CIRCULAR
Regulations on Delegation of Authority, Decentralization, and Definition of Competence
to Carry Out State Management Tasks of Two-Tier Local Authorities
for General Education
Pursuant to Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly on handling certain issues related to the restructuring of the state apparatus;
Pursuant to the Government Decree No. 37/2025/NĐ-CP dated February 26, 2025, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Government Decree No. 142/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the definition of competence of two-tier local authorities in the field of state management by the Ministry of Education and Training;
Pursuant to Government Decree No. 143/2025/NĐ-CP dated June 12, 2025 of the Government stipulating delegation of authority and decentralization in the field of state management by the Ministry of Education and Training;
At the proposal of the Director of the Department of General Education;
The Minister of Education and Training issues this Circular to regulate the delegation of authority, decentralization, and definition of competence to carry out state management tasks of two-tier local authorities for general education.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Circular regulates the delegation of authority, decentralization, and definition of competence to carry out state management tasks of two-tier local authorities for general education as prescribed in the legal normative documents of the Minister of Education and Training.
Article 2. This Circular applies to central administrative agencies, local authorities, general education institutions, and other organizations and individuals related thereto.
Article 2. Principles of Delegation of Authority, Decentralization, and Definition of Competence
Clause 1. Ensuring compliance with the Constitution; consistent with the principles and provisions on delegation of authority, decentralization, and definition of competence under the Law on Organization of the Government, the Law on Organization of Local Administration, and Government Decrees on delegation of authority, decentralization, and definition of competence regarding general education. Clause 2. Ensuring delegation of authority, decentralization, and definition of tasks and powers between different levels of local authorities in accordance with the tasks, powers, and capabilities of the agencies and competent persons; avoiding overlap, duplication, or omission of functions and tasks between different levels of local authorities and among agencies and organizations under local authorities in carrying out state management tasks in the field of general education.
Clause 3. Ensuring that it does not affect the implementation of international treaties and agreements in the field of education to which the Socialist Republic of Vietnam is a party.
Clause 4. Resources for implementing tasks of delegation of authority, decentralization, and definition of competence shall be guaranteed from the state budget in accordance with the regulations.
Article 4. Principles of Utilization and Management of Electronic Data
Article 3. On Fees and Charges
Agencies implementing administrative procedures have the responsibility to utilize electronic data already available in the National Population Database and other specialized databases to supplement information in the electronic files of individuals and organizations implementing administrative procedures; they shall not require individuals and organizations to submit or present documents whose information has been obtained from these databases, except when such data is used for verification or rechecking the authenticity of the information, documents, or materials that have been digitized.
Article 4. Principles of Utilization and Management of Electronic Data
Agencies implementing administrative procedures are responsible for utilizing electronic data already available in the National Population Database and other specialized databases to supplement information in the electronic files of individuals and organizations implementing administrative procedures; they shall not require individuals and organizations to submit or present documents whose information has been obtained from these databases, except when such data is used for verification or rechecking the authenticity of the information, documents, or materials that have been digitized.
Chapter II
DELEGATION OF AUTHORITY, DECENTRALIZATION, AND DEFINITION OF COMPETENCE
TO CARRY OUT STATE MANAGEMENT TASKS OF LOCAL
AUTHORITIES AT TWO LEVELS FOR GENERAL EDUCATION
Article 5. Implementation organization of regulations on transferring schools and receiving students to study at secondary schools
1. The authority to issue transfer certificates for secondary education level as stipulated in point f, Clause 1, Article 5 of the Decision on transferring schools and receiving students to study at secondary and high schools issued together with Decision No. 51/2002/QĐ-BGDĐT dated December 25, 2002 of the Minister of Education and Training (hereinafter referred to as Decision No. 51/2002/QĐ-BGDĐT) shall be exercised by the Chairman of the People's Committee of the commune where the student is leaving.
2. The authority to receive, introduce to the school in the place of residence, and check the files as stipulated in point a, Clause 2, Article 5 and Clause 1, Article 11 of Decision No. 51/2002/QĐ-BGDĐT shall be exercised by the People's Committee of the commune where the student is moving to.
3. The authority to examine and decide exceptional cases regarding the time limit for transferring schools for the secondary education level as stipulated in Clause 3, Article 5 of Decision No. 51/2002/QĐ-BGDĐT shall be exercised by the Chairman of the People's Committee of the commune where the student is moving to.
4. Replace the phrase "Department of Education and Training" with the phrase "People's Committee of the commune" in point c, Clause 2, Article 21 of Decision No. 51/2002/QĐ-BGDĐT.
Article 6. Implementation organization of regulations on inclusive education for children in difficult circumstances
The authority to organize the implementation of regulations on inclusive education for children in difficult circumstances as stipulated in Clause 2, Article 23 of the Circular on Inclusive Education for Children in Difficult Circumstances issued together with Circular No. 39/2009/TT-BGDĐT dated December 29, 2009 of the Minister of Education and Training (hereinafter referred to as Circular No. 39/2009/TT-BGDĐT) shall be exercised by the People's Committee of the commune.
Article 7. Implementation organization of regulations on scholarship payment and cost support
The authority to manage and organize the implementation of scholarship payment and cost support for purchasing means of transportation and learning materials specifically for persons with disabilities as stipulated in the first and third bullet points of point b, Clause 2, Article 8 of the Joint Circular No. 42/2013/TTLT-BGDĐT-BLĐTBXH-BTC dated December 31, 2013 on policies for education of persons with disabilities (hereinafter referred to as Joint Circular No. 42/2013/TTLT-BGDĐT-BLĐTBXH-BTC) shall be exercised by the People's Committee of the commune.
