The Minister of Finance issues this Circular amending and supplementing certain articles of Circular No. 76/2021/TT-BTC dated September 15, 2021 of the Minister of Finance guiding Clause 1 and Clause 2 Article 31 of Decree No. 20/2021/NĐ-CP dated March 15, 2021 of the Government on social assistance policies for beneficiaries of social protection.

Pursuant to the State Budget Law dated June 25, 2015;

Based on Decree No. 20/2021/NĐ-CP dated March 15, 2021 by the Government regarding social assistance policies for social aid recipients;

Based on Decree No. 33/2023/NĐ-CP dated June 10, 2023 by the Government regarding village-level civil servants and non-professional staff at the commune level, ward level, and neighborhood level;

Pursuant to Decree No. 14/2023/NĐ-CP dated April 20, 2023, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

At the proposal of the Director of the Department of Administrative and Public Financial Affairs;

Article 1. Amending and supplementing certain articles of Circular No. 76/2021/TT-BTC dated September 15, 2021 of the Minister of Finance guiding Clause 1 and Clause 2 Article 31 of Decree No. 20/2021/NĐ-CP dated March 15, 2021 of the Government on social assistance policies for beneficiaries of social protection.

1. Amending and supplementing Point a Clause 2 Article 3 as follows:

"a) Reviewing and examining files:

Reviewing cost: VND 30,000 per file;

Examination cost: VND 30,000 per file."

2. Amending and supplementing Clause 7 Article 3 as follows:

"7. Costs for implementing social assistance payment work for beneficiaries of social protection:

a) Office supplies, printing, photocopying materials, forms, notices, rental costs for payment locations, drinking water for beneficiaries at payment locations, and other necessary expenses to serve the payment of social assistance benefits for beneficiaries of social protection: Payment amount based on actual expenses within the budget approved by the competent authority and in accordance with laws on bidding;

b) Cash transportation costs, costs for transferring money to beneficiaries of social assistance policies, supporting costs for making ATM cards for beneficiaries who request bank transfers, rental costs for security forces at payment locations (if necessary): Payment amount based on actual expenses within the budget approved by the competent authority and in accordance with laws on bidding;

c) Night shift and overtime costs: Implemented according to the Labor Code, Decree No. 145/2020/NĐ-CP dated December 14, 2020 of the Government detailing and guiding the implementation of certain provisions of the Labor Code on labor conditions and labor relations;

d) In cases where social assistance payments for beneficiaries of social protection are made through service payment organizations: The payment costs are determined as a percentage of the total amount paid to beneficiaries of social protection by the People's Councils of provinces based on local conditions and the actual number of beneficiaries in each locality."

2. When regulations on payment systems and standards referred to for application in this Circular are amended, supplemented, or replaced by new regulations, they shall be applied according to the amended, supplemented, or replacing regulations.

Article 2. Implementation clause

1. This Circular takes effect from September 1, 2024.
