Regulations on conditions for investment and business in military uniforms,
military equipment, firearms for military use, technical equipment, and specialized technology serving national defense and security
Pursuant to the Law on Management and Use of Firearms, Explosives Materials, and Auxiliary Tools dated June 20, 2017;
On the basis of Law on Government Organization dated June 19, 2015; Law Amending and Supplementing Certain Provisions of the Law on Government Organization and the Law on Local Administration dated November 22, 2019;
On the basis of Investment Law dated June 17, 2020;
On the basis of The Government promulgates this Decree amending and supplementing certain articles and appendices of Decree No. 58/2021/NĐ-CP dated June 10, 2021 of the Government on the operation of credit information service provision (hereinafter referred to as Decree No. 58/2021/NĐ-CP).
On the basis of Pursuant to the Law on Management and Use of Firearms, Explosives Materials, and Auxiliary Tools dated November 25, 2019; Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense; Decree No. 03/2025/NĐ-CP dated February 28, 2025 of the Government amending and supplementing certain articles of Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government; The Government promulgates this Decree stipulating conditions for investment and business in military uniforms, military equipment, firearms for military use, technical equipment, and specialized technology serving national defense and security.
"Based on the proposal of the Minister of National Defense;"
1. This Decree stipulates principles; conditions for investment and business; procedures and formalities for reviewing conditions; and responsibilities of ministries, sectors, localities, agencies, and enterprises in the activities of investing and doing business in military uniforms, military equipment for the people's armed forces, firearms for military use, technical equipment, special-purpose military and police equipment, spare parts, components, accessories, materials, and specialized technology for manufacturing them serving national defense and security (hereinafter referred to as military uniforms, military equipment, firearms for military use, technical equipment, and specialized technology serving national defense and security) within the territory of the Socialist Republic of Vietnam.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
2. In cases where international treaties to which the Socialist Republic of Vietnam is a member or has joined provide different provisions, such provisions shall be applied according to the provisions of those international treaties.
3. Export and import activities of firearms for military use and specialized technical equipment must comply with the regulations of laws on trade and related laws.
4. Research, manufacture, production, business, repair, and development of industrial security products by industrial security establishments shall be carried out in accordance with the provisions of Government Decree No. 63/2020/NĐ-CP dated June 8, 2020, stipulating industrial security.
This Decree applies to enterprises, agencies, organizations, and individuals involved in investment and business in military uniforms, military equipment, firearms for military use, technical equipment, and specialized technology serving national defense and security.
Article 2. Applicability
1. Military uniforms include:
Article 3. Explanation of Terms
In this Decree, the following terms are understood as follows:
a) Military insignia, rank insignia, service insignia, and uniforms prescribed in Government Decree No. 82/2016/NĐ-CP dated July 1, 2016, stipulating military insignia, rank insignia, service insignia, and uniforms of the People's Army of Vietnam;
b) Police insignia, rank insignia, service insignia, and uniforms prescribed in Government Decree No. 160/2007/NĐ-CP dated October 30, 2007, stipulating traditional flags, police insignia, rank insignia, service insignia, and uniforms of the People's Public Security Force and Government Decree No. 29/2016/NĐ-CP dated April 21, 2016, amending and supplementing certain articles of Government Decree No. 160/2007/NĐ-CP dated October 30, 2007, stipulating traditional flags, police insignia, rank insignia, service insignia, and uniforms of the People's Public Security Force;
c) Coast Guard insignia, rank insignia, service insignia, uniform, ceremonial uniform, and flag of the Vietnam Coast Guard prescribed in Government Decree No. 61/2019/NĐ-CP dated July 10, 2019, detailing certain provisions and measures to implement the Law on the Vietnam Coast Guard;
d) Uniforms, hats, service insignia of civilian self-defense forces prescribed in Government Decree No. 72/2020/NĐ-CP dated June 30, 2020, detailing certain provisions of the Law on Civilian Self-Defense Forces regarding organization, construction of forces, and policies for civilian self-defense forces.
