CIRCULAR
Guidelines for Implementing Decision No. 178/1999/QĐ-TTg dated August 30, 1999
of the Prime Minister Issuing the Labeling Regulations for Domestic Circulation Goods and Exported and Imported Goods
Particularly for Aquatic Products
On August 30, 2000, the Prime Minister issued the Labeling Regulations for Domestic Circulation Goods and Exported and Imported Goods pursuant to Decision No. 178/1999/QĐ-TTg .
On August 15, 2000, the Prime Minister further issued Decision No. 95/2000/QĐ-TTg concerning amendments and supplements to certain contents of the Labeling Regulations for Domestic Circulation Goods and Exported and Imported Goods.
Clause 2, Article 19 of the Regulations stipulates that "Ministries managing specific sectors shall, based on their management functions and specific requirements related to the use and preservation of individual goods within their jurisdiction, be responsible for providing detailed guidance on how to label such individual goods,..."
To implement the Labeling Regulations, the Ministry of Fisheries provides detailed unified guidance on labeling aquatic products as follows:
This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.
1. The labeling of domestic circulation aquatic products and exported and imported aquatic products must comply with the general provisions of the Labeling Regulations for Domestic Circulation Goods and Exported and Imported Goods (hereinafter referred to as the Regulations) issued together with Decision No. 178/1999/QĐ-TTg dated August 30, 1999 and Decision No. 95/2000/QĐ-TTg dated August 15, 2000 of the Prime Minister, and Circular No. 34/1999/TT-BTM of the Ministry of Trade guiding the implementation of Decision No. 178/1999/QĐ-TTg dated August 30, 1999 of the Prime Minister (hereinafter referred to as Circular No. 34).
2. Scope of regulation
Aquatic product groups with commercial packaging when circulating must comply with the labeling regulations set forth in this Circular:
a) Processed food products derived from aquatic animals and plants or containing significant aquatic animal and plant components (hereinafter referred to as aquatic food products).
b) Aquatic animal and plant seeds (including parent seeds).
c) Aquatic raw materials for producing feed and industrially processed feed for aquaculture (hereinafter referred to as raw materials and feed).
d) Drugs, chemicals, and biological preparations for aquatic animals and plants (hereinafter referred to as drugs, chemicals, and biological preparations).
e) Fishing nets including net sheets, threads for weaving nets, and ropes (frames) for assembling nets (hereinafter referred to as fishing nets).
3. For exported aquatic food products, the labeling of the following mandatory contents may be agreed upon according to the requirements of the importing market:
a) Composition.
b) Shelf life, expiration date.
c) Storage and usage instructions.
II. CONTENTS OF THE LABEL
A. MANDATORY CONTENTS
1. Aquatic Food Products
1.1. Product Name
a) In accordance with the general provisions of Clauses 1, 2, and 3 of Article 6 of the Regulations and industry standards.
b) For products regulated under Clause 4 of Article 6 of the Regulations, the product name must accurately describe the aquatic food product in the package, including the following information:
- The species name of the aquatic animal or plant (Example: Frozen cod fillet...) or a description of the characteristics and function of the product (Example: Frozen crab spring roll...).
- The processing technology of the product: Frozen, dried, canned, etc. Example: Frozen cod fillet.
- The form of the processed product: With shell (HOSO), peeled (PUD, PD), filleted, cut into pieces, etc. Example: Frozen crab spring roll.
1.2. Name and Address of the Responsible Trader
a) The name and address registered in business operation.
b) For production facilities of aquatic food products, the content should be: Produced at (name and address of the facility) or: Product of (name and address of the facility).
c) For import facilities of aquatic food products or facilities acting as agents for foreign sales, the content should be: Importer (name and address of the facility) or: Agent (name and address of the facility).
d) For facilities repackaging aquatic food products for sale, the content should be: Product of (name and address of the facility), packaged by (name and address of the facility) or: Product of (name and address of the facility), packaged at (name and address of the facility).
1.3. Quantity of the Product
In accordance with the provisions of Article 8 of the Regulations and Section II.A.3 of Circular No. 34.
1.4. Composition
a) For unprocessed aquatic food products without the use of processing additives, there is no need to list the composition.
b) For processed aquatic food products supplemented with other components that are not aquatic, the main raw material ingredients used in the production process must be clearly stated (aquatic raw materials, other processed components).
c) For aquatic food products using processing additives, the content must clearly state the group name of the additive and the name of the additive or the international code of the additive (the code is placed in parentheses). Specifically, for additives classified as "flavorings," "sweeteners," and "colorants," it must also specify whether they are "natural," "artificial," or "synthetic."
d) For aquatic food products using genetic technology or a component of the raw material used in the processing of aquatic food products produced through genetic technology, the phrase "Genetic Technology Used" must be printed in Vietnamese on the label.
e) For aquatic food products or a component of the raw material used in the processing of aquatic food products that have been treated with irradiation during production, processing, or storage, the phrase "Irradiated Food" must be printed in Vietnamese on the label or the label must display the internationally recognized symbol for irradiated food as specified by Vietnam.
