DECREE
Detailed provisions and guidelines for the implementation of certain articles of the Law on Teachers
Based on Decree No. 63/2025/QH15 on Government Organization;
Based on Decree No. 73/2025/QH15 on Teachers;
Based on Resolution No. 248/2025/QH15 of the Fifteenth National Assembly on mechanisms, special policies, and outstanding measures to achieve breakthroughs in education and training development;
In accordance with the proposal of the Minister of Education and Training;
The Government promulgates this Decree to provide detailed provisions and guidelines for the implementation of certain articles of the Law on Teachers.
CHAPTER I
GENERAL PROVISIONS
Article 1. Scope of application
This Decree provides detailed provisions for Articles 12(5); 14(6); 15(4); 16(3); 17(4); 19(4); 20(4); 22(4); 25(4); 27(5); 28(2); 29(3); and 41(2) of the Law on Teachers, and provides guidelines for their implementation.
Article 2. Applicability
This Decree applies to teachers as defined in paragraph 1 of Article 2 of the Law on Teachers No. 73/2025/QH15, state management agencies of education, educational management agencies, national education institutions, and related organizations and individuals.
CHAPTER II
TEACHING RANKS, APPOINTMENT,
AND CHANGE OF TEACHING RANKS TEACHING RANKS
Article 3. Teaching ranks
Teaching ranks in educational institutions include:
1. Various teaching ranks
a) Preschool teachers;
b) Primary school teachers;
c) Junior high school teachers;
d) Senior high school teachers;
e) Pre-university teachers;
f) Continuing education teachers;
g) Lower secondary teachers;
h) Vocational secondary teachers;
i) Secondary vocational teachers.
2. Various lecturer ranks
a) College lecturers: lecturers, senior lecturers, principal lecturers;
b) University lecturers: lecturers, senior lecturers, principal lecturers, associate professors, full professors;
c) Lecturers in training and development: lecturers, senior lecturers, principal lecturers;
d) Political science school lecturers: lecturers, senior lecturers, principal lecturers.
Article 4. Appointment, salary grading, and change of teaching ranks
1. The appointment of teaching ranks and the assignment of salaries for teachers, except as provided in paragraph 2 hereof, shall be carried out upon recruitment, reception, and change of position. A teacher must meet the professional standards of the rank to which they are appointed.
2. Appointment and salary grading for professor and associate professor ranks
a) Teachers who meet the criteria and conditions as stipulated by the Minister of Education and Training shall be appointed as professors or associate professors;
b) Teachers appointed as professors or associate professors shall have their salaries assigned according to the lecturer rank specified in paragraph 2, point b of this Decree.
3. The change of teaching ranks corresponding to a change in position for teachers in public educational institutions is carried out in accordance with the provisions of the civil servant law on changes in position.
4. Private educational institutions shall specify specific procedures and processes for the appointment and change of teaching ranks for teachers under their management, ensuring transparency and openness.
5. The Minister of Education and Training shall provide for the appointment and salary grading of teaching ranks in public educational institutions as provided in Article 3 of this Decree.
6. The Ministers of Public Security and National Defense shall provide for the appointment and salary grading of teaching ranks under their jurisdiction.
Chapter III
RECRUITMENT AND ACCEPTANCE OF TEACHERS
Article 5. Basis and Authority for Recruiting Teachers
1. Basis for recruiting teachers
a) For public education institutions: the recruitment of teachers shall be based on the professional standards corresponding to the teaching position for which recruitment is anticipated, in accordance with relevant provisions of the law concerning civil servants;
b) For private education institutions: the recruitment of teachers shall be based on the professional standards corresponding to the teaching position for which recruitment is anticipated and the organization and operation regulations of the educational institution, ensuring transparency and openness.
2. Authority for recruiting teachers in public vocational education institutions, public higher education institutions, and private education institutions
a) For public vocational education institutions and public higher education institutions, the head of the educational institution shall conduct the recruitment or delegate it to subordinate schools, units directly under its jurisdiction, and member units;
b) For private education institutions, the head of the educational institution shall conduct the recruitment in accordance with the organization and operation regulations of the educational institution.
Article 6. Priority Candidates for Recruitment
1. Priority candidates for recruitment as stipulated in paragraph 3, point a, Article 14 of the Law on Teachers
a) Individuals who have served in teaching and education at the position to be recruited or at different educational levels but with compatible subject areas for a period of not less than three years (36 months), having paid mandatory social insurance according to legal provisions (if not continuous and without receiving one-time social insurance benefits, such periods may be cumulated);
b) Shall receive an additional 5 points in the second round examination or recruitment evaluation.
2. Priority candidates for recruitment as stipulated in paragraph 3, point b, Article 14 of the Law on Teachers
a) Individuals who possess a national vocational skill certificate level IV or higher, or individuals with practical experience in production, business, and services relevant to their teaching subjects for at least three years (36 months), having paid mandatory social insurance according to legal provisions (if not continuous and without receiving one-time social insurance benefits, such periods may be cumulated);
b) Shall receive an additional 5 points in the second round examination or recruitment evaluation.
