Pursuant to Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly on handling certain issues related to the restructuring of the state apparatus;

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates the decentralization, grading, and definition of authority for the implementation of state management tasks by two-level local governments in the field of education as prescribed in the legal normative documents issued by the Minister of Education and Training.

Article 2. This Circular applies to central administrative agencies, local governments, educational institutions, and other organizations and individuals related to the field of education.

Article 2. Principles of Decentralization, Grading, and Definition of Authority

Point 1. Ensuring compliance with the Constitution; consistent with the principles and regulations on decentralization, grading, and definition of authority under the Law on the Organization of the Government, the Law on the Organization of Local Administration, and the Government Decrees on decentralization, grading, and definition of authority in the field of education.

Point 2. Ensuring appropriate decentralization, grading, and definition of tasks and powers between levels of local government in accordance with the tasks, powers, and capabilities of the authorities; avoiding overlap, duplication, or omission of functions and tasks between different levels of local government and among agencies and organizations within local government when implementing state management tasks in the field of education.

Point 3. Ensuring that it does not affect the implementation of international treaties and agreements in the field of education to which the Socialist Republic of Vietnam is a party.

Point 4. The resources for implementing decentralization, grading, and definition of authority shall be guaranteed by the state budget in accordance with the provisions.

Article 3. Regarding Fees and Charges

When handling administrative procedures requiring payment of fees and charges as prescribed by law, citizens and organizations must pay the fees and charges simultaneously with submitting their application documents to the receiving agency. The amount of fees and charges, their management and use shall be carried out according to the regulations of the Government, the Minister of Finance, or the People's Council at the provincial level for corresponding fees and charges.

Article 4. Principles for Exploitation and Use of Electronic Data

Agencies handling administrative procedures have the responsibility to exploit electronic data already available in the National Population Database and other specialized databases to supplement information in the electronic files of individuals and organizations handling administrative procedures; they shall not require individuals and organizations to submit or present documents whose information has been obtained from these databases, except for purposes of verification and rechecking the authenticity of the information, documents, and materials that have been digitized.

Chapter II

DECENTRALIZATION, GRADING AND DEFINITION OF AUTHORITY FOR THE IMPLEMENTATION OF STATE MANAGEMENT TASKS BY TWO-LEVEL LOCAL GOVERNMENTS IN THE FIELD OF EDUCATION

Article 5. Management of diplomas and certificates

1. The authority to manage the use of blank diplomas and certificates and to be responsible for issuing diplomas and certificates as prescribed in Clause 3, Article 3 of the Regulation on the management of secondary school graduation diplomas, high school graduation diplomas, college teacher training diplomas, higher teacher training diplomas, university education diplomas, and certificates of the national education system issued together with Circular No. 21/2019/TT-BGDĐT of the Minister of Education and Training (hereinafter referred to as Circular No. 21/2019/TT-BGDĐT) shall be implemented by the People's Committee of the commune.

2. Replace the phrase "Department of Education and Training" with the phrase "People's Committee of the commune" in Circular No. 21/2019/TT-BGDĐT.

3. For diplomas and certificates issued by the Department of Education and Training before this Circular takes effect, the reissuance; issuance of certified copies from original records; correction of information recorded on diplomas and certificates; recovery and cancellation of diplomas and certificates shall be carried out by the Department of Education and Training.

4. Amend the time limit for implementing procedures for issuing certified copies of diplomas and certificates from original records and correcting information on diplomas and certificates as prescribed in Circular No. 21/2019/TT-BGDĐT as follows:

a) In cases where multiple certified copies are requested simultaneously from several original records, a large number of copies are required, or the content of the diplomas and certificates is complex and difficult to verify, if the agency receiving the request cannot meet the time limit specified in Point b, Clause 2, Article 31 of Circular No. 21/2019/TT-BGDĐT, the time limit for issuing certified copies may be extended by no more than one working day or longer upon agreement in writing with the person requesting the certified copies;

b) Within two working days from the date of receipt of complete and valid files, the competent authority shall examine and decide on the correction of the content of diplomas and certificates; if no correction is made, it must respond in writing and specify the reasons.

