CIRCULAR
Regulations on management, use, and settlement of funds for conducting statistical surveys statistical investigations

Pursuant to the Statistics Law on June 17, 2003;
Based on Decree No. 221/2013/NĐ-CP dated December 30, 2013 of the Government stipulating the system of applying administrative handling measures for placement in compulsory drug rehabilitation facilities (hereinafter referred to as Decree No. 221/2013/NĐ-CP);
Pursuant to Decree No. 40/2004/ND-CP dated February 13, 2004 of the Government detailing and guiding the implementation of certain provisions of the Law on Statistics;
To manage and use state budget funds for statistical surveys correctly and effectively for their intended purposes, the Ministry of Finance hereby stipulates the management, use, and settlement of funds for conducting statistical surveys as follows:
Article 1. Scope and Applicability
1. These Circular applies to statistical surveys (included in the national statistical survey program and outside the national statistical survey program) conducted by ministries, sectors, localities decided upon by the General Director of the General Statistics Office, ministers, heads of ministerial-level agencies, and agencies under the Government, and Chairpersons of People's Committees of provinces and centrally-run cities according to Clause 2, 3, and 4 of Article 10 of Decree No. 40/2004/ND-CP dated February 13, 2004 of the Government detailing and guiding the implementation of certain provisions of the Law on Statistics.
2. For comprehensive statistical surveys decided upon by the Prime Minister, and statistical surveys arranged from development investment capital, economic public service capital, and environmental public service capital currently being implemented according to separate guidance documents, these do not fall within the scope of regulation of this Circular.
Article 2. Sources of Funds
1. The state budget ensures and allocates in the state budget expenditure plan of ministries, sectors, and localities according to the division of responsibilities under the State Budget Law and related guiding documents.
- The central budget ensures funding for statistical surveys included in the national statistical survey program and outside the national statistical survey program decided upon by ministers, heads of ministerial-level agencies, and agencies under the Government.
- Local budgets ensure funding for statistical surveys outside the national statistical survey program decided upon by Chairpersons of People's Committees of provinces and centrally-run cities.
2. International organization sponsorship funds according to programs and projects.
3. Other lawful sources of funding as prescribed by law.
Article 4. Contents of Expenditure
1. Expenditure on building statistical survey plans: depending on the scale, nature, and volume of indicators of each survey, the agency or unit builds the survey plan (including general outline and detailed outline) to submit for approval by the competent authority (after obtaining comments on the survey plan from the General Statistics Office according to Article 11 of Decree No. 40/2004/ND-CP).
2. Expenditure on printing survey forms approved by the project leader.
3. Expenditure on trial surveys to perfect the survey plan.
4. Expenditure on professional seminars, soliciting opinions from experts in relevant fields (if necessary), reviewing the survey plan, accepting the survey plan and content of survey forms, reporting survey results.
5. Expenditure on building manuals for surveyors (if necessary).
6. Expenditure on printing guidance materials, manuals for surveyors, survey forms, tables serving the survey, survey results, publishing survey publications (if necessary). The quantity of printed materials must be sufficient to serve participants in the survey and meet the requirements of management work. Printing of survey materials, forms, tables, and manuals for surveyors must be carried out according to current regulations of the State on tendering procurement to maintain the regular operation of state agencies with state funds.
7. Expenditure on training surveyors (if necessary).
8. Survey expenditure:
a) Travel expenses for survey participants, rechecks, inspections, supervision.
b) Hiring surveyors (in cases where external hiring is required).
c) Hiring ethnic language interpreters and guides, hiring non-interpreting guides: this expenditure only applies to survey areas in minority ethnic regions, mountainous areas, highlands, remote areas, where surveyors do not reside in the survey area or do not know the ethnic language, thus requiring local people to guide and interpret.
d) Expenditure for information providers, self-filling survey forms.
đ) Sampling analysis (if necessary).
9. Expenditure on transporting survey materials (if necessary), renting vehicles for officials and surveyors to conduct field surveys.
10. Expenditure on processing survey results including: acceptance of survey forms, inspection, coding, cleaning, and completing survey forms; building software to enter and process, aggregate survey result data. In cases where external units must be hired to enter and process, aggregate data, the survey leading agency shall implement according to regulations on tendering procurement to maintain the regular operation of state agencies with state funds and ensure the procedures of the contract according to current regulations of the State.
11. Expenditure on hiring analysts to evaluate survey results (if necessary). The number of analysts is determined by the survey leading agency but shall not exceed five analysts for one survey.
