CIRCULAR

GUIDELINES FOR THE WORK OF COMPETITION AND REWARD IN THE CULTURE, SPORTS AND TOURISM SECTOR

Pursuant to the Law on Competition and Reward dated November 26, 2003; the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated June 14, 2005 and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated July 16, 2013June 2024;Pursuant to Decree No. 91/2017/ND-CP dated July 31, 2017 of the Government detailing the implementation of certain provisions of the Law on Competition and Reward, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP ,No. Pursuant to Decision No. 79/2017/NĐ-CP dated July 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and TourismAverage loan repayment period is 10 years;At the proposal of the Director of the Department of Competition and RewardJune 2024;, Sports and Tourism, hereby promulgates this Circular guiding the work of competition and reward in the Culture, Sports and Tourism sector.June 2024;At the proposal of the Director of the Party Work and Political Affairs Department, and the Director of the Department for Building Mass Movements for National Security Protection;

Article 1. This Circular guides certain contents regarding the subjects of competition and reward; organizing competitions, honorary titles and standards for honorary titles; forms of rewards and reward standards; authority to decide, present, procedures, and files for proposing to grant honorary titles and reward forms; the Competition and Reward Council, the Initiative Council, and the Competition and Reward Fund of the Culture, Sports and Tourism sector (hereinafter referred to as the Sector).June 2024;ng 7 namendArticle 2. Subjects of competition and reward"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."1. The subjects of competition include:in;

đ) Departments, offices, or equivalent units directly under the units specified in points a and b of this clause;;

b) Public libraries at the district level: libraries under the People's Committee of districts, towns, cities directly under provinces, or libraries under the Department of Culture, Information, Cultural Center, or Cultural-Sports Center, or District Cultural House of districts, towns, cities directly under provinces;Coate) Officials, civil servants, public officials, and workers including probationary civil servants and indefinite-term contract employees working in the units specified in points a, b, c, d, and đ of this clause.ớ2. PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

c) Individuals and groups outside the Sector with outstanding achievements in areas within the scope of management of the Ministry of Culture, Sports and Tourism;

d) Vietnamese individuals and groups abroad and foreign individuals and groups who have made contributions to the construction and development of the Sector.

Article 3. Principles of competition include:

a) The provisions at points a and b of Clause 1 of Article 6 of the Law on Competition and Reward;

b) Individuals and groups participating in competition movements must register for competition, set goals, and criteria for competition; those not registering for competition shall not be considered or recognized for honorary titles.

Article 4. Principles of reward include:

a) The provisions at Clause 3 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward in 2013 and Article 3 of Decree No. 91/2017/ND-CP dated July 31, 2017 of the Government detailing the implementation of certain provisions of the Law on Competition and Reward (Decree No. 91/2017/ND-CP);

b) Individuals engaged in leadership and management, in addition to long-term contribution award forms, during their tenure may still be considered and proposed for regular rewards and other reward forms if they meet the conditions and standards prescribed and must be based on the achievements of the group they are responsible for.

đ) Departments, offices, or equivalent units directly subordinate to the agency or unit specified in points a and b of this clause;

e) Officials, civil servants, public officials, employees including probationary civil servants and indefinite-term contract staff working at the agencies or units specified in points a, b, c, d, and đ of this clause;

2. The subjects for commendation include:

a) The competition participants as stipulated in Clause 1 of this Article;

b) Associations, clubs, and professional unions operating in the fields of culture, sports, and tourism;

c) Individuals and groups outside the Industry who have outstanding achievements in areas under the management of the Ministry of Culture, Sports and Tourism;

d) Vietnamese individuals and groups abroad and foreign individuals and groups who have made contributions to the construction and development of the Industry;

Article 3. Principles of Competition and Reward

1. Competition principles include:

a) The provisions set forth in points a and b of Clause 1 of Article 6 of the Law on Competition and Commendation;

b) Individuals and groups participating in the competition movement must register for the competition, determine goals and criteria for the competition; those who do not register for the competition shall not be eligible for evaluation and recognition of competition titles;

2. Commendation principles include:

a) The provisions set forth in Clause 3 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Commendation 2013 and Article 3 of Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government detailing certain provisions of the Law on Competition and Commendation (Decree No. 91/2017/NĐ-CP);

b) Individuals engaged in leadership and management positions, in addition to long-term contribution awards, during their tenure may still be considered and proposed for regular commendations and other forms of commendation if they meet the prescribed conditions and standards and must be based on the achievements of the group they are responsible for;

Article 4. Rights and responsibilities of organizations and individuals in the work of competition and reward

1. The Minister of Culture, Sports and Tourism (hereinafter referred to as the Minister) shall organize and direct the implementation of the competition movement throughout the Sector, decide on awarding commendation titles and reward forms within the scope of authority or submit to the competent authority for examination and awarding of commendation titles and reward forms according to the laws on competition and reward, and be responsible for the competition and reward work in the Sector.

2. The Director of the Department of Competition and Reward shall provide advice, coordinate with agencies and units under the Ministry to propose to the Minister on policies, contents, programs, plans, measures to organize the competition movement; guide, urge, inspect, summarize, and conclude the competition movements and reward work; promote exemplary models and good deeds and people in the Sector; review the files for rewards proposed to the Competition and Reward Council of the Ministry of Culture, Sports and Tourism (hereinafter referred to as the Competition and Reward Council of the Ministry) for examination and submission to the Minister for awarding within the scope of authority or submit to the competent authority for examination and awarding of commendation titles and reward forms according to the laws on competition and reward.

3. Heads of agencies and units under the Ministry, Directors of Departments have the responsibility to lead and coordinate with Party committees, Trade Unions, Youth Leagues, Women's Associations at the same level to concretize the contents, targets, measures to organize competition movements, and inspect the implementation; summarize and conclude competition movements, promote exemplary models; propose rewards and suggest innovations in competition and reward work; give opinions on cases of rewards when requested by the Competition and Reward Council of the Ministry.

4. News agencies under the Ministry of Culture, Sports and Tourism have the responsibility to regularly publicize the competition and reward work; identify exemplary individuals and collectives with outstanding achievements in the competition movement to set examples, promote, and disseminate exemplary models; criticize negative phenomena and behaviors violating the laws on competition and reward.