Article 6. Implementation of regulations on quality assurance and recognition of national standards for primary schools

1. The authority to organize the acceptance and examination of external evaluation registration files, and to send accepted external evaluation registration files to the Department of Education and Training for primary schools as prescribed in Clause 1, Article 27 of the Regulations on Quality Assurance and Recognition of National Standards for Primary Schools issued together with Circular No. 17/2018/TT-BGDĐT dated August 22, 2018 of the Minister of Education and Training, amended and supplemented by Circular No. 22/2024/TT-BGDĐT dated December 10, 2024 of the Minister of Education and Training (hereinafter referred to as Circular No. 17/2018/TT-BGDĐT) shall be implemented by the People's Committee of the commune.

2. The authority to implement regulations on quality assurance and recognition of national standards for primary schools as prescribed in Article 42 of Circular No. 17/2018/TT-BGDĐT shall be implemented by the People's Committee of the commune.

3. Replace the phrase "Department of Education and Training" with the phrase "People's Committee of the commune" in Circular No. 17/2018/TT-BGDĐT.

4. Remove the phrases "or head or deputy head of the Department of Education and Training," "or leaders or staff of the Department of Education and Training," "Department of Education and Training" in Article 29; the phrases "Advise the People's Committee of the district," "People's Committee of the district" in Article 42 of Circular No. 17/2018/TT-BGDĐT.

5. Amend the time limit for establishing external evaluation teams and implementing steps in the external evaluation process for primary schools, issuing Certificates of schools meeting quality assurance standards, and issuing Certificates of primary schools meeting national standards as prescribed in Circular No. 17/2018/TT-BGDĐT as follows:

a) The Department of Education and Training shall be responsible for establishing external evaluation teams according to the provisions of Articles 29 and 30 and implementing steps in the external evaluation process according to the provisions of Article 28 of this Regulation within two months from the date of notification to the People's Committee of the commune or primary school that the registration file has been accepted for external evaluation;

b) Issuing Certificates of schools meeting quality assurance standards: Within fifteen working days from the date of receipt of the report of the external evaluation team, the Director of the Department of Education and Training shall issue a decision to grant the Certificate of schools meeting quality assurance standards according to the level achieved by the primary school;

c) Issuing Certificates of primary schools meeting national standards: Within fifteen working days from the date of receipt of the report of the external evaluation team, the Director of the Department of Education and Training shall issue a decision to grant the Certificate of primary schools meeting national standards.

Article 7. Organization to implement regulations on quality assessment and national standard recognition for junior high schools and general secondary schools with the highest level being junior high school.

1. The authority to organize the acceptance, examination of registration files for external evaluation, and sending accepted registration files for external evaluation to the Department of Education and Training for junior high schools and general secondary schools with the highest level being junior high school (hereinafter referred to as junior high schools) as stipulated in Clause 1 of Article 27 of the Regulations on Quality Assessment and National Standard Recognition for Junior High Schools, Secondary General Schools, and General Secondary Schools with Multiple Levels issued together with Circular No. 18/2018/TT-BGDĐT dated August 22, 2018 of the Minister of Education and Training, which has been amended and supplemented by Circular No. 22/2024/TT-BGDĐT dated December 10, 2024 of the Minister of Education and Training (hereinafter referred to as Circular No. 18/2018/TT-BGDĐT) shall be carried out by the People's Committee at the commune level.

2. The authority to organize the implementation of regulations on quality assessment and national standard recognition for junior high schools as stipulated in Article 42 of Circular No. 18/2018/TT-BGDĐT shall be carried out by the People's Committee at the commune level.

3. Replace the phrase "Department of Education and Training" with the phrase "People's Committee at the commune level" in Circular No. 18/2018/TT-BGDĐT.

4. Remove the phrases "or head, deputy head of the Department of Education and Training," "or leaders, specialists of the Department of Education and Training," and "Department of Education and Training" in Article 29; and the phrases "Advise the People's Committee at the district level," "People's Committee at the district level" in Article 42 of Circular No. 18/2018/TT-BGDĐT.

