Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Law on National Border dated June 17, 2003;

Pursuant to the Law on Electronic Transactions dated November 29, 2005;

Pursuant to the Law on Information Technology dated June 29, 2006;

Pursuant to the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam dated June 16, 2014;

Pursuant to the Ordinance on Border Guard dated March 28, 1997;

Pursuant to Decree No. 112/2014/NĐ-CP dated November 21, 2014 of the Government on management of land border gates;

1. Amending Clause 2 Article 2 as follows:

Article 1. Amending and supplementing certain provisions of the Regulation on Management of Activities at the Cam Ranh International Port - Ministry of National Defense issued together with Decision No. 25/2016/QĐ-TTg dated June 27, 2016 of the Prime Minister of the Government, amended and supplemented by Decision No. 29/2019/QĐ-TTg dated October 3, 2019 of the Prime Minister of the Government.

At the proposal of the Minister of National Defense,

The Government Chairman promulgates this Decision on the implementation of electronic border procedures at border gates managed by the Ministry of National Defense[1].

Chapter I. GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Decision stipulates the implementation of electronic border procedures for persons, drivers, passengers, vehicles exiting and entering at international border gates, main border gates on the land border; Vietnamese ships operating domestic routes arriving at and departing from port border gates; issuance of visas at international border gates on the land border and port border gates managed by the Ministry of National Defense (hereinafter referred to as the implementation of electronic border procedures in visa issuance at border gates).

2. Electronic border procedures at port gates managed by the Ministry of National Defense for Vietnamese ships entering and exiting; foreign ships, foreign seafarers entering and exiting, transiting, and changing ports shall be implemented in accordance with Decision No. 10/2016/QĐ-TTg dated March 3, 2016 of the Government Chairman on the implementation of electronic border procedures at ports.

Article 2. Applicability

1. Border Guard Posts at international border gates, border guard posts at main border gates, and border inspection stations at international border gates, main border gates on the land border (hereinafter referred to as border guards at land border gates); Command Posts of Border Guards at port gates, border guard posts at port gates, and border guard stations at port gates under border guard posts (hereinafter referred to as border guards at port gates).

2. Vietnamese citizens exiting and entering (individuals or groups) at international border gates, main border gates on the land border; foreigners (individuals or groups) entering and exiting Vietnam for sightseeing and tourism according to programs organized by international travel enterprises in Vietnam (hereinafter referred to as tourist groups); foreigners obtaining visas at international border gates on the land border and port gates managed by the Ministry of National Defense (hereinafter referred to as visa recipients at border gates).

3. Vietnamese citizens, foreigners exiting and entering at international border gates, main border gates on the land border in groups dispatched abroad or invited to Vietnam by ministries, agencies at the level of ministries, provincial people's committees, or equivalent bodies (hereinafter referred to as official delegations).

4. Drivers, passengers, vehicles exiting and entering, including:

a)[2] Drivers, passengers, foreign motor vehicles entering and exiting to participate in traffic in Vietnam in accordance with Decree No. 151/2024/NĐ-CP dated November 15, 2024 of the Government detailing certain provisions and measures to implement the Road Traffic Safety Law;

b) Drivers, passengers, vehicles exiting and entering operating in accordance with agreements on road transport between Vietnam and neighboring countries and international treaties to which the Socialist Republic of Vietnam is a party.

5. Vietnamese ships operating domestic routes arriving at and departing from port gates.

6. Agencies, organizations, and individuals related to the implementation of electronic border procedures at border gates managed by the Ministry of National Defense.

Article 3. Explanation of Terms

In this Decision, the following terms are understood as follows:

1. Electronic border procedure at land border gate refers to the process where the person making the declaration reports information, and the border guard at the land border gate receives, processes, exchanges information, and confirms the completion of the electronic border procedure declaration for persons and vehicles entering and exiting through the Electronic Border Procedure Portal or through the National Single Window Portal in accordance with regulations on implementing the national single window mechanism and this Decision when the Electronic Border Procedure Portal is fully connected to the National Single Window Portal.

2. Electronic border procedure for Vietnamese ships operating domestic routes arriving at and departing from port gates refers to border procedures wherein the person making the declaration reports, and the border guard at the port gate receives, processes, exchanges information, and confirms the completion of the border procedure for crew members, passengers, and Vietnamese ships operating domestic routes arriving at and departing from port gates through the National Single Window Portal or through the Electronic Border Procedure Portal in case of malfunction of the National Single Window Portal.

3. Electronic border control procedures for visa issuance at border gates involve the declarant reporting information, and the land border gate border guards or port border gate border guards receiving, processing, and confirming the completion of the information declaration for foreigners' visa issuance at land border gates and ports through the electronic border control procedure portal or the National Single Window portal, in accordance with regulations on implementing the national single window mechanism and this Decision, when the electronic border control procedure portal is fully connected to the National Single Window portal.

4. The person conducting electronic border control procedures (hereinafter referred to as the declarant)

a) For Vietnamese citizens entering and exiting the country, the declarant is an individual Vietnamese citizen entering or exiting the country, or a person authorized by a Vietnamese citizen entering or exiting the country to conduct electronic border control procedures at land border gates;

b) For tour groups and visa recipients at the border gate, the declarant is a person authorized by a Vietnamese international travel service enterprise to report and conduct electronic border control procedures for tour groups and visa recipients at the border gate;

c) For official delegations, the declarant is a person authorized by agencies or organizations specified in Clause 3, Article 2 of this Decision to report and conduct electronic border control procedures for official delegations at land border gates;

d) For persons controlling or traveling on vehicles, and vehicles entering or exiting the country, the declarant is a person authorized by a Vietnamese international travel service enterprise or an international road transport business enterprise or cooperative to report and conduct electronic border control procedures for persons controlling or traveling on vehicles, and vehicles entering or exiting the country at land border gates;

đ) For Vietnamese vessels operating domestic routes arriving at or departing from port border gates, the declarant is the vessel owner, vessel manager, vessel lessee, vessel operator, captain, or a person authorized to report and conduct electronic port border control procedures for Vietnamese vessels operating domestic routes arriving at or departing from port border gates.