5. Individuals and collectives proposed for examination and awarding of commendation titles and reward forms must fully and timely comply with the procedures, formalities, and deadlines for submitting reward proposal files according to this Circular and relevant laws.

Article 5. Rights and obligations of individuals and collectives awarded commendation titles and reward forms

1. Individuals awarded commendation titles and reward forms shall receive Certificates of Merit, Certificates of Commendation, and monetary or material rewards according to the laws on competition and reward; shall be given priority for research, study, work, and professional training both domestically and internationally; shall be given priority in consideration, evaluation, planning, appointment, reappointment, and early salary increase according to regulations.

2. Collectives awarded commendation titles and reward forms shall receive Certificates of Merit, Certificates of Commendation, and monetary or material rewards according to the laws on competition and reward; have the right to retain, display, and use Certificates of Merit, Certificates of Commendation, Certificates of Commendation, or material rewards on official documents and materials of the agency or unit.

3. Individuals and collectives awarded commendation titles and reward forms have the responsibility to maintain and further strive to achieve higher commendation titles and reward forms; properly preserve the awarded materials.

Article 6. Competition Groups, Competition Clusters

1. Based on the characteristics of position, function, tasks, nature of work, and scope of operation of organizations, the Department of Competition and Awards shall submit to the Minister for the decision to establish Competition Groups comprising agencies and units under the Ministry and Competition Clusters comprising Departments.

2. On the basis of selection and recommendation from Competition Groups and Competition Clusters (hereinafter referred to as Competition Groups and Clusters), the Department of Competition and Awards shall submit to the Minister for the decision to recognize Group Leaders, Cluster Leaders, Deputy Group Leaders, and Deputy Cluster Leaders. The Group Leader and Cluster Leader shall lead and direct the activities of the Competition Group and Cluster; be responsible for all activities of the Competition Group and Cluster; chair and conclude meetings of the Competition Group and Cluster, and propose awards according to regulations.

The Deputy Group Leader and Deputy Cluster Leader shall assist the Group Leader and Cluster Leader in implementing the activities of the Competition Group and Cluster when the leader is absent or in necessary cases. The Deputy Group Leader and Deputy Cluster Leader shall be responsible for their decisions before the Group Leader and Cluster Leader and before the law.

3. Tasks and authorities of Competition Groups and Clusters:

a) Organize the launch and signing of competition agreements to implement the competition movement initiated by the Ministry, specifically detailing targets, contents, and measures to build the competition movement within the Competition Group and Cluster, aiming to develop strongly, widely, correctly, and effectively;

b) Summarize and conclude the competition movement, propose directions and tasks for organizing the competition movement, exchange learning, share experiences, build new models, and exemplary cases within the Competition Group and Cluster;

c) Evaluate, review, and honor outstanding collectives with excellent achievements in the Competition Group and Cluster in descending order and report to the Competition and Awards Council of the Ministry to recommend the Minister to consider awarding commendation titles and forms of rewards according to authority for outstanding collectives in the Competition Groups and Clusters or submit to competent authorities for consideration;

d) Carry out other tasks assigned by the Minister.

Article 7. Initiatives, Research Topics

1. Initiatives and research topics that have a scope of influence to serve as grounds for recommending the awarding of commendation titles and forms of rewards include:

a) The contents stipulated in Article 6 of Circular No. 08/2017/TT-BNV dated October 27, 2017 issued by the Minister of Home Affairs detailing the implementation of certain provisions of Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government detailing the implementation of certain provisions of the Law on Competition and Awards (Circular No. 08/2017/TT-BNV);

b) Legal regulatory documents issued;

c) Proposals in the Program of Work of the Government issued;

d) Gold, Silver, Bronze (First, Second, Third or A, B, C) awards at professional art contests and literary-art exhibitions at the national level organized by ministries and sectors or awards of central specialized literature and art associations or professional contests and literary-art exhibitions internationally recognized.

2. Classification of initiatives:

a) National-level initiatives are new solutions created or improvements to previous solutions applied in cultural, sports, and tourism activities bringing tangible benefits and effectiveness to the entire country;

b) Ministry-level initiatives are new solutions created or improvements to previous solutions applied in cultural, sports, and tourism activities bringing tangible benefits and effectiveness to the sector;

c) Grassroots-level initiatives are new solutions created or improvements to previous solutions applied in cultural, sports, and tourism activities, bringing tangible benefits and effectiveness to the operations of agencies and units.

3. Documents serving as evidence to prove initiatives, research topics, and legal regulatory documents proposed for the awarding of commendation titles and forms of rewards include:

a) Certificate of initiative issued by the competent state agency or Decision recognizing the results of scientific and technological tasks issued by the competent state agency or Minutes of acceptance by the competent Scientific and Technological Council. The recognized subject with a research topic is the Head of the Topic and the person directly participating in researching the topic;

b) For legal regulatory documents, Proposals submitted to the Government: The person recommended for commendation is named in the Decision establishing the Drafting Board, Editorial Team;

c) For awards at professional art contests and literary-art exhibitions at the national level organized by ministries and sectors or awards of central specialized literature and art associations or professional contests and literary-art exhibitions internationally recognized: The award counts as an individual award. For programs and performances winning awards, the award counts as an individual award for the director of the program or performance.

Chapter II

ORGANIZING THE COMPETITION MOVEMENT; COMPETITION TITLES AND STANDARDS FOR COMPETITION TITLES

Article 8. Forms and contents of organizing competitive movements

1. The forms and contents of organizing competitive movements shall be carried out in accordance with the provisions of Articles 4 and 5 of Decree No. 91/2017/NĐ-CP.

2. The Minister shall launch competitive movements in batches or on specific topics to strive for the successful implementation of the five-year national socio-economic development plan or to complete the annual tasks of the Sector. When organizing competitive movements within the Sector lasting three years or more, the Ministry shall submit its organization plan for launching competitive movements to the Central Steering Committee for Mobilization and Reward for consolidation and guidance in awarding rewards.

3. Agencies and units within the Sector shall organize the launch of competitive movements to celebrate the Sector's communication day, commemorate the Sector's founding day, or the anniversary of the establishment of agencies and units in years ending in 5 or when there are key or urgent tasks requiring concentrated competitive efforts throughout the agency or unit.

