Regarding amendments and supplements to certain contents of Circular No. 09/2009/TT-BNN dated March 3, 2009 on the issuance of the List of Plant Protection Chemicals Permitted for Use, Restricted Use, and Prohibited Use in Vietnam and Circular No. 20/2009/TT-BNN dated April 17, 2009
and Circular No. 32/2009/TT-BNNPTNT dated June 8, 2009 on amendments and supplements to certain contents of Circular No. 09/2009/TT-BNN dated March 3, 2009
On the basis of Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
On the basis of the Plant Protection and Quarantine Law promulgated on August 8, 2001;
On the basis of the Regulation on Management of Plant Protection Chemicals issued together with Decision No. 89/2006/QĐ-BNN dated October 2, 2006 of the Ministry of Agriculture and Rural Development;
The Ministry of Agriculture and Rural Development amends and supplements certain contents of Circular No. 09/2009/TT-BNN dated March 3, 2009, Circular No. 20/2009/TT-BNN dated April 17, 2009, and Circular No. 32/2009/TT-BNNPTNT dated June 8, 2009 as follows:

Amendments and supplements to certain contents of Circular No. 09/2009/TT-BNN dated March 3, 2009 of the Ministry of Agriculture and Rural Development on the issuance of the List of Plant Protection Chemicals Permitted for Use, Restricted Use, and Prohibited Use in Vietnam include:
1. Amending the name of the organization applying for registration, amending the object of application for registration, amending the active ingredient name, amending the drug concentration, and amending the drug name (Annex 1 attached).
2. Official Registration: 17 cases (including 9 insecticides, 6 fungicides, 1 snailicide, 1 adjuvant (spreaders)) into the list of plant protection chemicals permitted for use in Vietnam (Annex 4 attached)
3. Supplementary Registration: 340 cases (including 176 insecticides, 117 fungicides, 29 herbicides, 6 growth regulators, 8 snailicides, 1 insect attractant, 1 fumigant, 1 wood preservative, 1 termicide) into the list of plant protection chemicals permitted for use in Vietnam (Annex 5 attached).
Article 1. Amend Annex 1 (Name of Organization Applying for Registration) issued by Circular No. 20/2009/TT-BNN dated April 17, 2009 of the Ministry of Agriculture and Rural Development on amendments and supplements to certain contents of Circular No. 09/2009/TT-BNN dated March 3, 2009 (Annex 2 attached).
Amend Annex 1 (Name of Organization Applying for Registration) issued by Circular No. 32/2009/TT-BNN dated June 8, 2009 of the Ministry of Agriculture and Rural Development on amendments and supplements to certain contents of Circular No. 09/2009/TT-BNN dated March 3, 2009 (Annex 3 attached).
Exporting and importing plant protection chemicals according to this Circular shall be carried out in accordance with Decree No. 12/2006/NĐ-CP dated January 23, 2006 of the Government detailing the implementation of the Law on Trade regarding international trade activities and agency buying, selling, processing, and transiting goods with foreign countries.
The Director of the Plant Protection Department, the Head of the Ministry's Office, Heads of units under the Ministry, and relevant organizations and individuals are responsible for implementing this Circular./.
Article 2. Amend Appendix 1 (Name of Organization Applying for Registration) issued by Circular No. 20/2009/TT-BNN dated April 17, 2009 of the Ministry of Agriculture and Rural Development on amending and supplementing certain contents of Circular No. 09/2009/TT-BNN dated March 3, 2009 (Appendix 2 attached).
Article 3. Amend Appendix 1 (Name of Organization Applying for Registration) issued by Circular No. 32/2009/TT-BNN dated June 8, 2009 of the Ministry of Agriculture and Rural Development on amending and supplementing certain contents of Circular No. 09/2009/TT-BNN dated March 3, 2009 (Appendix 3 attached).
Article 4. The export and import of various types of plant protection products under this Circular shall be carried out in accordance with Decree No. 12/2006/NĐ-CP dated January 23, 2006 of the Government detailing the implementation of the Law on Trade regarding international trade activities and related agency buying, selling, processing, and transit of goods with foreign countries.
Article 5. This Circular shall take effect forty-five days from the date of signature.
Article 6. The Director of the Plant Protection Department, the Head of the Ministry's Office, Heads of units under the Ministry, and relevant organizations and individuals are responsible for implementing this Circular./.