5. The electronic border control procedure portal is an access point on the internet, built based on the electronic port border control procedure portal stipulated in Clause 2, Article 3 of Decision No. 10/2016/QĐ-TTg dated March 3, 2016 of the Government Chairman regarding the implementation of electronic port border control procedures, to carry out electronic land border and port border control procedures; it integrates information, services, and applications (creating electronic forms and declarations, supporting export for printing forms and declarations), allowing users to exploit, use, and personalize the display of information at the address http://thutucbienphong.gov.vn.

The electronic border control procedure portal is connected to the National Single Window portal according to the provisions of the National Single Window mechanism and connected to the National Public Service Portal, the Ministry of National Defense Public Service Portal according to the provisions of Government Decree No. 61/2018/NĐ-CP dated April 23, 2018 on implementing the Single Window and Interconnected Single Window mechanisms in administrative procedures.

6. The electronic declaration form for land border gates is an electronic form that the declarant must fill out when conducting electronic border control procedures at land border gates.

7. The electronic border guard file for land border gates is a collection of electronic declaration forms for land border gates.

8. Reporting electronic border control procedures at land border gates involves the declarant using the Internet to report electronic declaration forms and send them to the land border gate border guards through the electronic border control procedure portal.

9. Manual border control procedures at land border gates involve the declarant and the land border gate border guards conducting border control procedures through paper forms.

10. Confirming the completion of electronic border control procedure reports at land border gates involves the land border gate border guards receiving, checking, processing the information, and sending the Confirmation of Completion of Electronic Border Control Procedure Reports to the declarant through the electronic border control procedure portal.

Article 4. Principles for Implementing Electronic Border Procedures

1. Ensuring equality, transparency, clarity, speed, safety, convenience; complying with Vietnamese laws on electronic transactions, entry and exit, and being consistent with relevant international treaties to which the Socialist Republic of Vietnam is a party.

2. Individuals may choose to implement electronic border procedures or follow manual procedures for border formalities.

Chapter II. IMPLEMENTATION OF ELECTRONIC BORDER PROCEDURES AT LAND BORDER GATES

Section 1. GENERAL PROVISIONS ON THE IMPLEMENTATION OF ELECTRONIC BORDER PROCEDURES AT LAND BORDER GATES

Article 5. Time and Location for Implementing Electronic Border Procedures at Land Border Gates

1. Time:

Electronic border procedures at land border gates are implemented 24 hours a day, seven days a week, including holidays.

2. Location:

a)[3] Individuals who declare electronic border forms and receive confirmation of completed declarations for electronic border procedures at land border gates through an electronic identity account established and verified according to the law on electronic identification and authentication and this Decision can do so from anywhere with internet access;

b) Border guards at land border gates implement electronic border procedures at the Joint Inspection Building of international border gates and main border gates.

Article 6. Use of Digital Signatures in Implementing Electronic Border Procedures at Land Border Gates

1. Agencies, units, and individuals within the Border Guard Force shall use digital signatures in accordance with the law on providing, managing, and using specialized digital signature authentication services for Party and State agencies and social organizations.

2. Individuals representing agencies, organizations, and enterprises must use digital signatures in accordance with the law on digital signatures and digital signature authentication services when implementing electronic border procedures at land border gates.

Individuals who are Vietnamese citizens exiting or entering the country are not required to use digital signatures when implementing electronic border procedures at land border gates.

3. Digital signatures must be issued by legitimate service providers of digital signature authentication and registered with the Electronic Border Procedure Portal at the address http://thutucbienphong.gov.vn or registered on the National Single Window Portal.

4. After registering the digital signature, individuals implement electronic border procedures at land border gates on the Electronic Border Procedure Portal at the address http://thutucbienphong.gov.vn.

Article 7. Use of Electronic Identity Accounts to Log In to the Electronic Border Procedure Portal to Implement Electronic Border Procedures at Land Border Gates

1. Individuals use electronic identity accounts created by the electronic identification and authentication system, connected and integrated on the Electronic Border Procedure Portal, to log in to the Electronic Border Procedure Portal to implement electronic border procedures at land border gates in accordance with the law on electronic identification and authentication and this Decision.

2. The process of using electronic identity accounts to log in to the Electronic Border Procedure Portal to implement electronic border procedures at land border gates:

a) Individuals access the address: http://thutucbienphong.gov.vn to log in to the Electronic Border Procedure Portal;

b) At the login interface of the Electronic Border Procedure Portal, individuals select the type of account as individual (for individuals representing agencies and organizations, they select the type of account as agency or organization), then log in with an electronic identity account issued by the Ministry of Public Security for Vietnamese citizens (for individuals representing agencies and organizations, they log in with an electronic identity account issued by the Ministry of Public Security for agencies and organizations); the system automatically redirects to the electronic identification and authentication system;

c) At the interface of the electronic identification and authentication system, individuals log in with their individual electronic identity account issued by the Ministry of Public Security (for individuals representing agencies and organizations, they log in with their agency or organizational electronic identity account issued by the Ministry of Public Security);

d) After successful login, the system automatically redirects to the interface of the Electronic Border Procedure Portal for individuals to proceed with declaring electronic border procedures.