5. Adjust the time limit for establishing the external evaluation team and implementing steps in the external evaluation process for junior high schools, issuing the Certificate of School Achieving Educational Quality Assessment and the Certificate of National Standard Recognition for Junior High Schools as stipulated in Circular No. 18/2018/TT-BGDĐT as follows:

a) The Department of Education and Training shall be responsible for establishing the external evaluation team in accordance with Articles 29 and 30 and implementing steps in the external evaluation process in accordance with Article 28 of this Regulation within two months from the date of notification to the People's Committee at the commune level or the junior high school that the registration file has been accepted for external evaluation.

b) Within fifteen working days from the date of receiving the report of the external evaluation team, the Director of the Department of Education and Training shall issue a decision to grant the Certificate of School Achieving Educational Quality Assessment according to the level achieved by the junior high school.

c) Within fifteen working days from the date of receiving the report of the external evaluation team, the Director of the Department of Education and Training shall issue a decision to grant the Certificate of National Standard Recognition for the junior high school.

Article 8. Organization to implement regulations on quality assessment and national standard recognition for kindergartens.

1. The authority to organize the acceptance, examination of registration files for external evaluation, and sending accepted registration files for external evaluation to the Department of Education and Training for kindergartens as stipulated in Clause 1 of Article 27 of the Regulations on Quality Assessment and National Standard Recognition for Kindergartens issued together with Circular No. 19/2018/TT-BGDĐT dated August 22, 2018 of the Minister of Education and Training, which has been amended and supplemented by Circular No. 22/2024/TT-BGDĐT dated December 10, 2024 of the Minister of Education and Training (hereinafter referred to as Circular No. 19/2018/TT-BGDĐT) shall be carried out by the People's Committee at the commune level.

2. The authority to organize the implementation of regulations on quality assessment and national standard recognition for kindergartens as stipulated in Article 42 of Circular No. 19/2018/TT-BGDĐT shall be carried out by the People's Committee at the commune level.

3. Replace the phrase "Department of Education and Training" with the phrase "People's Committee at the commune level" in Circular No. 19/2018/TT-BGDĐT.

4. Remove the phrases "or head, deputy head of the Department of Education and Training," "or leaders, specialists of the Department of Education and Training," and "Department of Education and Training" in Article 29; and the phrases "Advise the People's Committee at the district level," "People's Committee at the district level" in Article 42 of Circular No. 19/2018/TT-BGDĐT.

5. Adjust the time limit for establishing the external evaluation team and implementing steps in the external evaluation process for kindergartens, issuing the Certificate of School Achieving Educational Quality Assessment and the Certificate of National Standard Recognition for Kindergartens as stipulated in Circular No. 19/2018/TT-BGDĐT as follows:

a) The Department of Education and Training shall be responsible for establishing the external evaluation team in accordance with Articles 29 and 30 and implementing steps in the external evaluation process in accordance with Article 28 of this Regulation within two months from the date of notification to the People's Committee at the commune level or the kindergarten that the registration file has been accepted for external evaluation.

b) Within fifteen working days from the date of receiving the report of the external evaluation team, the Director of the Department of Education and Training shall issue a decision to grant the Certificate of School Achieving Educational Quality Assessment according to the level achieved by the kindergarten.

c) Within fifteen working days from the date of receiving the report of the external evaluation team, the Director of the Department of Education and Training shall issue a decision to grant the Certificate of National Standard Recognition for the kindergarten.

Article 9. Organization to implement the construction of safe schools and prevention of accidents and injuries in general education institutions and regular education facilities.

1. The authority to compile statistics and summarize the results of evaluating safe schools and prevention of accidents and injuries for schools under the management authority specified in Clause 3, Article 12 of Circular No. 18/2023/TT-BGDĐT dated October 26, 2023, issued by the Minister of Education and Training on the construction of safe schools and prevention of accidents and injuries in general education institutions and regular education facilities (hereinafter referred to as Circular No. 18/2023/TT-BGDĐT), shall be carried out by the People's Committee at the commune level.

2. Replace the phrase "report to the People's Committee at the district level" with the phrase "report to the People's Committee at the provincial level" in Clause 3, Article 12; and replace the phrase "Department of Education and Training" with the phrase "People's Committee at the commune level" in Articles 13 and 15 of Circular No. 18/2023/TT-BGDĐT.

