Based on the Ordinance on Fees and Charges No. 38/2001/PL-UBTVQH10 dated August 28, 2001;
Based on Decree No. 57/2002/NĐ-CP dated June 3, 2002; Decree No. 24/2006/NĐ-CP dated March 6, 2006 of the Government detailing the implementation of the Ordinance on Fees and Charges;
Based on Decree No. 23/2015/NĐ-CP dated February 16, 2015 of the Government on issuing copies from original records; certification of copies from original documents, certification of signatures, and certification of contracts and transactions;
Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 22/2013/NĐ-CP dated March 13, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;
The Minister of Finance and the Minister of Justice issue this Joint Circular to regulate the level of collection, collection system, payment, and management of certification fees for copies from original documents, certification of signatures, certification of contracts, and transactions:
Article 1. Scope of Regulation
This Circular regulates the level of collection, collection system, payment, and management of certification fees for copies from original documents, certification of signatures, certification of contracts, and transactions.
Article 2. Applicability
1. Organizations and individuals requesting certification of copies from original documents, certification of signatures, certification of contracts, and transactions at the Department of Justice of the district, city district, town, provincial city, or People's Committee of the commune must pay the certification fee according to the provisions of this Circular.
2. Individuals and households borrowing capital from credit institutions to serve the development of agriculture and rural areas as stipulated in Decree No. 55/2015/NĐ-CP dated June 9, 2015 of the Government on credit policies serving the development of agriculture and rural areas shall not have to pay the certification fee for the certification of mortgage contracts.
3. The agency implementing certification is the agency collecting the certification fee.
Article 3. Level of Collection of Fees
The level of collection of certification fees for copies from original documents, certification of signatures, certification of contracts, and transactions is as follows:
1. Certification of copies from original documents: VND 2,000 per page. From the third page onwards, collect VND 1,000 per page, but the maximum collection amount shall not exceed VND 200,000 per copy.
2. Certification of signatures: VND 10,000 per case (a case is considered as one or more signatures in one document or text).
3. Certification of contracts and transactions:
a) Certification of contracts and transactions: VND 30,000 per contract or transaction.
b) Certification of amendments, supplements, or cancellation of contracts and transactions: VND 20,000 per contract or transaction.
c) Correction of errors in contracts and transactions that have been certified: VND 10,000 per contract or transaction.
Article 4. Management of Certification Fees
Certification fees are revenue belonging to the state budget. The agency collecting the certification fee must remit 100% (one hundred percent) of the total amount of collected certification fees into the state budget according to the chapters, sections, and sub-sections of the current State Budget Classification. Related expenses for certification activities are funded from the state budget according to the approved annual budget estimates.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. This Circular takes effect from November 30, 2015. It replaces Joint Circular No. 92/2008/TTLT-BTC-BTP dated October 17, 2008 of the Ministry of Finance and the Ministry of Justice guiding the levels of collection, collection systems, payment, management, and use of certification fees for copies and certification, and Joint Circular No. 62/2013/TTLT-BTC-BTP dated May 13, 2013 of the Ministry of Finance and the Ministry of Justice regulating the levels of collection, collection systems, payment, management, and use of certification fees for contracts and transactions.
2. Other contents related to the collection, payment, management, and public disclosure of the collection system of certification fees not specified in this Circular shall be implemented according to the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws on fees and charges; Circular No. 45/2006/TT-BTC dated May 25, 2006 amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002; Circular No. 156/2013/TT-BTC dated November 6, 2013 of the Ministry of Finance guiding the implementation of certain articles of the Law on Tax Administration; the Law Amending and Supplementing Certain Articles of the Law on Tax Administration and Decree No. 83/2013/NĐ-CP dated July 22, 2013 of the Government; Circular No. 153/2012/TT-BTC dated September 17, 2012 of the Ministry of Finance guiding the printing, issuance, management, and use of various types of receipts for fees and charges belonging to the state budget and any subsequent amendments and supplements (if any).
3. Agencies, organizations, and individuals subject to the payment of certification fees and relevant agencies are responsible for implementing this Circular.
4. During the process of implementation, if there are any difficulties, organizations and individuals are requested to promptly report them to the Ministry of Finance and the Ministry of Justice for review and guidance./.