3. Priority candidates for recruitment as stipulated in paragraph 3, point c, Article 14 of the Law on Teachers and beneficiaries of preferential policies for veterans shall be subject to provisions concerning civil servants and military personnel laws.
4. In cases where a candidate is eligible for multiple priority categories, only the highest priority points will be added to their second round examination or recruitment evaluation score.
Article 7. Recruitment Examination for Teachers
The recruitment examination for teachers shall consist of two rounds as follows:
1. Round 1: A general knowledge test using computer-based multiple-choice questions. The content includes two parts, specifically as follows:
a) Part I: General Knowledge, 60 questions on legal provisions concerning teachers, Party policies and guidelines, education sector laws, and the position to be recruited. Duration of the examination is 60 minutes.
b) Part II: Foreign Language, 30 questions based on the requirements of the teaching position in one of five languages (English, Russian, French, German, Chinese) or a different foreign language as per the teaching position requirements; or a minority ethnic language for positions requiring such. Duration is 30 minutes.
For teaching positions that do not require a foreign language or a minority ethnic language as specified in the job description and competency framework of the position, Part II shall not be administered.
c) The result of Round 1 is determined by the number of correct answers for each part as stipulated in points a and b above; if at least 50% of the questions are answered correctly in each part, the candidate may proceed to Round 2.
d) Exemption from Part II:
Holders of a degree in the relevant foreign language (English, Russian, French, German, Chinese or another foreign language as per the teaching position requirements) at the same educational level or higher than the required professional and vocational education level for the teaching position. For candidates applying to university lecturer positions, the minimum requirement is a bachelor's degree or above in the relevant foreign language;
Holders of a degree at the same educational level or higher than the required professional and vocational education level for the teaching position who have studied abroad or obtained their degrees through foreign language instruction (English, Russian, French, German, Chinese or another foreign language as per the teaching position requirements) in Vietnam, recognized by an authorized body according to legal provisions. For candidates applying to university lecturer positions, the degree must be at least a bachelor's level and meet the requirements of the teaching position;
Holders of a professional qualification where the output standards for foreign languages in the training program as per regulations are equivalent or higher than the required foreign language standard for the teaching position;
Holders of a minority ethnic language certificate for positions directly related to minority ethnic people, or positions working in minority ethnic regions; candidates who are from minority ethnic groups and apply for positions directly related to minority ethnic people, or positions working in minority ethnic regions.
2. Round 2: Evaluation of the candidate's teaching ability through practical pedagogical practice.
a) Examination format: based on the nature, characteristics, and requirements of the teaching position to be recruited, the head of the recruiting authority shall decide on one of three examination formats: oral questioning, practical teaching demonstration, or written test. In case of a written test, it may be conducted in one of three formats: multiple-choice, essay, or a combination of both.
b) Examination content: assessing knowledge and practical teaching skills according to the requirements of the intended position. The examination content for round two must be based on the teacher's professional standards according to the rank and meet the requirements of the intended position. In the same recruitment period, if there are different intended positions requiring different professional standards, the Teacher Recruitment Committee shall organize the construction of different round two examination papers corresponding to the requirements of the intended position;
c) Examination time: oral questioning for 30 minutes (candidates have no more than 15 minutes for preparation, not included in the examination time); written test for 180 minutes (excluding time for copying the question paper); the time for practical teaching shall be decided by the head of the competent authority based on the nature and characteristics of the intended position's professional activities;
d) Scoring scale (oral questioning, practical teaching, written test): 100 points.
Article 8. Teacher Recruitment
Teacher recruitment is conducted in two rounds as follows:
1. Round 1: checking the eligibility criteria at the application form according to the requirements of the intended position. If the candidate meets all the requirements, they may proceed to round 2.
a) The recruitment committee shall verify whether the candidate meets the language or ethnic minority language requirement as stated in their application form. After being selected, the successful candidate must submit copies of their academic credentials and certificates of foreign language or ethnic minority language according to regulations;
b) If the intended position requires a certain level of foreign language or ethnic minority language based on the job description and competency framework, the competent authority shall specify the requirements for academic credentials and certificates of foreign language or ethnic minority language;
c) In cases where candidates are exempt from the foreign language test as stipulated in point d of paragraph 1 of this Decree's Article 7, they are deemed to meet the foreign language or ethnic minority language requirement according to the requirements of the intended position;
d) If candidates do not fall under the exemption category for the foreign language test as stipulated in point d of paragraph 1 of this Decree's Article 7, the recruitment committee shall conduct an assessment to evaluate their foreign language or ethnic minority language competency according to the requirements of the intended position. The assessment shall be conducted in accordance with the provisions of point b of paragraph 1 of this Decree's Article 7.
2. Round 2 is conducted in accordance with the provisions of paragraph 2 of this Decree's Article 7.
Article 9. Recruitment Committee, Procedures, Rules, Determination of Successful Candidates Teacher recruitment procedures for public education institutions are carried out in accordance with the regulations on civil servant recruitment.
