Decree No. 54/2022/ND-CP amends and supplements some articles of Decree No. 78/2016/ND-CP dated July 1, 2016 of the Government on conditions for operating training services for seafarers and inland waterway vessel operators, and Decree No. 08/2021/ND-CP dated January 28, 2021 of the Government on management of inland waterway transport activities.

DECREE

Amending and supplementing certain articles of Decree No. 78/2016/NĐ-CP dated July 1, 2016 of the Government on conditions for operating training services for seafarers and inland waterway vessel operators and Decree No. 08/2021/NĐ-CP dated January 28, 2021 of the Government on management of inland waterway transport activities

Pursuant to the Law on Government Organization on June 19, 2015; the Law amending and supplementing certain articles of the Law on Government Organization and the Law on Local Administration Organizationondated November 22, 2019;

Pursuant to the Law on Inland Waterway Transport dated June 15, 2004; the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Transport dated June 17, 2014;

At the proposal of the Minister of Transport;

The Government promulgates this Decree amending and supplementing certain articles of Decree No. 78/2016/NĐ-CP dated July 1, 2016 of the Government on conditions for operating training services for seafarers andJune 2024;inland waterway vessel operators and Decree No. 08/2021/NĐ-CP dated January 28, 2021 of the Government on management of inland waterway transport activities.

Article 1. Repealing Clause 2, Article 11 of Decree No. 78/2016/NĐ-CP dated July 1, 2016 of the Government on conditions for operating training services for seafarers and inland waterway vessel operators.

Article 2. Amending and supplementing certain articles of Decree No. 08/2021/NĐ-CP dated January 28, 2021 of the Government on management of inland waterway transport activities as follows:

1. Amending and supplementing Clause 2, Article 65 as follows:

“2. The Inland Waterway Transport Management Units under the Vietnam Inland Waterway Transport Administration shall perform specialized administrative management functions at inland waterway ports, wharfs (excluding passenger ferry wharfs), anchorage areas that have been announced and permitted to operate on national inland waterways and dedicated inland waterways connected to national inland waterways; inland waterway ports, wharfs, anchorage areas located within both national and local inland waterways; inland waterway ports, wharfs, anchorage areas within the waters of sea ports assigned by the Ministry of Transport.”

2. Amending and supplementing Clause 3, Article 65 as follows:

“3. The Inland Waterway Transport Management Units under the Department of Transport or units entrusted by the People's Committee of the province to perform such functions in provinces without an Inland Waterway Transport Management Unit under the Department of Transport shall perform specialized administrative management functions at inland waterway ports, wharfs (excluding passenger ferry wharfs), anchorage areas that have been announced and permitted to operate on local inland waterways and dedicated inland waterways connected to local inland waterways; inland waterway ports, wharfs, anchorage areas within the waters of sea ports within the administrative boundaries of the locality assigned by the Ministry of Transport; inland waterway ports, wharfs, anchorage areas as stipulated in Clause 2 of this Article which are delegated by the Minister of Transport in accordance with regulations.”

Article 3. Effectiveness and Implementation

1. This Decree takes effect from November 1, 2022.

2. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees are responsible for guiding and implementing this Decree.
