Article 1. Scope and Applicability

6. Support for the pilot construction of models to assist persons with disabilities, including:

a) Construction of models;

b) Training and guiding models;

c) Trial operation of models;

d) Surveying and learning experiences;

đ) Inspecting, supervising, and evaluating models.

Based on the content of each model's activities and the current financial expenditure regulations for administrative agencies and public service units, the Ministers in charge of implementing the models shall decide the specific contents and levels of expenditure for each model within the allocated budget estimate.

7. Costs for maintaining, developing, and upgrading electronic portals/websites; building a national database on persons with disabilities: The content and level of expenditure shall be implemented in accordance with Circular Joint Circular No. 19/2012/TTLT-BTC-BKHĐT-BTTTT dated February 15, 2012, issued by the Ministry of Finance, the Ministry of Planning and Investment, and the Ministry of Information and Communications guiding the management and use of funds for the National Program on the Application of Information Technology in State Administrative Activities, and Circular No. 194/2012/TT-BTC dated November 15, 2012, issued by the Ministry of Finance guiding the levels of expenditure for creating electronic information to maintain the regular operations of agencies and units funded by the state budget.

8. Costs for information and propaganda work:

a) For propaganda on assistance and care for persons with disabilities through mass media (radio, television, press); construction, production, reproduction, and distribution of various types of communication products according to the approved budget by the competent authority. The selection of forms, contents of propaganda, programs, and communication products shall be decided by the head of the agency responsible for communication based on the allocated budget and implemented in accordance with Decision No. 39/2008/QD-TTg dated March 14, 2008, issued by the Prime Minister on the bidding, ordering, and assignment of tasks for providing public services funded by the state budget and related guiding documents.

b) For organizing legal education on persons with disabilities and policies, programs to assist persons with disabilities. Contents and expenditure levels shall be carried out in accordance with Circular No. 73/2010/TTLT-BTC-BTP dated May 14, 2010, jointly issued by the Ministry of Finance and the Ministry of Justice on the establishment, management, and utilization of funds to ensure the dissemination and popularization of laws.

9. Expenses for supporting persons with disabilities participating in sports competitions both domestically and internationally:

a) Supporting living expenses, travel costs for persons with disabilities participating in sports competitions at provincial, national, regional, and international games held in Vietnam (if applicable) as stipulated in Joint Circular No. 200/2011/TTLT-BTC-BVHTTDL dated December 30, 2011, issued by the Ministry of Finance and the Ministry of Culture, Sports and Tourism on financial expenditure regulations for sports competitions and subsequent amendments and supplements.

b) Persons with disabilities who are members of sports teams participating in international sports competitions (not held in Vietnam) shall have their travel, accommodation, and food expenses reimbursed in accordance with Circular No. 102/2012/TT-BTC dated June 21, 2012, issued by the Ministry of Finance on the regulation of working expenses for civil servants and officials traveling abroad for short-term assignments funded by the state budget.

c) Expenses for rewarding athletes and coaches with disabilities who achieve outstanding results in sports competitions as stipulated in Decision No. 32/2011/QĐ-TTg dated June 6, 2011, issued by the Prime Minister on certain regulations for coaches and athletes in concentrated training and competition, and Joint Circular No. 149/2012/TTLT-BTC-BLDTBXH-BVHTTDL dated September 12, 2012, jointly issued by the Ministry of Finance, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Culture, Sports and Tourism guiding the implementation of Decision No. 32/2011/QĐ-TTg.

10. Expenses for cooperation with foreign organizations and individuals in providing technical support, experience, and resources to assist persons with disabilities: Contents and expenditure levels shall be implemented in accordance with Circular No. 102/2012/TT-BTC dated June 21, 2012, on the regulation of working expenses for civil servants and officials traveling abroad for short-term assignments funded by the state budget; Circular No. 01/2010/TT-BTC dated January 6, 2010, on the regulation of expenses for receiving foreign guests visiting Vietnam, organizing international conferences and seminars in Vietnam, and domestic hospitality expenses; Circular No. 219/2009/TT-BTC dated November 19, 2009, on certain expenditure standards applicable to projects/programs using official development assistance (ODA) funds; and Circular No. 192/2011/TT-BTC dated December 26, 2011, amending and supplementing certain provisions of Circular No. 219/2009/TT-BTC dated November 19, 2009, issued by the Ministry of Finance and subsequent amendments and supplements (if any).

