Provisions on forestry statistics

Circular No. 12/2019/TT-BNNPTNT dated October 25, 2019, issued by the Minister of Agriculture and Rural Development, stipulates provisions on forestry statistics, which took effect from December 15, 2019, amended and supplemented by:
Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development, amending and supplementing certain articles of circulars in the forestry sector, which took effect from February 1, 2023.
Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Law on Statistics dated November 23, 2015;
Pursuant to the Decree No. 94/2016/NĐ-CP dated July 1, 2016 of the Government detailing and guiding the implementation of certain provisions of the Law on Statistics;
Pursuant to Decree No. 97/2016/NĐ-CP dated July 1, 2016, issued by the Government, stipulating the contents of statistical indicators within the national statistical indicator system;
Pursuant to Decree No. 60/2018/NĐ-CP dated April 20, 2018, issued by the Government on detailed contents of the national-level statistical reporting system;
Pursuant to Decision No. 27/2018/QĐ-TTg dated July 6, 2018, issued by the Prime Minister, promulgating the Vietnamese Economic Classification;
Pursuant to Decision No. 43/2018/QĐ-TTg dated November 1, 2018, issued by the Prime Minister, promulgating the Vietnamese Product Classification;
Pursuant to Decision No. 54/2016/QĐ-TTg dated December 19, 2016, issued by the Prime Minister, promulgating the Provincial, District, and Commune Level Statistical Indicator System;
At the proposal of the Director General of the Forest Administration;
The Minister of Agriculture and Rural Development hereby issues this Circular stipulating provisions on forestry statistics.[1]
Article 1. Scope of Regulation
Article 1. This Circular stipulates the forestry statistical indicator system; the reporting regime for forestry statistics.
Article 2. For other reports not covered by this Circular, agencies, organizations, and individuals shall implement according to regulations set forth in documents issued by competent state management agencies.
Article 2. Applicability
This Circular applies to agencies, organizations, and individuals implementing the reporting regime for forestry statistics; agencies, organizations, and individuals related to forestry statistics work, including:
1.[2] The Forestry Service, the Forest Protection Service, and the Digital Transformation and Agricultural Statistics Center under the Ministry of Agriculture and Rural Development.
2. Departments of Agriculture and Rural Development.
3. Provincial Forest Protection Agencies.
4. District Forest Protection Agencies or units assigned to perform forestry statistics tasks at the district level in areas without district-level Forest Protection Agencies.
5. Agencies, organizations, and individuals related to forestry statistics work.
Article 3. Principles of forestry statistics
1. Truthfulness, objectivity, accuracy, completeness, and timeliness.
2. Independence in professional and operational statistics.
3. Uniformity in operations, no duplication, no overlap.
4. Transparency.
5. Comparability.
Article 4. Content of the Forestry Statistical Indicator System
1. The forestry statistical indicator system is a collection of statistical indicators reflecting the situation and results of activities in the forestry sector under the management authority of the Ministry of Agriculture and Rural Development.
2. The forestry statistical indicator system includes:
a) The list of forestry statistical indicators specified in Section I of Appendix I attached to this Circular;
b) The content of forestry statistical indicators specified in Section II of Appendix I attached to this Circular.
Article 5. Content of the Reporting Regime for Forestry Statistics
1. The reporting regime for forestry statistics is stipulated in Appendix II attached to this Circular.
2.[3] Provincial-level forestry statistics report
a) Reporting unit: Provincial Forest Protection Agency;
b) Receiving unit: The Forestry Service, the Forest Protection Service, and the Department of Agriculture and Rural Development.
3. District-level forestry statistics report
a) Reporting unit: District Forest Protection Agency or unit assigned to perform forestry statistics tasks at the district level in areas without district-level Forest Protection Agencies;
b) Receiving unit: Provincial Forest Protection Agency.
4. Reporting periods
a) Monthly statistics reports start from the first day of the month until the last day of that month;
b) Quarterly statistics reports start from the first day of the first month of the quarter until the last day of the reported quarter;
c) Six-monthly statistics reports start from January 1 until June 30 of the reporting period;
d) Annual statistics reports start from January 1 until December 31 of each year;
đ) Ad hoc statistics reports are conducted when there is an urgent requirement.
5. The deadline for receiving reports is specified in the upper left corner of each report form as stipulated in Appendix II attached to this Circular.
6. Methods of submitting reports
a) Written reports on paper with signatures and seals of the heads of the reporting agencies or units, or electronic files verified by digital signatures of the heads of the reporting agencies or units;
b) Submission through the electronic reporting software system, data entered via software must match the written reports and electronic files specified in point a of this clause.
Article 6. Responsibility for Implementation
1.[4] The Forestry Service
a) Implement the application of information technology in the process of integrating, storing, and exploiting forestry statistics data from specialized software applications; take the lead or coordinate in organizing forestry statistics surveys within the scope of management of the Ministry of Agriculture and Rural Development;
b) Guide, inspect, and report on the implementation of the forestry statistical indicator system and reporting regime for forestry statistics as stipulated in this Circular; request reporting units to inspect, provide, and re-supply reports and related information when necessary to verify the accuracy of the reported data;
c) Aggregate statistical information and forestry statistics reports to the Ministry of Agriculture and Rural Development as prescribed;
d) Manage, use, and secure forestry statistics information in accordance with the law;
đ) Serve as the focal point for coordinating with the General Statistics Office in collecting, aggregating, comparing, and unifying statistical data within the statistical indicator list; serve as the focal point for providing audit files for the forestry statistical indicator system;
e) Coordinate with relevant agencies and units to review the list and content of statistical report forms as prescribed by this Circular to promptly propose amendments and supplements to the report forms to align with practical needs.
