Based on the Law Amending and Supplementing Certain Provisions of the Law on Technical Regulations and Standards No. 70/2025/QH15;

Based on the Government Decree No. 105/2016/NĐ-CP dated July 1, 2016 stipulating conditions for the operation of organizations conducting calibration, verification, and testing of measuring instruments, measurement standards;

Based on the Government Decree No. 154/2018/NĐ-CP

dated November 9, 2018 amending and supplementing certain provisions on investment and business conditions in the field of management under the Ministry of Science and Technology and certain provisions on specialized inspection; Government Decree No. 55/2025/NĐ-CP dated March 2, 2025;

On the basis of stipulating functions, tasks, powers, and organizational structure of the Ministry of Science and Technology; At the proposal of the Chairman of the National Standardization, Metrology, and Quality Control Committee

The Minister of Science and Technology issues this Circular stipulating activities of calibration, verification, and testing of measuring instruments, measurement standards Article 1. This Circular stipulates activities of calibration, verification, and testing of measuring instruments, measurement standards.;

Article 2. Activities of calibration, verification, and testing of radiation and nuclear measuring instruments, measurement standards, and activities of calibration, verification, and testing of measuring instruments, measurement standards directly serving special measurement activities in the defense and security sectors shall be regulated by other legal documents.. 

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. Organizations providing calibration, verification, and testing services for measuring instruments, measurement standards (hereinafter referred to collectively as organizations providing calibration, verification, and testing services).

2. Organizations designated to conduct calibration, verification, and testing of Group 2 measuring instruments, measurement standards directly used for calibrating Group 2 measuring instruments (hereinafter referred to collectively as designated organizations for calibration, verification, and testing).

Article 2. Applicability

3. Relevant state agencies, organizations, and individuals.

PROCEDURE FOR DESIGNATING THE IMPLEMENTATION OF CALIBRATION, VERIFICATION, AND TESTING ACTIVITIES

Article 3. Application for designation

Chapter II

The application for designation to implement activities of calibration, verification, and testing of Group 2 measuring instruments, measurement standards directly used for calibrating Group 2 measuring instruments (hereinafter referred to collectively as the application for designation) includes:

1. Application for designation of organizations conducting calibration, verification, and testing of Group 2 measuring instruments, measurement standards directly used for calibrating Group 2 measuring instruments (hereinafter referred to collectively as the Application for designation to implement calibration, verification, and testing activities) according to Form No. 01 attached hereto.

2. Report on technical facilities and human resources (according to Form No. 02 attached to the Government Decree No. 105/2016/NĐ-CP dated July 1, 2016 stipulating conditions for the operation of organizations conducting calibration, verification, and testing of measuring instruments, measurement standards, amended and supplemented at Clause 12, Article 2 of the Government Decree No. 154/2018/NĐ-CP).

3. Declaration that a management system compatible with the National Standard TCVN ISO/IEC 17025 has been established and maintained for calibration, verification, and testing activities of measuring instruments, measurement standards according to Form No. 02 attached hereto.

Article 4. Processing of registration dossier for designation

1. The designation of organizations to carry out verification, calibration, testing activities for group 2 measuring instruments and direct measurement standards used to verify group 2 measuring instruments (hereinafter referred to collectively as the designation to carry out verification, calibration, and testing activities) falls within the jurisdiction of the National Standardization, Metrology and Quality Assurance Committee.

2. When there is a need to register for the designation to carry out verification, calibration, and testing activities, the organization shall prepare one set of the registration dossier for designation and submit it to the National Standardization, Metrology and Quality Assurance Committee through one of the following methods: directly at the One-Stop Service Center or via postal service or online at the National Public Service Portal.

3. Within seven working days from the date of receipt of complete dossier in accordance with regulations, if the dossier is not valid, the National Standardization, Metrology and Quality Assurance Committee shall notify the organization registering for designation in writing about the reasons for rejecting the dossier or the contents that need to be completed.

If the organization registering for designation does not complete the dossier according to regulations within ninety days from the date of issuance of the notification on the contents that need to be completed, the National Standardization, Metrology and Quality Assurance Committee shall terminate the processing of the dossier.

4. Within twenty working days from the date of receipt of complete dossier in accordance with regulations, the National Standardization, Metrology and Quality Assurance Committee shall issue a decision to establish an evaluation team at the facility. The on-site evaluation shall be carried out in accordance with the provisions of Article 5 of this Circular.

5. Within ten working days from the date of receipt of complete dossier of the on-site evaluation results in accordance with regulations, if the evaluation results meet the prescribed requirements, the National Standardization, Metrology and Quality Assurance Committee shall consider and issue a decision on the designation of the organization to carry out verification, calibration, and testing activities (hereinafter referred to collectively as the designation decision) in Form No. 07 attached to this Circular. The validity period of the designation decision is five years from the date of issuance. In case the evaluation results do not meet the requirements, the National Standardization, Metrology and Quality Assurance Committee shall notify the organization registering for designation and relevant agencies and organizations in writing.

Article 5. On-Site Evaluation

1. On-site evaluation is organized in the form of an evaluation team and conducted based on the principle of expert evaluation.