4. Upon completion of the period for organizing competitive movements within the Sector, agencies, units, Groups, and Clusters shall conduct summaries, evaluations, and propose commendation titles and reward forms according to their authority. In cases where the organization is nationwide, during mid-term and final reviews of movements lasting three years or more, the Ministry shall select individuals and groups with outstanding achievements to present to the Prime Minister for consideration and awarding of the Prime Minister's Commendation Certificate; for movements lasting five years or more, the Ministry shall select individuals and groups with exceptionally outstanding achievements to present to the Prime Minister for recommendation to the State President for consideration and awarding of the Labor Medal, Third Class.

Article 9. Registration for competition, signing of competition agreements

1. Agencies and units shall organize for collectives and individuals to register for competition annually, submitting the registration form for competition to the Department of Mobilization and Reward before March 25 each year.

2. Groups and Clusters shall organize the signing of competition agreements, unify the scoring table of the Group and Cluster, and submit it to the Department of Mobilization and Reward before March 30 each year.

Article 10. Competition Titles

1. Competition titles for individuals:

a) "National Model Competitor";

b) "Ministry-Level Model Competitor";

c) "Basic-Level Model Competitor";

d) "Advanced Worker".

2. Competition titles for collectives:

a) "Government Flag of Merit";

b) "Ministry Flag of Merit";

c) "Outstanding Working Collective";

d) "Advanced Working Collective".

Article 11. Standards for competition titles for individuals and methods of granting

1. Title "National Model Competitor":

a) The criteria for granting the title "National Model Competitor" shall be implemented in accordance with Clause 1 of Article 9 of Decree No. 91/2017/NĐ-CP;

b) Method of granting:

Organize the granting once a year at the first meeting of the Ministry's Mobilization and Reward Council for individuals working at agencies and units under the Ministry who have consecutively achieved the title "Ministry-Level Model Competitor" twice.

2. Title "Ministry-Level Model Competitor":

a) The criteria for granting the title "Ministry-Level Model Competitor" shall be implemented in accordance with Clause 2 of Article 9 of Decree No. 91/2017/NĐ-CP;

b) Method of granting:

Organize the granting once a year for individuals working at agencies and units under the Ministry at the end of the work year.

3. Title "Basic-Level Model Competitor":

a) The criteria for granting the title "Basic-Level Model Competitor" shall be implemented in accordance with Clause 3 of Article 9 of Decree No. 91/2017/NĐ-CP;

b) Method of granting:

Organize the granting once a year for individuals working at agencies and units under the Ministry; the ratio of selection shall not exceed 15% among cadres, civil servants, public officials, and workers who have achieved the title "Advanced Worker".

4. Title "Advanced Worker":

a) The criteria for granting the title "Advanced Worker" shall be implemented in accordance with Clause 6 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Mobilization and Reward and the following regulations:

- Time off for maternity leave as prescribed shall be counted towards the evaluation for granting the title "Advanced Worker";

- Individuals who bravely rescue people or property leading to injury requiring treatment or convalescence shall have this time counted towards the granting of the title "Advanced Worker";

- Individuals sent for short-term training or further education under one year, complying well with the rules of the training institution, shall have this study time counted towards their work time at the agency or unit for the evaluation of the title "Advanced Worker". In cases where individuals are sent for training or further education for one year or more, comply well with the rules of the training institution, and achieve satisfactory grades or higher, they shall be considered for the granting of the title "Advanced Worker";

- For individuals transferred to new agencies or units, the new agency or unit shall be responsible for evaluating and granting the title "Advanced Worker" (in cases where the individual has worked at the previous agency or unit for six months or more, the opinion of the previous agency or unit must be obtained);

- In cases where individuals are temporarily assigned or detailed to other agencies or units, the evaluation and granting of the title "Advanced Worker" shall be decided by the agency or unit assigning or detailing them, and confirmed by the agency or unit receiving the individual;

- Individuals newly recruited for less than ten months or disciplined with a warning or higher shall not be granted the title "Advanced Worker".

b) Method of granting:

Organize the granting annually at the end of the work year for individuals belonging to the agencies and units specified in points a, b, and d of Clause 1 of this Circular.

Article 12. Criteria for commendation titles for collectives and methods of awarding

1. The title "Flag of Government Competition":

a) The criteria for awarding the title "Flag of Government Competition" shall be implemented in accordance with Clause 1 and Clause 3, Article 25 of the Law on Competition and Reward, Clause 7, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward, and Article 11 of Decree No. 91/2017/NĐ-CP;

b) Method of granting:

- The organization shall conduct the award annually during the year-end summary of the Ministry's work;

- The number of collectives proposed for award shall not exceed 20% of the total number of collectives that have been awarded the "Flag of Ministry Competition".

Based on annual competition registration with the Government (through the Central Competition and Reward Board), the Ministry selects and submits to the Government for awarding to agencies and units under the Ministry, and considers and agrees to submit for awarding the title to Departments.

2. The title "Flag of Ministry Competition":

a) The criteria for awarding the title "Flag of Ministry Competition" shall be implemented in accordance with Article 26 of the Law on Competition and Reward and Article 12 of Decree No. 91/2017/NĐ-CP;

b) Method of granting:

- The organization shall conduct the award during the year-end summary of the Ministry's work;

- The number of collectives proposed for award shall be implemented according to the annual guidance of the Ministry of Culture, Sports and Tourism.

3. The title "Outstanding Labor Collective":

a) The criteria for awarding the title "Outstanding Labor Collective" shall be implemented in accordance with Clause 1, Article 27 of the Law on Competition and Reward;

b) Method of granting:

The organization shall conduct the award annually for collectives specified in Points a, b, and đ Clause 1 of this Circular.

4. The title "Advanced Labor Collective":

a) The criteria for awarding the title "Advanced Labor Collective" shall be implemented in accordance with Clause 1, Article 28 of the Law on Competition and Reward;

b) Method of granting:

The organization shall conduct the award annually for collectives specified in Points a, b, and đ Clause 1 of this Circular.

