Regulations on the basic statistical reporting system applicable to Groups, Corporations, and Companies under the Ministry of Industry and Trade

Pursuant to the Decree No. 40/2004/NĐ-CP dated February 13, 2004 of the Government detailing and guiding the implementation of certain provisions of the Law on Statistics;
Pursuant to Decree No. 189/2007/NĐ-CP dated December 27, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 44/2011/NĐ-CP dated June 14, 2011 of the Government amending and supplementing Article 3 of Decree No. 189/2007/NĐ-CP dated December 27, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decision No. 43/2010/QĐ-TTg dated June 2, 2010 of the Prime Minister on the issuance of the National Statistical Indicators System;

Pursuant to Decision No. 77/2010/QĐ-TTg dated November 30, 2010 of the Prime Minister promulgating the Basic Statistical Reporting System applicable to State-owned enterprises, businesses, and projects with foreign direct investment;
Pursuant to Circular No. 04/2011/TT-BKHĐT dated March 31, 2011 stipulating the system of basic statistical reporting forms applicable to State-owned enterprises, businesses, and projects with foreign direct investment;
The Minister of Industry and Trade hereby specifies the Basic Statistical Reporting System applicable to Groups, Corporations, and Companies under the Ministry as follows:
Section I. System of Reporting Forms:
Article 1. Reporting Forms
1. List of reporting forms:
a) Monthly report: 1 form;
b) Six-monthly report: 4 forms;
c) Annual report: 6 forms;
d) Official annual report: 1 form.
2. Reporting forms:
a) Form 01/BCT: Monthly business operation plan implementation report;
b) Form 02a/BCT: Six-monthly business operation plan implementation report;
c) Form 02b/BCT: Six-monthly and annual project implementation report;
d) Form 02c/BCT: Six-monthly and annual project disbursement report;
đ) Form 02d/BCT: Six-monthly and annual labor and income report;
e) Form 03a/BCT: Annual business operation plan implementation report;
g) Form 03b/BCT: New capacity increase of industrial products annual report;
h) Form 03c/BCT: Balance of certain industrial products annual report;
i) Form 04/BCT: Official annual business operation plan implementation report.

2. Joint Stock Companies, Limited Liability Companies holding more than 50% of the charter capital.
Section III. Reporting Deadline:
1. Monthly Report: The 17th day of each month.
2. Semi-annual Report: June 17th of each year.
3. Annual Report: November 17th of each year.
4. Official Annual Report: April 17th of the following year.
Section IV. Receiving Units:
Department of Planning - Ministry of Industry and Trade.
Section V. Reporting Requirements:
Article 4. Responsibilities and Obligations for Reporting
Groups, Corporations, Companies under the Ministry have the responsibility and obligation to:
1. Fully and accurately report all indicators specified in each reporting form.
2. Prepare reports according to the prescribed reporting deadlines and periods.
3. Submit reports to the receiving units within the stipulated deadlines.
Article 5. Methods of Submitting Reports
Reports shall be submitted in two forms:
1. In writing and must bear the signature and seal of the head of the unit.
2. As data files (sent via email) to the Department of Planning and the directly assigned civil servant overseeing the unit's activities (must bear the signature and seal of the head of the unit).
Section VI. Implementation Organization:
1. This Circular takes effect from December 1, 2011.
2. Departments, General Departments, Functional Agencies under the Ministry; Groups, Corporations, Companies under the Ministry and related units are responsible for implementing this Circular.
3. Any difficulties encountered during implementation should be reported to the Ministry of Industry and Trade (Department of Planning) for timely review and adjustment./.