2. The evaluation team is established by the National Standardization, Metrology and Quality Assurance Committee to conduct on-site evaluations and report the results to the National Standardization, Metrology and Quality Assurance Committee regarding the compliance of the organization registering for designation with the regulations on operational conditions of designated verification, calibration, and testing organizations.

3. Composition of the evaluation team and responsibilities of the team leader and members

a) The evaluation team consists of a team leader and members. The number of members depends on the field of registration and must be at least one person. The team leader and members of the evaluation team must complete specialized training courses organized by units under the National Standardization, Metrology and Quality Assurance Committee (formerly the General Bureau of Standardization, Metrology and Quality Assurance) on evaluating verification, calibration, and testing activities.

b) The team leader must have at least three years of experience managing verification, calibration, and testing activities. The team leader is responsible for organizing the implementation of the evaluation team's tasks; directly evaluating the management system; assigning specific responsibilities to members; convening and chairing meetings of the evaluation team; reviewing the evaluation result dossier before submitting it to the National Standardization, Metrology and Quality Assurance Committee.

c) Members of the evaluation team must have appropriate expertise and at least three years of experience in verification, calibration, and testing activities in the corresponding measurement field. Members are responsible for performing assigned tasks and are accountable for the content and results of their tasks.

4. Content of Evaluation: Evaluating the compliance of the organization registering for designation with the regulations on operational conditions of designated verification, calibration, and testing organizations.

5. Evaluation Methods:

a) Interviewing the responsible person and staff of the organization registering for designation regarding related information;

b) Reviewing stored files and related documents;

c) Observing the actual technical facilities and human resources conditions of the organization registering for designation;

d) Assessing the proficiency of verification, calibration, and testing staff through observation of operations and handling of verification, calibration, and testing results performed by such staff.

6. Evaluation Procedure

a) The team leader organizes a meeting of the evaluation team, reviews the evaluation program (in Form No. 03 attached to this Circular), agrees on the implementation plan for the evaluation according to the schedule and content specified in the decision establishing the evaluation team, and notifies the relevant parties.

b) According to the assigned tasks, members conduct evaluations and prepare technical measurement evaluation forms (in Form No. 04 attached to this Circular), evaluate and prepare management system evaluation forms (in Form No. 05 attached to this Circular).

c) Prepare a consolidated record of the evaluation results (in Form No. 06 attached to this Circular).

d) Within thirty days from the date of issuance of the decision to establish the evaluation team, the team leader must submit the evaluation result dossier to the National Standardization, Metrology and Quality Assurance Committee. The evaluation result dossier includes: the evaluation program, technical measurement evaluation forms, management system evaluation forms, and the consolidated record of the evaluation results as stipulated in points a, b, and c of Clause 6 of this Article.

d) In case the registering organization has points that are not suitable but can be rectified, after reaching an agreement with the organization, the inspection team sends a notification letter containing the content and deadline for rectification to the registering organization and the National Standard Measurement Quality Committee. The rectification period specified in the notification shall not exceed thirty days. The registering organization must carry out the rectifications and submit a report to the inspection team. The inspection team will review the rectification report, and if necessary, conduct another on-site assessment at the facility. In this case, the rectification period and the reassessment time will not be counted towards the assessment period. If the registering organization fails to complete the rectification within the deadline specified in the inspection team's notification, the inspection team will conclude that it does not meet the requirements and finalize the on-site assessment results according to point d, Clause 6 of this Article and send them back to the National Standard Measurement Quality Committee as prescribed.

7. The costs and other conditions serving the on-site assessment by the inspection team shall be borne by the registering organization.

Article 6. Adjustment of the Content of the Designation Decision, Re-designation

1. The adjustment of the content of the designation decision, re-designation falls under the authority of the National Standard Measurement Quality Committee.

2. When there is a need to apply for additional field designation, narrow down, expand the scope already designated, adjust information on the issued designation decision (in cases of merger, consolidation, name change, division, separation, form conversion, address change, location change), or re-designation, the designated calibration, verification, testing organization shall prepare one set of application documents in accordance with Clause 3, Clause 4, and Clause 5 of this Article and submit them to the National Standard Measurement Quality Committee through one of the following methods: Directly at the One-Stop Service Center or via postal service or online at the National Public Service Portal.

3. In the case of applying for additional field designation, narrowing down, expanding the scope already designated: the application documents as stipulated in Clause 1 and Clause 2 of Article 3 of this Circular for the additional field designation, narrowing down, expanding the scope.

4. In the case of requesting to adjust information on the issued designation decision, the application documents include:

a) A letter requesting adjustment clearly stating the content to be adjusted;

b) A certified copy stamped by the organization or an electronic copy of relevant documents related to the content to be adjusted.

5. In the case of applying for re-designation: the application documents as stipulated in Clause 1 and Clause 2 of Article 3 of this Circular.

6. Within seven working days from the date of receiving all required documents, if the application documents are not valid, the National Standard Measurement Quality Committee will notify the designated calibration, verification, testing organization in writing about the reasons for rejecting the application or the contents that need to be completed.

If the designated calibration, verification, testing organization fails to complete the application documents as required within ninety days from the date of issuance of the notification specifying the contents that need to be completed, the National Standard Measurement Quality Committee will terminate the processing of the application.

