DIRECTIVE
Regarding the implementation of the Ordinance on Fees and Charges and Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges
To implement the Ordinance on Fees and Charges of the Standing Committee of the National Assembly, dated June 3, 2002, the Government has issued Decree No. 57/2002/NĐ-CP detailing the implementation of the Ordinance on Fees and Charges.
The implementation of the Ordinance and the Government's Decree on fees and charges is of utmost importance in restoring order and discipline in the management of fee and charge collection, particularly for road bridge tolls, road tolls, ferry and pontoon fees. During the implementation process, it is necessary to change and improve certain procedures, address existing issues to ensure that activities involving fee and charge collection proceed smoothly, especially for road bridge tolls, road tolls, ferry and pontoon fees.
To ensure compliance with the provisions of the Ordinance on Fees and Charges and Decree No. 57/2002/NĐ-CP, the Prime Minister instructs:
1. Ministers, Heads of ministerial-level agencies, Heads of governmental agencies, Chairpersons of provincial People's Committees under the Central Government shall immediately review all fees and charges currently collected in their sectors and localities, compare them with the detailed list of fees and charges attached to Decree No. 57/2002/NĐ-CP, and classify and handle them as follows:
- Any fee or charge not listed in the detailed list of fees and charges shall not be collected. Any agency or entity issuing such fee or charge must issue a document abolishing it immediately. Organizations and individuals currently collecting these fees and charges must stop collecting them immediately and declare and settle all collected amounts with the directly managing tax authority according to current regulations and remit them to the State budget.
- Any fee or charge newly listed in the detailed list of fees and charges but without a guiding document from the competent state agency shall not be collected;
- Any fee or charge listed in the detailed list of fees and charges and with a guiding document from the competent state agency shall continue to be implemented until new guiding documents are issued.
The Ministry of Finance will develop specific plans to work with ministries, sectors, and localities to review the current application levels, ratios, collection, payment, management, and use of fees and charges; clearly identify which fees belong to the State budget and which do not.
2. Fee and charge exemptions and reductions can only be implemented in cases specified in Article 14 of Decree No. 57/2002/NĐ-CP. In places where traffic congestion has not been resolved, temporary exemption from road tolls for two-wheeled motorcycles, three-wheeled motorcycles, two-wheeled motorized vehicles, and three-wheeled motorized vehicles is allowed. The Ministry of Finance will specify the types of tickets for road bridges, roads, ferries, and pontoons, and establish management and usage regulations suitable for the actual situation, facilitating smooth traffic, especially for security and defense activities and public service operations. It will coordinate with the Ministry of Transport to provide specific guidance on places temporarily exempting road tolls for two-wheeled motorcycles, three-wheeled motorcycles, two-wheeled motorized vehicles, and three-wheeled motorized vehicles. The Ministry of Finance will specify the deadline for abolishing free pass issuance and the expiration date of already issued free passes. For the time being, while awaiting the issuance of comprehensive guiding documents, exemptions and reductions for road bridge tolls, road tolls, ferry, and pontoon fees will continue to be implemented according to current regulations.
Ministries, sectors, localities, and organizations and individuals collecting fees and charges must strengthen coordination, actively reorganize ticket sales procedures, and control fee and charge collection to prevent corruption, ensuring convenience and transparency, particularly for road bridge tolls and road tolls.
3. The implementation of the Ordinance on Fees and Charges and Decree No. 57/2002/NĐ-CP must be considered a significant task for all sectors and levels in 2002. To assist the Government in timely monitoring and directing, creating conditions for all sectors and levels to properly implement the Ordinance and Decree No. 57/2002/NĐ-CP, the Ministry of Finance will establish a permanent steering group to guide the implementation of the Ordinance on Fees and Charges and Decree No. 57/2002/NĐ-CP.
Provincial and municipal People's Committees under the Central Government shall organize permanent units to implement the Ordinance on Fees and Charges and Decree No. 57/2002/NĐ-CP to perform the following tasks:
- Monitor and inspect the collection, payment, management, and use of fees and charges at various facilities;
- Timely reflect difficulties encountered in implementing fees and charges to the competent state agencies;
- Regularly report the progress of implementing the Ordinance and Decree No. 57/2002/NĐ-CP to the competent state agencies.
4. Mass media agencies and propaganda agencies at all levels and sectors need to intensify the dissemination and promotion of the content and significance of the Ordinance and Decree No. 57/2002/NĐ-CP of the Government on fees and charges. Promptly highlight exemplary actions and units; expose and bring to public attention violations of the Ordinance and Decree No. 57/2002/NĐ-CP of the Government on fees and charges.
5. Organizations and individuals collecting fees and charges must publicly post and announce at collection points the regulations on fee and charge collection, including: name of fee or charge; applicable subjects; exempted or reduced subjects; collection level; application period (if any); collection and payment procedures; procedures and authorities for handling complaints and reports about fees and charges,... to facilitate implementation and serve as a basis for supervision by mass organizations and the people.
6. Ministers, Heads of ministerial-level agencies, Heads of governmental agencies, Chairpersons of provincial People's Committees under the Central Government, and heads of fee and charge collection units are responsible for strictly implementing this Directive, reporting quarterly to the Ministry of Finance (through the Permanent Steering Group for Implementing the Ordinance and Decree No. 57/2002/NĐ-CP) for consolidation and reporting to the Prime Minister.
During the implementation process, if there are difficulties or obstacles, relevant agencies and units shall promptly reflect them to the Ministry of Finance for appropriate measures to be taken; in cases exceeding its authority, the Ministry of Finance shall compile and report to the Prime Minister for consideration and resolution.
