CIRCULAR

Issuing the Civil Aviation Safety Regulations in the Aircraft and Aircraft Operation Sector

Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport to issue the Civil Aviation Safety Regulations in the Aircraft and Aircraft Operation Sector, which took effect from January 28, 2012, was amended and supplemented by:

1. Circular No. 03/2016/TT-BGTVT dated March 31, 2016, issued by the Minister of Transport to amend and supplement some articles of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport to issue the Civil Aviation Safety Regulations in the Aircraft and Aircraft Operation Sector, which took effect from May 15, 2016;

2. Circular No. 21/2017/TT-BGTVT dated June 30, 2017, issued by the Minister of Transport to amend and supplement some articles of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport to issue the Civil Aviation Safety Regulations in the Aircraft and Aircraft Operation Sector and Circular No. 03/2016/TT-BGTVT dated March 31, 2016, issued by the Minister of Transport to amend and supplement some articles of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport to issue the Civil Aviation Safety Regulations in the Aircraft and Aircraft Operation Sector, which took effect from September 1, 2017;

3. Circular No. 56/2018/TT-BGTVT dated December 11, 2018, issued by the Minister of Transport to issue the Circular amending and supplementing some articles of the Civil Aviation Safety Regulations in the Aircraft and Aircraft Operation Sector, which took effect from January 30, 2019;

4. Circular No. 42/2020/TT-BGTVT dated December 31, 2020, issued by the Minister of Transport to issue the Circular amending and supplementing some articles of the Civil Aviation Safety Regulations in the Aircraft and Aircraft Operation Sector, which took effect from March 15, 2021;

5. Circular No. 11/2022/TT-BGTVT dated June 29, 2022, issued by the Minister of Transport to amend and supplement some articles of the Civil Aviation Safety Regulations in the Aircraft and Aircraft Operation Sector, which took effect from June 29, 2022;

6. Circular No. 09/2023/TT-BGTVT dated June 9, 2023, issued by the Minister of Transport to amend and supplement some articles of the Civil Aviation Safety Regulations in the Aircraft and Aircraft Operation Sector issued together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport and the Circulars amending and supplementing Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport, which took effect from December 30, 2023;

7. Circular No. 28/2023/TT-BGTVT dated September 29, 2023, issued by the Minister of Transport to amend and supplement some articles of the Circulars in the Civil Aviation Sector, which took effect from September 29, 2023;

8. Circular No. 27/2024/TT-BGTVT dated July 2, 2024, issued by the Minister of Transport to amend and supplement some articles of the Civil Aviation Safety Regulations in the Aircraft and Aircraft Operation Sector issued together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport and the Circulars amending and supplementing Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport, which took effect from September 1, 2024;

9. Circular No. 65/2024/TT-BGTVT dated December 31, 2024, issued by the Minister of Transport to amend and supplement some articles of the Civil Aviation Safety Regulations in the Aircraft and Aircraft Operation Sector issued together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport and Circular No. 09/2023/TT-BGTVT dated June 9, 2023, issued by the Minister of Transport to amend and supplement some articles of the Civil Aviation Safety Regulations in the Aircraft and Aircraft Operation Sector issued together with Circular No. 01/2011/TT-BGTVT and the Circulars amending and supplementing Circular No. 01/2011/TT-BGTVT of the Minister of Transport, which took effect from March 31, 2025;

10. Circular No. 03/2025/TT-BGTVT dated April 14, 2025, issued by the Minister of Construction to amend and supplement some articles of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport to issue the Civil Aviation Safety Regulations in the Aircraft and Aircraft Operation Sector, which took effect from April 14, 2025;

Pursuant to the Civil Aviation Law of Vietnam dated June 29, 2006 and the Law Amending and Supplementing Some Articles of the Civil Aviation Law of Vietnam dated November 21, 2014;

Pursuant to the Law on Legislative Decrees 2025;

Pursuant to Decree No. 33/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

The Minister of Construction hereby issues the Civil Aviation Safety Regulations in the Aircraft and Aircraft Operation Sector as follows:[1]

Article 1. The Civil Aviation Safety Regulations in the Aircraft and Aircraft Operation Sector are issued together with this Circular[2].