2. Military equipment refers to equipment and tools (excluding those specified in Clause 3 and Clause 4 of this Article) manufactured and produced according to technical standards, designs, and functions prescribed by the Ministry of National Defense and the Ministry of Public Security to serve regular activities, training, field exercises, readiness for combat, and combat operations of the people's armed forces.
3. Military-use firearms are defined in point a, Clause 1, Article 1 of the Law amending and supplementing certain provisions of the Law on Management and Use of Firearms, Explosives Materials, and Auxiliary Tools.
4. Specialized technical equipment serving national defense and security includes:
a) Specialized technical equipment, military and police equipment, and special equipment are technical equipment and means of transportation manufactured and produced to serve national defense and security;
b) Spare parts, components, accessories, and materials are electronic components, semiconductor components, mechanical parts, and other accessories and materials manufactured and produced to replace, support, or ensure the operation of military-use firearms, technical equipment, military and police equipment, and special equipment as prescribed in Clause 3 of this Article and point a of this clause.
5. Specialized technology for manufacturing and producing military-use firearms and technical equipment serving national defense and security includes:
a) Technology for manufacturing and producing military-use firearms serving national defense and security as prescribed in Clause 3 of this Article;
b) Technology for manufacturing and producing specialized technical equipment serving national defense and security as prescribed in point a, Clause 4 of this Article.
6. Investment and business in military uniforms and military equipment serving national defense and security refer to the continuous implementation of one, several, or all stages from investment, production to supplying military uniforms and military equipment to the people's armed forces.
7. Investment and business in military-use firearms serving national defense and security refer to the continuous implementation of one, several, or all stages of research, manufacture, production, repair, purchase, and sale of military-use firearms for the people's armed forces.
8. Investment and business in specialized equipment serving national defense and security refer to the continuous implementation of one, several, or all stages from investment, production to supplying specialized equipment to the people's armed forces.
9. Investment and business in specialized technology for manufacturing and producing military-use firearms and technical equipment serving national defense and security refer to the continuous implementation of one, several, or all stages from research, development, application, transfer, and technology transfer services for specialized technology to manufacture and produce military-use firearms and specialized technical equipment for the people's armed forces.
9. Specialized technology investment for the manufacture and production of military weapons and technical equipment serving national defense and security is the continuous implementation of one, several, or all stages from research, development, application, transfer, and specialized technology transfer services for the manufacture and production of military weapons and specialized technical equipment for the people's armed forces.
Article 4. Principles for investment and business in military uniforms, military equipment, military weapons, technical equipment, and specialized technology serving national defense and security
1. Protecting the independence, sovereignty, unity, territorial integrity of the country, national security, and social order and safety.
2. Strict management, ensuring confidentiality and safety.
3. Training institutions, research centers, production facilities, manufacturing plants, repair shops, assembly workshops, and development units under the Ministry of National Defense and the Ministry of Public Security shall only carry out research, production, manufacturing, repair, assembly, and development activities when assigned tasks or given orders by competent authorities as stipulated in Article 10 of this Decree.
4. Adhering to legal provisions regarding industries and trades with conditions related to national security and public order as prescribed in Government Decree No. 96/2016/NĐ-CP dated July 1, 2016 on conditions concerning national security and public order for certain industries and trades with conditions; and legal provisions on environmental protection.
Article 5. Prohibited acts in investment and business in military uniforms, military equipment, military weapons, technical equipment, and specialized technology serving national defense and security
1. Exploiting activities in the industry and trade of investment and business in military uniforms, military equipment, military weapons, technical equipment, and specialized technology serving national defense and security to directly or indirectly harm the independence, sovereignty, unity, territorial integrity of the country, national security, and social order and safety.
2. Engaging in investment and business in military uniforms, military equipment, military weapons, technical equipment, and specialized technology serving national defense and security when:
a) Not being ordered by competent authorities through bidding procedures or not being assigned tasks or selected through bidding procedures;
b) Producing military uniforms, military equipment, military weapons, technical equipment beyond the quantities specified in contracts, orders, or task assignment documents issued by competent authorities;
c) Failing to meet the conditions for investment and business as prescribed in this Decree and relevant laws or failing to maintain such conditions throughout the operation period.
