Regulations on the Reporting System for Civil Enforcement Statistics and Supervision of Administrative Enforcement

Pursuant to the Civil Enforcement Law on November 14, 2008;

Based on the Law Amending and Supplementing Certain Provisions of the Civil Enforcement Law dated November 25, 2014;

Pursuant to the Law on Statistics dated November 23, 2015;

Pursuant to the Administrative Procedure Code dated November 25, 2015;

Based on Decree No. 97/2016/NĐ-CP dated July 1, 2016 of the Government stipulating the contents of statistical indicators under the National Statistical Indicator System;

Pursuant to Decree No. 60/2018/NĐ-CP dated April 20, 2018, issued by the Government on detailed contents of the national-level statistical reporting system;

Pursuant to Decree No. 96/2017/NĐ-CP dated August 16, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Justice;

At the proposal of the Director General of the Civil Enforcement General Department;

The Minister of Justice issues this Circular to regulate the Reporting System for Civil Enforcement Statistics and Supervision of Administrative Enforcement:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

This Circular regulates the Reporting System for Civil Enforcement Statistics and Supervision of Administrative Enforcement (hereinafter referred to collectively as civil enforcement statistics); the use and publication, dissemination of statistical information; inspection, verification, commendation, and handling of violations in implementing the Reporting System for Civil Enforcement Statistics.

a) The Civil Enforcement General Department; the Civil Enforcement Bureau of the Ministry of Defense; the Civil Enforcement Bureau of provinces and centrally-administered cities; the Civil Enforcement Office of military regions and equivalent offices (hereinafter referred to collectively as the Civil Enforcement Office of military regions); the Civil Enforcement Branches of districts, counties, towns, and provincial cities;

b) Enforcement officers, civil servants engaged in civil enforcement work; enforcement officers, non-commissioned officers, and professional soldiers engaged in civil enforcement work within the military;

c) Organizations and individuals related to civil enforcement activities as prescribed by law.

Article 2. Statistical Form System and Responsibility for Implementing Forms

1. Statistical Form System

The civil enforcement statistical forms issued together with this Circular include:

a) Results of civil enforcement expressed in terms of actions;

b) Results of civil enforcement expressed in monetary terms;

c) Results of civil enforcement for the state budget;

d) Results of civil enforcement expressed in terms of actions divided by civil enforcement agencies and enforcement officers;

đ) Results of civil enforcement expressed in monetary terms divided by civil enforcement agencies and enforcement officers;

e) Results of requests for exemption or reduction of civil enforcement obligations;

g) Results of compulsory enforcement of civil enforcement;

h) Results of resolving complaints and denunciations regarding civil enforcement;

i) Results of receiving citizens in civil enforcement;

k) Results of supervising and inspecting civil enforcement;

l) Results of state compensation in civil enforcement;

m) Results of monitoring administrative enforcement.

2. Responsibilities for Implementation

The responsibility for implementing the Reporting System for Civil Enforcement Statistics is specified in the Appendix attached to this Circular.

Article 3. Receiving Agencies for Statistical Reports

The agencies receiving civil enforcement statistical reports include: Civil Enforcement Branches; Civil Enforcement Bureaus; the Civil Enforcement General Department; People's Councils and People's Committees at the same level (if required); Civil Enforcement Offices of military regions; Commanders of military regions and equivalent positions; the Civil Enforcement Bureau of the Ministry of Defense; Statistical Agencies at the same level (if required).

Article 4. Statistical Reports and Reporting Periods for Statistical Reports

1. Civil enforcement statistical reports include regular statistical reports and ad hoc statistical reports:

a) Regular statistical reports are implemented according to the provisions of Clause 2 of this Article;

b) Ad hoc statistical reports are implemented according to written requirements from authorized persons. In cases where ad hoc statistical reports are required to fulfill management requirements in civil enforcement, the person making the request must provide a written document specifying the time, deadline, content of the statistical report, and other requirements (if any) for the organization or individual to implement.

