CIRCULAR
ISSUING ECONOMIC AND TECHNICAL STANDARDS FOR PUBLIC SERVICE BUOY GUIDANCE SERVICES

Pursuant to the Maritime Code of Vietnam dated June 27, 2005;
WHEREAS, Decree No. 31/2005/NĐ-CP dated March 11, 2005 of the Government on the production and supply of public utility products and services;
WHEREAS, Decree No. 173/2007/NĐ-CP dated November 28, 2007 of the Government on the organization and operation of Marine Pilots;
WHEREAS, Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
WHEREAS, Decree No. 49/2011/NĐ-CP dated June 21, 2011 of the Government amending and supplementing Article 11 of Decree No. 173/2007/NĐ-CP dated November 28, 2007 of the Government on the organization and operation of Marine Pilots;
WHEREAS, Decision No. 256/2006/QĐ-TTg dated November 9, 2006 of the Prime Minister promulgating the Bidding, Ordering, and Allocation Plan Implementation Regulation for the Production and Supply of Public Utility Products and Services;
WHEREAS, Circular No. 58/2011/TT-BGTVT dated November 28, 2011 stipulating the mandatory pilotage zones of Vietnam;
The Minister of Transport hereby promulgates:
Article 1. ATTACHED TO THIS CIRCULAR ARE THE ECONOMIC AND TECHNICAL STANDARDS FOR PUBLIC UTILITY MARINE PILOTAGE SERVICES.
Article 2. THIS CIRCULAR REGULATES THE ACTIVITIES OF PUBLIC UTILITY MARINE PILOTAGE SERVICES AND APPLIES TO ORGANIZATIONS, UNITS, ENTITIES, AND INDIVIDUALS INVOLVED IN THE SUPPLY, MANAGEMENT, INSPECTION, AND SUPERVISION OF PUBLIC UTILITY MARINE PILOTAGE SERVICE OPERATIONS.
Article 3. THIS CIRCULAR SHALL TAKE EFFECT 45 DAYS FROM THE DATE OF ISSUANCE AND REPEAL DECISION No. 162/QĐ-BGTVT dated January 19, 2010 of the Minister of Transport.
Article 4. THE DEPARTMENT OF SCIENCE AND TECHNOLOGY IS RESPONSIBLE FOR LEADING AND COORDINATING WITH RELATED UNITS TO MONITOR, COLLECT, AND SUMMARIZE THE IMPLEMENTATION RESULTS OF THIS CIRCULAR, AND TO CHECK THE QUALITY OF PUBLIC UTILITY MARINE PILOTAGE SERVICE SUPPLY AS REQUIRED.
Article 5. THE HEAD OF THE MINISTRY’S OFFICE, THE HEAD OF THE MINISTRY’S INSPECTORATE, THE DIRECTORS OF THE MINISTRY’S DEPARTMENTS, THE DIRECTOR OF THE VIETNAM MARITIME ADMINISTRATION, THE GENERAL DIRECTORS OF THE NORTH VIETNAM MARINE SAFETY GUARANTEE CORPORATION AND THE SOUTH VIETNAM MARINE SAFETY GUARANTEE CORPORATION, THE DIRECTORS OF THE PILOT COMPANIES, AND THE HEADS OF RELATED ORGANIZATIONS AND UNITS ARE RESPONSIBLE FOR ENFORCING THIS CIRCULAR./.