Article 8. Suspension of use of electronic identity account for logging into the Electronic Border Procedures Portal to perform electronic border procedures at land border gates.

In case of detecting risks affecting the security and safety of data on electronic border procedures, the Border Gate Commander of the land border gate has the right to temporarily suspend the use of the electronic identity account for logging into the Electronic Border Procedures Portal and notify the person performing the procedure, clearly stating the reason for not accepting electronic data.

Section 2. IMPLEMENTATION OF ELECTRONIC BORDER PROCEDURES AT LAND BORDER GATES UNDER THE NATIONAL SINGLE WINDOW MECHANISM AND THROUGH THE ELECTRONIC BORDER PROCEDURES PORTAL

Article 9. Implementation of electronic border procedures at land border gates under the National Single Window Mechanism

1. When the Electronic Border Procedures Portal is completed with connection to the National Single Window Portal, the Border Gate at the land border gate and the person performing the procedure shall implement electronic border procedures at the land border gate through the National Single Window Portal in accordance with regulations on implementing the National Single Window Mechanism and the provisions of this Decision.

2. During the period when the Electronic Border Procedures Portal has not been completed with connection to the National Single Window Portal to perform electronic border procedures or in cases where the National Single Window Portal encounters technical issues, the Border Gate at the land border gate and the person performing the procedure shall implement electronic border procedures at the land border gate through the Electronic Border Procedures Portal in accordance with the provisions of this Decision.

Article 10. Implementation of electronic border procedures at land border gates through the Electronic Border Procedures Portal

1. Electronic border procedures at land border gates for Tourist Groups, Official Delegations exiting and entering the country

a) Not later than six hours before the expected arrival time of the Tourist Group or Official Delegation at the international border gate or main border gate, the person performing the procedure must declare the Declaration Form for the Tourist Group or Official Delegation according to Model No. 07 prescribed in the Appendix attached to this Decision and send it to the Border Guard at the land border gate through the Electronic Border Procedures Portal;

The start time of the implementation of electronic border procedures is determined from the moment the Border Guard at the land border gate receives the Declaration Form for the Tourist Group or Official Delegation through the Electronic Border Procedures Portal.

b) Not later than three hours from the time of receiving the Declaration Form for the Tourist Group or Official Delegation, the Border Guard at the land border gate must send the Confirmation of Completion of Declaration for Electronic Border Procedures for the Tourist Group or Official Delegation according to Model No. 08 prescribed in the Appendix attached to this Decision to the person performing the procedure through the Electronic Border Procedures Portal;

The completion time of the declaration for electronic border procedures is determined from the moment the person performing the procedure receives the Confirmation of Completion of Declaration for Electronic Border Procedures for the Tourist Group or Official Delegation through the Electronic Border Procedures Portal.

c) When the Tourist Group or Official Delegation arrives at the international border gate or main border gate to exit or enter the country, the person performing the procedure must present passports or other international travel documents of the passengers to the Border Guard at the land border gate for inspection, control, and verification of exit and entry into Vietnam in the passports or other international travel documents of the passengers in accordance with the regulations.

2. Electronic border procedures at land border gates for the driver, passenger, and vehicle exiting and entering the country

a) Not later than six hours before the expected arrival time of the vehicle at the international border gate or main border gate, the person performing the procedure must declare the Declaration Form for the driver, passenger, and vehicle according to Model No. 09 prescribed in the Appendix attached to this Decision and send it to the Border Guard at the land border gate through the Electronic Border Procedures Portal;

The start time of the implementation of electronic border procedures is determined from the moment the Border Guard at the land border gate receives the Declaration Form for the driver, passenger, and vehicle through the Electronic Border Procedures Portal.

b) Not later than three hours from the time of receiving the Declaration Form for the driver, passenger, and vehicle, the Border Guard at the land border gate must send the Confirmation of Completion of Declaration for Electronic Border Procedures for the driver, passenger, and vehicle according to Model No. 10 prescribed in the Appendix attached to this Decision to the person performing the procedure through the Electronic Border Procedures Portal;

The completion time of the declaration for electronic border procedures is determined from the moment the person performing the procedure receives the Confirmation of Completion of Declaration for Electronic Border Procedures for the driver, passenger, and vehicle through the Electronic Border Procedures Portal.

c) When the driver, passenger, and vehicle arrive at the international border gate or main border gate to exit or enter the country, the person performing the procedure must present passports or other international travel documents of the driver and passenger and the relevant documents of the vehicle in accordance with Article 9 of Decree No. 112/2014/NĐ-CP dated November 21, 2014 of the Government on management of land border gates to the Border Guard at the land border gate for inspection, control, and verification of exit and entry into Vietnam in the passports or other international travel documents of the driver and passenger in accordance with the regulations.

3. Electronic border procedures at land border gates for Vietnamese citizens exiting and entering the country

a) Not later than three hours before the expected arrival at the international border gate or main border gate of Vietnamese citizens for departure or entry, the person handling the procedures must declare the Declaration Form for Vietnamese Citizens Departing from and Entering Vietnam according to Model No. 01 prescribed in the Appendix attached to this Decision and send it to the Border Guard of the land border gate through the Electronic Border Procedures Portal;

The time for initiating electronic border procedures is determined from the moment the Border Guard of the land border gate receives the Declaration Form for Vietnamese Citizens Departing from and Entering Vietnam through the Electronic Border Procedures Portal.

b) Not later than one hour after receiving the Declaration Form for Vietnamese Citizens Departing from and Entering Vietnam, the Border Guard of the land border gate must send the Confirmation of Completion of Electronic Border Procedures Declaration Form for Vietnamese Citizens Departing from and Entering Vietnam according to Model No. 02 prescribed in the Appendix attached to this Decision to the person handling the procedures through the Electronic Border Procedures Portal;

The completion time of the electronic border procedures declaration is the moment when the person handling the procedures receives the Confirmation of Completion of Electronic Border Procedures Declaration Form for Vietnamese Citizens Departing from and Entering Vietnam through the Electronic Border Procedures Portal.

c) When Vietnamese citizens arrive at the international border gate or main border gate for departure or entry, they must present their passport or valid travel document for departure and entry, or valid border area travel document to the Border Guard of the land border gate for inspection, control, and verification of departure and entry to Vietnam as prescribed.