3. Remove the phrase "and schools under the management authority of the People's Committee at the district level" in Clause 3, Article 12 of Circular No. 18/2023/TT-BGDĐT.

Article 10. Organization to implement the assessment and classification of physical fitness for students and trainees.

1. The authority to direct, guide, and inspect the organization of the assessment and classification of physical fitness for students and trainees at educational institutions under the management authority specified in Clause 2, Article 17 of the Regulation on the Assessment and Classification of Physical Fitness for Students and Trainees issued together with Decision No. 53/2008/QD-BGDĐT dated September 18, 2008, by the Minister of Education and Training (hereinafter referred to as Decision No. 53/2008/QD-BGDĐT), shall be carried out by the People's Committee at the commune level.

2. Replace the phrase "various Departments of Education" with the phrase "People's Committee at the commune level" in Clause 1, Article 17 of Decision No. 53/2008/QD-BGDĐT.

Article 11. Organization to implement regulations on the red cross emblem in schools.

1. The authority to organize the implementation of regulations on the red cross emblem in schools as stipulated in Article 11 of Circular No. 07/2014/TT-BGDĐT dated March 14, 2014, issued by the Minister of Education and Training on activities related to the red cross emblem in schools (hereinafter referred to as Circular No. 07/2014/TT-BGDĐT), shall be carried out by the People's Committee at the commune level.

2. Replace the phrase "Departments of Education and Training" with the phrase "People's Committee at the commune level" in Clause 2, Article 10 of Circular No. 07/2014/TT-BGDĐT.

Article 12. Organization to implement regulations on the use of email and electronic information portals.

1. The authority to guide and implement the organization of activities and use of email and electronic information portals; incorporate content on building, upgrading, managing, and operating email systems and electronic information portals into annual work plans; report on the results of organizing activities and using email and electronic information portals as stipulated in Article 14 of Circular No. 37/2020/TT-BGDĐT dated October 5, 2020, on the organization of activities and use of email and electronic information portals at Departments of Education and Training, Departments of Education and Training, and preschool, general education, and regular education facilities (hereinafter referred to as Circular No. 37/2020/TT-BGDĐT), shall be carried out by the People's Committee at the commune level.

2. The authority to organize inspections, evaluations, and rankings of activities of email and electronic information portal systems of subordinate educational facilities; publicly disclose results on electronic information portals as stipulated in Clause 5, Article 16 of Circular No. 37/2020/TT-BGDĐT, shall be carried out by the People's Committee at the commune level.

3. Replace the phrase "Department of Education and Training" with the phrase "People's Committee at the commune level" in Clause 1, 2 of Article 1, Clause 3 of Article 2, Clause 1 of Article 10, Clause 1, 3 of Article 13, and Clause 4 of Article 16; and replace the phrase "Head of the Department of Education and Training" with the phrase "Chairman of the People's Committee at the commune level" in Article 18 of Circular No. 37/2020/TT-BGDĐT.

Article 13. Organization to implement regulations on specialized classrooms

1. The authority to organize the implementation of regulations on specialized classrooms as stipulated in Article 19 of the Regulations on Specialized Classrooms for General Education Institutions issued together with Circular No. 14/2020/TT-BGDĐT dated May 26, 2022 of the Minister of Education and Training (hereinafter referred to as Circular No. 14/2020/TT-BGDĐT) shall be carried out by the People's Committee at the commune level.

2. Replace the phrase "Department of Education and Training" in Clause 2, Article 18 and Clause 3, Article 20 with the phrase "People's Committee at the commune level"; replace the phrase "People's Committee at the district level" with the phrase "People's Committee at the provincial level" in Clause 3, Article 19; and replace the phrase "Advise the People's Committee at the district level to establish" with the phrase "Organize establishment and decide according to its authority" in Clause 1, Article 19 of Circular No. 14/2020/TT-BGDĐT.

