Circular No. 09/2024/TT-BVHTTDL abolishes certain regulatory legal documents issued by the Minister of Culture, Sports and Tourism.

CIRCULAR

ABOLISHING CERTAIN LEGAL DOCUMENTS ISSUED BY THE MINISTER OF CULTURE, SPORTS AND TOURISM, JOINTLY ISSUED

Pursuant to the Law on Legislative Regulatory Documents dated June 22, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Legislative Regulatory Documents dated June 18, 2020;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Issuing Legal Documents; Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing certain articles of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Issuing Legal Documents; Decree No. 59/2024/NĐ-CP dated May 25, 2024 of the Government amending and supplementing certain articles of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Issuing Legal Documents which has been amended and supplemented certain articles according to Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government;

Pursuant to Decree No. 01/2023/NĐ-CP dated January 16, 2023 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Legal Department;

The Minister of Culture, Sports and Tourism issues this Circular to abolish certain legal documents issued by the Minister of Culture, Sports and Tourism, jointly issued.

Article 1. Abolish entirely 23 legal documents

Abolish entirely the following 23 legal documents:

1. Circular No. 1590/TT-LN dated November 23, 1996 of the joint sector General Department of Land Administration - General Department of Physical Education and Sports guiding on planning, managing, and using land for the development of physical education and sports.

2. Joint Circular No. 21/1997/TTLB-BVHTT-TCTDTT dated April 2, 1997 of the Ministry of Culture - Information, General Department of Physical Education and Sports on coordinating cultural and information activities and physical education and sports at the grassroots level.

3. Directive No. 14/2002/CT-BVHTT dated May 27, 2002 of the Minister of Culture - Information on strengthening work to prevent the harmful effects of tobacco in the cultural and information sector.

4. Decision No. 19/2002/QĐ-BVHTT dated August 2, 2002 of the Minister of Culture - Information on issuing regulations on the content and form of examinations for promotion to the method of civil servant.

5. Decision No. 48/2003/QĐ-BVHTT dated August 21, 2003 of the Minister of Culture - Information on issuing the Regulation on managing staff files and internal affairs files.

6. Joint Circular No. 52/2003/TTLT-BVHTT-BTC dated August 29, 2003 of the joint Ministries of Culture - Information and Finance on guiding support for creative works and art projects and press works under the state order mechanism.

7. Directive No. 192/2003/CT-UBTDTT dated September 9, 2003 of the Chairman of the State Committee for Physical Culture and Sports on ensuring honesty and integrity in organizing and competing in sports events at the 22nd Southeast Asian Games and the 2nd ASEAN Para Games.

8. Decision No. 1916/2003/QĐ-UBTDTT dated November 17, 2003 of the Chairman of the State Committee for Physical Culture and Sports on issuing the regulation on spokespersons for the Chairman of the State Committee for Physical Culture and Sports.

9. Decision No. 44/2005/QĐ-UBTDTT dated January 13, 2005 of the Chairman of the State Committee for Physical Culture and Sports on issuing the Regulation on health assurance for athletes of various national sports teams.

10. Decision No. 61/2005/QĐ-BVHTT dated November 4, 2005 of the Minister of Culture - Information approving the Project on Socialization of Cultural Activities Development until 2010.

11. Decision No. 709/2005/QĐ-UBTDTT dated April 20, 2005 of the Chairman of the State Committee for Physical Culture and Sports on issuing the Regulation on inspecting sports competitions.

12. Decision No. 1135/2005/QĐ-UBTDTT dated June 1, 2005 of the Chairman of the State Committee for Physical Culture and Sports on the Regulation on the operation of the Office of the State Committee for Physical Culture and Sports.

13. Decision No. 1336/2005/QĐ-UBTDTT dated June 30, 2005 of the Chairman of the State Committee for Physical Culture and Sports approving the Project "Socialization of Physical Education and Sports Development until 2010".

14. Decision No. 1738/2005/QĐ-UBTDTT dated September 5, 2005 of the Chairman of the State Committee for Physical Culture and Sports on issuing the "Regulation on the Operation of the International Cooperation Department".

15. Decision No. 2260/2005/QĐ-UBTDTT dated November 30, 2005 of the Chairman of the State Committee for Physical Culture and Sports on issuing the "Regulation on Self-inspection and Handling of Legal Documents Issued by the State Committee for Physical Culture and Sports".

16. Directive No. 14/2006/CT-UBTDTT dated January 18, 2006 of the Chairman of the State Committee for Physical Culture and Sports on urgent work to rectify football activities.

17. Decision No. 64/2006/QĐ-BVHTT dated August 4, 2006 of the Minister of Culture - Information on issuing the Regulation on the Organization and Operation of the Heritage Management Department.

18. Decision No. 450/2006/QĐ-UBTDTT dated March 10, 2006 of the Chairman of the State Committee for Physical Culture and Sports on issuing the "Program on Popularizing and Educating Laws of the State Committee for Physical Culture and Sports in 2006-2007".