Chapter III

FORMS OF REWARD AND STANDARDS FOR REWARD

Article 13. Types of rewards

1. Types of rewards shall be implemented in accordance with Clauses 1, 2, 3, 4, and 6, Article 13 of Decree No. 91/2017/NĐ-CP.

2. Rewards for dedication shall be implemented in accordance with Article 41 of Decree No. 91/2017/NĐ-CP and Clause 1, Article 10 of Circular No. 08/2017/TT-BNV.

Article 14. State-level reward forms

1. Orders:

a) "Golden Star Order";

b) "Ho Chi Minh Order";

c) "Independence Order", First Class, Second Class, Third Class;

d) "Labor Order", First Class, Second Class, Third Class;

đ) "Bravery Order";

e) "Friendship Order".

2. Friendship Medal.

3. National honorary titles:

a) Title "People's Armed Forces Hero";

b) Title "Heroic Laborer";

c) Title "National Teacher", "Excellent Teacher";

d) Title "National Doctor", "Excellent Doctor";

đ) Title "National Artist", "Excellent Artist";

e) Title "National Master Craftsperson", "Excellent Master Craftsperson".

4. National honorary awards:

a) "Ho Chi Minh Award", "State Award" for literature and art;

b) "Ho Chi Minh Award", "State Award" for science and technology.

5. "Prime Minister's Commendation".

Article 15. Reward forms within the authority of the Minister and heads of agencies and units under the Ministry to decide

1. Reward forms within the authority of the Minister to decide: Commendation Certificate; Commemorative Medal "For the Cultural, Sports and Tourism Cause".

2. Reward form within the authority of the heads of agencies and units under the Ministry with separate accounts and seals: Certificate of Merit.

Article 16. Standards for awarding national commendations

1. Standards for awarding the "Golden Star Medal":

a) Standards for awarding or posthumously awarding the "Golden Star Medal" to individuals shall be implemented in accordance with the provisions of Clause 1, Article 14 of Decree No. 91/2017/NĐ-CP;

b) Standards for awarding the "Golden Star Medal" to groups shall be implemented in accordance with the provisions of Clause 2, Article 14 of Decree No. 91/2017/NĐ-CP.

2. Standards for awarding the "Ho Chi Minh Medal":

a) Standards for awarding or posthumously awarding the "Ho Chi Minh Medal" to individuals shall be implemented in accordance with the provisions of Clause 1, Article 15 of Decree No. 91/2017/NĐ-CP;

b) Standards for awarding the "Ho Chi Minh Medal" to groups shall be implemented in accordance with the provisions of Clause 2, Article 15 of Decree No. 91/2017/NĐ-CP.

3. Standards for awarding the "Independence Medal" First Class, Second Class, Third Class to individuals and groups shall be implemented in accordance with the provisions of Articles 16, 17, and 18 of Decree No. 91/2017/NĐ-CP.

4. Standards for awarding the "Labor Medal" First Class, Second Class, Third Class to individuals and groups shall be implemented in accordance with the provisions of Articles 22, 23, and 24 of Decree No. 91/2017/NĐ-CP.

5. Standards for awarding the "Bravery Medal" to individuals shall be implemented in accordance with the provisions of Article 32 of Decree No. 91/2017/NĐ-CP.

6. Standards for awarding the "Friendship Badge" to individuals and foreign organizations shall be implemented in accordance with the provisions of Article 33 of Decree No. 91/2017/NĐ-CP.

7. Standards for awarding the "Friendship Medal" to foreign nationals shall be implemented in accordance with the provisions of Article 36 of Decree No. 91/2017/NĐ-CP.

8. Standards for awarding the title of "People's Heroic Armed Forces" for awarding or posthumously awarding to individuals and awarding to groups shall be implemented in accordance with the provisions of Article 60 of the Law on Competition and Commendation.

9. Standards for awarding the title of "People's Labor Hero" for awarding or posthumously awarding to individuals and awarding to groups shall be implemented in accordance with the provisions of Article 61 of the Law on Competition and Commendation.

10. Standards for awarding the titles of "National Teacher", "Outstanding Teacher" to individuals shall be implemented in accordance with the provisions of Articles 8 and 9 of Decree No. 27/2015/NĐ-CP dated March 10, 2015 of the Government on the awarding of the titles of "National Teacher", "Outstanding Teacher".

11. Standards for awarding the titles of "National Doctor", "Outstanding Doctor" to individuals shall be implemented in accordance with the provisions of Articles 9 and 10 of Decree No. 41/2015/NĐ-CP dated May 5, 2015 of the Government on the awarding of the titles of "National Doctor", "Outstanding Doctor".

12. Standards for awarding the titles of "National Artist", "Outstanding Artist" to individuals shall be implemented in accordance with the provisions of Articles 8 and 9 of Decree No. 89/2014/NĐ-CP dated September 29, 2014 of the Government on the awarding of the titles of "National Artist", "Outstanding Artist".

13. Standards for awarding the titles of "National Master", "Outstanding Master" in the field of intangible cultural heritage to individuals shall be implemented in accordance with the provisions of Articles 5 and 6 of Decree No. 62/2014/NĐ-CP dated June 25, 2014 of the Government on the awarding of the titles of "National Master", "Outstanding Master" in the field of intangible cultural heritage.

14. Standards for awarding the "Ho Chi Minh Prize", "State Prize" in literature and art shall be implemented in accordance with the provisions of Clauses 2 and 3, Article 1 of Decree No. 133/2018/NĐ-CP dated October 1, 2018 of the Government amending and supplementing some articles of Decree No. 90/2014/NĐ-CP dated September 29, 2014 on the "Ho Chi Minh Prize", "State Prize" in literature and art.

15. Standards for awarding the "Ho Chi Minh Prize", "State Prize" in science and technology shall be implemented in accordance with the provisions of Articles 9, 10, 13, and 14 of Decree No. 78/2014/NĐ-CP dated July 30, 2014 of the Government on the "Ho Chi Minh Prize", "State Prize" and other prizes in science and technology.

16. Standards for awarding the "Labor Medal", "Certificate of Merit from the Prime Minister" to athletes, coaches who achieve outstanding results at international sports competitions and artists who win high awards at international contests, festivals, and exhibitions shall be implemented in accordance with the State’s regulations and those of the Ministry.

