Pursuant to the Law on Organization of the Government dated December 25, 2001;

The Prime Minister issues this Decision amending and supplementing certain provisions of the Regulation on Response Activities to Oil Spill Incidents issued together with Decision No. 02/2013/QĐ-TTg dated January 14, 2013 of the Prime Minister.

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Article 1. Scope of Regulation

This Decision stipulates the implementation schedule for emission standards for new automobiles and two-wheeled motorcycles with internal combustion engines produced, assembled, and imported.

Article 2. Applicability

This Decision applies to relevant state management agencies, organizations, and individuals producing, assembling, and importing automobiles and two-wheeled motorcycles, except for special-purpose military and police vehicles used for national defense and security as specified by the Ministry of National Defense and the Ministry of Public Security.

Article 3. Explanation of Terms

Emission standards level 3, level 4, and level 5 are standards concerning testing procedures and limits on pollutants in exhaust emissions corresponding to Euro 3, Euro 4, and Euro 5 standards as defined in the United Nations Economic Commission for Europe's technical regulations on vehicle emissions or in European Union directives applicable to newly produced, assembled, and imported vehicles.

Article 4. Implementation Schedule for Emission Standards

1. New automobiles produced, assembled, and imported must comply with emission standards level 4 and level 5 as follows:

a) Emission standard level 4 from January 1, 2017.

b) Emission standard level 5 from January 1, 2022.

2. New two-wheeled motorcycles produced, assembled, and imported must comply with emission standard level 3 from January 1, 2017.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. The Ministry of Transport:

a) Establish, promulgate, and publish national technical standards for vehicle emissions levels 3, 4, and 5 to ensure they take effect according to the schedule set forth in Article 4 of this Decision.

b) Direct specialized agencies under the Ministry to enhance technical capabilities, material infrastructure, and equipment for inspecting and controlling emissions from newly produced, assembled, and imported vehicles according to the schedule for implementing emission standards levels 3, 4, and 5.

c) Organize the implementation of this Decision and based on actual conditions, study and develop higher emission standards for vehicles to be submitted for approval.

d) Participate and propose testing fees for emissions corresponding to each test method for emission standards levels 3, 4, and 5 issued by the Ministry of Finance.

2. Ministry of Science and Technology:

a) Study and promptly establish, promulgate, and publish national technical standards for gasoline, diesel fuel, and biofuels meeting emission standard level 3 quality requirements.

b) Establish, promulgate, and publish national technical standards for gasoline, diesel fuel, and biofuels meeting emission standard level 4 quality requirements to take effect from January 1, 2016; and for emission standard level 5 quality requirements to take effect from January 1, 2021.

c) Announce the implementation schedule for emission standards for newly produced, assembled, and imported automobiles and two-wheeled motorcycles to the World Trade Organization.

3. The Ministry of Industry and Trade:

Shall lead and coordinate with relevant ministries and sectors to ensure production, importation, and supply of fuels for vehicles meet national technical standards and the schedule announced by the Ministry of Science and Technology as stipulated in points a and b of Clause 2 of this Article.

4. The Ministry of Finance:

a) Establish and promulgate testing fees for emissions from automobiles and two-wheeled motorcycles corresponding to each test method for emission standards levels 3, 4, and 5.

b) Lead in establishing and promulgating financial mechanisms to support enterprises producing and trading in petroleum products in ensuring fuel supply that meets the emission standards schedule and encourages the production and use of environmentally friendly vehicles, either through its own authority or by submitting proposals to competent authorities for approval.

5. Relevant ministries, sectors, and People's Committees of provinces and centrally governed cities:

a) Organize information dissemination and publicity regarding the implementation schedule for emission standards for newly produced, assembled, and imported automobiles and two-wheeled motorcycles.

b) Direct specialized units under their jurisdiction to cooperate with the Ministry of Science and Technology in monitoring fuel quality circulating in the market.

6. The implementation of emission standards earlier than the schedule set forth in Article 4 of this Decision shall be led by the People's Committees of centrally governed cities, coordinating with relevant ministries and sectors.

Article 6. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from October 18, 2011.

2. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of provincial and centrally governed city People's Committees, and related organizations and individuals are responsible for enforcing this Decision./.