1.5. Main Quality Indicators
In accordance with the general provisions of Article 10 of the Regulations and Section II.A.5 of Circular No. 34.
1.6. Date of Production, Shelf Life, Expiration Date
In accordance with the provisions of Article 11 of the Regulations and Section II.A.6 of Circular No. 34.
1.7. Storage and Usage Instructions
a) In accordance with the general provisions of Article 12 of the Regulations. Additionally, the following information must be included: Special target users (e.g., for people on a diet) and usage methods (e.g., ready-to-eat or cooked before consumption).
b) For aquatic food products that have storage requirements, the content to be recorded must include the criteria affecting the efficacy, quality, and safety of such products.
Example: For dried goods, record "store in a cool, dry place".
1.8. Origin of Goods
When exporting or importing aquatic food products, the label of the goods must clearly indicate the name of the country of origin as prescribed in Article 13 of the Regulation.
2. Animal and Plant Aquatic Breeding Stock
2.1. Name of Goods
a) Recorded according to the general provisions of Article 6 of the Regulation and industry standards or scientific classification names.
b) The name of animal and plant aquatic breeding stock must include both the trade name and the scientific name of the subject.
Example: - For shrimp, record: Shrimp (Penaeus monodon).
- For golden thread seaweed, record: Golden thread seaweed (Gracilaria asiatica).
c) For breeding stock produced through hybridization, the name of the goods must include the hybrid lines.
Example: - Hybrid breeding stock name: Carp V1
- Hybrid lines: Hungarian Carp, Indonesian Yellow Carp, and Vietnamese White-Scaled Carp.
2.2. Name and Address of the Trader Responsible for the Goods
a) The name and address registered in business operation.
b) For breeding stock production facilities or nurseries, the content to be recorded is: Produced at (name and address of the facility) or: Product of (name and address of the facility).
c) For collection or natural harvesting facilities selling breeding stock, the content to be recorded is: Packaging facility (name and address of the facility) or: Packaged at (name and address of the facility). Additionally, for natural harvesting facilities, the content to be supplemented is: Natural harvesting location.
2.3. Quantity of Goods
a) For animal aquatic breeding stock, the content to be recorded is: Number of individuals (units).
b) For Artemia eggs, the content to be recorded is: Weight (g).
c) For single-cell plant aquatic breeding stock, the content to be recorded is: Number of cells (cells).
d) For multicellular plant aquatic breeding stock, the content to be recorded is: Weight (kg).
2.4. Main Quality Criteria
a) For animal aquatic breeding stock, the content to be recorded is: Age in days and length (mm or cm).
b) For parent aquatic animals, the content to be recorded is: Weight (g) and reproductive stage.
c) For Artemia eggs, the content to be recorded is: Number of eggs/g and hatching rate (%).
d) For plant aquatic breeding stock, the content to be recorded is: Length (cm), main stem diameter (mm), and development stage.
2.5. Date of Production, Storage Period, and Expiry Date
a) For animal and plant aquatic breeding stock:
- The date of production refers to the date of dispatch or sale, abbreviated as "NSX". Example: Dispatched on April 2, 2000, record as: NSX 020400.
- No need to record expiry date and storage period.
b) For Artemia eggs:
- The date of production refers to the date of packaging into boxes, abbreviated as "NSX".
Example: Boxed on May 3, 2000, record as: NSX 030500.
- Storage period, abbreviated as "HBQ".
Example: Expiry date of storage until May 10, 2000, record as: HBQ 100500.
- No need to record expiry date.
2.6. Storage and Usage Instructions
a) For animal and plant aquatic breeding stock, instructions must be provided for users regarding the standard codes or technical document names issued about transportation and release of breeding stock.
b) For Artemia eggs, the content to be recorded is: Egg storage conditions (temperature, humidity), summary of egg hatching method.
2.7. Origin of Goods
When exporting or importing animal and plant aquatic breeding stock, the label of the goods must clearly indicate the name of the country of origin as prescribed in Article 13 of the Regulation.
