CIRCULAR
Regulations on the Procedures for Issuing, Replacing, and Reissuing Citizen Identity Cards
The Minister of National Defense hereby issues this Circular amending and supplementing certain articles of normative legal documents within the competence to issue of the Minister of National Defense related to the declaration of personal information when performing administrative procedures.
On the basis of Decree No. 137/2015/NĐ-CP dated December 31, 2015 of the Government detailing certain provisions and implementing measures of the Law on Citizen Identity Cards;
Based on Decree No. 37/2021/NĐ-CP dated March 29, 2021 of the Government amending and supplementing certain articles of Decree No. 137/2015/NĐ-CP dated December 31, 2015 of the Government detailing certain provisions and implementing measures of the Law on Citizen Identity Cards;
Based on Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government amends and supplements certain Articles of Circular No. 09/2024/TT-BCA dated March 13, 2024 issued by the Minister of Public Security regarding the implementation of mass mobilization work by the People's Public Security force and Circular No. 124/2021/TT-BCA dated December 28, 2021 issued by the Minister of Public Security stipulating residential areas, communes, wards, towns, agencies, enterprises, and educational institutions meeting the criteria for "Safety in security and public order".
At the proposal of the Director of the Administrative Police Department under the Ministry of Public Security,
Article 1. Amending and supplementing some articles of Circular No. 21/2023/TT-BTTTT dated December 31, 2023 of the Ministry of Information and Communications on functions and technical features of the Administrative Procedure Handling Information System at the ministerial and provincial levels (hereinafter referred to as Circular No. 21/2023/TT-BTTTT) as follows: Ministry of Public Security issues the Circular hereby promulgates these regulations on the procedures for issuing, replacing, and reissuing citizen identity cards.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
These Circulars stipulate the principles and procedures for issuing, replacing, and reissuing citizen identity cards.
Article 2. Applicability
1. Local public security units.
2. Officers and soldiers of the People's Public Security Force.
3. Agencies, organizations, and individuals related to the work of issuing, replacing, and reissuing citizen identity cards.
Article 3. Principles for Implementing the Procedures for Issuing, Replacing, and Reissuing Citizen Identity Cards
1. The procedures for issuing, replacing, and reissuing citizen identity cards must comply with the provisions of the Law on Citizen Identity Cards and other relevant laws concerning the issuance and management of citizen identity cards.
2. Public security agencies shall create the most favorable conditions for citizens when performing procedures for issuing, replacing, and reissuing citizen identity cards, ensuring speed, accuracy, and timeliness.
3. Staff responsible for issuing, replacing, and reissuing citizen identity cards shall be responsible for guiding citizens and responding to their inquiries.
4. Staff responsible for issuing, replacing, and reissuing citizen identity cards shall regularly coordinate with competent authorities to update changes and additions to citizen information in the National Population Database to support the issuance and management of citizen identity cards.
5. Public security agencies receiving applications for issuing, replacing, and reissuing citizen identity cards shall not illegally copy data from devices used to collect citizen identity card application files.
Chapter II
PROCEDURES FOR ISSUING, REPLACING, AND REISSUING CITIZEN IDENTITY CARDS
Article 4. Acceptance of Applications for Issuing, Replacing, and Reissuing Citizen Identity Cards
1. Citizens may come to the location for applying for citizen identity cards or register through the National Public Service Portal or the Ministry of Public Security Public Service Portal to schedule the time and place for applying for issuing, replacing, and reissuing citizen identity cards.
2. If the citizen meets the conditions for issuing, replacing, or reissuing citizen identity cards, the staff accepting the application shall process it according to the provisions of this Circular.
3. If the citizen does not meet the conditions for issuing, replacing, or reissuing citizen identity cards, the staff shall refuse to accept the application and clearly state the reasons.
4. If violations of the law are discovered, they shall be handled according to the regulations.
Article 5. Collection of Citizen Information
After accepting applications for issuing, replacing, and reissuing citizen identity cards, staff collecting citizen information shall proceed as follows:
1. Search for citizen information in the National Population Database to establish the application file for issuing, replacing, or reissuing citizen identity cards.
a) If the citizen's information already exists in the National Population Database without any changes or adjustments, use the citizen's information in the National Population Database to establish the application file for issuing, replacing, or reissuing citizen identity cards.
b) If the citizen's information already exists in the National Population Database but has been changed or adjusted, request the citizen to present legal documents proving the changes to update and supplement the information in the application file for issuing, replacing, or reissuing citizen identity cards.
c) If the citizen's information does not exist in the National Population Database, request the citizen to present one of the types of legal documents proving personal information to update the information in the application file for issuing, replacing, or reissuing citizen identity cards.
