Election of National Assembly deputiesand People's Council deputies

On the basis of the Constitution of the Socialist Republic of Vietnam;

The National Assembly promulgates the Law on the election of National Assembly deputies and People's Council deputies.

PART I

GENERAL PROVISIONS

Article 1. Principles of election

The election of National Assembly deputies and People's Council deputies shall be conducted according to the principles of universal suffrage, equality, direct voting, and secret ballot.

Article 2. Voting age and candidacy age

As of the date of announcement of the election, citizens of the Socialist Republic of Vietnam who are eighteen years old or older have the right to vote, and those twenty-one years old or older have the right to run for election to the National Assembly and People's Councils at all levels as provided for in this Law.

Article 3. Candidate standards

1. Candidates for National Assembly deputies must meet the qualifications of National Assembly deputies as stipulated in the Law on the Organization of the National Assembly.

2. Candidates for People's Council deputies must meet the qualifications of People's Council deputies as stipulated in the Law on the Organization of Local Administration.

Article 4. Responsibilities of agencies and organizations in election work

1. The National Assembly decides the national election day for the election of National Assembly deputies and People's Council deputies at all levels; decides on supplementary elections for National Assembly deputies during the term of office; decides and establishes the National Election Committee.

2. The National Election Committee organizes the election of National Assembly deputies; directs and guides the election work of People's Council deputies at all levels.

3. The Standing Committee of the National Assembly implements the planning and allocation of the number of National Assembly deputies to be elected; determines the structure and composition of candidates for National Assembly deputies; guides the determination of the planned structure and composition, allocation of the number of candidates for People's Council deputies at all levels; supervises the election work of National Assembly deputies and People's Council deputies, ensuring that the election is conducted democratically, in accordance with the law, safely, and economically.

4. The Government directs ministries, ministerial-level agencies, government-affiliated agencies, People's Committees at all levels to implement election work in accordance with the law; organizes the implementation of measures to ensure funding, guides the management and use of funds for organizing the election, ensures information dissemination, publicity, security, safety, and other necessary conditions to serve the election.

5. The Vietnam Fatherland Front organizes consultations to select and introduce candidates for National Assembly deputies and People's Council deputies at all levels; participates in supervising the election of National Assembly deputies and People's Council deputies at all levels.

7. The Standing Committee of the People's Council forecasts the structure, composition, and number of People's Council deputies at their level; within the scope of their duties and powers, the Standing Committee of the People's Council and People's Committees at all levels are responsible for supervising, inspecting, and implementing election work in accordance with this Law and other relevant normative legal documents.

8. State agencies, political organizations, political-social organizations, social organizations, military units, public service units, and economic organizations have the responsibility to create conditions for election organizations to perform their duties and powers.

Article 5. Election Day

Election Day must be a Sunday and shall be announced no later than 115 days before Election Day.

Article 6. Budget for Organizing Elections

The budget for organizing elections for National Assembly deputies and People's Council deputies shall be guaranteed by the state budget.

Chapter II

PROJECTED STRUCTURE, COMPOSITION AND ALLOCATION OF DEPUTIESNATIONAL ASSEMBLY, PEOPLE'S COUNCIL DEPUTIES;ELECTORAL UNITS AND VOTING AREAS

The Standing Committee of the National Assembly shall project and allocate the number of National Assembly deputies to be elected in each province and centrally governed city on the following basis:

1. Each province and centrally governed city shall have at least three deputies residing and working in the locality.

2. The subsequent number of deputies shall be calculated based on the population and characteristics of each locality, ensuring that the projected total number of National Assembly deputies to be elected is five hundred people.

Article 8. Projected Structure and Composition of Individuals Proposed for Candidacy as National Assembly Deputies

1. Based on the projected number of National Assembly deputies to be elected, after reaching consensus with the Standing Committee of the Central Vietnam Fatherland Front and representatives of political-social organizations, no later than 105 days before Election Day, the Standing Committee of the National Assembly shall project the structure and composition of National Assembly deputies; the number of individuals from political organizations, political-social organizations, social organizations, people's armed forces, central and local state agencies proposed for candidacy as National Assembly deputies to ensure a reasonable representation ratio of various strata of the people in the National Assembly.

2. The number of ethnic minority individuals proposed for candidacy as National Assembly deputies shall be projected by the Standing Committee of the National Assembly based on the proposal of the Ethnic Council of the National Assembly, ensuring that at least eighteen percent of the total number of individuals in the official list of candidates for National Assembly deputies are ethnic minorities.

Based on the number of People's Council deputies to be elected in each administrative unit according to the Law on the Organization of Local State Administration, after reaching consensus with the Standing Committee of the Vietnam Fatherland Front and the same-level People's Committee, no later than 105 days before Election Day:

1. The Standing Committee of the Provincial People's Council (hereinafter referred to as the provincial level) and the Standing Committee of the District People's Council, town, urban district, and city under a province, city under a centrally governed city (hereinafter referred to as the district level) shall project the structure and composition, allocate the number of individuals from political organizations, political-social organizations, social organizations, people's armed units, state agencies at their own level and subordinate administrative units, public institutions, economic organizations on the territory proposed for candidacy as People's Council deputies at the provincial and district levels, ensuring that at least thirty-five percent of the total number of individuals in the official list of candidates for People's Council deputies are women; the number of candidates who are ethnic minorities shall be determined appropriately based on the specific situation of each locality;

2. The Standing Committee of the Commune People's Council, ward, town (hereinafter referred to as the commune level) shall project the structure and composition, allocate the number of individuals from political organizations, political-social organizations, social organizations, people's armed units, state agencies at their own level and village, hamlet, village group, village cluster, village community, residential area, street, neighborhood, quarter (hereinafter referred to as the village), public institutions, economic organizations on the territory proposed for candidacy as People's Council deputies at the commune level, ensuring that at least thirty-five percent of the total number of individuals in the official list of candidates for People's Council deputies are women; the number of candidates who are ethnic minorities shall be determined appropriately based on the specific situation of each locality;

3. The projected structure, composition, and allocation of individuals proposed for candidacy as People's Council deputies by the Standing Committee of the People's Council at each level shall be sent to the National Election Council, the Standing Committee of the higher-level People's Council, the Standing Committee of the Vietnam Fatherland Front, and the same-level election committee.

Article 10. Electoral Units

1. National Assembly deputies and People's Council deputies are elected according to electoral units.

The number of electoral units for provincial, district, and commune-level People's Council deputies, the list of electoral units, and the number of deputies to be elected in each electoral unit shall be determined by the respective level election committee upon proposal by the same-level People's Committee and shall be announced no later than eighty days before the election date.

4. Each electoral unit for National Assembly deputies may elect no more than three deputies. Each electoral unit for People's Council deputies may elect no more than five deputies.

Article 11. Polling Stations

1. Each electoral unit for National Assembly deputies and People's Council deputies shall be divided into polling stations. A polling station for electing National Assembly deputies shall also serve as a polling station for electing People's Council deputies at all levels.

3. Cases where separate polling stations may be established:

a) Military units;

b) Hospitals, maternity homes, convalescent homes, care facilities for persons with disabilities, and care facilities for the elderly with fifty or more voters;

c) Compulsory education institutions, compulsory drug rehabilitation centers, and temporary detention centers.

Chapter III

NATIONAL ELECTION COUNCIL AND LOCAL ORGANIZATIONS RESPONSIBLE FOR ELECTIONSLOCAL ELECTION RESPONSIBILITIES

Section 1

NATIONAL ELECTION COUNCIL

Article 12. Structure and Organization of the National Election Council

1. The National Election Council shall be established by the National Assembly, consisting of fifteen to twenty-one members including the Chairperson, Vice-Chairpersons, and Members who are representatives of the National Assembly Standing Committee, the Government, the Vietnam Fatherland Front Central Committee, and other relevant agencies and organizations.

2. The Chairperson of the National Election Council shall be elected and relieved of duty by the National Assembly upon the proposal of the National Assembly Standing Committee. The Vice-Chairpersons and Members of the National Election Council shall be approved by the National Assembly upon the proposal of the Chairperson of the National Election Council.

3. The National Election Council shall establish sub-committees to assist the National Election Council in performing its tasks and exercising its powers in specific fields.

Article 13. Principles of Operation of the National Election Council

The National Election Council operates under a collective system, making decisions by majority vote. Meetings are held when at least two-thirds of the total number of members of the National Election Council are present; decisions are adopted when more than half of the total number of members voting agree.

The National Election Council is accountable to the National Assembly and reports on its activities to the National Assembly and the Standing Committee of the National Assembly.

Article 14. General Duties and Authorities of the National Election Council

1. Organizing elections for National Assembly deputies.

2. Directing and guiding election work for People's Council deputies at all levels.

3. Directing information dissemination, propaganda, and voter mobilization work.

4. Directing security, public order, and social safety work during the election.

5. Inspecting and urging the enforcement of laws related to elections.

6. Prescribing models of candidate registration forms, voter cards, ballots, polling booth rules, and other documents used in election work.

Article 15. Duties and Authorities of the National Election Council in Organizing Elections for National Assembly Deputies

1. Determining and announcing the number of constituencies for National Assembly deputies, lists of constituencies, and the number of National Assembly deputies to be elected in each constituency.

4. Establishing and announcing the official list of candidates for National Assembly deputies according to each constituency; removing the names of candidates from the official list of candidates for National Assembly deputies.

6. Deciding on additional elections, re-elections of National Assembly deputies, or nullifying election results and deciding the date of re-election in polling areas or constituencies where serious violations of the law occur.

7. Confirming and announcing the election results for National Assembly deputies nationwide; confirming the qualifications of elected National Assembly deputies.

8. Submitting a report on the summary of the national election and the confirmation of the qualifications of elected National Assembly deputies to the new National Assembly session.

9. Resolving complaints and denunciations regarding the election work for National Assembly deputies; transferring complaint and denunciation files related to elected National Assembly deputies to the Standing Committee of the National Assembly.