Article 4. Content and Special Expenditure Levels for Certain Activities

1. Expenditure on early detection, early intervention, corrective surgery, and provision of assistive devices for persons with disabilities:

1.1. Expenditure on services for early detection and early intervention of defects in fetuses and newborns before birth. The content and expenditure levels shall be implemented according to the regulations stipulated for the Project on Screening Congenital Anomalies, Diseases, and Birth Defects and Monitoring Imbalances in Sex Ratios at Birth as set forth in Circular Joint No. 20/2013/TTLT-BTC-BYT dated February 20, 2013 issued by the Ministry of Finance and the Ministry of Health regarding management and utilization of funds for the National Target Program on Population and Family Planning from 2012 to 2015.

1.2. Expenditure on corrective surgery and provision of assistive devices for persons with disabilities as guided by the Ministry of Health:

1.2.1. Beneficiaries of corrective surgery support and assistive device support:

a) Children with disabilities under six years old;

b) Persons with severe disabilities and extremely severe disabilities.

1.2.2. Content and expenditure levels for supporting corrective surgery and providing assistive devices for children with disabilities:

a) Initial screening to classify:

- Expenditure on medical examination and implementation of medical technical testing services according to the physician's prescription and current pricing of medical examination and treatment services prescribed by the competent authority for public medical facilities.

- Expenditure on consultation to determine the degree of disability for surgical referral and other treatment methods. The expenditure level is 100,000 VND/person/session. In cases requiring inter-hospital consultations for difficult cases, the expenditure level is 200,000 VND/person/session.

- Expenditure on establishing a surgical record (including photographing and filling out forms for follow-up records). The expenditure level is 30,000 VND/patient with a surgical prescription from a physician.

b) Corrective surgery:

- The expenditure level for corrective surgery is based on the current pricing of medical examination and treatment services prescribed by the competent authority for public medical facilities.

- For additional compensation for performing surgeries not included in the pricing of medical examination and treatment services, the expenditure level is implemented according to Decision No. 73/2011/QĐ-TTg dated December 28, 2011 issued by the Prime Minister regarding certain special allowances for civil servants, employees, and workers in public health institutions and anti-disease allowances, along with implementing guidelines.

- Support for one caregiver from a poor household when the patient has no family member accompanying during hospitalization for treatment. The support level is 30,000 VND/day/patient (maximum one caregiver for up to five patients).

- Support for orthotic devices: Depending on the degree of disability, appropriate orthotic devices will be provided, with a support level of 500,000 VND/person.

c) Post-surgical examination:

After undergoing corrective surgery, persons with disabilities will be examined post-treatment to assess their health status and determine further treatment plans. The examination content follows the physician's prescription; the expenditure level is implemented according to the current pricing of medical examination and treatment services prescribed by the competent authority for public medical facilities.

d) Travel support for patients from poor households and one person escorting the patient (if accompanied). The support level is based on the price of public transportation tickets used. If self-provided transportation or medical facility transportation is used, individuals or medical facilities will be supported at a rate of 0.2 liters of gasoline per kilometer traveled, calculated based on administrative boundaries and gasoline prices at the time of use.

đ) Food support for patients from poor households and one person accompanying them (if applicable) during corrective surgery at medical facilities or rehabilitation centers. The support level for patients is 40,000 VND/person/day; for accompanying family members, it is 30,000 VND/person/day.

e) Support for assistive devices and means: Depending on the type and degree of disability, persons with disabilities will be supported with 1,000,000 VND/person to purchase suitable assistive devices and means.

1.2.3. The support levels specified in Point 1.2.2 Clause 1 of this Article are the minimum levels; depending on specific conditions and budget capacity, the Minister, Heads of Central Ministries, and the Chairman of Provincial People's Committees shall consider and decide on appropriate support levels.

2. Expenditure on propaganda, counseling, and provision of reproductive health services. The content and expenditure levels shall be implemented according to current regulations for the Project on Reproductive Health Care and Improvement of Nutritional Status of Children within the National Target Program on Health from 2012 to 2015.

3. Vocational training and job creation:

3.1. Persons with disabilities will be supported in vocational counseling and job placement according to their capabilities. The expenditure level for vocational counseling and job placement support shall be implemented according to the expenditure level stipulated in Circular Joint No. 95/2007/TTLT-BTC-BLDTBXH dated August 7, 2007 issued by the Ministry of Finance and the Ministry of Labor, Invalids, and Social Affairs guiding fees for job introduction.