4. In case of technical issues with the Electronic Border Procedures Portal, the Border Guard of the land border gate must notify the person handling the procedures in writing, by telephone, email, or on the Electronic Border Procedures Portal, or the Ministry of National Defense's Electronic Portal so that the person handling the procedures can perform the border procedures manually.

Article 11. Amending and Supplementing the Electronic Border Gate File

1. The person handling the procedures may amend and supplement the electronic file in the following cases:

a) Discovering errors or updating information that needs to be declared in the electronic file after receiving the Confirmation of Completion of Electronic Border Procedures Declaration Form for the land border gate but must obtain the approval of the Border Guard of the land border gate;

b) The Border Guard of the land border gate requests amendments and supplements to the declaration content in the electronic file;

c) Requests for amendments and supplements to the declaration content in the electronic file by the Border Guard shall be carried out according to Model No. 13, and the amended and supplemented declaration form by the person handling the procedures shall be carried out according to Model No. 14 prescribed in the Appendix attached to this Decision.

2. Processing the amended and supplemented electronic file

a) The Border Guard of the land border gate accepts the content of the amendment and supplementary declaration in the electronic file through verification and clarification of the reasons for requesting amendments and supplements by the person handling the procedures;

b) The electronic file before and after amendment and supplementation will be stored in the electronic border data processing system of the land border gate to serve as a basis for checking, comparing, and verifying the authenticity of the declaration in the electronic file by the person handling the procedures.

3. Time limit for requesting amendments and supplements to the electronic file; sending the amended and supplemented electronic file; confirming the completion of the electronic border procedures declaration for the amended and supplemented electronic file

a) Time limit for requesting amendments and supplements to the electronic file by the Border Guard of the land border gate

Immediately upon discovering that the electronic border procedures declaration of the person handling the procedures is incomplete or inaccurate, the Border Guard of the land border gate sends a request for amendment and supplementary declaration to the person handling the procedures through the Electronic Border Procedures Portal.

b) Time limit for sending the amended and supplemented electronic file

In case the Border Guard of the land border gate requests amendments and supplements to the declaration content in the electronic file: Not later than one hour after receiving the request for amendment and supplementary declaration content from the Border Guard of the land border gate, the person handling the procedures must declare the Amended and Supplementary Declaration Form for Electronic Border Procedures and send it to the Border Guard of the land border gate through the Electronic Border Procedures Portal;

In case the person handling the procedures discovers errors or updates information that needs to be declared in the electronic file: Immediately upon discovering errors or updating information that needs to be declared in the electronic file, the person handling the procedures must declare the Amended and Supplementary Declaration Form for Electronic Border Procedures and send it to the Border Guard of the land border gate through the Electronic Border Procedures Portal.

c) Time limit for confirming the completion of the electronic border procedures declaration for the amended and supplemented electronic file

Not later than one hour after receiving the Amended and Supplementary Declaration Form from the person handling the procedures, the Border Guard of the land border gate must send the Confirmation of Completion of Electronic Border Procedures Declaration for the Amended and Supplemented Electronic File according to Model No. 15 prescribed in the Appendix attached to this Decision to the person handling the procedures through the Electronic Border Procedures Portal.

Chapter III. IMPLEMENTATION OF ELECTRONIC BORDER PROCEDURES FOR VIETNAMESE SHIPS OPERATING ON DOMESTIC ROUTES ARRIVING AT AND DEPARTING FROM PORT GATES

Article 12. Implementation of electronic border procedures for Vietnamese vessels operating on domestic routes entering and leaving port customs checkpoints through the National Single Window Portal

1. The electronic border procedures for Vietnamese vessels operating on domestic routes entering and leaving port customs checkpoints shall be implemented through the National Single Window Portal in accordance with regulations on the implementation of the National Single Window Mechanism and the provisions of this Decision.

2.[6] In case of technical issues with the National Single Window Portal, the electronic border procedures for Vietnamese vessels operating on domestic routes entering and leaving port customs checkpoints shall be carried out through the Electronic Border Procedures Portal in accordance with the provisions of this Decision.

The use of digital signatures in implementing electronic border procedures for Vietnamese vessels operating on domestic routes entering and leaving port customs checkpoints shall be conducted in accordance with the regulations of the Ministry of National Defense on the implementation of electronic border procedures for seaports.

3. The port border guard checkpoint may refuse to implement electronic border procedures for Vietnamese vessels operating on domestic routes entering and leaving port customs checkpoints in accordance with Decision No. 10/2016/QĐ-TTg dated March 3, 2016 of the Government's Prime Minister on the implementation of electronic border procedures for seaports and the regulations of the Ministry of National Defense on the implementation of electronic border procedures for seaports.