Article 14. Organization to implement regulations on standards for libraries of preschool and general education institutions

1. The authority to assess and recognize preschool, primary school, junior high school, and general education schools with multiple levels (the highest level being junior high school) libraries as stipulated in Point b, Clause 4, Article 25 of the Standards for Libraries of Preschool and General Education Institutions issued together with Circular No. 16/2022/TT-BGDĐT dated November 22, 2022 of the Minister of Education and Training (hereinafter referred to as Circular No. 16/2022/TT-BGDĐT) shall be carried out by the People's Committee at the commune level.

2. The authority to organize the implementation of regulations on standards for libraries of preschool and general education institutions as stipulated in Clause 2, Article 26 of Circular No. 16/2022/TT-BGDĐT shall be carried out by the People's Committee at the commune level.

3. Replace the phrases: "district level," "commune/district level" with the phrase "commune level" in Article 4; replace the phrase "Advise the People's Committee at the district level to invest" with the phrase "Organize establishment and decide according to its authority investment project" in Point a, Clause 2, Article 26; replace the phrase "People's Committee at the district level" with the phrase "People's Committee at the provincial level" in Point c, Clause 2, Article 26; and replace the phrase "Department of Education and Training" with the phrase "People's Committee at the commune level" in Articles 25 and 26 of Circular No. 16/2022/TT-BGDĐT.

Article 15. Organization to implement regulations on sponsorship for educational institutions under the national education system

1. The authority to organize the implementation of regulations on sponsorship for educational institutions under the national education system as stipulated in Article 11 of Circular No. 16/2018/TT-BGDĐT dated August 3, 2018 of the Minister of Education and Training on sponsorship for educational institutions under the national education system (hereinafter referred to as Circular No. 16/2018/TT-BGDĐT) shall be carried out by the People's Committee at the commune level.

2. Replace the phrase "Department of Education and Training" with the phrase "People's Committee at the commune level" in Clause 1 and 2, Article 5 and Clause 1, Article 14; and replace the word "district" with the word "commune" in Clause 1, Article 9; and replace the phrase "People's Committee at the district level" with the phrase "Department of Education and Training" in Clause 3, Article 11 of Circular No. 16/2018/TT-BGDĐT.

Article 16. Organization to implement integration of national defense and security education content

1. The authority to direct, inspect, and supervise primary schools and junior high schools as stipulated in Clause 2, Article 10 of Circular No. 08/2024/TT-BGDĐT dated May 15, 2024 of the Minister of Education and Training guiding the integration of national defense and security education content in primary schools, junior high schools, and general education schools with multiple levels (hereinafter referred to as Circular No. 08/2024/TT-BGDĐT) shall be carried out by the People's Committee at the commune level.

2. Replace the phrase "Department of Education and Training" with the phrase "People's Committee at the commune level" in Article 9, Point b, Clause 1, Article 10, and Article 11 of Circular No. 08/2024/TT-BGDĐT.

Article 17. Implementation of regulations on educational and training databases

1. The authority to guide and urge the implementation of reporting and data management within the scope of management based on the educational and training database as stipulated in Clause 4, Article 11 of Circular No. 42/2021/TT-BGDĐT dated December 30, 2021, issued by the Minister of Education and Training regarding educational and training databases (hereinafter referred to as Circular No. 42/2021/TT-BGDĐT), shall be carried out by the People's Committee at the commune level.

2. Replace the phrase "Department of Education and Training or department with the function of advising state management over education under the People's Committee of districts, towns, urban districts, and provincial cities directly under the central government (hereinafter collectively referred to as Department of Education and Training)" in Clause 2, Article 1 and the phrase "Department of Education and Training" in Clause 4, Clause 5, Article 9, Clause 1, Clause 3, Article 10, and Clause 3, Article 13 of Circular No. 42/2021/TT-BGDĐT with the phrase "People's Committee at the commune level."