2. Private educational institutions conduct teacher recruitment according to their own procedures and rules, and evaluate the competency of applicants through practical teaching as stipulated in paragraph 2 of this Decree's Article 7. The determination of successful candidates is decided by the institution based on its organizational and operational regulations, ensuring transparency and fairness.
3. All work related to setting examination papers and marking examinations must be carried out in accordance with legal confidentiality provisions.

Article 10. Conditions, Procedure, and Procedures for Receiving Teachers in Public Educational Institutions
1. Conditions for Receiving Teachers
a) Conditions for receiving teachers where their appointment is subject to examination: shall be carried out in accordance with the provisions of the law on civil servants;
b) Conditions for receiving teachers who are beneficiaries of policies attracting and valuing talents as stipulated at Point d, Clause 1, Article 15 of this Decree: attainment of the training standards of a teacher according to the level of education and training; voluntary engagement in work at an educational institution located in ethnic minority areas, mountainous regions, border areas, islands, or areas with particularly difficult socio-economic conditions. In cases where teachers are received for work in ethnic minority areas, they must be able to use the language of the ethnic minority;
c) Specific conditions for receiving teachers shall be determined by the ministry, department, province, educational institution at the recruitment and reception plan.
2. Procedure and Procedures for Receiving Teachers
a) Establishment of the Examination Board: the head of the competent authority responsible for recruiting teachers establishes an examination board. The composition of the examination board shall be carried out in accordance with the provisions on the recruitment board for civil servants;
b) The examination board performs the following tasks:
Verification of conditions, standards, diplomas, and certificates of the person being recommended according to the requirements of the intended position. The verification of foreign language and ethnic minority language diplomas, certificates shall be carried out in accordance with the provisions at Clause 1, Article 8 of this Decree.
Organizing an interview or practical teaching assessment to evaluate the ability, professional knowledge, and skills of the person being recommended.
The examination board reports to the head of the competent authority for recruitment on the form and content of the assessment before conducting it.
The examination board operates on a collective principle, making decisions by majority; in case of equal votes, the decision is made according to the opinion of the Chairman who has voted. In cases where an assistant secretary is needed, the examination board decides to establish one when necessary.
The examination board reports to the head of the competent authority for recruitment on the results of the verification and assessment, and dissolves itself after completing its tasks;
c) The head of the competent authority for recruiting teachers issues a decision to receive the teacher and implements policies and benefits for the teacher.
3. The dossier of the person being recommended for recruitment as a teacher shall be carried out in accordance with the provisions of the law on receiving civil servants. In cases where the components of the dossier have already been approved by the competent authority, and information can be fully and accurately accessed from national or specialized data repositories, such information may be utilized to replace the corresponding paper dossier. Where the dossier is not valid; or where information cannot be accessed or the accessed information is incomplete or inaccurate, the competent authority for recruiting teachers requests the individual to supplement and complete the dossier in accordance with the provisions of the law on civil servants; submission, presentation, and certification of copies are carried out in accordance with the provisions of the law on authentication and electronic transactions.
4. The decision to receive a teacher must be updated into the teacher's electronic file according to regulations.
Chapter IV
MOVEMENT, TRANSPORTATION, TEACHING ASSOCIATIONS,
INTER-SCHOOL, EVALUATION OF EDUCATIONAL STAFF
Article 11. Movement of Educational Staff in Public Education Institutions
1. Authority to Transfer
a) The People's Committee at the commune level shall exercise authority to transfer educational staff, including those holding managerial positions within an educational institution, from one public education institution under its jurisdiction to another such institution; and from an educational institution to a local education management agency. b) The Director of the Department of Education and Training shall exercise authority to transfer educational staff, including those holding managerial positions within an educational institution, from one public education institution under his/her jurisdiction to another such institution; from one educational institution to another in two different administrative levels at the commune level; or from a provincial-level public education institution to a provincial-level education management agency.
c) The Minister of National Defense and the Minister of Public Security shall specify the transfer procedures for educational staff within military schools.
d) For cases not falling under points (a), (b), and (c) of this paragraph, the competent authority managing the educational institution shall decide on the authority to transfer educational staff under its jurisdiction.
e) The People's Committee at the provincial level, based on the provisions of this Article, relevant laws, and local realities, shall issue a regulation on transferring educational staff for cases specified in points (a) and (b) of this paragraph. Such regulations shall specify the objects, time limits, timing of transfers, and other related contents that are consistent with local realities.
f) The competent authority exercising transfer authority under point (d) of this paragraph shall specify the objects, time limits, timing of transfers, and other related contents in accordance with local realities.