2. Reporting periods for statistical reports include monthly, bi-monthly, quarterly, four-monthly, five-monthly, six-monthly, seven-monthly, eight-monthly, nine-monthly, ten-monthly, eleven-monthly, and yearly reporting periods. The yearly reporting period is the annual statistical report period. The statistical reporting period starts from October 1 of the current year and ends on the last day of each statistical period. The civil enforcement statistical reporting year begins on October 1 of the current year and ends on September 30 of the following year.

Article 5. Legal Value of Statistical Data

Civil Enforcement Statistical Data is a part of the Judicial Statistics. After being published and disseminated, it has legal value. No organization or individual may change or compel another organization or individual to publish or disseminate false civil enforcement statistical data. Civil enforcement statistical data serves as one of the bases for managing and directing civil enforcement work and monitoring administrative enforcement.

Article 6. Calculation Method in Statistical Reports

The statistical report data on civil enforcement at each period is calculated using the cumulative method.

Chapter II

PROCEDURE FOR IMPLEMENTING THE REPORTING SYSTEM

CIVIL ENFORCEMENT, MONITORING ADMINISTRATIVE ENFORCEMENT

Article 7. Preparation of Statistical Reports

1. At the end of each reporting period, organizations and individuals specified in Clause 2 of Article 1 of this Circular must finalize the data, close the books, and prepare the statistical report form. Results from each period must be reported within that period. Strictly prohibited is the transfer of statistical data generated in the current period to the next period. For cases where there are conditions not yet met for enforcement, separate tracking records are maintained. At the end of the statistical reporting period, the Civil Enforcement Office and the Civil Enforcement Bureau must finalize the data and prepare a list to be sent to the Civil Enforcement General Department for monitoring and management.

2. At the end of the annual reporting period, the Civil Enforcement Office prepares a list of unfinished enforcement actions and sends it to the Civil Enforcement Bureau. The Civil Enforcement Bureau prepares a list of unfinished enforcement actions within its jurisdiction and compiles a comprehensive list of the locality to be sent to the Civil Enforcement General Department for monitoring and management. The list of unfinished enforcement actions includes both civil enforcement actions and administrative enforcement monitoring.

The Civil Enforcement Office of the Military Region establishes a list of unfinished enforcement actions and sends it to the Civil Enforcement Bureau - Ministry of National Defense for monitoring and management.

3. The date of preparing the statistical report is:

a) The last day of the statistical period (for Enforcement Officers);

b) The date of receiving the report from the Enforcement Officer (for the Civil Enforcement Office and Civil Enforcement Bureau; Civil Enforcement Office of the Military Region);

c) The date of receiving the report from the Civil Enforcement Office (for the Civil Enforcement Bureau);

d) The date of receiving the report from the Civil Enforcement Bureau and the Civil Enforcement Office of the Military Region (for the Civil Enforcement General Department, Civil Enforcement Bureau - Ministry of National Defense).

If this date coincides with a public holiday, Tet holiday, or weekend, then the date of preparing the statistical report is the next working day following that date.

The deadline for sending and receiving statistical reports is implemented according to the provisions of Clause 2 of Article 9 of this Circular.

4. The method of recording and preparing statistical reports is carried out according to the instructions provided in the explanation of the form or directly printed from the case management software, organization of enforcement, and civil enforcement statistical report.

Article 8. Form of Report and Method of Sending Statistical Reports

1. Civil enforcement statistical reports shall be presented in the form of paper documents or electronic documents:

a) Written reports on paper must have the signature and name of the person preparing the form; the signature and name of the Head of the unit and the stamp issued according to regulations. The civil enforcement statistical report of the Enforcement Officer must have the signature of the Enforcement Officer and confirmation by the Head of the unit;

b) Electronic written reports are presented in the form of electronic data files (files), containing information as prescribed in point a, Clause 1 of this Article, and signed for issuance by the digital signature of the Head of the unit and related persons (if any). In cases where the person assigned to prepare the statistical form has not been issued a digital signature, the phrase "signed" is recorded in the signing place of the form preparer.