Article 18. Replacing some terms and phrases in certain legal normative documents of the Minister of Education and Training

1. Replace the phrase "Department of Education and Training" with the phrase "People's Committee at the commune level" in Article 1 and Article 12 of Circular No. 21/2017/TT-BGDĐT dated September 6, 2017, issued by the Minister of Education and Training regarding the application of information technology in activities for teacher, staff, and educational management cadre training through the Internet; in Article 11 of Circular No. 31/2017/TT-BGDĐT dated December 18, 2017, issued by the Minister of Education and Training guiding the implementation of psychological counseling work for students in general schools; in Article 11 of Circular No. 33/2018/TT-BGDĐT dated December 26, 2018, issued by the Minister of Education and Training guiding social work in schools; in Article 12 of Circular No. 06/2019/TT-BGDĐT dated April 12, 2019, issued by the Minister of Education and Training regarding rules of conduct in preschool education institutions, general education institutions, and regular education institutions; in Article 10 of Circular No. 06/2022/TT-BGDĐT dated May 11, 2022, issued by the Minister of Education and Training guiding the provision of knowledge and skills for fire prevention, firefighting, rescue, and emergency response for students and trainees in educational institutions; in Article 10 of Circular No. 07/2022/TT-BGDĐT dated May 23, 2022, issued by the Minister of Education and Training regarding vocational guidance, employment, and entrepreneurship support in educational institutions.

2. Replace the phrase "district level" in Clause 2, Article 4 and Point c, Clause 2, Article 6 with the phrase "commune level"; replace the word "district" with the word "province" in Point a, Clause 2, Article 6; replace the phrases "district level," "district/quận," and "district" with the phrase "commune level" in the Appendix attached to Circular No. 35/2017/TT-BGDĐT dated December 28, 2017, issued by the Minister of Education and Training regarding the management, operation, and use of the information system for universal education and literacy.

3. Replace the phrase "District, town, city (under province)" with the phrase "commune level" in Point b, Clause 5, Article 10 of Circular No. 48/2020/BGDĐT dated December 31, 2020, issued by the Minister of Education and Training regarding sports activities in schools.

4. Replace the phrase "district level" with the phrase "commune level" in Item 3.2 in the Job Description Descriptions Appendices IIA, IIB, IIC of Circular No. 15/2023/TT-BGDĐT dated September 28, 2023, issued by the Minister of Education and Training guiding job positions for education-related civil servants.

5. Replace the phrase "Director of the Department of Education and Training" with the phrase "Chairman of the People's Committee at the commune level" in Article 12 of the Regulations on anti-drug work in educational institutions under the national education system promulgated together with Circular No. 31/2009/TT-BGDĐT dated October 23, 2009, issued by the Minister of Education and Training, and in Point a, Item 2210 (regarding the ratio of students recognized as having completed junior high school) Clause 2.2, Appendix II of Circular No. 03/2024/TT-BGDĐT dated March 18, 2024, issued by the Minister of Education and Training promulgating the statistical index system for the education sector.

6. Replace the phrase "Department of Education and Training" with the phrase "People's Committee at the commune level" in Appendix II; replace the phrase "Director of the Department of Education and Training" with the phrase "Chairman of the People's Committee at the commune level" in Clause 1, Part III Table 03. CN-THCS and Clause 1, Part II Table 05. CN-GDTX of Appendix II of Circular No. 25/2024/TT-BGDĐT dated December 25, 2024, issued by the Minister of Education and Training promulgating the reporting and statistical system for the education sector.

Chapter III

IMPLEMENTING PROVISIONS

Article 19. Effectiveness and Responsibility for Enforcement

1. This Circular takes effect from July 1, 2025.

2. This Circular shall cease to be effective from March 1, 2027, except for cases where the Law, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees, resolutions of the Government, decisions of the Prime Minister, or Circulars of the Minister of Education and Training stipulate authority, responsibility for state management, procedures, and formalities prescribed in this Circular through or issued from July 1, 2025, and become effective before March 1, 2027, in which case the corresponding provisions in this Circular shall cease to be effective at the time these legal normative documents take effect.

3. During the period when the provisions of this Circular are effective, if the provisions on authority, responsibility for state management, procedures, and formalities in this Circular differ from those in related legal normative documents issued before July 1, 2025, then they shall be implemented according to the provisions of this Circular.

4. The Director of the Office, the Head of the Legal Department, the Heads of relevant units under the Ministry of Education and Training; the Chairpersons of the People's Committees of provinces and centrally governed cities; the Directors of Departments of Education and Training; the Chairpersons of the People's Committees of communes; and related agencies, organizations, units, and individuals shall be responsible for enforcing this Circular./.