Article 8. Implementation organization of regulations on evaluating general education students
1. The authority to direct schools within the same locality to accept and hand over educational results of students as stipulated in Clause 3, Article 12 of the Circular on Evaluating Elementary School Students issued together with Circular No. 27/2020/TT-BGDĐT dated September 4, 2020 of the Minister of Education and Training (hereinafter referred to as Circular No. 27/2020/TT-BGDĐT) shall be exercised by the People's Committee of the commune.
2. The authority to organize the implementation of evaluation of elementary school students within the locality as stipulated in point a, Clause 1, Article 14 of Circular No. 27/2020/TT-BGDĐT shall be exercised by the People's Committee of the commune.
3. The authority to direct the principal to organize the implementation of evaluation, acceptance, and handover of educational results and monitor, inspect, and resolve difficulties and issues during the implementation of the evaluation of elementary school students within the locality as stipulated in Clauses 2 and 3, Article 14 of Circular No. 27/2020/TT-BGDĐT shall be exercised by the People's Committee of the commune.
4. The authority to direct the organization of the implementation of evaluation of secondary school students; direct and guide educational institutions to use Student Monitoring and Evaluation Books (by class), Student Monitoring and Evaluation Books (by teacher), Student Records; guide the use of electronic file formats; inspect and resolve issues during the implementation of the regulation on evaluating secondary school students as stipulated in Article 17 of Circular No. 22/2021/TT-BGDĐT dated July 20, 2021 of the Minister of Education and Training on the evaluation of secondary school students and high school students (hereinafter referred to as Circular No. 22/2021/TT-BGDĐT) shall be exercised by the People's Committee of the commune.
5. Replace the phrase "hospitals at district level and above" with the phrase "authorized healthcare facilities" in Clause 2, Article 10; replace the phrase "District/County/City/District" with the phrase "Commune/ward/special zone" and remove the phrase "Commune (ward, town):" from the attached annexes to Circular No. 22/2021/TT-BGDĐT.
Article 9. Organization to implement provisions on the分级管理小学、初中、完全中学(最高学段为初中)、半寄宿制普通高中和初中寄宿制普通高中的规定
Clause 1. The authority to manage primary schools and perform state management functions for various types of primary school classes as stipulated in Article 6 of the Primary School Regulations issued together with Circular No. 28/2020/TT-BGDĐT dated September 4, 2020, by the Minister of Education and Training (hereinafter referred to as Circular No. 28/2020/TT-BGDĐT), shall be carried out by the People's Committee at the commune level.
Clause 2. The authority to manage junior high schools and complete secondary schools (with the highest grade being junior high school) as stipulated in Clause 1 of Article 6 of the Junior High School, Secondary General High School, and Complete Secondary School Regulations issued together with Circular No. 32/2020/TT-BGDĐT dated September 15, 2020, by the Minister of Education and Training (hereinafter referred to as Circular No. 32/2020/TT-BGDĐT), shall be carried out by the People's Committee at the commune level.
Clause 3. The authority to manage semi-residential general high schools as stipulated in Article 7 of the Organizational Structure and Operation Regulations of Semi-Residential General High Schools issued together with Circular No. 03/2023/TT-BGDĐT dated February 6, 2023, by the Minister of Education and Training (hereinafter referred to as Circular No. 03/2023/TT-BGDĐT), shall be carried out by the People's Committee at the commune level.
Clause 4. The authority to manage residential general high schools for junior high students as stipulated in Clause 1 of Article 6 of the Organizational Structure and Operation Regulations of Residential General High Schools issued together with Circular No. 04/2023/TT-BGDĐT dated February 23, 2023, by the Minister of Education and Training (hereinafter referred to as Circular No. 04/2023/TT-BGDĐT), shall be carried out by the People's Committee at the commune level.
Article 10. Organization to implement provisions on online teaching in general education institutions and regular education institutions
Clause 1. The authority to implement provisions on the management and organization of online teaching in general education institutions and regular education institutions as stipulated in Articles 13 and 14 of Circular No. 09/2021/TT-BGDĐT dated March 30, 2021, by the Minister of Education and Training regarding the management and organization of online teaching in general education institutions and regular education institutions (hereinafter referred to as Circular No. 09/2021/TT-BGDĐT), shall be carried out by the People's Committee at the commune level.
2. Replace the phrase "People's Committee of district, town, township, city under province, city directly under the central government (hereinafter collectively referred to as People's Committee at the district level)" with the phrase "People's Committee at the commune level" in Clause 1 of Article 11; replace the phrase "Education and Training Department" with the phrase "People's Committee at the commune level" in Clause 3 of Article 12; remove the phrase "Education and Training Department" in Clause 6 of Article 15 and Article 19; abolish Clause 1 of Articles 13 and 14 in Circular No. 09/2021/TT-BGDĐT.
Article 11. Organization to implement provisions on the establishment, recognition of school councils and chairpersons, principals, vice-principals, and management responsibilities for private primary schools, junior high schools, secondary general high schools, and complete secondary schools
Clause 1. The authority to establish private primary schools, junior high schools, and complete secondary schools (with the highest grade being junior high school) as stipulated in Clause 1 of Article 5 of the Organizational Structure and Operation Regulations of Private Primary Schools, Junior High Schools, Secondary General High Schools, and Complete Secondary Schools issued together with Circular No. 40/2021/TT-BGDĐT dated December 30, 2021, by the Minister of Education and Training (hereinafter referred to as Circular No. 40/2021/TT-BGDĐT), shall be carried out by the Chairman of the People's Committee at the commune level.