2. Objects for Transfer
a) Educational staff on excess staffing lists when implementing reorganization of educational institutions or due to changes in class size, subject, major, or profession;
b) Educational staff who wish to be transferred to work in ethnic minority areas, mountainous regions, border areas, islands, and areas with special economic and social difficulties;
c) Educational staff who have completed the time period of their transfer to work in ethnic minority areas, mountainous regions, border areas, islands, or areas with special economic and social difficulties as per a decision by the competent authority;
d) Educational staff with excellent professional knowledge and skills, extensive teaching experience, management experience, ability to support quality improvement at educational institutions, or provide specialized support to education management agencies;
f) Educational staff who are planned for or appointed to managerial positions within an educational institution as part of the arrangement and scheduling of personnel in line with mission requirements or to ensure that no position is held beyond its statutory time limit.
g) Educational staff not falling under objects (a), (b), (c), (d), and (f) who are transferred on a temporary basis by the competent authority to support educational institutions lacking staff or meet specialized needs of education management agencies.
3. Regulations, policies for educational staff during transfer
a) Educational staff holding managerial positions within an educational institution may retain their current position allowance if the new position has a lower allowance than the current one as per legal provisions.
b) Transferred educational staff shall enter into employment contracts with public education institutions. If transferred to an education management agency, they will be assigned to appropriate job positions according to regulations.
c) Regulations and policies for transferred educational staff are determined based on the regulations of the destination institution. If the current benefits are higher, they may be retained as per legal provisions.
d) In addition to points (a), (b), and (c) of this paragraph, transferred educational staff shall enjoy the same benefits and policies for civil servants and any special local or institutional regulations if applicable.
4. Transfer documents, procedures, and processes
a) The transfer document for educational staff includes: notification of intent and quota from the competent authority; proposal from the public education institution or education management agency regarding the need for transfer; personnel file as per civil servant regulations; and any other relevant documentation.
In cases where the personnel files specified in this paragraph have already been approved by a competent authority and information is available in the national database of civil servants, public officials, and civil servants or specialized databases, such information may be utilized to replace corresponding paper documents. If information cannot be accessed or is incomplete/inaccurate, the public education institution or education management agency, as well as the educational staff, shall supplement and complete the file according to regulations.
b) Procedure: The competent authority for transfer announces intent and quota; the public education institution or education management agency with a need for transfer prepares a proposal in accordance with regulations and submits it to the competent authority. Within 30 working days from receipt of a valid application, the competent authority reviews the conditions and criteria for the educational staff according to regulations and issues a decision on their transfer. If they do not agree to the transfer, the competent authority shall respond in writing to the public education institution or education management agency with reasons.
c) When transferring educational staff to assume managerial positions within an educational institution, the appointment process for external sources shall be followed.
d) The decision on transferring educational staff must be updated in their electronic personnel file according to regulations.

Article 12. Transfer of Teachers in Public Educational Institutions
1. Scope and Principles of Transfer
a) Scope of transfer: teachers who are willing to be transferred from teaching positions or managerial roles at public educational institutions;
b) Principles of transfer: the transfer of teachers shall be carried out when the teacher has a need for such, must obtain the consent of the receiving and transferring educational institution, agency, or unit, and is in line with the actual conditions of the position and work of the receiving and transferring educational institution, agency, or unit; it shall comply with guidelines and regulations on transfer issued by competent authorities.
2. Authority to Transfer Teachers
a) The head of the People's Committee at the commune level shall carry out transfers for teachers and managers from one public educational institution to another within its jurisdiction;
c) The head of a vocational education institution or a public higher education institution shall issue regulations on transfer of teachers and carry out transfers within its authority;
d) The Minister of National Defense and the Minister of Public Security shall specify the procedures for transferring teachers in military schools;
e) For cases not covered by points (a), (b), (c), and (d) of this paragraph, the competent authority managing the educational institution decides on the transfer of teachers;
f) The People's Committee at the provincial level shall formulate regulations on teacher transfers based on this provision, relevant laws, and local conditions to organize the implementation of teacher transfers for cases specified in points (a) and (b) of this paragraph. These regulations shall specify the scope of transfer, timing, and other related matters consistent with actual conditions.
3. Procedures, Sequence, and Process for Teacher Transfer
a) Application for transfer: application form signed by the head of the educational institution (Form No. 01 attached to this Decree); consent letter from the transferring educational institution or agency; acceptance letter from the receiving educational institution or agency; personnel file in accordance with laws on civil servants; and other relevant documents if applicable.
In cases where the teacher's personnel file as specified above has been approved by a competent authority and information is available in the national database of civil servants, public officials, and civil servants or specialized databases, such information may be utilized to replace corresponding paper documents. If such information cannot be accessed or is incomplete/inaccurate, the public educational institution or education management agency, as well as the teacher, shall ensure that the file is supplemented and completed in accordance with regulations;
b) For cases within the authority of the agencies specified in points (a) and (b) of paragraph 2, teachers shall submit one copy of the application documents as per point (a) of this paragraph either online through the National E-Government Portal or via postal service or directly to the Administrative Service Center of the competent authority;
c) For cases within the authority of the agencies specified in points (c) and (d) of paragraph 2, the submission of applications is carried out directly at the educational institution or through the information system or e-government portal of the educational institution if available;
d) Within 30 working days from receipt of a complete application, the competent authority shall review the application in accordance with regulations and issue a decision on teacher transfer. If the transfer is not approved, the competent authority shall provide written notification to the teacher along with reasons for rejection;
f) The decision on teacher transfer must be updated in the electronic file of the teacher as per regulations;
g) The procedures and processes for teacher transfers are carried out in accordance with this provision. Competent authorities ensure transparency, openness, and consistency with actual conditions when implementing teacher transfers.
