Repeals the circulars issued by the Minister of Agriculture

and Rural Development

Based on the Law on Enactment of Legislative Acts dated June 22, 2015;

On the basis of Law amending and supplementing some articles of the Law on Legislative Regulatory Documents dated June 1, 2020;8 May 14, 2016 Government Decree detailing some provisions and measures to implement the Law on Legislative Regulatory Documents;

Pursuant to Decree No.Decision No. 34/2016/NĐ-CPDecember 31, 2020 Government Decree amending and supplementing some articles of the Government Decree No.

On the basis of Decree No. Decision No. 154/2020/NĐ-CPMayDecision No. 34/2016/NĐ-CP2016 Government Decree detailing some provisions and measures to implement the Law on Legislative Regulatory Documents;/5/Government Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development

On the basis of at the proposal of the Director of the Legal Department;

Article 1. Repeal all the circulars

Repeal all the following circulars:

2. Circular No. 67/2011/TT-BNNPTNT dated October 17, 2011 of the Minister of Agriculture and Rural Development promulgating national technical standards for variety testing of crops.

3. Circular No. 24/2012/TT-BNNPTNT dated June 19, 2012 of the Minister of Agriculture and Rural Development promulgating national technical standards for variety testing of crops.

4. Circular No. 33/2013/TT-BNNPTNT dated June 21, 2013 of the Minister of Agriculture and Rural Development promulgating national technical standards for variety testing of crops.

5. Circular No. 05/2014/TT-BNNPTNT dated February 10, 2014 of the Minister of Agriculture and Rural Development promulgating national technical standards for crop production.

7. Circular No. 28/2019/TT-BNNPTNT dated December 31, 2019 of the Minister of Agriculture and Rural Development stipulating technical requirements for chemical and antibiotic residue testing in aquatic food products.

1. Abolish Clause 1 Article 1 of Circular No. 55/2009/TT-BNNPTNT dated August 28, 2009 of the Minister of Agriculture and Rural Development promulgating national technical standards for plant protection and quarantine.

Article 2. Repeal part of the Circulars

Repeal part of the following Circulars:

2. Abolish Clauses 1, 2, and 5 Article 1 of Circular No. 26/2010/TT-BNNPTNT dated April 27, 2010 of the Minister of Agriculture and Rural Development promulgating national technical standards for plant quarantine and protection.

3. Abolish Clauses 1, 2, 3, 5, 6, 7, 9, and 10 Article 1 of Circular No. 71/2010/TT-BNNPTNT dated December 10, 2010 of the Minister of Agriculture and Rural Development promulgating national technical standards for plant quarantine and protection.

4. Abolish Clauses 2, 3, and 6 Article 1 of Circular No. 45/2011/TT-BNNPTNT dated June 24, 2011 of the Minister of Agriculture and Rural Development promulgating national technical standards for seed quality.

5. Abolish Clauses 1, 2, 3, 4, 5, 6, 7, 14, and 15 Article 1 of Circular No. 63/2012/TT-BNNPTNT dated December 14, 2012 of the Minister of Agriculture and Rural Development promulgating national technical standards for plant quarantine and protection.

6. Abolish Clauses 1, 2, 6, 8, 9, 10, 11, and 12 Article 1 of Circular No. 32/2013/TT-BNNPTNT dated June 14, 2013 of the Minister of Agriculture and Rural Development promulgating national technical standards for plant quarantine and protection.

7. Abolish Clauses 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 18, 19, 20, 21, 22, and 23 Article 1 of Circular No. 16/2014/TT-BNNPTNT dated June 5, 2014 of the Minister of Agriculture and Rural Development promulgating national technical standards for plant quarantine and protection.

Article 3. Implementation Provisions

a) Pesticides currently undergoing testing according to the national technical standards prescribed in Clause 1 Article 1 of Circular No. 55/2009/TT-BNNPTNT dated August 28, 2009 of the Minister of Agriculture and Rural Development promulgating national technical standards for plant protection and quarantine; Clause 1, 2 Article 1 of Circular No. 26/2010/TT-BNNPTNT dated April 27, 2010 of the Minister of Agriculture and Rural Development promulgating national technical standards for plant protection and quarantine; Clause 1, 2, and 3 Article 1 of Circular No. 71/2010/TT-BNNPTNT dated December 10, 2010 of the Minister of Agriculture and Rural Development promulgating national technical standards for plant protection and quarantine; Clause 8, 9, 10, 11, and 12 Article 1 of Circular No. 32/2013/TT-BNNPTNT dated June 14, 2013 of the Minister of Agriculture and Rural Development promulgating national technical standards for plant quarantine and protection; Clause 2, 6, 12, 13, 16, and 20 Article 1 of Circular No. 16/2014/TT-BNNPTNT dated June 5, 2014 of the Minister of Agriculture and Rural Development promulgating national technical standards for plant quarantine and protection before this Circular takes effect shall continue to be implemented according to the national technical standards prescribed in Clause 1 Article 1 of Circular No. 55/2009/TT-BNNPTNT dated August 28, 2009; Clause 1, 2 Article 1 of Circular No. 26/2010/TT-BNNPTNT dated April 27, 2010; Clause 1, 2, and 3 Article 1 of Circular No. 71/2010/TT-BNNPTNT dated December 10, 2010; Clause 8, 9, 10, 11, and 12 Article 1 of Circular No. 32/2013/TT-BNNPTNT dated June 14, 2013; Clause 2, 6, 12, 13, 16, and 20 Article 1 of Circular No. 16/2014/TT-BNNPTNT dated June 5, 2014. The results of pesticide testing conducted under these national technical standards may be used to apply for a registration certificate for pesticides in accordance with the regulations.