3. Violating legal provisions on state secrets protection and information confidentiality regulations of the Ministry of National Defense and the Ministry of Public Security, including:
a) Information in contracts, orders, task assignment documents, bidding documents, and related documents in investment and business in military uniforms, military equipment, military weapons, technical equipment, and specialized technology serving national defense and security;
b) Information related to technical and tactical capabilities, standards, quality, quantity, results of scientific and technological research, production, improvement, modernization of military uniforms, military equipment, military weapons, technical equipment, and specialized technology serving national defense and security.
4. Transferring complete products, unfinished products, prototypes, test products, defective products, damaged products, low-quality products during the production and business of military uniforms, military equipment, research, manufacture, production, repair, improvement, modernization of military weapons, technical equipment, and specialized technology projects and research and development results for the manufacture and production of specialized technical equipment serving national defense and security to third parties without approval from competent authorities.
5. Providing false documents to meet the conditions for investment and business in military uniforms, military equipment, military weapons, technical equipment, and specialized technology serving national defense and security.
6. Obstructing or refusing to comply with inspection, supervision, and violation handling work in investment and business in military uniforms, military equipment, military weapons, technical equipment, and specialized technology serving national defense and security.
7. Misusing positions and powers to obstruct, cause inconvenience, infringe upon the freedom of investment and business of organizations and enterprises; shielding individuals involved in investment and business in military uniforms, military equipment, military weapons, technical equipment, and specialized technology serving national defense and security from legal violations.
Chapter II
Article 6. CONDITIONS FOR INVESTMENT AND BUSINESS IN MILITARY UNIFORMS, MILITARY EQUIPMENT, MILITARY WEAPONS, TECHNICAL EQUIPMENT, AND SPECIAL TECHNOLOGY TO SERVE NATIONAL DEFENSE AND SECURITY
Article 6. Conditions for investment and business in military uniforms, military equipment to serve national defense and security
1. Enterprises directly serving national defense and security may invest in and conduct business in military uniforms and military equipment to serve national defense as specified in points a, c, and d of Clause 1 and Clause 2 of Article 3 of this Decree when they meet the following conditions:
a) The production facilities, manufacturing bases, and storage warehouses must be arranged separately;
b) They must be commissioned by the Minister of National Defense through orders, assignments, or selection procedures via bidding.
2. Enterprises not falling under the category specified in Clause 1 of this Article may invest in and conduct business in military uniforms and military equipment to serve national defense as specified in points a, c, and d of Clause 1 and Clause 2 of Article 3 of this Decree when they meet the following conditions:
a) Established in accordance with the law; operating within the territory of Vietnam; without foreign capital investment;
b) Complying with point a and point b of Clause 1 of this Article.
3. Security industry establishments may invest in and conduct business in military uniforms and military equipment to serve security as specified in point b of Clause 1 and Clause 2 of Article 3 of this Decree in accordance with the provisions of Government Decree No. 63/2020/NĐ-CP dated June 8, 2020 on the security industry.
Article 7. CONDITIONS FOR INVESTMENT AND BUSINESS IN MILITARY WEAPONS TO SERVE NATIONAL DEFENSE AND SECURITY
1. Organizations and enterprises under the Ministry of National Defense and the Ministry of Public Security may invest in and conduct business in military weapons to serve national defense and security when they meet the conditions stipulated in Articles 7 and 8 of Government Decree No. 79/2018/NĐ-CP dated May 16, 2018 detailing certain provisions and measures for implementing the Law on Management and Use of Weapons, Explosives, and Auxiliary Equipment (hereinafter referred to as Decree No. 79/2018/NĐ-CP).
2. Organizations and enterprises not falling under the category specified in Clause 1 of this Article may participate in research, manufacture, production, and repair of military weapons to serve national defense and security when they meet the conditions stipulated in Article 10 of Decree No. 79/2018/NĐ-CP.
