1. Amend Clause 3 of Article 9 as follows:.

Tuition fees from the academic year 2023 - 2024: a) For educational institutions that have not yet self-sufficiently covered regular expenses: Maintain stable tuition fee levels from the academic year 2023 - 2024 at the level of tuition fees for the academic year 2021 - 2022 as established by the People's Council of the province and applied locally. b) For educational institutions that have self-sufficiently covered regular expenses and investment costs: Educational institutions shall establish tuition fee levels based on economic and technical norms, cost standards, and submit them to the People's Committee for proposal to the Provincial People's Council for approval."

Article 2. Abolish the following provision
Repeal Clause 3, Article 31.
Article 3. Implementation Provisions
1. This Decree shall take effect from the date of issuance.
2. Transitional provisions:
a) For public preschool and general education institutions
In cases where the People's Councils of provinces and the educational institutions have issued tuition fee frameworks or tuition fee levels for the 2023-2024 academic year in accordance with Decree No. 81/2021/NĐ-CP, with increased tuition fees compared to the 2021-2022 academic year, the local budget must ensure the additional difference compared to the tuition revenue of the 2021-2022 academic year. The support level for each educational institution shall be decided by the locality.
In cases where the People's Councils of provinces and the educational institutions have issued tuition fee frameworks or tuition fee levels for the 2023-2024 academic year in accordance with Decree No. 81/2021/NĐ-CP, with increased tuition fees compared to the 2021-2022 academic year but the local budget does not ensure the additional difference compared to the tuition revenue of the 2021-2022 academic year, adjustments must be made in accordance with the provisions of this Decree.
b) For public vocational education and higher education institutions
Public vocational education and higher education institutions that have established tuition fee levels for the 2023-2024 academic year in accordance with Decree No. 81/2021/NĐ-CP shall review and adjust in accordance with the provisions of this Decree.
c) For educational institutions that have been approved for financial autonomy schemes in accordance with Decree No. 60/2021/NĐ-CP dated June 21, 2021 of the Government on the financial autonomy mechanism of public service units, they may continue to implement the corresponding tuition fee collection mechanisms based on the degree of financial autonomy already approved. In cases where implementing tuition fee collection in accordance with this Decree leads to changes in revenue sources affecting the degree of financial autonomy already approved, the educational institutions shall be responsible for reviewing their income and expenditure, reporting to the superior management agencies for review and approval of the financial autonomy scheme for the remaining period of the stable period as stipulated in Decree No. 60/2021/NĐ-CP.
3. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairpersons of Provincial People's Committees, and relevant agencies shall be responsible for enforcing this Decree./.
