At the proposal of the Minister of Natural Resources and Environment,
The Government promulgates this Decree stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment.
Article 1. Position and Functions
||| The Ministry of Natural Resources and Environment is an agency of the Government, performing state management functions in the following areas: Land; water resources; mineral resources and geology; environment; meteorology and hydrology; climate change; surveying and mapping; comprehensive and unified state management over seas and islands; state management of public services in sectors and fields under the Ministry's jurisdiction.commission ||| Article 2. ||| The Ministry of Natural Resources and Environment performs the tasks and powers prescribed in Decree No. 36/2012/NĐ-CP dated April 18, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, and the following specific tasks and powers:

The Minister of Natural Resources and Environment shall stipulate the functions, tasks, powers, and organizational structure of subordinate units under the Ministry, except for units specified in Clauses 10 to 13 and Clause 22 of this Article; submit to the Prime Minister for stipulating the functions, tasks, powers, and organizational structure of General Departments under the Ministry, the National Hydro-meteorological Service Center, and decide to issue a list of other existing service organizations directly under the Ministry.specialized agency under the People's Committee of the province/city. This Decree takes effect from May 1, 2013.
Article 4. Effective date
1. This Decree replaces the following Government Decrees: No. 25/2008/NĐ-CP dated March 4, 2008 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment; No. 19/2010/NĐ-CP dated March 5, 2010 amending and supplementing Points c, d, g, h, and i of Clause 5, Article 2 of Decree No. 25/2008/NĐ-CP dated March 4, 2008 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment; No. 89/2010/NĐ-CP dated August 16, 2010 amending and supplementing Article 3 of Decree No. 25/2008/NĐ-CP dated March 4, 2008 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment.
2. Abolish previous regulationsy conflicting with this Decree.

Transitional Provisions trThe General Department of Geology and Mineral Resources continues to perform its functions, tasks, and powers according to current regulations until the Prime Minister decides on the functions, tasks, powers, and organizational structure of the General Department of Geology and Mineral Resources of Vietnam.