Article 8. CONDITIONS FOR INVESTMENT AND BUSINESS IN SPECIAL TECHNICAL EQUIPMENT TO SERVE NATIONAL DEFENSE AND SECURITY
1. Enterprises directly serving national defense and security may invest in and conduct business in special technical equipment to serve national defense and security as specified in Clause 4 of Article 3 of this Decree when they meet the following conditions:
a) Having a minimum registered capital of 100 billion VND at the time of application to participate in investment, research, manufacture, production, and repair of special technical equipment to serve national defense and security;
b) Possessing research, production, manufacturing, and repair processes, technologies, equipment, and means for special technical equipment to serve national defense and security; having measuring equipment to monitor technical requirements and product quality;
c) Production areas, auxiliary areas, testing areas, warehouses, and storage areas for special technical equipment to serve national defense and security must be arranged separately and designed and constructed according to current technical standards and regulations on safety, fire prevention, explosion protection, and environmental protection;
d) Having at least 50 technical workers with appropriate professional qualifications for research, manufacture, production, and repair of special technical equipment to serve national defense and security;
đ) Commissioned by the Minister of National Defense or the Minister of Public Security through orders, assignments, or selection procedures via bidding.
2. Enterprises not falling under the category specified in Clause 1 of this Article may invest in and conduct business in special technical equipment to serve national defense and security as specified in Clause 4 of Article 3 of this Decree when they meet the following conditions:
a) Complying with point a of Clause 2 of Article 6 of this Decree;
b) Complying with Clause 1 of this Article.
3. In cases where enterprises only engage in purchasing and selling special technical equipment to serve national defense and security as specified in Clause 4 of Article 3 of this Decree, enterprises specified in Clause 1 of this Article only need to meet the condition stipulated in point đ of Clause 1 of this Article, while enterprises specified in Clause 2 of this Article only need to meet the conditions stipulated in point đ of Clause 1 and point a of Clause 2 of this Article.
Article 9. Conditions for investing in and operating specialized technology serving national defense and security
1. A business directly serving national defense and security may invest in and operate specialized technology serving national defense and security as prescribed in Clause 5, Article 3 of this Decree when it meets all of the following conditions:
a) Having a minimum charter capital of 100 billion VND at the time of requesting to participate in investing in and operating specialized technology serving national defense and security;
b) Having a laboratory or testing facility that is separately arranged and equipped with devices, technology, means, and standard measuring equipment meeting research requirements;
c) Having at least 50 technical workers with appropriate professional qualifications for the field of investing in and operating specialized technology manufacturing, producing military weapons, and technical equipment serving national defense and security;
d) Being commissioned or assigned tasks or selected through tender procedures by the Minister of National Defense or the Minister of Public Security.
2. A business not falling within the scope prescribed in Clause 1 of this Article may invest in and operate specialized technology manufacturing, producing military weapons, and technical equipment serving national defense and security as prescribed in Clause 5, Article 3 of this Decree when it meets all of the following conditions:
a) Complying with point a of Clause 2 of Article 6 of this Decree;
b) Complying with Clause 1 of this Article.
Chapter III
PROCEDURE FOR REVIEWING CONDITIONS FOR INVESTING IN AND OPERATING MILITARY EQUIPMENT, MILITARY UTENSILS, MILITARY WEAPONS, TECHNICAL EQUIPMENT, AND SPECIALIZED TECHNOLOGY SERVING NATIONAL DEFENSE AND SECURITY
Article 10. Authority to Approve Investment in and Operation of Military Equipment, Military Utensils, Military Weapons, Technical Equipment, and Specialized Technology Serving National Defense and Security
1. The Prime Minister decides to approve organizations and businesses specified in Clause 2, Article 7 of this Decree to participate in researching, manufacturing, producing, and repairing military weapons serving national defense and security upon the proposal of the Minister of National Defense or the Minister of Public Security.
2. The Minister of National Defense, the Minister of Public Security:
a) Assign tasks or commission production and supply of military uniforms, military utensils, military weapons, technical equipment, and specialized technology;
b) Select contractors to produce and supply products of military uniforms, military utensils, technical equipment, and specialized technology;
c) Propose the Prime Minister to decide to approve organizations and businesses specified in Clause 2, Article 7 of this Decree to participate in researching, manufacturing, producing, and repairing military weapons.