2. Civil enforcement statistical reports shall be sent to the recipient through the following methods:

a) Sent via postal service or fax;

b) Sent directly;

c) Sent scanned (scanned) paper report or electronic written report through official email provided by the Ministry of Justice;

d) For units that have complete data on the case management software, organization of enforcement, and civil enforcement statistical report, upon request in writing by the Head of the unit, the Civil Enforcement Bureau or Civil Enforcement General Department will print directly from the software. The Director of the Civil Enforcement Office and the Director of the Civil Enforcement Bureau must direct the printing of the retention copy on the closing date and bear responsibility for the accuracy and timeliness of the data in the reports printed from the software;

e) The submission of civil enforcement statistical reports in the military is carried out according to the regulations of the Ministry of National Defense and guidance of the Civil Enforcement Bureau - Ministry of National Defense.

Article 9. Procedures for submission, receipt, date of submission, and deadlines for submitting statistical reports

1. Procedures for submitting statistical reports:

a) Enforcement officers submit reports to the unit where they work.

b) Civil Execution Branches submit reports to the Civil Enforcement Department; submit reports to the People's Councils, People's Committees at the district level, and Statistical Offices at the same level (if required).

c) The Civil Enforcement Department submits reports to the National Office of Civil Enforcement; submit reports to the People's Councils, People's Committees at the provincial level, and Statistical Offices at the same level (if required).

d) Military enforcement officers submit reports to the Execution Office at the military region where they work.

đ) The Execution Office at the military region submits reports to the Commander of the Military Region and the Civil Enforcement Department - Ministry of Defense.

e) The Civil Enforcement Department - Ministry of Defense submits statistical reports to the Minister of Defense and the Minister of Justice.

g) The National Office of Civil Enforcement compiles statistics on civil enforcement nationwide and in the military, and reports to the Minister of Justice to report to the Government, the National Assembly, and other competent authorities when required.

2. Deadlines for submitting and receiving civil enforcement statistical reports:

a) Within the latest 01 working day from the end of the reporting period, enforcement officers must submit statistical reports to the head of their working unit.

b) Within the latest 02 working days from the end of the reporting period, Civil Execution Branches must submit statistical reports of their units to the Civil Enforcement Department and other agencies receiving statistical reports as stipulated in Clause 1 of this Article.

c) Within the latest 04 working days from the end of the reporting period, the Civil Enforcement Department must submit statistical reports of its unit and the entire province to the National Office of Civil Enforcement and other agencies receiving statistical reports as stipulated.

d) Within the latest 01 working day from the end of the reporting period, military civil enforcement officers must submit statistical reports to the Head of the Execution Office at the military region where they work.

đ) Within the latest 02 working days from the end of the reporting period, the Execution Office at the military region must submit statistical reports to the Civil Enforcement Department - Ministry of Defense and other agencies receiving statistical reports as stipulated.

e) Within the latest 04 working days from the end of the reporting period, the Civil Enforcement Department - Ministry of Defense must submit statistical reports to the Minister of Defense, the Minister of Justice, and other agencies receiving statistical reports as stipulated.

g) Within the latest 06 working days from the end of the reporting period, the National Office of Civil Enforcement must submit statistical reports to the Minister of Justice.

Article 10. Correction of data in statistical reports

In cases where data in civil enforcement statistical reports need to be corrected, the unit or individual must submit supplementary reports and provide detailed explanations about the corrections. Supplementary reports and explanations must be signed and stamped by the leadership and sent to the National Office of Civil Enforcement according to the method prescribed in Article 8 of this Circular. Unauthorized erasing or altering in statistical report forms is strictly prohibited.

Article 11. Inspection and Audit of Statistics

1. The inspection of civil enforcement statistics includes the following contents:

a) Implementation of legal provisions on statistics;

b) The implementation of the Reporting System for Civil Enforcement Statistics;

c) Other contents related to civil enforcement statistics;

2. The audit of civil enforcement statistics includes the following contents:

a) Statistical data, statistical data analysis tables; sources of statistical data; methods of calculating statistical data;

b) Reports on statistical data;

c) Electronic data on civil enforcement;

d) Other statistical data related to civil enforcement statistics.