Article 2. This Circular takes effect twelve months after its date of issuance and revokes[3]:

1. Decision No. 10/2008/QĐ-BGTVT dated June 13, 2008, issued by the Minister of Transport to issue the Civil Aviation Safety Regulations;

2. Decision No. 2727/1998/QĐ-CHK dated October 10, 1998, issued by the Director of the Civil Aviation Administration of Vietnam to issue the Commercial Aircraft Operation Regulations - QCHK-KT1;

3. Decision No. 20/2000/QĐ-CHK dated August 1, 2000, issued by the Director of the Civil Aviation Administration of Vietnam regarding the Airworthiness Regulations - Issue 1 - QCHK-CB1;

4. Decision No. 06/2000/QĐ-CHK dated February 3, 2000, issued by the Director of the Civil Aviation Administration of Vietnam to issue the Regulations on Aircraft Maintenance Personnel Certification - QCHK-66;

5. Decision No. 10/2001/QĐ-CHK dated July 9, 2001, issued by the Director of the Civil Aviation Administration of Vietnam to issue the Regulations on Procedures for Issuing Certificates for Aircraft and Aircraft Products and Equipment - QCHK-21;

6. Decision No. 16/2006/QĐ-BGTVT dated March 31, 2006, issued by the Minister of Transport to issue National Standard 22TCN 337-06 on Aircraft Maintenance Organization Approval;

7. Decision No. 45/2006/QĐ-BGTVT dated December 19, 2006, issued by the Minister of Transport to issue the Commercial Helicopter Operation Regulations.

Article 3. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of the Departments, the Director of the Civil Aviation Administration of Vietnam, the Heads of agencies, organizations, and individuals related to this Circular shall be responsible for its implementation.[4]./.

Circular No. 21/2017/TT-BGTVT dated June 30, 2017, issued by the Minister of Transport amending and supplementing certain provisions of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation and Circular No. 03/2016/TT-BGTVT dated March 31, 2016, issued by the Minister of Transport amending and supplementing certain provisions of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, is based on the following grounds:

[2] Article 1 of Circular No. 03/2016/TT-BGTVT dated March 31, 2016, issued by the Minister of Transport to amend and supplement certain provisions of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, which took effect from May 15, 2016, is hereby stipulated as follows:

“Article 1. Amend and supplement certain provisions of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation issued together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011

1. Amend and supplement certain provisions of Part 1 of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation (hereinafter referred to as the Civil Aviation Safety Regulations - hereinafter abbreviated as "Bộ QCATHK") at Appendix I promulgated together with this Circular.

2. Amend and supplement certain provisions of Part 3 of the Civil Aviation Safety Regulations at Appendix II promulgated together with this Circular.

3. Amend and supplement certain provisions of Part 4 of the Civil Aviation Safety Regulations at Appendix III promulgated together with this Circular.

4. Amend and supplement certain provisions of Part 5 of the Civil Aviation Safety Regulations at Appendix IV promulgated together with this Circular.

5. Amend and supplement certain provisions of Part 6 of the Civil Aviation Safety Regulations at Appendix V promulgated together with this Circular.

6. Amend and supplement certain provisions of Part 7 of the Civil Aviation Safety Regulations at Appendix VI promulgated together with this Circular.

7. Amend and supplement certain provisions of Part 8 of the Civil Aviation Safety Regulations at Appendix VII promulgated together with this Circular.

[3] Article 2 of Circular No. 03/2016/TT-BGTVT dated March 31, 2016, of the Minister of Transport amending and supplementing certain provisions of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, of the Minister of Transport issuing the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, which took effect from May 15, 2016, shall be as follows:

“Article 2. Effective Date

1. This Circular takes effect from May 15, 2016.

2. This Circular abolishes Circular No. 14/2014/TT-BGTVT dated May 12, 2014, of the Minister of Transport amending and supplementing Article 14.010 Chapter B Part 14 of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation issued together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, of the Minister of Transport."