10. Managing and allocating funds for organizing elections for National Assembly deputies.

Article 16. Tasks and powers of the National Election Council in directing and guiding the election work for People's Council delegates

1. Direct and guide the implementation of legal provisions on the election of People's Council delegates.

2. Guide the activities of organizations responsible for the election of People's Council delegates.

3. Inspect the organization of the election of People's Council delegates.

4. Invalidate the election results of People's Council delegates in areas or constituencies where there are serious violations of the law, and decide on the date for a re-election.

Article 17. Tasks and powers of the Chairman, Vice Chairmen, and Members of the National Election Council

1. The Chairman of the National Election Council is responsible to the National Assembly for the activities of the National Election Council and performs the following tasks and powers:

a) Submit the list of Vice Chairmen and Members of the National Election Council to the National Assembly for approval;

b) Convene and chair meetings of the National Election Council;

c) Lead and manage the operations of the National Election Council;

d) Maintain contact with members of the National Election Council;

e) Represent the National Election Council in relations with other agencies and organizations;

f) Perform other tasks and powers assigned by the National Election Council.

2. Vice Chairmen and Members of the National Election Council perform tasks and powers assigned by the National Election Council and are accountable to the National Election Council for their performance.

3. In the absence of the Chairman, a Vice Chairman appointed by the Chairman shall represent and perform the tasks and powers of the Chairman of the National Election Council.

Article 18. Working Relationships of the National Election Council

1. The National Election Council collaborates with the Standing Committee of the National Assembly in supervising and inspecting the election work for National Assembly delegates and People's Council delegates.

2. The National Election Council collaborates with the Central Steering Committee of the Vietnam Fatherland Front in negotiating and introducing candidates for National Assembly delegates, guiding the negotiation and introduction of candidates for People's Council delegates, and mobilizing voters.

3. The National Election Council collaborates with the Government in ensuring funding, security, safety, and other necessary conditions for the election work for National Assembly delegates and People's Council delegates.

4. The National Election Council directs and guides organizations responsible for elections nationwide regarding the election work for National Assembly delegates and People's Council delegates.

Article 19. Supporting Machinery and Operating Budget of the National Election Council

1. The National Election Council has a supporting machinery as prescribed by the Standing Committee of the National Assembly.

2. The National Election Council has the authority to requisition civil servants from state agencies, political organizations, and political-social organizations to assist the National Election Council.

3. The operating budget of the National Election Council is guaranteed by the state budget.

Article 20. Termination of the Term of Office of the National Election Council

The National Election Council terminates its term of office after submitting a report on the national election results and the confirmation of the qualifications of elected National Assembly delegates to the new session of the National Assembly, and transferring the summary records and election-related documents to the new session of the Standing Committee of the National Assembly.

Section 2

LOCAL ORGANIZATIONS RESPONSIBLE FOR ELECTIONS

1. The provincial election committee, the municipal election committee under the central government, the district election committee, the town election committee, the county election committee under the province, the city election committee under the centrally governed city, the commune election committee, the ward election committee, and the town election committee (hereinafter referred to collectively as the election committee).

2. The National Assembly representative election board, the provincial People's Council representative election board, the district People's Council representative election board, the commune People's Council representative election board (hereinafter referred to collectively as the election board).

3. The Polling Station.

1. Not later than 105 days before the election day, the provincial People's Committee shall decide on the establishment of the provincial election committee (hereinafter referred to collectively as the provincial election committee) after reaching consensus with the Standing Committee of the Provincial People's Council and the Standing Committee of the Provincial Vietnam Fatherland Front Committee to implement the work of electing National Assembly representatives and organizing the election of provincial People's Council representatives in the province or centrally governed city.

The provincial election committee consists of twenty-one to thirty-one members including the Chairman, Vice Chairmen, and members who are representatives of the Standing Committee of the People's Council, the People's Committee, the Vietnam Fatherland Front Committee at the same level, and some relevant agencies and organizations.

The list of members of the provincial election committee must be sent to the National Election Council, the Standing Committee of the National Assembly, the Government, and the Standing Committee of the Central Vietnam Fatherland Front Committee.

2. Not later than 105 days before the election day, the district People's Committee and the commune People's Committee shall decide on the establishment of the district election committee, the town election committee, the county election committee under the province, the city election committee under the centrally governed city (hereinafter referred to collectively as the district election committee), and the commune election committee, the ward election committee, and the town election committee (hereinafter referred to collectively as the commune election committee) after reaching consensus with the Standing Committee of the People's Council and the Standing Committee of the Vietnam Fatherland Front Committee at the same level to organize the election of district and commune People's Council representatives.

The district election committee has eleven to fifteen members; the commune election committee has nine to eleven members. Members of the district and commune election committees include the Chairman, Vice Chairmen, and members who are representatives of the Standing Committee of the People's Council, the People's Committee, the Vietnam Fatherland Front Committee at the same level, and some relevant agencies and organizations.

The list of members of the district election committee and the commune election committee must be sent to the Standing Committee of the People's Council, the People's Committee, and the Standing Committee of the Vietnam Fatherland Front Committee at the higher level.

Article 23. Duties and powers of the election committee

1. In the election of National Assembly representatives, the provincial election committee has the following duties and powers:

b) Direct the implementation of information dissemination, propaganda, and mobilization for the election of National Assembly representatives in the locality;

c) Direct the implementation of security, public order, and social safety during the election of National Assembly representatives in the locality;

d) Receive and examine the files of individuals nominated as candidates for National Assembly representatives by political organizations, political-social organizations, social organizations, people's armed forces units, state agencies, public institutions, and economic organizations in the locality, and the files of self-nominated candidates for National Assembly representatives in the locality; send the list of brief biographies, copies of short resumes, and declarations of assets and income of those nominated and self-nominated candidates for National Assembly representatives to the Standing Committee of the Vietnam Fatherland Front Committee at the provincial level for negotiation; send the files and lists of candidates for National Assembly representatives in the locality to the National Election Council;

đ) Compile the list of candidates for National Assembly representatives according to constituencies and report to the National Election Council for decision;

e) Direct and inspect the compilation and posting of voter lists;

h) Resolve complaints and denunciations regarding the implementation of the election of National Assembly representatives by the National Assembly representative election board and the electoral team; complaints and denunciations about the election of National Assembly representatives transferred by the National Assembly representative election board and the electoral team; complaints and denunciations about candidates for National Assembly representatives;

i) Receive and examine the minutes determining the election results of National Assembly representatives from the National Assembly representative election boards; compile the minutes determining the election results of National Assembly representatives in the locality;

k) Report on the organization and conduct of the election of National Assembly representatives as required by the National Election Council;

l) Transfer the files and minutes determining the election results of National Assembly representatives to the National Election Council;

m) Organize additional or re-elections of National Assembly representatives according to the decision of the National Election Council.

2. In the election of People's Council representatives, the election committees at all levels have the following duties and powers:

a) Direct the organization of the election of People's Council representatives in their own constituencies; inspect and urge the implementation of laws on the election of People's Council representatives;

b) Manage and allocate funds for the organization of the election of People's Council representatives at their own level;

c) Direct the implementation of information dissemination, propaganda, and mobilization for the election of People's Council representatives in the locality;

d) Direct the implementation of security, public order, and social safety during the election of People's Council representatives in the locality;

đ) Determine and announce the number of constituencies, the list of constituencies, and the number of representatives to be elected in each constituency for the People's Council representatives at their own level;

e) Receive and examine the files of individuals nominated for election by political organizations, socio-political organizations, social organizations, people's armed units, state agencies, public institutions, economic organizations, villages, and residential wards at the local level, and those who have self-nominated themselves as candidates for People's Council representatives; send a list of brief biographies, copies of summarized resumes, and declarations of assets and income of the nominated and self-nominated candidates to the Standing Committee of the Vietnam Fatherland Front Committee at the same level for consultation;

g) Establish and announce the official list of candidates for People's Council representatives according to each electoral unit; remove the name of a candidate from the official list of candidates for People's Council representatives;

i) Receive and review the certification of election results for People's Council representatives from each electoral unit sent by the Election Committees; establish a summary record of the election of People's Council representatives;

k) Direct additional and re-elections of People's Council representatives as stipulated in Articles 79, 80, 81, and 82 of this Law;

l) Confirm and announce the election results for People's Council representatives; confirm the qualifications of elected People's Council representatives;

m) Report to the new session of the People's Council on the summary of the election of People's Council representatives and the confirmation of the qualifications of the elected People's Council representatives;

n) Resolve complaints and denunciations regarding the implementation of the election work of the Election Committees and Polling Stations; complaints and denunciations about the election of People's Council representatives transferred by the Election Committees and Polling Stations; complaints and denunciations about candidates and the establishment of the list of candidates for People's Council representatives;

o) Hand over the summary records and files, materials related to the election of People's Council representatives to the Standing Committee of the new session of the People's Council;

1. At least 70 days before the election date, the provincial People's Committee, after reaching consensus with the Standing Committee of the People's Council and the Standing Committee of the Vietnam Fatherland Front Committee at the same level, decides to establish an Election Committee for each electoral unit for the National Assembly consisting of nine to fifteen members including the Chairperson, Deputy Chairpersons, and Members representing the Standing Committee of the People's Council, the People's Committee, the Vietnam Fatherland Front Committee, and some relevant agencies and organizations;

2. At least 70 days before the election date, the provincial, district, and commune People's Committees, after reaching consensus with the Standing Committee of the People's Council and the Standing Committee of the Vietnam Fatherland Front Committee at the same level, decide to establish an Election Committee for each electoral unit for the People's Council consisting of representatives from state agencies, political organizations, socio-political organizations, and social organizations. The commune-level Election Committee includes additional representatives from local voters;

The Election Committee for the provincial People's Council consists of eleven to thirteen members. The Election Committee for the district People's Council consists of nine to eleven members. The Election Committee for the commune People's Council consists of seven to nine members. Each Election Committee includes a Chairperson, Deputy Chairpersons, and Members;

3. The Election Committee has the following tasks and powers:

a) Supervise and urge the implementation of election laws by Polling Stations within the electoral unit;

b) Supervise and urge the establishment and posting of voter lists and the posting of candidate lists at Polling Stations within the electoral unit;

c) Direct, supervise, and urge the arrangement of polling rooms and election procedures in polling rooms;

d) Receive and distribute voting materials to Polling Stations no later than 15 days before the election date;

đ) Receive, compile, and check the certification of vote counting results from Polling Stations; establish a certification of the election results in the electoral unit;

e) Resolve complaints and denunciations regarding the implementation of election work by Polling Stations and complaints and denunciations about elections transferred by Polling Stations; receive and transfer complaints and denunciations about National Assembly candidates to the Provincial Election Committee; receive and transfer complaints and denunciations about People's Council candidates to the corresponding Election Committee;

g) Report on the organization and conduct of the election according to the guidance and requirements of the National Election Council or the requirements of the same-level Election Committee;

h) Transfer election files and materials for National Assembly candidates to the Provincial Election Committee; transfer election files and materials for People's Council candidates to the same-level Election Committee;

i) Organize additional and re-elections (if necessary).

