Regulations detailing and guiding the implementation of the Law on Housing
THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Housing dated November 29, 2005;
Based on Law No. 34/2009/QH12 amending and supplementing Article 126 of the Law on Housing and Article 121 of the Land Law on June 18, 2009;
Based on Law No. 38/2009/QH12 amending and supplementing certain Articles of Laws related to basic construction investment on June 19, 2009;
Considering the proposal of the Minister of Construction,
DECREE
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree details and guides the implementation of certain contents regarding ownership of housing, development of housing, management of housing use, transactions concerning housing, and state management of housing as stipulated in the Law on Housing.
Article 2. Applicability
This Decree applies to the following subjects:
1. Organizations and individuals within the country; overseas Vietnamese; foreign organizations and individuals investing in housing development in Vietnam;
2. Organizations and individuals owning housing, using housing, and participating in housing transactions in Vietnam;
3. State management agencies at all levels in the field of housing;
4. Organizations and individuals not falling under the provisions of Clauses 1, 2, and 3 of this Article but engaging in activities related to the field of housing.
Article 3. Explanation of Terms
In this Decree, the following terms are understood as follows:
1. Commercial housing refers to housing constructed by organizations and individuals belonging to various economic sectors for sale or lease according to demand and market mechanisms;
2. Social housing refers to housing constructed by the State or organizations and individuals belonging to various economic sectors for purchase, rental, or lease-purchase by the subjects specified in Article 53 and Article 54 of the Law on Housing and this Decree, according to mechanisms prescribed by the State;
3. Official housing refers to housing constructed by the State for lease to the subjects specified in Article 60 of the Law on Housing and this Decree during their tenure of office, as prescribed by the Law on Housing and this Decree;
4. Detached house in urban areas refers to a separate house (or originally a house now used for other purposes) with a yard, garden, fence, and independent entrance, having no more than three main floors (excluding covered staircases, roof floors, and basements), with at least three sides of the house facing the yard or garden, with a construction area not exceeding 50% of the land plot area, identified as a functional zone in the urban planning approved by the competent authority;
5. Apartment building is a residential building with two or more floors, with a common pathway, staircase, and shared infrastructure system serving multiple households and individuals. A condominium has portions of its area owned individually by each household or individual, by the developer, and portions of its area owned collectively by the condominium owners;
6. Lease-purchase of social housing refers to the act where the lessee pays a predetermined amount according to the agreement in the contract, the remaining amount is calculated as rent and the lessee must pay monthly or periodically. After the lease period ends and the lessee has paid off the rent, the competent state agency will issue a certificate of ownership for that housing unit.
Chapter II
HOUSING DEVELOPMENT
SECTION 1. HOUSING DEVELOPMENT PROJECTS
Article 4. Types of housing development projects
Housing development projects include the following two types:
1. Housing development project aimed at constructing technical infrastructure, social infrastructure, housing, and other architectural works according to approved planning (hereinafter referred to as housing development area project - Project Level I), wherein technical infrastructure is invested and constructed by the Project Level I investor; housing and other architectural works (Project Level II) are invested and constructed by the Project Level I investor or the Project Level II investor;
2. Housing development project aimed at constructing only an independent housing building or a cluster of housing buildings, including mixed-use buildings for housing, offices, shopping centers, and services (hereinafter referred to as mixed-use housing buildings) on land already equipped with technical infrastructure (Project Level II within the housing development area project as stipulated in Clause 1 of this Article or in new urban areas) or an independent housing development project within urban renewal areas (hereinafter referred to as independent housing development project).
Article 5. Requirements for housing development projects
1. Prior to investing in housing construction (including housing constructed within new urban areas), the investor must request the competent state authority to approve investment (except in cases where the investor must be selected through bidding as provided for in Article 14 of this Decree), organize the preparation, examination, and approval of the housing development project in accordance with the Law on Housing, this Decree, and relevant laws.
2. Before preparing a housing development project, the investor must organize the preparation and submit to the People's Committee of the competent level at the location of the housing development project for approval of the detailed construction planning scheme at a scale of 1/500 in accordance with the law on construction planning, except in cases where the location of the project already has an approved detailed construction planning scheme at a scale of 1/500 and the investor does not propose any adjustments, or in cases where it is not necessary to prepare a detailed construction planning scheme at a scale of 1/500 according to the law on construction planning.
The procedures for preparing, examining, and approving the detailed construction planning scheme at a scale of 1/500 shall be carried out in accordance with the law on construction planning, and the master plan of this detailed construction planning scheme must be publicly announced in accordance with Article 81 of this Decree.
3. Housing development projects must be consistent with land use plans, urban construction plans, rural residential area plans, urban designs, and comply with the housing development programs of each stage of the locality, and meet the requirements for housing development stipulated in Articles 24, 25, and 26 of the Law on Housing.
4. The design of housing in housing development projects must comply with construction standards and standards for apartment buildings, individual houses, and villa houses as prescribed in the Law on Housing and this Decree.
5. For housing development projects involving the development of housing areas, they must be built with a synchronized infrastructure system and social infrastructure; for independent housing development projects, they must ensure connectivity with the common infrastructure system of the area.
6. The contents of the housing development project dossier include the explanatory section and the basic design section prepared in accordance with Article 6 of this Decree.
Article 6. Contents of the housing development project dossier
1. The contents of the housing development project dossier for housing areas include:
a) The explanatory section of the project:
- Project name;
- The necessity and legal basis of the project;
- Objectives, investment form; construction location; project scale; land use needs; natural conditions of the project area;
- Implementation solutions: compensation, land clearance, resettlement plans (if applicable); construction technology application plans; construction standards applicable to the project; environmental impact assessment; fire prevention and firefighting plans; technical infrastructure solutions and connection with the common technical infrastructure of the area; the ability to utilize social infrastructure of the area;
- Public parking areas and parking areas for households and individuals living in the project area after completion of housing construction (including bicycles, motorbikes, cars);
- Areas for constructing social infrastructure systems (kindergartens, schools, healthcare, services, sports, entertainment, parks), except in cases where the project area already has social infrastructure facilities;
- Land area allocated for building social housing (if applicable);
- Number and proportion of various types of housing (including villas, individual houses, apartments), total floor area of housing; product consumption plans (number of houses sold, rented, or sold on lease-purchase terms);
- Proposals regarding mechanisms applicable to the project (regarding land use, finance, and other mechanisms);
- Project implementation time frame and progress (progress by each phase) and project management form;
- Total investment amount, sources of capital, methods of raising capital, capital repayment capacity, and capital recovery capacity;
- State responsibilities for constructing technical infrastructure outside the perimeter and passing through the project;
- Non-compensatory transferred works;
- Project management and operation organization plans and public utility works within the project (organizational model, management and operation forms, service fees);
b) The basic design section of the project:
- Explanatory section of the basic design: introduction to the project location; the project's technical infrastructure system and its connection with the common technical infrastructure of the area; environmental protection plans; fire prevention and firefighting plans; architectural plans for initial phase component works;
- Basic design drawings section: overall site plan of the project, cross-section drawings, floor plans, and main structural solutions of initial phase component works; technical infrastructure system drawings of the project connected to the common technical infrastructure of the area.
2. The contents of the housing development project dossier for independent housing include:
a) The explanatory section of the project includes the contents specified in point a, Clause 1 of this Article, excluding the requirement for the State to invest in technical infrastructure outside the perimeter and passing through the project, and the determination of non-compensatory transferred works;
b) The basic design section of the project is implemented in accordance with the law on construction.
3. The examination of the basic design of housing development projects as stipulated in Clauses 1 and 2 of this Article shall be carried out in accordance with the law on construction.
Article 7. Competence to review, approve projects, and consent to investment for housing development projects
1. For housing development projects funded by state budget funds, the following provisions shall be implemented:
a) In cases where houses are built using local government budget funds, the investor must organize the preparation of a project to submit to the Chairman of the People's Committee of the province or centrally governed city (hereinafter referred to collectively as the Provincial People's Committee) for review and approval. Based on specific conditions of the locality, the Chairman of the Provincial People's Committee may delegate authority to the Chairman of the People's Committee of the district, town, or city under the province (hereinafter referred to collectively as the District People's Committee) to review and approve housing development projects with an investment capital below 30 billion VND.
- Before approving a housing development project, the Chairman of the Provincial People's Committee or the Chairman of the District People's Committee (if delegated) shall be responsible for organizing the review of the project. The maximum time for reviewing and approving a housing development project shall not exceed 45 days from the date the competent state agency receives the proposal from the investor accompanied by the project dossier.
The Construction Department shall be the focal point for receiving project dossiers and shall take the lead, coordinating with relevant agencies at the local level to organize the review of housing development projects to submit to the Chairman of the Provincial People's Committee for approval; in cases where the Chairman of the District People's Committee is authorized to approve housing development projects, the competent agency managing housing at the district level shall be the focal point for receiving project dossiers and leading the organization of the project review.
b) In cases where houses are built using central government budget funds, the unit entrusted as the investor of the project shall issue a document requesting the provincial people's committee where the project is located to consent to the investment in the housing development project with the contents stipulated in point b, Clause 2 of this Article before preparing the project, except for projects decided to be invested in by the Prime Minister.
After obtaining the investment consent document from the Provincial People's Committee, the investor shall be responsible for preparing the project to submit to the investment decision-maker for the organization of review and approval of the project. The maximum time for the Provincial People's Committee to issue an investment consent document is 30 days, and the maximum time for reviewing and approving the project is 45 days, starting from the date the competent state agency receives all required documents according to regulations.
c) The contents of the decision to approve housing development projects specified in points a and b of this clause include:
- Project name (housing area development project or independent housing development project);
- Investor's name; investment objectives, investment forms;
- Project location; project scale, land area and boundaries, population scale;
- Technical infrastructure works: roads, electricity supply, water supply and drainage, waste treatment, communication, fire prevention and explosion protection; social infrastructure works: kindergartens, schools, healthcare, services, sports, entertainment, parks (if applicable);
- Proportion and number of types of housing (including villa houses, individual houses, apartment units); tenants and rental prices for housing;
- Public parking areas and parking areas for households and individuals living in the project area after completion of housing construction;
- Total project investment amount;
- Time and progress of implementing the project (progress implementation by each phase);
- Main rights and obligations of the investor;
- Management operation and exploitation plan of the project, management operation of apartment buildings after construction (organizational model, management form, service fees);
2. For housing development projects (excluding housing development projects of second-level investors) funded by non-state budget funds (regardless of land usage scale), the following provisions shall be implemented:
a) The investor must submit a proposal to the Provincial People's Committee to obtain an investment consent document for the housing development project; in cases where the housing development project has a scale of less than 500 houses (including villa houses, individual houses, apartment units), the investor shall submit to the District People's Committee to obtain an investment consent document, except for projects subject to tendering to select investors as stipulated in Article 14 of this Decree;
b) The contents of the investment consent document for housing development projects specified in point a of this clause and housing development projects specified in point b of Clause 1 of this Article include:
- Project name (housing area development project or independent housing development project);
- Investor's name, except in cases of tendering to select investors as stipulated in Article 14 of this Decree;
- Investment objectives and forms; project location and scale; land usage area; population scale;
- Construction of technical infrastructure works; social infrastructure works: kindergartens, schools, healthcare, services, sports, entertainment, parks (if applicable);
- Proportion and number of types of housing (villa houses, individual houses, apartment units); total floor area of housing;
- Product consumption plan: sell, rent, rent-to-own (specify the area and number of houses to be sold, rented, or rent-to-owned);
- Public parking areas and parking areas for households and individuals living in the project area after completion of housing construction;
- Land area allocated for building social housing (if applicable);
- Responsibilities of the investor and local authorities;
- Time and progress of implementing the project (progress implementation by each phase);
For housing area development projects, additional contents must be included: handover plan for technical infrastructure works to the localities after the completion of investment construction; responsibility for constructing social infrastructure works (if constructed by local authorities, the deadline for completing construction must be clearly stated, if beyond this deadline, the investor may undertake construction or call on other investors to participate in constructing social infrastructure works);
c) The Provincial People's Committee or the District People's Committee shall be responsible for checking and issuing an investment consent document within a maximum period of 30 days from the date of receipt of the proposal from the investor accompanied by the project dossier;
d) After obtaining the investment consent document, the investor shall be responsible for organizing the preparation, review, and approval of the housing development project according to the contents of the investment consent document, the provisions of this Decree, and related laws.
3. In cases where a housing development project (irrespective of the source of investment capital and scale of land use) has a total number of housing units of 2,500 or more (including detached houses, individual houses, apartment units, new urban areas, and mixed-use residential buildings), the investor shall be responsible for preparing a proposal to request the provincial People's Committee to examine and submit to the Prime Minister for approval of the investment orientation of the housing development project (housing area development project or independent housing development project) before drafting, reviewing, and approving the project.
Within ten working days from the date of receipt of the investor's proposal, the provincial People's Committee shall be responsible for checking and issuing a document to seek opinions from the Ministry of Construction, the Ministry of Natural Resources and Environment, the Ministry of Planning and Investment, and the Ministry of Finance on certain contents: land use planning, construction planning, time frame, progress of the project implementation, ratio of different types of housing, capacity of the investor, and other issues under the management responsibility of these ministries before submitting to the Prime Minister. The time limit for seeking opinions from the ministries as stipulated in this clause is twenty days from the date of receipt of the investor's proposal, and the ministries must respond to the provincial People's Committee within the time limit specified in this clause.
The dossier submitted to the Prime Minister includes: the investor's proposal requesting the provincial People's Committee to report to the Prime Minister for approval of the investment orientation, the provincial People's Committee's proposal submitted to the Prime Minister for approval of the investment orientation of the housing area development project (or independent housing development project) as prescribed in point b, Clause 2, Article 2 of this Decree, the approved master plan at a scale of 1/2000, and the comments of the ministries as stipulated in this clause.
Within a maximum period of ten days after receiving the Prime Minister's approval opinion, the provincial People's Committee shall issue a notification for the investor to organize the drafting, review, and approval of the housing development project in accordance with the laws on construction and this Decree; if the housing development project uses state budget funds, the investor shall organize the drafting of the project to submit to the competent authority for review and approval in accordance with Clause 1 of this Article. In cases where the housing development project is decided by the Prime Minister, the Ministry of Construction shall organize the review and submit to the Prime Minister for approval.
4. In cases where a housing development project has been approved but the investor requests changes to one of the following contents: investment objectives; project scale; land use area; number of housing units; project implementation schedule, the investor must have a document requesting the competent state agency as prescribed in Clause 1 and Clause 2 of this Article to issue a supplementary approval document before construction begins; if the project has a total number of housing units of 2,500 or more (including detached houses, individual houses, apartment units, new urban areas, and mixed-use residential buildings), the investor must request the provincial People's Committee to examine and prepare a proposal to seek the Prime Minister's supplementary approval for the housing development project content (housing area development project or independent housing development project). The time limit for issuing a supplementary approval document is twenty days from the date of receipt of the investor's request or the provincial People's Committee's request.
The Ministry of Construction shall specify the templates: the investor's proposal requesting the provincial People's Committee or the district People's Committee to approve investment as prescribed in Clause 2 of this Article; the investor's proposal requesting the provincial People's Committee to report to the Prime Minister for approval of the investment orientation and the provincial People's Committee's proposal requesting approval of the housing development project investment orientation from the Prime Minister as prescribed in Clause 3 of this Article; the template for the Decision Approving the Project, the template for the Approval Document for Investment as prescribed in Clause 1 and Clause 2 of this Article, and guidelines for implementing the provisions of this Article.
Article 8. Implementation of housing development projects
1. The project investor must comply with the provisions of the Law on Housing, this Decree, and the construction laws when implementing investment in housing construction.
2. The project investor must apply for a Construction Permit before commencing construction of housing and other architectural works of the project, except in cases where the Construction Permit is exempted according to the construction laws.
3. For housing development projects, the investor must construct a synchronized technical infrastructure system in accordance with the approved project content. In cases where social infrastructure works must be constructed according to the decision approving the project or the investment approval document of the competent state agency, the investor must implement in accordance with the approved project content and schedule or the investment approval content of the competent state agency.
4. The first-level project investor of a housing development project has the right to transfer land use rights with technical infrastructure to the second-level project investor for housing construction after having completed corresponding technical infrastructure works in accordance with the project content and schedule, and must comply with the approved project content and the investment approval content of the competent state agency. The first-level investor is responsible for managing the project's technical infrastructure system until it is handed over to local authorities, providing electricity and water for the second-level investor to build housing, and organizing inspections and supervision of compliance with planning, architecture, and investment content permitted by the competent state agency, as well as the construction progress of technical works within the project scope of the second-level investor.
5. The second-level investor does not need to request investment approval from the competent state agency but must construct housing and other architectural works in accordance with the land use rights transfer contract signed with the first-level investor, complying with the approved project planning, architecture, schedule, and investment content permitted by the competent state agency for the first-level investor.
If the second-level investor violates planning, construction order, or investment content during the implementation of housing and other architectural works, the first-level investor has the right to require the second-level investor to temporarily halt construction and report to the competent authority to handle these violations.