7. Upon receipt of all required documents, depending on specific circumstances, the National Standard Measurement Quality Committee will consider and decide whether to examine based on the documents or conduct an on-site assessment, specifically as follows:

a) In the case of examination based on documents, within ten working days from the date of receipt, the National Standard Measurement Quality Committee will examine and issue the designation decision according to Model No. 07 attached and promulgated together with this Circular.

b) In the case of an on-site assessment, the processing of the application, on-site assessment, and issuance of the designation decision shall be carried out in accordance with Clause 4 and Clause 5 of Article 4 and Article 5 of this Circular.

Article 7. Revocation of the designation decision effectiveness

1. The revocation of the designation decision effectiveness falls within the jurisdiction of the National Standardization, Measurement and Quality Control Committee.

2. The designation decision already issued to an organization shall be revoked in any of the following cases:

a) At the request of the designated calibration, verification, testing organization;

b) At the request of the competent state agency.

3. In case the designated calibration, verification, testing organization goes bankrupt or is dissolved, the designation decision already issued to the organization automatically becomes ineffective.

Article 8. Retention of registration files for designation, adjustment of designation, re-designation, and revocation of the designation decision effectiveness测量

1. The files are retained by the National Standardization, Measurement and Quality Control Committee and the designated calibration, verification, testing organization, including: Registration file for designation as prescribed in Article 3, on-site assessment file as prescribed in Article 5, adjustment file for designation and re-designation as prescribed in Article 6, file for revocation of the designation decision effectiveness as prescribed in Article 7, designation decision and decision on revocation of the designation decision effectiveness as prescribed in this Circular.

2. The retention period for the files mentioned in Clause 1 of this Article is ten years as prescribed.

Chapter III

PROCEDURE AND REQUIREMENTS FOR THE CERTIFICATION OF MEASUREMENT STANDARDS USED FOR THE CALIBRATION OF GROUP 2 MEASURING INSTRUMENTS

Article 9. Requirements for measurement standards to be certified

1. Working standards of organizations that meet the following requirements shall be certified as measurement standards used directly for the calibration of Group 2 measuring instruments:

a) Have been calibrated at a designated calibration organization as prescribed; the calibration certificate must still be valid;

b) Meet the technical measurement requirements stipulated in the current Vietnamese technical measurement document.

2. Reference materials of organizations that meet the following requirements shall be certified as measurement standards used directly for the calibration of Group 2 measuring instruments:

a) Have been tested or compared at a Vietnamese testing organization with relevant fields of activity designated or at an overseas testing organization with relevant fields of activity recognized; the test result certificate or comparison certificate (Certificate of Analysis) must still be valid;

b) The homogeneity, stability, and attribute value of reference materials ensure compliance with the technical measurement requirements stipulated in the current Vietnamese technical measurement document.

Article 10. Maintenance, storage, and use of measurement standards

1. Measurement standards used directly for the calibration of Group 2 measuring instruments must be maintained, stored, and used in accordance with the regulations issued by the head of the organization holding the standard and the current Vietnamese technical measurement document.

2. Regulations on maintenance, storage, and use of measurement standards must include the following main contents:

a) For maintenance and storage

- Area for maintenance and storage;

- Environmental conditions and other technical conditions;

- Periodic monitoring of maintenance and storage conditions;

- Periodic calibration to ensure traceability;

- Requirements for maintaining, storing, and using equipment to perform maintenance and storage of measurement standards;

- Assignment and responsibilities of personnel assigned to maintain and store.

b) For use

- Assignment and responsibility regulations for personnel assigned to perform calibration or comparison of measurement standards as prescribed;

- Record usage log.

Article 11. Documents for requesting certification of measurement standards used directly to calibrate group 2 measuring instruments

The documents for requesting certification of measurement standards used directly to calibrate group 2 measuring instruments (hereinafter referred to as the application for certification of measurement standards) include:

1. Application for certification of measurement standards (in accordance with Form No. 08 attached hereto).

2. A certified copy of the original certificate of calibration of working standards or test result certificates or comparison certificates (Certificate of Analysis) of reference materials complying with the provisions of Article 9 of this Circular issued by the requesting organization, or an electronic copy thereof.

3. Photographs of the measurement standard (for the case where the measurement standard is being requested for certification for the first time), including one overall photograph and one label photograph. Color photographs must be clear and legible, providing detailed information about the measurement standard.

Article 12. Processing of applications for certification of measurement standards

1. Certification of measurement standards used directly to calibrate group 2 measuring instruments falls within the authority of the Chairman of the People's Committee of provinces and centrally governed cities (hereinafter collectively referred to as provincial level).

2. When there is a need to certify measurement standards used directly to calibrate group 2 measuring instruments, the organization shall prepare one set of application documents for certification of measurement standards and submit them to the agency responsible for receiving such documents at the province or city where the organization’s main office is located through one of the following methods: In person at the One-Stop Service Center, via postal service, or online at the National Public Service Portal.

3. Within ten working days from the date of receipt of complete documents in accordance with regulations, the Chairman of the People's Committee at the provincial level shall examine and issue a decision certifying measurement standards used directly to calibrate group 2 measuring instruments in accordance with Form No. 09 attached hereto. The validity period of the decision certifying measurement standards used directly to calibrate group 2 measuring instruments is five years from the date of issuance.