Article 13. Implementation of electronic border procedures for Vietnamese vessels operating on domestic routes entering and leaving port customs checkpoints through the Electronic Border Procedures Portal

1. At least four hours before a Vietnamese vessel operating on a domestic route is expected to arrive at the port customs checkpoint, and at least two hours before a Vietnamese vessel leaves the port customs checkpoint, the person handling the procedure must declare the required electronic forms on the Electronic Border Procedures Portal, including:

a) General declaration form;

b) Crew list;

c) Passenger list (if applicable).

2. Within one hour from the time of receiving all valid electronic declarations, the port border guard checkpoint must confirm the completion of the electronic border procedures for Vietnamese vessels operating on domestic routes entering and leaving the port customs checkpoint.

The time for initiating the electronic border procedures is determined from the moment the port border guard checkpoint receives all electronic declarations through the Electronic Border Procedures Portal.

The time point confirming the completion of the electronic border procedures is the moment when the person handling the procedure receives confirmation of the completion of the electronic border procedures through the Electronic Border Procedures Portal.

3. Types of documents that the person handling the procedure must present, locations, and deadlines for presenting such documents to the port border guard checkpoint after completing the electronic border procedures for Vietnamese vessels operating on domestic routes entering and leaving the port customs checkpoint

a) [7] Types of documents to be presented:

Passports of crew members; passports or international travel documents or Identity Cards or Citizen Identification Cards of passengers (if applicable);

Other documents upon request of the port border guard checkpoint: Voyage logbook; documents related to goods (if there are goods on board), including: Cargo transportation contracts; purchase and sale contracts for goods and value-added tax invoices or internal dispatch and transport certificates; permits for transporting goods issued by competent authorities of Vietnam for goods subject to conditions.

b) Locations for presenting documents:

At the headquarters of the port border guard checkpoint or the headquarters of the Maritime Port Authority or the representative office of the Maritime Port Authority.

c) Deadlines for presenting documents:

For Vietnamese vessels arriving at the port customs checkpoint: At most two hours after the vessel docks at the wharf, at most four hours after the vessel docks at other positions within the port waters;

For Vietnamese vessels leaving the port customs checkpoint: At most immediately before the vessel leaves the port customs checkpoint.

Article 14. Amending and supplementing electronic border control files for Vietnamese vessels operating on domestic routes entering and leaving port customs checkpoints

1. The person handling procedures may amend and supplement electronic files in the following cases:

a) Discovering errors or updating information that needs to be reported in the electronic file after receiving confirmation of completion of electronic border control procedures but must obtain approval from the port border guard checkpoint;

b) At the request of the port border guard checkpoint to amend and supplement the content reported in the electronic file;

c) The amended and supplemented electronic file declaration form of the person handling procedures and the request to amend and supplement the content reported in the electronic file of the port border guard checkpoint shall be carried out according to the forms prescribed on the Electronic Border Control Procedure Information Portal.

2. Processing amended and supplemented files

a) The port border guard checkpoint accepts the amended and supplementary declarations in the electronic file through verification and investigation to clarify the reasons for requesting amendments and supplements from the person handling procedures;

b) The electronic file before and after amendment and supplementation will be stored in the electronic border control data processing system at the seaport as a basis for checking, comparing, and verifying the authenticity of the electronic file declaration made by the person handling procedures.

3. Time limit for requesting amendment and supplementation of electronic files; submitting amended and supplemented electronic files and confirming completion of electronic border control procedures for amended and supplemented electronic files

a) Time limit for requesting amendment and supplementation of electronic files:

Immediately upon discovering that the electronic border control procedure declaration of the person handling procedures is incomplete or inaccurate, the port border guard checkpoint requests the person handling procedures to declare amendments and supplements;

b) Time limit for submitting amended and supplemented electronic files:

In case the port border guard checkpoint requests amendments and supplements to the content reported in the electronic file: Within the latest 01 hour from the time of receiving the request for amendments and supplements to the content reported by the port border guard checkpoint, the person handling procedures must declare the amended and supplemented content report form of the electronic border control procedure and submit it to the port border guard checkpoint via the Electronic Border Control Procedure Information Portal;

In case the person handling procedures discovers errors or updates information that needs to be reported in the electronic file: Within the latest 02 hours after the vessel docks at the quay, within the latest 04 hours after the vessel docks at other positions within the port water area for Vietnamese vessels arriving at the port customs checkpoint; within the latest immediately before the vessel leaves the port customs checkpoint for Vietnamese vessels departing from the port customs checkpoint, the person handling procedures must submit the amended and supplemented electronic file to the port border guard checkpoint via the Electronic Border Control Procedure Information Portal.

c) Time limit for confirming completion of electronic border control procedures for amended and supplemented electronic files:

Within the latest 01 hour from the time of receiving all the amended and supplemented electronic files, the port border guard checkpoint must confirm the completion of electronic border control procedures for the amended and supplemented electronic files and send it to the person handling procedures via the Electronic Border Control Procedure Information Portal.

Chapter IV. IMPLEMENTATION OF ELECTRONIC BORDER CONTROL PROCEDURES IN VISA ISSUANCE AT CUSTOMS CHECKPOINTS

Article 15. Electronic Border Control Procedures for Issuing Visas at Border Gates through the National Single Window Portal

1. When the electronic border control procedures portal is fully connected to the National Single Window Portal, the electronic border control procedures for issuing visas at border gates shall be carried out through the National Single Window Portal in accordance with the regulations on implementing the National Single Window Mechanism and the provisions of this Decision.

2.[8] When the electronic border control procedures portal has not yet been fully connected to the National Single Window Portal or there is a malfunction with the National Single Window Portal, the electronic border control procedures for issuing visas at border gates shall be carried out through the electronic border control procedures portal in accordance with the provisions of this Decision.