2.[5] The Digital Transformation and Agricultural Statistics Center
a) Post online forms (in PDF, Excel format), update guiding documents and materials, store report data files and published statistical information on the Ministry of Agriculture and Rural Development's electronic portal in accordance with the statistical reporting system;
b) Coordinate with relevant agencies and units to guide and implement measures to ensure information security in managing statistical information;
2a.[6] Forest Protection Department
a) Coordinate with the Forestry Department to urge, compile, and update forestry statistical data for forest protection indicators and forest cover ratio; coordinate to organize forestry statistical surveys within the scope of management by the Ministry of Agriculture and Rural Development;
b) Coordinate to guide, inspect, and report on the implementation results of the statistical index system and the forestry statistical reporting system;
3. Provincial Departments of Agriculture and Rural Development
a) Direct and assign tasks to the Forest Protection Agency and related agencies to implement the forestry statistical reporting system;
b) Train and guide statistical procedures for the Forest Protection Agency and provincial and district-level agencies responsible for forestry statistics;
c) Direct subordinate agencies to closely cooperate with the same-level statistical agencies;
4. Provincial Forest Protection Agencies
a) Compile and provide forestry statistical data within their jurisdiction; assign tasks to subordinate units to implement the statistical reporting system as stipulated in this Circular;
b) Collect data and statistical information from: Group II forest owners with forest areas spanning two or more districts within the province; the Provincial Forest Protection Fund or organizations performing the functions of the Provincial Forest Protection Fund; the District Forest Protection Agency or units assigned to perform forestry statistics at the district level where there is no District Forest Protection Agency;
c) Report fully, accurately, and on time, as specified in the statistical reporting system, and be responsible for the contents of the reports according to the law;
d) Coordinate with the General Statistics Office in allocating, collecting, verifying, and unifying forestry statistical data in the area;
đ) Inspect, re-supply reports and related information when requested by the receiving unit;
5. District Forest Protection Agencies or units assigned to perform forestry statistics at the district level where there is no District Forest Protection Agency
a) Organize the collection, compilation, and provision of forestry statistical data within their jurisdiction; select and delegate specific tasks and areas to rangers to carry out statistical work;
b) Organize the collection of data and statistical information from Group II forest owners within the district; compile statistical information from rangers within the district for Group I forest owners. If the District Forest Protection Agency manages two or more districts, separate the data and information by district before submitting the report;
c) Report fully, accurately, and on time, as specified in the statistical reporting system, and be responsible for the contents of the reports according to the law;
d) Coordinate with the District Statistics Office in allocating, collecting, verifying, and unifying forestry statistical data in the area;
đ) Inspect, re-supply reports and related information when requested by the receiving unit;
6. Agencies and organizations implementing the statistical reporting system shall exercise rights and obligations as prescribed in Article 44 of the Law on Statistics. Statistical activities at state agencies and public service units shall be carried out in accordance with Article 65 of the Law on Statistics;
Article 7. Effective Date[7]
1. This Circular takes effect from December 15, 2019;
2. The provisions regarding the statistical index system and the forestry statistical reporting system in Decision No. 3201/QĐ-BNN-KH dated November 26, 2010, issued by the Ministry of Agriculture and Rural Development, ceases to be effective from the date this Circular takes effect;
3. In the course of implementation, if any difficulties arise, please reflect them to the Ministry of Agriculture and Rural Development for research, guidance, amendment, and supplementation./.

[1] Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development on Amending and Supplementing Certain Provisions of Circulars in the Forestry Sector is based on the following grounds for issuance;
Pursuant to Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Forestry Law dated November 15, 2017;
At the proposal of the Director of the Forest Management Department;
The Minister of Agriculture and Rural Development issues this Circular amending and supplementing certain provisions of Circulars in the forestry sector;
[2] This Clause is amended and supplemented in accordance with Clause 1, Article 6 of Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development on Amending and Supplementing Certain Provisions of Circulars in the Forestry Sector, which takes effect from February 1, 2024;
[3] This Clause is amended and supplemented in accordance with Clause 2, Article 6 of Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development on Amending and Supplementing Certain Provisions of Circulars in the Forestry Sector, which takes effect from February 1, 2024;
[4] This Clause is amended and supplemented in accordance with Point a, Clause 3, Article 6 of Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development on Amending and Supplementing Certain Provisions of Circulars in the Forestry Sector, which takes effect from February 1, 2024;
[5] The phrase "Information Technology and Statistics Center" is replaced by the phrase "Digital Transformation and Agricultural Statistics Center" in accordance with Point c, Clause 3, Article 6 of Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development on Amending and Supplementing Certain Provisions of Circulars in the Forestry Sector, which takes effect from February 1, 2024.
[6] This Clause is added pursuant to Point b, Clause 3, Article 6 of Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development on amending and supplementing certain Articles of Circulars in the forestry sector, which shall take effect from February 1, 2024.
[7] This Article is amended and supplemented by Article 14 of Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development on Amending and Supplementing Certain Articles of Circulars in the Forestry Sector, which shall take effect from February 1, 2023.
