CIRCULAR

Regulations on the list and periodic rotation terms of positions within agencies, organizations, units under the Ministry of Construction and within the scope of construction industry management at local authorities

Pursuant to the Law on Prevention and Control of Corruption No. 36/2018/QH14 amended and supplemented by Law No. 59/2020/QH14, Law No. 81/2025/QH15, and Law No. 132/2025/QH15;

Pursuant to the Decree No. 59/2019/NĐ-CP detailing certain provisions and implementation measures of the Law on Prevention and Control of Corruption, amended and supplemented by Decree No. 134/2021/NĐ-CP and Decree No. 184/2026/NĐ-CP;

Pursuant to the Decree No. 33/2025/NĐ-CP stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.

The Minister of Construction promulgates this Circular regulating the list and periodic rotation terms of positions within agencies, organizations, units under the Ministry of Construction and within the scope of construction industry management at local authorities.

Article 1. Scope of Regulation and Applicability

Article 1. This Circular regulates the list and periodic rotation terms of positions within agencies, organizations, units under the Ministry of Construction and within the scope of construction industry management at local authorities.

Article 2. This Circular applies to civil servants not holding leadership or managerial positions and staff working in positions required to be rotated according to regulations within agencies, organizations, units under the Ministry of Construction and within the scope of construction industry management at local authorities.

Article 2. List of positions in the construction sector that must undergo periodic rotation

The list of positions subject to periodic rotation is specified in the Appendix attached hereto.

Article 3. Periodic Term for Position Rotation

Point 1. The periodic rotation term for each field of work is specifically determined in the Appendix attached hereto.

Point 2. The time point for calculating the rotation term is the date when the individual is assigned to work in that position pursuant to the decision of the competent authority as prescribed by law.

Article 4. Implementation provisions

Point 1. This Circular takes effect from August 15, 2026, and revokes Circular No. 08/2023/TT-BXD dated October 3, 2023, which stipulates the list and periodic rotation terms for civil servants not holding leadership or managerial positions and staff directly involved in handling construction-related matters issued by the Minister of Construction.

Point 2. Heads of agencies and units under the Ministry of Construction; Chairpersons of People's Committees of provinces and centrally-administered cities, and related organizations and individuals are responsible for implementing this Circular.

Article 5. Transitional Provisions

In cases where individuals have been assigned to work in positions subject to periodic rotation before the effective date of this Circular, the agencies and units shall continue to monitor and carry over the time spent in those positions to review periodic rotations according to the terms set forth in this Circular./.