3. Raw Materials and Feed
3.1. Name of Goods
Recorded according to the general provisions of Article 6 of the Regulation and industry standards. In addition, the name of the product group must clearly indicate the intended use.
Example: - Mixed feed pellets for shrimp.
- Fish feed for ornamental fish,
- Feed for shrimp larvae,...
3.2. Name and Address of the Trader Responsible for the Goods
a) The name and address registered in business operation.
b) For raw material and feed production facilities, the content to be recorded is: Produced at (name and address of the facility) or: Product of (name and address of the facility).
c) For import facilities of raw materials and feed or facilities acting as agents for foreign sales, the content to be recorded is: Importer (name and address of the facility) or: Agent (name and address of the facility).
d) For facilities repackaging raw materials and feed for resale, the content to be recorded is: Product of (name and address of the facility), packaging facility (name and address of the facility) or: Product of (name and address of the facility), packaged at (name and address of the facility).
3.3. Quantity of Goods
a) For raw materials and feed in powder, fragment, or pellet form, the content to be recorded is: Weight (g or kg).
b) For raw materials and feed in liquid form, the content to be recorded is: Volume (ml or liters).
3.4. Composition
a) Recorded according to the general provisions of Article 9 of the Regulation.
b) Record the main raw material components used in the production technology of the goods (e.g., fish meal, shrimp meal, cod liver oil...).
c) If the feed uses non-nutritive substances for disease prevention and treatment, the content must also include the non-nutritive substance component.
d) If one of the raw materials has been irradiated or is a product of genetic technology, then it must be clearly indicated on the label according to international regulations that Vietnam has announced to apply.
3.5. Main Quality Criteria
a) Recorded according to the general provisions of Article 10 of the Regulation and Section II.A.5 of Circular No. 34.
b) Record some main quality criteria that determine the quality of raw materials and feed, along with the quantification of these criteria:
- For composite raw materials and feed, record the protein, lipid, ash, fiber, moisture, and solubility content.
- For supplementary feed, if it supplements a certain nutrient, record the quality criteria of that nutrient.
Example: For vitamin and mineral supplementary feed, record some main vitamin and mineral criteria.
3.6. Date of Production, Storage Period, and Expiry Date
In accordance with the provisions of Article 11 of the Regulations and Section II.A.6 of Circular No. 34.
3.7. Storage and Usage Instructions
a) Includes contents to be recorded: Storage conditions (temperature, humidity, light) and feeding methods.
b) For types of feed that require cessation of use before harvest, the cessation time must be specifically recorded.
3.8. Origin of Goods
When exporting or importing raw materials and feed, the label of the goods must clearly indicate the name of the country of origin as prescribed in Article 13 of the Regulation.
4. Drugs, chemicals, and biological products
4.1. Name of goods
Record according to the general provisions stipulated in Article 6 of the Regulation and industry standards. Additionally, the name of the goods must clearly state the drug name, chemical name, and main active ingredient.
Example: Drug name: EM-55, main active ingredient: Erythromycin.
4.2. Name and address of the trader responsible for the goods
a) The name and address registered in business operation.
b) For drug manufacturing facilities, chemicals, and biological products, the content recorded shall be: Produced at (name and address of the facility) or: Product of (name and address of the facility).
c) For import facilities of drugs, chemicals, and biological products or facilities acting as agents selling for foreign entities, the content recorded shall be: Importer (name and address of the facility) or: Agent (name and address of the facility).
d) For facilities repackaging drugs, chemicals, and biological products for sale, the content recorded shall be: Product of (name and address of the facility), packaging facility (name and address of the facility) or: Product of (name and address of the facility), packaged at (name and address of the facility).
4.3. Quantity of goods
a) For drugs in tablet form, the content recorded shall be: Number of tablets (quantity), weight of one tablet (mg).
b) For drugs and biological products in powder form, the content recorded shall be: Weight (mg or g or kg).
c) For drugs, chemicals, and biological products in liquid form, the content recorded shall be: Volume (ml or liters).
d) For fish spawning hormone stimulants (HCG), the content recorded shall be in international units (IU).
4.4. Composition
Record chemical formula, composition (except for HCG) and other contents according to the general provisions stipulated in Article 9 of the Regulation.
4.5. Main quality criteria
Record according to the general provisions stipulated in Article 10 of the Regulation and Section II.A.5 of Circular No. 34.
4.6. Date of production, storage period, and usage period
Record according to the general provisions stipulated in Article 11 of the Regulation and Section II.A.6 of Circular No. 34.
