CIRCULAR
Regulating the manner of reporting and receiving temporary residence information from foreign nationals in Vietnam
BASED ON THE LAW ON ENTRY, EXIT, TRANSIT AND RESIDENCE OF FOREIGNERS IN VIETNAM No. 47/2014/QH13, AMENDED AND ENHANCED BY LAWS Nos. 51/2019/QH14, 23/2023/QH15, 103/2025/QH15, AND 118/2025/QH15;
BASED ON DECREE No. 02/2025/NĐ-CP OF THE GOVERNMENT REGULATING THE FUNCTION, MISSIONS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF PUBLIC SECURITY, AMENDED BY DECREE No. 11/2025/NĐ-CP OF THE GOVERNMENT;
IN ACCORDANCE WITH THE RECOMMENDATION OF THE DIRECTOR OF THE IMMIGRATION MANAGEMENT BUREAU;
THE MINISTER OF PUBLIC SECURITY ISSUES THIS CIRCULAR REGULATING THE MANNER OF IMPLEMENTING REPORTING AND RECEIVING TEMPORARY RESIDENCE INFORMATION FROM FOREIGN NATIONALS IN VIETNAM.
CHAPTER I GENERAL PROVISIONS
Article 1. Scope of Application
This Circular regulates the manner of reporting and receiving temporary residence information from foreign nationals in Vietnam.
Article 2. Applicability
This Circular applies to foreign nationals residing in Vietnam; accommodation establishments where foreign nationals temporarily reside overnight (hereinafter referred to collectively as accommodation establishments); agencies responsible for managing the residence of foreign nationals and other relevant agencies, organizations, or individuals.
Article 3. Interpretation of Terms
In this Circular, the following terms are understood as follows:
1. The electronic temporary residence reporting system is an electronic information system managed and operated by the Ministry of Public Security to perform the tasks of reporting, receiving, managing, sharing, and utilizing the reported temporary residence information from foreign nationals in Vietnam.
2. The digital accommodation service platform is an information system established on an electronic environment for connecting between the accommodation service provider and the tenant.
3. The temporary resident reporter is the owner of the accommodation establishment, the legal representative of the accommodation establishment, or a person authorized by such entity.
4. The reporting account is an account issued to perform reporting and updating information on the electronic temporary residence reporting system.
Article 4. Principles of Implementation
1. Facilitating foreign nationals, accommodation establishments, and other relevant agencies, organizations, or individuals in performing the tasks of reporting and receiving temporary residence information from foreign nationals in Vietnam.
2. Temporary residence information of foreign nationals must be reported and received promptly, fully, and accurately. In case a foreign national does not have a passport or travel documents or when signs of violation of laws on entry, exit, transit, and residence of foreign nationals in Vietnam are detected, the accommodation establishment shall immediately report to the local police station (police office) or the nearest police station where the accommodation establishment is located (hereinafter referred to collectively as local police); in case of detection within border areas, it must be reported immediately to the local police or the nearest border guard post.
Article 5. Responsibilities for Temporary Residence Reporting
1. Accommodation establishments are responsible for reporting temporary residence information of foreign nationals through an electronic environment or a temporary residence report form. 2. The temporary resident reporter shall perform the task of reporting temporary residence information of foreign nationals, including cases where such reporting is done via the digital accommodation service platform.
Article 5. Obligation to Report Temporary Residence
1. Accommodation establishments shall report temporary residence of foreign nationals through an electronic environment or by means of a Temporary Residence Declaration Form.
2. The person reporting temporary residence shall report the temporary residence of foreign nationals, including cases where such reporting is conducted through a digital platform providing accommodation services.
Chapter II
SPECIFIC PROVISIONS
Section 1
REPORTING AND RECEIVING TEMPORARY RESIDENCE INFORMATION OF
FOREIGNERS THROUGH ELECTRONIC ENVIRONMENT
Article 6. Access electronic temporary residence reporting system to obtain a reporting account
1. The person reporting temporary residence accesses the electronic temporary residence reporting system, provides accommodation information and personal information of the reporter on the system as required by the system to be granted a reporting account. In case there are changes in the relevant account information, the person reporting temporary residence must update such information immediately on the electronic temporary residence reporting system.
2. The person reporting temporary residence is responsible for managing and safeguarding the reporting account and bears responsibility for the information generated by the reporting account. Upon discovering that the reporting account has been exposed or misused, or cannot be used, they must report it immediately to the local police station.