Article 11. Procedure for Approving Organizations and Businesses to Invest in and Operate Military Weapons Serving National Defense and Security
Organizations and businesses specified in Clause 2, Article 7 of this Decree which wish to participate in researching, manufacturing, producing, and repairing weapons shall comply with the provisions of Clauses 2, 3, and 4 of Article 10 of Decree No. 79/2018/NĐ-CP.
Article 12. Procedure for Reviewing Conditions for Investing in and Operating Military Uniforms, Military Utensils, Technical Equipment, and Specialized Technology Serving National Defense and Security
1. Agencies and units under the Ministry of National Defense and the Ministry of Public Security authorized by the Minister of National Defense or the Minister of Public Security to decide on procurement of military uniforms, military utensils, technical equipment, and specialized technology serving national defense and security shall include the investment and operation conditions prescribed in this Decree in the tender announcement or bidding documents, request documents sent to businesses or announced on mass media. The deadline for submitting documents must be clearly stated in the tender announcement or bidding documents, request documents.
Businesses wishing to participate in investment and operation shall submit a written request (in Form No. 01 attached to this Decree), accompanied by documents proving their capacity and compliance with investment and operation conditions as prescribed in this Decree, to the agency or unit under the Ministry of National Defense or the Ministry of Public Security issuing the tender announcement or bidding documents, request documents for review.
2. Documents proving capacity and conditions for investing in and operating military uniforms and military utensils serving national defense include:
a) Documents proving compliance with security, public order, fire prevention and fighting, accident prevention and response, and environmental protection regulations;
b) Copies of design drawings and documents proving that the factory system, production facilities, storage areas are separately arranged and designed and constructed according to current standards and technical regulations on safety, fire prevention, and environmental protection.
3. Documents proving capacity and conditions for investing in and operating technical equipment serving national defense and security include:
a) Documents prescribed in point a, Clause 2 of this Article;
b) Copies of research, production, manufacturing, and repair processes of technical equipment; lists of technologies, equipment, means, and measuring equipment for quality control and monitoring technical requirements and product quality;
c) List of the number and information about the technical qualifications of the technical workforce;
d) Annual financial reports audited at the latest date closest to the date the business requests to participate in researching, manufacturing, producing, and repairing technical equipment serving national defense and security, and documents proving financial capacity.
4. Documents proving capacity and conditions for businesses only engaged in purchasing and selling specialized technical equipment serving national defense and security include the documents prescribed in point a, Clause 2 of this Article.
5. Documents proving capacity and conditions for investing in and operating specialized technology include:
a) Documents prescribed in point a, Clause 2 and point c, Clause 3 of this Article;
b) Annual financial reports audited at the latest date closest to the date the business requests to participate in operating specialized technology, and documents proving financial capacity.
6. Functional agencies under the Ministry of National Defense and the Ministry of Public Security specified in Clause 1 of this Article shall complete the review of compliance with investment and operation conditions within seven working days from the date of receiving valid documents (for tender procedures, counting from the bid opening date):
a) In case an organization or business does not meet the investment and operation conditions, a written reply stating the reasons shall be issued.
b) In the case where organizations and enterprises meet the conditions for investment and business operations, they shall continue to implement negotiation steps to sign contracts under the tendering method or continue the procedures to select contractors under the bidding method in accordance with the provisions.
Chapter IV
RESPONSIBILITIES OF MINISTRIES, SECTORS, LOCAL AUTHORITIES AND ORGANIZATIONS, ENTERPRISES
Article 13. Responsibilities of the Ministry of National Defense
1. Shall be responsible before the Government for state management over activities of investing in and operating military uniforms, military equipment, weapons, and specialized technical equipment serving national defense.
2. Organize inspections, examinations, and handle violations of the implementation of regulations on conditions for investing in and operating military uniforms, military equipment, weapons, specialized technical equipment, and technology serving national defense.
3. Develop and promulgate the list of military equipment serving national defense as stipulated in Clause 2, Article 3 of this Decree.
