Reviewing and checking personal files, employee evaluation forms, professional files;

+ Attending the teacher's classes; conducting student surveys after observation; exchanging experiences with the inspection object; completing observation forms;

+ Exchanging with the leadership of the educational institution, heads of professional departments, mass organizations;

+ Completing the inspection file

The educational institution leader's review form, observation form, inspection result report.

+ Notifying the inspection results to the inspection object and the head of the management unit.

4. Reporting Inspection Results and Inspection Conclusions

a) Report on Inspection Results

Based on criteria for evaluating employees regarding moral qualities, ethics, compliance with legal provisions; School Regulations; Organizational and operational regulations of other educational institutions; Professional regulations; criteria for evaluating class hours; educational quality assessment results, build an inspection result report with contents specified in Clause 2, Section III of this Circular, including:

- Political qualities, ethics, lifestyle (based on the annual employee evaluation form provided by the educational institution leader);

- Results of assigned work:

+ Comments on the implementation of professional regulations;

+ Class hour classification according to the Ministry of Education and Training's guidance on class hour evaluation and classification;

+ Teaching results of the teacher;

+ Fulfillment of other assigned tasks: performing head-of-class duties, other兼任的职务任务,基于教育机构领导的意见。

- Recommendations to the inspection object and educational management authorities at all levels.

The inspection result report is sent to the person who issued the inspection decision. If the person issuing the inspection decision is the head of the state management agency, the inspection result report is also sent to the head of the inspection agency at the same level.

b) Inspection Conclusion

Based on the inspection result report, the person issuing the inspection decision reviews the report content and signs the inspection conclusion document. The inspection conclusion is sent to the head of the state management agency at the same level. If the person issuing the inspection decision is the head of the state management agency, the inspection conclusion is also sent to the head of the inspection agency at the same level.

IV. IMPLEMENTATION

1. This Circular takes effect fifteen days after its publication in the Official Gazette. This Circular replaces Circular No. 07/2004/TT-BGD&ĐT dated March 30, 2004 of the Ministry of Education and Training on guiding comprehensive inspections of general secondary schools and inspections of the pedagogical activities of general secondary school teachers, and Circular No. 13/GD-ĐT dated August 4, 1997 of the Ministry of Education and Training on guiding inspection activities in preschool education.

2. Directors of Departments of Education and Training appoint inspection collaborators with a term of two years. For approximately fifty teachers, one inspection collaborator should be appointed to conduct comprehensive inspections of educational institutions and inspections of teachers' pedagogical activities.

3. During the implementation process, if there are emerging issues or difficulties, agencies and units should reflect them to the Ministry of Education and Training for timely resolution./.