Article 25. Election Team

For districts without communes or towns, the People's Committee at the district level shall decide, in consultation with the Standing Body of the People's Council and the Standing Body of the Vietnam Fatherland Front Committee at the same level, to establish an Election Team in each polling area consisting of eleven to twenty-one members including the Team Leader, Secretary, and other Members who are representatives from state agencies, political organizations, socio-political organizations, social organizations, and local voters.

Military units identified as separate polling areas shall establish an Election Team consisting of five to nine members including the Team Leader, Secretary, and other Members who are representatives from the command of the military unit and military personnel of that military unit.

In cases where military units and localities share the same polling area, the People's Committee at the commune level shall decide, in consultation with the Standing Body of the People's Council, the Standing Body of the Vietnam Fatherland Front Committee at the same level, and the command of the military unit, to establish an Election Team consisting of eleven to twenty-one members including the Team Leader, Secretary, and other Members who are representatives from state agencies, political organizations, socio-political organizations, social organizations, local voters, the command of the military unit, and military personnel of that military unit.

2. The Election Team shall have the following tasks and powers:

c) Receiving election materials and ballots from the Election Board and distributing ballots stamped by the polling station to voters;

d) Regularly informing voters of the election date, voting location, and voting time ten days before the election day;

c) Receive election materials and ballots from the Election Board; issue voter cards and ballots stamped by the Election Team to voters;

d) Regularly inform voters about the election date, polling place, and voting time within ten days before the election day;

đ) Ensure strict compliance with the legal provisions on elections and the rules of conduct in the polling station;

e) Resolve complaints and denunciations regarding the performance of the tasks and powers of the Election Team as stipulated in this Article; receive and forward complaints and denunciations concerning candidates for members of the National Assembly, candidates for representatives of People's Councils, and other complaints and denunciations not within the jurisdiction of the Election Team to the corresponding Election Board;

g) Count the votes and prepare a record of the vote counting results to send to the corresponding Election Board;

h) Transfer the record of the vote counting results and all ballots to the People's Committee at the commune level upon completion of the vote counting;

i) Report on the organization and conduct of the election according to the regulations of higher-level election management bodies;

k) Carry out additional or repeat voting in the polling area (if necessary).

Article 26. Principles of Operation of Local Election Management Bodies

1. Local election management bodies operate under a collective system, making decisions by majority rule. Meetings shall be held when at least two-thirds of the total number of members are present; decisions shall be adopted when more than half of the total number of members voting agree.

2. The competent authority responsible for establishing election management bodies has the right to summon civil servants, public officials, and employees from state agencies, socio-political organizations, social organizations, and public service units to assist in carrying out tasks related to organizing the election.

Article 27. Cases where individuals are not allowed to participate in election organizations

Candidates for National Assembly deputies and People's Council deputies shall not be members of the Election Board or the Election Team in the electoral unit where they are candidates. If they are already members of the Election Board or the Election Team in the electoral unit where they are candidates, such candidates must request their removal from the list of members of the election organization no later than the day the official list of candidates is announced. In case the candidate does not submit a withdrawal request, the agency that established the Election Board or the Election Team shall issue a decision to remove the candidate's name from the list of members of the election organization and replace them with another member.

Article 28. The termination date of the duties of local election organizations

1. The Provincial Election Board, the Election Board for National Assembly deputies, and the Election Team cease their duties regarding the election of National Assembly deputies after the National Election Council concludes the election work and announces the election results for National Assembly deputies nationwide.

2. The Election Board ceases its duties regarding the election of People's Council deputies after it reports the summary of the election and submits relevant files and documents to the first session of the newly elected People's Council.

3. The Election Board for People's Council deputies and the Election Team cease their duties regarding the election of People's Council deputies after the Election Board concludes the election work and announces the election results for People's Council deputies.

Chapter IV

Voters who are students, pupils, and trainees at vocational schools, universities, colleges, and specialized secondary schools, and voters who are military personnel in military units are included in the voter list to vote for provincial and district-level People's Council deputies in their temporary residence or garrison locations.

Article 29. Principles for compiling voter lists

1. All citizens with the right to vote shall be included in the voter list and issued voter cards, except for cases specified in Clause 1 of Article 30 of this Law.

2. Each citizen may only be listed on one voter list at either their place of permanent residence or temporary residence.

5. Voters who are under temporary detention, arrest, or serving compulsory educational or drug rehabilitation measures shall be included in the voter list to elect National Assembly deputies and provincial-level People's Council deputies at the location where they are detained, arrested, or serving such measures.

Article 30. Cases where names cannot be included, removed, or added to the voter list

1. Individuals whose right to vote has been revoked according to court judgments or decisions that have taken legal effect, those sentenced to death and awaiting execution, those serving prison sentences without suspended sentences, and those lacking civil capacity shall not be included in the voter list.

2. Individuals falling under the cases stipulated in Clause 1 of this Article, if they regain their right to vote, are released, or are confirmed by competent authorities to no longer lack civil capacity before the start of voting, shall be added to the voter list and issued voter cards in accordance with Article 29 of this Law.

5. Individuals who are listed on the voter list but lose their right to vote, are required to serve a prison sentence, or lose their civil capacity at the time of voting, the People's Committee of the commune shall remove their names from the voter list and reclaim their voter cards.

Article 31. Authority to establish voter lists

For districts without commune administrative units, the district People's Committee shall be responsible for establishing voter lists for each polling station area.

2. Voter lists within military units shall be established by the unit commander according to the military unit to be included in the voter list of the polling station where the unit is stationed. Military personnel with permanent residence registration in a nearby locality to the unit’s location may be issued a certificate by the unit commander to have their names recorded on the voter list and participate in voting at their place of permanent residence. When issuing the certificate, the unit commander must immediately record next to the name of that person in the voter list of the military unit the phrase "Vote at place of residence."

Article 32. Publicizing voter lists

At least 40 days before election day, the agency responsible for establishing the voter list shall publicize the voter list at the office of the commune-level People's Committee and at public places in the polling station area, and widely announce the voter list and its publicizing for the people to check.

Article 33. Complaints about voter lists

When checking the voter list, if any errors are found, citizens have the right to lodge complaints with the agency responsible for establishing the voter list within 30 days from the date of publicizing. The agency responsible for establishing the voter list must record those complaints in a logbook. Within five days from the date of receiving the complaint, the agency responsible for establishing the voter list must resolve it and inform the complainant of the resolution result.

If the complainant disagrees with the resolution of the complaint or if the complaint remains unresolved beyond the resolution period, they have the right to initiate legal proceedings at the Administrative Court in accordance with the provisions of the law on administrative litigation procedures.

Article 34. Voting at another location

From the date of publicizing the voter list until election day, if a voter cannot participate in voting at the location where they were registered due to being elsewhere, they have the right to request a certificate from the commune-level People's Committee where they are registered as a voter to have their name added to the voter list and participate in voting for National Assembly deputies and provincial People's Council representatives at a location where they can vote. When issuing the certificate, the commune-level People's Committee must immediately record next to the voter's name in the voter list of the polling station area the phrase "Vote at another location."

Chapter V

NOMINATION AND NEGOTIATION, INTRODUCTION OF CANDIDATESIN SUPPLEMENTARY ELECTIONS

Section 1

NOMINATION

Article 35. Nomination dossier and time limit for submission of nomination dossier

2. The nomination dossier includes:

a) Nomination application form;

b) A certified curriculum vitae from the competent authority;

c) Summary biography;

d) Three color passport-sized photographs measuring 4cm x 6cm;

e) Declaration of assets and income in accordance with the law on anti-corruption.

3. The National Election Council shall guide the implementation of this provision.

Article 36. Submission of nomination dossier

1. The submission of the nomination dossier of candidates for National Assembly deputies shall be carried out as follows:

a) Candidates nominated by political organizations, political-social organizations, social organizations, military forces, central state agencies shall submit two copies of the nomination dossier to the National Election Council;

b) Candidates nominated by political organizations, political-social organizations, social organizations, military units, state agencies, public institutions, economic organizations at the local level, and self-nominated candidates shall submit two copies of the nomination dossier to the Provincial Election Council where they reside or work regularly;

c) After receiving and reviewing the dossiers of the candidates, if they meet the requirements stipulated by this Law, the National Election Council shall transfer the abbreviated curriculum vitae, copies of the summary biography, and declarations of assets and income of the nominated candidates to the Standing Board of the Central Vietnam Fatherland Front Committee. The Provincial Election Council shall transfer the nomination dossiers of the nominated candidates and self-nominated candidates at the local level to the National Election Council; transfer the abbreviated curriculum vitae, copies of the summary biography, and declarations of assets and income of the nominated candidates and self-nominated candidates at the local level to the Standing Board of the Vietnam Fatherland Front Committee at the provincial level for inclusion in the negotiation list.

2. Candidates for People's Council deputies shall submit one copy of the nomination dossier to the Election Council of the administrative unit where they are running. Self-nominated candidates and candidates introduced for candidacy for People's Council deputies of a locality must be residents or regular workers in that locality.