Clause 2. The authority to manage private primary schools, junior high schools, and complete secondary schools (with the highest grade being junior high school) as stipulated in Clause 1 of Article 5 of Circular No. 40/2021/TT-BGDĐT shall be carried out by the People's Committee at the commune level.
Clause 3. The authority to recognize school councils and chairpersons for private primary schools, junior high schools, and complete secondary schools (with the highest grade being junior high school) as stipulated in Point b, Clause 3 of Article 7 of Circular No. 40/2021/TT-BGDĐT shall be carried out by the Chairman of the People's Committee at the commune level.
Clause 4. The authority to recognize principals and vice-principals for private primary schools, junior high schools, and complete secondary schools (with the highest grade being junior high school) as stipulated in Point a, Clause 3 of Article 9 of Circular No. 40/2021/TT-BGDĐT shall be carried out by the Chairman of the People's Committee at the commune level.
Clause 5. Replace the term "district" with the term "commune"; replace the phrase "Director of the Education and Training Department" with the phrase "Chairman of the People's Committee at the commune level" in Circular No. 40/2021/TT-BGDĐT.
Article 12. Organization to implement regulations on teaching and learning Vietnamese for ethnic minority children before entering first grade
The authority to develop plans to implement the organization of teaching Vietnamese for ethnic minority children before entering first grade; advise the provincial People's Committee to develop investment plans for infrastructure, resources, and funding to ensure conditions for organizing Vietnamese language teaching for ethnic minority children before entering first grade as stipulated in Clause 3, Article 20, and Article 22 of Circular No. 23/2023/TT-BGDĐT dated December 8, 2023, issued by the Minister of Education and Training on teaching and learning Vietnamese for ethnic minority children before entering first grade (hereinafter referred to as Circular No. 23/2023/TT-BGDĐT) shall be carried out by the People's Committee at the commune level.
Article 13. Organization to implement regulations on selecting textbooks in general education institutions
1. Replace the phrase "reviewing the dossier" with the phrase "screening the dossier" in Article 8, Clause 1 of Article 15 of Circular No. 27/2023/TT-BGDĐT dated December 28, 2023, issued by the Minister of Education and Training on selecting textbooks in general education institutions (hereinafter referred to as Circular No. 27/2023/TT-BGDĐT). The authority to screen dossiers for textbook selection of primary and secondary schools as stipulated in Clause 1, Article 8 of Circular No. 27/2023/TT-BGDĐT shall be carried out by the People's Committee at the commune level.
2. The authority stipulated in Article 15 of Circular No. 27/2023/TT-BGDĐT shall be carried out by the People's Committee at the commune level.
Article 14. Organization to implement regulations on the graduation examination regulation
1. The authority to recognize secondary school graduation as stipulated in Article 12 of the Secondary School Graduation Recognition Regulation issued together with Circular No. 31/2023/TT-BGDĐT dated December 29, 2023, issued by the Minister of Education and Training (hereinafter referred to as Circular No. 31/2023/TT-BGDĐT) shall be carried out by the People's Committee at the commune level.
2. The authority to establish the Graduation Recognition Examination Board, decide on graduation recognition, announce the list of students recognized as graduating from secondary school, organize the issuance of graduation certificates to recognized graduates as stipulated in Clause 1, Article 7, Article 8, Clause 2, and Clause 7, Article 14 of Circular No. 31/2023/TT-BGDĐT shall be carried out by the Chairman of the People's Committee at the commune level.
Article 15. Organization to implement regulations on management organization and operation of schools and classes for persons with disabilities
1. The authority to guide, inspect, and manage the organization of teaching and educating students with disabilities (for both public and private types); allocate staffing and funding for hiring, contracting teachers and civil servants for other positions, contractual workers, and investing in infrastructure (for public type) of Specialized Education Schools, high schools with Specialized Education Classes or high schools with Specialized Education Classes following the regular education curriculum stipulated in Articles 28 and 29 of the Regulations on the Organization and Operation of Schools and Classes for Persons with Disabilities issued together with Circular No. 27/2024/TT-BGDĐT dated December 26, 2024, issued by the Minister of Education and Training (hereinafter referred to as Circular No. 27/2024/TT-BGDĐT) shall be carried out by the People's Committee at the provincial level.
2. The authority to guide, inspect, and manage the organization of teaching and educating students with disabilities (for both public and private types); allocate staffing and funding for hiring, contracting teachers and civil servants for other positions, contractual workers, and investing in infrastructure (for public type) of schools with remaining Specialized Education Classes stipulated in Articles 28 and 29 of Circular No. 27/2024/TT-BGDĐT shall be carried out by the People's Committee at the commune level.
Article 16. Implementation of regulations on supplementary teaching and learning
1. The management authority over supplementary teaching and learning activities within its jurisdiction; guiding and inspecting the implementation of regulations on supplementary teaching and learning within its jurisdiction; handling or recommending competent authorities to handle violations; supervising and inspecting compliance with legal provisions on working hours, overtime hours, and legal provisions on security, public order, safety, environmental hygiene, and fire prevention of organizations and individuals conducting supplementary teaching and learning outside schools as stipulated in Article 10 of Circular No. 29/2024/TT-BGDĐT dated December 30, 2024 issued by the Minister of Education and Training on supplementary teaching and learning (hereinafter referred to as Circular No. 29/2024/TT-BGDĐT) shall be carried out by the People's Committee of the commune.
