The Minister of Industry and Trade issues this Circular regulating the issuance of Origin Certificates (hereinafter referred to as C/O) and granting written approval for traders to self-certify the origin of exported goods (hereinafter referred to as Approval Document) pursuant to Clause 6, Article 28 of Decree No. 146/2025/NĐ-CP dated June 12, 2025 of the Government on decentralization and hierarchical division in the industrial and trade sector.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular regulates the issuance of Origin Certificates (hereinafter referred to as C/O) and granting written approval for traders to self-certify the origin of exported goods (hereinafter referred to as Approval Document) pursuant to Clause 6, Article 28 of Decree No. 146/2025/NĐ-CP dated June 12, 2025 of the Government on decentralization and hierarchical division in the industrial and trade sector.
Article 2. Applicability
1. The Import-Export Department (Ministry of Industry and Trade).
2. People's Committees of provinces and centrally governed cities (hereinafter referred to as Provincial People's Committee).
3. Traders, organizations, and individuals related to state management tasks concerning the origin of goods.
Chapter II
ORGANIZATION AND IMPLEMENTATION OF THE ISSUANCE OF C/O AND APPROVAL DOCUMENTS
Article 3. Principles for organizing and implementing the issuance of C/O and Approval Documents
1. Ensuring consistency and comprehensiveness in state management work regarding the origin of exported goods.
2. Ensuring compliance with the policies stipulated in the Law on the Organization of the Government and the Law on the Organization of Local Authorities.
3. Being consistent with the provisions on competent authorities entitled to issue C/O and Approval Documents under international treaties to which the Socialist Republic of Vietnam is a party.
4. Ensuring that the implementation of international treaties to which the Socialist Republic of Vietnam is a party and international agreements at the level of Departments under Ministries, Ministries, and equivalent Ministries is not disrupted, where such agreements contain provisions on the origin of goods.
Article 4. Content and scope of the issuance of C/O and Approval Documents
Article 5. Conditions for the issuance of C/O and Approval Documents
1. Ensuring a workforce to carry out the issuance and organization of the issuance of various types of C/O and Approval Documents.
2. Receiving training and instruction on the origin of goods for those authorized to sign C/O and Approval Documents.
3. Having an account for collecting fees for the certification of the origin of goods.
4. Ensuring digital infrastructure to implement the Ministry of Industry and Trade's Electronic Management and Certification System (hereinafter referred to as eCoSys) at the website www.ecosys.gov.vn continuously, stably, and smoothly executing the electronic fee collection process for the certification of the origin of goods, issuing electronic C/O, transmitting electronic C/O data, and issuing Approval Documents.
5. Having a separate storage area and necessary equipment to store files and certificates for the issuance of C/O and Approval Documents.
Chapter III
RESPONSIBILITY FOR IMPLEMENTATION AND PROVISIONAL CLAUSES
Article 6. Responsibilities of the Provincial People's Committee
1. Within ninety days from the date this Circular takes effect, the Provincial People's Committee must ensure that the organization assigned tasks according to its authority implements the issuance of various types of Certificates of Origin (C/O) and Approval Documents.
2. Provide information to the Department of Import-Export (Ministry of Industry and Trade) on the implementation documents for issuing C/O and Approval Documents (if any); sample seals of the agencies and organizations issuing C/O and Approval Documents; sample signatures of authorized persons signing C/O and Approval Documents, following the guidance of the Department of Import-Export (Ministry of Industry and Trade), and update immediately upon any changes.
3. Publicly announce the state management content regarding the origin of goods and guide traders to request C/O and Approval Documents in accordance with the legal regulations on the origin of goods.
4. Inspect and supervise the organizations assigned the task of issuing C/O and Approval Documents; handle violations related to the implementation of issuing C/O and Approval Documents in accordance with relevant legal provisions.
Article 7. Responsibilities of organizations assigned by the Provincial People's Committee to issue C/O and Approval Documents
1. Maintain conditions for issuing C/O and Approval Documents as stipulated in Article 5 of this Circular.
2. Implement procedures and formalities for issuing C/O and Approval Documents in accordance with legal regulations on the origin of goods, ensuring principles of transparency, administrative reform, and facilitation; receive and resolve complaints and difficulties raised by traders requesting C/O and Approval Documents.
3. Monitor and guide traders requesting C/O and Approval Documents to comply with legal regulations on the origin of goods.
4. Inspect and verify issued C/O and Approval Documents in accordance with legal regulations on the origin of goods (including cases where they no longer perform the task of issuing C/O and Approval Documents).
5. Report periodically by quarter and year or submit ad hoc reports to the Department of Import-Export (Ministry of Industry and Trade) and the Provincial People's Committee on the situation of issuing C/O and Approval Documents and fees for certification of the origin of goods as specified in Appendix IV attached to this Circular.
Article 8. Responsibilities of units under the Ministry of Industry and Trade
1. The Department of Import-Export shall be responsible for:
a) Summarizing the implementation status of issuing C/O and Approval Documents.
b) Developing training and training program contents on the origin of goods.
c) Taking the lead and coordinating with competent authorities and related units to regularly or ad hoc inspect agencies and organizations issuing C/O and Approval Documents.
2. The Department of E-commerce and Digital Economy shall be responsible for:
a) Managing technical infrastructure of the eCoSys System, connecting and transmitting electronic C/O data from the eCoSys System to the National Single Window Portal of Vietnam.
b) Creating accounts and assigning codes for agencies and organizations issuing C/O and Approval Documents on the eCoSys System.
c) Publishing and updating the list of agencies and organizations issuing C/O and Approval Documents on the eCoSys System.
Article 9. Effective Date
1. This Circular takes effect from July 1, 2025.
2. In case the legal normative documents cited in this Circular are amended, supplemented, or replaced, they shall be implemented in accordance with the amended, supplemented, or replaced legal normative documents./.