After receiving and reviewing the dossiers of self-nominated candidates and candidates introduced by agencies, organizations, and units, if they meet the requirements stipulated by this Law, the Election Council shall transfer the abbreviated curriculum vitae, copies of the summary biography, and declarations of assets and income of the candidates to the Standing Board of the Vietnam Fatherland Front Committee at the same level for inclusion in the negotiation list.

Article 37. Cases where one cannot be nominated as a National Assembly Delegate or People's Council Delegate

1. A person who has been deprived of the right to be nominated according to a court judgment or decision that has taken legal effect, a person currently serving a prison sentence, a person whose civil capacity is restricted or lost.

2. A person who is under criminal investigation.

3. A person currently serving a criminal judgment or decision of the court.

4. A person who has completed serving a criminal judgment or decision of the court but has not yet had their criminal record expunged.

Section 2

NEGOTIATION, INTRODUCTION OF NOMINEES FOR NATIONAL ASSEMBLY DELEGATES AND ADJUSTMENT OF STRUCTURE,COMPOSITION, NUMBER OF PERSONS TO BE INTRODUCED AS NOMINEES FOR NATIONAL ASSEMBLY DELEGATES,COMPOSITION AND NUMBER OF PERSONS TO BE NOMINATEDNOMINATION OF NATIONAL ASSEMBLY DELEGATES

Article 38. The first negotiation meeting at the central level

1. The first negotiation meeting at the central level shall be organized by the Central Steering Committee of the Vietnam Fatherland Front no later than 95 days before the election day. The first negotiation meeting shall include the Central Steering Committee of the Vietnam Fatherland Front, representatives from the leadership bodies of the member organizations of the Fatherland Front. Representatives from the National Election Council, the Standing Committee of the National Assembly, and the Government shall be invited to attend this meeting.

2. The negotiation meeting shall agree on the structure, composition, and number of persons from agencies, organizations, and units at the central level to be introduced as nominees for National Assembly Delegates based on the preliminary plan of the Standing Committee of the National Assembly.

3. The minutes of the negotiation meeting must clearly record the participants, the number of people attending, the proceedings, and the results of the meeting, and must be immediately sent to the National Election Council and the Standing Committee of the National Assembly.

2. The negotiation meeting shall agree on the structure, composition, and number of persons from agencies, organizations, and units at the local level to be introduced as nominees for National Assembly Delegates based on the preliminary plan of the Standing Committee of the National Assembly.

3. The minutes of the negotiation meeting must clearly record the participants, the number of people attending, the proceedings, and the results of the meeting, and must be immediately sent to the National Election Council, the Standing Committee of the National Assembly, the Central Steering Committee of the Vietnam Fatherland Front, and the Provincial Election Committee.

Article 40. First adjustment by the Standing Committee of the National Assembly

Based on the results of the first negotiation, no later than 90 days before the election day, the Standing Committee of the National Assembly shall make the first adjustment to the structure, composition, and number of persons from agencies, organizations, and units at the central and local levels to be introduced as nominees for National Assembly Delegates.

Article 41. Nomination of candidates for National Assembly deputies from central agencies, organizations, and units

Based on the first adjustment of the Standing Committee of the National Assembly, according to the criteria for National Assembly deputies, the central agencies, organizations, and units allocated the number of people to be nominated as candidates for National Assembly deputies shall conduct selection and nomination of their own agency, organization, or unit members as candidates for National Assembly deputies as follows:

1. The leadership of political organizations, political-social organizations, and social organizations shall propose individuals from their own organizations to be nominated as candidates for National Assembly deputies, and organize meetings of voters at the workplace of such individuals to seek opinions. On the basis of the opinions of the voter meeting, the leadership of the organization shall convene an expanded Standing Committee meeting or an expanded Chairman's Board meeting to discuss and nominate individuals from their organization as candidates for National Assembly deputies;

3. In People's Armed Forces units, the unit commander shall propose individuals from their own unit to be nominated as candidates for National Assembly deputies, and organize meetings of voters at the workplace of such individuals to seek opinions. On the basis of the opinions of the voter meeting, the unit commander shall convene a meeting including leaders and commanders of the unit, representatives of the Party Committee (if any), representatives of military personnel, and direct subordinates' commanders to discuss and nominate individuals from their unit as candidates for National Assembly deputies;

4. The organization of voter meetings as stipulated in this Article shall be carried out in accordance with the provisions of Article 45 of this Law;

5. Central agencies, organizations, and units nominating individuals as candidates for National Assembly deputies must transfer the minutes of the voter meeting at the workplace and the minutes of the leadership meeting of their own agency, organization, or unit regarding the individual proposed as a candidate for National Assembly deputy to the Central Steering Committee of the Vietnam Fatherland Front before the second round of negotiation meeting is organized.

Article 42. Nomination of candidates for National Assembly deputies from local agencies, organizations, and units

Based on the first adjustment of the Standing Committee of the National Assembly, according to the criteria for National Assembly deputies, local agencies, organizations, and units allocated the number of people to be nominated as candidates for National Assembly deputies shall conduct selection and nomination of their own agency, organization, or unit members as candidates for National Assembly deputies as follows:

1. The leadership of political organizations, political-social organizations, and social organizations shall propose individuals from their own organizations to be nominated as candidates for National Assembly deputies, and organize meetings of voters at the workplace of such individuals to seek opinions. On the basis of the opinions of the voter meeting, the leadership of the organization shall convene an expanded Standing Committee meeting to discuss and nominate individuals from their organization as candidates for National Assembly deputies;

3. In People's Armed Forces units, the unit commander shall propose individuals from their own unit to be nominated as candidates for National Assembly deputies, and organize meetings of voters at the workplace of such individuals to seek opinions. On the basis of the opinions of the voter meeting, the unit commander shall convene a meeting including leaders and commanders of the unit, representatives of the Party Committee (if any), representatives of military personnel, and direct subordinates' commanders to discuss and nominate individuals from their unit as candidates for National Assembly deputies;

4. The organization of voter meetings as stipulated in this Article shall be carried out in accordance with the provisions of Article 45 of this Law;

5. Local agencies, organizations, and units nominating individuals as candidates for National Assembly deputies must transfer the minutes of the voter meeting at the workplace and the minutes of the leadership meeting of their own agency, organization, or unit regarding the individual proposed as a candidate for National Assembly deputy to the Provincial Steering Committee of the Vietnam Fatherland Front before the second round of negotiation meeting is organized.

Article 43. The second round of consultation meetings at the central level

2. The second round of consultation meetings shall base on the criteria for National Assembly deputies, the structure, composition, and number of people from agencies, organizations, and units at the central level that have been introduced as candidates for National Assembly deputies after the first adjustment by the Standing Committee of the National Assembly to establish a preliminary list of candidates for National Assembly deputies and send it to collect opinions from voters in their place of residence. The organization of collecting voter opinions shall be carried out in accordance with Article 45 of this Law.

3. The minutes of the consultation meeting must clearly record the composition, number of participants, proceedings, and results of the meeting and be immediately sent to the National Election Council and the Standing Committee of the National Assembly.

2. The second round of consultation meetings shall base on the criteria for National Assembly deputies, the structure, composition, and number of people from agencies, organizations, and units at the local level that have been introduced as candidates for National Assembly deputies after the first adjustment by the Standing Committee of the National Assembly to establish a preliminary list of candidates for National Assembly deputies and send it to collect opinions from voters in their place of residence; for self-nominated candidates, opinions from voters where they work (if applicable) shall also be collected. The organization of collecting voter opinions shall be carried out in accordance with Article 45 of this Law.

3. The minutes of the consultation meeting must clearly record the composition, number of participants, proceedings, and results of the meeting and be immediately sent to the National Election Council, the Standing Committee of the National Assembly, the Provincial Steering Committee of the Vietnam Fatherland Front, and the Provincial Election Committee.

Article 45. Voter Meetings

Candidates for National Assembly deputies and representatives of agencies, organizations, and units that have introduced candidates shall be invited to attend these meetings.

Candidates for National Assembly deputies shall be invited to attend these meetings.

3. At the voter meeting, voters shall compare the criteria for National Assembly deputies, comment, express their trust in the candidate for National Assembly deputy by raising hands or voting secretly according to the decision of the meeting.

4. The minutes of the voter meeting to collect opinions on candidates for National Assembly deputies must clearly record the composition, number of participants, proceedings, and results of the meeting. Minutes of the voter meeting at the place of residence to collect opinions on candidates introduced by central-level agencies, organizations, and units shall be sent to the Central Steering Committee of the Vietnam Fatherland Front. Minutes of the voter meeting to collect opinions on self-nominated candidates and candidates introduced by local-level agencies, organizations, and units shall be sent to the Provincial Steering Committee of the Vietnam Fatherland Front.

5. The Standing Committee of the National Assembly shall provide detailed regulations on organizing voter meetings as stipulated in this Article.

Article 46. Verification and Response to Matters Raised by Voters Against Candidates for National Assembly Deputies

Clause 1. For matters at the place of work, the agency, organization, or unit directly managing the candidate shall be responsible for verifying and responding in writing to the Standing Committee of the Vietnam Fatherland Front Central Committee and the Standing Committee of the Vietnam Fatherland Front Provincial Committee.

In cases where the candidate for a National Assembly deputy is the head of an agency, organization, or unit, the superior agency, organization, or unit shall be responsible for verification and response. If there is no direct supervising agency, organization, or unit, then the authority that issued the decision to establish such agency, organization, or unit shall be responsible for verification and response.

Clause 2. For matters in residential areas, the agency, organization, or unit introducing the candidate shall cooperate with the People's Committee of the commune to verify and respond in writing to the Standing Committee of the Vietnam Fatherland Front Central Committee and the Standing Committee of the Vietnam Fatherland Front Provincial Committee.

