Pursuant to the Law on Information Technology dated June 29, 2006;

The Minister of Information and Communications promulgates this Circular amending and supplementing Circular No. 09/2013/TT-BTTTT dated April 8, 2013 of the Minister of Information and Communications on the List of software and hardware, electronic products.

Pursuant to Decree No. 187/2007/NĐ-CP dated December 25, 2007, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications, and Decree No. 50/2011/NĐ-CP dated June 24, 2011, of the Government amending Decree No. 187/2007/NĐ-CP;

Article 1. Amending and supplementing Circular No. 09/2013/TT-BTTTT dated April 8, 2013 of the Minister of Information and Communications on the List of software and hardware, electronic products as follows:

The Minister of Information and Communications issues the List of Software and Hardware, Electronic Products[1].

Article 1. Scope of Regulation

This Circular issues the List of Software and Hardware, Electronic Products (hereinafter referred to as the List), including:

1. The List of software products is specified in Appendix No. 01.

2. The List of hardware and electronic products is specified in Appendix No. 02.

Article 2. Applicability

This Circular applies to agencies, organizations, and individuals participating in information technology industry activities, management, production, and trading of software and hardware, electronic products in Vietnam.

Article 3. Principles of Construction and Purpose of Application of the List

1. The List is established to form a system of specialized products in the software industry and the hardware, electronic industry serving business registration; investment activities; tax policies application; preferential policies; import and export management; quality management; and other related activities involving software and hardware, electronic products.

2. Based on market development conditions and information technology development policies in each period, the Ministry of Information and Communications adjusts the List to be consistent with management requirements.

Article 4. Effective Date

This Circular shall take effect from May 23, 2013.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. The Heads of the Office, the Department of Information Technology, the Heads of agencies and units under the Ministry of Information and Communications, the Directors of Provincial Departments of Information and Communications, and enterprises, organizations, and individuals mentioned in Article 2 shall be responsible for implementing this Circular.

2. During the implementation process, if any difficulties arise, organizations and individuals are advised to report to the Ministry of Information and Communications for supplementation and amendment as necessary./.

The Minister of Information and Communications issues this Circular to amend and supplement certain articles of Circular No. 03/2015/TT-BTTTT dated March 6, 2015 of the Minister of Information and Communications detailing and guiding the implementation of certain articles and clauses of Decree No. 60/2014/NĐ-CP dated June 19, 2014 of the Government on printing activities, Circular No. 05/2016/TT-BTTTT dated March 1, 2016 of the Minister of Information and Communications on managing and using International Standard Book Number, Circular No. 22/2018/TT-BTTTT dated December 28, 2018 of the Minister of Information and Communications promulgating the List of goods for import and export in the field of printing and publication distribution, and Circular No. 09/2013/TT-BTTTT of the Minister of Information and Communications promulgating the List of software and hardware, electronic products (amended and supplemented by Circular No. 20/2021/TT-BTTTT dated December 3, 2021 of the Minister of Information and Communications).

[2] Article 2 and Article 3 of Circular No. 20/2021/TT-BTTTT dated December 3, 2021 of the Minister of Information and Communications amending and supplementing Circular No. 09/2013/TT-BTTTT dated April 8, 2013 of the Minister of Information and Communications promulgating the List of software and hardware, electronic products, which shall take effect from February 2, 2022, are stipulated as follows:

"Article 2. Effective date and transitional provisions

1. This Circular shall take effect from February 2, 2022.

2. Software products that have been determined to belong to the List of software before the effective date of this Circular shall continue to be applied according to the purpose of the List under Circular No. 09/2013/TT-BTTTT dated April 8, 2013 of the Minister of Information and Communications.

Article 3. Responsibility for Implementation

1. The Director of the Office, the Director of the Department of Information Technology, the Heads of agencies and units under the Ministry of Information and Communications, the Directors of Provincial Departments of Information and Communications, and enterprises, organizations, and individuals related to this matter are responsible for implementing this Circular.

2. During the implementation process, if any difficulties arise, organizations and individuals are requested to report to the Ministry of Information and Communications for supplementation and amendment to ensure suitability."

Article 5 of Circular No. 11/2024/TT-BTTTT dated September 23, 2024 of the Minister of Information and Communications amending and supplementing certain articles of Circular No. 03/2015/TT-BTTTT dated March 6, 2015 of the Minister of Information and Communications detailing and guiding the implementation of certain articles and clauses of Decree No. 60/2014/NĐ-CP dated June 19, 2014 of the Government on printing activities, Circular No. 05/2016/TT-BTTTT dated March 1, 2016 of the Minister of Information and Communications on managing and using International Standard Book Number, Circular No. 22/2018/TT-BTTTT dated December 28, 2018 of the Minister of Information and Communications promulgating the List of goods for import and export in the field of printing and publication distribution, and Circular No. 09/2013/TT-BTTTT of the Minister of Information and Communications promulgating the List of software and hardware, electronic products (amended and supplemented by Circular No. 20/2021/TT-BTTTT dated December 3, 2021 of the Minister of Information and Communications), which shall take effect from November 7, 2024, is stipulated as follows:

"Article 5. Implementation Provisions

1. This Circular takes effect from November 7, 2024.

2. For import declaration procedures for printing equipment, non-commercial import of publications, and registration for commercial import of publications submitted to the competent authority for resolution before the effective date of this Circular, but if the deadline for resolving such procedures is on or after the effective date of this Circular, then the relevant provisions of this Circular shall not apply.

