AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES
OF THE LAND LAW NUMBER 31/2024/QH15, HOUSING LAW NUMBER 27/2023/QH15,
REAL ESTATE BUSINESS LAW NUMBER 29/2023/QH15 AND
CREDIT ORGANIZATIONS LAW NUMBER 32/2024/QH15
On the basis of the Constitution of the Socialist Republic of Vietnam;
The National Assembly enacts this Law to amend and supplement certain provisions of the Land Law number 31/2024/QH15, Housing Law number 27/2023/QH15, Real Estate Business Law number 29/2023/QH15 and Credit Organizations Law number 32/2024/QH15.
Article 1. Amend and supplement certain provisions of the Land Law number 31/2024/QH15
1. Amend and supplement Clause 2 of Article 251 as follows:
"2. Repeal Resolution No. 132/2020/QH14 dated November 17, 2020 of the National Assembly on piloting certain policies to resolve difficulties and backlog in land management and use for national defense and security combined with labor production and economic construction activities from January 1, 2025."
2. Amend and supplement Clause 1 of Article 252 as follows:
"1. This Law shall take effect from August 1, 2024, except as provided in Clauses 2 and 3 of this Article."
3. Amend and supplement Clause 10 of Article 255 as follows:
"10. Investment projects that fall under the cases of allocating land or leasing land without going through the public auction process for land use rights as prescribed by the Land Law number 45/2013/QH13, relevant laws, and are consistent with land planning and utilization plans but have not yet been allocated land or leased land shall continue to implement subsequent steps in the procedures and formalities for allocating land or leasing land to investors or project owners according to this Law if they meet one of the following conditions:
a) Projects that have selected investors or project owners in accordance with the investment law, housing law, and bidding law from July 1, 2014 to before August 1, 2024;
b) Projects where investors have submitted valid applications to select investors or project owners before August 1, 2024 and have selected investors or project owners before January 1, 2025.
The selection of investors or project owners for projects specified herein shall be carried out in accordance with the investment law, housing law, and bidding law in effect at the time of application submission."
4. Amend and supplement the first part of Clause 4 of Article 260 as follows:
"4. Land use plans, handling plans, reorganization and handling plans for houses and lands approved by competent authorities in accordance with Resolution No. 132/2020/QH14 of the National Assembly on piloting certain policies to resolve difficulties and backlog in land management and use for national defense and security combined with labor production and economic construction activities before January 1, 2025 shall be implemented according to the approved plans."
Article 2. Amend and supplement Clause 1 of Article 197 of the Housing Law number 27/2023/QH15
Amend and supplement Clause 1 of Article 197 as follows:
"1. This Law shall take effect from August 1, 2024."
Article 3. Amend and supplement Clause 1 of Article 82 of the Real Estate Business Law number 29/2023/QH15
Amend and supplement Clause 1 of Article 82 as follows:
"1. This Law shall take effect from August 1, 2024."
Article 4. Amend and supplement Clause 2 of Article 209 of the Credit Organizations Law number 32/2024/QH15
Amend and supplement Clause 2 of Article 209 as follows:
"2. Clause 3 of Article 200 and Clause 15 of Article 210 of this Law shall take effect from August 1, 2024."
Article 5. Effective Date
This Law shall take effect from August 1, 2024./.
This Law was adopted by the National Assembly of the Socialist Republic of Vietnam, the fifteenth session, seventh meeting, on June 29, 2024.