Clause 3. For self-nominated candidates for National Assembly deputies, the Election Committee of the province shall coordinate with the agency, organization, or unit directly managing the candidate or the People's Committee of the commune where the candidate resides to verify and respond in writing to the Standing Committee of the Vietnam Fatherland Front Provincial Committee.

Based on the results of the second round of consultations, at least 55 days before the election day, the Standing Committee of the National Assembly adjusts for the second time the structure, composition, and number of people from central and local agencies, organizations, and units introduced as candidates for National Assembly deputies.

Article 48. Third Round of Consultations at the Central Level

Clause 2. The third round of consultations shall base on the standards for National Assembly deputies, the structure, composition, and number of people from central agencies, organizations, and units introduced as candidates for National Assembly deputies already adjusted by the Standing Committee of the National Assembly for the second time, and the results of voter opinions to select and compile a list of individuals meeting the criteria to run for National Assembly deputies.

3. The minutes of the negotiation meeting must clearly record the participants, the number of people attending, the proceedings, and the results of the meeting, and must be immediately sent to the National Election Council and the Standing Committee of the National Assembly.

Clause 2. The third round of consultations shall base on the standards for National Assembly deputies, the structure, composition, and number of people from local agencies, organizations, and units introduced as candidates for National Assembly deputies already adjusted by the Standing Committee of the National Assembly for the second time, and the results of voter opinions to select and compile a list of individuals meeting the criteria to run for National Assembly deputies.

3. The minutes of the consultation meeting must clearly record the composition, number of participants, proceedings, and results of the meeting and be immediately sent to the National Election Council, the Standing Committee of the National Assembly, the Provincial Steering Committee of the Vietnam Fatherland Front, and the Provincial Election Committee.

Section 3

NEGOTIATION, INTRODUCTION OF NOMINEES FOR NATIONAL ASSEMBLY DELEGATES AND ADJUSTMENT OF STRUCTURE,DELEGATES TO THE PEOPLE'S COUNCIL AND STRUCTURE ADJUSTMENT,COMPOSITION AND NUMBER OF PERSONS TO BE NOMINATEDNOMINATION FOR DEPUTY OF THE PEOPLE'S COUNCIL

Article 50. First Consultative Meeting

1. The first consultative meeting at each level shall be organized by the Standing Board of the Vietnam Fatherland Front Committee at the same level no later than 95 days before the election day. The first consultative meeting shall include the Standing Board of the Vietnam Fatherland Front Committee, representatives from the leadership of member organizations of the Front. Representatives from the Election Committee, the Standing Body of the People's Council, and the People's Committee at the same level shall be invited to attend this meeting.

3. At the commune level, the first consultative meeting shall agree on the structure, composition, and number of individuals proposed for candidacy as People's Council deputies by political organizations, socio-political organizations, social organizations, military units, state agencies, public institutions, economic organizations, villages, and residential wards within the territory.

The minutes of the consultative meeting at the provincial level shall be immediately sent to the National Election Council, the Standing Committee of the National Assembly, the Government, the Central Vietnam Fatherland Front Committee, and the Standing Body of the People's Council and the Election Committee at the same level.

The minutes of the consultative meeting at the district and commune levels shall be immediately sent to the Standing Body of the People's Council, the People's Committee, the Vietnam Fatherland Front Committee at the higher level directly, and the Standing Body of the People's Council and the Election Committee at the same level.

Article 51. Adjustment of Structure, Composition, and Number of Individuals Proposed for Candidacy as People's Council Deputies by the Standing Body of the People's Council

2. Based on the results of the first consultative meeting, no later than 90 days before the election day, the Standing Body of the People's Council at the commune level shall adjust the structure, composition, and number of individuals from local agencies, organizations, units, villages, and residential wards proposed for candidacy as People's Council deputies at their own level.

Article 52. Proposal of Individuals from Agencies, Organizations, and Units for Candidacy as People's Council Deputies

On the basis of the results of the first consultative meeting and the adjustments made by the Standing Body of the People's Council, based on the criteria for People's Council deputies, agencies, organizations, units, and villages (for the commune level) allocated the number of individuals proposed for candidacy shall proceed to select and propose candidates for People's Council deputies as follows:

1. The leadership of political organizations, socio-political organizations, and social organizations shall propose individuals from their organization for candidacy as People's Council deputies, and organize meetings of voters where these individuals work to solicit opinions. Based on the opinions of the voter meetings, the leadership of the organization shall convene an expanded Standing Board meeting to discuss and propose individuals from their organization for candidacy as People's Council deputies;

3. Leaders and commanders of military units shall propose individuals from their unit for candidacy as People's Council deputies, and organize meetings of voters where these individuals work to solicit opinions. Based on the opinions of the voter meetings, leaders and commanders of the unit shall convene a meeting including leaders and commanders of the unit, representatives of the trade union committee (if any), representatives of military personnel, and direct subordinates' commanders to discuss and propose individuals from their unit for candidacy as People's Council deputies;

4. The Mass Mobilization Team in villages and residential wards shall propose individuals from the village or residential ward for candidacy as commune-level People's Council deputies and coordinate with village chiefs and residential ward chiefs to organize voter meetings to discuss and propose individuals for candidacy as commune-level People's Council deputies.

The proposal of individuals for candidacy as commune-level People's Council deputies in villages and residential wards shall be guided by the Standing Committee of the National Assembly;

5. The organization of voter meetings as stipulated in this Article shall be carried out according to the provisions of Article 54 of this Law;

6. Agencies, organizations, and units proposing individuals for candidacy as People's Council deputies must transfer the minutes of the voter meetings where the individuals work and the minutes of the expanded leadership meetings of their agency, organization, or unit regarding discussions and proposals of individuals for candidacy as People's Council deputies to the Standing Board of the Vietnam Fatherland Front Committee at the level organizing the consultative meeting.

The Mass Mobilization Team shall transfer the minutes of the voter meetings in villages and residential wards regarding discussions and proposals of individuals for candidacy as commune-level People's Council deputies to the Standing Board of the Vietnam Fatherland Front Committee at the commune level.

Article 53. The Second Consultative Meeting

2. The second consultative meeting shall base on the criteria for People's Council delegates, structure, composition, and the number of persons recommended for candidacy to establish a preliminary list of candidates for People's Council delegates. It shall send the list to voters in their place of residence for their opinions on self-nominated candidates and candidates recommended by organizations and units. For self-nominated candidates and candidates recommended by village associations or residential area associations for communal-level People's Council delegates, it shall also seek the opinions of voters where they work (if applicable). The organization of voter opinion collection shall be conducted in accordance with Article 54 of this Law.

The minutes of the consultative meeting at the provincial level shall be immediately sent to the National Election Council, the Standing Committee of the National Assembly, the Government, the Central Vietnam Fatherland Front Committee, and the Standing Body of the People's Council and the Election Committee at the same level.

The minutes of the consultative meeting at the district and commune levels shall be immediately sent to the Standing Body of the People's Council, the People's Committee, the Vietnam Fatherland Front Committee at the higher level directly, and the Standing Body of the People's Council and the Election Committee at the same level.

Article 54. Voter Meetings

3. Candidates for People's Council delegates, representatives of agencies, organizations, units, villages, and residential area associations that have recommended candidates may be invited to attend these meetings.

4. At the voter meeting, voters shall compare the candidates with the criteria for People's Council delegates, express their trust or lack thereof through raising hands or secret ballot as decided by the meeting.

5. The minutes of the voter meeting to collect opinions on candidates for People's Council delegates must clearly record the composition, number of participants, proceedings, and results of the meeting. Minutes of voter meetings collecting opinions on candidates for People's Council delegates at which level shall be sent to the Standing Board of the Vietnam Fatherland Front Committee at that level to prepare for the third consultative meeting.

6. The Standing Committee of the National Assembly shall provide detailed regulations on organizing voter meetings as stipulated in this Article.

Article 55. Verification and Responses to Matters Raised by Voters Regarding Candidates for People's Council Delegates

1. For matters related to the workplace, the agency, organization, or unit directly managing the candidate for People's Council delegate shall be responsible for verification and providing a written response to the Standing Board of the Vietnam Fatherland Front Committee at the level organizing the consultative meeting.

In cases where the candidate is the head of an agency, organization, or unit, the superior agency, organization, or unit shall be responsible for verification and providing a written response. If there is no direct superior management, the authority issuing the decision to establish the agency, organization, or unit shall be responsible for verification and providing a written response.

2. For matters related to the residential community, the agency, organization, or unit recommending the candidate for People's Council delegate shall be responsible for coordinating with the Commune People's Committee to verify and provide a written response to the Standing Board of the Vietnam Fatherland Front Committee at the level organizing the consultative meeting.

3. For self-nominated candidates for People's Council delegates, the Election Committee shall be responsible for coordinating with the agency, organization, or unit directly managing the candidate or the Commune People's Committee where the candidate resides to verify and provide a written response to the Standing Board of the Vietnam Fatherland Front Committee at the level organizing the consultative meeting.

Article 56. The Third Consultative Meeting

2. The third consultative meeting shall base on the criteria for People's Council delegates, structure, composition, number of persons nominated for candidacy from agencies, organizations, units, and the results of collecting voters' opinions to select and establish a list of persons who meet the criteria for candidacy as People's Council delegates.

The minutes of the consultative meeting at the provincial level shall be immediately sent to the National Election Council, the Standing Committee of the National Assembly, the Government, the Central Vietnam Fatherland Front Committee, and the Standing Body of the People's Council and the Election Committee at the same level.

The minutes of the consultative meeting at the district and commune levels shall be immediately sent to the Standing Body of the People's Council, the People's Committee, the Vietnam Fatherland Front Committee at the higher level directly, and the Standing Body of the People's Council and the Election Committee at the same level.

Section 4

LIST OF CANDIDATES

Article 57. List of Candidates for National Assembly Delegates

3. Based on the list of persons who meet the criteria for candidacy for National Assembly delegate introduced by the Central Vietnam Fatherland Front Committee's Executive Board, the National Election Council shall send to the Provincial Election Council the list and dossier of persons introduced to run for candidacy in their locality.