Article 2 of Circular No. 21/2017/TT-BGTVT dated June 30, 2017, issued by the Minister of Transport to amend and supplement certain provisions of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, and Circular No. 03/2016/TT-BGTVT dated March 31, 2016, issued by the Minister of Transport to amend and supplement certain provisions of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, shall take effect from September 1, 2017, and is hereby stipulated as follows:

“Article 2. Effective Date

1. This Circular shall take effect from September 1, 2017.

2. The application of the provisions set forth in Appendix XI of this Circular shall be implemented from July 1, 2018.

3. This Circular abolishes:

a) Circular No. 41/2015/TT-BGTVT dated August 12, 2015, issued by the Minister of Transport to amend and supplement certain provisions in Part 12 and Part 14 of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation promulgated together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport.

b) Decision No. 471/QĐ-BGTVT dated February 22, 2017, regarding the correction of Circular No. 03/2016/TT-BGTVT dated March 31, 2016, issued by the Minister of Transport to amend and supplement certain provisions of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation.

Article 2 of Circular No. 56/2018/TT-BGTVT dated December 11, 2018, issued by the Minister of Transport to issue a Circular amending and supplementing certain provisions of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, shall take effect from January 30, 2019, and is hereby stipulated as follows:

“Article 2. Effective Date

1. This Circular shall take effect from January 30, 2019.

2. This Circular replaces Circular No. 14/2018/TT-BGTVT dated April 3, 2018, amending and supplementing certain provisions of Circular No. 03/2016/TT-BGTVT dated March 31, 2016, issued by the Minister of Transport to amend and supplement certain provisions of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation.

Article 2 of Circular No. 42/2020/TT-BGTVT dated December 31, 2020, issued by the Minister of Transport to issue a Circular amending and supplementing certain provisions of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, shall take effect from March 15, 2021, and is hereby stipulated as follows:

“Article 2. Effective Date

This Circular shall take effect from March 15, 2021.

Article 2 of Circular No. 11/2022/TT-BGTVT dated June 29, 2022, issued by the Minister of Transport to amend and supplement certain provisions of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, shall take effect from June 29, 2022, and is hereby stipulated as follows:

“Article 2. Effective Date

1. This Circular shall take effect from June 29, 2022.

2. Administrative procedures submitted to the Civil Aviation Administration of Vietnam before the effective date of this Circular shall be carried out according to the provisions of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation (amended and supplemented by Circular No. 03/2016/TT-BGTVT dated March 31, 2016; Circular No. 21/2017/TT-BGTVT dated June 30, 2017; Circular No. 56/2018/TT-BGTVT dated December 11, 2018; Circular No. 42/2020/TT-BGTVT dated December 31, 2020).

Article 2 of Circular 09/2023/TT-BGTVT dated June 9, 2023, issued by the Minister of Transport to amend and supplement certain provisions of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation promulgated together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport, and Circulars amending and supplementing Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport, shall take effect from December 30, 2023, is stipulated as follows:

“Article 2. Effective Date

This Circular takes effect from December 30, 2023.”

Article 5 of Circular 28/2023/TT-BGTVT dated September 29, 2023, issued by the Minister of Transport, amending and supplementing certain articles of Circulars in the civil aviation sector, shall take effect from September 29, 2023, as follows:

“State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

This Circular takes effect from September 29, 2023.”

Article 2 of Circular No. 27/2024/TT-BGTVT dated July 2, 2024, issued by the Minister of Transport, amending and supplementing certain articles of the Civil Aviation Safety Regulations for Aircraft and Aircraft Operations issued together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport, and other Circulars amending and supplementing Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport, shall take effect from September 1, 2024, as follows:

“Article 2. Effective Date

This Circular takes effect from September 1, 2024.

Article 2 of Circular No. 65/2024/TT-BGTVT dated December 31, 2024, issued by the Minister of Transport, amending and supplementing certain articles of the Civil Aviation Safety Regulations for Aircraft and Aircraft Operations issued together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport, and Circular No. 09/2023/TT-BGTVT dated June 9, 2023, issued by the Minister of Transport, amending and supplementing certain articles of the Civil Aviation Safety Regulations for Aircraft and Aircraft Operations issued together with Circular No. 01/2011/TT-BGTVT and other Circulars amending and supplementing Circular No. 01/2011/TT-BGTVT issued by the Minister of Transport, shall take effect from March 31, 2025, as follows:

“ Article 2. Effective Date

1. This Circular takes effect from March 31, 2025.

2. In cases where the legal normative documents cited in this Circular are amended, supplemented, or replaced, the amended, supplemented, or replaced legal normative documents shall be applied.