During the implementation of this Circular, in case of any difficulties, please report in writing to the Ministry of Information and Communications (through the Publishing, Printing, and Distribution Department) for consideration and resolution./.

[4] "Offset printing machine, roll printing machine" is abolished pursuant to Point a, Clause 2, Article 4 of Circular No. 11/2024/TT-BTTTT dated September 23, 2024 of the Minister of Information and Communications amending and supplementing certain articles of Circular No. 03/2015/TT-BTTTT dated March 6, 2015 of the Minister of Information and Communications detailing and guiding the implementation of certain articles and clauses of Decree No. 60/2014/NĐ-CP dated June 19, 2014 of the Government on printing activities, Circular No. 05/2016/TT-BTTTT dated March 1, 2016 of the Minister of Information and Communications on managing and using International Standard Book Number, Circular No. 22/2018/TT-BTTTT dated December 28, 2018 of the Minister of Information and Communications promulgating the List of goods for import and export in the field of printing and publication distribution, and Circular No. 09/2013/TT-BTTTT of the Minister of Information and Communications promulgating the List of software and hardware, electronic products (amended and supplemented by Circular No. 20/2021/TT-BTTTT dated December 3, 2021 of the Minister of Information and Communications), which shall take effect from November 7, 2024.

[10] "Inkjet printer" shall be amended and supplemented to read "Inkjet printer, except for multi-color types with printing speed of up to 60 sheets per minute (A4 size) or with print size of up to A3" pursuant to Point b, Clause 1, Article 4 of Circular No. 11/2024/TT-BTTTT dated September 23, 2024, issued by the Minister of Information and Communications to amend and supplement certain provisions of Circular No. 03/2015/TT-BTTTT dated March 6, 2015, issued by the Minister of Information and Communications detailing and guiding the implementation of certain articles and clauses of Decree No. 60/2014/NĐ-CP dated June 19, 2014, of the Government on printing activities, Circular No. 05/2016/TT-BTTTT dated March 1, 2016, issued by the Minister of Information and Communications on management and use of international standard book number, Circular No. 22/2018/TT-BTTTT dated December 28, 2018, issued by the Minister of Information and Communications promulgating the list of goods for import and export in the printing and publication distribution sector, and Circular No. 09/2013/TT-BTTTT of the Minister of Information and Communications promulgating the list of software and hardware, electronic products (amended and supplemented by Circular No. 20/2021/TT-BTTTT dated December 3, 2021, issued by the Minister of Information and Communications), which shall take effect from November 7, 2024.

[11] "Single-function and multifunction photocopiers (black and white or color)" shall be amended and supplemented to read "Single-function and multifunction photocopiers (black and white)" pursuant to Point c, Clause 1, Article 4 of Circular No. 11/2024/TT-BTTTT dated September 23, 2024, issued by the Minister of Information and Communications to amend and supplement certain provisions of Circular No. 03/2015/TT-BTTTT dated March 6, 2015, issued by the Minister of Information and Communications detailing and guiding the implementation of certain articles and clauses of Decree No. 60/2014/NĐ-CP dated June 19, 2014, of the Government on printing activities, Circular No. 05/2016/TT-BTTTT dated March 1, 2016, issued by the Minister of Information and Communications on management and use of international standard book number, Circular No. 22/2018/TT-BTTTT dated December 28, 2018, issued by the Minister of Information and Communications promulgating the list of goods for import and export in the printing and publication distribution sector, and Circular No. 09/2013/TT-BTTTT of the Minister of Information and Communications promulgating the list of software and hardware, electronic products (amended and supplemented by Circular No. 20/2021/TT-BTTTT dated December 3, 2021, issued by the Minister of Information and Communications), which shall take effect from November 7, 2024.

[12] "Automatic plate dryer" shall be abolished pursuant to Point e, Clause 2, Article 4 of Circular No. 11/2024/TT-BTTTT dated September 23, 2024, issued by the Minister of Information and Communications to amend and supplement certain provisions of Circular No. 03/2015/TT-BTTTT dated March 6, 2015, issued by the Minister of Information and Communications detailing and guiding the implementation of certain articles and clauses of Decree No. 60/2014/NĐ-CP dated June 19, 2014, of the Government on printing activities, Circular No. 05/2016/TT-BTTTT dated March 1, 2016, issued by the Minister of Information and Communications on management and use of international standard book number, Circular No. 22/2018/TT-BTTTT dated December 28, 2018, issued by the Minister of Information and Communications promulgating the list of goods for import and export in the printing and publication distribution sector, and Circular No. 09/2013/TT-BTTTT of the Minister of Information and Communications promulgating the list of software and hardware, electronic products (amended and supplemented by Circular No. 20/2021/TT-BTTTT dated December 3, 2021, issued by the Minister of Information and Communications), which shall take effect from November 7, 2024.