5. The official list of candidates for National Assembly delegates must clearly state the full name, date of birth, gender, place of origin, place of residence, ethnicity, religion, educational qualifications, profession, position, workplace of the candidate. The list of candidates for National Assembly delegates according to each electoral unit shall be arranged alphabetically by the initials A, B, C...

A candidate for National Assembly delegate may only have their name recorded in the list of candidates for National Assembly delegate in one electoral unit.

6. The number of persons in the list of candidates for National Assembly delegate in each electoral unit must exceed the number of delegates to be elected for that electoral unit by at least two persons. In case of a vacancy due to force majeure, the National Election Council shall examine and decide.

Article 58. List of Candidates for People's Council Delegates

The establishment of the official list of candidates for People's Council delegates shall be carried out according to the provisions set forth in Clause 5 of Article 57 of this Law.

3. The number of persons in the list of candidates for People's Council delegates in each electoral unit must exceed the number of delegates to be elected for that electoral unit; if the electoral unit elects three delegates, the number of persons in the list of candidates must exceed the number of delegates to be elected by at least two persons; if the electoral unit elects four or more delegates, the number of persons in the list of candidates must exceed the number of delegates to be elected by at least three persons. The National Election Council shall provide guidance in cases of vacancies due to force majeure.

At least twenty days before the election day, the Election Board must post the official list of candidates for National Assembly deputies and People's Council representatives in the polling area.

Article 60. Removing Names of Candidates for National Assembly Deputies and People's Council Representatives

1. For individuals listed on the official list of candidates for National Assembly deputies announced by the National Election Council who, at the time of voting commencement, have been indicted as suspects, arrested, detained due to being caught in the act of committing a crime, lost their civil capacity, died, or seriously violated election laws, the National Election Council shall remove such individuals from the list of candidates for National Assembly deputies.

2. For individuals listed on the official list of candidates for People's Council representatives announced by the Election Committee who, at the time of voting commencement, have been indicted as suspects, arrested, detained due to being caught in the act of committing a crime, lost their civil capacity, died, or seriously violated election laws, the Election Committee, after reaching consensus with the Standing Committee of the Vietnam Fatherland Front Committee at the same level, shall decide to remove such individuals from the list of candidates for People's Council representatives.

Article 61. Complaints and Accusations Regarding Candidates and the Establishment of Candidate Lists

1. Citizens have the right to accuse candidates, lodge complaints, make accusations, and propose corrections regarding errors in the establishment of candidate lists. The procedures for lodging complaints, making accusations, and proposing corrections are as follows:

a) Complaints, accusations, and proposals related to candidates for National Assembly deputies and the establishment of the list of candidates for National Assembly deputies should be submitted to the Election Board for National Assembly deputies, the Election Committee at the provincial level, and the National Election Council. If the complainant, accuser, or proposer disagrees with the resolution of the Election Board or the Election Committee, they may appeal to the National Election Council. The decision of the National Election Council is final;

b) Complaints, accusations, and proposals related to candidates for People's Council representatives and the establishment of the list of candidates for People's Council representatives at any level should be submitted to the Election Board for People's Council representatives at that level. If the complainant, accuser, or proposer disagrees with the resolution of the Election Board, they may appeal to the Election Committee at the corresponding level. The decision of the Election Committee is final;

c) The Election Board, Election Committee, and National Election Council must record and resolve complaints, accusations, and proposals received within their jurisdiction.

2. Within ten days before the election day, the National Election Council, the Election Committee, and the Election Board will cease considering and resolving all complaints, accusations, and proposals regarding candidates and the establishment of candidate lists.

In cases where complaints and accusations clearly indicate that a candidate does not meet the qualifications for a National Assembly deputy or a People's Council representative, the National Election Council (for elections of National Assembly deputies) or the Election Committee at the corresponding level (for elections of People's Council representatives) shall decide to remove such individuals from the official list of candidates before the election day and inform voters accordingly.

3. Complaints without the name of the accuser or those falsely made under another person's name will not be considered or resolved.

Chapter VI

ELECTION CAMPAIGNING AND MOTIVATION

Article 62. Responsibilities of agencies and organizations in directing election information, propaganda, and mobilization work

1. The National Election Council directs election information, propaganda, and mobilization work nationwide; election committees at all levels direct the implementation of election information, propaganda, mobilization work, and handle complaints and denunciations regarding election mobilization in their respective localities.

2. Central press agencies have the responsibility to report on the process of organizing election work and the situation of election mobilization nationwide. Local mass media agencies have the responsibility to report on meetings with voters, interviews with candidates for National Assembly deputies and People's Council representatives, and election mobilization activities in their respective localities.

4. State agencies, political organizations, socio-political organizations, social organizations, public service units, economic organizations, people's armed forces units, and local authorities within the scope of their duties and powers shall create conditions for candidates for National Assembly deputies and People's Council deputies to meet with voters in their respective agencies, organizations, units, and localities.

5. Propaganda and mobilization funds are guaranteed from the state budget.

Article 63. Principles of election mobilization

1. Election mobilization is conducted democratically, openly, equally, in accordance with the law, ensuring social order and safety.

2. Candidates for National Assembly deputies and People's Council deputies must conduct election mobilization in the electoral unit where they are candidates.

3. Organizations responsible for elections and members of these organizations may not mobilize for candidates.

Article 64. Time for conducting election mobilization

The time for election mobilization begins on the day the official list of candidates is announced and ends 24 hours before the start of voting.

Article 65. Forms of election mobilization

The election mobilization of candidates is conducted through the following forms:

1. Meeting and contacting voters at voter contact meetings held in the locality where they are candidates, as stipulated in Article 66 of this Law;

2. Through mass media, as stipulated in Article 67 of this Law.

1. The Standing Committee of the Provincial Vietnam Fatherland Front Committee, in conjunction with the People's Committee in the electoral unit, organizes voter contact meetings for candidates for National Assembly deputies and People's Council deputies at the provincial level. Participants in the voter contact meeting include representatives of agencies, organizations, units, and voters in the locality.

The Standing Committees of the Vietnam Fatherland Front Committees at the district and commune levels, in conjunction with the Commune People's Committee in the electoral unit, organize voter contact meetings for candidates for People's Council deputies at their respective levels. Participants in the voter contact meeting include representatives of agencies, organizations, units, and voters in the locality.

The People's Committee organizing the voter contact meeting is responsible for announcing the time and location of the meeting so that voters can attend fully.

2. The program of the voter contact meeting includes the following contents:

a) Stating the reasons;

b) A representative of the Standing Committee of the Vietnam Fatherland Front Committee organizing the voter contact meeting chairs the meeting, introduces and reads a brief biography of the candidate;

c) Each candidate reports to the voters about their program if elected as a National Assembly deputy or People's Council deputy;

d) Voters express their opinions and convey their wishes to the candidates. Candidates and voters exchange views democratically, frankly, and openly on issues of common concern;

đ) The chairperson of the meeting makes concluding remarks.

3. After the voter contact meeting, the Standing Committee of the Provincial Vietnam Fatherland Front Committee prepares a report on the organization of voter contact meetings for candidates for National Assembly deputies and People's Council deputies in the locality, and the opinions of voters on each candidate for National Assembly deputy, and sends it to the National Election Council and the Standing Committee of the Central Vietnam Fatherland Front Committee. The Standing Committees of the Vietnam Fatherland Front Committees at various levels prepare a report on the organization of voter contact meetings for candidates for People's Council deputies in their respective localities and send it to the election committee at the same level and the Standing Committee of the Vietnam Fatherland Front Committee at the immediately higher level.

Article 67. Election Campaigning through Mass Media

1. Candidates for National Assembly representatives shall present to voters their proposed program of action if elected as National Assembly representatives when answering interviews on mass media in the locality where they are candidates and on the online election information page of the National Election Council.

2. Candidates for People's Council representatives shall present to voters their proposed program of action if elected as People's Council representatives when answering interviews on mass media in the locality and on the online election information page of the Election Committee (if any).

3. The National Election Council, Election Committee shall be responsible for directing the management of online information pages to comply with legal provisions regarding the posting of campaign content.

4. The provincial People's Committee shall organize the posting of candidates' programs of action for National Assembly representatives and People's Council representatives on local mass media.

Article 68. Prohibited Conduct in Election Campaigning

1. Exploiting election campaigning to disseminate propaganda contrary to the Constitution and laws or damaging the honor, dignity, reputation, lawful rights, and interests of other organizations and individuals.

2. Misusing positions and powers to use mass media in election campaigns.

3. Exploiting election campaigning to solicit financial support or donations from within and outside the country for oneself or one’s organization.

4. Using or promising to give money, property, or material benefits to entice or buy votes from voters.

Chapter VII

PRINCIPLES AND PROCEDURES FOR VOTING

Article 69. Principles of Voting

1. Each voter has the right to cast one vote for a National Assembly representative and one vote for a People's Council representative corresponding to each level of People's Council.

2. Voters must vote themselves, not entrusting others to vote on their behalf except in cases stipulated in Clause 3 and Clause 4 of this Article; when voting, they must present their voter identification card.

3. If a voter cannot write their ballot themselves, they may ask someone else to write it on their behalf, but the voter must cast the ballot themselves; the person writing the ballot must ensure the secrecy of the voter's ballot. In the case of a voter who, due to disability, cannot cast the ballot themselves, they may ask someone else to cast the ballot into the ballot box.

4. In the case of a voter who is sick, elderly, or disabled and unable to go to the polling station, the Election Team will bring the supplementary ballot box and ballots to the voter's residence or place of treatment so that the voter can receive the ballot and conduct the voting. For voters who are under temporary detention, serving compulsory educational measures, or compulsory drug rehabilitation measures and the detention center, educational facility, or drug rehabilitation facility does not organize a separate voting area, or for voters who are under temporary custody at a temporary custody facility, the Election Team will bring the supplementary ballot box and ballots to the detention center, temporary custody facility, educational facility, or drug rehabilitation facility so that the voter can receive the ballot and conduct the voting.

