Amending and supplementing certain articles of the Regulations on the organization of training, retraining, and issuing certificates for ethnic minority languages promulgated together with Circular No. 09/2023/TT-BGDĐT dated April 18, 2023 of the Minister of Education and Training

Pursuant to the Education Law No. 43/2019/QH14 amended and supplemented by Law No. 123/2025/QH15;

Pursuant to Decree No. 37/2025/NĐ-CP dated February 26, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 82/2010/NĐ-CP dated July 15, 2010 of the Government stipulating the teaching and learning of ethnic minority languages in general education institutions and regular education centers; Decree No. 96/2025/NĐ-CP dated April 29, 2025 of the Government amending and supplementing certain articles of Decree No. 82/2010/NĐ-CP dated July 15, 2010 of the Government stipulating the teaching and learning of ethnic minority languages in general education institutions and regular education centers;

Pursuant to Directive No. 38/2004/CT-TTg dated November 9, 2004 of the Prime Minister on accelerating the training and retraining of ethnic minority languages for cadres and civil servants working in ethnic minority and mountainous regions;

Pursuant to Decision No. 1753/QĐ-BGDĐT dated June 27, 2025 of the Minister of Education and Training approving the plan to cut and simplify seven administrative procedures related to production and business activities within the scope and functions of management of the Ministry of Education and Training;

At the proposal of the Director of the Department of Teachers and Educational Management;

The Minister of Education and Training issues this Circular amending and supplementing certain articles of the Regulations on the organization of training, retraining, and issuing certificates for ethnic minority languages promulgated together with Circular No. 09/2023/TT-BGDĐT dated April 18, 2023 of the Minister of Education and Training.

Article 1. Amending and supplementing Article 1

"1. This Circular stipulates the organization of training, retraining, and issuing certificates for ethnic minority languages according to the training and retraining programs for ethnic minority languages issued by the Ministry of Education and Training.

2. These provisions apply to higher education institutions, colleges, and regular education centers, vocational education and regular education centers that organize training and retraining of ethnic minority languages (hereinafter referred to collectively as training and retraining institutions for ethnic minority languages); Departments of Education and Training, organizations, and individuals related thereto."

Article 2. Supplementing Clause 5, Clause 6 to Article 2

"5. The training and issuance of certificates for teachers of ethnic minority languages shall be carried out by higher education institutions and colleges with teacher training programs.

6. The retraining and issuance of certificates for ethnic minority languages shall be carried out by higher education institutions, colleges, and regular education centers, vocational education and regular education centers."

Article 3. Amending and supplementing some points and clauses of Article 3

1. Amending and supplementing Point a Clause 1 as follows:

"a) The standard qualification level of lecturers teaching ethnic minority languages at higher education institutions and colleges shall be implemented in accordance with the regulations of the Government."

2. Amending and supplementing Point b Clause 1 as follows:

"b) Teaching materials for training and retraining shall be developed based on the Program of the Ministry of Education and Training."

3. Amending and supplementing Point a Clause 2 as follows:

"a) The standard qualification level of teachers teaching ethnic minority languages at regular education centers, vocational education and regular education centers shall be implemented in accordance with the regulations of the Government."

4. Amending and supplementing Point b Clause 2 as follows:

"b) Retraining materials shall be developed based on the Program of the Ministry of Education and Training and approved by the competent authority."

Article 4. Amending and supplementing some points and clauses of Article 5

1. Amending and supplementing Point b Clause 1 as follows:

"b) Admissions for the retraining program in ethnic minority languages: Vietnamese citizens who have a need to learn ethnic minority languages; cadres, civil servants, public officials, and officers and soldiers in the police and military forces working in ethnic minority and mountainous regions."

2. Amending and supplementing Clause 3 as follows:

"3. Examination and evaluation: Training and retraining institutions for ethnic minority languages shall organize regular and periodic examinations to evaluate the learning process of students; each module (approximately 30-45 hours) must have a regular examination and a periodic examination, which are detailed in the teaching materials for training and retraining."

3. Amending and supplementing Point b Clause 4 as follows:

"b) The final exam will cover knowledge and skills as prescribed in the training and retraining programs for ethnic minority languages issued by the Ministry of Education and Training. The duration of the final exam for the teacher training program is 120 minutes, and for the retraining program is 90 minutes for the four skills of listening, speaking, reading, and writing."

4. Amending and supplementing Point c Clause 4 as follows:

"c) Higher education institutions and colleges organizing training and retraining of ethnic minority languages shall be responsible for organizing the final exam for students. Departments of Education and Training shall take the lead or entrust training and retraining institutions with sufficient conditions to organize the final exam for students studying the retraining program in ethnic minority languages at regular education centers, vocational education and regular education centers under their jurisdiction."