4. If the documents are not in compliance, within seven working days from the date of receipt of complete documents in accordance with regulations, the Chairman of the People's Committee at the provincial level shall notify the requesting organization in writing of the reasons for refusing to process the application or the contents that need to be completed.

If the requesting organization fails to complete the documents in accordance with regulations within ninety days from the date of issuance of the written notification of the contents that need to be completed, the Chairman of the People's Committee at the provincial level shall terminate the processing of the application.

Article 13. Amendment of the content of the decision on certification of measurement standards

1. The amendment of the content of the decision on certification of measurement standards falls within the authority of the Chairman of the People's Committee at the provincial level.

2. When there is a need to amend the content of the already issued decision on certification of measurement standards, the requesting organization shall prepare one set of application documents for amendment and submit them to the agency responsible for receiving such documents at the province or city where the organization’s main office is located through one of the following methods: In person at the One-Stop Service Center, via postal service, or online at the National Public Service Portal. The documents include:

a) A letter requesting adjustment clearly stating the content to be adjusted;

b) A certified copy (with confirmation of the certified true copy by the requesting organization) or an electronic copy of the certificate of calibration of working standards or test result certificates or comparison certificates (Certificate of Analysis) of reference materials complying with the provisions of Article 9 of this Circular and photographs of the measurement standard complying with Clause 3 of Article 11 of this Circular (for cases where information on the measurement standard needs to be amended or additional fields of calibration need to be added).

c) A certified copy stamped by the organization or an electronic copy of relevant documents and papers related to the content to be amended (for cases where organizational information needs to be amended after merger, consolidation, name change, division, separation, conversion, or address change...).

3. Within seven working days from the date of receipt of complete documents in accordance with regulations, the Chairman of the People's Committee at the provincial level shall examine and issue a decision certifying measurement standards used directly to calibrate group 2 measuring instruments in accordance with Form No. 09 attached hereto.

4. If the documents are not in compliance, within five working days from the date of receipt of complete documents in accordance with regulations, the Chairman of the People's Committee at the provincial level shall notify the requesting organization in writing of the reasons for refusing to process the application or the contents that need to be completed.

If the requesting organization fails to complete the documents in accordance with regulations within ninety days from the date of issuance of the written notification of the contents that need to be completed, the Chairman of the People's Committee at the provincial level shall terminate the processing of the application.

Article 14. Revocation of the Effectiveness of the Decision on Calibration Standard Certification

1. The revocation of the effectiveness of the decision on calibration standard certification falls within the authority of the Chairman of the People's Committee at the provincial level.

2. The effectiveness of the decision on calibration standard certification shall be revoked when the organization has submitted a request for the revocation of the effectiveness of the decision on calibration standard certification that has been issued.

3. Handling of the file for the revocation of the effectiveness of the decision on calibration standard certification

a) When there is a need to revoke the effectiveness of the decision on calibration standard certification that has been issued, the organization shall submit a request through one of the following methods to the agency responsible for receiving the file at the province or city where the organization's main office is located: directly at the One-Stop Service Center, via postal service, or online at the National Public Service Portal.

b) Within three working days from the date of receipt of the organization's request, the Chairman of the People's Committee at the provincial level shall examine and issue a decision to revoke the effectiveness of the decision on calibration standard certification according to Model No. 10 attached to this Circular.

Article 15. Retention of Calibration Standard Certification Files, amendment of the content of the decision on calibration standard certification, revocation of the effectiveness of the decision on calibration standard certification

1. The files are retained by the issuing agency and the requesting organization, including: the calibration standard certification file used directly for calibrating measuring instruments group 2 as stipulated in Article 11, the file for amending the content of the decision on calibration standard certification as stipulated in Article 13, the file for revoking the effectiveness of the decision on calibration standard certification as stipulated in Article 14, the decision on calibration standard certification used directly for calibrating measuring instruments group 2, and the decision to revoke the effectiveness of the decision on calibration standard certification as stipulated in this Circular.

2. The retention period for the files mentioned in Clause 1 of this Article is ten years as prescribed.

Chapter IV

PROCEDURE AND PROCEDURAL REQUIREMENTS FOR CALIBRATION STANDARD CERTIFICATION AND ISSUANCE OF MEASUREMENT INSPECTOR CARDS

Article 16. Requirements for Inspectors to Obtain Certification and Issuance of Measurement Inspector Cards

Inspectors of organizations meeting the following requirements shall be certified and issued measurement inspector cards:

1. Graduated from a college or equivalent level or higher.

2. Hold a certificate of completion of a professional training course for inspectors organized by units under the National Standardization, Metrology and Quality Control Committee (formerly the General Bureau of Standardization, Metrology and Quality Control) corresponding to the inspection field.

Article 17. Application File for Certification and Issuance of Measurement Inspector Cards

The application file for certification and issuance of measurement inspector cards includes:

1. Application for certification and issuance of measurement inspector cards (according to Model No. 11 attached to this Circular).

2. A certified true copy of the certificate of completion of a professional training course for inspectors provided by the requesting organization or an electronic copy of the certificate of completion of a professional training course for inspectors as stipulated in Clause 2 of Article 16 of this Circular.

3. A certified true copy of the college diploma or equivalent or higher provided by the requesting organization or an electronic copy of the college diploma or equivalent or higher of the inspector (for individual cases being requested for certification and issuance of measurement inspector cards for the first time).