Article 9. Mobilizing capital for housing construction investment
1. In cases where the investor of a housing development project, new urban area project (first-level investor) needs to mobilize capital for technical infrastructure investment for the housing construction area and housing construction within that housing area or urban area, they can only mobilize capital through the following forms:
a) Signing loan contracts with credit organizations, investment funds, or issuing bonds according to the law to mobilize the remaining capital for housing construction; the lender or bond buyer does not have the right to priority purchase or registration for housing purchase;
b) Signing capital contribution contracts or cooperation investment contracts with the second-level investor for the purpose of transferring land use rights with technical infrastructure to the second-level investor;
c) Signing capital contribution agreements or cooperation investment agreements with organizations or individuals for housing construction, and the capital contributors or cooperation investors can only share profits (in cash or shares) or share products which are houses based on the agreed capital contribution ratio; if the parties agree to share housing products, the investor must distribute to individuals eligible to own houses in Vietnam according to the Law on Housing and must comply with the number of houses allowed to be distributed as stipulated in point d, Clause 3 of this Article;
d) Signing business cooperation contracts with real estate trading enterprises for housing construction, and the cooperation investors can only share profits (in cash or shares) or share housing products according to the agreement; if the parties agree to share housing products, they must comply with the number of houses allowed to be distributed as stipulated in point d, Clause 3 of this Article;
đ) Mobilizing capital from advance payments for house purchases made by individuals eligible to own houses in Vietnam according to the Law on Housing through pre-sale house purchase contracts.
2. In cases where the investor of an independent housing development project (including the second-level investor in a housing development project, new urban area project, mixed-use housing construction project) needs to mobilize capital for housing construction, they can only mobilize capital through the forms prescribed in points a, c, d, and đ of Clause 1 of this Article.
3. Investors specified in Clauses 1 and 2 of this Article, when mobilizing capital for housing construction, must comply with the following conditions:
a) For the case prescribed in point b, Clause 1 of this Article, the investor can only sign capital contribution contracts or cooperation investment contracts with the second-level investor after completing land clearance for the project and initiating construction of the project's technical infrastructure works. After having completed corresponding technical infrastructure works in accordance with the project content and schedule, the first-level investor can sign a land use rights transfer contract with the second-level investor.
In cases where the second-level investor needs to mobilize capital for housing construction on the transferred land area from the first-level investor, they can only sign a capital mobilization contract after signing a land use rights transfer contract with the first-level investor, agreeing in the contract that the second-level investor can mobilize capital for housing construction, and meeting all conditions for capital mobilization as stipulated herein; in cases where the land use rights have not been transferred from the first-level investor to the second-level investor according to the land law, the capital mobilization must be agreed to in writing by the first-level investor.
b) In cases provided for in point c, Clause 1 of this Article, the investor may only sign contracts, capital contribution documents, or investment cooperation contracts after having obtained approval for the residential development project, commenced construction of the residential building, and notified the Construction Department where the residential development project is located as stipulated in point e of this Clause;
c) In cases provided for in point d, Clause 1 of this Article, the investor may only sign business cooperation contracts after having obtained approval for the housing project, completed land clearance, received the boundary handover record of the project, and notified the Construction Department where the residential development project is located as stipulated in point e of this Clause;
In cases where the business cooperation participant receives housing products and has the need to sell or lease such housing, they shall not directly sign sales or lease contracts but must have the investor (the land user) directly sign contracts with buyers or tenants after meeting the conditions specified in this Clause; if the business cooperation participant has already taken over the housing and holds the ownership certificate for the allocated housing, they may directly sign sales or lease contracts for such housing according to the provisions of the Law on Housing and this Decree;
d) For cases of capital mobilization in the forms prescribed in points c and d, Clause 1 of this Article, where there is an agreement to allocate housing products, the investor may only allocate a maximum of up to 20% of the total number of houses in each project (based on the total number of commercial houses in a first-level project or an independent housing development project that is not a second-level project) without going through real estate trading floors, but must notify the Construction Department where the housing development project is located for confirmation in accordance with Clause 1 of Article 60 of this Decree; the remaining number of houses in each project must be sold or leased in accordance with the provisions of points đ and e of this Clause;
đ) In cases of capital mobilization in the form prescribed in point đ, Clause 1 of this Article, the investor may only sign housing purchase contracts after obtaining approval for the technical design of the housing, completing the foundation construction of the housing, completing the real estate trading floor transaction procedures in accordance with the laws on real estate business, and notifying the Construction Department where the housing development project is located as stipulated in point e of this Clause;
The completion of the foundation construction of the housing (including mixed-use housing projects) as provided in this point is determined to be the stage where the ground beam foundation construction (including ground treatment if applicable) or reaching the floor level of the lowest floor of the housing project has been completed and technically accepted in accordance with the construction laws;
e) In cases of capital mobilization in the forms prescribed in points b, c, and đ, Clause 1 of this Article, the investor must provide a written notice to the Construction Department where the housing development project is located at least 15 days before signing the capital mobilization contract; the notice must clearly state the form of capital mobilization, the amount of capital to be raised; in cases of capital mobilization in the form prescribed in point b, Clause 1 of this Article, it must specify the area of land to be transferred and the name of the investor receiving the land use rights transfer; in cases of capital mobilization in the form prescribed in point c, Clause 1 of this Article, it must specify the name and address of the organization or individual participating in capital contribution or investment cooperation, if there is an agreement to allocate housing products, it must specify the quantity and type of housing to be allocated and the name and address of the organization or individual receiving the housing; in cases of capital mobilization in the form prescribed in point đ, Clause 1 of this Article, it must specify the quantity and type of housing (individual houses, villas, apartment units) and the address of the housing to be sold. The investor may only sign capital mobilization contracts or housing purchase contracts after meeting all the conditions stipulated in this Article;
4. Investors of housing development projects must use the raised capital for the intended purpose of constructing the housing development project, and may not use the raised capital for other purposes or for other housing development projects. Contracts signed in cases of raising capital in forms not complying with the provisions of this Article and failing to meet the required conditions will be void and the party raising capital will be dealt with according to current regulations;
5. The Ministry of Construction shall provide detailed guidance on the capital mobilization prescribed in this Article.
The Ministry of Construction shall provide specific guidance on the mobilization of capital as prescribed in this Article.
Article 10. Completion of the investment construction phase of housing development projects
Upon completion of the investment construction phase, the investor of the housing development project must fulfill the following requirements:
1. Report to the provincial People's Committee or the district People's Committee where the project is located about the results of the project; for housing development projects that require approval of the investment proposal from the Prime Minister according to Clause 3, Article 7 of this Decree, the investor must also submit a report to the Ministry of Construction;
2. Complete all files and documents required for archiving in accordance with the Law on Housing, this Decree, and laws on construction;
3. Conduct final inspection of the works in accordance with Article 11 of this Decree;
4. Transfer technical infrastructure and social infrastructure works to local authorities or specialized management agencies as stipulated in the approved project content or investment approval document;
5. Submit final settlement reports in accordance with financial laws;
6. Process procedures for competent authorities to issue ownership certificates for houses and construction works within the scope of the project to owners;
7. Coordinate with local authorities to resolve administrative management issues in the project area;
8. Organize operation and management of works not transferred to local authorities or specialized management agencies.
Article 11. Final Inspection of Works in Housing Development Projects
1. For housing development projects involving residential areas, the investor must comply with the following regulations:
a) Organize comprehensive final inspection of technical infrastructure systems and social infrastructure if constructed by the investor according to the approved project content and meeting legal requirements on construction. In cases where housing development projects include component projects, final inspection of technical infrastructure and works should be conducted separately for each component project;
b) Process procedures to obtain quality compliance certification for the works in accordance with construction laws;
c) Organize provision of management services of the project.
2. For independent housing development projects, the investor must comply with the following regulations:
a) Conduct comprehensive final inspection of technical infrastructure systems, fire prevention and explosion protection systems, wastewater treatment and waste disposal systems of the project;
b) Conduct final inspection of the quality of housing works and other architectural works in accordance with construction laws;
c) Process procedures to obtain quality compliance certification for the works in accordance with construction laws.
3. Project files and documents related to final inspection and transfer of works specified in this Article must be stored at the project operation and management unit and at the Department of Construction (if the housing development project is approved or investment is accepted by the provincial People's Committee); at the housing management agency of the district where the project is located (if approved or investment is accepted by the district People's Committee) for monitoring and inspection.
PART 2. DEVELOPMENT OF COMMERCIAL HOUSING
Article 12. Investors of Commercial Housing Development Projects
1. Investors of commercial housing development projects (including investors of residential area development projects and independent housing development projects) include:
a) Domestic enterprises established and operating in accordance with the Enterprise Law;
b) Enterprises with 100% foreign capital, joint ventures with foreign investors; enterprises of overseas Vietnamese investing in Vietnam in accordance with the Investment Law;
c) Cooperatives established and operating in accordance with the Law on Cooperatives.
2. Conditions for registration as investors of commercial housing development projects:
a) Must have a business registration for real estate or an Investment Certificate with real estate investment activities and sufficient statutory capital as prescribed by Vietnamese laws;
b) Must have their own investment capital to implement the project not less than 15% of the total investment amount of the project with land use scale under 20 hectares, not less than 20% of the total investment amount of the project with land use scale of 20 hectares or more.
Article 13. Selection of the Project Investor for Commercial Housing Development
1. The selection of the project investor for commercial housing development shall be carried out in the following forms:
a) Bidding to select the project investor for commercial housing development in areas where land clearance has not yet been implemented as stipulated in Article 14 of this Decree;
b) Auctioning the right to use land in accordance with the laws on land;
c) Designating the project investor in the following cases:
- A plot of land for developing commercial housing but within the time limit specified in Clause 2, Article 14 of this Decree, only one investor who meets all conditions prescribed in Article 12 of this Decree registers as the project investor;
- An investor who legally possesses the right to use land in accordance with the laws on land, is consistent with the urban housing construction planning, meets all conditions prescribed in Article 12 of this Decree, and has a registration document to become the project investor;
- Belongs to the case prescribed in Clause 5, Article 73 of this Decree.
2. In the case of being selected as the project investor for housing development without going through the bidding form prescribed in point b and point c, Clause 1 of this Article, the investor must complete procedures to request investment approval and organize the preparation, examination, and approval of the housing development project in accordance with Article 7 of this Decree.
Article 14. Bidding to Select the Project Investor for Commercial Housing Development
1. Based on the local housing development program, the Provincial People's Committee is responsible for directing the public announcement on the provincial People's Committee's Electronic Information Portal (Website) and the Construction Department's Website of the following contents to provide investors with a basis to register to participate as the project investor for commercial housing development:
a) Urban construction planning, rural residential area planning at a scale of 1/2000;
b) Location, boundaries, and area of plots of land for commercial housing development within the administrative region;
c) Conditions for land use (allocated or leased, lease term, resettlement land fund; land price list of each area and financial obligations that the investor must pay according to regulations);
d) Requirements for planning, architecture, quantity, and types of houses, technical infrastructure systems, social infrastructure, and other architectural works within the scope of the project; project implementation schedule;
đ) Overall plan for compensation, land clearance, and resettlement (if applicable);
e) Requirements for managing and operating the project after completion of construction;
g) Conditions for participating in the bidding to select the project investor for housing development;
h) Time for receiving bidding documents.
2. Within thirty days from the date the provincial People's Committee publicly announces the information as prescribed in Clause 1 of this Article, if there are two or more investors meeting the conditions stipulated in Article 12 of this Decree sending registration documents to the Construction Department to become the project investor for housing development, the Construction Department must publicly announce on its Website the list of investors, notify the investors to prepare bidding documents and report to the provincial People's Committee to organize the bidding to select the project investor in accordance with this Article.
3. Conditions for investors to participate in bidding:
a) Must meet the conditions stipulated in Article 12 of this Decree;
b) Propose a total investment amount for the project in the bidding documents that is not lower than the provisional total investment amount stated in the bidding invitation document (hereinafter referred to as the floor price);
c) Propose contents of the project according to the provisions of point b, Clause 2, Article 7 of this Decree;
d) Have the ability to mobilize capital and other resources to implement the project;
đ) Have bidding documents as prescribed in Clause 4 of this Article;
e) Pay a bidding guarantee fee equivalent to 3% of the floor price specified in the bidding invitation document.
4. Bidding documents include the following types of papers:
a) Papers proving legal basis, professional capacity, experience, financial capability, and other conditions as prescribed in Clause 3 of this Article;
b) Detailed explanation and diagram showing economic-technical solutions to fulfill the requirements stipulated in Clause 1 of this Article; contents according to the investment approval document of the competent state agency if it falls under the provisions of Clause 11 of this Article;
c) Capacity and other advantages of the investor (if any) when assigned as the project investor for housing development.
5. Based on the provisions of Clauses 1, 3, and Clause 4 of this Article, the Construction Department is responsible for preparing and issuing the bidding invitation document; the bidding invitation document must clearly specify the requirements stipulated in Clause 1 of this Article, the floor price of the project, and other related requirements.
Investors purchase the bidding invitation document, prepare the bidding document, and submit the bidding document along with the bidding guarantee fee at the Construction Department where the housing development project is located. The deadline for receiving bidding documents is twenty days after the expiration of the information announcement period as stipulated in Clause 2 of this Article and recorded in the bidding invitation document; in cases falling under the provisions of point a, Clause 11 of this Article, the deadline for receiving bidding documents is calculated from the date the district People's Committee issues the investment approval document.
After receiving the bidding documents, the Construction Department is responsible for submitting to the provincial People's Committee to establish a specialized team to select the project investor, issue specific regulations on organizing the bidding and working rules of the specialized team. The specialized team is responsible for establishing evaluation criteria, specific scoring scales based on the content of the bidding invitation document and the requirements stipulated in Clause 1 of this Article to examine and score each bidding document.
6. Conditions for organizing the bidding to select the project investor for housing development:
a) There are two or more investors meeting the conditions stipulated in Clause 3 of this Article participating in the bidding;
b) There is an approved urban construction planning at a scale of 1/2000;
c) There is an overall plan for compensation, land clearance, and resettlement;
d) There is a plan for organizing the bidding.
7. The selection of the project investor for commercial housing development is carried out through international bidding or domestic bidding. The method and procedure for organizing the bidding to select the project investor for housing development are applied similarly to the case of bidding to select investors to implement projects using land.
8. After the bidding results are obtained, the Expert Group shall issue a notification of the results to the Construction Department for reporting to the Provincial People's Committee for examination and issuance of a decision selecting the project investor for housing development. In cases where the project falls within the investment approval authority of the Provincial People's Committee, the Provincial People's Committee shall simultaneously carry out the investment approval in the decision selecting the project investor; if the project does not fall within the investment approval authority of the Provincial People's Committee, it shall be carried out in accordance with the provisions of Clause 11 of this Article.
The maximum period for organizing the bidding to select the project investor for housing development is 90 days, starting from the date the Construction Department receives the bidding documents.
9. Within 30 days from the date of the decision selecting the project investor for housing development, the Construction Department shall be responsible for refunding the bidding guarantee fee to investors who participated in the bidding but were not selected as the project investor; for the selected project investor, the refund of the bidding guarantee fee shall be completed within no more than 10 days from the date the Bid Inviter receives the investment performance guarantee of the investor (equivalent to 5% to 10% of the total investment amount of the selected investor). In case the investor violates the bidding organization regulations of the Provincial People's Committee, the bidding guarantee fee shall be transferred to the state budget.
10. If, three months from the date of the decision selecting the project investor, the project investor fails to comply with the provisions of Article 7 of this Decree, the Provincial People's Committee shall cancel the bidding result and reorganize the bidding.
11. In cases where the project does not fall within the investment approval authority of the Provincial People's Committee, the following provisions shall apply:
a) For projects within the investment approval authority of the District People's Committee, after the expiration of the information announcement period stipulated in Clause 2 of this Article, the Provincial People's Committee shall be responsible for seeking the investment approval opinion of the District People's Committee. The deadline for the Provincial People's Committee to seek opinions and the District People's Committee to issue the investment approval document shall not exceed 30 days from the end of the information announcement period stipulated in Clause 2 of this Article.
After receiving the investment approval document from the District People's Committee, the Construction Department shall accept the bidding documents and submit them to the Provincial People's Committee to establish the Expert Group to select the project investor to conduct the bidding in accordance with the provisions of this Article; the deadline for accepting the bidding documents shall be implemented according to the provisions of Clause 5 of this Article, and the deadline for organizing the bidding shall be implemented according to the provisions of Clause 8 of this Article;
b) For projects within the investment proposal approval authority of the Prime Minister, the Provincial People's Committee must seek the opinions of the Ministries specified in Clause 3 of Article 7 of this Decree. The deadline for seeking opinions and the Ministries' response opinions shall be 20 days from the end of the information announcement period stipulated in Clause 2 of this Article.
After receiving the opinions of the relevant Ministries, the Construction Department shall accept the bidding documents according to the deadline stipulated in Clause 5 of this Article. Within 10 days from the end of the bidding document acceptance period, the Provincial People's Committee must submit a report requesting the Prime Minister to approve the investment proposal for the housing development project along with the comments of the relevant Ministries, a list of participating investors, and the detailed construction plan at a scale of 1/2000.