2. Replace the phrase "People's Committees at all levels" with the phrase "People's Committee of the commune," the phrase "education management agencies" with the phrase "education management agency" in point a, Clause 2, Article 8; the word "district" with the word "commune"; the phrase "Department of Education and Training" with the phrase "People's Committee of the commune, ward, special administrative region" in the title and note 4 of Model No. 03 in the Appendix; remove the phrase "Direct the People's Committee of the commune" in Clause 3, Article 10; remove the line "..., day... month... year..." in the title of Model No. 03 in the Appendix; abolish Article 11, Article 12 in Circular No. 29/2024/TT-BGDĐT.
Article 17. Implementation of regulations on establishing the Secondary School Admissions Council
1. The authority to establish the Secondary School Admissions Council, approve the secondary school admissions plan, and approve the list of successful candidates (except for secondary schools under universities, colleges, and research institutes) as stipulated in Clause 1, Clause 2, Article 6, Clause 1, Clause 3, Article 7 of the Regulations on Secondary School Admissions and High School Admissions issued together with Circular No. 30/2024/TT-BGDĐT dated December 30, 2024 by the Minister of Education and Training (hereinafter referred to as Circular No. 30/2024/TT-BGDĐT) shall be carried out by the Chairman of the People's Committee of the commune.
2. The authority to direct and manage secondary school admissions work as stipulated in Article 17 of Circular No. 30/2024/TT-BGDĐT shall be carried out by the People's Committee of the commune.
Article 18. Amending and supplementing certain articles of some normative legal documents of the Minister of Education and Training
1. Amend and supplement certain articles of Circular No. 39/2009/TT-BGDĐT as follows:
a) Amend Clause 2 and point a Clause 2, Article 23 as follows:
"2. The People's Committee of the commune has the responsibility:
a) To submit to the People's Council of the commune for approval the plan and budget for inclusive education and incorporate it into the overall educational development plan of the locality;"
b) Add points d, đ, and e to Clause 2, Article 23 as follows:
"d) Assign staff responsible for inclusive education work; inspect, evaluate, and support inclusive education for educational institutions under its management.
đ) Form a core team for inclusive education; enter into labor contracts with support staff for inclusive education institutions.
e) Report periodically on inclusive education work for children in difficult circumstances according to the requirements of the Department of Education and Training."
c) Amend and supplement Clause 3, Article 24 as follows:
"3. Assign staff responsible for inclusive education work; inspect, evaluate, and support inclusive education for communes and educational institutions directly under the Department."
d) Abolish Article 25.
2. Amend and supplement certain articles of Joint Circular No. 42/2013/TTLT-BGDĐT-BLĐTBXH-BTC as follows:
a) Amend and supplement Article 6 as follows:
"Article 6. Tuition Fee Policy
Persons with disabilities studying at educational institutions are exempted from or granted reductions in tuition fees and supported in educational expenses according to current regulations."
b) Amend and supplement the first bullet point, point a, Clause 1, Article 8 as follows:
"- Certificate of disability issued by the competent authority in accordance with regulations."
c) Amend and supplement the second bullet point, point a, Clause 1, Article 8 as follows:
"- Certificate of being a poor household or near-poor household issued by the competent authority in accordance with regulations."
d) Amend and supplement the first bullet point, point a, Clause 2, Article 8 as follows:
"- For persons with disabilities studying at educational institutions managed by the commune level, send to the People's Committee of the commune."
đ) Amend and supplement the third bullet point, point a, Clause 2, Article 8 as follows:
"- For persons with disabilities residing in the commune area, currently studying at higher education institutions or vocational training institutions nationwide, send to the People's Committee of the commune."
e) Amend and supplement the fifth bullet point, point a, Clause 2, Article 8 as follows:
"- Certificate of disability issued by the competent authority in accordance with regulations."
g) Amend and supplement the sixth bullet point, point a, Clause 2, Article 8 as follows:
"- Certificate of being a poor household or near-poor household issued by the competent authority in accordance with regulations."
h) Amend and supplement Clause 2, Article 9 as follows:
"2. Public educational institutions where persons with disabilities have dropped out or been expelled shall be responsible for notifying the immediate superior management agency; non-public educational institutions where persons with disabilities have dropped out or been expelled shall be responsible for notifying the People's Committee of the commune and the Department of Education and Training within 15 working days from the date of dropout or expulsion to stop granting scholarships and funding for purchasing study materials and equipment."
i) Amend and supplement the Appendix - Application Form as follows:
- Replace the phrase "Permanent Resident Registration" with the phrase "Place of Permanent Residence";
- Remove the phrase "District (Quarter)".
3. Amend and supplement certain articles of Circular No. 27/2020/TT-BGDĐT as follows:
a) Supplement point c, Clause 2, Article 10 as follows:
"c) Digitalized Student Record Book is the Student Record Book implemented in a digital environment according to the guidelines of the Ministry of Education and Training."
b) Amend and supplement point b, Clause 1, Article 14 as follows:
"b) Guide the use of student assessment files and Student Record Books in cases of implementing digital student assessment files and Student Record Books according to the guidelines of the Ministry of Education and Training."
c) Replace the word "district" with the word "commune" in Clause 3, Article 12, Article 14; replace the phrase "Department of Education and Training" with the phrase "People's Committee of the commune" in Article 14, Article 15; replace the phrase "Director of the Department of Education and Training" with the phrase "Chairman of the People's Committee of the commune" in Clause 3, Article 12.