4. Two (02) color photographs measuring (2 x 3) cm, taken against a white background ensuring clarity (for individual cases being requested for certification and issuance of measurement inspector cards for the first time).

Article 18. Processing of Application Files for Requesting Certification and Issuance of Metrology Calibration Technician Cards 测量,重新发放卡片

1. The certification and issuance of metrology calibration technician cards shall be within the authority of the Chairman of the People's Committee of the province.

2. When there is a need for certification and issuance of metrology calibration technician cards, organizations shall prepare one set of application files and submit them to the agency responsible for receiving such files at the provincial or municipal level where the organization’s main office is located through one of the following methods: directly at the One-Stop Service Center, via postal service, or online at the National Public Service Portal.

3. Within ten working days from the date of receipt of complete application files in accordance with regulations, the Chairman of the People's Committee of the province shall examine and issue the decision on certification and issuance of metrology calibration technician cards according to Model No. 12 and Model No. 13 attached as an appendix to this Circular. The validity period of the decision on certification and issuance of metrology calibration technician cards is five years from the date of issuance.

4. If the documents are not in compliance, within seven working days from the date of receipt of complete documents in accordance with regulations, the Chairman of the People's Committee at the provincial level shall notify the requesting organization in writing of the reasons for refusing to process the application or the contents that need to be completed.

If the requesting organization fails to complete the documents in accordance with regulations within ninety days from the date of issuance of the written notification of the contents that need to be completed, the Chairman of the People's Committee at the provincial level shall terminate the processing of the application.

Article 19. Metrology Calibration Technician Card

1. The metrology calibration technician card (hereinafter referred to as the card) shall be issued to each individual calibration technician.

2. Each calibration technician shall only be issued one card and may only have it reissued if there is incorrect information, loss, damage, or deterioration that renders it unusable.

3. The card shall lose its validity when the decision on certification and issuance of the metrology calibration technician card expires or is revoked.

4. The content and format of the metrology calibration technician card shall comply with the provisions of Model No. 13 attached as an appendix to this Circular.

Article 20Adjustment of Content of Certification Decision and Reissuance of Cards 3. 当本通则生效时,如果行政机关或有权实施行政程序的人员发生变化,则该机关或人员应:继承在本通则生效前由原行政机关或人员完成的所有处理结果;不得要求组织和个人重新提交已提交的文件;不得重复执行在本通则生效前已完成的行政程序步骤。

1. The adjustment of content of the certification decision and reissuance of cards shall be within the authority of the Chairman of the People's Committee of the province.

2. When there is a need to adjust the content of the certification decision and reissue cards, organizations shall prepare one set of application files for adjustment and submit them to the agency responsible for receiving such files at the provincial or municipal level where the organization’s main office is located through one of the following methods: directly at the One-Stop Service Center, via postal service, or online at the National Public Service Portal. The application file shall include:

a) A letter requesting adjustment clearly stating the reasons;

b) A certified copy of the relevant documents or electronic copies of materials related to the adjustment content (certificate of completion of refresher courses or specialized training programs for metrology technicians as stipulated in Clause 2, Article 16 of this Circular; graduation certificate of secondary vocational education or higher for metrology staff; documents related to the adjustment of organizational information after mergers, acquisitions, name changes, divisions, separations, changes in form, address changes, etc.);

c) Two (2) color photographs measuring 2 x 3 cm, taken against a white background, ensuring clarity (in cases of reissuance requests).

3. Within seven working days from the date of receipt of complete application files in accordance with regulations, the Chairman of the People's Committee of the province shall examine and issue the decision on certification and issuance of metrology calibration technician cards according to Model No. 12 and Model No. 13 attached as an appendix to this Circular.

4. If the documents are not in compliance, within five working days from the date of receipt of complete documents in accordance with regulations, the Chairman of the People's Committee at the provincial level shall notify the requesting organization in writing of the reasons for refusing to process the application or the contents that need to be completed.

If the requesting organization fails to complete the documents in accordance with regulations within ninety days from the date of issuance of the written notification of the contents that need to be completed, the Chairman of the People's Committee at the provincial level shall terminate the processing of the application.

Article 21. Revocation of Effectiveness of Certification Decision and Card Issuance 测量,重新发放卡片

1. The revocation of effectiveness of the certification decision and card issuance shall be within the authority of the Chairman of the People's Committee of the province.

2. The effectiveness of the certification decision and card issuance shall be revoked when the organization has a document requesting the revocation of the effectiveness of the certification decision and card issuance already issued.

3. Processing of Application Files for Revocation of Effectiveness of Certification Decision and Card Issuance

a) When there is a need to revoke the effectiveness of the certification decision and card issuance, the organization shall submit a request document to the agency responsible for receiving such files at the provincial or municipal level where the organization’s main office is located through one of the following methods: directly at the One-Stop Service Center, via postal service, or online at the National Public Service Portal.

b) Within three working days from the date of receipt of the organization's request document, the Chairman of the People's Committee of the province shall examine and issue the decision to revoke the effectiveness of the certification decision and card issuance according to Model No. 14 attached as an appendix to this Circular.