2. Select the type of citizen identity card issuance (issuance, replacement, reissuance) and describe the citizen's biometric characteristics.
3. Collect fingerprints of the citizen as follows:
Collect flat fingerprints of the four fingers of the right hand (index finger, middle finger, ring finger, little finger);
Collect flat fingerprints of the four fingers of the left hand (index finger, middle finger, ring finger, little finger);
Collect flat fingerprints of both thumbs;
Roll fingerprints of all ten fingers in the following order: Right thumb, right index finger, right middle finger, right ring finger, right little finger, left thumb, left index finger, left middle finger, left ring finger, left little finger.
If it is not possible to collect all ten fingerprints of the citizen, describe and enter information about the uncollected fingerprints.
4. Take a frontal photograph of the citizen
The photograph of the citizen when applying for issuing, replacing, or reissuing citizen identity cards shall be a color photo with a white background, taken frontally, bareheaded, showing the face and both ears, without glasses; the attire and demeanor shall be serious and courteous. For citizens who follow religious or ethnic customs, they may wear religious or ethnic ceremonial attire, if wearing head coverings, they may keep them on but must ensure that the face and both ears are visible.
5. Print the Citizen Identity Card Information Collection Form for the citizen to check, sign, and write their full name; the staff collecting citizen information shall also check, sign, and write their full name.
6. Print the Population Information Collection Form (if applicable), the Population Information Update and Correction Form (if applicable) for the citizen to check, sign, and write their full name.
7. Collect fees as prescribed.
8. Retrieve old Identity Cards or Citizen Identity Cards for citizens who are applying to replace from Identity Cards to Citizen Identity Cards or to replace Citizen Identity Cards.
9. Issue a receipt for the result of the application for issuing, replacing, or reissuing citizen identity cards to the citizen.
10. On the same working day, the civil servant responsible for collecting citizen information shall hand over the application file for issuing, replacing, or reissuing the Citizen Identity Card to the department responsible for sorting files, and transfer the Household Registration Information Collection Form (if applicable) and the Household Registration Information Update and Amendment Form (if applicable) to the Police Station of the commune, ward, town where the citizen is registered as a resident, or the Police Station of the district, city district, town under province, centrally governed municipality (hereinafter referred to as the Police Station of the commune) in places without a commune-level administrative unit.
The Police Station of the commune must, within one working day from the date of receipt of the Household Registration Information Collection Form and the Household Registration Information Update and Amendment Form, conduct verification and approval, and update citizen information into the National Population Database.
Article 6. Application files for issuing, replacing, or reissuing the Citizen Identity Card need to be searched in the archive of citizen identity cards.
1. Cases requiring searches in the archive of citizen identity cards include:
a) A nine-digit identification card that is lost or damaged and cannot provide complete information on the identification card.
b) When it is necessary to verify and cross-check citizen information in the archive of citizen identity cards.
2. Search files include: the Application File Handover Form for requesting issuance, replacement, or reissuance of the Citizen Identity Card; the Information Reception Form for citizen identity cards.
3. Approval of search files:
a) At the Police Station of the district, city district, town under province, centrally governed municipality (hereinafter referred to as the Police Station of the district):
In cases of searching the archive of citizen identity cards within the province or centrally governed municipality, the Head of the Administrative Management Police Team for Social Order shall approve the search file and send it to the Citizen Identity Card Archive Team under the Administrative Management Police Team for Social Order for searching.
In cases of searching the archive of citizen identity cards outside the province or centrally governed municipality, the Chief of the Police Station of the district shall approve the search file and send it to the Administrative Management Police Team for Social Order at the location requiring the search.
b) At the Administrative Management Police Team for Social Order:
In cases of searching the archive of citizen identity cards within the province or centrally governed municipality, the Head of the Citizen Identity Card Issuance and Management Team (hereinafter referred to as the Head of the Citizen Identity Card Team) shall approve the search file and send it to the Citizen Identity Card Archive Team under the Administrative Management Police Team for Social Order for searching.