4. Amend and supplement certain articles of Circular No. 28/2020/TT-BGDĐT as follows:
a) Amend and supplement point a, Clause 3, Article 5 as follows:
"3. The school nameplate shall include the following information:
a) Top left corner: First line: People's Committee of commune, ward, special administrative zone (hereinafter referred to collectively as People's Committee of commune).
b) Amend and supplement Clause 3 of Article 20 as follows:
“3. Participate in investigation, update data and manage files on universal education, compulsory education, and eradication of illiteracy within the assigned area; coordinate to inspect and evaluate the results of universal education, compulsory education, and eradication of illiteracy at the commune level; advise the commune-level authority to request the provincial People's Committee to inspect and recognize the achievement of universal education, compulsory education, and eradication of illiteracy standards as prescribed.”
c) Replace the term "district" with the term "commune"; replace the phrase "Director of the Education and Training Department" with the phrase "Chairman of the People's Committee of commune"; replace the phrase "Chairman of the People's Committee of district" with the phrase "Chairman of the People's Committee of commune".
5. Amend and supplement some articles of Circular No. 32/2020/TT-BGDĐT as follows:
a) Amend and supplement point a, Clause 3, Article 5 as follows:
"3. The school nameplate shall include the following information:
a) Top left corner:
- For secondary schools where the highest grade level is junior high school: First line: People's Committee of commune, ward, special administrative zone (hereinafter referred to collectively as People's Committee of commune).
b) Amend and supplement Clause 3 of Article 20 as follows:
“3. The school participates in investigation, update data and manage files on universal junior high school education within the assigned area; coordinate to inspect and evaluate the results of universal junior high school education at the commune level; advise the commune-level authority to request the provincial People's Committee to inspect and recognize the achievement of universal junior high school education standards as prescribed.”
c) Amend and supplement Clause 4 of Article 22 as follows:
“4. Students who complete the junior high school curriculum and meet the conditions stipulated by the Ministry of Education and Training shall be issued a junior high school graduation certificate by the Chairman of the People's Committee of commune.”
d) Replace the phrase "district level" with the phrase "commune level"; replace the phrase "Director of the Education and Training Department" with the phrase "Chairman of the People's Committee of commune"; replace the phrase "Chairman of the People's Committee of district" with the phrase "Chairman of the People's Committee of commune" in point d of Clause 1 of Article 10.
đ) Remove the phrase "at that educational level" in point a of Clause 3 of Article 11; the phrase "Chairman of the People's Committee of district"; the phrase "People's Committee of district"; the phrase "Director of the Education and Training Department."
6. Amend and supplement Clause 3 of Article 5 of Circular No. 03/2023/TT-BGDĐT as follows:
"3. The school nameplate shall include the following information:
a) Top left corner: People's Committee of commune/ward (hereinafter referred to collectively as People's Committee of commune) + name of administrative unit.
b) In the middle, record the school name as prescribed in Clause 1 of this Article. For schools with branch campuses, the branch campus name should be recorded below the main school name.
c) At the bottom, record the address, phone number, email, and website (if available) of the school.”
7. Amend and supplement some articles of Circular No. 04/2023/TT-BGDĐT as follows:
a) Amend Article 5 as follows:
“Article 5. School Name, School Signboard
1. The naming of ethnic minority boarding schools is regulated as follows:
Ethnic Minority Boarding School for Junior High School/Ethnic Minority Boarding School for Senior High School/Ethnic Minority Boarding School for Junior High School and Senior High School + specific name.
2. The school name shall be recorded on the establishment decision, school signboard, seal, and transaction documents of the school.
3. The school signboard shall include the following contents:
a) Top left corner:
- For Ethnic Minority Boarding Schools for Junior High School: People's Committee of commune/ward and name of administrative unit.
- For Ethnic Minority Boarding Schools where the highest grade level is senior high school:
First line: People's Committee of province/city directly under the Central Government (hereinafter referred to collectively as People's Committee of province) and name of province;
Second line: Department of Education and Training;
b) In the middle, record the school name as prescribed in Clause 1 of this Article;
c) At the bottom, record the address, phone number, email, and website (if available) of the school.”
b) Amend and supplement Clause 2 of Article 10 as follows:
“2. Application Documents
a) Enrollment for Junior High School
- Student information form including: Full name, date of birth, personal identification number/Citizen Identification Card number/Citizen Card number, permanent residence address;
- Elementary school transcript or other equivalent documents;
- Certificate of preferential treatment issued by the competent authority (if applicable).
b) Enrollment for Senior High School
- Student information form including: Full name, personal identification number/Citizen Identification Card number/Citizen Card number, permanent residence address;
- Junior High School transcript;
- Certificate of preferential treatment issued by the competent authority (if applicable).”
c) Amend and supplement Clause 2 of Article 11 as follows:
“2. Direct admission to Ethnic Minority Boarding Schools for the following categories:
a) Ethnic minority students from very small ethnic groups as defined in Decree No. 57/2017/NĐ-CP dated May 9, 2017 of the Government.
b) Junior High School students belonging to the category specified in Article 9 of this Regulation who have won national-level awards organized by the Ministry of Education and Training or jointly with other ministries and agencies at the national scale for cultural, artistic, sports competitions, scientific research contests (hereinafter referred to collectively as contests); those who have won international contests recognized by the Minister of Education and Training.”
d) Amend point a of Clause 2 of Article 12 as follows:
“a) The Department of Education and Training shall guide enrollment for Ethnic Minority Boarding Schools where the highest grade level is senior high school and the People's Committee of commune having Ethnic Minority Boarding Schools for Junior High School located within its territory.”