Article 22. Retention of certification record files and issuance of metrology calibration personnel cards measurement, adjustment of the content of the decision Certification and Issuance of Metrology Calibration Technician Cards measurement, revocation of the effectiveness of the decision Certification and Issuance of Metrology Calibration Technician Cards 测量,重新发放卡片

1. The file shall be retained by the issuing authority and the requesting organization, including: certification record files and issuance of metrology calibration personnel cards as prescribed in Article 17, record files for adjusting the content of the certification decision and issuance of metrology calibration personnel cards as prescribed in Article 20, record files for revoking the effectiveness of the certification decision and issuance of metrology calibration personnel cards as prescribed in Article 21, certification and issuance decisions of metrology calibration personnel cards and decisions to revoke the effectiveness of the certification and issuance decisions of metrology calibration personnel cards as prescribed in this Circular.

2. The retention period for the files mentioned in Clause 1 of this Article is ten years as prescribed.

Chapter V

CERTIFICATES OF CALIBRATION, REFERENCE STANDARDS, TESTING

Article 23. Calibration seal

1. Calibration seals shall be implemented in one or more of the following forms: stamping, clamping, printing, engraving, directly painting on measuring instruments as required by the corresponding calibration procedures and at appropriate locations.

2. Calibration seals include type 1 and type 2 as specified in Clause 3 and Clause 4 of this Article.

a) Content and form of calibration seals used for group 2 measuring instruments according to Model No. 15 attached as an appendix to this Circular.

b) Content and form of calibration seals used for group 1 measuring instruments as stipulated by organizations providing calibration, reference standard, and testing services; the registration number (DK...) of the organization must be clearly displayed on the seal without causing confusion.

3. Calibration seal type 1 shall be used in the following cases:

a) Used independently for measuring instruments not subject to a validity period for calibration. The validity period for calibration of group 2 measuring instruments is determined according to the calibration cycle regulations; the validity period for calibration of group 1 measuring instruments is determined by relevant organizations or individuals.

b) Used concurrently with calibration labels and/or calibration certificates for measuring instruments subject to a validity period for calibration.

4. Calibration seal type 2 shall be used independently to simultaneously perform sealing and notification functions regarding the validity period for calibration of measuring instruments subject to a validity period without the need for concurrent use of calibration labels and/or calibration certificates.

Article 24. Calibration label, reference standard label

1. Calibration label

a) Calibration labels shall be affixed directly on measuring instruments as required by the corresponding calibration procedures and at appropriate locations.

b) Calibration labels shall be used in conjunction with calibration seals and/or calibration certificates to notify the validity period for calibration of measuring instruments subject to a validity period or the date of calibration for measuring instruments not subject to a validity period.

c) In cases where measuring instruments do not have sufficient space or cannot affix calibration labels, calibration certificates may be used to notify the validity period for calibration.

d) Content and form of calibration labels used for group 2 measuring instruments according to Model No. 16 attached as an appendix to this Circular;

đ) Content and form of calibration labels used for group 1 measuring instruments as stipulated by organizations providing calibration, reference standard, and testing services; the registration number (DK...) of the organization and the label number must be clearly displayed on the label without causing confusion.

2. Reference standard label

a) Reference standard labels shall be affixed directly on measuring instruments, reference standards, or at appropriate locations.

b) Reference standard labels shall be used in conjunction with reference standard certificates to notify the validity period for calibration. The validity period for calibration of reference standards used directly for calibrating group 2 measuring instruments is determined according to Vietnamese technical measurement documents; the validity period for calibration of group 1 measuring instruments and reference standards not used directly for calibrating group 2 measuring instruments is determined by relevant organizations or individuals.

c) In cases where measuring instruments or reference standards do not have sufficient space or cannot affix reference standard labels, reference standard certificates may be used to notify the validity period for calibration.

d) Content and form of reference standard labels used for reference standards used directly for calibrating group 2 measuring instruments according to Model No. 17 attached as an appendix to this Circular;

đ) Content and form of reference standard labels used for group 1 measuring instruments and reference standards not used directly for calibrating group 2 measuring instruments as stipulated by organizations providing calibration, reference standard, and testing services; the registration number (DK...) of the organization and the label number must be clearly displayed on the label without causing confusion.

Article 25. Calibration certificates, calibration certificates, testing certificates

1. Calibration certificates are issued for each measuring instrument that meets the requirements specified in the corresponding calibration procedures.

2. Calibration certificates are issued for each measuring instrument or each measurement standard to provide the measured value (along with the uncertainty of the measured value) of the measuring instrument, measurement standard, or to provide the relationship between the measured value of the measuring instrument, measurement standard and the measured value of the measurand.

3. Testing certificates (also known as measurement result certificates, testing certificates) are issued for each sample of measuring instruments, measurement standards to provide the metrological characteristics of those measuring instruments, measurement standards.

4. Calibration certificates may be used independently or in combination with inspection marks, inspection seals as prescribed in Article 23 and Clause 1 of Article 24 of this Circular.

5. Calibration certificates may be used independently or in combination with calibration seals as prescribed in Clause 2 of Article 24 of this Circular.

6. The content and form of calibration certificates, calibration certificates, testing certificates for Group 2 measuring instruments and measurement standards directly used to calibrate Group 2 measuring instruments shall be in accordance with Model Nos. 18, 19, and 20 attached to this Circular.