After receiving the approval opinion of the Prime Minister, the Provincial People's Committee shall organize the bidding in accordance with the provisions of this Article and report the bidding results to the Prime Minister.
12. The unit selected as the project investor for housing development shall be responsible for organizing the preparation and submission for review and approval of the detailed construction plan at a scale of 1/500 in accordance with the provisions of Article 5 of this Decree, organizing the preparation and submission for review and approval of the housing development project in accordance with the provisions of Article 7 of this Decree, and in accordance with the content of the investment approval of the competent authority.
Article 15. Rights of the project investor for commercial housing development
1. Request competent authorities to provide information necessary for implementing the commercial housing development project.
2. Exercise rights of land users as prescribed by laws on land. For primary project investors, they may transfer land use rights with infrastructure works to secondary project investors for housing construction in accordance with this Decree's provisions.
3. Choose the form of project management.
4. Enjoy preferential policies as prescribed by law.
5. Sell or lease houses and construction works within the scope of the project in accordance with the Law on Housing, this Decree, and laws on real estate business, except for infrastructure works that must be transferred according to the decision of competent state agencies.
6. Exercise other rights as prescribed by law.
Article 16. Obligations of the project investor for commercial housing development
1. Organize the establishment, review, approval of the housing development project, and implement housing construction in accordance with the Law on Housing, this Decree, and related legal documents issued by competent state agencies; implement the project on schedule and in accordance with the approved project content or permitted supplements.
2. Publicize information related to the housing development project as stipulated in Clause 3, Article 36 of the Law on Housing after receiving the project approval decision.
3. Mobilize capital for housing construction in accordance with Articles 9 and 60 of this Decree.
4. In cases where foreign organizations or individuals invest in building houses for lease based on investment certificates issued by Vietnamese competent authorities and in accordance with the approved housing development project content, the investor shall not sell those houses.
When a primary project investor transfers land use rights to a secondary project investor, they can only sign a land use right transfer contract after completing infrastructure works corresponding to the approved project content and progress.
5. For housing development projects in cities, towns, or newly planned urban areas intended to become cities or towns, the investor shall not transfer land use rights through selling undeveloped plots but must construct houses for sale in accordance with this Decree’s provisions; for other cases, follow the relevant land laws.
6. Allocate land area for social housing construction within commercial housing development projects and new urban areas, which have invested in infrastructure systems, in accordance with Clause 2, Article 32 of this Decree.
7. Process procedures for competent state agencies to issue Land Use Right Certificates, House Ownership Certificates, and Certificates for Other Assets Attached to Land for houses built for sale and deliver related documents to buyers within a maximum period of 50 days from the date of house delivery to buyers, except when buyers voluntarily process certificate issuance procedures.
If permitted to build houses on leased state land for sale to domestic organizations, individuals, and overseas Vietnamese eligible for house ownership in Vietnam, the investor must process procedures for competent state agencies to recognize long-term stable land use rights for buyers and the investor must pay land use fees to the State as prescribed by law.
8. Warranty houses in accordance with Article 74 of the Law on Housing and this Decree.
9. Maintain rental housing under their ownership (if any) and infrastructure works that have not been transferred or do not need to be transferred within the project scope in accordance with the law.
10. Organize activities for managing and using housing, technical infrastructure systems, and other related services within the project scope in accordance with the law; manage and operate facilities put into operation according to assigned tasks or before transferring management to public service organizations or specialized management organizations.
11. Organize security and order management in the operational and commercialized project area until administrative management is transferred to local authorities.
12. Chair the establishment of the Condominium Management Board in accordance with the Law on Housing and regulations on condominium usage management issued by the Ministry of Construction.
13. Implement provisions of Articles 10 and 11 of this Decree.
14. Fulfill financial obligations and other obligations as prescribed by this Decree and related laws.
PART 3. DEVELOPMENT AND MANAGEMENT OF PUBLIC HOUSING FUNDS
Article 17. Development of Public Housing
1. Public housing development projects include the following three types:
a) Public housing development projects decided by the Provincial People's Committee to invest for rental purposes for subjects under local management;
b) Public housing development projects decided by the Prime Minister to invest for rental purposes for subjects under central management;
c) Public housing development projects decided by the Ministry of Public Security and the Ministry of National Defense to invest for rental purposes for subjects under the management of the Ministry of Public Security and the Ministry of National Defense, after obtaining permission from the Prime Minister to invest.
2. Selection of project investors for public housing development:
a) The Provincial People's Committee decides on the selection of investors for the public housing projects specified in point a, Clause 1 of this Article;
b) The Prime Minister decides on the selection of investors for the public housing projects specified in point b, Clause 1 of this Article;
c) The Ministry of Public Security and the Ministry of National Defense decide on the selection of investors for the public housing projects specified in point c, Clause 1 of this Article.
Article 18. Establishment, Review, and Approval of Public Housing Development Projects
1. The content of public housing development projects shall be established according to the provisions of Article 6 of this Decree.
2. For public housing development projects decided by the Provincial People's Committee to invest, the Department of Construction shall take the lead and coordinate with relevant agencies at the locality to review the project before submitting it to the Chairman of the Provincial People's Committee for approval. In cases where the Chairman of the Provincial People's Committee delegates authority to the Chairman of the District People's Committee to make investment decisions (for projects under 30 billion VND), the provisions of Clause 1, Article 7 of this Decree shall apply.
3. For public housing development projects decided by the Prime Minister to invest, the Ministry of Construction shall take the lead and coordinate with relevant ministries and sectors to review the project for submission to the Prime Minister for approval.
4. For public housing development projects decided by the Ministry of Public Security and the Ministry of National Defense to invest, the Ministry of Public Security and the Ministry of National Defense shall seek opinions from the Ministry of Construction, the Ministry of Natural Resources and Environment, the Ministry of Finance, and the Ministry of Planning and Investment before reviewing and approving the project.
5. The content of project approval for public housing development shall be implemented according to the provisions of point c, Clause 1, Article 7 of this Decree.
6. For areas in remote, difficult regions, border areas, islands, the construction of public housing can be combined with the construction of office buildings, schools, or healthcare facilities, and may be constructed within the premises of these facilities, but there must be a fence delineating the boundary between the public housing area and the workplace.
Article 19. Capital for Building Public Housing
1. For public housing built for rental purposes for subjects under local management, capital from the local budget shall be used.
Based on the demand for public housing in the locality, the Provincial People's Committee is responsible for preparing a capital plan to submit to the Provincial People's Council for decision. For localities receiving annual support from the central budget and facing difficulties in funding for public housing construction, they must report to the Ministry of Construction to coordinate with the Ministry of Finance and the Ministry of Planning and Investment to submit to the Prime Minister for decision.
2. For public housing built for rental purposes for subjects under central agency management (including housing of the Ministry of National Defense and the Ministry of Public Security), capital from the central budget shall be used.
Agencies tasked with building public housing for subjects under central agency management shall be responsible for notifying the Ministry of Construction of their capital needs for public housing construction to lead and coordinate with the Ministry of Planning and Investment and the Ministry of Finance in preparing a capital plan to submit to the Prime Minister for decision.
3. Capital for building public housing shall be allocated from the following sources:
a) Central budget according to the Prime Minister's decision; local budget according to the decision of the Provincial People's Council;
b) Deductions from proceeds from selling houses and transferring land use rights for areas designated for official housing but no longer needed, as decided by the Prime Minister.
Article 20. Land Fund for Construction of Official Housing
1. The People's Committee at the competent level shall be responsible for determining the land fund for constructing official housing as stipulated in Clause 1, Article 17 of this Decree on the territory when organizing the preparation and approval of land use planning and urban construction planning, rural residential area planning.
2. The agency entrusted with building official housing for objects under the management of central agencies shall be responsible for notifying the demand for official housing to the Ministry of Construction to coordinate with the Provincial People's Committee in determining the land fund for constructing official housing and incorporating it into the local land use plan and program.
Based on the requirements of the Ministry of Construction, the Provincial People's Committee shall be responsible for preparing plans and land use planning and allocating the land fund for constructing official housing in accordance with the provisions of this Decree.
3. Land use fees shall be exempted for the land area allocated to implement projects developing official housing.
Article 21. Types of Houses and Standards for Official Housing Area
1. Official housing shall have area standards, quality, and types of houses suitable for users, ensuring that those who rent have conditions to complete their assigned tasks well.
2. Cadres and civil servants holding leadership positions as members of the Politburo, Deputy Prime Ministers, and equivalent positions who are eligible to rent official housing shall be arranged to rent villa-type houses. Other objects shall be arranged to rent apartment buildings or low-rise houses (single-family houses, one-story multi-room houses) in areas where apartment buildings have not yet been developed.
3. Official housing includes villa-type houses, apartment buildings, single-family houses, and one-story multi-room houses. The standards for official housing area shall be prescribed by the Prime Minister and adjusted to suit each period of economic and social development of the country according to the proposal of the Ministry of Construction.
4. The Ministry of Construction shall provide specific guidelines for model designs and typical designs of the types of official housing prescribed in this Article.
Article 22. Implementation of Investment in Building Official Housing
1. The design, budget estimation, selection of consulting units for design, and construction units for official housing must comply with the laws on construction and the laws on management and use of state budget funds.
2. Consulting units for designing official housing must apply regulations on design standards, construction technology solutions, and reasonable material usage to ensure the goals of progress, quality, and reduced construction costs.
Article 23. Objects Eligible to Rent Official Housing
1. Party and State leaders within the scope of residing in official housing during their tenure.
2. Cadres and civil servants of Party and State agencies, political-social organizations transferred or temporarily dispatched by the competent authority from localities to the central level, from the central level to localities, or from one locality to another, who meet the conditions prescribed in Article 24 of this Decree, shall be eligible to rent official housing during their service period.
3. Officers and professional soldiers of the people's armed forces dispatched or serving according to national defense and security requirements.
4. Teachers assigned to work in communes in remote, mountainous, extremely difficult areas, border regions, and islands.
5. Doctors and health workers assigned to work in communes in remote, mountainous, extremely difficult areas, border regions, and islands, or assigned to rotate and work temporarily at hospitals and lower-level health centers.
Article 24. Conditions for renting public service housing
1. The subjects specified in Clause 1 of Article 23 of this Decree shall be allocated public service housing according to security requirements.
2. The subjects specified in Clauses 2, 3, 4, and Clause 5 of Article 23 of this Decree who are eligible to rent public service housing must not own housing under their ownership, nor have purchased, rented, or rented-purchased social housing in the locality where they are assigned to work.
Article 25. Arrangement, allocation, and signing of rental contracts for public service housing
1. The subjects specified in Clause 1 of Article 23 of this Decree shall be allocated public service housing according to the decision of the competent authority. The Ministry of National Defense and the Ministry of Public Security decide on the subjects eligible to rent public service housing within their management scope.
2. The subjects eligible to rent public service housing as specified in Clauses 2, 3, 4, and Clause 5 of Article 23 of this Decree must submit a rental application for public service housing with confirmation from the agency or organization where they are currently working.
3. The agency or organization where the subject requiring public service housing is currently working shall collect the rental applications for public service housing of the subjects specified in Clause 2 of this Article and send a written request to the unit responsible for managing and operating public service housing.
4. Based on the allocation decision of the competent authority, the Ministry of Public Security, and the Ministry of National Defense for the cases specified in Clause 1 of this Article; the rental application of the tenant and the written request of the agency or organization directly managing the tenant for the cases specified in Clause 3 of this Article, the unit responsible for managing and operating public service housing shall sign a rental contract with the tenant or sign a contract with the agency directly managing the tenant.
Article 26. Rental Price for Public Service Housing
1. The rental price for public service housing shall be determined based on the following principles:
a) Covering all necessary costs for management, operation, and maintenance during the use of the housing (excluding depreciation costs of investment capital for construction);
b) Not including land use fees;
c) The rental price for public service housing shall be reviewed and adjusted every five years.
2. Based on the principles stipulated in Clause 1 of this Article and the method for determining the rental price for public service housing as guided by the Ministry of Construction, the Department of Construction shall be responsible for developing and submitting a framework for the rental price for public service housing to the provincial People's Committee for issuance and uniform application in the area. On the basis of the framework issued by the provincial People's Committee, the public service housing management agency shall submit the rental price for public service housing under its management for approval by the investment decision-maker.
Article 27. Payment of Rent for Public Service Housing
1. The person renting public service housing shall be responsible for paying rent according to the terms of the signed rental contract and in accordance with the time when the State pays salary as prescribed. If the tenant fails to pay rent for three consecutive months, the unit managing and operating public service housing may require the agency directly managing the tenant to deduct the rent from the tenant's salary; the agency directly managing the tenant shall be responsible for deducting the tenant's salary to pay the unit managing and operating public service housing.
2. In the case where the unit managing and operating public service housing signs a rental contract with the agency directly managing the tenant, that agency shall be responsible for deducting the tenant's salary to pay the unit managing and operating public service housing.
Article 28. Management and Use of Public Housing
1. Public housing shall only be used for rental purposes. The management, maintenance, and renovation of public housing shall be carried out in accordance with regulations on the management, maintenance, and renovation of state-owned housing.
2. The entity deciding to invest in a project to develop public housing shall decide on selecting the operating unit for public housing after completing the construction investment.
3. The activities of managing and operating public housing shall enjoy mechanisms similar to those for public services as guided by the Ministry of Finance.
The Ministry of Construction shall stipulate and guide the management and use of public housing to ensure uniform application throughout the country.
Article 29. Rights and Obligations of Public Housing Tenants
1. To use the housing for its intended purpose, to responsibly maintain the housing and accompanying assets; not to arbitrarily renovate or repair public housing.
2. Not to convert or sublet the housing under any form and must return the housing to the operating unit of public housing within three months from when they no longer qualify as public housing tenants or when they no longer have a need to rent public housing.
3. Those who are arranged to rent public housing must pay monthly rent according to Article 27 of this Decree. The payment of other living expenses shall be implemented in accordance with the provisions of the law.
4. To use public housing for themselves and family members.
5. In cases where they are eligible to rent public housing but there is no public housing available for allocation, the agency or organization directly managing the staff shall be responsible for renting housing for them at a standard equivalent to the public housing rental standard they are entitled to, and deducting the rent from their salary.
If the rent for public housing exceeds the rental price that the tenant has to pay, the State budget shall cover the difference according to the principle that the central government budget covers the rent for cadres managed by central agencies, while the local government budget covers the rent for cadres managed by local agencies.
6. When the tenant must return public housing as stipulated in point a, Clause 6, Article 30 of this Decree, and they do not own housing or have not purchased or rented social housing in their place of residence after returning the public housing, the agency or organization where they work shall coordinate with the provincial People's Committee in their place of residence to arrange for them to purchase, rent, or lease-purchase social housing or provide support in another form so that they have housing.
Article 30. Responsibilities of Units Managing and Operating Public Housing
1. To lease to the correct subjects and conditions as prescribed in Articles 23 and 24 of this Decree.
2. To collect and retain all public housing files.
3. To cooperate with local functional agencies in ensuring security and order for public housing. Functional agencies responsible for security and order shall cooperate according to the requirements of the public housing management unit.
4. To implement maintenance and operation of public housing in accordance with the Law on Housing, this Decree, and relevant laws on construction.
5. To collect rent from those allocated public housing.
6. To recover public housing in the following cases:
a) When the tenant no longer meets the rental criteria for public housing;
b) When the tenant transfers to work in another locality.
c) When the tenant requests to return public housing;
d) When the tenant of public housing dies;
e) When the tenant uses public housing for purposes other than its intended use or fails to fully fulfill the obligations of a public housing tenant.
PART 4. DEVELOPMENT AND MANAGEMENT OF SOCIAL HOUSING
Article 31. Development of Social Housing
1. Social housing is constructed for purchase, rental, or lease-purchase by the subjects specified in Article 37 of this Decree. Social housing includes two types as follows:
a) Social housing built by the State using state budget funds for rental purposes;
b) Social housing developed using non-state budget funds for sale, rental, or lease-purchase in accordance with the provisions of this Decree.
2. Social housing as stipulated in Clause 1 of this Article must be strictly managed; the entity entrusted with managing and operating social housing must sell, rent, or lease-purchase to eligible subjects in accordance with the provisions of this Decree and may not arbitrarily change the intended use of social housing to other purposes.
3. Responsibilities of the Ministry of Construction in the development of social housing:
a) Based on national housing development orientation and strategy, and actual conditions, build and submit to the Prime Minister for approval national target programs supporting housing and developing social housing for social groups in need of state support for housing;
b) Organize and direct the implementation of national target programs supporting housing and developing social housing as stipulated in Point a of this Clause;
c) Guide design standards; subjects, conditions, and procedures for selecting subjects for purchase, rental, or lease-purchase of housing; methods for determining selling prices, rental prices, and lease-purchase prices of housing, and management of social housing as stipulated in this Section.