19. Decision No. 608/2006/QĐ-UBTDTT dated March 28, 2006 of the Chairman of the State Committee for Physical Culture and Sports on issuing the "Action Plan of the State Committee for Physical Culture and Sports to Implement the Government's Program on Anti-Corruption Law".

20. Decision No. 621/2006/QĐ-UBTDTT dated March 28, 2006 of the Chairman of the State Committee for Physical Culture and Sports on issuing the Action Plan of the State Committee for Physical Culture and Sports on Thrift and Anti-Waste.

21. Decision No. 1546/2006/QĐ-UBTDTT dated September 1, 2006 of the Chairman of the State Committee for Physical Culture and Sports on issuing the Regulation on Managing and Using Information of the Sports Industry Database.

22. Joint Circular No. 11/2007/TTLT-BVHTT-BTC dated May 21, 2007 of the joint Ministries of Culture - Information and Finance on guiding support for creative literary and artistic works and local literary and artistic associations during the period 2006-2010.

23. Joint Circular No. 17/2007/TTLT-BVHTT-BTC dated June 14, 2007 of the joint Ministries of Culture - Information and Finance on guiding support for high-quality press works at central and local levels during the period 2006-2010.

Article 2. Repeal part of nine regulatory legal documents

Repeal part of the following nine documents:

1. Repeal Article 2, Article 3, Article 4, Article 6, and Clause 1 of Article 8 of the Regulation on the organization and operation of cultural, sports, and tourism service organizations at district, county, town, and provincial city level under Decree No. 01/2010/TT-BVHTTDL dated February 26, 2010 issued by the Minister of Culture, Sports, and Tourism.

2. Repeal Criterion 1, 5.1, 5.3, 5.4, 6, and 8 of Article 2 of Circular No. 11/2010/TT-BVHTTDL dated December 22, 2010 issued by the Minister of Culture, Sports, and Tourism regarding the criteria for Cultural and Sports Centers at district, county, town, and provincial city level.

3. Repeal Clause 1 and Clause 3 of Article 3, and Criterion 4 of Article 6 of Circular No. 12/2010/TT-BVHTTDL dated December 22, 2010 issued by the Minister of Culture, Sports, and Tourism regarding the model of organization, operation, and criteria for Cultural and Sports Centers at commune level.

4. Repeal Article 4 and Criterion 5 of Article 6 of Circular No. 06/2011/TT-BVHTTDL dated March 8, 2011 issued by the Minister of Culture, Sports, and Tourism regarding the model of organization, operation, and criteria for Cultural Houses and Sports Areas at village level.

5. Repeal Clause 2 of Article 1 of Circular No. 11/2016/TT-BVHTTDL dated November 8, 2016 issued by the Minister of Culture, Sports, and Tourism regarding the professional conditions for organizing yoga training and competition.

6. Repeal Criterion 4 of Article 2 of Circular No. 14/2016/TT-BVHTTDL dated December 21, 2016 issued by the Minister of Culture, Sports, and Tourism regarding the criteria for Cultural and Sports Centers at ward and town level.

7. Repeal Article 3 of Circular No. 35/2018/TT-BVHTTDL dated November 19, 2018 issued by the Minister of Culture, Sports, and Tourism amending and supplementing certain provisions of Circulars No. 15/2012/TT-BVHTTDL, No. 10/2013/TT-BVHTTDL, No. 11/2014/TT-BVHTTDL, and No. 04/2016/TT-BVHTTDL.

8. Repeal certain phrases, articles, and clauses of Circular No. 01/2018/TT-BVHTTDL dated January 18, 2018 issued by the Minister of Culture, Sports, and Tourism detailing certain provisions of Decree No. 113/2013/NĐ-CP dated October 2, 2013 of the Government on fine arts activities.

a) Repeal the phrase "outdoor fine art works" and the phrase "Based on the scale and content of the work, the People's Committee of the province or centrally-administered city may delegate the Department of Culture, Sports, and Tourism or the Department of Culture and Sports to issue permits" in Clause 2 of Article 9.

b) Repeal Clause 3 of Article 9.

9. Repeal certain phrases, articles, and clauses of Circular No. 13/2023/TT-BVHTTDL dated October 30, 2023 issued by the Minister of Culture, Sports, and Tourism amending and supplementing regulations related to citizen documents in certain Circulars issued by the Minister of Culture, Sports, and Tourism.

a) Repeal Clause 1 and Clause 2 of Article 4.

b) Repeal the phrase "Attached documents include: A certified copy of the Representative Office Establishment Permit that has been issued" in the Application for Amending and Supplementing the Representative Office Establishment Permit of foreign advertising enterprises in Form No. 4 of Appendix III.

Article 3. Implementation Provisions

1. This Circular shall take effect from December 10, 2024.

2. Heads of agencies and units under the Ministry; Directors of Departments of Culture, Sports, and Tourism, Departments of Culture and Sports, and Departments of Tourism of provinces and centrally-administered cities, and relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