5. When a voter writes their ballot, no one may look, including members of the Election Team.

6. If a ballot is spoiled, the voter has the right to exchange it for another ballot.

7. After the voter casts their ballot, the Election Team is responsible for stamping "Voted" on the voter identification card.

8. Everyone must follow the rules of the polling station.

Article 70. Announcement of Voting Time and Polling Place

Within ten days before the election day, the Election Committee must regularly inform voters of the election date, polling place, and voting time through posting notices, broadcasting, and other local mass media.

Article 71. Voting Time

1. Voting shall commence from seven o'clock in the morning until seven o'clock in the evening on the same day. Depending on local circumstances, the Election Committee may decide to start voting earlier but not before five o'clock in the morning, or end later but not beyond nine o'clock in the evening on the same day.

2. Prior to voting, the Election Committee must inspect the ballot box in the presence of voters.

3. Voting must be conducted continuously. In case of unexpected events interrupting the voting process, the Election Committee must immediately seal the ballot box and related materials directly related to the election, promptly report to the Election Board, and take necessary measures to ensure that voting can continue.

Article 72. Early Voting and Postponement of Voting Day

In special cases requiring postponement of the voting day or early voting, the Election Committee shall submit for consideration and decision by the National Election Council.

Chapter VIII

ELECTION RESULTS

Section 1

COUNTING OF BALLOTS

Article 73. Counting Ballots

The ballot counting must be conducted in the polling room immediately after the end of the voting session.

Before opening the ballot box, the Election Committee must tally, record, and seal unused ballots, and invite two voters who are not candidates to witness the counting of ballots.

Candidates, representatives of agencies, organizations, units introducing candidates, or persons authorized have the right to witness the counting of ballots and lodge complaints about the counting of ballots. Journalists are allowed to witness the counting of ballots.

Article 74. Invalid Ballots

1. The following ballots are invalid:

a) Ballots not in accordance with the prescribed form issued by the Election Committee;

b) Ballots without the stamp of the Election Committee;

c) Ballots listing more candidates than the number of representatives to be elected for the electoral unit;

d) Ballots with all candidate names crossed out;

đ) Ballots containing additional names outside the list of candidates or ballots with additional content.

2. In cases where ballots are deemed invalid, the Election Committee Chairperson shall present them for the entire committee to review and decide. The Election Committee shall not strike out or amend names listed on the ballots.

Article 75. Complaints and Reports Regarding Ballot Counting

On-site complaints and reports regarding violations of the law during ballot counting received by the Election Committee shall be resolved and recorded in the minutes.

If the Election Committee cannot resolve such complaints and reports, it shall record its opinion in the complaint and report resolution minutes and transfer them to the Election Board.

Article 76. Minutes of the Results of Ballot Counting

1. After completing the ballot counting, the Election Committee must prepare the following types of minutes:

a) Minutes of the results of the election of National Assembly deputies at the polling station;

b) Minutes of the results of the election of provincial People's Council deputies at the polling station;

d) Minutes of the results of the election of commune People's Council deputies at the polling station.

2. The minutes of the results of ballot counting must include the following contents:

b) The number of voters participating in the voting;

b) Number of voters participating in the vote;

d) The number of ballots

d) Number of ballots collected;

f) The number of invalid ballots;

g) The number of votes cast for each candidate;

h) Complaints received, resolved complaints and their resolutions, and complaints transferred to the Election Board for resolution.

h) Received complaints and reports; resolved complaints and reports and their outcomes; complaints and reports transferred to the Election Board.

3. Each type of minute specified in Clause 1 of this Article shall be prepared in three copies, signed by the Chairperson, Secretary of the Election Committee, and two invited voters witnessing the ballot counting. The minutes shall be sent to the corresponding Election Board and the People's Committee, and the Standing Committee of the Vietnam Fatherland Front at the commune level no later than three days after the election day.

Section 2

a) The number of People's Council representatives allocated to the electoral unit;

Article 77. Minutes Determining Election Results at Electoral Units

1. After receiving, checking the minutes of vote counting results from the Election Teams and resolving complaints and denunciations (if any), the Election Board shall prepare minutes determining the election results at its electoral unit.

2. The minutes determining the election results shall include the following contents:

a) The number of National Assembly deputies and People's Council members allocated to the electoral unit;

b) The number of candidates;

e) The number of ballots issued;

d) The number of voters who participated in voting, and the ratio compared to the total number of voters in the electoral unit;

received;

e) The number of ballots received;

h) The number of invalid ballots;

i) The number of votes cast for each candidate;

j) The list of successful candidates;

k) Complaints resolved by the Election Teams; complaints resolved by the Election Board; complaints transferred to the Election Council for resolution.

l) Complaints and denunciations resolved by the Election Teams; complaints and denunciations resolved by the Election Board; complaints and denunciations transferred to the Election Committee, the National Election Council.

3. The minutes determining the election results for National Assembly deputies at the electoral unit shall be prepared in three copies, signed by the Chairperson and Deputy Chairpersons of the Election Board. The minutes shall be sent to the National Election Council, the Election Committee at the provincial level, and the Provincial Vietnam Fatherland Front Committee not later than five days after the election day.

4. The minutes determining the election results for People's Council deputies at the electoral unit shall be prepared in four copies, signed by the Chairperson and Deputy Chairpersons of the Election Board. The minutes shall be sent to the Election Committee at the same level, the Standing Body of the People's Council, the People's Committee, and the Standing Body of the Vietnam Fatherland Front Committee at the same level not later than five days after the election day.

Article 78. Principles for Determining Successful Candidates

1. The election results shall be counted based on valid votes and only recognized when more than half of the total number of voters listed in the voter list at the electoral unit have participated in the election, except in cases provided for in Clause 4 of Article 80 of this Law.

2. A successful candidate must be a candidate who has received more than half of the total valid votes.

3. In case the number of candidates who have received more than half of the total valid votes exceeds the number of representatives that the electoral unit is entitled to elect, the successful candidates will be those with the highest number of votes.

4. In case there are multiple candidates tied for the last position on the list of successful candidates and their number exceeds the number of representatives that the electoral unit is entitled to elect, the older candidate will be the successful candidate.

Section 3

ADDITIONAL ELECTIONS, RE-ELECTIONS

Article 79. Additional Elections

1. In the first election, if the number of successful candidates for National Assembly deputies is less than the number of representatives allocated to the electoral unit, the Election Board must clearly record this in the minutes determining the election results and immediately report to the Election Committee at the provincial level to request the National Election Council to consider and decide on holding an additional election in that electoral unit.

2. In the first election, if the number of successful candidates for People's Council deputies is less than two-thirds of the number of representatives allocated to the electoral unit, the Election Board must clearly record this in the minutes determining the election results and immediately report to the Election Committee responsible for organizing the election of People's Council deputies at that level to decide on the date of the additional election in that electoral unit.

Article 80. Re-election

1. In cases where the number of voters casting ballots in an electoral unit has not reached more than half of the total number of voters listed in the voter list, the Election Board must clearly record this in the minutes and immediately report to the Election Committee responsible for organizing the election of representatives at that level.

2. For the election of National Assembly representatives, the Election Committee at the provincial level shall propose to the National Election Council to consider and decide on re-election in electoral units where the number of voters casting ballots has not reached more than half of the total number of voters listed in the voter list.

3. For the election of People's Council representatives, the Election Committee responsible for organizing the election of People's Council representatives shall decide the date of re-election in electoral units where the number of voters casting ballots has not reached more than half of the total number of voters listed in the voter list after reporting and obtaining the consent of the National Election Council.

Article 81. Annulment of Election Results and Decision on Re-election

1. The National Election Council itself or upon the proposal of the National Assembly Standing Committee, the Government, the Central Vietnam Fatherland Front Committee, and the Provincial Election Committee shall annul the election results in polling stations and electoral units with serious violations of the law and decide the date of re-election in those polling stations and electoral units.

Article 82. Voter List for Additional Elections and Re-elections

The voter list for additional elections and re-elections is established based on the voter list from the first election and in accordance with this Law.

Section 4

SUMMARY OF THE ELECTION

1. After receiving and checking the minutes confirming the election results of National Assembly representatives from the Election Boards and resolving complaints and denunciations (if any), the Provincial Election Committee shall establish the minutes confirming the election results in the locality.

a) Number of electoral units;

b) The number of candidates;

c) Total number of voters in the locality;

d) Number of voters who participated in voting, ratio compared to the total number of voters in the locality;

f) The number of invalid ballots;

g) The number of votes cast for each candidate;

h) Complaints received, resolved complaints and their resolutions, and complaints transferred to the Election Board for resolution.

h) List of successful candidates by each electoral unit;

i) Complaints and denunciations resolved by the Polling Station Organization and the Election Board;

k) Important events that occurred and their resolution results;

l) Complaints and denunciations resolved by the Provincial Election Committee;

m) Complaints, denunciations, and recommendations transferred to the National Election Council.

Article 84. Minutes Summarizing the National Election for Members of the National Assembly

1. After receiving and checking the minutes determining the election results from the Election Committees, the Provincial Election Committee, and resolving complaints and denunciations (if any), the National Election Council shall prepare the minutes summarizing the national election for members of the National Assembly.

2. The minutes summarizing the national election for members of the National Assembly shall include the following contents:

a) The total number of members of the National Assembly elected;

b) The total number of candidates;

c) The total number of voters nationwide;

d) The total number of voters who participated in voting, the ratio compared to the total number of voters nationwide;

f) The number of invalid ballots;

g) The number of votes cast for each candidate;

h) Complaints received, resolved complaints and their resolutions, and complaints transferred to the Election Board for resolution.

h) List of successful candidates by each electoral unit;

i) Important events that occurred and their resolution results;

k) Complaints and denunciations resolved by the National Election Council.

3. The minutes summarizing the national election for members of the National Assembly shall be prepared in five copies, signed by the Chairman and Vice Chairmen of the National Election Council. These minutes shall be sent to the Standing Committee of the National Assembly, the Government, the Central Committee of the Vietnam Fatherland Front, and submitted to the new session of the National Assembly.