4. Responsibilities of provincial People's Committees in the development of social housing:
a) Approve and publicly announce detailed urban construction plans, housing development plans, land funds, and specific locations reserved for social housing development, ensuring integration with commercial housing development projects, new urban areas, or economic zones, industrial parks, export processing zones, and high-tech parks;
b) Develop five-year and annual plans for social housing development, specifying the types of housing; requirements for housing area, apartment structure for sale, rental, or lease-purchase, balancing specific sources of investment capital in accordance with the provisions of Article 52 of the Law on Housing; incentive mechanisms to encourage organizations and individuals from various economic sectors to participate in social housing development investments;
c) Approve within their authority or delegate to district-level People's Committees to approve social housing development projects funded by local budgets; approve investment for projects funded by non-state budget sources, and direct and inspect implementation.
Article 32. Land Fund for Social Housing Development
1. Provincial People's Committees or district-level People's Committees have the responsibility to determine and allocate land funds for social housing construction when formulating and approving land use plans, urban construction plans, rural settlement plans, economic zone plans, industrial park plans, export processing zone plans, and high-tech park plans within their jurisdiction.
2. For regions with a demand for social housing, based on specific conditions, provincial People's Committees shall consider and decide that developers of commercial housing projects and new urban areas with land use areas of 10 hectares or more must reserve 20% of the land area for constructing social housing, which has already been invested in infrastructure systems.
In cases where developers transfer the land area specified in this Clause to local authorities for social housing construction, they are entitled to reimbursement or deduction from financial obligations to the state budget for compensation and infrastructure construction costs of the land area designated for social housing construction.
3. For land funds for constructing social housing for workers in industrial parks, export processing zones, economic zones, and high-tech parks (hereinafter referred to collectively as industrial parks), the following regulations apply:
a) In cases where industrial parks are in the formation stage, the local industrial park management board or infrastructure business enterprises have the responsibility to organize land clearance and invest in building technical infrastructure for worker housing serving those industrial parks and transfer it to project developers for worker housing construction. Compensation and land clearance costs, as well as infrastructure construction costs for worker housing, are allocated to land rental fees at the industrial parks;
b) In cases where industrial parks have been established, provincial People's Committees have the responsibility to review and supplement planning, organize land recovery and compensation for land clearance to allocate to infrastructure business enterprises in industrial parks or real estate business enterprises to construct housing for workers to rent. Land clearance costs are deducted from land use fees and land rental fees retained by the locality.
Article 33. Subject investing in social housing development projects
1. For social housing development projects funded by state budget funds, the investment decision maker shall select the subject investor.
2. For social housing development projects funded by non-state budget funds, the selection of the subject investor for such projects shall be carried out according to the following provisions:
a) In cases where social housing is constructed within commercial housing development projects or new urban areas as stipulated in Clause 2, Article 32 of this Decree, the subject investor of the commercial housing development project or new urban area shall simultaneously undertake the role of subject investor for the social housing development project; if the subject investor of the commercial housing development project or new urban area does not undertake the role of subject investor for the social housing development project, then the People's Committee of the province shall assign another subject investor to construct social housing for sale, lease, or lease-purchase.
b) In cases where the investor already has land under their lawful use rights, suitable for housing construction planning, and registers as the subject investor, that investor shall be allowed to act as the subject investor for the social housing development project;
c) In cases where the investor is assigned land by the State to construct social housing, that investor shall be allowed to act as the subject investor for the social housing development project.
Article 34. Benefits for subjects investing in social housing development projects
Subjects investing in social housing development projects funded by non-state budget funds shall enjoy the following benefits:
1. Exemption from land use fees and land rental fees for the area of land within the scope of the approved social housing construction project;
2. Application of preferential VAT rates as prescribed by laws on VAT;
3. Exemption, reduction, and enjoyment of preferential tax rates on corporate income tax as prescribed by laws on corporate income tax;
4. Support for investment credit from sources including: preferential loan interest rate subsidies or interest rate compensation as prescribed; loans from the Housing Development Fund or the Housing Savings Fund (if available); consideration by the People's Committee of the province for partial or full interest rate support;
5. Consideration for partial or full funding support for the construction cost of technical infrastructure within the scope of the social housing development project;
6. Provision of free sample designs, typical designs for housing, and scientific and technological advancements in construction and installation to reduce construction costs by the Ministry of Construction; application of direct award procedures for consulting, construction and installation contracts or equipment procurement;
7. For enterprises that self-fund the construction of housing for industrial workers but do not charge rent or charge rent at a rate not exceeding the social housing rent rate issued by the People's Committee of the province, and for enterprises that lease housing to arrange accommodation for workers, the construction costs of housing or rental costs for housing shall be considered reasonable production costs when calculating corporate income tax.
The Ministry of Finance shall be responsible for guiding or submitting to the competent authority for regulations on exemption and reduction of VAT and corporate income tax as prescribed in Clauses 2 and 3 of this Article.
Article 35. Establishment, Review, and Approval of Social Housing Development Projects
1. For social housing development projects constructed with state budget funds, the entity assigned as the project owner shall organize the establishment of the project and submit it to the People's Committee of the province or district for review and approval in accordance with Article 7 of this Decree. In cases where housing is constructed with central government budget funds, it shall be implemented in accordance with point b, Clause 1, Article 7 of this Decree.
2. For social housing development projects constructed with non-state budget funds, the project owner must submit an investment approval document to the People's Committee of the province or district in accordance with Article 7 of this Decree. After obtaining the investment approval document, the project owner shall organize the establishment, review, and approval of the project in accordance with this Decree and laws on construction.
In cases where social housing development projects have a scale of 2,500 units or more, they shall be implemented in accordance with Clause 3, Article 7 of this Decree.
Article 36. Design Standards for Social Housing
1. The design standards for social housing shall be implemented as follows:
a) For social housing in urban areas constructed with state budget funds, the design standards for housing shall be implemented in accordance with Clause 1 and Clause 2, Article 47 of the Law on Housing. In other areas that are not urban, individual houses or single-story multi-room houses may be built;
b) For housing constructed with non-state budget funds to serve workers, employees in industrial zones, and low-income individuals in urban areas, the floor area standard for each apartment unit shall not exceed 70 square meters, without controlling the number of floors. The project owner may adjust the building density and land use coefficient up to 1.5 times higher than current construction standards, in line with the approved planning.22. The selection of consulting and construction units for social housing shall be carried out in accordance with the law.
3. Consulting design units must base their designs on construction standards, social housing design standards to ensure quality and reduce construction costs, encouraging the application of model designs and typical designs for social housing.
Article 37. Subjects Eligible to Purchase, Rent, or Lease-Purchase Social Housing
1. Civil servants and public officials as stipulated by laws on civil servants, public officials, and civil servants.
2. Officers and professional military personnel belonging to the people's armed forces receiving salaries from the state budget.
3. Workers employed in industrial zones.
4. Individuals who have returned public service housing as stipulated in point a, Clause 6, Article 30 of this Decree.
5. Students and trainees at universities, colleges, vocational high schools, vocational colleges, and secondary technical schools, regardless of whether they are public or private institutions, may rent housing during their study period.
6. Low-income individuals in urban areas as defined by the provincial People's Committee.
Article 38. Conditions for Purchasing, Renting, or Lease-Purchasing Social Housing
1. Individuals eligible to rent social housing constructed by the state using state budget funds must meet the following conditions:
a) Not having owned housing and not having purchased, rented, or lease-purchased social housing, nor received state support for housing or land in any form, or owning housing but with an average household floor area of less than 5 square meters per person or temporary, dilapidated, or leaking housing;
b) Having an average monthly income of the household within the low-income category as defined by the provincial People's Committee, except in cases specified in Clause 5, Article 37 of this Decree.2 2. Individuals eligible to purchase or lease-purchase social housing constructed with non-state budget funds must meet the following conditions:
a) Meeting the conditions stipulated in point a, Clause 1 of this Article;
b) Having an average monthly income of the household below the average income level of the locality as defined by the provincial People's Committee;
c) In cases of purchasing or lease-purchasing social housing, they must have a permanent or long-term residence registration at the location of the social housing development project;
d) In cases of lease-purchasing social housing, in addition to the conditions stipulated in points a, b, and c of this clause, they must also have the ability to pay the initial payment equivalent to 20% of the value of the leased-purchased housing.
3. Based on this Decree, guidelines issued by the Ministry of Construction, and specific conditions of each locality, the provincial People's Committee shall be responsible for determining the average income and low-income levels in the locality, the conditions for purchasing, renting, or lease-purchasing social housing within its jurisdiction during each period, and publicly announcing them through local mass media, on the provincial People's Committee's website, and the Department of Construction's website.
d) In the case of purchasing social housing on lease-to-own terms, in addition to the conditions stipulated in points a, b, and c of this Clause, there must also be the ability to make an initial payment of 20% of the value of the leased property.
3. Based on this Decree, the guidance of the Ministry of Construction, and the specific conditions of each locality, the People's Committee of the province shall be responsible for determining the average income and low income levels in the locality, the conditions for purchasing, renting, and lease-purchasing social housing within its jurisdiction during each period, and publicly announcing them through local mass media, on the provincial People's Committee's website, and the Department of Construction's website.
Article 39. Sale Price, Rental Price, and Lease-Purchase Price of Social Housing
1. The rental price of social housing constructed with state budget funds shall be determined based on the following principles:
a) Ensuring all costs necessary to recover construction investment capital, maintenance, management, and operation of the social housing fund.
b) Provincial People's Committees shall issue a framework for rental prices of social housing to apply within their jurisdiction.
2. The sale price, rental price, and lease-purchase price of social housing constructed with non-state budget funds shall be determined based on the following principles:
a) The sale price of social housing developed by the project investor must ensure recovery of all construction investment costs, including interest (if applicable) and the prescribed profit margin; state benefits stipulated in Article 34 of this Decree shall not be included in the sale price. In cases of deferred or phased payment, the buyer must pay at least 20% of the house price upfront, except where otherwise agreed by the parties; the minimum period for deferred or phased purchase is 10 years from the date of signing the house purchase contract.
b) The rental price and lease-purchase price of social housing developed by the project investor must ensure recovery of all construction investment costs, including interest (if applicable), maintenance, management, operation, and the prescribed profit margin; state benefits shall not be included in the rental or lease-purchase price. The minimum period for recovering investment costs for rented houses is 20 years from the date of signing the rental contract.
In the case of lease-purchase, the lease-purchaser must pay at least 20% of the house value upfront; the minimum lease-purchase period is 10 years from the date of signing the lease-purchase contract.
c) Provincial People's Committees are responsible for organizing the appraisal of sale prices, rental prices, and lease-purchase prices for social housing constructed with non-state budget funds within their jurisdiction.
Article 40. Management and Use of Social Housing
1. For social housing constructed with state budget funds, the investment decision-maker selects the unit to manage and operate the housing; if two or more units register to participate, the selection of the management and operation unit shall be conducted through bidding.
2. For social housing constructed with non-state budget funds, the project investor is responsible for organizing the management of the use, operation, and exploitation of social housing.
3. Management and operation services for social housing shall enjoy mechanisms similar to public utility services as guided by the Ministry of Finance.
4. Units managing and operating social housing have the right to conduct other business services within the social housing area to create revenue sources to offset management and operation costs, maintenance, thereby reducing rental prices for housing.
5. Tenants and lease-purchasers of social housing may not transfer the housing under any form during the rental or lease-purchase period. In cases of purchasing or lease-purchasing social housing, they are only permitted to sell or rent out the housing after fully repaying the developer and obtaining ownership certificates, but must ensure a minimum period of 10 years from the date of signing the purchase or lease-purchase contract.
In cases where the purchased housing has not reached the 10-year period from the date of signing the purchase contract but the buyer wishes to sell it, they can only sell to the state or the developer or to eligible buyers of social housing according to local regulations; the selling price cannot exceed the current price of the same type of social housing. If the sale violates this provision, the purchase contract will have no legal effect and will be handled according to Clause 4 of Article 58 of this Decree.
PART 5. CONSTRUCTION OF INDIVIDUAL HOUSING FOR HOUSEHOLDS AND INDIVIDUALS
Article 41. Requirements for Construction of Individual Housing for Households and Individuals
1. Households and individuals may only construct housing on land areas for which they have land use rights certificates in accordance with laws on land and which are not prohibited from construction under laws on construction.
2. Prior to constructing individual housing, households and individuals must complete procedures for the competent authority to issue a Construction Permit, except where exempted from obtaining a Construction Permit in accordance with laws on construction.
3. The competent authority issuing a Construction Permit for housing must base its issuance on construction standards and regulations, and detailed construction plans at a scale of 1/500 or rural residential area planning schemes that have been approved by the competent authority, to issue a Construction Permit for households and individuals in accordance with the timeframes stipulated by laws on construction.
Article 42. Surveying, Designing, and Constructing Individual Housing for Households and Individuals
1. Surveying and designing of individual housing for households and individuals shall be carried out in accordance with laws on construction. For individual housing in urban areas with a total floor area of 250 square meters or more, or with a height of three floors or more (including basements), design must be conducted by organizations or individuals possessing sufficient capacity for construction design activities or construction design professions.2 2. In cases where households and individuals construct individual housing in urban areas with a total floor area of 250 square meters or more, or with a height of three floors or more (including basements), they must hire contractors with sufficient capacity as prescribed by laws on construction to carry out the construction work.
3. Households and individuals must construct housing strictly in accordance with the approved design and Construction Permit, comply with all provisions of laws on construction during the construction process, and bear responsibility for the quality of the housing.2 Construction of housing must ensure safety for people and property; in cases causing damage to others, compensation must be provided according to the law.
Article 43. Quality Management of Individual Housing for Households and Individuals
1. Construction of individual housing in urban areas by households and individuals must meet requirements for connection to the common technical infrastructure system of the area.
2. Households and individuals constructing individual housing in urban areas with a total floor area of 1,000 square meters or more, or with a height of six floors or more (including basements), must obtain a force-bearing safety certification issued by a competent unit in accordance with laws on construction before putting it into use.
3. In cases where households and individuals construct housing in urban areas with two or more floors, each floor having two or more apartments, and each apartment designed and constructed as a closed unit (with separate living rooms, kitchens, bathrooms, and showers), the minimum floor area of each apartment must be 30 square meters and must comply with the regulations on apartment buildings as stipulated in Article 70 of the Law on Housing.
4. For housing falling within the scope defined in Clause 2 of this Article without a force-bearing safety certification issued by a competent unit; housing with multiple apartments that do not meet the conditions specified in Clause 3 of this Article; or housing required to obtain a Construction Permit but lacking such a permit, the State will not issue ownership certificates for such housing.2 5. For housing meeting the conditions specified in Clause 3 of this Article, if households and individuals request, the competent state authority may issue ownership certificates for each apartment in the housing; households and individuals may only sell or lease these apartments after obtaining ownership certificates for them. When selling an apartment, households and individuals must complete procedures to transfer land use rights to the buyer in the form of shared land use.
6. Management and use of communal housing with multiple owners or used by multiple households and individuals shall be carried out in accordance with regulations on management and use of communal housing in urban areas.2 OWNERSHIP AND MANAGEMENT AND USE OF HOUSING
4. For houses subject to the provisions of Clause 2 of this Article that do not have a force safety certification issued by a competent unit; houses with multiple units that do not meet the conditions stipulated in Clause 3 of this Article, or houses that require a construction permit but do not have one, the State shall not issue ownership certificates for such houses.
5. For houses meeting the conditions stipulated in Clause 3 of this Article, if households or individuals request, the competent state authority shall issue ownership certificates for individual units within such houses; households or individuals may only sell or rent out these units after obtaining ownership certificates for them. When selling a unit, households or individuals must process the transfer of land use rights to the buyer in the form of shared land use.
6. The management and use of communal housing with multiple owners or used by multiple households or individuals shall be carried out in accordance with regulations on the management and use of communal housing in urban areas.
Chapter III
OWNERSHIP AND MANAGEMENT AND USE OF HOUSING
PART 1. GENERAL PROVISIONS
Article 44. Provisions on the lawful establishment of housing
Housing is established lawfully through the following forms:
1. Investing in the construction of new housing in accordance with the Law on Housing, this Decree, and laws on construction;
2. Purchasing, receiving gifts, exchanging, or inheriting housing in accordance with the Law on Housing, this Decree, laws on real estate business, and civil laws;
3. Through other forms as prescribed by law.
Article 45. Provisions on the recognition of ownership rights over housing
1. Organizations and individuals who are entitled to own housing in Vietnam according to the Law on Housing and have documents proving the lawful establishment of housing as stipulated in Article 44 of this Decree shall be recognized by the State for their ownership rights over such housing without being required to meet conditions regarding permanent residence registration or business registration at the location of the housing, except in cases provided for in point c, Clause 2, Article 38 of this Decree.
In cases where households or individuals establish housing through the transfer of contracts for the sale of future housing projects before this Decree takes effect, the recognition of ownership rights over such housing shall be carried out in accordance with the guidance of the Ministry of Construction.
2. The competent state agency shall recognize ownership rights over housing through the issuance of Certificates of Land Use Rights, Ownership of Housing, and Other Assets Attached to Land to the owners in accordance with the law.