17. Standards for awarding the Certificate of Merit from the Prime Minister to individuals, groups, and families shall be implemented in accordance with the provisions of Article 38 of Decree No. 91/2017/NĐ-CP.

Article 17. Criteria for awarding commendation forms within the decision-making authority of the Minister and heads of agencies and units under the Ministry

1. The Certificate of Merit of the Minister shall be awarded to individuals according to the following provisions:

a) Individuals belonging to agencies and units under the Ministry meeting the criteria stipulated in Clause 1, Article 39 of Decree No. 91/2017/ND-CP;

b) Awarded annually during the year-end work summary of the Ministry to individuals from Departments and individuals from agencies and units directly under Departments who meet the criteria specified in point a and point b of Clause 1, Article 39 of Decree No. 91/2017/ND-CP;

c) Awarded exceptionally to individuals who achieve outstanding achievements at national and international competitions, festivals, and exhibitions in the fields of culture, family, sports, and tourism organized by the Ministry, or who achieve outstanding and exemplary results recognized during campaign periods initiated by the Ministry;

d) Awarded exceptionally to individuals outside the Sector in Vietnam and abroad who have made many outstanding contributions to the development of the Sector.

2. The Certificate of Merit of the Minister shall be awarded to groups according to the following provisions:

a) Groups belonging to agencies and units directly under the Ministry meeting the criteria stipulated in Clause 2, Article 39 of Decree No. 91/2017/ND-CP;

b) Awarded annually during the year-end work summary of the Ministry of Culture, Sports and Tourism to Departments belonging to the Competition Group; departments (or equivalent) under Departments and agencies and units directly under Departments who meet the criteria specified in point a and point b of Clause 2, Article 39 of Decree No. 91/2017/ND-CP;

c) Awarded exceptionally to groups achieving outstanding results winning high awards at national and international competitions, festivals, and exhibitions in the fields of culture, family, sports, and tourism, or achievements that serve as role models within the Ministry and the Sector, not included in the competition targets or not participating in signing competition agreements, or achieving outstanding and exemplary results recognized during campaign periods initiated by the Ministry;

d) Awarded exceptionally to agencies and units outside the Sector in Vietnam and abroad who have made many outstanding contributions to the development of the Sector.

3. Commemorative Medal "For the Cause of Culture, Sports and Tourism":

The awarding of the Commemorative Medal "For the Cause of Culture, Sports and Tourism" shall be carried out in accordance with the provisions of Circular No. 11/2014/TT-BVHTTDL dated October 1, 2014, issued by the Minister of Culture, Sports and Tourism on the awarding of the Commemorative Medal "For the Cause of Culture, Sports and Tourism".

4. Certificate of Merit of the Head of an agency or unit under the Ministry having its own account and seal:

The awarding of the "Certificate of Merit" by the Head of an agency or unit under the Ministry shall be carried out in accordance with the provisions of Clause 42, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Encouragement and Reward in 2013.

Chapter IV

AUTHORITY, PROCEDURES, AND DOCUMENTS FOR PROPOSING AWARDS OF ACHIEVEMENT TITLES AND REWARD FORMS AND ORGANIZING THE AWARDING

Article 18. Authority to decide on awarding achievement titles and reward forms

1. The authority to decide on awarding Orders, Medals of Friendship, National Honorary Titles, National Honor Awards, "Flag of Excellence from the Government", "National Vanguard Soldier", and "Certificate of Merit of the Prime Minister" shall be implemented in accordance with the provisions of Articles 77 and 78 of the Law on Encouragement and Reward.

2. The Minister decides to award:

a) Achievement titles "Outstanding Vanguard Soldier of the Ministry", "Flag of Excellence of the Ministry", and "Excellent Labor Collective";

b) Achievement titles "Advanced Worker" and "Vanguard Soldier at the Base Level" for individuals and "Advanced Labor Collective" for groups for Departments, the Office of the Ministry, and the Inspectorate of the Ministry;

c) Certificates of Merit and Commemorative Medal "For the Cause of Culture, Sports and Tourism".

3. The head of an agency or unit under the Ministry having its own account and seal decides to award:

a) Achievement titles "Advanced Worker", "Vanguard Soldier at the Base Level", and "Advanced Labor Collective" for individuals and groups under their management;

b) Certificates of Merit.

Article 19. Authority to Propose Awards for Merit and Commendation Forms

1. The leading agency or unit initiating a campaign shall select outstanding individuals or groups for commendation or propose higher authorities to commend them within their authority.

2. The head of a ministry-affiliated agency or unit shall be responsible for commending or proposing higher authorities to commend individuals or groups under their management within their authority.

3. The Department proposes:

a) Provincial People's Committees and municipal people's committees directly under the central government shall examine and propose to the State for awards of merit titles and commendation forms as prescribed by laws on competition and commendation;

b) Ministers shall commend merit titles and commendation forms within their authority as stipulated in Clause 2, Article 18 of this Circular.

4. The heads of agencies or units outside the specified sector in Point c, Clause 2, Article 2 of this Circular shall propose to competent levels to consider and propose to the Ministry for commendation.

5. Individuals and groups specified in Point d, Clause 2, Article 2 of this Circular shall be proposed to competent levels of the State to consider and commend or propose to the Ministry to consider and commend.