The use of digital signatures in implementing electronic border control procedures for issuing visas at seaport border gates shall be carried out in accordance with the regulations of the Ministry of National Defense on implementing electronic border control procedures at seaports.

Article 16. Implementation of Electronic Border Control Procedures for Issuing Visas at Border Gates through the Electronic Border Control Procedures Portal

1.[9] At least 12 hours before the visa recipient is expected to arrive at the international land border gate or seaport gate, the person handling the procedure must declare the Application Form for Visa Issuance at the Border Gate according to Model No. 03 stipulated in the Appendix issued together with this Decision and send it through the electronic border control procedures portal to the Border Guard at the land border gate (in case of requesting to receive the visa at the international land border gate) or send it to the Border Guard at the seaport gate (in case of requesting to receive the visa at the seaport gate).

At least two hours before the expected departure from the seaport where the vessel is moored, the person handling the procedure must declare the Application Form for Visa Issuance at the Border Gate according to Model No. 03 stipulated in the Appendix issued together with this Decision and send it through the electronic border control procedures portal to the Border Guard at the seaport in cases where foreign seafarers who are not exempted from entry visas to Vietnam need to depart from another port.

The time for initiating the electronic border control procedures for issuing visas at the border gate is determined from the moment the Border Guard at the land border gate or the Border Guard at the seaport receives the Application Form for Visa Issuance at the Border Gate through the electronic border control procedures portal.

2. Within at most three hours from the time of receiving a complete and valid Application Form for Visa Issuance at the Border Gate, the Border Guard at the land border gate and the Border Guard at the seaport must send the Confirmation of Completion of Declaration of Electronic Border Control Procedures for the visa recipient at the border gate according to Model No. 17 stipulated in the Appendix issued together with this Decision to the person handling the procedure through the electronic border control procedures portal.

For foreign seafarers specified in Clause 1 of this Article, within at most one hour from the time of receiving the Application Form for Visa Issuance at the Border Gate, the Border Guard at the seaport must send the Confirmation of Completion of Declaration of Electronic Border Control Procedures for the visa recipient at the border gate according to Model No. 17 stipulated in the Appendix issued together with this Decision to the person handling the procedure through the electronic border control procedures portal;

The completion time of the declaration of electronic border control procedures for issuing visas at the border gate is the time when the person handling the procedure receives the Confirmation of Completion of Declaration of Electronic Border Control Procedures for the visa recipient at the border gate through the electronic border control procedures portal.

3.[10] When the visa recipient arrives at the international land border gate or seaport gate to enter Vietnam or the foreign seafarer specified in Clause 1 of this Article departs from the seaport gate, the person handling the procedure must present their passport or other travel document and pay the visa issuance fee as prescribed to the Border Guard at the land border gate or the Border Guard at the seaport.

Immediately upon receipt of the full passport or other travel document and the visa issuance fee, the Border Guard at the land border gate or the Border Guard at the seaport will issue the visa in accordance with the regulations.

Article 17. Amending and supplementing the electronic border control file for visa recipients at border gates

1. The person handling procedures may amend and supplement the electronic border control file for visa recipients at border gates in the cases provided for in point a, b Clause 1 Article 11 and point a, b Clause 1 Article 14 of this Decision.

Requests for amendment and supplementation by Border Gate Guards and the amended and supplemented electronic file declaration form of the person handling procedures shall be carried out in accordance with point c, Clause 1 Article 11 of this Decision.

2. Processing of amended and supplemented files shall be carried out in accordance with the provisions of Clause 2 Article 11 and Clause 2 Article 14 of this Decision.

3. Time limit for requesting amendment and supplementation; sending the amended and supplemented electronic file and confirming completion of the border control electronic procedure for the amended and supplemented electronic file

a) Time limit for requesting amendment and supplementation of the electronic file of the Border Gate Guard of land border gate and port border gate:

Immediately upon discovering that the electronic border control procedure declaration of the person handling procedures is incomplete or inaccurate, the Border Gate Guard of land border gate or port border gate sends a request to declare amendment and supplementation to the person handling procedures through the Electronic Border Control Procedure Portal.

b) Time limit for submitting amended and supplemented electronic files:

In case the Border Gate Guard of land border gate or port border gate requests amendment and supplementation of the content declared in the electronic file: Within the latest 01 hour from receiving the request for amendment and supplementation of the content declared by the Border Gate Guard of land border gate or port border gate, the person handling procedures must declare the amendment and supplementation declaration form for visa recipients at border gates and send it to the Border Gate Guard of land border gate or port border gate through the Electronic Border Control Procedure Portal;

In case the person handling procedures discovers errors or updates information needed to be declared in the electronic file: Immediately upon discovering errors or updating information needed to be declared in the electronic file, the person handling procedures must declare the amendment and supplementation declaration form for visa recipients at border gates and send it to the Border Gate Guard of land border gate or port border gate through the Electronic Border Control Procedure Portal.

c) Time limit for confirming completion of the electronic border control procedure declaration for the amended and supplemented electronic file:

Within the latest 01 hour from receiving the amendment and supplementation declaration form for visa recipients at border gates, the Border Gate Guard of land border gate or port border gate must send the confirmation of completion of the electronic border control procedure declaration for the amended and supplemented electronic file according to Model No. 15 prescribed in the Appendix issued together with this Decision to the person handling procedures through the Electronic Border Control Procedure Portal.

Chapter V. IMPLEMENTATION

Article 18. Responsibilities of the Ministry of National Defense

1. To take the lead and coordinate with ministries, sectors, provincial People's Committees to cooperate with the Permanent Office of the National Steering Committee on the Single Window Mechanism of the State, ASEAN Single Window Mechanism, and facilitation of trade in implementing the electronic border control procedure and integrating and connecting smoothly with the National Single Window Portal in accordance with regulations.