3. The competent state agency must base its issuance of Certificates of Land Use Rights, Ownership of Housing, and Other Assets Attached to Land on the provisions of the law on the issuance of such certificates and the provisions of this Decree to issue certificates of ownership rights over housing to the owners. Housing that does not meet the conditions for recognition of ownership rights under the Law on Housing and this Decree shall not be issued Certificates of Land Use Rights, Ownership of Housing, and Other Assets Attached to Land.
Article 46. Warranty for Housing
1. During the warranty period for housing as stipulated in Article 74 of the Law on Housing, the seller has the responsibility to warrant the housing, except in cases where the housing is damaged due to natural disasters, enemy attacks, or caused by the user.
2. The contents of the warranty for housing (including mixed-use residential buildings) include repairs and rectification of damages to the main structure of the housing (beams, columns, floors, ceilings, roofs, walls, cladding, tiling, plastering), and attached equipment such as door systems, fuel supply systems, electrical wiring for daily use, lighting, water supply systems, drainage systems, and rectification of tilting, subsidence, or collapse of the housing. For other equipment attached to the housing, the seller shall perform the warranty according to the manufacturer's specified warranty period.
3. In cases where organizations or individuals constructing or selling housing fail to fulfill their warranty obligations as stipulated in Article 74 of the Law on Housing and this Article, the owner of the housing has the right to initiate litigation to request the People's Court to resolve the matter; if causing damage to others, the organization or individual causing the damage must compensate or be held criminally responsible in accordance with the law.
Article 47. Maintenance of Housing
1. The owner of housing shall be responsible for maintaining the housing in accordance with the provisions of the Law on Housing and relevant laws, except where the owner and user have agreed otherwise. In cases where the owner has not been identified, the person currently using the housing shall be responsible for its maintenance.
2. For housing with multiple owners, each owner shall be responsible for maintaining their own portion and contributing funds to maintain the common portion; if they cannot reach an agreement, the cost of maintaining the common portion shall be allocated proportionally based on the area of each owner's individual portion.
Contributions towards the maintenance fund for apartment buildings shall be carried out in accordance with the provisions of Article 51 of this Decree.
3. The content, procedures, and management of maintenance records for housing shall be implemented in accordance with the laws on construction project maintenance.
Article 48. Renovation of Housing
1. The owner has the right to renovate housing under their ownership. Renovation of housing must ensure safety for people and property, maintain environmental hygiene around the housing, and comply with the relevant laws on construction.
2. In cases where renovation of housing requires a construction permit, the owner may only carry out the renovation after obtaining a Construction Permit.
3. Renovation of common housing must be agreed upon in writing by all owners. Each owner shall be responsible for contributing funds to renovate the common area.
In cases of renovating old apartment buildings, it shall be carried out in accordance with the provisions of Article 52 of this Decree.
Section 2. Management and Use of Apartment Buildings
Article 49. Individual Ownership and Common Ownership in Apartment Buildings with Multiple Owners
1. Individual ownership and personal-use equipment in apartment buildings with multiple owners include:
a) The interior area of the apartment (including balconies and terraces attached to the apartment) owned by the apartment owner; other areas within the apartment building sold individually to each apartment owner or sold to other organizations or individuals by the developer;
b) Areas owned individually by the developer (retained by the developer without selling and also not allocating the value of these individual areas into the sale price of apartments to apartment owners);
c) Personal-use equipment within the apartment or within other individually-owned areas of the apartment owner or other owners.
The apartment owner and owners of other areas within the apartment building as specified in points a and b of this clause are collectively referred to as apartment building owners.
2. Common ownership in apartment buildings with multiple owners includes shared areas and equipment for the entire apartment building, defined as follows:
a) Shared areas owned by apartment building owners including: space, corridors, staircases, elevators, rooftops, structural frames, columns, load-bearing walls, exterior walls, partition walls between apartments, floors, roofs, escape routes, sewage systems, walkways, communal playgrounds, and other areas not individually owned by apartment building owners;
b) Other areas not included in the individually-owned areas of apartment building owners as stipulated in Clause 1 of this Article;
c) Parking spaces (for bicycles, motorbikes, and disabled persons' vehicles) constructed according to construction standards and may be located in basements, ground floors, or other areas inside or outside the apartment building. For parking areas for automobiles, they must be constructed according to construction standards but the developer decides whether they belong to the common ownership of apartment building owners or to the individual ownership of apartment building owners as stipulated in Clause 1 of this Article;
d) Common-use equipment for the apartment building as stipulated in Clause 3 of Article 70 of the Law on Housing.
The area specified in this clause that belongs to common ownership shall be used for the common use of the owners of the apartment buildings in accordance with the Law on Housing, this Decree, and regulations on the management and use of apartment buildings.
3. The private ownership portion and the common ownership portion of the apartment building as stipulated in this Article must be clearly recorded in the sales contract for the apartment unit.
Article 50. Management and Operation of Apartment Buildings
1. Apartment buildings with multiple owners must have a Management Board elected by the owners and users of the apartment building in accordance with Article 71 of the Law on Housing and regulations on the management and use of apartment buildings. The developer has the responsibility to prepare the content necessary for establishing the Management Board of the apartment building in accordance with the Law on Housing.
2. The Management Board of the apartment building has rights and responsibilities as stipulated in Article 72 of the Law on Housing and regulations on the management and use of apartment buildings. For social housing apartment buildings, the rights and responsibilities of the Management Board of the apartment building shall be implemented according to the guidelines of the Ministry of Construction.
3. The management and operation of apartment buildings shall be carried out by enterprises with expertise in managing and operating apartment buildings.
4. The management and operation services of apartment buildings shall enjoy mechanisms similar to those for public utility services as guided by the Ministry of Finance.
5. Service fees when using apartment buildings, including parking fees for automobiles, shall not exceed the service fee levels set by the provincial People's Committee, except where the parties agree otherwise.
6. In cases where an apartment building has only one owner, the owner shall be responsible for organizing the management and operation of the apartment building.
The Ministry of Construction shall issue regulations on the management and use of apartment buildings to be uniformly applied throughout the country.
Article 51. Maintenance Fund for the Common Ownership Portion of Apartment Buildings with Multiple Owners
1. The maintenance fund for the common ownership portion of apartment buildings with multiple owners is defined as follows:
a) In cases where the developer enters into a contract to sell units from the date the Law on Housing takes effect, the developer shall be responsible for paying the following amounts:
- For the area of the house sold, the developer must pay 2% of the sale price, which amount shall be included in the purchase price of the unit or other areas that the buyer must pay and clearly stated in the sales contract;
- For the area of the house retained by the developer without selling (excluding the common use area), the developer must pay 2% of the value of that area; the value shall be calculated based on the highest-priced unit in the apartment building.
b) The maintenance fund specified in point a of this clause shall be deducted before tax and paid (the State does not levy tax on this fund) and deposited into a commercial bank managed by the Management Board of the apartment building to serve the maintenance of the common ownership portion in accordance with regulations on the management and use of apartment buildings;
c) In cases where the developer enters into a contract to sell units before the Law on Housing takes effect and has not collected 2% of the sale price, the owners of the apartment units shall be responsible for contributing funds for the maintenance of the common ownership portion. These contributions shall only be collected when maintenance work arises and shall be determined for each specific maintenance task.
2. If the maintenance fund specified in points a and b of Clause 1 of this Article is insufficient to carry out the maintenance of the common ownership portion, the owners of the apartment building shall be responsible for contributing additional funds corresponding to the private ownership area of each owner. In cases where the apartment building needs to be demolished and the maintenance fund specified in Clause 1 of this Article has not been fully utilized, it may be used to support resettlement when rebuilding the apartment building or added to the maintenance fund for the apartment building after reconstruction.
Article 52. Renovation and Demolition of Apartment Buildings
1. In cases where old apartment buildings are severely damaged, deteriorated, and at risk of collapse, with a conclusion from the competent authority on the quality inspection of construction works, the People's Committee of the province shall be responsible for organizing the relocation of households living in these buildings to other locations for demolition.
Households have the responsibility to relocate according to the decision of the People's Committee of the province and enjoy rights and benefits as in cases of land clearance.
2. For apartment buildings with multiple owners, if demolition is carried out based on the request of the owners to rebuild, it must be agreed upon by two-thirds of the total number of owners of the apartment building. The remaining owners who disagree with the demolition will be forcibly relocated by the People's Committee of the province and must bear the costs of forced demolition.
The State has preferential policies and encourages cases where owners voluntarily move to other places of residence (not resettlement in place) after rebuilding the apartment building.
3. In cases where old apartment buildings not falling under the scope of demolition as stipulated in Clause 1 of this Article but the owners have the need for renovation, upgrading, or expanding the area, it must be agreed upon by two-thirds of the total number of owners of the apartment building. The renovation of apartment buildings must comply with the urban planning and follow the regulations of the Construction Law.
The renovation of apartment buildings shall be implemented on the principle of socialization, ensuring that the new place of residence is better than the old one in terms of housing quality and living environment. The State encourages the renovation of old apartment buildings that have deteriorated according to comprehensive infrastructure projects of the entire area.
4. Based on the provisions of the Housing Law and this Decree, the Ministry of Construction shall submit specific policies on the renovation and reconstruction of old apartment buildings to the Government for approval.
SECTION 3. MANAGEMENT AND USE OF VILLA HOUSING IN URBAN AREAS
Article 53. Principles of Management and Use of Villa Housing
1. The management and use of villa housing must comply with the approved urban planning by the competent authority, as stipulated in this Decree and relevant laws.
2. Maintenance, renovation, and reconstruction of villa housing must be consistent with the approved urban planning, comply with the regulations on maintenance of construction works, this Decree, and laws on cultural heritage management.
3. For state-owned villa housing, additional management must be conducted in accordance with the regulations on state-owned property management; in cases where it is used for official residences, it must comply with the regulations on the management and use of official residences as stipulated in the Housing Law and this Decree.
4. The Ministry of Construction shall issue regulations on the management and use of villa housing for uniform application throughout the country.
Article 54. Classification of Villa Housing
Villa housing is classified into three groups as follows:
1. Group One villas are those listed as historical-cultural relics according to the law on cultural heritage; villas with typical architectural value, ancient houses identified, listed, and submitted for approval by provincial authorities on construction, architecture, and culture. Villas in Group One must maintain their original architectural appearance, internal structure, building density, number of floors, and height.
2. Group Two villas are those not included in Group One but have architectural value identified and listed by provincial authorities on construction and architecture for approval by the provincial People's Committee. Villas in Group Two must maintain their original exterior architectural appearance.
3. Group Three villas are those not covered by the provisions of Clauses 1 and 2 of this Article.
Article 55. Maintenance of Detached Houses
1. In cases where maintenance of detached houses is also historical and cultural relics, it must comply with regulations on repair, restoration, preservation, and recovery of historical and cultural relics.
2. In cases where maintenance of detached houses belonging to Group One involves changes in color or building materials, such changes must be approved by the Provincial People's Committee before maintenance work begins.
Article 56. Renovation and Reconstruction of Detached Houses
1. For cases involving renovation or reconstruction of detached houses that require a Construction Permit, such activities may only commence after obtaining said permit.
2. For detached houses belonging to Groups One and Two, the following additional provisions must be adhered to:
a) For detached houses in Group One:
- The original state of the detached house must not be altered;
- Demolition of the old detached house is prohibited. If demolition is necessary due to severe damage posing a risk of collapse, as determined by a competent inspection unit, reconstruction must follow the original architectural design, use the correct materials, and comply with the planning regulations (correct density, number of floors, and height) of the old detached house;
- For detached houses that are historical and cultural relics, preservation, restoration, and recovery regulations for historical and cultural relics must be strictly followed;
- Additional structures using different materials to increase area or expand beyond the exterior space of the detached house are prohibited.
b) For detached houses in Group Two:
- The external architecture must remain unchanged;
- If demolition is required due to severe damage posing a risk of collapse, as determined by a competent inspection unit, reconstruction must adhere to the original external architectural style and comply with planning regulations (correct density, number of floors, and height).
Chapter IV
TRANSACTIONS RELATING TO HOUSING
Article 57. Sale of Housing Belonging to Joint Ownership but with Absent Joint Owners
1. Sales of housing belonging to joint ownership must comply with the provisions set forth in Article 96 of the Law on Housing.
2. In cases where a sale involves a joint owner who is absent and whose place of residence cannot be determined, the remaining joint owners must request the court to declare the absent person missing according to the law prior to selling the housing.
Based on the sale price recorded in the housing transaction, the remaining joint owners are responsible for depositing the corresponding value of the absent person’s share of the housing ownership rights into a commercial bank located at the site of the sold housing; when the declared missing person returns and makes a claim, the bank receiving the deposit must repay the full principal and interest according to the non-term interest rate regulations at the time the missing person receives the money.
3. If the declared missing person dies or is declared dead by the court, the deposited funds under paragraph 2 of this Article shall be distributed among their lawful heirs according to civil law regulations.
Article 58. Rent-to-Purchase Social Housing
1. Rent-to-purchase social housing must be conducted through a contract signed between the developer and the rent-to-purchaser.
2. After paying 20% of the rent-to-purchase housing value upfront, the rent-to-purchaser has the right to pay the remaining amount over a period agreed upon by the developer and the rent-to-purchaser, but no less than ten years from the date of signing the rent-to-purchase housing contract.
3. Upon completion of the rent-to-purchase term and payment of the remaining balance as stipulated in paragraph 2 of this Article, the developer is responsible for processing the necessary procedures for the competent authority to issue a Certificate of Land Use Right, House Ownership, and Other Assets Attached to the Land to the rent-to-purchaser.
4. The developer has the right to unilaterally terminate the rent-to-purchase housing contract and reclaim the rented housing in the event of any of the following circumstances:
a) The rent-to-purchaser fails to pay rent continuously for three months without a valid reason;
b) The rent-to-purchaser arbitrarily repairs, demolishes, alters, or expands the rented housing;
c) The rent-to-purchaser sells the rented housing in violation of Article 40 of this Decree or transfers the right to rent-to-purchase to another party without the consent of the landlord.
In cases of violations under points a and b of this paragraph, the rent-to-purchaser is entitled to a refund of 20% of the rent-to-purchase payment (excluding interest); in cases of violation under point c of this paragraph, the rent-to-purchaser is not entitled to a refund of the previously paid 20%.
5. Disputes arising from rent-to-purchase housing contracts are resolved through mediation. If mediation fails, the parties have the right to request the court to resolve the dispute according to the law.
Article 59. Exchange of Housing
1. The exchange of housing transactions regulated by the Law on Housing shall only be applicable in cases where the parties exchange housing and transfer ownership rights to each other, and shall not apply to cases involving the exchange of usage rights to housing.
2. The parties involved in exchanging housing shall have the responsibility to comply with the procedures and formalities for exchanging housing and to fully fulfill their financial obligations to the State as prescribed.
Article 60. Transactions of Housing through Real Estate Trading Floors
1. In cases where the maximum division does not exceed 20% of non-trading floor real estate products as stipulated in Point d Clause 3 Article 9 of this Decree, the developer must issue a notification regarding the quantity, address, and type of housing being divided, accompanied by a list of names and addresses of the recipients of the divided housing for confirmation by the Construction Department at the location of the housing project instead of the confirmation certificate issued by the real estate trading floor.
The Construction Department shall be responsible for confirming the list of recipients, types of housing, addresses, and areas of the divided housing within 20 days from the date of receipt of the developer's notification based on the provisions of Article 9 of this Decree and in comparison with the number of housing units according to the design and planning of the approved project; this list can only be confirmed once and must be kept at the Construction Department for monitoring and inspection. The developer of the housing development project must divide the correct number, address, type, and area of housing and the correct names of the recipients confirmed by the Construction Department. The recipient of the divided housing may not transfer the right to receive the housing to another organization or individual.
For the remaining housing units in each project after division, the developer must sell or lease them through the real estate trading floor in accordance with the procedures and formalities prescribed by the laws on real estate business and this Decree.
2. After completing the foundation construction of the housing as stipulated in Point đ Clause 3 Article 9 of this Decree, the developer may enter into a purchase and sale contract with the recipients of the divided housing products as specified in Clause 1 of this Article to replace previous contracts and documents. The purchase and sale contract in this case and the confirmation certificate of the Construction Department as stipulated in Clause 1 of this Article serve as the legal basis for the competent state authority to issue the Certificate of Land Use Right, House Ownership Right, and Other Property Rights Attached to the Land to the buyer of the housing.
In cases where housing must be sold or leased through the real estate trading floor, the developer may only sign a purchase and sale or lease contract after meeting all conditions stipulated in Points đ and e Clause 3 Article 9 of this Decree.