Article 20. Documents for Proposing Commendation

1. Documents for proposing commendation shall be submitted to the Ministry (through the Department of Competition and Commendation).

a) Documents for proposing commendation for the titles "Heroic Labor Medal", "Heroic Armed Forces Medal", "National Model Worker", "Prime Minister's Flag of Excellence" and commendation forms such as Orders, Medals, and "Prime Minister's Certificate of Merit" include:

- A proposal for commendation report (with attached list) implemented according to Model 01 stipulated in the Appendix issued together with this Circular;

- Minutes of the meeting of the Competition and Commendation Council implemented according to Model 03 stipulated in the Appendix issued together with this Circular;

- Reports on achievements of the individual or group proposed for commendation implemented according to Models 05, 06, 07, 08, and 09 stipulated in the Appendix issued together with this Circular;

- Copies of Decisions or Certificates recognizing receipt of merit titles and commendation forms from competent authorities for the group or individual proposed for commendation (one set);

- Opinions of local administrative authorities regarding compliance with Party guidelines, policies, and state laws (for individuals who are heads of agencies or units and for agencies or units);

- Opinions of tax management authorities confirming that agencies or units or heads of agencies or units have paid all types of taxes as required (for agencies or units and heads of units with obligations to pay state budget);

- Copies of confirmations of innovations, improvements, application of new technologies, scientific topics confirmed by the Scientific Council or Innovation Council; copies of certificates of national and international awards (if any).

b) Documents for proposing commendation for "Minister's Certificate of Merit", "Ministry's Flag of Excellence", "Outstanding Labor Group", "Ministry-Level Model Worker" (one set) include:

- A proposal for commendation report of the Department for individuals or groups under the Department or heads of ministry-affiliated agencies or units (with attached list) implemented according to Model 02 stipulated in the Appendix issued together with this Circular;

- Minutes of the meeting of the Department's Competition and Commendation Council or of the ministry-affiliated agencies or units implemented according to Model 04 stipulated in the Appendix issued together with this Circular;

- Reports on achievements of the individual or group proposed for commendation implemented according to Models 07 and 08 at the Appendix issued together with this Circular;

- Copies of Decisions or Certificates recognizing receipt of the title "Local Model Worker" or "Outstanding Labor Group" from competent authorities;

- Copies of confirmations of innovations, improvements, application of new technologies, scientific topics confirmed by the Scientific Council or Innovation Council; copies of certificates of national and international awards (if any).

c) Documents for proposing commendation for exceptional cases include:

- A proposal for commendation report of the agency or unit (with attached list) implemented according to Models 01 and 02 stipulated in the Appendix issued together with this Circular;

- Minutes of the meeting of the Competition and Commendation Council implemented according to Models 03 and 04 stipulated in the Appendix issued together with this Circular;

- Reports on achievements of individuals and groups with outstanding achievements implemented according to Model 10 stipulated in the Appendix issued together with this Circular.

d) Documents for proposing commendation during campaigns or special topics include:

- A proposal for commendation report of the agency or unit (with attached list) implemented according to Models 01 and 02 stipulated in the Appendix issued together with this Circular;

- Minutes of the meeting of the Competition and Commendation Council implemented according to Models 03 and 04 stipulated in the Appendix issued together with this Circular;

- Reports on achievements for commendation during campaigns or special topics of individuals and groups implemented according to Model 11 stipulated in the Appendix issued together with this Circular.

đ) Documents for proposing commendation for long-term contributions:

- A proposal for commendation report implemented according to Model 01 stipulated in the Appendix issued together with this Circular;

- Minutes of the meeting of the Competition and Commendation Council implemented according to Model 03 stipulated in the Appendix issued together with this Circular;

- Report on achievements implemented according to Model 09 stipulated in the Appendix issued together with this Circular.

e) Documents for proposing commendation according to simplified procedures as stipulated in Article 85 of the Law on Competition and Commendation:

- A proposal for commendation report of the agency or unit (with attached list) implemented according to Models 01 and 02 stipulated in the Appendix issued together with this Circular;

- A summary of achievements of the direct managing agency, organization, or unit, clearly stating actions, achievements, and merits for commendation through simplified procedures.

2. Number of documents for proposing commendation:

a) For the titles "Heroic Armed Forces Medal", "Heroic Labor Medal": five original sets and twenty photocopy sets;

b) For the title "National Model Worker": three original sets and three photocopy sets;

c) For the title "Prime Minister's Flag of Excellence": three original sets;

d) For commendation forms such as Orders: four original sets.

Specifically, for groups considered for awarding; individuals under the management of the Politburo and Secretariat of the Central Committee: six original sets.

đ) For commendation forms such as Medals, "Prime Minister's Certificate of Merit": three original sets;

e) For merit titles and commendation forms within the authority of the Minister: one original set.

3. Time limit for receiving documents for awarding merit titles and commendation forms:

a) For the title "Outstanding Labor Collective", "Flag of Government Competition", "Flag of Ministry Competition", and "Ministry Commendation" for the subjects specified in points a, b, and c, Clause 1, Article 2 of this Circular: Acceptance of application files before December 5th each year (based on the postmark).

For the title "Flag of Ministry Competition" and "Ministry Commendation" for the subject specified in point d, Clause 1, Article 2 of this Circular: Acceptance of application files before December 5th each year (based on the postmark);

For the title "Outstanding Labor Collective" for the subject specified in point đ, Clause 1, Article 2 of this Circular; the title "Ministry-Level Model Worker" for individuals within agencies and units under the Ministry, and "Ministry Commendation" for the subjects specified in points đ and e, Clause 1, Article 2 of this Circular: Acceptance of application files before February 25th of the following year (based on the postmark);

b) For Medals, Orders, "Prime Minister's Commendation", titles of "People's Armed Forces Hero", "Labor Hero", and "National Model Worker", the deadlines for accepting application files and presenting to the State for commendation shall be carried out as follows:

- First round: Acceptance of application files before March 5th each year (based on the postmark) for Medals, Orders, "Prime Minister's Commendation", and the title of "National Model Worker". The Ministry's Commendation and Competition Council will convene from April 5th to April 15th each year. Complete the file to submit to the National Competition Council before April 25th each year. Specifically, for the title of "People's Armed Forces Hero" and "Labor Hero", the awarding process will take place at the National Competition Congress every five years during the National Patriotic Competition Congresses (in years ending in 5 and those in between) and accept applications during this period.

- Second round: Acceptance of application files before August 20th each year (based on the postmark) for Medals, Orders, and "Prime Minister's Commendation". The Ministry's Commendation and Competition Council will convene from September 15th to September 25th each year. Complete the file to submit to the National Competition Council before October 5th each year (combined with special forms of commendation for training institutions under the Ministry);

c) For immediate commendations: Immediately after achieving the achievement, the head of the agency or unit has the responsibility to prepare the file and send it to the Ministry's Commendation and Competition Council for review and presentation for commendation;

d) For competition titles and commendation forms within the authority of the head of the agency or unit with separate accounts and seals, the deadline for accepting application files is determined by the agency or unit.