8. Amend and supplement some articles of Circular No. 23/2023/TT-BGDĐT as follows:
a) Rename Article 22 as "Responsibilities of the People's Committee of Commune";
b) Amend the numbering of Clause 4 of Article 22 as follows:
“2. Monitor, inspect, identify difficulties and obstacles, and take effective and appropriate measures to support the implementation process according to local conditions; promptly commend and publicize collectives and individuals who perform well to promote achievements in organizing Vietnamese language teaching for ethnic minority children before entering Grade One; report the implementation results to the Department of Education and Training after the completion of the teaching period.”
c) Amend and supplement Clause 3 of Article 23 as follows:
“3. Explain, resolve concerns, suggestions, comments, and evaluate the results of teaching within the authority of the principal of primary schools; report the implementation results to the Department of Education and Training before the start of the new academic year.”
d) Replace the term "huyện" with "xã" in Clause 3, Article 20; replace the phrase "Guidance for Departments of Education and Training" with "Guidance for primary schools with ethnic minority students" in Clause 2, Article 21; replace the phrase "Advising the same-level People's Committee" with "Advising the provincial People's Committee" in Clause 1, Article 22; replace the term "Director of the Department of Education and Training" with "Chairman of the People's Committee of communes" in Article 26;
đ) Repeal Clause 2 and Clause 3 of Article 22.
9. Amend and supplement some articles of Circular No. 27/2023/TT-BGDĐT.
a) Amend and supplement Clause 5 of Article 7 as follows:
“5. Educational institutions establish a file to select textbooks and send it to the People's Committee of the commune (for primary and lower secondary levels), the Department of Education and Training (for upper secondary level). The file includes:
a) Decision on establishing the Council of the educational institution;
b) Minutes of the Council meeting in accordance with Clause 3 of this Article;
c) List of selected textbooks of the educational institution.”
b) Amend and supplement Article 8 as follows:
“Article 8. Reviewing files and approving results of textbook selection
1. The People's Committee of the commune reviews the files of textbook selection of educational institutions under its management in accordance with Clause 5 of Article 7 of this Circular; reports to the Department of Education and Training on the results of textbook selection of educational institutions under its management.
2. The Department of Education and Training reviews the files of textbook selection of educational institutions under its management in accordance with Clause 5 of Article 7 of this Circular; reviews the reports of the People's Committee of the commune on the results of selection and list of selected textbooks of educational institutions in accordance with Clause 1 of this Article; summarizes the results, compiles the list of selected textbooks of educational institutions (including the files of textbook selection of educational institutions in accordance with Clause 5 of Article 7 of this Circular), submits to the provincial People's Committee for consideration and approval.”
c) Amend and supplement Clause 1 of Article 11 as follows:
“1. During the process of using, based on the recommendations of teachers, students, and parents of students (if any), educational institutions report and propose to the People's Committee of the commune (for primary and lower secondary levels), the Department of Education and Training (for upper secondary level) regarding adjustments and supplements to the list of selected textbooks.”
d) Amend and supplement Point b of Clause 1 of Article 13 as follows:
“b) Guide and inspect educational institutions within their jurisdiction in selecting and using textbooks in accordance with regulations.”
đ) Amend and supplement Point d of Clause 1 of Article 13 as follows:
“d) Review the files of textbook selection of educational institutions under their management in accordance with Clause 5 of Article 7 of this Circular; review the reports of the People's Committee of the commune on the results of selection and list of selected textbooks of general education institutions; compile the results of textbook selection of educational institutions, submit to the provincial People's Committee for consideration and approval.”
e) Amend and supplement Article 15 as follows:
“Article 15. People's Committee of the Commune
1. Guide and inspect educational institutions under their jurisdiction in organizing textbook selection. Review the files of textbook selection of educational institutions under their management in accordance with Clause 5 of Article 7 of this Circular; summarize and report to the Department of Education and Training the list of selected textbooks of educational institutions under their management.
2. Direct educational institutions under their management to notify the list of approved textbooks to teachers, students, and parents of students; guide the use of textbooks in accordance with regulations.
3. Propose budget estimates to the competent authority to allocate financial resources and facilities for educational institutions under their management to organize textbook selection in accordance with the State Budget Law.
4. Implement inspections of educational institutions under their management on the organization of textbook selection and use in accordance with the law.”
g) Amend and supplement Point of Clause 4 and Clause 5 of Article 16 as follows:
“4. Compile the recommendations of teachers, students, and parents of students (if any) regarding adjustments and supplements to the list of selected textbooks that have been approved by the provincial People's Committee, report to the Department of Education and Training (for upper secondary level), the People's Committee of the commune (for primary and lower secondary levels) before implementing according to this Circular.
5. Be responsible to educational management agencies, students, and parents of students for the organization of textbook selection of educational institutions in accordance with Article 7 of this Circular. Publicize and transparently disclose information on textbook selection and explain decisions on textbook selection to public opinion.”
h) Replace the term "huyện" with "xã"; replace the phrase "Department of Education and Training" with "People's Committee of the commune"; replace the phrase "People's Committee of district, town, city district, provincial city, centrally governed city" with "People's Committee of the province";
i) Remove the term "inspection" at Point b of Clause 1 of Article 13;
k) Repeal Clause 4 of Article 13, Article 14.