3. Organizations or individuals who have housing obtained through division or purchased through the real estate trading floor as stipulated in Clauses 1 and 2 of this Article, if they resell such housing to others, must comply with the following regulations:
a) They may only sell to individuals or organizations eligible to own housing in Vietnam as prescribed by the Law on Housing after signing a purchase and sale contract with the developer.
b) If they are businesses with real estate trading functions, they must sell through the real estate trading floor in accordance with the laws on real estate business;
c) If they are households, individuals, or other organizations, they are not required to sell through the real estate trading floor but must sell in accordance with the Law on Housing and this Decree. In cases where they have not yet received the handover of the housing and have not been granted the ownership certificate for the housing by the competent authority, they must sell the housing in accordance with the guidance of the Ministry of Construction.
4. Real estate trading floors shall not participate in investment, purchase, or leasing of housing but shall act as intermediaries to implement sales and leases of housing under the authorization of the developer and charge transaction fees according to the laws on real estate business. If violated, they will lose their function of operating real estate trading floors and will be subject to administrative penalties under the laws on administrative violations in the field of real estate business activities.
5. In cases where the purchase and sale or lease of housing does not comply with the provisions of this Article, the purchase and sale or lease contract shall have no legal validity, and the buyer shall not be granted the Certificate of Land Use Right, House Ownership Right, and Other Property Rights Attached to the Land for the purchased housing; the seller and lessor shall be responsible for compensating the buyer and tenant for any losses incurred.
Article 61. Mortgage on Housing
1. The mortgage on housing must be established through a contract and comply with the provisions of the Law on Housing and relevant laws.
2. Organizations and individuals purchasing future housing from real estate businesses have the right to mortgage such housing at credit institutions to borrow funds. Procedures for mortgaging future housing shall be carried out in accordance with guidelines issued by the State Bank.
Article 62. Transactions Involving Overseas Vietnamese Nationals and Foreign Organizations and Individuals
1. Overseas Vietnamese nationals participating in transactions involving the purchase, gift, or inheritance of housing in Vietnam must fulfill the following requirements:
a) They must fall within the category eligible to own housing and meet the conditions for owning housing in Vietnam as stipulated by the Law on Housing;
b) They must carry out the purchase, gift, or inheritance of housing in accordance with the provisions of the Law on Housing and this Decree;
c) Those who do not fall within the scope defined in Article 1 of Law No. 34/2009/QH12 amending and supplementing Article 126 of the Law on Housing and Article 121 of the Land Law, or those who are eligible to own one house in Vietnam under the Law on Housing but already own a house in Vietnam, if they receive a gift or inherit another house, will only be entitled to the value of that house as provided for in Article 72 of this Decree.
2. Overseas Vietnamese nationals and foreign organizations and individuals renting housing in Vietnam must comply with the following regulations:
a) They must meet the conditions for renting housing in Vietnam as stipulated in Article 131 of the Law on Housing;
b) The rental housing contract must be established in writing in accordance with Article 93 of the Law on Housing and this Decree;
c) The tenant must fully exercise the rights and obligations of a tenant as prescribed by the Law on Housing, the Civil Code, and this Decree.
3. The owner of housing who is an overseas Vietnamese national has the right to sign a lease contract or a management authorization contract with another person during the period when the housing is not being used.
The owner must present a dispatch or transfer document to another locality or assignment abroad from the current workplace agency or organization; in cases where they are not subject to dispatch or assignment to another location, they must submit a temporary commitment letter not to use the housing when certifying or authenticating the lease contract or the management authorization contract.
Article 63. Types of Housing Contracts
1. The sale, lease, lease-purchase, gift, exchange, mortgage, loan, accommodation, and management authorization contracts for housing must be established in writing (collectively referred to as housing contracts). Housing contracts must comply with the provisions of Clause 2, Article 93 of the Law on Housing, the Civil Code, and this Decree. If an organization gifts housing, it must provide a gift document.
2. For housing sales contracts resulting from newly constructed buildings (including ready-made housing and future housing), in addition to complying with the requirements set forth in Clause 1 of this Article, the sales contract must clearly specify the contents, deadlines, and warranty responsibilities for housing according to the Law on Housing and this Decree; the value of land use rights included in the housing sale price and the seller's responsibility to pay land use fees to the state; in the case of apartment sales, it must also clearly specify the common area, the private area owned by the apartment owner, the 2% maintenance fee based on the sale price, and the method of calculating the apartment area sold. A housing sales contract signed with a seller who is a real estate business does not require certification or authentication.
In the case of housing sales through auction, the content of the housing sales contract, in addition to complying with the provisions of the Law on Housing and this Decree, must also comply with the provisions of the law on asset auction sales.
3. Social housing lease and lease-purchase contracts specifically define the rights and obligations of both parties and do not require certification or authentication.
Social housing lease contracts are signed periodically but not exceeding five years. At the end of the term, the tenant may apply to the competent authority for contract renewal if they comply with all leasing regulations during the lease period and still qualify for social housing leasing. Social housing lease-purchase contracts are signed based on agreements between the developer and the lessee in accordance with this Decree.
4. Civil service housing lease contracts specifically define the rights and obligations of the related parties and do not require certification or authentication. Civil service housing lease contracts are signed periodically according to the time the tenant holds office as determined by dispatch or rotation decisions, but not exceeding five years. In cases where the lease term expires and the tenant still meets the criteria, conditions, and area for civil service housing leasing as stipulated by the Law on Housing and this Decree and pays all rent, the housing management unit will continue to sign the lease contract according to the term specified in this clause.
5. Commercial housing lease contracts specifically define the rights and obligations of both parties as prescribed by the Law on Housing and the Civil Code. In cases where an individual leases housing for less than six months or the lessor is a real estate business, the lease contract does not require certification or authentication.
6. Management, supervision, use, sale, and lease authorization contracts must be certified or authenticated. Parties can only enter into such authorization contracts, and authorized agencies can only certify or authenticate these contracts as provided in this clause when the housing has been completed (applicable to existing housing).
7. Exchange, gift, mortgage, loan, and accommodation contracts for housing are established in accordance with the Law on Housing and the Civil Code.
8. The authority to certify or authenticate housing contracts as stipulated in this Article shall be implemented in accordance with current legal regulations.
9. The Ministry of Construction shall stipulate and issue model contracts for the sale and purchase of housing, rental of housing (including commercial rental housing, public service housing, and social rental housing), lease-purchase of housing, gift-giving contracts, and exchange contracts in accordance with the provisions of this Article.
Article 64. Time of Transfer of Ownership Rights to Housing in Sale, Gift, Exchange, Lease-Purchase, and Inheritance Transactions
1. The time of transfer of ownership rights to housing in the case of sale of housing shall be calculated from the date when the sale and purchase contract of housing is notarized or certified. In the case of sale of housing where the seller is a business entity with real estate trading functions, the time of transfer of ownership rights to housing shall be the time when the seller delivers the housing to the buyer according to the agreement in the contract.
2. The time of transfer of ownership rights to housing in the case of gift of housing shall be calculated from the date when the gift contract of housing is notarized or certified. In the case of a legal person giving housing as a gift, the time of transfer of ownership rights to housing for the recipient shall be calculated from the date when the donor signs the gift document.
3. The time of transfer of ownership rights to housing in the case of exchange of housing shall be calculated from the date when the exchange contract of housing is notarized or certified. In the case where both parties exchanging housing are business entities with real estate trading functions, the time of transfer of ownership rights to the received housing shall be the time when the housing is delivered according to the agreement in the exchange contract.
4. The time of transfer of ownership rights to housing in the case of lease-purchase of housing shall be calculated from the date when the lessee is granted the certificate of ownership right to the leased-purchased housing in accordance with Clause 3, Article 58 of this Decree.
5. The time of transfer of ownership rights to housing in the case of inheritance of housing shall be calculated from the date when the inheritance process begins. The determination of organizations and individuals who inherit housing shall be carried out in accordance with the provisions of civil law.
6. The time of transfer of ownership rights in the case of delayed or gradual payment for the purchase of housing shall be calculated from the date when the buyer pays off the full price of the housing to the seller, except in cases where the parties have agreed otherwise.
Chapter V
OWNERSHIP RIGHTS TO HOUSING IN VIETNAM OF VIETNAMESE RESIDENTS ABROAD AND FOREIGN ORGANIZATIONS AND INDIVIDUALS
Article 65. Ownership Rights to Housing in Vietnam of Vietnamese Residents Abroad and Foreign Organizations and Individuals
1. Vietnamese residents abroad may own housing in Vietnam if they belong to the categories and meet the conditions specified in Article 1 of Law No. 34/2009/QH12 on Amending and Supplementing Article 126 of the Housing Law and Article 121 of the Land Law. The term of ownership of housing by Vietnamese residents abroad is stable and long-term.
2. Foreign organizations and individuals, when implementing investment construction of housing in Vietnam in accordance with investment laws, shall own housing in accordance with the provisions of the Housing Law. In the case of purchasing housing in Vietnam, they shall own housing in accordance with Resolution No. 19/2008/QH12 dated June 3, 2008 of the National Assembly on piloting allowing foreign organizations and individuals to buy and own housing in Vietnam and the guiding documents for the implementation of this Resolution.
Article 66. Documents Proving the Eligibility of Vietnamese Residents Abroad to Own Housing in Vietnam
1. Vietnamese residents abroad who are eligible to own housing in Vietnam under Article 1 of Law No. 34/2009/QH12 on Amending and Supplementing Article 126 of the Housing Law and Article 121 of the Land Law must have the following documents to prove their eligibility:
a) For those with Vietnamese nationality, they must have a valid Vietnamese passport; in cases where they hold a foreign passport, they must have one of the documents proving their continued Vietnamese nationality as prescribed by the law on nationality.
b) For those of Vietnamese origin, they must have a foreign passport accompanied by a document confirming their Vietnamese origin issued by a competent authority of Vietnam to prove their Vietnamese origin.
2. Vietnamese residents abroad belonging to the following categories have the right to own (without limitation on the number of houses in Vietnam) through the forms of purchase, receipt of gifts, inheritance, exchange of housing, or receiving the transfer of land use rights in housing development projects of real estate trading businesses (for projects in areas permitted to transfer land use rights in the form of selling land plots according to the law on land) so that buyers can build housing for themselves and family members in Vietnam:
a) Those specified in point a, Clause 1 of this Article;
b) Those specified in point b, Clause 1 of this Article but must belong to one of the following categories:
- People directly investing in Vietnam according to investment laws with Investment Certificate or Business Registration Certificate issued by a competent authority of Vietnam;
- People who have made contributions to the country, including: people enjoying preferential treatment according to the Preferential Treatment Ordinance for Persons Contributing to the Revolutionary Cause with proof of preferential treatment issued by a competent authority of Vietnam; people with achievements in the national liberation and construction cause awarded Orders, Medals by the President of the State, or Commendation Certificates by the Prime Minister; people participating in the Executive Committees of political and social organizations of Vietnam, or the Vietnam Fatherland Front at provincial level or above confirmed by these organizations; people elected to the Central Executive Committee of associations, key figures in overseas compatriot movements and organizations related to the domestic situation, and people who have actively contributed to the activities of Vietnamese diplomatic agencies or foreign affairs in their countries, confirmed by the State Committee for Overseas Vietnamese or diplomatic agencies of Vietnam abroad.
- Cultural figures and scientists, including those conferred academic titles in science, education, culture-art, sports from Vietnam or abroad, and experts in socio-economic fields working in Vietnam. These subjects must be invited to work as specialists, collaborators, or lecturers by Party and State leaders, Ministers, Heads of Ministries equivalent to Ministries, Government agencies, Chairpersons of provincial People's Committees, Heads of universities, colleges, academies, and research institutes in Vietnam, and confirmed by the inviting agency or organization regarding their employment status.
- Individuals with special expertise and skills certified by Vietnamese professional associations or trade unions, or by agencies under Ministries responsible for the relevant field, accompanied by a professional practice license issued by competent Vietnamese authorities (in cases where a practice license is required by law), or a work permit issued by competent Vietnamese authorities (in cases where a practice license is not required by law).
- Individuals whose spouse is a Vietnamese citizen residing in Vietnam, holding marriage certification issued by competent Vietnamese or foreign authorities, along with the resident registration certificate and identity card of one of the spouses who is a Vietnamese citizen residing in Vietnam.
In cases where documents are issued by foreign countries, they must be translated into Vietnamese and certified by a Vietnamese notary public.
3. Overseas Vietnamese of Vietnamese origin but not falling within the categories specified in point b, Clause 2, Article 2 of this Decree, if they hold the documents specified in point b, Clause 1, Article 2 of this Decree and a visa exemption certificate issued by competent Vietnamese authorities, have the right to own a single detached house or a condominium unit in Vietnam.
If such individuals already own a house in Vietnam through inheritance or gift and acquire another house, they may only choose to own one house; for the remaining house, they have the right to gift or sell it to eligible owners of houses in Vietnam according to the provisions of Article 72 of this Decree.
Article 67. Documents Proving Residency Conditions in Vietnam for Overseas Vietnamese
1. For overseas Vietnamese holding Vietnamese passports, they must present one of the following documents issued by police stations (hereinafter referred to as ward-level police stations) where they reside:
a) Temporary residence book;
b) Certificate confirming temporary residence registration at the local level.
Overseas Vietnamese holding Vietnamese passports must submit a request form and present their passport to the ward-level police station when applying for the documents stipulated herein. Within a maximum period of three days from the date of receiving the application, the ward-level police station shall issue one of the documents stipulated herein to overseas Vietnamese.
2. For overseas Vietnamese holding foreign passports, they must present one of the following documents issued by Vietnamese immigration management authorities:
a) Temporary residence card;
b) A stamp certifying temporary residence affixed in the passport with a stay duration of three months or more in Vietnam.
Article 68. Procedures for managing the ownership of a residential house by overseas Vietnamese residing in Vietnam
Đối với trường hợp người Việt Nam định cư ở nước ngoài thuộc diện được sở hữu một nhà ở theo quy định của Luật Nhà ở thì cơ quan có thẩm quyền cấp Giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất phải thực hiện các quy định sau đây:
1. Trước khi cấp Giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất, Ủy ban nhân dân cấp huyện phải kiểm tra thông tin về tình trạng sở hữu nhà ở của người Việt Nam định cư ở nước ngoài tại Việt Nam đăng trên Website của Bộ Xây dựng.
Trường hợp người đề nghị cấp Giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất không có tên trên Website của Bộ Xây dựng thì Ủy ban nhân dân cấp huyện ký giấy chứng nhận và làm thủ tục trao giấy chứng nhận cho chủ sở hữu; trường hợp người đề nghị cấp giấy chứng nhận đang có tên đăng trên Website của Bộ Xây dựng thì Ủy ban nhân dân cấp huyện trả lại hồ sơ và có văn bản trả lời để đương sự biết rõ lý do;
2. Trong thời hạn hai ngày làm việc, kể từ ngày ký Giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất, Ủy ban nhân dân cấp huyện phải có văn bản gửi Bộ Xây dựng thông báo các thông tin về họ tên, số hộ chiếu, nơi cấp, ngày cấp hộ chiếu của người mua, được tặng cho, được thừa kế nhà ở, địa chỉ nhà ở được cấp giấy chứng nhận, số giấy chứng nhận và ngày cấp Giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất để Bộ Xây dựng đăng tải các thông tin này trên Website của Bộ;
3. Trường hợp chủ sở hữu nhà ở quy định tại Điều này đã bán, tặng cho hoặc làm thủ tục để thừa kế nhà ở cho người khác thì Ủy ban nhân dân cấp huyện phải có văn bản thông báo cho Bộ Xây dựng biết để xóa tên khỏi danh sách đăng trên Website của Bộ;
4. Chủ tịch Ủy ban nhân dân cấp huyện phải chịu trách nhiệm về việc chậm thông báo hoặc không thông báo cho Bộ Xây dựng biết khi các đối tượng quy định tại Điều này có chủ sở hữu nhà ở tại Việt Nam hoặc chuyển quyền sở hữu nhà ở cho người khác.
Bộ Xây dựng ban hành mẫu báo cáo của Ủy ban nhân dân cấp huyện gửi Bộ Xây dựng theo quy định tại Điều này.
Điều 69. Xử lý hành vi vi phạm quy định về việc sở hữu một nhà ở tại Việt Nam của người Việt Nam định cư ở nước ngoài
1. Người Việt Nam định cư ở nước ngoài thuộc diện được sở hữu một nhà ở tại Việt Nam theo quy định của Luật Nhà ở nếu giả mạo giấy tờ hoặc có các hành vi vi phạm khác để được sở hữu nhiều hơn một nhà ở tại Việt Nam thì không được cấp giấy chứng nhận quyền sở hữu đối với nhà ở đó; nếu đã được cấp giấy chứng nhận thì phải thực hiện bán nhà ở đó trong thời hạn 120 ngày, kể từ ngày hành vi vi phạm bị phát hiện, đồng thời bị xử phạt theo quy định của pháp luật về xử phạt vi phạm hành chính trong lĩnh vực quản lý, phát triển nhà ở.
2. Trường hợp quá thời hạn quy định tại khoản 1 Điều này mà người có hành vi vi phạm chưa bán nhà ở thì bị thu hồi giấy chứng nhận quyền sở hữu đối với nhà ở đã được cấp; nhà ở chưa bán thuộc quyền sở hữu của Nhà nước Việt Nam.