Article 13. Teaching at Multiple Schools or Levels for Teachers in Public Educational Institutions
1. Principle of Assigning Teachers to Teach at Multiple Schools or Levels
a) The assignment of teachers to teach at multiple schools or levels shall be carried out based on the examination of the geographical and practical conditions, as well as the opinions of the head of the educational institution with authority over teacher management and the educational institution where the teacher is assigned to teach at multiple schools or levels;
b) The educational institution with authority over teacher management and the educational institution where the teacher is assigned to teach at multiple schools or levels shall cooperate, create conditions regarding time, and arrange other tasks appropriately so that the teacher can complete teaching duties at multiple schools or levels.
2. Authority and Procedure for Assigning Teachers to Teach at Multiple Schools or Levels
a) For educational institutions under the management authority of the People's Committee at the commune level and the Department of Education and Training: based on teaching needs, the educational institution that requires teachers to teach at multiple schools or levels shall cooperate with the educational institution managing teachers to develop and unify the plan for assigning teachers to teach at multiple schools or levels. This plan should be reported to the People's Committee at the commune level or the Department of Education and Training for a decision;
b) For higher education institutions, vocational education institutions with multiple levels of study, training degrees, affiliated schools, subordinate units, and member units: the head of the educational institution decides on the assignment or delegates the authority to decide on assigning teachers to teach at multiple schools or levels based on proposals and agreements from affiliated schools, subordinate units, and member units;
c) The Minister of National Defense and the Minister of Public Security shall specify teaching at multiple schools or levels for teachers in educational institutions under their management (if applicable);
d) Decisions assigning teachers to teach at multiple schools or levels must clearly define the time and volume of teaching, responsibilities for cooperation between educational institutions, and be updated into the teacher's electronic file according to regulations.
3. Regulations and Policies for Teachers Teaching at Multiple Schools or Levels
a) The number of lessons taught or hours worked by teachers under the working system is the total number of lessons taught or hours worked in various educational institutions, levels of study, and training degrees where the teacher is assigned to teach at multiple schools or levels;
b) The evaluation of teachers teaching at multiple schools or levels shall be conducted by the head of the educational institution with authority over teacher management based on comments regarding the extent to which the head of the educational institution where the teacher teaches at multiple schools or levels has fulfilled their duties according to the assignment;
c) Salaries and other salary benefits for teachers teaching at multiple schools or levels are paid by the educational institution with authority over teacher management. Additional overtime pay (if applicable) and mobility allowances, as well as other expenses if any, shall be implemented in accordance with relevant laws. The implementation costs of policies under this point during the time when teachers are assigned to teach at multiple schools or levels are guaranteed by the state budget.
Article 14. Evaluation of Teachers According to Professional Standards
1. Evaluation of Teachers According to Professional Standards
a) The content of evaluating teachers in public and private educational institutions according to professional standards includes: teacher ethics and adherence to teacher conduct codes; level of education, training, and refresher courses; professional competence and expertise as required by the position held;
b) The results of evaluating teachers under point a of this clause shall serve as the basis for evaluating teachers in accordance with Article 22 of the Law on Teachers.
2. Criteria for Ranking Teacher Quality
a) For teachers in public educational institutions: meet the common criteria for evaluating and ranking civil servants, as well as the criteria for ranking civil servants under relevant laws;
3. Procedures, formalities for evaluating, ranking, and using the results of teacher evaluations in public educational institutions are carried out in accordance with laws on civil servants and related laws; procedures, formalities for evaluating, ranking, and using the results of teacher evaluations in private educational institutions are implemented according to the quality assessment regulations issued by the educational institution.
3. The procedures, processes for evaluating, categorizing, and the utilization of evaluation results for teachers in public educational institutions are conducted in accordance with laws concerning civil servants and related laws; the procedures, processes for evaluating, categorizing, and the utilization of evaluation results for teachers in non-public educational institutions are carried out in accordance with the teacher evaluation regulations established by such institutions.
Chapter V
POLICY ON ATTRACTION AND PREMIUM TREATMENT FOR TEACHERS,
RETIREMENT BENEFITS FOR TEACHERS AT AN ADVANCED AGE
Article 15. Subjects Eligible for Policy on Attraction and Premium Treatment for Teachers
1. The subjects eligible for the policy on attraction and premium treatment for teachers as provided in paragraph 1 of Article 25 of the Law on Teachers include:
a) Individuals with talent as defined in Article 4 of Decree No. 179/2024/NĐ-CP dated December 31, 2024 by the Government on policies for attracting and premium treating individuals with talent working in Party, State, Vietnam Fatherland Front, and political-social organizations;
b) Professors or associate professors, or those recognized as meeting the standards of professorial or associate professorial rank;
c) Individuals achieving high-level national or international achievements in cultural, artistic, sports, traditional industries, and professions;
d) National Artists, National Actors, National Physicians, People's Artists, People's Actors, People's Physicians; individuals with a national vocational skill certificate level 4 or above, or those who have received outstanding skill certificates, first, second, or third place prizes in regional or international skill competitions;
d) Individuals working in ethnic minority areas, mountainous regions, border areas, islands, and areas with special difficult economic and social conditions;
e) Teachers engaged in teaching, education, and scientific research in key fields to meet the needs of economic and social development;
g) Teachers teaching subjects that are difficult to recruit students for but have societal demand; specialized fields in arts, sports, medicine, national defense, and security.