2.[11] To coordinate with the Government Office to organize the connection of the Electronic Border Control Procedure Portal with the National Public Service Portal in accordance with Decree No. 118/2025/NĐ-CP dated June 9, 2025 of the Government on the implementation of administrative procedures under the single window mechanism, interlinked single window mechanism at the one-stop service center and the National Public Service Portal.

3. To take the lead in building plans and organizing the assurance of information security for the Electronic Border Control Procedure Portal; organizing propaganda and support for organizations, businesses, individuals related to participating in the implementation of the electronic border control procedure; coordinating with relevant ministries and sectors to inspect and handle arising difficulties.

4. To ensure financial resources and necessary conditions regarding infrastructure and equipment for the implementation of the electronic border control procedure.

5. To take the lead and coordinate with ministries, sectors, provincial People's Committees to organize the implementation of this Decision.

6. To conduct mid-term reviews, summaries, evaluations, and report to the Prime Minister on the results of implementing the electronic border control procedure at border gates managed by the Ministry of National Defense.

7. To direct the General Cryptographic Department to provide sufficient specialized digital signatures for the Border Guard to resolve administrative procedures; to build solutions for verifying the digital signatures of individuals and organizations registering to implement the electronic border control procedure.

8. To direct the Border Guard

a) To build and implement projects to carry out the electronic border control procedure for border gate systems managed by the Ministry of National Defense; to build a roadmap for upgrading and perfecting the electronic data processing system, applying digital signatures, eliminating paper documents required in the implementation of the electronic border control procedure; to organize training, briefing, and arranging staff with adequate qualifications, capabilities, and experience to meet the requirements of implementing the electronic border control procedure;

During the period of building and implementing projects to carry out the electronic border control procedure for border gate systems managed by the Ministry of National Defense, which have not yet been equipped with devices and connections to implement the electronic border control procedure, the person handling procedures and the Border Gate Guard shall implement the border control procedure manually;

b)[12] To review, inspect, and approve organizations and individuals participating in the implementation of the electronic border control procedure; to guide the installation and declaration of information for the person handling procedures participating in the implementation of the electronic border control procedure;

c) To provide and share information related to persons, means of transport entering and exiting at border gates managed by the Ministry of National Defense to relevant agencies; at the same time, to receive shared information from specialized management agencies at border gates about persons, means of transport, exported and imported goods;

d) To secure information; to handle violations and resolve complaints and denunciations; to guide the implementation of issues arising during the process of completing the connection between the Electronic Border Control Procedure Portal and the National Single Window Portal;

đ) To take the lead and coordinate with specialized management agencies at border gates and local authorities in propaganda work and the implementation of the electronic border control procedure;

e) Handle violations of the law by organizations and individuals in implementing electronic border procedures in accordance with the provisions of the law.

g)[13] Proactively exploit information and data online from national information systems, national databases, databases of ministries, sectors, and localities that have been connected to resolve exit, entry, and transit procedures at border gates managed by the Ministry of National Defense.

Article 19. Responsibilities of Relevant Ministries and Sectors and Provincial People's Committees

1. The Ministry of National Defense shall take the lead and coordinate with the Ministry of Public Security to unify the connection and sharing of data for using electronic identity accounts to log into the Electronic Border Procedures Portal in accordance with Decree No. 69/2024/ND-CP dated June 25, 2024 of the Government on electronic identification and authentication and the provisions of this Decision.

2. Ministry of Finance

a) Within their scope of duties and authority, they are responsible for directing and guiding specialized state management agencies under their jurisdiction to cooperate with the Border Guard Force in implementing electronic border procedures; coordinating with the Ministry of National Defense to guide enterprises, organizations, and individuals related to the implementation of electronic border procedures according to the single window mechanism.

b) Direct the integration of electronic identity accounts onto the National Single Window Portal, connecting with specialized systems to implement electronic procedures according to the single window mechanism.

c) Annually, take the lead and coordinate with the Ministry of National Defense to ensure budget allocation for investment in building, managing, and operating the Electronic Border Procedures Portal within the medium-term public investment plan to ensure the implementation of this Decision.

3. Relevant ministries and sectors within their scope of duties and authority are responsible for cooperating with the Ministry of National Defense in implementing electronic border procedures and deploying the use of electronic identity accounts to log into the Electronic Border Procedures Portal in accordance with Decree No. 69/2024/ND-CP dated June 25, 2024 of the Government on electronic identification and authentication.

4. Provincial People's Committees

Within their scope of duties and authority, provincial people's committees are responsible for directing propaganda and guidance to functional departments, district people's committees, and local residents where electronic border procedures are implemented to facilitate the deployment and implementation of electronic border procedures by border gate authorities.

Chapter VI. IMPLEMENTING PROVISIONS[15]

Article 20. Effective Date

This Decision takes effect from June 1, 2019.

Article 21. Stages of Implementation of Electronic Border Procedures at Land Border Gates

1. Stage 1

a) Timeframe: From the date this Decision takes effect until the end of 2019;

b) Location: At international border gates: Mong Cai in Quang Ninh Province, Huu Nghi in Lang Son Province, Cau Treo in Ha Tinh Province, Cha Lo in Quang Binh Province, Mo Bai in Tay Ninh Province;

c) After completing Stage 1, the Ministry of National Defense will lead the summary, evaluation, and draw lessons to implement Stage 2.

2. Stage 2

From 2020 onwards, implement at all international border gates and main border gates along the land border.