3. Cán bộ, công chức và những người có liên quan nếu có hành vi vi phạm các quy định của Luật Nhà ở và Nghị định này thì bị xử lý theo quy định của pháp luật về cán bộ, công chức và các quy định của pháp luật có liên quan.
Điều 70. Sở hữu nhà ở của tổ chức, cá nhân nước ngoài tại Việt Nam
1. Tổ chức, cá nhân nước ngoài được sở hữu nhà ở tại Việt Nam thông qua hình thức đầu tư xây dựng nhà ở để cho thuê hoặc được mua căn hộ chung cư trong dự án phát triển nhà ở thương mại.
2. Tổ chức, cá nhân nước ngoài đầu tư xây dựng nhà ở để cho thuê được cơ quan nhà nước có thẩm quyền cấp Giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất đối với nhà ở đó. Thời hạn được sở hữu nhà ở là thời hạn quy định trong Giấy chứng nhận đầu tư và được ghi rõ trong Giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất.
3. Trường hợp đầu tư xây dựng nhà ở để bán thì Nhà nước không cấp Giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất cho chủ đầu tư. Sau khi hoàn thành việc xây dựng nhà ở, chủ đầu tư được quyền bán nhà ở này cho tổ chức, cá nhân thuộc diện được sở hữu nhà ở tại Việt Nam theo quy định của Luật Nhà ở, pháp luật về kinh doanh bất động sản và Nghị định này.
Chủ đầu tư có trách nhiệm làm thủ tục đề nghị cơ quan nhà nước có thẩm quyền cấp Giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất cho người mua trong thời hạn 50 ngày, kể từ ngày bàn giao nhà ở cho người mua nhà, trừ trường hợp người mua nhà tự nguyện làm thủ tục đề nghị cấp giấy chứng nhận.
4. Trình tự, thủ tục cấp Giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất cho tổ chức, cá nhân nước ngoài được thực hiện theo quy định của pháp luật về cấp Giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất.
Điều 71. Người Việt Nam định cư ở nước ngoài, tổ chức, cá nhân nước ngoài thuê nhà ở tại Việt Nam
1. Đối tượng và điều kiện được thuê nhà ở tại Việt Nam bao gồm:
a) Tổ chức nước ngoài được phép hoạt động tại Việt Nam;
b) Cá nhân nước ngoài được phép vào Việt Nam có thời hạn từ ba tháng liên tục trở lên;
c) Người Việt Nam định cư ở nước ngoài đang ở Việt Nam có nhu cầu thuê nhà ở.
2. Trình tự, thủ tục thuê nhà ở, quyền và nghĩa vụ của bên thuê nhà ở thực hiện theo quy định tại khoản 2 Điều 62 Nghị định này.
Điều 72. Các trường hợp được hưởng giá trị của nhà ở
1. Tổ chức, cá nhân nước ngoài, người Việt Nam định cư ở nước ngoài thuộc các diện sau đây được tặng cho hoặc được thừa kế nhà ở tại Việt Nam thì không được cấp giấy chứng nhận quyền sở hữu đối với nhà ở và chỉ được hưởng giá trị của nhà ở đó:
a) Tổ chức, cá nhân nước ngoài không thuộc diện được sở hữu nhà ở tại Việt Nam;
b) Cá nhân nước ngoài thuộc diện chỉ được sở hữu một căn hộ chung cư trong dự án phát triển nhà ở thương mại và tại thời điểm được tặng cho, được thừa kế đang có sở hữu căn hộ tại Việt Nam;
c) Tổ chức, cá nhân nước ngoài thuộc diện được sở hữu căn hộ chung cư trong dự án phát triển nhà ở thương mại nhưng được tặng cho hoặc được thừa kế nhà ở không phải là căn hộ chung cư trong dự án phát triển nhà ở thương mại;
d) Người Việt Nam định cư ở nước ngoài được phép về Việt Nam cư trú có thời hạn dưới ba tháng;
đ) Người Việt Nam định cư ở nước ngoài thuộc diện chỉ được sở hữu một nhà ở và tại thời điểm được tặng cho, được thừa kế đang có sở hữu nhà ở tại Việt Nam.
2. Tổ chức, cá nhân được tặng cho, được thừa kế nhà ở quy định tại khoản 1 Điều này được trực tiếp hoặc ủy quyền cho người khác bán nhà ở khi đã có các giấy tờ sau đây:
a) Hợp đồng tặng cho, giấy tờ về thừa kế nhà ở được lập theo quy định tại Điều 93 của Luật Nhà ở, Nghị định này và pháp luật về dân sự Việt Nam;
b) Một trong các giấy tờ chứng minh quyền sở hữu nhà ở của bên tặng cho, bên để thừa kế nhà ở theo quy định sau đây:
- Giấy chứng nhận quyền sở hữu nhà ở đã được cấp theo quy định của Luật Nhà ở;
- Giấy chứng nhận quyền sở hữu nhà ở và quyền sử dụng đất ở đã được cấp theo quy định tại Nghị định số 60/CP ngày 05 tháng 7 năm 1994 của Chính phủ về quyền sở hữu nhà ở và quyền sử dụng đất ở tại đô thị;
- Giấy chứng nhận quyền sở hữu nhà ở đã được cấp theo quy định tại Nghị định số 95/2005/NĐ-CP ngày 15 tháng 7 năm 2005 của Chính phủ về việc cấp Giấy chứng nhận quyền sở hữu nhà ở, quyền sở hữu công trình xây dựng;
- Giấy chứng nhận quyền sử dụng đất đã được cấp theo quy định của pháp luật về đất đai mà trong nội dung giấy chứng nhận đã có ghi nhận về nhà ở của bên tặng cho, bên để thừa kế;
- Giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất được cấp theo quy định của pháp luật về đất đai.
c) Văn bản ủy quyền bán nhà ở được lập theo quy định của pháp luật về dân sự Việt Nam (nếu ủy quyền cho người khác bán nhà ở).
Chương VI
QUẢN LÝ NHÀ NƯỚC VỀ NHÀ Ở
Điều 73. Xây dựng định hướng phát triển nhà ở quốc gia
1. Căn cứ vào chiến lược phát triển kinh tế - xã hội của đất nước từng thời kỳ, Bộ Xây dựng có trách nhiệm xây dựng và trình Thủ tướng Chính phủ ban hành định hướng và chiến lược phát triển nhà ở quốc gia cho từng giai đoạn mười năm làm cơ sở cho việc nghiên cứu, hoạch định chính sách về nhà ở và làm căn cứ cho các địa phương xây dựng chương trình phát triển nhà ở của từng địa phương.
2. Định hướng, chiến lược phát triển nhà ở quốc gia bao gồm các nội dung:
a) Khái quát hiện trạng nhà ở toàn quốc;
b) Phân tích, đánh giá kết quả, tồn tại, nguyên nhân công tác phát triển, quản lý nhà ở;
c) Xác định rõ quan điểm, mục tiêu, nhu cầu phát triển nhà ở trong giai đoạn tới, trong đó xác định rõ các chương trình trọng điểm, các quan điểm, mục tiêu, yêu cầu, các chỉ tiêu cơ bản về phát triển nhà ở thương mại, nhà ở xã hội, nhà ở công vụ, nhà ở cho các đối tượng chính sách xã hội;
d) Xác định rõ các giải pháp thực hiện nhằm đạt được các mục tiêu phát triển nhà ở, bao gồm các cơ chế chính sách về quy hoạch, đất đai, hạ tầng kỹ thuật, tài chính, tín dụng và biện pháp tổ chức triển khai thực hiện;
đ) Các nội dung có liên quan khác.
3. Căn cứ vào chiến lược phát triển kinh tế - xã hội, định hướng, chiến lược phát triển nhà ở quốc gia, Bộ Xây dựng nghiên cứu, trình Thủ tướng Chính phủ ban hành các chính sách phát triển nhà ở trọng điểm để giải quyết nhà ở cho các đối tượng có khó khăn về nhà ở theo các vùng, miền.
4. Các chỉ tiêu cơ bản về phát triển nhà ở trong định hướng, chiến lược phát triển nhà ở quốc gia phải được đưa vào nhiệm vụ phát triển kinh tế - xã hội của đất nước trong từng giai đoạn. Trong quá trình triển khai thực hiện phải sơ kết đánh giá, rà soát, sửa đổi, điều chỉnh, bổ sung kịp thời định hướng, chương trình đã đề ra cho phù hợp thực tế. Kết thúc kỳ thực hiện phải có tổng kết, đánh giá kết quả thực hiện.
5. Căn cứ vào tình hình phát triển kinh tế - xã hội của khu vực và vùng kinh tế trọng điểm, Bộ Xây dựng đề xuất Thủ tướng Chính phủ xem xét, quyết định các cơ chế đặc thù và lựa chọn chủ đầu tư có đủ năng lực tài chính và kinh nghiệm để thực hiện đầu tư xây dựng dự án phát triển nhà ở có quy mô lớn hoặc có liên quan đến nhiều địa phương, nhằm góp phần thúc đẩy các khu vực phát triển, bảo đảm an sinh xã hội. Trong trường hợp Ủy ban nhân dân cấp tỉnh đề xuất thì phải có ý kiến của Bộ Xây dựng trước khi trình Thủ tướng Chính phủ xem xét, quyết định.
Điều 74. Xây dựng chương trình, kế hoạch phát triển nhà ở của các địa phương
1. Trên cơ sở định hướng, chiến lược phát triển nhà ở quốc gia đã được Thủ tướng Chính phủ ban hành, các cơ chế, chính sách về phát triển, quản lý nhà ở hiện hành của trung ương và nhiệm vụ phát triển kinh tế - xã hội của địa phương, Chủ tịch Ủy ban nhân dân cấp tỉnh có trách nhiệm chỉ đạo xây dựng chương trình, kế hoạch phát triển nhà ở cho từng giai đoạn năm năm và mười năm hoặc dài hơn trên địa bàn để trình Hội đồng nhân dân cùng cấp thông qua trước khi ban hành.
2. Chương trình, kế hoạch phá triển nhà ở của địa phương bao gồm các nội dung chính sau đây:
a) Khái quát hiện trạng nhà ở của địa phương;
b) Phân tích, đánh giá kết quả, tồn tại, nguyên nhân công tác phát triển, quản lý nhà ở của địa phương;
c) Xây dựng chương trình, kế hoạch phát triển nhà ở, trong đó nêu rõ từng khu vực, từng loại đối tượng trên địa bàn theo quy định sau đây:
- Đối với nhà ở tại khu vực đô thị: phải nêu rõ thực trạng các loại nhà ở (các nhà chung cư xuống cấp nguy hiểm, các khu nhà ở tạm bợ, nhà ổ chuột, khu nhà ở có hạ tầng kỹ thuật không đáp ứng yêu cầu), các khó khăn vướng mắc trong việc xây dựng, cải tạo nhà ở, nhu cầu về nhà ở của từng loại đối tượng và xây dựng kế hoạch phát triển nhà ở trong từng năm.
Trong chương trình phải đề xuất hướng giải quyết về quỹ đất, công tác giải phóng mặt bằng, bố trí tái định cư, về quy hoạch các khu dự án phát triển nhà ở, về nguồn vốn cho đầu tư phát triển nhà ở, cơ chế, chính sách về tài chính đất đai cho phát triển nhà ở, về chỉ tiêu diện tích nhà ở bình quân đầu người và phương án giải quyết chỗ ở cho từng loại đối tượng tại đô thị;
- Đối với nhà ở khu vực nông thôn: phải nêu rõ thực trạng về nhà ở của từng khu vực, nhà ở của đồng bào các dân tộc (nếu có), phong tục tập quán về xây dựng nhà ở của người dân, diện tích đất bình quân để xây dựng nhà ở, những khó khăn vướng mắc trong việc phát triển nhà ở, nhu cầu về nhà ở của người dân và kế hoạch phát triển nhà ở trong từng năm.
Trong chương trình phải đề xuất quỹ đất, lập quy hoạch các khu vực xây dựng nhà ở, phương án huy động các nguồn vốn tham gia xây dựng nhà ở, các hình thức hỗ trợ xây dựng nhà ở, chỉ tiêu diện tích nhà ở bình quân đầu người.
- Đối với nhà ở công nhân khu công nghiệp (nếu có): phải nêu rõ thực trạng và nhu cầu về nhà ở cho công nhân khu công nghiệp, lập quy hoạch, tạo quỹ đất xây dựng nhà ở, kế hoạch huy động các nguồn vốn đầu tư xây dựng nhà ở, kế hoạch bố trí nhà ở cho công nhân trong từng năm;
- Đối với nhà ở của các đối tượng khác trên địa bàn, bao gồm: nhà ở cho học sinh, sinh viên, nhà ở cho người nghèo tại đô thị và nông thôn, nhà cho cán bộ, công chức, nhà ở công vụ, nhà ở cho người có công với cách mạng thì phải nêu rõ thực trạng và nhu cầu về nhà ở của từng loại đối tượng, nêu rõ kế hoạch xây dựng nhà ở cho từng loại đối tượng, phương thức tạo điều kiện hỗ trợ về nhà ở (bố trí cho thuê, cho thuê mua nhà ở, hỗ trợ kinh phí, nguyên vật liệu để xây dựng nhà ở, cấp đất xây dựng nhà ở, ưu đãi về tín dụng);
d) Các nội dung có liên quan khác;
đ) Chương trình phát triển nhà ở phải xác định rõ tiến độ thực hiện; nhiệm vụ và trách nhiệm cụ thể của các Sở, Ban, ngành, các cấp chính quyền trong quá trình triển khai thực hiện.
3. Các chỉ tiêu cơ bản về phát triển nhà ở trong chương trình, kế hoạch phát triển nhà ở phải được đưa vào nhiệm vụ phát triển kinh tế - xã hội của địa phương trong từng giai đoạn. Hàng năm phải có sơ kết, đánh giá và thực hiện sửa đổi, điều chỉnh những điểm chưa phù hợp với thực tế. Kết thúc chương trình, kế hoạch phải có tổng kết, đánh giá kết quả thực hiện.
4. Ủy ban nhân dân cấp tỉnh có trách nhiệm báo cáo Thủ tướng Chính phủ và gửi Bộ Xây dựng Chương trình, kế hoạch phát triển nhà ở của địa phương để theo dõi, kiểm tra. Đối với các thành phố trực thuộc Trung ương thì sau khi Hội đồng nhân dân thành phố thông qua Chương trình, kế hoạch phát triển nhà ở, Ủy ban nhân dân thành phố phải trình Thủ tướng Chính phủ phê duyệt trước khi triển khai thực hiện.
5. Ủy ban nhân dân cấp tỉnh có trách nhiệm bố trí ngân sách địa phương cho việc điều tra, khảo sát, xây dựng chương trình, kế hoạch phát triển nhà ở của địa phương mình.
Điều 75. Lập Quỹ phát triển nhà ở
1. Quỹ phát triển nhà ở của địa phương được hình thành từ các nguồn sau đây:
a) Tiền thu từ việc bán, cho thuê nhà ở thuộc sở hữu nhà nước trên địa bàn;
b) Trích tối thiểu 10% từ tiền sử dụng đất của các dự án phát triển nhà ở thương mại và các dự án khu đô thị mới trên địa bàn. Mức thu cụ thể do Hội đồng nhân dân cấp tỉnh xem xét, quyết định;
c) Ngân sách địa phương hỗ trợ hàng năm theo quyết định của Hội đồng nhân dân cấp tỉnh;
d) Tiền huy động từ các nguồn vốn hợp pháp khác theo quy định của pháp luật;
đ) Tiền hỗ trợ, đóng góp tự nguyện từ các tổ chức, cá nhân khác trong và ngoài nước.
2. Căn cứ tình hình thực tế của địa phương, Chủ tịch Ủy ban nhân dân cấp tỉnh xem xét, quyết định thành lập Quỹ phát triển nhà ở của địa phương trên cơ sở các nguồn vốn huy động quy định tại khoản 1 Điều này và ban hành quy chế quản lý Quỹ này bảo đảm các nguyên tắc sau đây:
a) Quỹ phát triển nhà ở là tổ chức tài chính nhà nước hoạt động theo nguyên tắc bảo toàn vốn, bù đắp chi phí phát sinh trong quá trình hoạt động và không vì mục đích lợi nhuận;
b) Quỹ phát triển nhà ở được quản lý, điều hành và tổ chức hoạt động theo Điều lệ tổ chức và hoạt động của Quỹ do Ủy ban nhân dân cấp tỉnh ban hành và tuân thủ các quy định của pháp luật có liên quan;
c) Quỹ phát triển nhà ở được miễn, giảm các loại thuế và nộp ngân sách nhà nước theo hướng dẫn của Bộ Tài chính;
d) Quỹ phát triển nhà ở của địa phương được sử dụng để phát triển nhà ở xã hội thuộc sở hữu nhà nước trên phạm vi địa bàn.
Giao Bộ Tài chính chủ trì, phối hợp với Bộ Xây dựng hướng dẫn việc tổ chức, hoạt động đối với Quỹ phát triển nhà ở của các địa phương.