2. Based on the provisions of paragraph 1 of this Article and taking into account goals, strategies, and actual conditions, localities and educational institutions shall specifically determine the subjects eligible for the policy on attraction and premium treatment for teachers at different stages as appropriate.
Article 16. Policy on Attraction and Premium Treatment for Teachers
1. The policies and standards, conditions for enjoying the policy on attraction and premium treatment for teachers as provided in points a, b, c, d, e, and g of paragraph 1 of this Decree shall be implemented according to the provisions of Decree No. 179/2024/NĐ-CP.
2. The policies and standards, conditions for enjoying the policy on attraction and premium treatment for teachers as provided in point d of paragraph 1 of this Decree:
a) Shall be recruited through the method of receiving teachers without requiring compliance with the working period conditions stipulated by the law on recruitment of civil servants;
b) Shall enjoy policies applicable to cadres, public officials, civil servants, and employees in the armed forces working in areas with special difficult economic and social conditions as per regulations.
3. In addition to the policies provided in paragraphs 1 and 2 of this Article, subjects eligible for the policy on attraction and premium treatment for teachers shall also enjoy other policies and benefits according to local regulations, educational institution regulations, and relevant legal provisions.
Article 17. Summer Vacation for Teachers
1. Teacher's Summer Vacation
a) The annual summer vacation of teachers in preschool education institutions, primary and secondary education institutions, specialized schools is 8 weeks, including annual leave;
b) The minimum annual summer vacation of teachers in continuing education institutions is 4 weeks, with a maximum of 8 weeks, including annual leave;
c) The annual summer vacation of teachers in preparatory university schools is 8 weeks, including annual leave;
d) The annual summer vacation of teachers teaching vocational education programs, secondary vocational and higher vocational levels is 6 weeks; for those teaching primary level is 4 weeks, including annual leave;
d) The annual summer vacation of teachers in higher education institutions, political schools, and training and development institutions shall be implemented according to the organizational and operational regulations of such educational institutions;
e) In cases of emergency or urgent situations for disaster prevention and control or epidemic prevention, as well as critical circumstances, the duration of teacher's summer vacation as provided in points a and b of this paragraph is decided by the Minister of Education and Training according to his authority; the duration of teacher's summer vacation as provided in points c, d, and e of this paragraph is decided by the head of the educational institution;
g) During the summer vacation period, teachers shall be paid their full salary and allowances as per regulations.
2. In addition to the summer vacation time specified in paragraph 1 of this Article, teachers may take holidays for festivals and other days off according to the Labor Law.
3. Based on the academic year schedule issued by the Ministry of Education and Training and specific conditions of the locality, the People's Committee Chairperson at the provincial level decides the summer vacation period for teachers in preschool education institutions, primary and secondary education institutions, continuing education institutions, and specialized schools within their jurisdiction.
4. Based on the provisions of points c, d, and e of paragraph 1 of this Article, heads of higher education institutions, vocational education institutions, vocational training centers, preparatory university schools, political schools, and training and development institutions decide the summer vacation period for teachers in accordance with the training schedule and specific conditions of each educational institution.
5. The summer vacation of teachers in educational institutions under the Ministry of National Defense and Ministry of Public Security shall be implemented according to regulations by the Minister of National Defense and Minister of Public Security, respectively.
Article 18. Procedure and Process for Retirement at an Advanced Age
1. Annually, public educational institutions shall, based on development orientation, human resource conditions of the organization, and job position requirements, announce their intention and need to utilize retired teachers at an advanced age.
2. Application Documents for Retirement at an Advanced Age
a) Application Form for Retirement at an Advanced Age (in accordance with Model No. 02 attached hereto);
b) Teacher's file in accordance with the law on civil servants;
c) Documentation and evidence meeting the conditions for retirement at an advanced age.
3. Teachers who meet the specified conditions shall submit one copy of their application documents directly to the public educational institution or online through its information system or e-government portal (if available) at least six months before their intended retirement date.
Within thirty working days from receipt of a complete and valid application, the public educational institution shall examine and evaluate the teacher's conditions for advanced age retirement, as well as the institution’s intentions and needs, to determine whether to approve the retirement at an advanced age, the time frame for such retirement, and on a case-by-case basis.
In cases where extended working hours are not agreed upon, the public educational institution shall respond in writing to the teacher, specifying the reasons.
