The Minister of Justice issues this Circular amending and supplementing certain articles of Circular No.02/2017/TT-BTPdated March 23, 2017, issued by the Minister of Justice guiding certain contents on the management of civil servants, officials, and employees under the system of civil execution organizations; amended and supplemented by Circular No. 18/2018/TT-BTP; abolishing certain articles by Circular No. 06/2021/TT-BTP and Circular No. 12/2024/TT-BTP.
Article 1. Amending and supplementing Article 52
"Article 52. Examination Rules and Recruitment Regulations
The examination rules and recruitment regulations for the initial level Enforcement Officer position shall be implemented according to the provisions of Circular No. 001/2025/TT-BNV of the Minister of Home Affairs promulgating Examination Rules and Recruitment Regulations, Promotion, and Merit Rating of Civil Servants and Officials (until December 9, 2025) and Circular No. 22/2025/TT-BNV of the Minister of Home Affairs promulgating Examination Rules and Recruitment Regulations for Civil Servants (from December 10, 2025)."
Article 2. Amending and supplementing Clause 2 of Article 54
"2. The supervisory board performs duties and exercises powers as prescribed in Circular No. 001/2025/TT-BNV (until December 9, 2025) and Circular No. 22/2025/TT-BNV (from December 10, 2025)."
Article 3. Amending and supplementing Article 57
"Article 57. Forms and Times of Examinations
Candidates for the initial level Enforcement Officer position must participate in the following examinations, including:
1. Legal Knowledge Examination on Civil Execution:
Examination Form: Computer-based multiple-choice test.
Examination Time: 45 minutes.
Examination Content and Number of Questions for each examination period shall be decided by the Minister of Justice.
Candidates who answer correctly at least 50% of the questions will be eligible to take the Civil Execution Skills Examination.
2. Civil Execution Skills Examination:
Examination Form: Computer-based multiple-choice test.
Examination Time: Minimum 90 minutes, maximum 180 minutes.
Examination Content: Minimum 60 questions, maximum 120 questions on specific situations in civil execution work.
Examination Time and Number of Questions for the Civil Execution Skills Examination for each examination period shall be decided by the Minister of Justice."
Article 4. Amending and supplementing Article 58
"Article 58. Calculation of points for examination papers
1. Examination papers are graded on a scale of 100 points.
2. Points for examination papers are calculated as follows:
a) The examination paper on civil enforcement law is multiplied by a factor of 1;
b) The examination paper on civil enforcement skills is multiplied by a factor of 2."
Article 5. Amending and supplementing some clauses of Article 59
1. Amending and supplementing Clause 3 as follows:
"3. Those with a higher total score will be selected in descending order within the quota for初级级执行员 of each province and city.
Total score = (score of the civil enforcement skills examination paper) x 2 + score of the civil enforcement law examination paper.
Civil servants from civil enforcement agencies in localities with developed economic and social conditions who register to take the examination for primary level enforcement officers at civil enforcement agencies in border areas, islands, and regions with particularly difficult economic and social conditions shall have an additional 10 points added to their total score to determine the successful candidate."
2. Amending and supplementing Clause 4 as follows:
"4. In cases where two or more candidates have the same total score at the final quota, the candidate with a higher score in the civil enforcement skills examination paper will be the successful candidate. If it is still not possible to determine the successful candidate, the Chief of Civil Enforcement shall issue a report to the Director of the Civil Enforcement Management Department for submission to the Minister of Justice for consideration and decision on the successful candidate."
Article 6. Replacing and abolishing certain phrases
1. Replacing the phrase "Civil Enforcement General Bureau" in Clause 4 Article 1; Clause 1 Article 2; Clauses 1 and 2 Article 51; Point b, c and d Clause 1 Article 53; Clause 2 Article 55; Clause 5 Article 56; Clause 1 Article 60 and Point a Clause 1 Article 67 with the phrase "Civil Enforcement Management Department";
2. Replacing the phrase "Director of the Civil Enforcement General Bureau" in Clause 1 Article 53, Clause 3 Article 61, Clause 1 Article 62 and the phrase "Director" in Clause 5 Article 56 with the phrase "Director of the Civil Enforcement Management Department".
3. Replacing the phrase "Deputy Director of the Civil Enforcement General Bureau" in Point a Clause 1 Article 67 with the phrase "Deputy Director of the Civil Enforcement Management Department".
4. Replacing the phrase "Organization and Cadre Affairs Division" in Point d Clause 1 Article 53, Point a Clause 1 Article 67 with the phrase "Cadre Organization Board".
5. Replacing the phrase "Provincial Civil Enforcement Bureau" in Clause 4 Article 1; Clause 1, Clause 3 Article 56; the phrase "Provincial Civil Enforcement Bureau" in Clause 2 Article 2 and the phrase "Provincial Civil Enforcement Bureau under the Central Government" in Clause 1 Article 60, Clause 1 Article 61 with the phrase "Provincial Civil Enforcement".
6. Replacing the phrase "Director of the Provincial Civil Enforcement Bureau" in Clause 1 Article 51; Point c Clause 1 Article 53; Clauses 4, 5 Article 56; Point b Clause 1 Article 67 and the phrase "Director of the Provincial Civil Enforcement Bureau under the Central Government" in Clause 3 Article 61 with the phrase "Chief of Provincial Civil Enforcement".
7. Replacing the phrase "One Chief of Civil Enforcement District Bureau" in Point b Clause 1 Article 67 with the phrase "One Head of Civil Enforcement Section Area".
8. Abolishing the phrases: "Civil Enforcement District Bureau" in Clause 4 Article 1; "Civil Enforcement District Bureau at the county level" in Clause 2 Article 2.
9. Abolishing the phrase "under the Central Government" in Point c Clause 1 Article 55, Clause 3 Article 61.
Article 7. Effective Date
1. This Circular takes effect from November 11, 2025.
2. Heads of units under the Ministry of Justice; Chiefs of Civil Enforcement of provinces and cities; Directors of Civil Enforcement Departments under the Ministry of National Defense shall be responsible for implementing this Circular within their respective duties and authorities.