10. Amend and supplement some articles of Circular No. 31/2023/TT-BGDĐT as follows:
a) Amending and supplementing Clause 1 of Article 7 as follows:
“1. The Examination Council for Graduation Recognition (hereinafter referred to as the Council) shall be established by the principal’s decision. Each educational institution with students completing grade 9 in the year of graduation recognition shall establish one (1) Council.”
b) Amend and supplement Clause 4 of Article 8 as follows:
“The Council sends the minutes and list of candidates recommended for graduation recognition to the principal for approval.”
c) Amend and supplement Clause 5 of Article 8 as follows:
“The principal issues a Decision on Graduation Recognition for students based on the recommendation of the Graduation Examination Council.”
d) Amend and supplement Clause 2 of Article 11 as follows:
“2. Guide and inspect educational institutions in organizing the examination for graduation recognition of lower secondary school.”
đ) Amend and supplement Article 12 as follows:
“Article 12. Responsibilities of the People's Committee of the Commune
1. Ensure funding sources and conditions for organizing graduation recognition.
2. Store files for graduation recognition requests, lists of recognized graduates, and management files for lower secondary school graduation certificates as prescribed.”
3. Report to the Department of Education and Training the results of the graduation recognition examination and the list of students recognized as having graduated annually.
5. Amend Clause 2 of Article 14 as follows:
“2. Issue a Decision to establish the Graduation Recognition Examination Board for junior high school.”
e) Amend Clause 7 of Article 14 as follows:
“Issue a Decision recognizing graduation and publish the list of students recognized as having graduated from junior high school, organize the issuance of graduation certificates to students recognized as having graduated.”
g) Replace the phrase "Prepare a list of students meeting the conditions for graduation recognition and submit it to the educational institution for approval by the Director of the Department of Education and Training" with the phrase "Prepare a list of students meeting the conditions for graduation recognition and submit it for approval by the principal" at Point b Clause 2 Article 7;
h) Repeal Article 13.
11. Amend and supplement some articles of Circular No. 27/2024/TT-BGDĐT as follows:
a) Replace the term "district" with the term "commune";
b) Amend and supplement Point c Clause 1 Article 15 as follows:
“c) The content of activities and study of disabled students shall be developed based on the content of special skills education, vocational training, and the content prescribed in the preschool education program and general education program of the Ministry of Education and Training, suitable to their abilities and personal needs;”
c) Amend and supplement Point a Clause 1 Article 16 as follows:
“For Special Education Classes of Continuing Education Centers, Vocational Education and Continuing Education Centers: the curriculum and education plan shall be developed based on the content of special skills education, vocational training, and the continuing education program of the Ministry of Education and Training, ensuring suitability to the abilities and needs of disabled students;”
d) Amend and supplement Clause 1 Article 26 as follows:
“1. Direct the Department of Education and Training to take the lead and coordinate with relevant departments, agencies, and commune People's Committees to guide and inspect the organization and operation of specialized education schools and schools with Special Education Classes within their jurisdiction.”
đ) Amend and supplement Clause 4 of Article 26 as follows:
“4. Direct the Department of Education and Training to take the lead and coordinate with the Department of Health in implementing social welfare policies, health support, and functional recovery programs to enhance the effectiveness of education for disabled students in specialized education schools and Special Education Classes within their jurisdiction.”
e) Amend the name of Article 28 as follows:
“Article 28. Responsibilities of Commune People's Committees”
g) Amend and supplement Clause 1 Article 28 as follows:
“1. Coordinate with related units to guide and inspect the organization and operation of schools with Special Education Classes according to their authority.”
h) Amend and supplement Clause 2 Article 28 as follows:
“2. Invest in physical facilities for public schools with Special Education Classes according to their authority to serve teaching and education for disabled students.”
i) Supplement Clause 3 Article 28 as follows:
“3. Manage and direct activities according to their authority for schools with Special Education Classes within their jurisdiction.”
k) Repeal Article 29.
12. Amend and supplement some articles of Circular No. 30/2024/TT-BGDĐT as follows:
a) Amend and supplement Article 17 as follows:
“Article 17. Responsibilities of Commune People's Committees
1. Direct secondary school enrollment work within their management scope.
2. Decide to establish the Secondary School Enrollment Examination Board.
3. Decide to establish the Secondary School Enrollment Steering Committee; approve the secondary school enrollment plan within their management scope.
4. Handle or report to the provincial People's Committee to handle any irregularities during the secondary school enrollment process within their management scope.
5. Direct the inspection of secondary school enrollment work within their management scope.
6. Store secondary school enrollment files in accordance with the law.
7. Conduct statistics, information, and reporting on secondary school enrollment work when required by competent authorities.”
b) Amend and supplement Clause 3 Article 18 as follows:
“3. Guide Commune People's Committees, secondary schools, and high schools within their jurisdiction to implement secondary school enrollment and high school enrollment work.”
c) Replace the phrase “People's Committee of district, town, city under province, city under central city” with the phrase “Commune People's Committee”; replace the phrase “People's Committee of district, town, city under province, city under central city under central city (hereinafter referred to as People's Committee of district)” with the phrase “Commune People's Committee”; replace the phrase “People's Committee of district” with the phrase “Commune People's Committee”;
d) Remove the phrase “inspection” at Clause 4 Article 17, Clause 5 Article 18;
đ) Repeal Article 20.