Article 21. Examination of Application Files for Commendation

1. The Department of Competition and Commendation is responsible for receiving and conducting the examination of application files for commendation according to the provisions in point b, Clause 2, Article 48 of Decree No. 91/2017/NĐ-CP.

For commendation forms: "Golden Star Medal", "Ho Chi Minh Medal", "Independence Medal" (all categories), title of "Labor Hero", and "National Model Worker", prior to submitting the file to the Prime Minister for consideration and submission to the President (through the Central Competition and Commendation Board), the Department of Competition and Commendation must complete the file and report to seek the opinion of the Party Cadre Affairs Committee.

2. In cases where the application file is incomplete, within three working days, the Department of Competition and Commendation will notify the agency or unit to complete the file. Within the latest five working days from the date of receipt of the notification, the agency or unit is responsible for completing and resubmitting the file to the Department of Competition and Commendation.

3. After the examination results are obtained, within ten working days, the Department of Competition and Commendation will compile the results and submit them to the Chairman of the Ministry's Competition and Commendation Council.

Article 22. Procedures for considering awards and recommending awards to higher authorities

1. For the form of award "Golden Star Order", "Ho Chi Minh Order"; titles "People's Armed Forces Hero", "Labor Hero", "National Model Worker", after receiving the application file, the Department of Mobilization and Awards shall be responsible for reporting to the Minister and the Chairman of the Mobilization and Awards Council of the Ministry for their opinions before submitting to the Mobilization and Awards Council of the Ministry for discussion and voting. The result of the meeting of the Mobilization and Awards Council of the Ministry must reach at least 90% agreement from the total number of Council members (if a member is absent, their opinion will be obtained through voting).

2. For the consideration and granting of commendation titles and forms of awards to individuals and units under the Ministry, the Department of Mobilization and Awards shall complete the files and minutes of the Mobilization and Awards Council of the Ministry to submit to the Minister for decision on awarding within their authority, or to submit to the Prime Minister, President for consideration of awarding (through the Central Mobilization and Awards Board).

3. For the consideration and granting of the title "Ministry Flag" and "Ministry Commendation Certificate" to individuals and units under Departments, the Department of Mobilization and Awards shall present the results of the examination of the application files to the Mobilization and Awards Council of the Ministry for discussion and voting, completing the files and minutes of the Mobilization and Awards Council of the Ministry, and submitting to the Minister for decision.

4. For the consideration and recommendation of awards for individuals and units outside the sector: the Department of Mobilization and Awards shall submit to the Mobilization and Awards Council of the Ministry for review and submit to the Minister for decision.

5. For the consideration and recommendation of awards for Ministry Leaders: the Department of Mobilization and Awards shall propose to the Mobilization and Awards Council of the Ministry for submission to the Party Cadre and Civil Servant Affairs Committee for review and recommendation to the Minister for decision on awarding or to the competent authority for awarding.

6. After the Mobilization and Awards Council of the Ministry has met and reached a unified decision or taken opinions from its members, within seven working days, the Department of Mobilization and Awards shall complete all procedures as prescribed to submit to the Minister for decision on awarding or to the competent authority for awarding.

7. In cases of urgent awards, after receiving the application file, the Department of Mobilization and Awards shall report to the Chairman of the Mobilization and Awards Council of the Ministry for their opinion before organizing the collection of opinions from the Mobilization and Awards Council of the Ministry. After collecting opinions from the Mobilization and Awards Council of the Ministry, the Department of Mobilization and Awards shall complete the procedures to submit to the Minister for decision on awarding or to the competent authority for awarding.

Article 23. Organization of presenting commendation titles and forms of awards

1. Ceremonies for presenting and receiving national honors, State Awards, Orders, Medals, "Flag of Merit of the Government", "Certificate of Merit of the Prime Minister" shall be carried out in accordance with the provisions of Decree No. 145/2013/NĐ-CP dated October 29, 2013 of the Government on the organization of commemorative days; ceremonies for presenting and receiving forms of awards and commendation titles; diplomatic ceremonies and welcoming foreign guests.

2. The Minister, acting on behalf of the State, organizes the presentation of State awards; organizes the presentation of Ministry awards and delegates to the heads of agencies and units to organize presentations.

3. Heads of agencies and units shall be responsible for developing plans for award presentation ceremonies to submit to the Minister for approval.

Article 24. Management and storage of commendation files

The management and storage of commendation files at the Ministry and at units proposing commendations shall be carried out in accordance with the provisions of Circular No. 09/2011/TT-BNV dated June 3, 2011, issued by the Minister of Home Affairs on the retention period for competition and commendation files and documents.

Article 25. Reporting on competition and commendation work

1. Annually, units under the Ministry, Departments; Competition and Advancement Groups shall conduct summaries and evaluations of competition and commendation work and submit annual work summary reports to the Ministry (through the Department of Competition and Commendation) before December 5 each year.

2. When launching competitions and after each competition period, units shall organize mid-term and final summaries and submit reports to the Ministry (through the Department of Competition and Commendation) according to Model No. 11 attached to this Circular.

Chapter V

COMPETITION AND COMMENDATION COUNCIL AND INNOVATION COUNCIL

Article 26. Competition and Commendation Council of the Ministry

1. The Minister decides to establish the Competition and Commendation Council of the Ministry.

2. The Competition and Commendation Council of the Ministry consists of:

a) The Chairman of the Board is the Minister;

b) The Vice Chairman in charge of the Council is the Director of the Department of Competition and Commendation;

c) The Deputy Chairmen include the Director of the Department of Organization and Cadre, the Head of the Ministry's Office;

d) The Members include: the General Director of the Sports Administration; the General Director of the Tourism Administration; the Director of the Copyright Office; the Director of the Cultural Heritage Office; the Director of the Film Office; the Director of the International Cooperation Office; the Director of the Fine Arts, Photography and Exhibition Office; the Director of the Performing Arts Office; the Director of the Grassroots Culture Office; the Director of the Planning and Finance Department; the Director of the Legal Department; the Director of the Training Department; the Director of the Library Department; the Director of the Ethnic Culture Department; the Director of the Science, Technology and Environment Department; the Director of the Family Department; the Inspector General of the Ministry; the Standing Secretary of the Party Committee of the Ministry; the Chairman of the Ministry’s Trade Union; the Secretary of the Communist Youth Union of Ho Chi Minh City of the Ministry;

đ) The Council's secretariat includes one leader and some specialists from the Department of Competition and Commendation.

