DECREE
REGULATIONS ON THE BASIC WAGE FOR OFFICIALS, CIVIL SERVANTS, CIVIL SERVICE MEMBERS, AND MILITARY PERSONNEL
Based on the Government Organization Law dated June 19, 20015;
Based on the Labor Code dated June 18, 2012;
Based on Resolution No. 99/215/QH13 dated November 11, 11 2015 of the National Assembly regarding the state budget for 2016;
At the proposal of the Minister of Home Affairs and the Minister of Finance;
At the proposal of promulgating the Decree stipulating the basic salary level for lofficials, civil servants, public officials, and armed forces personnel;June 2024;and staff. lThis Decree stipulates the application of the basic salary level for officials, civil servants, public officials, those receiving salaries and allowances, and workers (hereinafter collectively referred to as persons receiving salaries and allowances) working in agencies, organizations, public service units of the Party, State, political-social organizations, and associations supported by the state budget at the central, provincial, municipal, district, town, township levels (district level), commune, ward, town (commune level), and special administrative-economic units and armed forces.invalid input page.
Article 1. Scope of Regulation
1. Officials and civil servants from the central to the district level as specified in Clause 1 and Clause 2, Article 4 of the Civil Servants Law 2008.
Article 2. Applicability
Persons receiving salaries and allowances as provided for in Article 1 of this Decree include:
2. Officials and civil servants at the commune level as specified in Clause 3, Article 4 of the Civil Servants Law 2008.
3. Public officials in public service units as provided for in the Public Officials Law 2010.
4. Persons working under labor contracts with classified salaries pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for officials, civil servants, public officials, and armed forces, including:
a) Persons working under labor contracts in agencies and units of the Party, State, and political-social organizations as provided for in Decree No. 68/2000/NĐ-CP dated November 17, 2000 of the Government on implementing employment contracts for certain types of work in administrative agencies and public service units;
b) Persons working under labor contracts within the number of employees approved by the competent authority in public service units as decided by
5. Persons working within the staffing quota in associations supported by the state budget as provided for in Decree No. 45/2010/NĐ-CP dated April 21, 2010 of the Government on the organization, operation, and management of associations.
6. Officers, professional military personnel, non-commissioned officers, conscript soldiers, and defense workers, contract workers belonging to the Vietnam People's Army.
c) Calculating deductions and benefits based on the basic salary level.
7. Officers, non-commissioned officers receiving salaries, non-commissioned officers, conscript soldiers, police workers, and contractual employees belonging to the Vietnam People's Public Security Force.
8. Persons working in confidential organizations.
9. Non-professional staff at commune level, village, and neighborhood.
Article 3. Basic Salary Level
1. The basic salary level serves as a basis for:
a) Calculating the salary levels in the salary tables, allowances, and implementing other systems according to the laws for the subjects specified in Article 2 of this Decree;
b) Calculating activity fees and living expenses as prescribed by law;
2. As of May 1, 2016, the basic salary level is VND 1,210,000 per month.
3. The basic salary level will be adjusted based on the state budget capacity, consumer price index, and national economic growth rate.
1. Ministries, ministerial-level agencies, government agencies, and other agencies at the central level shall use the remaining funds from the salary reform budget not utilized in 2015, arrange within the allocated state budget estimate, and use any revenue (if available) to balance the sources for adjusting the basic salary level in 2016.
Article 4. Implementation funds
2. Provinces and centrally-administered cities:
a) Utilize the source of saving 10% of regular expenses (excluding salary items and items with salary nature) according to the budget estimate assigned by the competent authority in 2016 for administrative agencies and public service units;
b) Utilize additional savings of 10% of regular expenses (excluding salary items and items with salary nature) beyond the amount mentioned in Point a of this Clause;
c) Utilize part of the revenue of administrative agencies and public service units;
d) Utilize 50% of increased local budget revenue, excluding land use fees (including 50% of increased revenue compared to the 2015 budget estimate set by the Prime Minister and 50% of increased revenue in the 2016 budget estimate compared to the 2015 budget estimate set by the Prime Minister);
đ) Remaining funds from the salary reform budget in 2015 that were not used;
e) For some poor areas with difficult budgets, after implementing the provisions in Points a, b, c, d, and đ of this Clause and still lacking sources to implement the salary reform in 2016, the central budget will supplement the shortfall to enable the locality to implement it.
1. This Decree takes effect from July 15, 2016.
Article 5. Effective Date
The basic salary level stipulated in this Decree shall be calculated from May 1, 2016.
2. Decree No. 66/2013/NĐ-CP dated June 27, 2013 stipulating the basic salary level for officials, civil servants, public officials, and armed forces, and Decree No. 17/2015/NĐ-CP dated February 14, 2015 of the Government stipulating additional salary increases for officials, civil servants, public officials, and personnel in the armed forces with a salary coefficient of 2.34 or lower shall cease to be effective from May 1, 2016.
For individuals with a salary coefficient of 2.34 or lower who have already received additional salary increases as stipulated in Decree No. 17/2015/NĐ-CP dated February 14, 2015 of the Government, if the total salary according to rank, grade, position, title, and any salary allowances (if applicable) calculated based on the basic salary level of VND 1,210,000 per month in May 2016 is lower than the total salary according to rank, grade, position, title, any salary allowances (if applicable), and additional salary increases according to Decree No. 17/2015/NĐ-CP calculated based on the basic salary level of VND 1,150,000 per month in April 2016, they shall be entitled to receive the difference to equal the total salary received in April 2016. This differential amount shall not be used to calculate social insurance contributions, health insurance contributions, unemployment insurance contributions, and any salary allowances.
1. The Minister of Home Affairs shall guide the implementation of the provisions of this Decree for persons receiving salaries and allowances in agencies, organizations, and units of the Party, State, political-social organizations, and associations.
Article 6. Responsibilities for guidance and implementation
b) Review the demand and funding sources for implementing the basic salary level under this Decree for provinces and centrally-administered cities, and supplement the funding shortfall for poor areas with difficult budgets after implementing the salary reform funding mechanism as prescribed, compile and report the results of implementation to the Prime Minister.
2. The Ministers of National Defense and Public Security shall guide the implementation of the provisions of this Decree for individuals within their respective jurisdictions;
3. The Minister of Finance:
a) Guide the determination of needs, sources, and methods of expenditure for implementing the basic salary level prescribed in this Decree;
b) Review the need and funding sources for implementing the basic salary level under this Decree for provinces and centrally governed cities, and supplement the insufficient funds for poor localities and those with difficult budgets after implementing the revenue-generating mechanism for salary reform as prescribed, and compile a report to the Prime Minister on the implementation results.
4. The ministers, heads of ministerial-level agencies, heads of government agencies, chairpersons of provincial people's committees under the central government shall be responsible for implementing this Decree./.