Article 22. Responsibility for enforcement

Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of provincial and centrally-administered city people's committees, and relevant organizations and individuals are responsible for enforcing this Decision.

[6] THIS CLAUSE IS AMENDED IN ACCORDANCE WITH THE PROVISIONS OF Clause 4, Article 1 of Decision No. 03/2025/QĐ-TTg AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF Decision No. 15/2019/QĐ-TTg DATED MARCH 28, 2019 OF THE PRIME MINISTER ON IMPLEMENTING ELECTRONIC BORDER PROCEDURES AT GATEWAYS UNDER THE MANAGEMENT OF THE MINISTRY OF NATIONAL DEFENSE, TO TAKE EFFECT FROM APRIL 1, 2025.

[7] THIS POINT IS AMENDED AND SUPPLEMENTED IN ACCORDANCE WITH THE PROVISIONS OF Article 7 of Decision No. 31/2025/QĐ-TTg AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE PRIME MINISTER'S DECISIONS ON IMPLEMENTING ELECTRONIC BORDER PROCEDURES AT GATEWAYS UNDER THE MANAGEMENT OF THE MINISTRY OF NATIONAL DEFENSE, TO TAKE EFFECT FROM OCTOBER 1, 2025.

[8] THIS CLAUSE IS AMENDED IN ACCORDANCE WITH THE PROVISIONS OF Clause 5, Article 1 of Decision No. 03/2025/QĐ-TTg AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF Decision No. 15/2019/QĐ-TTg DATED MARCH 28, 2019 OF THE PRIME MINISTER ON IMPLEMENTING ELECTRONIC BORDER PROCEDURES AT GATEWAYS UNDER THE MANAGEMENT OF THE MINISTRY OF NATIONAL DEFENSE, TO TAKE EFFECT FROM APRIL 1, 2025.

[9] THIS CLAUSE IS AMENDED IN ACCORDANCE WITH THE PROVISIONS OF Clause 1, Article 8 of Decision No. 31/2025/QĐ-TTg AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE PRIME MINISTER'S DECISIONS ON IMPLEMENTING ELECTRONIC BORDER PROCEDURES AT GATEWAYS UNDER THE MANAGEMENT OF THE MINISTRY OF NATIONAL DEFENSE, TO TAKE EFFECT FROM SEPTEMBER 2, 2025.

[10] THIS CLAUSE IS AMENDED IN ACCORDANCE WITH THE PROVISIONS OF Clause 2, Article 8 of Decision No. 31/2025/QĐ-TTg AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE PRIME MINISTER'S DECISIONS ON IMPLEMENTING ELECTRONIC BORDER PROCEDURES AT GATEWAYS UNDER THE MANAGEMENT OF THE MINISTRY OF NATIONAL DEFENSE, TO TAKE EFFECT FROM SEPTEMBER 2, 2025.

[11] THIS CLAUSE IS AMENDED IN ACCORDANCE WITH THE PROVISIONS OF Clause 1, Article 9 of Decision No. 31/2025/QĐ-TTg AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE PRIME MINISTER'S DECISIONS ON IMPLEMENTING ELECTRONIC BORDER PROCEDURES AT GATEWAYS UNDER THE MANAGEMENT OF THE MINISTRY OF NATIONAL DEFENSE, TO TAKE EFFECT FROM SEPTEMBER 2, 2025.

[12] THIS POINT IS AMENDED IN ACCORDANCE WITH THE PROVISIONS OF Subpoint b, Clause 6, Article 1 of Decision No. 03/2025/QĐ-TTg AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF Decision No. 15/2019/QĐ-TTg DATED MARCH 28, 2019 OF THE PRIME MINISTER ON IMPLEMENTING ELECTRONIC BORDER PROCEDURES AT GATEWAYS UNDER THE MANAGEMENT OF THE MINISTRY OF NATIONAL DEFENSE, TO TAKE EFFECT FROM APRIL 1, 2025.

[13] THIS POINT IS ADDED IN ACCORDANCE WITH THE PROVISIONS OF Clause 2, Article 9 of Decision No. 31/2025/QĐ-TTg AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE PRIME MINISTER'S DECISIONS ON IMPLEMENTING ELECTRONIC BORDER PROCEDURES AT GATEWAYS UNDER THE MANAGEMENT OF THE MINISTRY OF NATIONAL DEFENSE, TO TAKE EFFECT FROM SEPTEMBER 2, 2025.

[14] This provision has been amended and supplemented pursuant to Article 10 of Decision No. 31/2025/QĐ-TTg amending and supplementing certain provisions of Decisions of the Prime Minister on implementing electronic border procedures at border gates managed by the Ministry of National Defense, which takes effect from September 2, 2025.

[15] Article 3 of Decision No. 03/2025/QĐ-TTg amending and supplementing certain provisions of Decision No. 15/2019/QĐ-TTg dated March 28, 2019 of the Prime Minister on the implementation of electronic border procedures at border gates managed by the Ministry of National Defense, which takes effect from April 1, 2025, is stipulated as follows:

"Article 3. Implementation Provisions

1. This Decision shall take effect from April 1, 2025.

2. The period for using accounts established through the electronic border procedure information portal shall be implemented in accordance with the provisions of Government Decree No. 69/2024/NĐ-CP dated June 25, 2024 on electronic identification and authentication."

Article 12 of Decision No. 31/2025/QĐ-TTg amending and supplementing certain provisions of Decisions of the Prime Minister on implementing electronic border procedures at border gates managed by the Ministry of National Defense, which takes effect from September 2, 2025, is stipulated as follows:

"Article 12. Implementation Provisions

This Decision shall take effect from the date of issuance."