4. The decision regarding retirement at an advanced age for teachers shall be communicated to relevant organizations or individuals at least three months before their intended retirement date and updated in the electronic file of the teacher according to regulations.
5. Based on the decision regarding retirement at an advanced age, public educational institutions shall enter into a written agreement or supplementary contract with teachers concerning the terms and conditions applicable under relevant laws.
Article 19. Retirement at an Advanced Age for Teachers in Specialized Fields
1. For teachers working in specialized fields within the healthcare, culture, arts, physical education, and sports sectors, those without a professor or associate professor title but with appropriate professional expertise may be eligible for retirement benefits at an advanced age.
2. The time frame for retirement at an advanced age for teachers in specialized fields within the healthcare, culture, arts, physical education, and sports sectors shall not exceed five years.
3. The Minister of Health and the Minister of Culture, Sports and Tourism shall specify detailed requirements regarding the target group, standards, and conditions for teachers eligible for retirement benefits at an advanced age as provided in this Article.
Chapter VI
QUALIFICATIONS OF TEACHERS,
TRAINING AND DEVELOPMENT FOR TEACHERS
Article 20. Qualifications of Teachers Trained to Standard
1. The qualifications of teachers trained to standard shall be implemented in accordance with the provisions of paragraph 1 of Article 28 of the Law on Teachers, except as provided in paragraphs 2, 3, 4, 5, 6, and 7 of this article.
2. For teachers teaching Art, Music, Fine Arts (Music, Art), Foreign Language at primary level, Computer Science and Technology in general education institutions, vocational education institutions, specialized schools: they shall have a college degree or higher in teacher training programs relevant to the specific subject or a college degree or higher in relevant fields of study with a certificate of pedagogical training for teachers corresponding to the grade level taught according to regulations.
3. Qualifications of Teachers Trained to Standard Teaching Minority Ethnic Languages at Higher Education Institutions
Teachers teaching minority ethnic languages at higher education institutions shall meet one of the following requirements:
a) Hold a bachelor's degree or higher in teacher training programs for minority ethnic languages relevant to the subject taught;
b) Hold a master's degree or higher in teacher training programs and have a certificate of minority ethnic language proficiency corresponding to the teaching program issued by the Ministry of Education and Training;
c) Hold a bachelor's degree or higher in language studies for minority ethnic languages relevant to the subject taught;
d) Hold a bachelor's degree or higher in teacher training programs or cultural studies on minority ethnic groups in Vietnam and be from a minority ethnic group, able to use the corresponding minority ethnic language.
4. Qualifications of Teachers Trained to Standard Teaching Minority Ethnic Languages at General Education Institutions, Vocational Education, Continuing Education, Higher Normal Colleges, Specialized Schools
Teachers teaching minority ethnic languages in general education institutions, vocational education, continuing education, higher normal colleges, and specialized schools shall meet one of the following requirements:
a) Hold a college degree or higher in teacher training programs for minority ethnic languages relevant to the subject taught;
b) Hold a college degree or higher in language studies for minority ethnic languages relevant to the subject taught and have a certificate of pedagogical competence, professional capability for teachers corresponding to the grade level and educational level;
c) Hold a college degree or higher in teacher training programs for minority ethnic languages other than the subject taught or language studies for minority ethnic languages other than the subject taught or cultural studies on minority ethnic groups in Vietnam and have a certificate of minority ethnic language proficiency corresponding to the teaching program issued by the Ministry of Education and Training. In cases where there is no college degree or higher in teacher training programs, they must have a certificate of pedagogical competence, professional capability for teachers corresponding to the grade level and educational level;
d) Hold a bachelor's degree or higher in teacher training programs and have a certificate of minority ethnic language proficiency corresponding to the teaching program issued by the Ministry of Education and Training;
d) Hold a college degree or higher in teacher training programs or cultural studies on minority ethnic groups in Vietnam and be from a minority ethnic group, able to use the corresponding minority ethnic language. In cases where there is no college degree or higher in teacher training programs, they must have a certificate of pedagogical competence, professional capability for teachers corresponding to the grade level and educational level.
5. The professional standard of teachers teaching national defense and security education in higher education institutions, vocational education institutions shall be carried out in accordance with the provisions of the Law on National Defense and Security Education.
6. The professional standard of teachers performing training and retraining tasks at state agency schools or political organizations: shall have a bachelor's degree or above that is relevant to their position, specialty, and teaching subject.
7. The professional standard of teachers teaching specialized fields in health, culture, arts, physical education, and sports shall be carried out in accordance with the provisions of the Minister of Health and the Minister of Culture, Sports, and Tourism.
8. In cases provided for in paragraph 2; points a, c, and d of paragraph 3; points a, b, c, and d of paragraph 4 of this Article, after being recruited, teachers shall participate in training to meet the corresponding professional standard as stipulated in paragraph 1 of Article 28 of the Teachers' Law according to the local plan and educational institution's schedule.