Article 5. Amending and supplementing Point b Clause 3 of Article 7

"b) Higher education institutions and colleges with the necessary conditions for training and retraining shall independently manage and issue certificates for teachers of ethnic minority languages and ethnic minority language certificates for students who have completed the corresponding training and retraining programs."

Article 6. Amending and supplementing Article 8

"Article 8. Departments of Education and Training

1. Advise provincial People's Committees: Select ethnic minority languages needed for training and retraining in the locality; inspect the retraining work of ethnic minority languages at training and retraining institutions under their jurisdiction.

2. Take the lead and coordinate with higher education institutions and colleges to advise provincial People's Committees to develop plans for training and retraining ethnic minority language teachers; retrain ethnic minority languages for educational management staff and teachers of other subjects to meet local needs.

3. Lead the review and approval of materials, manage the organization of retraining ethnic minority languages at regular education centers, vocational education and regular education centers in the area; organize the compilation of materials, organize exams or entrust training and retraining institutions with sufficient conditions to implement; issue certificates for retraining ethnic minority languages in accordance with current regulations on the management of diplomas and certificates of the national education system."

Article 7. Amending and supplementing Article 9

"Article 9. Training and improving ethnic minority languages

1. Higher education institutions, college

- Based on the training and improvement program for ethnic minority languages issued by the Ministry of Education and Training, organize the compilation, examination, and approval of materials, develop enrollment plans, and organize improvement activities;

- Publicize information about the enrollment plan and quality assurance conditions as prescribed on the educational institution's website or other appropriate forms; report to the supervising authority and the Ministry of Education and Training before implementing.

- Organize examinations and issue certificates according to current regulations on the management of diplomas and certificates within the national education system.

2. Continuing education centers, vocational education and continuing education centers

- Based on approved materials, develop enrollment plans and organize improvement activities;

- Publicize information about the enrollment plan and quality assurance conditions as prescribed on the educational institution's website or other appropriate forms; report to the supervising authority before implementing."

Article 8. Amending and supplementing Clause 2 of Article 11

"2. Higher education institutions, colleges, and Departments of Education and Training shall report the results of training, improvement, and issuing certificates for ethnic minority languages to the Ministry of Education and Training before December 30 each year."

Article 9. Abolishing certain points, clauses, and articles of the Regulation on the organization of training, improvement, and issuance of certificates for ethnic minority languages issued together with Circular No. 09/2023/TT-BGDĐT dated April 18, 2023, by the Minister of Education and Training

1. Abolish Point d Clause 1 and Point d Clause 2 Article 3;

2. Abolish Article 4.

Article 10. Effectiveness

1. This Circular takes effect from the date 22 month 01 year 2026.

2. Abolishing certain phrases in the following Circulars:

a) The phrase: "assigned tasks by the Ministry of Education and Training" in Clause 5 Section VI and "assigned tasks for improvement by the Ministry of Education and Training" in Clause 7 Section VI of the teacher improvement program for teaching Jrai language, the teacher improvement program for teaching Khmer language, and the teacher improvement program for teaching Mong language issued together with Circular No. 19/2013/TT-BGDĐT dated June 3, 2013, by the Minister of Education and Training;

b) The phrase "assigned tasks for improvement by the Ministry of Education and Training (referred to as the improvement institution)" in Clause 1 Section VI and "assigned tasks for improvement by the Ministry of Education and Training" in Clause 6 Section VI of the teacher improvement program for teaching Bana language, the teacher improvement program for teaching Ede language, and the teacher improvement program for teaching Cham language issued together with Circular No. 19/2014/TT-BGDĐT dated May 30, 2014, by the Minister of Education and Training;

c) The phrase "after being assigned tasks for improving teachers of Thai language" in Clause 3 Section VI of the teacher improvement program for teaching Thai language and "after being assigned tasks for improving teachers of Mnong language" in Clause 3 Section VI of the teacher improvement program for teaching Mnong language in Circular No. 34/2015/TT-BGDĐT dated December 30, 2015, by the Minister of Education and Training;

d) The phrase "assigned tasks for improving teachers of ethnic minority languages" in Clause 2 Article 6 of Circular No. 32/2021/TT-BGDĐT dated November 22, 2021, by the Minister of Education and Training guiding the implementation of certain provisions of Decree No. 82/2010/NĐ-CP dated July 15, 2010, of the Government on teaching and learning ethnic minority languages in general education institutions and continuing education centers.

3. Ethnic minority language training and improvement courses that commence before this Circular takes effect shall continue to be implemented according to the provisions of Circular No. 09/2023/TT-BGDĐT dated April 18, 2023, by the Minister of Education and Training.

4. Chairmen of People's Committees of provinces and centrally governed cities; Directors of Departments of Education and Training; Heads of higher education institutions and colleges; Heads of agencies, organizations, and individuals related to this matter are responsible for enforcing this Circular./.