3.2. Vocational training and job creation suitable for persons with disabilities:

a) Conditions for receiving support for primary vocational training and short-term vocational training: Persons with disabilities aged 14 to under 60 years old (for males) and under 55 years old (for females), who have a desire to learn a trade and physical health compatible with the requirements of the trade they wish to learn.

b) Persons with disabilities may only receive support for vocational training once under this policy. Those who have already received vocational training support from other State Programs or Projects are not eligible for vocational training support under this Project.

c) Training costs for each trade: The Department of Labor, Invalids, and Social Affairs shall lead and coordinate with the Department of Finance and relevant agencies to develop and submit to the Provincial People's Committee for approval the training cost levels for each trade in the list of suitable trades, based on the training program, duration, characteristics of persons with disabilities, and local conditions.

d) Vocational training support levels:

- Based on the approved training cost levels for each trade by the Provincial People's Committee and the actual training duration, the Department of Labor, Invalids, and Social Affairs shall decide on vocational training support for primary vocational training and short-term vocational training for each individual and trade, but not exceeding 6,000,000 VND/person/course.

- For occupations with actual training costs exceeding the maximum support level specified in this Circular, localities shall proactively develop plans to mobilize additional funding from trainees' contributions, local government budgets, and other sources to ensure vocational training costs for the target groups.

d) Persons with disabilities who are rural workers and persons with disabilities who are urban workers belonging to poor households shall be provided with financial support for meals and travel expenses during their vocational training period according to the levels prescribed in Decision No. 1956/QD-TTg dated November 27, 2009 of the Prime Minister approving the Vocational Training Program for Rural Workers and guiding documents implementing Decision No. 1956/QD-TTg. Depending on specific conditions and budget capacity, the Ministers, Heads of central agencies, and Chairpersons of provincial People's Committees shall consider and decide on appropriate levels of meal and travel expense support.

e) The methods and conditions for supporting vocational training costs, meal expenses, and travel expenses for persons with disabilities during their training period:

- Based on the demand and number of persons with disabilities enrolled in vocational training, the list of vocational training occupations, teaching plans, training costs for each occupation, and the budget allocated from the funds of the National Target Program on Employment and Vocational Training; the agencies and units entrusted with the task of vocational training for persons with disabilities shall enter into contracts with vocational training institutions that have the necessary conditions for vocational training or production and business establishments with projects organizing vocational training linked to job creation for persons with disabilities, in accordance with Circular No. 105/2008/TT-BTC dated November 13, 2008 of the Ministry of Finance guiding certain provisions of Decision No. 39/2008/QĐ-TTg dated March 14, 2008 of the Prime Minister regarding bidding, ordering, and assigning tasks for the provision of public services funded by the state budget and transferring funds to vocational training institutions or production and business establishments to implement vocational training for persons with disabilities.

- The placement of vocational training orders with production and business establishments (training through apprenticeship and work-study programs) must ensure that persons with disabilities are employed stably at these establishments for a minimum of twenty-four months (for those meeting the recruitment requirements of the establishment).

- Vocational training institutions or production and business establishments are responsible for paying monthly meal expenses and travel expenses for persons with disabilities according to the established regulations and settling the training support funds based on the number of trainees and the actual training time. In cases where persons with disabilities voluntarily withdraw from training, drop out, or are dismissed from training, they will not receive meal expenses during the withdrawal, dropout, dismissal periods, and travel expenses (return trips).

Article 5. Preparation, implementation, and settlement of the state budget

1. The establishment, allocation, execution, and settlement of funds for implementing the Project shall comply with the provisions of the State Budget Law, the Accounting Law, and guiding documents for these laws.

2. The funds for implementing the activities of the Project shall be allocated within the annual regular expenditure budget or the annual special-purpose expenditure budget of national target programs, related programs, and projects of ministries, sectors, central agencies, and localities according to the spending categories and current state budget classification.

3. Ministries and sectors shall base their assigned tasks under Section V, Article 1 of Decision No. 1019/QĐ-TTg to take the lead and coordinate with relevant ministries and sectors to develop implementation plans for the Project within their authority and submit them to the Ministry of Labor, Invalids, and Social Affairs.

4. The Department of Labor, Invalids, and Social Affairs shall take the lead and coordinate with relevant departments and sectors to develop implementation plans for the Project at the local level to be submitted to the Chairman of the Provincial People's Committee for approval, specifying clearly the targets, activities, funds of the Project, and the responsibilities of each agency in organizing its implementation.

5. Ministries, sectors, and provincial and centrally-administered city People's Committees shall be responsible for reporting annually on the implementation status and results of the Project to the Ministry of Labor, Invalids, and Social Affairs for consolidation and reporting to the Prime Minister.

Article 6. Implementation Provisions

1. This Circular takes effect from June 10, 2013.

2. During the implementation process, if there are any difficulties, units are requested to promptly report to the Ministry of Finance for coordination with the Ministry of Labor, Invalids, and Social Affairs to study and resolve them./.