Article 21. Training and Professional Development of Teachers
1. Training to Meet Professional Standards, Advanced Training for Teachers
a) The training to meet professional standards shall be carried out in accordance with the government's program;
2. Professional Competency Training
a) The professional competency training program shall be developed and issued corresponding to the teacher's position specified in Article 3 of this Decree;
3. Training According to Standards, Positions, Leadership and Management Functions
a) Teachers in public educational institutions shall be planned and appointed to management positions at the institution according to the civil servant law and the training programs specified in point c of this paragraph;
4. Continuous Training
a) The continuous training programs shall be conducted annually for teachers to update knowledge and skills to serve professional activities, meet the requirements of their corresponding teaching position;
a) Teachers in public educational institutions shall be planned and appointed to managerial positions at educational institutions according to the training program based on standards, job titles, and leadership positions as stipulated in laws concerning civil servants and the training programs specified in this clause;
b) Teachers in non-public educational institutions shall be planned and appointed to managerial positions at educational institutions according to the organizational and operational regulations of such institutions and the training programs specified in this clause;
c) The training program for managerial education administration is implemented for teachers who are planned and appointed to leadership, management roles within national education system institutions; the maximum duration for implementing the training program is one week.
4. Ongoing Training
a) The ongoing training program is conducted annually for teachers to update knowledge and skills to serve professional activities, meeting the requirements of corresponding teaching positions;
b) The maximum duration for implementing the ongoing training program each academic year is three weeks.
Article 22. Authority to Manage Training and Education Programs for Teachers
1. The Minister of Education and Training shall formulate, promulgate, and guide the organization of teacher professional standards training programs, continuous teacher education programs according to the teaching ranks specified in Clause 3 of this Decree, as well as management education training programs for teachers except as provided in Paragraph 2 of this Article.
2. The Minister of Public Security, the Minister of National Defense shall formulate, promulgate, and manage training programs for teachers under their respective authority.
Article 23. Funding for Teacher Training and Education
1. Funding for teacher training and education is as follows:
a) The State supports funding for training and education specified in Clause 21 of this Decree according to the approved planning, program, and schedule by an authorized body, consistent with the provisions on budgetary decentralization. The funding source shall be projected within the educational sector's budget.
b) Encourage educational institutions to use the Development Fund for Educational Activities and other lawful income sources to support funding for advanced training and continuous education of teachers;
c) Encourage organizations and individuals to provide funding for teacher training and education activities in accordance with legal provisions;
d) Teachers shall bear their own costs for programs of study according to personal needs not included in the approved training and education program of the agency or unit.
2. Terms, policies, and responsibilities of teachers when dispatched for training and education:
a) Teachers dispatched for training and education are entitled to retain their salary, allowances (if applicable), and other terms and conditions as per current regulations. The time spent in training and education is counted towards continuous service;
b) Teachers dispatched with State funding or educational institution financial resources who leave the program, resign, or fail to serve the committed period must compensate for the training and education costs according to the Government's regulations on cadre, civil servant, and staff training.
Chapter VII
CONDITIONS OF IMPLEMENTATION
Article 24. Effective Date of Implementation
1. This Decree shall come into effect from the date of promulgation, except as provided in Paragraphs 2 and 3 of this Article.
2. The evaluation of the level of completion of professional standards corresponding to teaching ranks specified in Clause 3 of this Decree will be conducted starting from the 2026-2027 academic year.
3. Continuous education according to standards, positions, and leadership or management roles as provided in Paragraph 3 of Clause 21 of this Decree shall be implemented for teachers who are planned and appointed to hold leadership or management positions in educational institutions from the date this Decree comes into effect. The person appointed to a leadership or management position is responsible for completing the training within 24 months from the date of decision by an authorized body.
Article 25. Transitional Provisions
1. Where approval has been granted by an authorized body for recruitment, teacher reception, and professional rank evaluation plans before June 30, 2026, these plans may continue to be implemented until December 31, 2026. The standards for professional ranks, promotion of professional ranks, teaching standards, professional knowledge, and skills shall be implemented according to the regulations issued by the Minister of Education and Training and the Minister of Labor, Invalids, and Social Affairs.
2. Where teachers have been transferred, reassigned, or assigned to teach across multiple schools since January 1, 2026, they may continue to implement decisions already issued by an authorized body from January 1, 2026, and shall enjoy the terms and conditions as provided in this Decree.
3. Where teachers meet all criteria for retirement at a higher age between April 1, 2026, and June 30, 2026, but have not yet notified of their intention to retire at an advanced age, the competent authority under delegated management shall issue a decision extending the teacher's service period from the date this Decree comes into effect.
4. Until new guidance on salary grading by position is issued by the competent authority, the ranking and grading for teaching positions specified in Clause 3 of this Decree shall be conducted according to the instructions provided by the Minister of Education and Training.
Article 26. Implementation Responsibility
The Minister, Head of a Ministry-level Agency, Head of an Agency under the Government, Chairperson of People's Committees of Provinces and Municipalities Directly Under Central Authority, Head of Educational Management and Training Agency, and using entity for teachers shall bear responsibility for implementing this Decree.