Article 85. Minutes Summarizing the Election for Members of the People's Council

1. After receiving and checking the minutes determining the election results from the Election Committees and resolving complaints and denunciations (if any), the Election Committee shall prepare the minutes summarizing the election for members of the People's Council under its responsibility to organize.

2. The minutes summarizing the election for members of the People's Council shall include the following contents:

a) The total number of members of the People's Council elected in the administrative unit;

b) The total number of candidates;

c) The total number of voters in the administrative unit;

d) The total number of voters who participated in voting, the ratio compared to the total number of voters in the administrative unit;

f) The number of invalid ballots;

g) The number of votes cast for each candidate;

h) Complaints received, resolved complaints and their resolutions, and complaints transferred to the Election Board for resolution.

h) List of successful candidates by each electoral unit;

i) Important events that occurred and their resolution results;

k) Complaints and denunciations resolved by the Election Committee.

Article 86. Announcing the Election Results and List of Successful Candidates

2. Based on the minutes summarizing the election, the Election Committee shall announce the election results and list of successful candidates for members of the People's Council at its level no later than 10 days after the election day.

Article 87. Resolving Complaints about the Election Results

Complaints about the election results for members of the People's Council must be sent to the Election Committee no later than 05 days from the date of announcing the election results for members of the People's Council.

The Election Committee shall be responsible for examining and resolving complaints about the election results for members of the People's Council within 20 days from the date of receipt of the complaint.

3. The decision resolving complaints of the National Election Council and the Election Committee is the final decision.

Article 88. Confirmation of the Qualification of Elected Members of the National Assembly and People's Councils

1. Based on the election results for members of the National Assembly, the resolution of complaints and denunciations related to elected members of the National Assembly, the National Election Council shall conduct the confirmation of the qualification of elected members of the National Assembly, issue certificates of membership for the new term of the National Assembly to the elected members, and report to the new term of the National Assembly at its first session about the results of confirming the qualifications of National Assembly members.

2. Based on the election results for members of the People's Councils, the resolution of complaints and denunciations related to elected members of the People's Councils, the Election Committee shall conduct the confirmation of the qualification of elected members of the People's Councils under its responsibility for organizing elections, issue certificates of membership for the new term of the People's Councils to the elected members, and report to the new term of the People's Councils at its first session about the results of confirming the qualifications of People's Council members.

Chapter IX

SUPPLEMENTARY ELECTIONS FOR NATIONAL ASSEMBLY MEMBERS,ĐẠI BIỂU HỘI ĐỒNG NHÂN DÂN

Article 89. Supplementary Elections

1. Supplementary elections for members of the National Assembly during the term may only be conducted when the remaining time of the term exceeds two years and there is a shortage of more than ten percent of the total number of National Assembly members elected at the beginning of the term.

2. Supplementary elections for members of the People's Councils during the term may only be conducted when the remaining time of the term exceeds eighteen months and meet one of the following conditions:

a) The People's Council is short of more than one-third of the total number of People's Council members elected at the beginning of the term;

b) An administrative unit newly established based on the merger, division, or adjustment of the boundaries of existing administrative units does not have enough two-thirds of the number of People's Council members as prescribed by the Law on the Organization of Local Administration.

4. The date of supplementary elections must be a Sunday and be announced no later than thirty days before the election day.

Article 90. Organizations Responsible for Conducting Supplementary Elections

1. The National Assembly establishes a Supplementary Election Council to organize supplementary elections for members of the National Assembly. The Supplementary Election Council consists of five to seven members including the Chairperson, Vice-Chairpersons, and members representing the Standing Committee of the National Assembly, the Government, the Central Committee of the Vietnam Fatherland Front, and other relevant agencies and organizations.

No later than twenty days before the supplementary election day, the Provincial People's Committee, after reaching consensus with the Standing Body of the People's Council and the Standing Committee of the Vietnam Fatherland Front at the same level, decides to establish a Supplementary Election Board in the electoral units where supplementary elections for National Assembly members are needed. The Supplementary Election Board consists of three to five members including the Head, Deputy Heads, and members representing local authorities and the Vietnam Fatherland Front at the local level.

2. For supplementary elections for members of the People's Councils, no later than twenty days before the supplementary election day for People's Council members at a certain level, the People's Committee, after reaching consensus with the Standing Body of the People's Council and the Standing Committee of the Vietnam Fatherland Front at that level, decides to establish a Supplementary Election Committee to organize supplementary elections for People's Council members at their own level, and no later than fifteen days before the supplementary election day, establish a Supplementary Election Board in each electoral unit where supplementary elections for People's Council members are needed. The Supplementary Election Committee consists of three to five members including the Chairperson, Vice-Chairpersons, and members; the Supplementary Election Board consists of three to five members including the Head, Deputy Heads, and members representing state agencies, political organizations, political-social organizations, social organizations, and local voters.

3. No later than fifteen days before the supplementary election day, the Commune People's Committee, after reaching consensus with the Standing Body of the People's Council and the Standing Committee of the Vietnam Fatherland Front at the same level, decides to establish a Supplementary Election Team in each polling area. The Supplementary Election Team consists of nine to eleven members including the Team Leader, Secretary, and members representing state agencies, political organizations, political-social organizations, social organizations, and local voters.

4. Nhiệm vụ, quyền hạn của Hội đồng bầu cử bổ sung, Ủy ban bầu cử bổ sung, Ban bầu cử bổ sung, Tổ bầu cử bổ sung được thực hiện theo các quy định tương ứng của Luật này về nhiệm vụ, quyền hạn của Hội đồng bầu cử quốc gia, Ủy ban bầu cử, Ban bầu cử, Tổ bầu cử.

Điều 91. Danh sách cử tri trong bầu cử bổ sung

Danh sách cử tri trong bầu cử bổ sung do Ủy ban nhân dân cấp xã lập theo quy định tại Chương IV của Luật này và phải được công bố chậm nhất là 15 ngày trước ngày bầu cử bổ sung.

Điều 92. Ứng cử và hiệp thương, giới thiệu người ứng cử trong bầu cử bổ sung

1. Việc ứng cử và hồ sơ ứng cử đại biểu Quốc hội, đại biểu Hội đồng nhân dân trong bầu cử bổ sung được thực hiện theo quy định tại Mục 1 Chương V của Luật này.

Công dân ứng cử đại biểu Quốc hội, đại biểu Hội đồng nhân dân trong bầu cử bổ sung phải nộp hồ sơ ứng cử chậm nhất là 18 ngày trước ngày bầu cử bổ sung.

2. Việc hiệp thương, giới thiệu người ứng cử, lập danh sách người ứng cử đại biểu Quốc hội, ứng cử đại biểu Hội đồng nhân dân trong bầu cử bổ sung được thực hiện theo quy định của Ủy ban thường vụ Quốc hội và phải được hoàn thành chậm nhất là 12 ngày trước ngày bầu cử bổ sung.

3. Danh sách chính thức người ứng cử đại biểu Quốc hội, ứng cử đại biểu Hội đồng nhân dân được công bố chậm nhất là 10 ngày trước ngày bầu cử bổ sung.

Điều 93. Trình tự bầu cử và xác định kết quả trong bầu cử bổ sung

Thể thức bỏ phiếu, trình tự bầu cử và xác định kết quả bầu cử bổ sung được áp dụng theo các quy định tại Chương VII và Chương VIII của Luật này.

Điều 94. Khiếu nại, tố cáo, kiến nghị về bầu cử bổ sung

Khiếu nại, tố cáo, kiến nghị về bầu cử bổ sung và việc giải quyết khiếu nại, tố cáo, kiến nghị được áp dụng theo các quy định tương ứng của Luật này.

Điều 95. Xử lý vi phạm

Người nào dùng thủ đoạn lừa gạt, mua chuộc hoặc cưỡng ép làm trở ngại việc bầu cử, ứng cử của công dân; vi phạm các quy định về vận động bầu cử; người có trách nhiệm trong công tác bầu cử mà giả mạo giấy tờ, gian lận phiếu bầu hoặc dùng thủ đoạn khác để làm sai lệch kết quả bầu cử hoặc vi phạm các quy định khác của pháp luật về bầu cử thì tùy theo tính chất, mức độ vi phạm mà bị xử lý kỷ luật, xử phạt vi phạm hành chính hoặc truy cứu trách nhiệm hình sự.

Trong việc tổ chức bầu cử tại các huyện, quận, phường thực hiện thí điểm không tổ chức Hội đồng nhân dân huyện, quận, phường theo Nghị quyết số 26/2008/QH12 của Quốc hội, Nghị quyết số 724/2009/UBTVQH12 và Nghị quyết số 725/2009/UBTVQH12 của Ủy ban thường vụ Quốc hội, Thường trực Hội đồng nhân dân cấp tỉnh thực hiện nhiệm vụ, quyền hạn của Thường trực Hội đồng nhân dân huyện, quận, phường quy định tại các điều 4, 9 và 51 của Luật này trên cơ sở đề nghị của Ủy ban nhân dân cấp tỉnh, có tham khảo ý kiến của Ủy ban nhân dân huyện, quận, phường có liên quan.

Điều 97. Hiệu lực thi hành

1. Luật này có hiệu lực thi hành từ ngày 01 tháng 9 năm 2015.

2. Luật bầu cử đại biểu Quốc hội năm 1997 đã được sửa đổi, bổ sung một số điều theo Luật số 31/2001/QH10 và Luật số 63/2010/QH12, Luật bầu cử đại biểu Hội đồng nhân dân số 12/2003/QH11 đã được sửa đổi, bổ sung một số điều theo Luật số 63/2010/QH12 hết hiệu lực kể từ ngày Luật này có hiệu lực thi hành.

Điều 98. Quy định chi tiết và hướng dẫn thi hành

1. Ủy ban thường vụ Quốc hội quy định chi tiết các điều, khoản được giao trong Luật.

Luật này đã được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XIII, kỳ họp thứ 9 thông qua ngày 25 tháng 6 năm 2015./.