12. Expenditure on writing survey result reports: depending on the nature and scale of the survey, the survey leading agency decides on expenditure for writing summary reports (including main report and summary report); thematic analysis reports.
13. Expenditure on announcing survey results: depending on the nature and necessity of the survey, ministers, heads of ministerial-level agencies, agencies under the Government, and Chairpersons of People's Committees of provinces and centrally-run cities decide on announcing survey results through mass media, reporting to functional agencies, or organizing conferences to announce.
14. Other expenditures directly related to survey work such as:
a) Stationery, communication.
b) Translating foreign documents for the survey.
c) Overtime work.
d) Other expenditures.
Article 4. Levels of expenditure
The levels of expenditure for the contents specified in Article 3 are implemented according to the current financial expenditure standards and norms prescribed by authorized state agencies and some specific expenditure levels prescribed in the attached appendix to this Circular.
Article 5. Establishment, implementation, and settlement of investigation budget statistics
1. Establishment of investigation budget:
The funds for conducting statistical investigations of ministries, central agencies, and localities shall be allocated within the annual state budget expenditure plan according to the fields of expenditure of each agency and unit based on the current state budget classification.
Based on approved investigation decisions, the agencies and units assigned with the investigation tasks must establish detailed budgets for each investigation within their annual state budget expenditure plans, submit them to the supervising agency for consolidation, and send them to the financial agency together with the time of establishing the annual state budget expenditure plan for approval by the competent authority.
2. On the basis of approved statistical investigation decisions, the supervising agency allocates the budget to the direct using agencies and units along with the regular expenditure budget, sends it to the financial agency for review before December 31st of each year. After receiving written agreement from the financial agency, the supervising agency issues a decision allocating the state budget to the agencies and units, sends it to the financial agency, and the State Treasury where the unit has its transaction account to coordinate implementation. The agency or unit primarily responsible for the investigation must establish a detailed budget and submit it for approval by the supervising agency.
3. For sudden statistical investigations as stipulated in Clause 1, Article 9 of Decree No. 40/2004/NĐ-CP, which have not been allocated state budget expenditures for the assigned investigation agencies and units: Based on the investigation decision and the approved investigation plan, the assigned agencies and units must establish a detailed budget, submit it for review by the supervising agency, request the financial agency to examine it, and propose to the competent authority to supplement the budget according to the分级翻译如下:
4. The use and settlement of investigation budget funds shall be carried out in accordance with the provisions of the State Budget Law, Accounting Law, and implementing regulations of these laws. In addition, this Circular provides guidance on the following matters:
- If external units need to be hired to perform certain tasks during the statistical investigation process, the leading agency must enter into contracts with the external units. Documentation serving as the basis for settlement and finalization shall be retained by the leading agency, including: Contract for performing the task (accompanied by the detailed budget approved by the leading agency), acceptance certificate for work completion, contract termination record, payment authorization form or payment voucher, and other directly related documents. Specific expense documentation shall be kept by the agencies and units directly conducting the investigation in accordance with current regulations.
- At the end of the year, the agencies and units shall consolidate the investigation budget settlement into their annual state budget settlement and report the project implementation status and the use of investigation funds to the higher-level supervising agency.
- The higher-level supervising agency shall inspect the results of the entire investigation or the results of each phase (for investigations conducted over multiple years), notify the results to the financial agency at the same level to serve as the basis for reviewing (or examining) the investigation budget settlement and preparing the next year's investigation budget (if applicable).
- At the end of the year, if the statistical investigation has not concluded according to the approved plan, the remaining budget and advance payments may be carried over to the next year for use and settlement; if the statistical investigation has concluded, any unused funds must be remitted to the state budget in accordance with regulations.
Article 6. Effectiveness
1. This Circular takes effect from June 30, 2011, and replaces Circular No. 120/2007/TT-BTC dated October 15, 2007, issued by the Ministry of Finance, guiding the management, use, and settlement of funds for conducting investigations from state budget funds.
2. Depending on the scale and nature of each investigation, the heads of agencies and units shall base on the maximum spending framework set forth in this Circular to request the Minister, the head of a ministry equivalent to a ministry, or a government agency, the Chairman of the People's Committee of provinces and centrally-administered cities to approve specific spending amounts that do not exceed the maximum spending limit set forth in this Circular, ensuring economy and avoiding waste within the scope of the state budget allocated by the competent authority.
3. During the implementation process, if there are any difficulties, they should be promptly reported to the Ministry of Finance for research and resolution.