Article 12. Authority to Publish and Disseminate Statistical Informationông bố và phổ biến thông tin thống kê

1. The Minister of Justice shall publish and disseminate information on civil enforcement statistics or authorize the Director of the Civil Enforcement General Department to perform such tasks.

2. Monthly, the statistical data of the Civil Enforcement District Office, the Civil Enforcement Service Bureau, and the Civil Enforcement System shall be publicly posted on the Civil Enforcement Information Portal/Website.

Article 13. Use of Data and Information in Statistical Reports

Data and information in civil enforcement statistical reports are used as one of the bases when deciding on the following fundamental issues:

1. Evaluating the results of enforcement, the organizational structure and activities of civil enforcement agencies, enforcement officers, auditors, secretaries, and other civil servants during reporting periods and annual reports.

2. Developing plans for enforcement and assigning annual targets and tasks for civil enforcement agencies and enforcement officers.

3. Allocating staffing; evaluating, planning, appointing, reappointing leaders and managers; training, enhancing, rotating, transferring, and dismissing enforcement officers, auditors, and civil servants of civil enforcement agencies.

4. Calculating performance indicators and compiling, assessing competition, and rewarding civil enforcement agencies and enforcement officers.

5. Implementing financial systems in civil enforcement; considering decisions on investment funding for building headquarters and evidence storage facilities; providing working equipment for the Civil Enforcement System and other matters related to financial assurance and material infrastructure to fulfill the organizational enforcement task.

6. Reporting to the Government, the Standing Committee of the National Assembly, the National Assembly, and other competent authorities as prescribed by law.

7. Using for other management and operational activities aimed at enforcing civil enforcement tasks.

Chapter III

IMPLEMENTATION

Article 14. Responsibility for Implementing the Reporting System for Statistics

1. The Ministry of Justice is responsible for directing priority investments and applying information technology and advanced statistical methods to civil enforcement statistics activities; upgrading and perfecting statistical software and electronic databases on civil enforcement statistics.

2. The Civil Enforcement General Department assists the Minister of Justice in guiding, directing, inspecting, auditing, and urging the implementation of the Reporting System for Statistics in the Civil Enforcement System.

3. The Civil Enforcement Service Bureau is responsible for implementing and guiding, directing, inspecting, auditing, and urging the implementation of the Reporting System for Statistics for enforcement officers under its jurisdiction and district offices within its locality.

4. The Civil Enforcement District Office is responsible for implementing, inspecting, auditing, and urging enforcement officers and statisticians within their unit to implement the Reporting System for Statistics.

5. The Civil Enforcement Bureau - Ministry of National Defense is responsible for implementing and assisting the Minister of National Defense in guiding, directing, inspecting, auditing, and urging the implementation of the Reporting System for Statistics in the military.

6. The Civil Enforcement Office of Military Region is responsible for implementing the Reporting System for Statistics and guiding, directing, inspecting, auditing, and urging the implementation of the Reporting System for Statistics for enforcement officers under its management.

7. Enforcement Officers are responsible for implementing the Statistical Reporting System for civil enforcement and performing assigned tasks.

Article 15. Rewards and Handling of Violations

1. Organizations and individuals who have achievements in implementing the Reporting and Statistical System for Civil Enforcement shall be rewarded according to current regulations.

2. Organizations and individuals who violate the Reporting System for Statistics in civil enforcement will be subject to disciplinary action or criminal responsibility depending on the nature and severity of the violation according to the law.

Article 16. Effective Date

1. This Circular takes effect 45 days from the date of signature, replacing Circular No. 01/2013/TT-BTP dated January 3, 2013, issued by the Ministry of Justice guiding the Reporting System for Statistics in civil enforcement, and Circular No. 08/2015/TT-BTP dated June 26, 2015, issued by the Ministry of Justice amending and supplementing certain articles of Circular No. 01/2013/TT-BTP dated January 3, 2013, guiding the Reporting System for Statistics in civil enforcement.

2. During implementation, if there are difficulties, they should be promptly reflected to the Ministry of Justice for research and resolution.