In cases of searching the archive of citizen identity cards outside the province or centrally governed municipality, the Chief of the Administrative Management Police Team for Social Order shall approve the search file and send it to the Administrative Management Police Team for Social Order at the location requiring the search.
c) At the National Population Data Center:
The Director of the National Population Data Center shall approve the search file and send it to the Administrative Management Police Team for Social Order at the location requiring the search.
4. The unit receiving the search request shall be responsible for conducting the search according to the content and deadline of the search and sending the search results to the requesting unit.
Article 7. Processing and Approving Application Files for Issuing, Replacing, or Reissuing the Citizen Identity Card
After receiving the search results from the archive of citizen identity cards (if applicable), the approval and updating results of the Household Registration Information Collection Form (if applicable) and the Household Registration Information Update and Amendment Form (if applicable) into the National Population Database, the following actions shall be taken:
1. At the unit receiving the request for issuing, replacing, or reissuing the Citizen Identity Card
a) For the Police Station of the district
The staff assigned to classify application files for issuing, replacing, or reissuing the Citizen Identity Card shall classify files meeting and not meeting the conditions, prepare a list with the application files for issuing, replacing, or reissuing the Citizen Identity Card, and report to the Head of the Administrative Management Police Team for Social Order.
The Head of the Administrative Management Police Team for Social Order shall check the files meeting and not meeting the conditions and report to the Chief of the Police Station of the district.
The Chief of the Police Station of the district shall check the processing results of the files and approve the list of files meeting the conditions for issuing, replacing, or reissuing the Citizen Identity Card. For files not meeting the conditions, a written notice shall be issued to the citizen.
After the Chief of the Police Station of the district approves the list of files meeting the conditions, the Head of the Administrative Management Police Team for Social Order shall transfer the electronic data for issuing, replacing, or reissuing the Citizen Identity Card to the National Population Data Center.
b) For the Administrative Management Police Team for Social Order
The staff assigned to classify application files for issuing, replacing, or reissuing the Citizen Identity Card shall classify files meeting and not meeting the conditions, prepare a list with the application files for issuing, replacing, or reissuing the Citizen Identity Card, and report to the Head of the Citizen Identity Card Team.
The Head of the Citizen Identity Card Team shall check the files meeting and not meeting the conditions and report to the Chief of the Administrative Management Police Team for Social Order.
The Chief of the Administrative Management Police Team for Social Order shall check the processing results of the files and approve the list of files meeting the conditions for issuing, replacing, or reissuing the Citizen Identity Card. For files not meeting the conditions, a written notice shall be issued to the citizen.
After the Chief of the Administrative Management Police Team for Social Order approves the list of files meeting the conditions, the Head of the Citizen Identity Card Team shall transfer the electronic data for issuing, replacing, or reissuing the Citizen Identity Card to the National Population Data Center.
2. At the National Population Data Center:
a) For electronic data for issuing, replacing, or reissuing the Citizen Identity Card transferred from local police stations, the provisions of Article 8 of this Circular shall apply.
b) For application files for issuing, replacing, or reissuing the Citizen Identity Card directly received by the National Population Data Center, the following actions shall be taken:
The staff assigned to classify application files for issuing, replacing, or reissuing the Citizen Identity Card shall classify files meeting and not meeting the conditions, prepare a list with the application files for issuing, replacing, or reissuing the Citizen Identity Card, and report to the Director of the National Population Data Center.
The Director of the National Population Data Center checks the processing results of the application files and approves the list of applications meeting the conditions for issuing, replacing, or reissuing the Citizen Identity Card; for applications not meeting the conditions, he/she shall notify the citizen in writing.
After the application file has been approved by the Director of the National Population Data Center, it shall be implemented according to the provisions of Article 8 of this Circular.
Article 8. Processing of electronic data for issuing, replacing, or reissuing the Citizen Identity Card at the National Population Data Center
Based on the biometric matching results of the Citizen Identity Card issuance system, the data processing staff shall perform as follows:
1. For cases meeting the conditions for issuing, replacing, or reissuing the Citizen Identity Card:
Report to the Director of the National Population Data Center to propose the Director of the Administrative Police Department to approve the list of issuing, replacing, or reissuing the Citizen Identity Card.