2. Transitional provisions:

a) Plant protection products undergoing testing in accordance with national technical regulations stipulated in Clause 1, Article 1 of Circular No. 55/2009/TT-BNNPTNT dated August 28, 2009 issued by the Minister of Agriculture and Rural Development on national technical regulations for plant protection and quarantine; Clause 1 and 2, Article 1 of Circular No. 26/2010/TT-BNNPTNT dated April 27, 2010 issued by the Minister of Agriculture and Rural Development on national technical regulations for plant protection and quarantine; Clause 1, 2, and 3, Article 1 of Circular No. 71/2010/TT-BNNPTNT dated December 10, 2010 issued by the Minister of Agriculture and Rural Development on national technical regulations for plant protection and quarantine; Clause 8, 9, 10, 11, and 12, Article 1 of Circular No. 32/2013/TT-BNNPTNT dated June 14, 2013 issued by the Minister of Agriculture and Rural Development on national technical regulations for plant quarantine and protection; Clause 2, 6, 12, 13, 16, and 20, Article 1 of Circular No. 16/2014/TT-BNNPTNT dated June 5, 2014 issued by the Minister of Agriculture and Rural Development on national technical regulations for plant quarantine and protection before this Circular takes effect shall continue to be implemented in accordance with the national technical regulations stipulated in Clause 1, Article 1 of Circular No. 55/2009/TT-BNNPTNT dated August 28, 2009; Clause 1 and 2, Article 1 of Circular No. 26/2010/TT-BNNPTNT dated April 27, 2010; Clause 1, 2, and 3, Article 1 of Circular No. 71/2010/TT-BNNPTNT dated December 10, 2010; Clause 8, 9, 10, 11, and 12, Article 1 of Circular No. 32/2013/TT-BNNPTNT dated June 14, 2013; Clause 2, 6, 12, 13, 16, and 20, Article 1 of Circular No. 16/2014/TT-BNNPTNT dated June 5, 2014. The results of the testing of plant protection products conducted in accordance with these national technical regulations may be used to apply for a Registration Certificate for plant protection products as prescribed.

b) Plant varieties undergoing trial testing in accordance with national technical regulations stipulated in Clauses 3, 4, 5, and 6 of Article 1 of Circular No. 67/2011/TT-BNNPTNT dated October 17, 2011 issued by the Minister of Agriculture and Rural Development on national technical regulations for plant variety trials; Clauses 3, 6, 7, 9, 10, 11, 12, 13, and 14 of Article 1 of Circular No. 24/2012/TT-BNNPTNT dated June 19, 2012 issued by the Minister of Agriculture and Rural Development on national technical regulations for plant variety trials; Clauses 2, 3, 4, 5, 6, 7, and 8 of Article 1 of Circular No. 33/2013/TT-BNNPTNT dated June 21, 2013 issued by the Minister of Agriculture and Rural Development on national technical regulations for plant variety trials; Clauses 1, 2, 3, 4, and 5 of Article 1 of Circular No. 05/2014/TT-BNNPTNT dated February 10, 2014 issued by the Minister of Agriculture and Rural Development on national technical regulations in crop production before the effective date of this Circular shall continue to be tested in accordance with the national technical regulations issued in the aforementioned Circulars until the trial results are obtained. These trial results will be used as the basis for issuing Plant Variety Protection Certificates in accordance with the provisions.

c) For plant varieties specified in Clauses 3, 4, 5, and 6 of Article 1 of Circular No. 67/2011/TT-BNNPTNT dated October 17, 2011 issued by the Minister of Agriculture and Rural Development on national technical regulations for plant variety trials; Clauses 3, 6, 7, 9, 10, 11, 12, 13, and 14 of Article 1 of Circular No. 24/2012/TT-BNNPTNT dated June 19, 2012 issued by the Minister of Agriculture and Rural Development on national technical regulations for plant variety trials; Clauses 2, 3, 4, 5, 6, 7, and 8 of Article 1 of Circular No. 33/2013/TT-BNNPTNT dated June 21, 2013 issued by the Minister of Agriculture and Rural Development on national technical regulations for plant variety trials; Clauses 1, 2, 3, 4, and 5 of Article 1 of Circular No. 05/2014/TT-BNNPTNT dated February 10, 2014 issued by the Minister of Agriculture and Rural Development on national technical regulations in crop production that have submitted applications for plant variety protection prior to the effective date of this Circular but have not yet commenced trials shall conduct trials in accordance with Clauses 3, 4, 5, and 6 of Article 1 of Circular No. 67/2011/TT-BNNPTNT dated October 17, 2011; Clauses 3, 6, 7, 9, 10, 11, 12, 13, and 14 of Article 1 of Circular No. 24/2012/TT-BNNPTNT dated June 19, 2012; Clauses 2, 3, 4, 5, 6, 7, and 8 of Article 1 of Circular No. 33/2013/TT-BNNPTNT dated June 21, 2013; Clauses 1, 2, 3, 4, and 5 of Article 1 of Circular No. 05/2014/TT-BNNPTNT dated February 10, 2014 until the trial results are obtained or conduct other comparative trial materials for distinctness, uniformity, and stability currently in use to serve as the basis for issuing Plant Variety Protection Certificates in accordance with the provisions.