3. The tasks and powers of the Competition and Commendation Council of the Ministry shall be implemented in accordance with Clause 3, Article 62 of Decree No. 91/2017/NĐ-CP.

4. The Competition and Commendation Council of the Ministry operates based on the principle of democratic centralism and majority voting. In case of equal opinions among Council members, the opinion of the Chairman of the Council shall prevail.

Article 27. Competition and Commendation Councils at units under the Ministry

1. The head of units under the Ministry decides to establish the Competition and Commendation Council of their unit.

2. The Chairman of the Council is the head of the unit.

3. The Deputy Chairmen include the Chairman of the Trade Union and the Deputy Head of the unit.

4. The Permanent Member is the Head of the Department or Section responsible for competition and commendation.

5. The Members of the Council include representatives of the Party Committee, the Communist Youth Union of Ho Chi Minh City, Heads of specialized departments decided by the head of the unit.

6. The Secretary of the Council is a specialist assigned to handle competition and commendation work of the unit.

Article 28. Innovation Council at the Ministry level

1. The Minister decides to establish the Innovation Council at the Ministry level.

2. The composition and working principles of the Innovation Council at the Ministry level are stipulated by the Minister and implemented in accordance with the laws on competition and commendation. The Council has the task of examining, evaluating, and recognizing innovations and solutions that have an impact on the Ministry, the Sector, and the country.

3. The recognition of innovations is carried out in accordance with Decree No. 13/2012/NĐ-CP dated March 2, 2012, issued by the Government on the Charter of Innovations and Circular No. 18/2013/TT-BKHCN dated August 1, 2013, issued by the Minister of Science and Technology guiding the implementation of certain provisions of Decree No. 13/2012/NĐ-CP.

Article 29. Initiative Councils at agencies and units under the Ministry

1. The heads of agencies and units under the Ministry shall decide to establish the Initiative Council of their agency or unit.

2. The composition and working principles of the Initiative Councils at agencies and units under the Ministry shall be determined and implemented by the head of each agency or unit in accordance with the laws on competition and rewards. The Council shall have the tasks of examining, evaluating, and recognizing initiatives and work solutions of individuals that have an impact on the agency or unit; examining and proposing initiatives at the Ministry level and nationwide for individuals within its authority.

3. The recognition of innovations is carried out in accordance with Decree No. 13/2012/NĐ-CP dated March 2, 2012, issued by the Government on the Charter of Innovations and Circular No. 18/2013/TT-BKHCN dated August 1, 2013, issued by the Minister of Science and Technology guiding the implementation of certain provisions of Decree No. 13/2012/NĐ-CP.

Chapter VI

FUND FOR COMPETITION AND REWARD

Article 30. Sources and Levels of Deduction from the Competition and Reward Fund

1. The Competition and Reward Fund of the Ministry shall be established by the Minister in accordance with the provisions of the law.

2. The Competition and Reward Funds of agencies and units under the Ministry having separate seals and accounts shall be established by the heads of these agencies and units in accordance with the provisions of the law.

3. The sources and levels of deduction from the Competition and Reward Fund shall be carried out in accordance with the provisions of Clause 1, Article 65 of Decree No. 91/2017/ND-CP.

4. It is encouraged for organizations and individuals inside and outside the industry to support and contribute to supplementing the Competition and Reward Fund of the Ministry and the Competition and Reward Funds of agencies and units under the Ministry.

Article 31. Management and Use of the Competition and Reward Fund

1. The management and use of the Competition and Reward Fund shall be carried out in accordance with the provisions of Articles 66 and 67 of Decree No. 91/2017/ND-CP.

2. The Department of Competition and Rewards shall coordinate with relevant agencies and units to advise the Minister on managing and using the Competition and Reward Fund of the Ministry in accordance with the laws on finance.

Article 32. Responsibilities, Award Amounts, and Principles for Calculating Awards

1. Responsibility for award payments:

a) The Ministry of Culture, Sports and Tourism shall be responsible for paying awards for:

- Honorary titles and reward forms within the State's decision-making authority presented by the Ministry;

- Honorary titles and reward forms for individuals and groups receiving salaries at the Ministry's Office;

- Honorary titles and reward forms for individuals and groups during the annual work summary of the Ministry (with annual guidance documents);

- Other cases decided upon by the Minister.

b) Agencies and units under the Ministry with separate seals and accounts shall be responsible for paying awards for:

- Honorary titles and reward forms within the Minister's decision-making authority for individuals and groups of the agency or unit not covered by the provisions of point a, Clause 1 of this Article;

- Honorary titles and reward forms within the decision-making authority of the head of the agency or unit for individuals and groups under their responsibility;

- Other cases decided upon by the head of the agency or unit.

2. Amounts of awards accompanying honorary titles and reward forms shall be implemented in accordance with the provisions of Articles 69, 70, 71, 72, 73, and 74 of Decree No. 91/2017/ND-CP and related legal documents.

3. Principles for calculating awards:

a) In accordance with the provisions of Article 68 of Decree No. 91/2017/ND-CP;

Chapter VII

IMPLEMENTING PROVISIONS

Article 33. Implementation Organization

1. The Chairman of the Competition and Reward Council of the Ministry, the Director of the Department of Competition and Rewards, the Head of the Ministry's Office, the heads of agencies and units under the Ministry, the Directors of Departments, the Heads of Groups and Clusters, and related agencies and units shall be responsible for implementing this Circular.

2. The Department of Competition and Rewards - the permanent body of the Competition and Reward Council of the Ministry shall be responsible for urging, monitoring, and inspecting the implementation of competition and reward activities throughout the industry.

Article 34. Effective Date

This Circular shall take effect from October 15, 2019.

Circular No. 21/2014/TT-BVHTTDL dated December 12, 2014 of the Minister of Culture, Sports and Tourism regarding competition and reward activities in the culture, sports, and tourism sector shall cease to be effective from the date this Circular takes effect./.