Article 2 of Circular No. 03/2025/TT-BXD amending and supplementing certain articles of the Civil Aviation Safety Regulations for Aircraft and Aircraft Operations issued together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport, is as follows:

"Article 2. Effective Date

This Circular takes effect from the date of issuance./.”

[4] Article 3 of Circular No. 03/2016/TT-BGTVT dated March 31, 2016, issued by the Minister of Transport, amending and supplementing certain articles of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport, issuing the Civil Aviation Safety Regulations for Aircraft and Aircraft Operations, shall take effect from May 15, 2016, as follows:

“Article 3. Implementation Organization

The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, and the Heads of relevant agencies, organizations, and individuals shall be responsible for implementing this Circular./.”

Article 3 of Circular No. 21/2017/TT-BGTVT dated June 30, 2017, issued by the Minister of Transport, amending and supplementing certain articles of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport, issuing the Civil Aviation Safety Regulations for Aircraft and Aircraft Operations, and Circular No. 03/2016/TT-BGTVT dated March 31, 2016, issued by the Minister of Transport, amending and supplementing certain articles of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport, issuing the Civil Aviation Safety Regulations for Aircraft and Aircraft Operations, shall take effect from September 1, 2017, as follows:

“Article 3. Implementation Organization

The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, and the Heads of relevant agencies, organizations, and individuals shall be responsible for implementing this Circular./.”

Article 3 of Circular No. 56/2018/TT-BGTVT dated December 11, 2018, issued by the Minister of Transport to amend and supplement certain articles of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, which took effect from January 30, 2019, is stipulated as follows:

“Article 3. Implementation Organization

The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, and the Heads of relevant agencies, organizations, and individuals shall be responsible for implementing this Circular./.”

Article 3 of Circular No. 42/2020/TT-BGTVT dated December 31, 2020, issued by the Minister of Transport to amend and supplement certain articles of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, which took effect from March 15, 2021, is stipulated as follows:

“Article 3. Implementation Organization

The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, and the Heads of relevant agencies, organizations, and individuals shall be responsible for implementing this Circular./.”

Article 3 of Circular No. 11/2022/TT-BGTVT dated June 29, 2022, issued by the Minister of Transport to amend and supplement certain articles of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation, which took effect from June 29, 2022, is stipulated as follows:

Article 3. Implementation organization

The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, the Heads of agencies, organizations, and individuals concerned shall be responsible for implementing this Circular./.

Article 3 of Circular No. 09/2023/TT-BGTVT dated June 9, 2023, issued by the Minister of Transport to amend and supplement certain provisions of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation promulgated together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport, and Circulars amending and supplementing Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport, shall take effect from December 30, 2023, is stipulated as follows:

“Article 3. Implementation Organization

The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, the Heads of agencies, units, and individuals concerned shall be responsible for implementing this Circular./..

Article 5 of Circular No. 28/2023/TT-BGTVT dated September 29, 2023, issued by the Minister of Transport to amend and supplement certain articles of various Circulars in the field of civil aviation, which took effect from September 29, 2023, is stipulated as follows:

“State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, the Director of the Information Technology Center, the Heads of agencies, units, and individuals concerned shall be responsible for implementing this Circular./.

Article 3 of Circular No. 27/2024/TT-BGTVT dated July 2, 2024, issued by the Minister of Transport to amend and supplement certain articles of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation promulgated together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, of the Minister of Transport and Circulars amending and supplementing Circular No. 01/2011/TT-BGTVT dated January 27, 2011, of the Minister of Transport, which took effect from September 1, 2024, is stipulated as follows:

Article 3. Implementation organization

The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, the Heads of agencies, organizations, and individuals concerned shall be responsible for implementing this Circular./.