3. A reporting account will be temporarily suspended and a notification sent via email or the registered phone number in the following cases:
a) When no temporary residence information is reported within a period of 12 months;
b) When it is found that the information provided by the reporting account is inaccurate.
4. A reporting account will be restored immediately upon receiving a request from the accommodation provider through the electronic temporary residence reporting system for cases specified in point (a) of paragraph 3, or when all updated and accurate information has been entered into the electronic temporary residence reporting system for cases specified in point (b) of paragraph 3.
Article 7. Reporting Temporary Residence Information
1. The reporting of temporary residence information is conducted through the electronic temporary residence reporting system.
2. The person reporting temporary residence accesses the electronic temporary residence reporting system, logs into their reporting account to report temporary residence information. Such reporting must be done immediately upon a foreigner's arrival at an accommodation facility.
3. The reported temporary residence information includes the following details of foreigners: full name, gender, date, month, and year of birth, nationality, passport or travel document number, duration of temporary residence permit or extension, and anticipated period of stay at the accommodation facility.
Article 8. Receiving Temporary Residence Information
1. The local police station receives temporary residence information of foreigners reported through the electronic temporary residence reporting system 24 hours a day, seven days a week.
2. Border guard stations use accounts provided by competent authorities under the Ministry of Public Security to access and utilize temporary residence information of foreigners at accommodation facilities within border areas and related border regions in accordance with the law, including: local administrative units, tourist services, special economic administrative and commercial units, other economic zones.
3. In cases where border guard stations do not meet the infrastructure conditions required by paragraph 2, the local police station is responsible for immediately reporting the temporary residence information of foreigners to the border guard stations.
Section 2
REPORTING AND RECEIVING TEMPORARY RESIDENCE INFORMATION OF
FOREIGNERS THROUGH REPORTING FORMS
Article 9. Declaration and Transfer of Temporary Residence Registration Form
1. Persons declaring temporary residence have the obligation to fully and accurately record information on the Temporary Residence Registration Form in accordance with the NA17 model issued in Circular No. 04/2015/TT-BCA by the Minister of Public Security, which stipulates the forms related to entry, exit, and residence for foreigners in Vietnam, as amended and supplemented by Circulars No. 57/2020/TT-BCA, No. 22/2023/TT-BCA, and No. 70/2026/TT-BCA; directly transfer the Temporary Residence Registration Form to the local police station within 12 hours for areas in deep or remote regions, within 24 hours from the time of arrival at a place of accommodation.
2. The Temporary Residence Registration Form shall be immediately sent by an appropriate communication method to the local police station before transferring it according to the time limit specified in paragraph 1 of this Article.
Article 10. Receipt of Temporary Residence Registration Form
1. Local police stations receive temporary residence information declared by foreigners through the Temporary Residence Registration Form within 24 hours a day, seven days a week.
2. The local police station shall inspect the Temporary Residence Registration Form; if it is not fully completed, request immediate supplementary declaration, confirm, photocopy, and return the Temporary Residence Registration Form to the person declaring temporary residence.
3. Local police stations shall immediately update the declared temporary residence information of foreigners into the electronic temporary residence reporting system through the account already issued. In case the border guard station or detachment does not have the necessary infrastructure to collect information as specified in paragraph 2 of Article 8, then the local police station is responsible for promptly informing the border guard station or detachment about the declared temporary residence information of foreigners.
4. Where a border guard station or detachment receives temporary residence declarations from foreigners in accordance with international agreements to which Vietnam is a party, such border guard station or detachment shall immediately update the declared temporary residence information of foreigners into the electronic temporary residence reporting system through the account already issued; if infrastructure conditions are not met for updating, they must promptly inform the local police station about the declared temporary residence information of foreigners.
Chapter III
ORGANIZATION OF IMPLEMENTATION
Article 11. Effective Date of Implementation
1. This Circular comes into effect on July 24, 2026.
2. This Circular replaces Circular No. 53/2016/TT-BCA dated December 28, 2016, by the Minister of Public Security, which stipulates the procedures for declaring and receiving temporary residence information from foreigners in Vietnam.
3. In case any legal document referred to in this Circular is amended, supplemented, replaced, or newly issued, the relevant contents concerning this Circular will also be changed according to the amended, supplemented, replaced, or newly issued documents.
Article 12. Enforcement Responsibility
1. The Bureau of Exit-Entry Administration shall be responsible for monitoring, guiding, and inspecting the implementation of this Circular.
2. Heads of units under the Ministry of Public Security, Directors of provincial public security departments, and relevant agencies, organizations, and individuals are responsible for enforcing this Circular./.