7. The content and form of calibration certificates, calibration certificates, testing certificates for Group 1 measuring instruments and measurement standards not directly used to calibrate Group 2 measuring instruments shall be provided by organizations providing calibration, verification, and testing services; the registration number (DK ...) of the organization must be clearly displayed on the certificate without causing confusion.

8. Calibration certificates, calibration certificates, testing certificates may be issued in electronic form; the issuance of certificates must comply with the provisions of the Law on Electronic Transactions.

Article 26. Content presentation on calibration certificates, calibration certificates, testing certificates

1. The recorded content must be clear, clean, without abbreviations, erasures, and must include the certificate number, date of issue of the certificate. The name and symbol of the unit of measurement, quantity value, error value... must be presented according to the regulations on legal units of measurement.

2. Number of measuring instruments, measurement standards: Record according to the production number of the measuring instrument, measurement standard. In cases where the measuring instrument, measurement standard does not have a production number, the calibration, verification, testing staff must mark a management number on the measuring instrument, measurement standard and consider it as the number of the measuring instrument, measurement standard.

3. Year of manufacture, place of manufacture of measuring instruments, measurement standards: Record the year of manufacture, name of factory or manufacturer and country of manufacture of the measuring instrument, measurement standard; if there is none, leave this section blank.

4. Section on metrological technical characteristics: Summarize the main metrological technical characteristics of the measuring instrument, measurement standard such as measurement range, accuracy class, accuracy. In cases where the measuring instrument, measurement standard does not indicate the accuracy class or accuracy, record the permissible error or smallest division value or measurement uncertainty. In cases where the measuring instrument, measurement standard has multiple measurement ranges, record these characteristics according to each measurement range of the measuring instrument, measurement standard.

5. Method of implementation (also called implementation procedure): Record the identification number and name of the calibration, verification, testing procedure applied for calibration, verification, testing.

6. The results section is recorded as follows:

a) For calibration certificates of measuring instruments: Record "Meets metrological technical requirements".

b) For calibration certificates, testing certificates: Record "See results at page...".

7. Calibration seal number: Fully record the information of the calibration seal (serial number and calibration seal number) and calibration seal (calibration seal number). If seals are not used, this section records "None".

8. Expiry date or calibration date requested (if applicable): Record the last valid date of calibration, verification, testing from the date of issuing the certificate.

The validity period of calibration, verification, testing is determined based on one of the following cases: the regulation on the calibration cycle of Group 2 measuring instruments; the regulation in Vietnamese metrology technical documents for measurement standards directly used to calibrate Group 2 measuring instruments; determined by the relevant organizations or individuals for Group 1 measuring instruments and measurement standards not directly used to calibrate Group 2 measuring instruments.

Example: The calibration cycle for fuel dispensers is 12 months. If a fuel dispenser is concluded to meet requirements and issued a certificate on October 16, 2023, then on the calibration certificate, the "Expiry Date" section will record: "October 16, 2024".

9. Signature section of calibration certificates, verification certificates, testing certificates:

a) Must include signatures, full names of the calibration, verification, testing staff or Laboratory Head. In cases of issuing calibration certificates for Group 2 measuring instruments, the calibrator must be certified and hold a metrology inspector card;

b) Must include signatures, full names, position seals of the head or authorized person and administrative stamp according to the law.

10. In case of necessity, organizations may add additional information (brand logo, traceability information...) but must ensure compliance with the contents prescribed in Clauses 1 to 9 of this Article and bear legal responsibility for the supplementary information.

Chapter VI

RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS IN CALIBRATION, VERIFICATION, TESTING ACTIVITIES

Article 27Responsibilities of designated calibration, verification, testing organizations

1. Maintain and retain complete files and documents regarding the organization's implementation of the operational conditions of designated calibration, verification, testing organizations as prescribed; retain complete results of calibration, verification, testing of measuring instruments, measurement standards and calibration certificates, verification certificates, testing certificates issued to customers.

2. Conduct verification, calibration, and testing of type 2 measuring instruments and direct-use measurement standards for verifying type 2 measuring instruments within the scope and field of operation designated and in accordance with the procedures and formalities stipulated in the current Vietnamese technical measurement documents.

3. Issue and implement regulations on maintaining, preserving, and using measurement standards and measuring instruments for verification, calibration, and testing to ensure traceability; measures to prevent and protect against influences that may alter the key technical characteristics of measuring instruments and measurement standards during use; contents, formats, printing, manufacturing, management, and use of seals, marks, certificates of verification, calibration, and testing of measuring instruments and measurement standards (including electronic certificates or digitized certificates) in compliance with the provisions of this Circular.

4. Require verifiers to carry and present their cards when conducting verification of measuring instruments.

5. Retrieve, report, and submit cards when reissuing or when verifiers no longer participate in verification activities to the Chairman of the People's Committee of the province where the designated organization has its main office.

6. Ensure that technical staff receive training and updates on specialized knowledge and skills in verification, calibration, and testing when there are changes to the corresponding Vietnamese technical measurement documents in the designated fields of verification, calibration, and testing, following the guidance of the National Standardization, Measurement, and Quality Control Committee.