4.7. Storage and usage instructions
a) Includes contents that must be recorded: Storage conditions (temperature, humidity, light) and usage method (dosage, concentration, duration, usage scenarios, target groups, application methods...).
b) For types of drugs that require cessation of use before harvesting aquatic products, the cessation period must be specifically recorded.
4.8. Origin of goods
When exporting or importing drugs, chemicals, and biological products used in aquaculture, the product label must clearly record the country of origin according to the provisions of Article 13 of the Regulation.
5. Fishing nets
5.1. Name of goods
Record according to the general provisions stipulated in Article 6 of the Regulation and industry standards.
Example: Sheet net, thread, rope
5.2. Name and address of the trader responsible for the goods
a) The name and address registered in business operation.
b) For fishing net manufacturing facilities, the content recorded shall be: Produced at (name and address of the facility) or: Product of (name and address of the facility).
c) For import facilities of fishing nets or facilities acting as agents selling for foreign entities, the content recorded shall be: Importer (name and address of the facility) or: Agent (name and address of the facility).
d) For facilities repackaging fishing nets for sale, the content recorded shall be: Product of (name and address of the facility), packaging facility (name and address of the facility) or: Product of (name and address of the facility), packaged at (name and address of the facility).
5.3. Quantity of goods
a) For sheet nets, the content recorded shall be Size including stretched length and width (m or number of mesh), weight (g or kg).
b) For ropes, the content recorded shall be: Weight (kg) and length (m).
c) For threads, the content recorded shall be: Weight (g or kg).
5.4. Composition
Record according to the general provisions stipulated in Article 9 of the Regulation. Example: Nylon thread, rope, PE thread,...
5.5. Main quality criteria
a) For sheet nets, the content recorded shall be: Color, coarseness (Tex), dry tensile strength (N-newtons) and mesh size 2a (mm).
b) For threads and ropes, the content recorded shall be: Diameter (mm), coarseness (Tex), dry tensile strength (N-newtons) and elasticity (turns/m).
5.6. Date of production, storage period, and usage period
Record according to the provisions stipulated in Article 11 of the Regulation and Section II.A.6 of Circular No. 34.
5.7. Storage and usage instructions
a) For goods and fishing nets, usage instructions do not need to be recorded.
b) Storage instructions must clearly state storage conditions (temperature, humidity, light).
5.8. Origin of goods
When exporting or importing fishing nets, the product label must clearly record the country of origin according to the provisions of Article 13 of the Regulation.
B. NON-MANDATORY CONTENTS
In addition to mandatory contents on labels, traders may record additional information on product labels according to the provisions stipulated in Article 14 of the Regulation such as: product quality registration number, product quality standard code...and Section B of Circular No. 34.
III. LABELING AND ATTACHMENT OF PRODUCT LABELS
1. Requirements and language for presenting product labels for aquatic products must comply with the provisions stipulated in the Regulation and Circular No. 34.
2. Product labels are written, printed, drawn, or imaged and presented as follows:
2.1. For goods without outer packaging: Labels are embossed, raised directly on the container or firmly attached, sewn, or fastened on the goods.
2.2. For goods with outer packaging:
a) Labels are embossed, raised directly on the container or firmly attached, sewn, or fastened on the goods. On the outer packaging of the goods, only the name of the goods or all contents of the product label should be recorded as with the container. Or
b) On the container, only some mandatory contents of the label are recorded, while the remaining contents are recorded on the outer packaging similar to the provisions below.
3. In cases where the container is small and the label does not have enough space to record all mandatory contents, the label shall be recorded as follows:
3.1. Record the product label on the container with some major mandatory contents such as: name of goods, name and address of the trader responsible for the goods, quantity of goods, usage period or storage period.
3.2. The remaining mandatory contents and non-mandatory contents (if any) must be recorded on the outer packaging or on the accompanying explanatory note.
IV. IMPLEMENTATION PROVISIONS
1. The Ministry of Fisheries in coordination with the Ministry of Commerce implements state management of product labeling according to the provisions of the Regulation.
2. The Department of Science and Technology shall be the lead agency, assisting the Minister in uniformly managing the State's labeling of aquatic products nationwide, and coordinating with the Fisheries Resource Protection Agency, the Aquatic Product Quality Inspection and Sanitation Center to guide, organize, direct, and implement this Circular.
3. Sectoral inspectors shall be responsible for supervising and inspecting compliance with legal normative documents on product labeling; detecting, preventing, and handling violations related to the labeling of aquatic products within their authority, or recommending competent authorities to handle such violations.
4. This Circular shall take effect from January 1, 2001. Any supplementation or amendment to the content of this Circular shall be reviewed and decided upon in writing by the Minister of Fisheries./.