13. Amend and supplement some articles of Circular No. 07/2016/TT-BGDĐT dated March 22, 2016, issued by the Minister of Education and Training, stipulating the conditions for ensuring and the content, procedures, and formalities for recognizing the achievement of universal primary education and literacy as follows:
a) Amend and supplement Point b Clause 2 Article 8 as follows:
“b) Inspect in person at least 20% of communes, with at least two households inspected in each commune.”
b) Replace the phrase “town” with the phrase “special zone” at Clause 2 Article 1; the term “district” with the term “commune” at Point a Clause 2 Article 4, Point a Clause 2 Article 4, Point a Clause 2 Article 5, Clause 5 Article 10; the phrase “Primary Education Department, Secondary Education Department, Continuing Education Department” with the phrase “General Education Department, Vocational Education and Continuing Education Department” at Article 11, Article 13;
c) Remove the phrase “districts” and the phrase “district leaders” at Clause 2 Article 1; the phrase “each district” and the phrase “district leadership” at Clause 2 Article 10; the phrase “district-level unit” at Point b Item 3 and the phrase “number of district-level units achieving universal primary education and literacy, level, ratio” at Point a Item 4 Part I Appendix.
14. Amend and supplement some articles of Circular No. 03/2018/TT-BGDĐT dated January 29, 2018, issued by the Minister of Education and Training, stipulating inclusive education for persons with disabilities as follows:
a) Amend and supplement Clause 3 Article 16 as follows:
"3. The People's Committee at the commune level shall direct departments and sectors to cooperate with educational institutions within their jurisdiction to investigate, detect, intervene early, and effectively implement inclusive education locally; develop plans for inclusive education for persons with disabilities within their jurisdiction; effectively implement policies on inclusive education as directed by the People's Committee at the provincial level; mobilize and organize conditions for persons with disabilities to study inclusively at educational institutions; direct the implementation of programs, plans, and development master plans for inclusive education locally; organize the implementation and inspection of regulations on inclusive education locally; report periodically on the results of implementing inclusive education to the Department of Education and Training and the People's Committee at the provincial level."
b) Replace the phrase "People's Committee at the district, city under province level" with the phrase "People's Committee at the commune level";
c) Delete the phrase "Department of Education and Training" in Clause 5 and Clause 6 of Article 17;
d) Repeal Clause 2 of Article 16, Article 18;
15. Repeal Article 3 of Circular No. 32/2021/TT-BGDĐT dated November 22, 2021, issued by the Ministry of Education and Training guiding the implementation of certain provisions of Decree No. 82/2010/NĐ-CP dated July 15, 2010, of the Government regarding teaching and learning the spoken language and writing of ethnic minorities in general education schools and regular training centers;
16. Replace the phrase "Director of the Department of Education and Training" with the phrase "Chairman of the People's Committee at the commune level" in Circular No. 50/2021/TT-BGDĐT dated December 31, 2021, issued by the Minister of Education and Training amending and supplementing some articles of the Regulation on transferring schools and receiving students at secondary and high schools promulgated together with Decision No. 51/2002/QĐ-BGDĐT dated December 25, 2002, of the Minister of Education and Training;
17. Amend and supplement some articles of the Regulation on the organization and operation of Inclusive Education Support Centers issued together with Circular No. 20/2022/TT-BGDĐT dated December 28, 2022, of the Minister of Education and Training as follows:
a) Amend and supplement Clause 4 of Article 5 as follows:
"4. Provide training and counseling to persons with disabilities and organizations, units, and individuals with needs in psychology, health, education, vocational guidance, and vocational training.";
b) Amend and supplement Clause 4 of Article 18 as follows:
"4. Vocational guidance, vocational training, job introduction, and support for employment for persons with disabilities.";
c) Amend and supplement Clause 2 of Article 32 as follows:
"2. Direct the Department of Education and Training and the People's Committee at the commune level to guide and inspect the organization and operation of these Centers within their jurisdiction.";
d) Amend and supplement Clause 4 of Article 33 as follows:
"4. At the beginning of each school year, the Department of Education and Training shall request reports or consolidate the needs for inclusive education support from the People's Committees at the commune level and subordinate educational institutions, social assistance facilities, and submit them to the Center so that the Center has a basis for developing inclusive education support plans.";
đ) Amend and supplement the name of Article 34 as follows:
"Article 34. Responsibilities of the People's Committees at the commune level assigned to manage the Center";
e) Replace the word "district" with the word "commune"; the phrase "ordinance" with the phrase "law" in Point a Clause 1 of Article 28;
g) Repeal Clause 2 of Article 34.
Chapter III
IMPLEMENTING PROVISIONS
Article 19. Effectiveness and Responsibility for Implementation
1. This Circular takes effect from July 1, 2025.
2. This Circular shall cease to be effective from March 1, 2027. In cases where the Law, Resolution of the National Assembly, Ordinance, Resolution of the Standing Committee of the National Assembly, Decree, Resolution of the Government, Decision of the Prime Minister, or Circular of the Minister of Education and Training stipulates authority, responsibility for state management, procedures, and formalities through or promulgated from July 1, 2025 and become effective before March 1, 2027, then the corresponding provisions in this Circular shall cease to be effective at the time these legal normative documents come into effect.
3. During the period when the provisions of this Circular are effective, if the provisions on authority, responsibility for state management, procedures, and formalities in this Circular differ from those in related legal normative documents issued before July 1, 2025, they shall be implemented according to the provisions of this Circular.
4. The Director of the Office, the Heads of the General Department of Primary Education, the Head of the Legal Department, the Heads of relevant units under the Ministry of Education and Training; the Chairpersons of the People's Committees of provinces and centrally governed cities; the Directors of Departments of Education and Training; the Chairpersons of the People's Committees at the commune level; relevant agencies, organizations, units, and individuals shall be responsible for implementing this Circular./.