7. Annually before December 31 or upon request from competent state authorities, prepare and submit reports on verification, calibration, and testing activities of measuring instruments and measurement standards according to Form No. 04 attached to Decree No. 105/2016/NĐ-CP on the National Standardization, Measurement, and Quality Control Committee, the Department of Science and Technology of the province or city where the designated organization for verification, calibration, and testing has its main office.

Article 28Responsibilities of Verifiers, Calibrators, and Testers

1. The verifiers, calibrators, and testers of designated verification, calibration, and testing organizations shall have the following responsibilities:

a) Carry out verification, calibration, and testing within the designated field of activity as assigned by the head of the designated organization and in accordance with the specialized and vocational training received;

b) Adhere strictly to the procedures and formalities stipulated in the current Vietnamese technical measurement documents and be responsible for the results of verification, calibration, and testing they have conducted;

c) Implement measures prescribed to prevent and protect against influences that may alter the technical characteristics of measuring instruments and measurement standards during use;

d) Report immediately to the head of the organization upon discovering any behavior indicative of violations of measurement laws, to cooperate with competent state authorities in handling such violations in accordance with the law.

2. In addition to the responsibilities stipulated in Clause 1 of this Article, measuring instrument verifiers of designated verification organizations shall also have the following responsibilities:

a) Verify measuring instruments within the verification fields certified and issued with verifier cards;

b) Carry and present their verifier cards when conducting verification of measuring instruments;

c) Not use the verifier card for other purposes;

d) Return the verifier card to the designated verification organization when it is reissued or when they no longer participate in verification activities.

Article 29Responsibilities of the National Standardization, Measurement, and Quality Control Committee

1. Designate verification, calibration, and testing organizations in accordance with Chapter II of this Circular.

2. Issue Vietnamese technical measurement documents.

3. Guide and organize the implementation of specialized and vocational training for verifiers, calibrators, and testers and metrology evaluation experts regarding verification, calibration, and testing of measuring instruments and measurement standards.

4. Conduct state supervision over measurement in verification, calibration, and testing activities of measuring instruments and measurement standards in accordance with the law.

5. Update measurement data on the National Database on Standards, Measurement, and Quality.

Article 30. Responsibilities of the People's Committee at the provincial level

1. Organize propaganda and dissemination, ensure necessary resources and conditions to implement the provisions of this Circular within their jurisdiction.

2. Update measurement data on the National Database on Standards, Measurement, and Quality for information about measurement standards and calibration officers within their jurisdiction.

  Chapter VII

IMPLEMENTING PROVISIONS

Article 31. Effect in force 1. This Circular takes effect from February 15, 2026; Circular No. 24/2013/TT-BKHCN dated September 30, 2013 of the Minister of Science and Technology on activities related to calibration, verification, testing of measuring instruments, and measurement standards shall cease to be effective from the date this Circular takes effect.

2. The following provisions are abolished from the date this Circular takes effect:

a) Clause 1, Article 2 of Circular No. 13/2023/TT-BKHCN dated June 30, 2023 of the Minister of Science and Technology abolishing certain legal normative documents issued by the Minister of Science and Technology, jointly issued;

b) Article 18 of Circular No. 07/2024/TT-BKHCN dated October 8, 2024 of the Minister of Science and Technology amending and supplementing some articles in legal normative documents under the authority of the Minister of Science and Technology related to the National Standardization, Metrology, and Quality Control Committee;

c) Articles 4, 5, 6, 7, 8, and 9 of Circular No. 07/2025/TT-BKHCN dated June 20, 2025 of the Minister of Science and Technology on the delegation and determination of authority when local administrative authorities at two levels organize activities in the field of standards, measurement, and quality under the management of the Ministry of Science and Technology; Part A Administrative Procedures in the Field of Measurement and Forms No. 01, No. 02, No. 03, No. 04, No. 05 in Part A Appendix attached to Circular No. 07/2025/TT-BKHCN.

3. In cases where legal normative documents referred to for application in this Circular are amended, supplemented, or replaced by other legal normative documents, they shall be implemented according to the amended, supplemented, or replacing documents.

. Transitional Provisions

Article 321. For applications and files received by competent authorities before the date this Circular takes effect but not yet resolved, such authorities shall continue to process them according to the laws applicable at the time of receipt.

2. Documents and papers issued and granted by competent authorities, relevant organizations before the date this Circular takes effect and which have not expired or reached their usage period shall continue to be applied and used according to the law until their expiration or adjustment, replacement, revocation, or reissue by competent authorities, relevant organizations as stipulated in this Circular.

3. In cases where there is a change in the competent authority or person responsible for administrative procedures when this Circular takes effect, such authority or person shall be responsible for: inheriting all results of the resolution made by the previous competent authority before the date this Circular takes effect; not requiring organizations or individuals to resubmit submitted files; not repeating steps in administrative procedures already completed before the date this Circular takes effect.

Article 33. Implementation Organization

1. The ministries, ministerial-level agencies, government agencies, provincial people's committees under the central government, and related organizations and individuals shall be responsible for implementing this Circular.

2. In case difficulties or obstacles arise during implementation, the agencies, organizations, and individuals concerned are requested to report in writing to the Ministry of Science and Technology (through the National Standardization, Metrology and Quality Control Committee) for guidance or further study, amendment, or supplementation as necessary./.