4. Annually compile and report to the Government on the situation of implementing activities of investing in and operating military uniforms, military equipment, weapons, specialized technical equipment, and technology serving national defense in accordance with Article 17 of this Decree.
Article 14. Responsibilities of the Ministry of Public Security
1. Shall be responsible before the Government for state management over activities of investing in and operating military uniforms, military equipment, weapons, and specialized technical equipment serving security.
2. Organize inspections, examinations, and handle violations of the implementation of regulations on conditions for investing in and operating military uniforms, military equipment, weapons, specialized technical equipment, and technology serving security.
3. Develop and promulgate the list of military equipment serving security as stipulated in Clause 2, Article 3 of this Decree.
4. Annually compile and report to the Government on the situation of implementing activities of investing in and operating military uniforms, military equipment, weapons, specialized technical equipment, and technology serving security in accordance with Article 17 of this Decree.
Article 15. Responsibilities of Ministries, ministerial-level agencies, government agencies, People's Committees of provinces and centrally governed cities
Based on their functions, tasks, and authorities as prescribed by law, ministries, ministerial-level agencies, government agencies, People's Committees of provinces and centrally governed cities shall have the responsibility to coordinate with the Ministry of National Defense and the Ministry of Public Security to guide enterprises in complying with the provisions of this Decree and related laws.
Article 16. Responsibilities of enterprises
1. Maintain continuously all conditions for investment and business operations throughout the entire process of implementation.
2. Implement reporting systems on the situation of implementing activities of investing in and operating military uniforms, military equipment, weapons, specialized technical equipment, and technology serving national defense and security in accordance with Article 17 of this Decree.
Article 17. Reporting System
1. Annual or ad hoc reporting system:
a) Annually, organizations and enterprises shall report on the situation of conducting business in military uniforms, military equipment, weapons, specialized technical equipment, and technology serving national defense and security tasks according to the contents specified in Clause 2 of this Article, to be sent (directly or through postal services) to the Ministry of National Defense and the Ministry of Public Security for consolidation and reporting to the Prime Minister;
b) Report ad hoc as required by competent state agencies.
2. Content of reports: including explanatory sections and forms, specifically as follows:
a) Compliance with regulations on business conditions;
b) The number of contracts or orders placed, tasks assigned for implementation in the reporting year;
c) The quantity and types of military uniforms, military equipment, weapons, specialized technical equipment, and technology serving national defense tasks that the enterprise has implemented in the reporting year;
d) Difficulties, obstacles, and recommendations.
3. Deadline for submitting reports:
a) Organizations and enterprises submit reports to the Ministry of National Defense or the Ministry of Public Security before December 20th of the reporting year;
b) The Ministry of National Defense and the Ministry of Public Security consolidate and report to the Prime Minister before December 30th of the reporting year.
4. The data cut-off period for reporting is from December 15th of the previous reporting year to December 14th of the reporting year.
5. Reports shall be made in Form No. 02 attached to this Decree.
Chapter V
IMPLEMENTING PROVISIONS
Article 18. Effectiveness and Transitional Provisions
1. This Decree shall take effect from January 30, 2023.
2. In cases where regulatory legal documents and provisions referred to in this Decree are changed, supplemented, or replaced, they shall be implemented according to new regulatory legal documents.
3. Enterprises that are currently investing in and operating military uniforms, military equipment, technical equipment, and specialized technology serving national defense and security under orders, assigned tasks, or selected through bidding procedures approved by competent authorities before this Decree takes effect shall continue to implement according to existing orders or contracts signed.
4. Enterprises currently investing in and operating technical equipment and specialized technology serving national defense and security but not yet meeting the minimum charter capital conditions stipulated in Articles 8 and 9 of this Decree shall continue their operations for a period of 12 months from the date this Decree takes effect. After the 12-month period, enterprises must meet all conditions stipulated in this Decree.
Article 19. Responsibility for Implementation
1. The Minister of National Defense and the Minister of Public Security shall be responsible for urging, guiding, and inspecting the implementation of this Decree.
2. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees, and relevant agencies, organizations, enterprises, and individuals shall be responsible for implementing this Decree./.