3. Căn cứ vào điều kiện của từng địa phương, Ủy ban nhân dân cấp tỉnh có thể ủy thác cho Quỹ đầu tư phát triển của địa phương thực hiện quản lý các hoạt động của Quỹ phát triển nhà ở quy định tại khoản 2 Điều này.
4. Ngoài Quỹ phát triển nhà ở quy định tại Điều này, giao Bộ Xây dựng chủ trì, phối hợp với các Bộ, ngành liên quan nghiên cứu, trình Thủ tướng Chính phủ ban hành quyết định về việc thành lập, hoạt động, cơ chế quản lý, nguồn đóng góp, cơ chế cho vay, đối tượng cho vay của Quỹ tiết kiệm nhà ở để phục vụ cho các đối tượng gặp khó khăn về nhà ở được vay vốn mua nhà ở hoặc để hỗ trợ cho các doanh nghiệp vay vốn xây dựng nhà ở xã hội.
Điều 76. Quản lý và cung cấp thông tin về nhà ở
1. Cơ quan có trách nhiệm quản lý hồ sơ về nhà ở:
a) Sở Xây dựng quản lý hồ sơ về nhà ở của tổ chức; người Việt Nam định cư ở nước ngoài thực hiện dự án đầu tư xây dựng nhà ở tại Việt Nam; cá nhân nước ngoài; nhà ở thuộc sở hữu chung của tổ chức và cá nhân;
b) Phòng có chức năng quản lý nhà ở cấp huyện quản lý hồ sơ về nhà ở của cá nhân (gồm cá nhân trong nước và người Việt Nam định cư ở nước ngoài sở hữu nhà ở gắn liền với quyền sử dụng đất).
2. Hồ sơ nhà ở bao gồm các nội dung theo quy định tại khoản 3 Điều 66 của Luật Nhà ở và các giấy tờ khác liên quan đến nhà ở.
3. Cơ quan quản lý hồ sơ nhà ở có trách nhiệm cung cấp các thông tin về nhà ở cho các cơ quan quy định tại khoản 7 Điều này và các tổ chức, cá nhân có quyền và nghĩa vụ liên quan đến nhà ở đó khi họ có yêu cầu.
4. Thông tin về nhà ở là các thông tin liên quan đến hiện trạng và tình trạng pháp lý của nhà ở, đất ở có trong hồ sơ nhà ở.
5. Tổ chức, cá nhân đề nghị cung cấp thông tin về nhà ở phải có văn bản đề nghị cung cấp thông tin. Văn bản đề nghị phải ghi rõ họ tên, địa chỉ của người yêu cầu cung cấp thông tin, nội dung các thông tin đề nghị cung cấp và mục đích của việc đề nghị cung cấp thông tin.
6. Hình thức cung cấp thông tin có thể bằng văn bản trả lời, cung cấp thông tin qua mạng điện tử, sao chụp hoặc trích lục hồ sơ.
7. Tổ chức, cá nhân yêu cầu cung cấp thông tin về nhà ở phải trả phí cung cấp thông tin cho cơ quan quản lý hồ sơ nhà ở, trừ trường hợp cơ quan nhà nước có thẩm quyền đề nghị cung cấp thông tin phục vụ cho công tác quản lý nhà nước về nhà ở và cơ quan điều tra, Viện kiểm sát nhân dân, Tòa án nhân dân đề nghị cung cấp thông tin phục vụ cho công tác điều tra, giải quyết tranh chấp, khiếu nại, tố cáo, các vụ án về nhà ở.
Bộ Tài chính phối hợp với Bộ Xây dựng quy định mức thu, tỷ lệ trích nộp ngân sách và chế độ sử dụng phí cung cấp thông tin quy định tại Điều này.
Điều 77. Điều tra, thống kê, xây dựng dữ liệu về nhà ở
1. Điều tra, thống kê về nhà ở được thực hiện định kỳ năm năm và mười năm một lần theo quy định sau đây:
a) Định kỳ mười năm một lần, Bộ Xây dựng phối hợp với Bộ Kế hoạch và Đầu tư và Ủy ban nhân dân cấp tỉnh tổ chức điều tra, thống kê nhà ở cùng với tổng điều tra số và nhà ở trong cả nước;
b) Định kỳ năm năm một lần (tính giữa mỗi kỳ tổng điều tra dân số và nhà ở), Bộ Xây dựng chủ trì, phối hợp với Bộ Kế hoạch và Đầu tư và Ủy ban nhân dân cấp tỉnh tổ chức điều tra điểm, điều tra mẫu về nhà ở tại một số xã, phường, thị trấn của một số tỉnh, thành phố thuộc các vùng, miền khác nhau trong cả nước để thống kê số liệu về tình hình phát triển nhà ở phục vụ cho công tác hoạch định chính sách phát triển nhà ở trong cả nước.
Trước khi tổ chức thực hiện điều tra nhà ở quy định tại điểm này, Bộ Xây dựng có trách nhiệm lập kế hoạch điều tra và đề xuất kinh phí điều tra báo cáo Thủ tướng Chính phủ xem xét, quyết định.
2. Kinh phí điều tra, thống kê và xây dựng cơ sở dữ liệu về nhà ở quy định tại Điều này được bố trí từ ngân sách nhà nước.
Điều 78. Đào tạo, bồi dưỡng kiến thức về phát triển, quản lý nhà ở và thị trường bất động sản
1. Cán bộ, công chức làm việc trong lĩnh vực quản lý, phát triển nhà ở và thị trường bất động sản của các cấp, các ngành ít nhất ba năm một lần phải tham dự lớp đào tạo, bồi dưỡng kiến thức về phát triển, quản lý nhà ở và thị trường bất động sản. Các cơ quan, đơn vị có liên quan đến lĩnh vực nhà ở và thị trường bất động sản có trách nhiệm bố trí và tạo điều kiện để cán bộ, công chức tham gia các lớp đào tạo, bồi dưỡng theo quy định tại Điều này.
Đối với các cá nhân, doanh nghiệp tham gia hoạt động quản lý vận hành nhà chung cư (kể cả các công trình nhà ở có mục đích sử dụng hỗn hợp) thì phải tham dự khóa đào tạo, bồi dưỡng kiến thức và chuyên môn, nghiệp vụ về quản lý vận hành nhà chung cư theo hướng dẫn của Bộ Xây dựng.
2. Bộ Xây dựng quy định về kế hoạch, chương trình, nội dung đào tạo và phối hợp với các cơ quan liên quan, các địa phương tổ chức các lớp đào tạo, bồi dưỡng, nâng cao kiến thức về phát triển, quản lý nhà ở và thị trường bất động sản cho đội ngũ cán bộ, công chức làm việc trong lĩnh vực quản lý, phát triển nhà ở và các cá nhân, tổ chức tham gia hoạt động quản lý vận hành nhà chung cư quy định tại Điều này.
3. Kinh phí đào tạo do các cơ quan, đơn vị cử học viên tham dự khóa học thanh toán cho cơ sở đào tạo.
Điều 79. Trách nhiệm của Bộ Xây dựng
1. Giúp Chính phủ thực hiện thống nhất quản lý nhà nước về nhà ở trên phạm vi cả nước
2. Nghiên cứu, trình Thủ tướng Chính phủ ban hành định hướng, chiến lược phát triển nhà ở quốc gia cho từng giai đoạn theo quy định của Nghị định này.
3. Nghiên cứu, trình Chính phủ, Thủ tướng Chính phủ sửa đổi, bổ sung, ban hành mới hoặc sửa đổi, bổ sung, ban hành theo thẩm quyền các văn bản liên quan đến quản lý và phát triển nhà ở theo quy định của Luật Nhà ở và Nghị định này.
4. Trực tiếp chỉ đạo việc thực hiện chiến lược, các chương trình, mục tiêu quốc gia về nhà ở do Thủ tướng Chính phủ phê duyệt.
5. Kiểm tra, thanh tra, giải quyết theo thẩm quyền hoặc trình Chính phủ, Thủ tướng Chính phủ giải quyết các khó khăn, vướng mắc của các Bộ, ngành, các cơ quan, tổ chức và cá nhân trong quá trình triển khai thực hiện Luật Nhà ở và Nghị định này; theo dõi, kiểm tra việc thực hiện các quy định có liên quan đến nhà ở nhưng được giao cho các Bộ, ngành khác triển khai thực hiện.
6. Thực hiện các nhiệm vụ được giao theo quy định của Nghị định này và theo chỉ đạo của Thủ tướng Chính phủ.
7. Định kỳ hàng năm và theo yêu cầu đột xuất báo cáo Chính phủ, Thủ tướng Chính phủ về tình hình triển khai Luật Nhà ở và Nghị định này trên phạm vi cả nước.
Điều 80. Trách nhiệm quản lý nhà nước về nhà ở của các Bộ, ngành liên quan
1. Các Bộ, cơ quan ngang Bộ trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm phối hợp với Bộ Xây dựng thực hiện quản lý nhà nước về nhà ở.
2. Nghiên cứu sửa đổi, bổ sung, ban hành các văn bản liên quan đến quản lý, phát triển nhà ở theo chức năng, nhiệm vụ được Chính phủ giao hoặc phối hợp với Bộ Xây dựng trong việc nghiên cứu soạn thảo chính sách, tham gia chỉ đạo, hướng dẫn tổ chức thực hiện và kiểm tra, thanh tra việc chấp hành các quy định của pháp luật về quản lý và phát triển nhà ở của các ngành, các cấp, các cơ quan, tổ chức, cá nhân có liên quan.
Điều 81. Trách nhiệm quản lý nhà nước về nhà ở của địa phương
1. Ủy ban nhân dân cấp tỉnh có trách nhiệm:
a) Thực hiện quản lý nhà nước về nhà ở trên địa bàn;
b) Xây dựng và tổ chức triển khai thực hiện chương trình, kế hoạch phát triển nhà ở của địa phương, bao gồm chương trình, kế hoạch phát triển nhà ở nói chung và các chương trình mục tiêu của địa phương về hỗ trợ nhà ở cho các đối tượng xã hội gặp khó khăn về nhà ở;
c) Công bố công khai trên Website của Ủy ban nhân dân cấp tỉnh và của Sở Xây dựng quy hoạch xây dựng tỷ lệ 1/2000 và quy hoạch chi tiết xây dựng tỷ lệ 1/500, các dự án phát triển nhà ở đang được triển khai thực hiện, các trường hợp chuyển nhượng dự án, thay đổi chủ đầu tư và tiến độ thực hiện các dự án phát triển nhà ở trên địa bàn;
d) Lập quy hoạch và bố trí quỹ đất để xây dựng nhà ở xã hội, nhà ở công vụ theo quy định của Nghị định này;
đ) Tổ chức thực hiện quản lý quỹ nhà ở công vụ và nhà ở xã hội được xây dựng bằng vốn ngân sách của địa phương;
e) Xác định danh mục nhà biệt thự để thực hiện quản lý theo quy định của Nghị định này và pháp luật có liên quan;
g) Chỉ đạo, hướng dẫn, tổ chức thực hiện, kiểm tra, thanh tra công tác quản lý và phát triển nhà ở trên địa bàn theo chức năng nhiệm vụ được giao;
h) Tuyên truyền, vận động các tổ chức, cá nhân chấp hành các quy định của pháp luật về quản lý và phát triển nhà ở;
i) Xử lý theo thẩm quyền hoặc đề nghị cơ quan có thẩm quyền xử lý các hành vi vi phạm pháp luật về nhà ở;
k) Chủ trì hoặc phối hợp với các Bộ, ngành thực hiện nhiệm vụ được giao theo quy định của Luật Nhà ở và Nghị định này;
l) Định kỳ hàng năm hoặc theo yêu cầu đột xuất báo cáo cấp trên về tình hình triển khai Luật Nhà ở và Nghị định này trên địa bàn.
2. Giúp Ủy ban nhân dân cấp tỉnh thực hiện chức năng quản lý nhà nước về nhà ở và thị trường bất động sản trên địa bàn là Sở Xây dựng.
3. Ủy ban nhân dân cấp huyện có trách nhiệm thực hiện việc quản lý nhà nước về nhà ở và thị trường bất động sản trên địa bàn theo chức năng, nhiệm vụ được giao.
4. Chủ tịch Ủy ban nhân dân cấp tỉnh và Chủ tịch Ủy ban nhân dân cấp huyện chịu trách nhiệm trước pháp luật nếu chậm trễ thực hiện hoặc không thực hiện các quy định của Luật Nhà ở và Nghị định này.
Điều 82. Ban Chỉ đạo về chính sách nhà ở và thị trường bất động sản
1. Thủ tướng Chính phủ quyết định thành lập Ban Chỉ đạo trung ương về chính sách nhà ở và thị trường bất động sản để giúp Thủ tướng Chính phủ nghiên cứu, chỉ đạo và phối hợp giải quyết những vẫn đề quan trọng, liên ngành có liên quan đến chính sách quản lý, phát triển nhà ở và thị trường bất động sản trên phạm vi toàn quốc.
2. Ban Chỉ đạo trung ương về chính sách nhà ở và thị trường bất động sản có nhiệm vụ, quyền hạn: chỉ đạo, đôn đốc, hướng dẫn và kiểm tra việc thực hiện các chương trình phát triển nhà ở, các chủ trương, chính sách về nhà ở và thị trường bất động sản tại các Bộ, ngành và các địa phương; tham gia góp ý các chính sách lớn, quan trọng liên quan đến nhà ở và thị trường bất động sản; kiến nghị Thủ tướng Chính phủ và các cơ quan có thẩm quyền xem xét, sửa đổi, bổ sung hoặc đình chỉ việc thi hành các văn bản có liên quan đến nhà ở và thị trường bất động sản do các Bộ, ngành và Ủy ban nhân dân cấp tỉnh ban hành trái với quy định của pháp luật về nhà ở và thị trường bất động sản.
3. Căn cứ vào nhiệm vụ, quyền hạn của Ban Chỉ đạo trung ương về chính sách nhà ở và thị trường bất động sản, Chủ tịch Ủy ban nhân dân cấp tỉnh quyết định thành lập Ban Chỉ đạo về chính sách nhà ở và thị trường bất động sản cấp tỉnh để giúp Chủ tịch Ủy ban nhân dân cấp tỉnh chỉ đạo triển khai thực hiện các chính sách liên quan đến lĩnh vực nhà ở và thị trường bất động sản tại địa phương.
4. Các thành viên của Ban Chỉ đạo và Tổ chuyên gia giúp việc Ban Chỉ đạo về chính sách nhà ở và thị trường bất động sản làm việc theo chế độ kiêm nhiệm và được hưởng phụ cấp theo quy định của Thủ tướng Chính phủ. Kinh phí hoạt động của Ban Chỉ đạo do ngân sách nhà nước cùng cấp cấp.
5. Chức năng, nhiệm vụ, quyền hạn, quy chế hoạt động của Ban Chỉ đạo và các tổ chức giúp việc Ban Chỉ đạo ở Trung ương do Thủ tướng Chính phủ quy định, ở địa phương do Chủ tịch Ủy ban nhân dân cấp tỉnh quy định.
Chương VII
ĐIỀU KHOẢN THI HÀNH
Điều 83. Hiệu lực thi hành
1. Nghị định này có hiệu lực thi hành từ ngày 08 tháng 8 năm 2010.
2. Nghị định này thay thế Nghị định số 90/2006/NĐ-CP ngày 06 tháng 9 năm 2006 của Chính phủ quy định chi tiết và hướng dẫn thi hành Luật Nhà ở.
3. Đối với dự án phát triển nhà ở đã được lập và trình phê duyệt theo quy định của Nghị định số 90/2006/NĐ-CP ngày 06 tháng 9 năm 2006 của Chính phủ quy định chi tiết và hướng dẫn thi hành Luật Nhà ở nhưng Ủy ban nhân dân cấp tỉnh hoặc Ủy ban nhân dân cấp huyện chưa phê duyệt hoặc trường hợp đã được phê duyệt (kể cả nhà ở được xây dựng trong khu đô thị mới) nhưng có đề nghị thay đổi một trong các nội dung của dự án phát triển nhà ở theo quy định tại khoản 4 Điều 7 của Nghị định này thì thực hiện lập, thẩm định, phê duyệt, chấp thuận đầu tư hoặc chấp thuận bổ sung nội dung dự án phát triển nhà ở (dự án phát triển khu nhà ở hoặc dự án phát triển nhà ở độc lập) theo quy định của Nghị định này.
4. Bãi bỏ các nội dung liên quan đến phát triển nhà ở, công nhận quyền sở hữu nhà ở, quản lý sử dụng nhà ở, giao dịch về nhà ở, quản lý nhà nước về nhà ở được quy định trong các Nghị định của Chính phủ, các văn bản pháp luật do các Bộ, ngành và Ủy ban nhân dân cấp tỉnh ban hành trước ngày Nghị định này có hiệu lực thi hành mà trái với quy định của Nghị định này.
Điều 84. Trách nhiệm thi hành
Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương chịu trách nhiệm thi hành Nghị định này./.