2. For cases not meeting the conditions for issuing, replacing, or reissuing the Citizen Identity Card:
Report to the Director of the National Population Data Center to propose the Director of the Administrative Police Department to approve the list of applications not meeting the conditions for issuing, replacing, or reissuing the Citizen Identity Card and inform the unit receiving the application for issuing, replacing, or reissuing the Citizen Identity Card to review, verify, and handle violations (if any).
Article 9. Approval and Printing of the Citizen Identity Card
1. The Director of the Administrative Police Department approves the issuance, replacement, or reissuance of the Citizen Identity Card.
2. The date of issuance, replacement, or reissuance of the Citizen Identity Card is the date when the Director of the Administrative Police Department approves the issuance, replacement, or reissuance of the Citizen Identity Card.
3. The Director of the National Population Data Center organizes the printing of the completed Citizen Identity Card after approval.
Article 10. Delivery of the Citizen Identity Card and Results of Issuing, Replacing, or Reissuing the Citizen Identity Card
1. The National Population Data Center is responsible for:
a) Delivering the Citizen Identity Card and updating the data on the results of approving the issuance, replacement, or reissuance of the Citizen Identity Card to the initial receiving unit for the application for issuing, replacing, or reissuing the Citizen Identity Card;
b) Updating the data on the results of approving the issuance, replacement, or reissuance of the Citizen Identity Card to the National Population Database and recommending the establishment of a new personal identification number (if necessary) in accordance with regulations.
2. The unit receiving the application for issuing, replacing, or reissuing the Citizen Identity Card is responsible for:
a) Delivering the Citizen Identity Card, Certificate of the Citizen Identity Card Number, and the Citizen Identity Card Number (if applicable).
In cases where citizens request delivery of the results to their address, hand over the Citizen Identity Card, Certificate of the Citizen Identity Card Number, and the Citizen Identity Card Number (if applicable) to the service provider for delivery to the citizen.
b) Transfer the application file for issuing, replacing, or reissuing the Citizen Identity Card to the permanent residence identity card archive according to regulations;
c) Delete the data on issuing, replacing, or reissuing the Citizen Identity Card from the application receipt software after six months from the date of receipt of the application file for issuing, replacing, or reissuing the Citizen Identity Card.
Article 11. Time limit for processing applications for issuance, replacement, and reissuance of Citizen Identity Cards
1. For applications received by the Public Security Office at the district level or the Social Order Administrative Management Police Department, within two working days from the date of receiving complete applications, they must complete the processing and transfer the electronic data to the National Population Data Center.
2. At the Social Order Administrative Management Police Corps:
a) For electronic data submitted by units requesting the issuance, replacement, or reissuance of Citizen Identity Cards from provincial-level public security organs transferred up, within three working days from the date of receiving complete electronic data, the Director of the Social Order Administrative Management Police Corps must complete the processing, approval, and full printing of the Citizen Identity Card;
b) For applications received by the National Population Data Center, within four working days from the date of receiving the application, they must complete the processing, approval, and full printing of the Citizen Identity Card;
c) Within two working days from the completion of printing the Citizen Identity Card, it must be delivered back to the place where the application for issuance, replacement, or reissuance of the Citizen Identity Card was made.
Chapter III
IMPLEMENTATION
Article 12. Effective Date
This Circular takes effect from July 1, 2021, replacing Circular No. 11/2016/TT-BCA dated March 4, 2016 on the procedures for issuing, replacing, and reissuing Citizen Identity Cards and Circular No. 48/2019/TT-BCA dated October 15, 2019 amending and supplementing some articles of Circular No. 11/2016/TT-BCA dated March 4, 2016 on the procedures for issuing, replacing, and reissuing Citizen Identity Cards.
Article 13. Responsibility for Implementation
1. The Director of the Social Order Administrative Management Police Corps shall be responsible for guiding, inspecting, and urging the implementation of this Circular.
2. Heads of units under the Ministry of Public Security, Directors of provincial-level public security organs, and related agencies, organizations, and individuals shall be responsible for implementing this Circular.
During the implementation process, if there are difficulties or obstacles, local public security units shall report to the Ministry of Public Security (through the Social Order Administrative Management Police Corps) for timely guidance./.
